it's over, kevin mccarthy has been ousted as speaker. the house taking away his gavel in a vote of 216-210. the house is now in recess, so the democrats and republicans will meet separately to discuss who they want to have as speaker. the effort being led by florida congressman matt gaetz who is fuming over out of control spending and claims mccarthy has broken promises. lawmakers duking it out all day over what kevin's fate should be. >> think long and hard before you plunge us into chaos because that is where we are headed if we vacate the speakership. >> chaos is speaker mccarthy. chaos is somebody who we cannot trust with their word. >> we need a speaker who will fight for something, anything besides just staying or becoming speaker. under speaker mccarthy leadership our house republican majority has defied all odds and over-performed expectations again and again and again. >> this chamber has been run better, more conservatively, and more transparently under mr. mccarthy furious. first of all we are without a speaker. this is historic. something like this hasn't happened in well over 100 years. now what we've got is total chaos when the republicans are playing out their infighting on national television in a historic way instead of fighting joe biden's policies. the one time we are up in virtually every metric as it relates to the biden administration, you've got the republicans going out there and showing how dysfunctional they are as matt gaetz engages in fundraising. i've got to tell you something. i'm furious. there is no question this is something they have been trying to do for almost nine months that mccarthy has been speaker. the truth is they have done a lot in congress. they have got a lot of bills passed, the fact that the senate doesn't want to take them. they've done a lot in terms of oversight. now you've got the democrats, this is the crazy thing, democrats who hate the maga republicans are joining with the maga republicans to oust speaker mccarthy. this is like the devil is in the middle of all of this chaos and donald trump is right. why are republicans fighting with each other like this? >> chad pergram is telling us they might not even meet tonight, they may meet tonight, it is all in flux. >> greg, you've been following this closely all day. your thoughts? >> yeah, the thing is i have to leave because they need a speaker, so i just got a call from matt and we are going to meet for lunch. >> at his place? >> yeah, over at his place. it is kind of sad because nobody bothered to bring any clarity to this. if you can't explain or persuade your point without putting people to sleep, you lose. these parties, we realize, are not mirror images, one wants to win and the other doesn't. they shot themselves in the foot and by the foot i mean head. they broke promises. i had to go find out what these promises were, right? he promised to use the 2022 baseline numbers as appropriation numbers for this year, and he didn't. are you angry? he promised not to let bills pass with more support by dems than republicans. maybe he didn't. are you pissed? not to take up a bill with anonymity on the house rules committee. he denies making the two latter promises, so who is telling the truth? i don't know that i care because i'm with trump on this. i mean we are talking about this instead of the border, instead of crime, instead of inflation. every time the republicans implode, you just give the democrats more cover then jerrold nadler's underpants. we have serious issues right here, and instead of uniting and fighting for the people of america who can sense that this country is going in a really bad direction, we are doing this. i get it, it's a historic event, but it's one of the few historic events that i don't care about. this has no effect on our viewers. does it make our streets safer? no. does it make our borders real again? no. does it make our gas prices go down? no. it is just sound and fury confidence. i get -- my sense is, this was a personal thing. it's a personal thing that's being acted out publicly. you know what, it's kind of pathetic, but that's my opinion and i'll said he wouldn't do. what does katie p say? >> nancy mace voted to oust speaker mccarthy which i think was surprising to people who were watching. she said it was because about trust and keeping your word. matt gaetz is arguing that he was lying, that he didn't do what he said he was going to do, but it's a five seat majority and matt gaetz is sitting in a safe seat in florida. when you have a number of republicans who are in biden districts, if you want a majority to win, you have to have a majority, and you have to win by a lot to get your full agenda through. the republican party looks like they are out of commission. donald trump was in court unfairly or not. today you have this happening, republicans ousting their own speaker in front of the world. they have no plan right now to replace the speaker of the house which means they can't move their agenda forward. i was talking to a friend who works on capitol hill, on the senate side, and he said the stars are finally aligning with mccarthy's office to get a border deal done. that is dead in the water now. they can't move forward with that