person or persons who opened fire at morgan state university in maryland overnight. five people were shot, including four students during homecoming week. you're watching "fox and friends first," i'm didn't open the campus up until our swat team cleared the building of where we thought the shot came from. they cleared everywhere twice and after that we realized campus was most likely safe and opened it back up because the shooter was nowhere around that we could find. >> todd: is that greater community safe? >> brooke: that is right, the victims are between 18 and 22 years old and thankfully all expected to make a complete recovery. this unfolded last night. it was a large homecoming events on campus. students and families come together each year. urging to stay off campus right now. one student says it happened so quickly he hardly had time to react. listen. >> the bullets hit the glass behind my head. just another day here. it wasn't supposed to happen, but it happened. >> we tried to get out of the way, lay down, run. >> brooke: baltimore police issued shelter in place order as swat teams swarmed the campus. >> swat, federal and local and other jurisdictions came to assist us as we cleared the building to make sure we did not have an active shooter. the scene remains active and we are working along with law enforcement to piece together everything that happened. >> brooke: the active shooter lockdown was lifted just after midnight. the mayor says the city will not stop until the shooters are brought to justice. watch. >> for those who decide to come on this jewel of campus and inflict this pain and trauma on their communities, we will find you. we won't stop, turn yourself in, we will not tolerate this happening here or anywhere else. >> brooke: last year a 20-year-old was injured during a shooting on homecoming night. >> carley: this is so sad. one freshman said i heard a lot of bangs, i had adren lin, but had to stay calm. morgan state is the largest historically black college, by the way. thank you, we appreciate you. police are searching for the attacker seen in this video, who threatened and hit two people at a seattle train station last week. security footage shows the male suspect wearing a dress and swinging his weapon around the city. the victims are a man and woman in their 60s, emphasizing the beating was unprovoked. the suspect yelled, i hate you to one victim moments before the attack. both victims were taken to the hospital, now in good condition. >> todd: the family of -- the sena family praising the police for their work. the aunt saying, we are thrilled she is home and the outcome is not what every family gets. huge thank you to the police and agencies mobilized. volunteers supported us and worked tirelessly to bring charlotte home thchl started saturday night when she took a bike ride with friends. when she did not return, her parents became concerned and called 911 after finding her bike in the woods. police declared her mising, issuing an amber alert. the next day the suspect showed up at the family's house to drop a ransom note in their mailbox. the police were able to lift fingerprints. craig jr. is charged -- a few months ago in july. i told police a man tried to grab my grandson in july and they showed me pictures. i recognized him 100% immediately, i said, that's him and that is frightening because that situation could have ended horribly, the charlotte situation could have. thank goodness for quick action. >> carley: when the mug shot was released, you look at the guy and go, wow, that makes sense. usually when these things happen, you hear from people who notice red flags before and told police. thankfully these things did not end worse than they did. >> todd: raising red flags, if you see something, say something. let the cops deal with it, at least they have knowledge, if there is something sketchy, trust your instincts. >> carley: let's hope this story goes away, you want this little girl to get her life back, take attention off her, so she can get help she needs. the family can gather around her and lead a normal life again. >> todd: i learned this family is tough, strong, a great family. i spoke to patrick cane, a family friend who said this family will recover, just give them time, to your point. >> carley: "fox tomorrow better than today, i fought for what i believe in. i believe in this country of america. unfortunately, 4% of our conference can join all democrats and dictate who can be the republican speaker in this house. i don't think that rule is good for the institution, but apparently, i'm the only one. >> todd: matt gaetz introduced motion to vacate kevin mccarthy on monday night. he is the first speaker in american history to have his gavel taken away. patrick mchenry named temporary speaker, the house is paralyzed until a permanent speaker is elected. this comes, we're doing this again, five weeks before the new government funding deadline. greg gutfeld says the drama in d.c. is a distraction from the real issues. watch. >> greg: it is sad, nobody bothered to bring any clarity to this. if you can't explain or persuade your point without putting people to sleep, you lose. these parties are not mirror images, one wants to win and the other doesn't. they shot themselves in the foot and by foot, i mean head. okay, they broke promises. i had to go find out what the promises were. he promised to use 2022 appropriations numbers as numbers for this year and he didn't. are you angry? he