right so there they are. if ever there was a time to pull the fire alarm. i can't believe they ousted mccarthy before they ousted bowman, but i guess that's where we are. >> we don't even really need to hear from you, jessica, but since you're on the table, go ahead. rub it in, five seat majority. that is the same number that nancy pelosi had and she managed just fine. nothing like this ever happened when nancy pelosi was in charge. the judge is correct in that they are squandering an opportunity. today gallup released their economic poll data and republicans have the largest advantage on who's better to run the economy since 1991. this will be the cycle for i don't know how many days, especially if they go back and meet with their caucuses tonight. there are 18 republican congressmen and congresswomen in districts where joe biden won. those people voted for divided government. they say we want him in the white house, but we want to make sure we have republicans in control of congress. this signals they made a big mistake. mccarthy has no one to blame, but himself. obviously matt gaetz has his own agenda et cetera. but kevin mccarthy decided he should go on "face the nation" this weekend and lie about how that continuing resolution got cut over the weekend. he tried to blame the democrats. they push back and they said no, they saved your butt like they did back in january. it's being reported if he wouldn't have done that there would've been democrats that would have shifted over and supported him to keep him in control. it was a big big mistake that he did that, squandering that opportunity to hold onto the speakership for a few more months. yeah, nancy pelosi, hats off to you. >> it's easy to hold the line when you're a democrat because you just want to spend trillions. republicans don't want to spend that kind of money. >> there democratic congressman henry cuellar carjacked at gunpoint in our nation's capital while he was parking his car. >> i was just coming into my place. three guys came out of nowhere and they pointed guns at me. i do have a black belt, but i recognize when you have three guns, looked at one with the gun i felt one behind me, so they said give me your car, i said sure. you have to keep calm in those situations and they took off. they recovered the car, they recovered everything. what got me upset was they took my sushi, but that is something else. and they did recover the sushi after all. the message is simple, you've got to support law enforcement and i've been doing that for a long time. >> jesse, you will talk to congressman cuellar tonight and peter doocy grilling the white house on crime and what may be one of his best questions yet. >> so if president biden's policies are helping bring crime down, would he be comfortable with somebody borrowing his corvette and parking on the street overnight in southeast dc. >> i'm not going to get into hypotheticals. i'm going to get into what this president has done. >> if a member of congress is not safe on the streets of the nation's capital, who is? >> there will always be more work to be done, but the fact is the president has taken action. >> greg, i'm glad that congressman is safe and he wasn't injured, but we are talking about this more than the media is talking about it because it was a congressman. they didn't talk about the afghan interpreter who was killed recently in a carjacking. >> there are so many crimes like this every day, and you know, these are the ones that make the press. i feel like we don't do a service to the public by coming out against crime, because when we do then the left defends the crime. from now on i'm pro crime and i think carjacking is valuable because it reduces the carbon footprint. >> that might hurt your speakership >> it is kind of sad because it doesn't seem like the consequences matter. la is doubling down on basically cashless bail. it's basically getting rid of bail. this is after all the horrifying visual examples of what's going on in california that they are still doing this. it makes you think maybe this wants that to happen because it subverts society and culture. this is a punishment that we have so richly deserved. i feel like this is like you know how addicts have to hit the bottom before they realize they need help. is that what we are waiting for? we're waiting for cities to hit rock bottom or the people who run the cities to hit rock bottom before they ask for help and everybody else we have to painfully watch what's going on and see the collateral damage and waiting for them to wise up and actually abandoning their sunk costs and their ability to admit they are wrong about this, which may never happen. they refuse help. they could turn to people and say we need help, but they won't. >> judge, greg brings up a good point about hitting rock bottom. washington, d.c. isn't any city, it's the nation nations capital the place for every american and people from around the world should be able to come and be safe and it's not. yet congress is sitting by, they have the power to do things about this, and they haven't done anything. >> i remember when the dc council wanted to pass a bill and fortunately, the bill was passed. initially there was a movement they were saying there wasn't that much crime in dc. dc is a mess. buildings are boarded up. it's not the same dc i remember from five or six years ago. the interesting thing about what the congressman said, and want to be clear i like henry cuellar. i like the fact that he's honest. i like his take on the border. i like what he talked about. one of the things that bothered me is what he said. he said our leader hakeem is there, catherine clark, a whole bunch of members live in that area. so what? you're talking about the privilege. here talking about the protected. you're talking about the people who will always be able to go out and get another car, always be able to go out in public. they don't talk about the people the public that is frozen in fear, the elderly afraid to come out of their homes, the women who have been attacked who are afraid to even go out. none of that is being talked about. look at all of us important people. nobody cares about that. the bottom line here is that until we get rid of cashless bail, and i want to bring in particular the arsonist in san francisco who put lighter fluid on a storekeeper and lit him on fire. he has third-degree burns which are the worst burns. i have seen burn victims for 30 years and it is the most painful injury you can have. yet this guy had outstanding warrants and nobody has picked him up. it is time not just for the police to be refunded and funded again, it is time to get rid of the prosecutors who don't prosecute crime. by the way, the prosecutor in the jurisdiction where the guy burnt -- the arsonist burnt the storekeeper, she didn't exercise any effort to execute the warrants on that guy. the woman with the two kids in the car in philly is being -- forget about the damage to the car. those two kids will suffer posttraumatic stress from seeing their mother victimized, seeing a gun and seeing their car destroyed by a dirt bag. they're all dirtbags and they have to go back to jail. >> i know so many people that have been victimized by crimes in the cities that i need another hand to count them. jessica, there are no deterrence for these crimes at all. it's interesting that washington, dc, san francisco help a lot of gun control for people who want to go to work, yet these guys show up, teenagers with guns and hold them hostage and sometimes they shoot and kill them. that's not working out so well. no self-defense for the citizens. >> i think it's making a lot of people consider their choices. we have seen people moving, that's for a whole host of reasons. but we talked about this many times. these are not constituents who identify with this branch of liberalism or whatever you want to call it. this is not anyone's utopia. this is not what we thought leadership would end up creating. maybe that means that some mistakes were made in terms of people who were voted for. i know there are a lot of people here in new york city with buyer's remorse. they obviously had the recall in dc. but the real crime in all of this is the majority of the people who are committing these crimes are folks that we know who they are. there is some crazy stat like two thirds of petty crime that is committed here in new york city are a small group of people that are just coming in or going out or they're not even being taken in. like the judge was saying with the arsonist, a lengthy record. i would doubt anybody doing something like this whether they are teenagers up to 50 years old hasn't done something before hand. there should be some kind of policies or some kind of nationwide movement or it's like go down the list and go find these people even. bring up what has happened. we know a lot of people in dc -- obviously you live right there. i think it's really sad and am glad for the congressman is okay, but it has to change. >> the majority isn't putting these guys in jail. jesse, it seems like virtuallity meeting reality, but not enforcing these crimes. >> i'm just glad that the carjackers are okay because cuellar apparently knows a good karate chop and they really skated. they are never going to do anything until this keeps affecting the politicians. remember paul pelosi? he got hit in the head with a hammer in san francisco by a guy that should've been deported or institutionalized. they still didn't do anything. now these politicians are getting jacked and robbed in dc. it's probably going to take a senator for them to do anything. remember during the blm riots, it was okay if they got charge but their place of business, don't set foot in their business but those that you in solitary. the democrats in dc, in the house voted to weaken carjacking penalties so they own this. you know who else owns this is the parents of these carjackers. the government can only do so much. right? we have to hold people responsibility. where's the dad, where is the mom, where are the neighborhoods? you guys have unleashed a ring of hooligans onto the rest of society and everybody is talking about laws this, you got -- what about these people that are not being raised properly and they tiptoe around race, they tiptoe around the family. that democrats have to start speaking the truth because they are the ones afraid of having this conversation. we are not afraid of