promised not to let bills pass with more dems than republicans, maybe he didn't. are you pissed? i don't know. not to take up a bill with anonymity, he denies the two latter promises. not sure i care, i'm with trump on this. we're talking about this instead of the border, instead of crime, instead of inflation. >> todd: house set to vote on a new speaker a week from today, steve scalise, emer, stefanik, patrick mchenry, he is running the show for now and mike johnson. >> carley: and troy nehls nominated trump to be speaker of the house, you don't have to be a member to be speaker. congressman, what is your reaction, you have eight democrats who joined forces -- or eight republicans who joined forces with all 208 democrats to oust kevin mccarthy. what is your reaction to this and where do things go from here? >> cory: good to be with you this morning. bottom line is that kevin mccarthy knew exactly what the rules were when he came into speaker. he understood what motion to vocate would mean. i agree with the eight with regard to things that may have been promised that were not delivered. we did ask for 12 appropriations, it is important to get that done so we can fund the government and defund the jack smith investigation and things like this. there was many areas, eight as way and hr 2 with security and the border. we were to return to prelevel spending. idea was to cut spending, reform program and make sure we grew our economy and that was not happening. i voted no on both cr's, i do not believe in continuing resolution or setting an omnibus across the table. with theim tooing, we had 12 appropriations bills to finish in 40 days. this may lead to another cr now that you have mchenry who adjourned us for a week. no bills come to the floor, no policies come to the floor. our border remains open. personally if this was going to happen, i rather see it happen after this month, when we scheduled to get appropriations bills done. now we're at a freeze before we get a new speaker in place. we need a good unifying, conservative, constitutionally based speaker willing to meet the mission to secure our border and get our spending under control. >> todd: i understand the argument, let's be realistic, that is in the weeds for the average american. how should the average republican view this? i'm sure to many it looks like you guys, you republicans in congress, took a gift horse of a wildly unpopular president who is going to be on the ticket when all these representatives are up for election in 2024 and turned into the loss of the house majority in 2024. what do you say to the average republican who is thinking that this morning? >> cory: todd, i don't agree with the premise we're going to lose the house in 2024. look at what we've done so far. we passed hr 1, hr 2, hr 5, hr 21, we passed things like the lsu, limit paved gross bill for spending level to pre-covid levels. this was done in the house and the d.c. crime bill joe biden said he would veto. there were good things moving forward, american people see that. we have a senate controlled by two democrats, mcconnell and chuck schumer, we need to acknowledge the fact the house has been doing their job, but we missed key deadlines, that is an issue for me. we should have had our appropriations bills done by the 30th and if not we shouldn't have taken the recess. we are able to legislate and appropriate. >> carley: kevin mccarthy said he will not run again, the top contenders, steve scalise, patrick mchenry, donald trump has been thrown into the mix. >> i would support president donald jtrump, bob emer, byron donalds. he is a great leader. >> todd: i know it was an odd day yesterday, appreciate you being with us. and democrat henry cuellar speaking out after being carjacked in washington, d.c. >> i don't care who it is, people, if they break the law or threaten somebody, carjack somebody, you throw the key away. >> todd: wait until you >> when you think it can't get worse, we go 10 feet lower. crime continues to spiral out of control. this is behavior we know is wrong, unethical and illegal, to see individuals preyed upon, hunted down and attacked, we just had a shoot out in one of the busiest intersection in chicago. only folks like myself and other members of city council are speaking out and calling light to this while progressive and liberal leaders choose to ignore it in hope of sticking to their narrative. in addition to shooting and murder stats, there has been a rise in motor vehicle theft, robbery theft and total crime in chicago compared to last year. we always ask if voters will stop voting for policies that jeopardize their own lives. to that end, you are running for congress, challenging fellow democrat chewy garcia. why are you running as a democrat, if you think this party has abandon you and your constituents? >> i think the democratic party still has something to offer the people of the united states and chicago, if they stick to their core values. this party has been co-opted by individuals pushing us to the extreme. if common-sense folks leave, the democratic party will be socialism running amuck in the united states. we need to stand up and show there are sane democrats focusing on solutions more than politics of the moment. >> todd: when you look at what is happening in chicago, it begs the question, are there any democrats? democrats in the state of illinois, the state of illinois got rid of cash bail, officially gone. that is bad, what that does, emboldens criminals