it on "the five," but they are and until we have it, it will keep happening. >> speaking of crime, hunter biden before today on felony gun charges and he had to take a drug test. what happened is up next. ♪ ♪ >> hunter biden showing up at a delaware courthouse with a freshly shaved head and officially pleading not guilty to three federal gun charges. the court laying out the rules for the road for conditions of his release. hunter has got to get a real job, tell the court if he is going to leave the country, and he can't have a gun. and he also must submit to random drug testing. could be the reason for the haircut. speaking of which, he apparently passed one recently. team hunter said he was wrapping his defense around the second amendment that puts him at odds with his dad's desire to crackdown on guns. >> if you willfully sell a gun to someone prohibited from possessing it, if you willfully failed to run a background check, if you willfully falsify a record, if you willfully fail to cooperate with the request of inspections, my message to you is this, we will find you and we will seek your license to sell guns. we will make sure you can't sell death and mayhem on our streets. >> you know, katie, critics will say where are the second amendment advocates out to protect hunter biden, but they don't understand lawful gun owners. lawful gun owners follow the law and would be just as hard on hunter as they would be anybody in their family. >> exactly, they don't want this kind of stench on them. they don't want to have to shave their heads when they go to court his lawyers could have a case actually. there was a case in august where the federal appeals court ruled that a guy that brought my case against the federal government when he was charged with a felony for having marijuana in the car with the pistol that was unconstitutional and the appeals court agreed with him. he might win on this, that's true, but the hypocrisy is incredible because joe biden has been wanting to throw up millions of americans into prison for simply having a piece of plastic that goes on a firearm and without any kind of due process at all and going around congress and the law. so when it comes to everything joe biden has said about crime, about drugs in the 1990s, he wants regular law-abiding americans to, he has none of those expectations for those son despite it being all over his laptop. but what is the job going to be, dog trainer? >> he could teach painting at a local school. >> he's a gross painter. he spits through a straw. >> you know, judge, is the haircut just a haircut or is there something else going on? >> you know, we have known hunter for a long time and we've never seen him with a buzz cut, so i happen to think that he is now represented by an attorney who knows full well that you can pee in a cup, they can test your blood, and lots of drugs will move very quickly through your system. the part of your body that drugs don't move quickly through is your hair. i was a narcotics judge for over a year, so i would mandate that certain defendants be tested by their hair. now, the hair maintains the drug for a significant period of time even for years depending on how long it is, depending on the toxicity, and how concentrated it was and how much it was used. by his having a buzz cut, when they go to pull a hair, they are not going to have sufficient amount to be able to test so that he can be clean in a urine or a blood sample because there is some marijuana they can go in and out of your system in a matter of two or three days, but the hair, you could also take pubic hair, but we know from the laptop that he happens to take care of himself in that way. so what we've got is a guy that was very savvy about drug testing and doesn't want there to be any evidence about it. i have to tell you the truth, that's what goes on in real courtrooms. let me tell you one thing. he can maybe, based upon that federal courts get away with one count, but he can't get away with the other counts. he lied on the application and he lied when he went to buy a gun. the other thing i think is outrageous is that he supposed to communicate his international travel plans to the judge. really? why is this guy being allowed to travel internationally? shouldn't he be registered as a foreign agent before he does that? it's just a sad commentary on all the favoritism he has gotten. >> jesse, i'm not sure how it affects people who have somebody else's hair on their head, so you're safe for now,. >> i got this, the guy got this from never touch the stuff. i know watch the video closely enough. >> you've got to open the laptop. >> that is cutting-edge stuff. so what is still relevant to all of this is that people don't get prosecuted for this. data again, under 300 people prosecuted for falsifying documents to get a gun out of 25-30 million people they got background checks the year that hunter biden got this gun. katie is right about the case in appeals court, but it seems like the supreme court decision in 2022 new york state rifle and pistol association versus bruin is going to bring this up with the use when they bring this up saying that there was no historical tradition of firearms regulation when it comes to people