and let's them say there are no consequences, i will walk out if i do something. if they didn't participate and visited chicago, you have to think to yourself, is this the world the democrats want? what do you say about that, raymond? >> it is unfortunate, we see democrats try to make this the public safety partisan issue and i said with you and with many on this network. public safety shouldn't be partisan, that is something we're guaranteed, government to keep citizens safe and democratic party continues to fail that. not in the democratic party enabling gang bangers and criminality, some believe you can support law enforcement and be a democrat and we have to show that is possible. residents of my fourth congressional district are true blue democratic voters and understand there is place for law enforcement and support first responders and want leader to stand up and share in washington. >> todd: it started with administrative and academic focus against law enforcement. you have a long road as democrat to get back to the days of kennedy, see if you, raymond lopez are the start of that movement. carley. >> carley: turn to janice dean for the fox weather forecast. >> janice: are you enjoying temperatures in the southeast or do you feel weird? >> i like it. >> janice: enjoy today and tomorrow, then it all ends. 67 here in new york and you can see we've got a couple cold fronts moving toward north other than plains and upper midwest. some areas in the 90s. double cold front move through and bring us back to reality that it is fall. we go through saturday, will bring temperatures down. risk for severe storms as that cold front moves through the southern plains, including texas and oklahoma, potential for flash flooding in some areas. this is good news story, too much of a good thing will cause problems for the dallas area, texarkana, andshreveport. we will have to watch felipe, and this cold front and how they interact. potential for heavy rain for another weekend for new england. that is the bottom line. this is felipe, the storm has been lingering and now we're watching the track come close to what lee did, maybe swipe of cape cod island and canada. strong tropical storm that could bring impact. >> todd: i was excited early part of your forecast, i was guaranteed pumpkin picking on sunday, now i'm worried. >> janice: sunday in new york, should be okay. new england issue not so much, like northern new england. you have me on speed dial, i'll give you an up to date forecast. i'll let you know tomorrow. >> carley: sounds good. >> todd: a 16-year-old transgender runner in the girls league moving to fourth. one mother here to react. >> carley: the white house wants you to think president biden is cool, some say mean girl inspired post is not. see what joe concha thinks coming up. >> todd: 21 people dead, 18 injured after a tourist bus broke through a barrier and plunged off an overpass in italy and bursting into flames. firefighters searching the rubble for survivors. the mayor offen havis says two kids were killed and four people are fighting for their lives. the city is under a state of mourning, investigating the cause of the tragedy. >> carley: parents in made speaking out about a transgender student dominating high school track. last year the runner was ranked 172 in the boys division and now sits fourth in the girl's division after racking up several victories. catherine collins is a mother in maine and her son and daughter run high school track and she joins me now. cathlin issue good morning. this hits close to home, your children are very involved in the world of track in the state of maine. what is your reaction to this situation? >> it is a matter of unfairness. the men are bigger, stronger and faster than women and a recent statement that was put out by the american college of sports medicine says this is primary difference in performance between men and women. men's hearts are bigger, their lungs are bigger, their muscles, their legses have more muscle mass than women. once a boy starts going through puberty and hormones start kicking in, they become this muscular machine and girls, when they go through puberty, they start aaccumulating fat stores and tend to get slower, rather than -- so boys, it is about 10 to 20% difference, just based on gender in performance. so -- >> carley: yeah. >> the men are just faster and for men who are pretending to be women, competing against girls is unfair. >> carley: i ran cross country very unsuccessfully in high school, when i was breaking 30 minutes for a 5k was good, boys were doing it left and right and some girls couldn't. it is biological difference. last year this student participated as a boy, this year as a girl whochl is making the rules that allow this to happen? >> it is stated boys and girls should be in separate eventing, but there is exception for transgenders. they say unless such participation would result in unfair advantage and obviously there is unfair advantage. they allowed this last year in outdoor track, two boys participated, one podiumed and was moved on to the new england track meet. so a girl was put aside and not allowed to medal and not allowed to participate at a higher level because of this boy. >> carley: that is so sad for her. this is such a tough and challenging situation, also uncharted territory, you want every student to feel comfortable in their own skin and compete in the way they want to compete. the other issue is the girls who are at unfair