who were drug abusers. it should be noted as well there is discussion of applying this case to people who were domestic violence abusers in the past. i am firmly on joe biden's side about all of this. i don't want people who are high, i don't want people who beat their wives, girlfriends, whatever to have access to guns, but you've got to admire it, flip the script. >> should he be prosecuted? >> they don't usually. >> no, no, no, they do. how many of those people lied on the application? that is the issue. the issue is not how many people filed and got pistol permit, how many lied? it's a local issue. is not a federal issue. the feds don't get involved in something unless it is. >> if there is no other and nbc say there were wmds in iraq. didn't all these network say covid didn't come from a lab, so his side does not have a monopoly on the truth. the internet doesn't either, but it allows access to information to regular people, just like the protestant reformation with the printing press. all of a sudden the catholic church can't say what's in the bible because everybody can read the bible for themselves. so they splintered off and form their own church. the same thing is happening now the mainstream media is the filter and whatever happens, we don't need to filter anymore because we can go before. >> that's true. you can't underestimate how dangerous what they call the censorship industrial complex with the government and private industry actually is, and the biden administration continues to try to take factual information and bury it. we don't have enough time to go through the list but think of all the things that the government censored during the covid pandemic, about the border, about the war in the past, that has resulted in these huge consequences for the country and for people everywhere. you have a president who is now continuing to advocate after a court has told him your agencies are not allowed to talk to big tech because you're censoring americans and violating their several liberties with the first amendment. he wants to continue to do that despite being told no multiple times, and that is why it's so essential that people like elon musk are out there with these big platforms and allowing people to disagree and have a debate about information published. >> don't you agree jessica that the public is entitled to hear what people have to say, that the first amendment is pretty much absolute except for things like pornography and yelling fire in a crowded theater. >> i do, but also these social media companies are private entities and it's about government censorship and there have been republican and democratic that have worked in tandem with the social media companies. >> but the court has stopped them doing that. the court has said to the biden administration, "you can't tell private companies what to say and what not to say." >> they would argue that they are just referring -- they're giving their opinion. >> they lost. >> and it's being evaluated. i still remain uncomfortable, and we've talked about this before where there is covid vaccine misinformation. i will use the bronny james example again who successfully gone and had surgery to fix what was wrong with him, which was not that he had the shot, it was that he had a pre-existing condition that affected his heart. people immediately took that and ran with this because of the vaccine. elon musk has also dismantled the trust and lessened safety information at reported people. sometimes i get up on a saturday morning, and you know i would love to get people thrown off twitter, so i send in, you can post and say this has misogynistic comments, it has violent comments, it has anti-semitic comments and there is a steep increase in saying no, this is all fine. i can tell you it's not fine. >> you wake up on saturdays and report people on twitter? >> if i'm having a good day. >> go ahead, greg. >> i think it's perfectly fine to complain about the media and social media platforms, that's all i do all day. trump built his legend onto words, fake news. this is differentness because it's like combine agencies and law fair to back up their desires for censorship. they want to control the spigot they're suing elaine musk right now because musk is un-cancelable. he's the world's richest man he can't be bought. he is fulfilling a role necessary right now because anybody else would be destroyed. the whole point of the misinformation bureau was to relabel dissent as somehow dangerous. i do emphasize with you about the stuff you get and your example of the covid misinformation, that's just part of the package. you're either going to have free speech or you're not. you can say that these are private companies, but if you were removed from one of these companies, your career could be destroyed. these are giant companies. threr are things that people make their livelihood off of. if you're banned from twitter, you could disappear. they say why don't you make your own, why don't you make your own, well good luck, but my point is this, this is about targeting people who are different in their views. and the fact is, elon musk presents a threat because he is not a liberal. that's it. >> but shouldn't these people not post