advantage because of biology and this poor student who didn't place when she could had if this transgender hadn't competed. there is feedback from top female runners, what are they saying? >> they are saying that this is unfair. the only reason this boy did not win the meet on saturday was because maine has some of the strongest female athletes in the nation. the first two girls who finished on saturday, largest cross country race in maine every year, first place winner ranks number eighth in the country and second place is ranked number 15th in the country. if it wasn't for the top-ranked girls who are faster than most girls in the whole united states, this boy would have won the entire girls cross-country meet. >> carley: wow, this is an issue that is not going anywhere. i know it is difficult to speak out on, you are doing so to speak up for your children, who like we said, are very good runners in their own right in the state of maine. we reached out to maine principal's association and have not received a response. thank you for joining us, we appreciate it. did you hear about this? a massive new electric vehicle battery factory in kansas is going to need to run on coal for a while. >> todd: interesting how that happens. bill copley was a coalminer who lost his job over climate regulations, we'll talk to him about it next. there are giants among us. they are the men and women building our navy's next generation submarines. they are giants in what they do because they work in a place where they can grow. where they can learn the skills to build careers as powerful as the beasts they forge. we build giants. because it takes one to build one. >> todd: 75,000 healthcare workers across the united states are expected to walk out today after negotiations stalled with kaiser-permanente yesterday. >> carley: cheryl casone has more. hi, cheryl. >> cheryl: we'll see what happens this morning. looks like this will go on today. it is another day, another strike, following the uaw. now healthcare workers at kaiser-permanente scheduled to walk out today, 75,000, largest on record. california, colorado, washington, d.c., oregon, virginia, washington state and maryland are striking over wages, retirement benefits and working conditions. a spokesperson for the union says kaiser-permanente continued to bargain in bad faith and so far there is no light at the end of the tunnel. we prepare for the largest strike in american history. every healthcare company has been facing burn out. we have had fewer people to help carry the worked for. the three-day strike expected to go through saturday. >> todd: you lived in california, i lived in california, kaiser-permanente is huge, most people get their healthcare from kaiser-permanente. this is a huge deal. >> cheryl: it will be certainly. remember that think about patient care. there has been a lot of talk about, they have contingency plans to make sure hospital patients and critical care recover. i want to make it clear, healthcare workers are not walking out on the patients, they are walking out on the company and the company is prepared for the next three days. >> todd: battery plant being built in kansas may actually run on coal. require 250 megawatts of electricity to operate, that is what it takes to operate a small city. >> carley: a coal miner joins us now. what do you think of this ev factory that could be running on coal? >> good morning, thanks for having me on. it is one of the bright spots that i've started to realize could come from electric vehicles, not having the type of structures and things we need to run these kind of cars for our grid. coal is something that is reliable and something plants can look to. honestly, if they are going to pass along rate hikes and burdens to individuals in states, it is very similar to what happened to us with the epa, under the obama administration. coal was one of the largest employers in our state. you take away jobs and you are struggling to find ways to pay your bills. they say, we're going to raise your rates that you already can't afford. >> todd: we cannot overstate the irony. in order to build the plan the new green dealers, that is the electric company will have to stop plan to get rid of burning coal to create that energy and the people who use residential energy, you know, like you, me, everybody, they will have to pay for it all. i thought joe biden said coal was dead. listen to joe. >> president biden: no one is building new coal plants, they can't rely on it. it is goes to become wind generation and all they are doing is going to save them a hell of a lot of money issue using same transmission line that transmitted coal fire electric on. we will shut plants down across america. >> todd: in light of what happening in kansas right now, how do you respond to joe? >> obviously it doesn't look like wind is our future, looks like we'll continue to rely on coal. coal has proven time and time again, we need good, reliable energy sources. we can be pushed to the back burner for so long, eventually we get brought back to the front, they know they can depend on us. west virginia is a great example of a state that we are primed and ready for these type of manufacturing jobs, as well, but again, it's hard to say we're going to have to raise our rates and increase prices to individuals. it is hard to welcome in industries if it is going to bring burden in on top of the citizens. >> carley: real quick, what is state of the coal industry like right now?
