tonight. fox news alert, #-year-old girl who v vanished while on a campig trip with her family has been found alive. this is great news. we will have all the breaking news in moments. first, the real frauds. that's the focus of tonight's angling. ♪ >> laura: now, you may have heard that there is a legal case playing out in new york involving the g.o.p. presidential frontrunner. but the real fraud here doesn't involve overvaluing assets. the real fraud is what we witnessed from new york officials in that courtroom today where right off the bat the presiding judge, democrat arthur edge i don't know if allowed cameras in the courtroom just long enough for them to captured his famed surprise and up close his beaming smile it was weird. and then the fraudulent display continued outside the courtroom, with new york attorney general letitia james tried to publicly cleanse herself of the appearance of bias. >> no matter how powerful you are, no matter how much money you think you may have, no one is above the law. and it is my responsibility and my duty and my job to enforce it. >> laura: what we're seeing occur in real time is a rampant abuse of official authority in order to advance a political vendetta. and with ms. james, this was evident way back in 2018. >> i'm running for attorney general because i will never be afraid to challenge this illegitimate president when our fundamental rights are at stake. the days of donald trump are coming to an end. >> i look forward to going into the office of attorney general every day suing him, defending your rights, and then going home. >> laura: if only. well, of course, the real point here is if a trial like this is allowed to proceed, who is going to defend the people against the likes of her? the woman is just another vicious partisan hack trying to compensate for her lack of talent with an abundance of political vitriol. instead of being elected state a.g., she should have been sanctioned by the state bar for those comments. now, this entire trial is a fraud, because to ms. james trump is just a political stepping zone, first from obscurity to a.g. and if she gets a conviction from a.g. to the governor's mansion or the u.s. senate even. would she have ever pursued such an idiotic case against a rich, politically powerful democrat? of course not. because it wouldn't have helped her professionally. yet, she thinks the rest of us are as stupid as she is. and so she tries her best elliott impersonation. >> donald trump and the other defendants have committed consistent and persistent fraud, justice will prevail. >> laura: of course justice from ms. james is whatever the far left demands. she doesn't just want the judge to find him guilty of fraud. they want to drive donald trump and his business out of new york completely. think about that. and then they want to force him to sell his real estate holdings. now, in real estate, this is the equivalent of putting someone in stocks. and his own public remarks, trump called out the fraud within the state, the federal, and all of the judicial system. >> the crime is against me because we have a corrupt district attorney but we have a corrupt attorney general and did all comes down to the doj. they totally coordinated this in washington. because i'm leading. i'm the leading candidate. >> laura: of course, the timing of the trial speaks to the real goal here to keep trump off the campaign trail. >> sitting in the courthouse all day long instead of being in iowa, new hampshire, south carolina, or a lot of other places i could be at. this is a horrible situation for our country. it's never happened before. it's election interference. they are interfering with the presidential election of 2024. and the people of our country see it. >> laura: we'll examine the legal weakness of this case in moments. along with the obscene $250 million fine being sought. but the ongoing damage being done to the credibility of our legal system, that cannot be understated tonight. not that they care. they don't. they are too busy salivating over what they sees a their death by 1,000 cuts way of defeating trump in 2024. >> so an unprecedented spectacle in new york today. >> it is also pretty easy to see why crump is so unhappy about this trial in addition to the embarrassment, it hits at the core of the very identity that he has built up. >> he looks weak, whiney, the grumpy smurf thing pouting ha rumping his way around court. >> what selfish silly people. what we are see something a destruction of many people's faith in the system this cases isn't about donald trump. this case is about who gets to make the big decisions about plutocratic donors and wholly owned media, democracy means rule by unelected democrats who agree with the democrats. >> you they will still attack you as a bad person and do whatever it takes to beat you. but, they won't try to destroy you destroy or your family. if you try to take real power away from the democrats, they will try to destroy your life and even put you in jail. they are going to keep doing it until they are beaten so badly that they have no choice but to back down. let's hope for the country that that happens in 2024. and that's the angle. joining us now delighted mollie hemingway, fox news contributor and editor and chief of the federalist. david schoen former trump impeachment lawyer. i will start with you on the legal case here, which i find extraordinarily weak. what do the people need to understand in layman's terms about how lame this is and how dangerous this is? >> let me focus on the danger of it because you have hit the nail on the head with that and with the word extraordinary. this case is brought under new york executive law 6312. it gives the attorney general a politically partisan elected official and in this case extremely partisan, incredibly broad powers to ruin a life, ruin a career, et cetera. then the case is assigned to a trump-hating judge, also politically appointed. politically elected and if you read a news article that appeared this weekend, he has shown a consistent antipathy against real estate developers during his entire career. now, many people say why is the judge deciding it, not a jury? the judge said earlier today that that's not his fault, no one asked for a jury trial. that's a good disingenuous. it is true that president trump's lawyers could have asked for jury trial under 4102 of the new york cpr. there is a grace 2011 that said under this executive law, 6312 there was no right to a jury because it's equitable. asking for injunctive relief not damages. that's simply not true. they are talking about stripping donald trump of hundreds of millions of dollars, taking away a brand that's not just a new york brand. it's an international brand. but today at least it seems the judge finally got a clue on what is going on here. because they tried to take things back to 2011. the court of appeals said nothing before 2014. so we will see how it plays out. you are right. it's extraordinarily dangerous. >> laura: yeah. well, the appearance of bias and just corruption in this entire proceeding, mollie, to keep on this issue for a moment, last night on "60 minutes," attorney general garland denied that there is any -- even a whiff of bias in these prosecutions. watch. >> we do not have one rule for republicans and another rule for democrats. we don't have one rule for fauxes and another for friends. we have only one rule. that one rule follow the facts and the law and we reach the decisions required by the constitution and we protect civil liberties. prop began da in would you have about merrick garland. >> merrick garland is participating in a democrat campaign strategy of indicting trump all over the place in the hope they can get quick convictions and interfere with the elections objectively true participating in this democratic campaign strategy. they said they don't have one rule for one group and another for another. look at the hillary clinton situation when she was secretary of state, not president, when she mishandled classified information shrks when she obstructed the investigation they came up with an entirely novel legal standard to let her off the hook and then meanwhile go after president trump or hunter biden, they are still trying to deny that is even hunter biden's laptop. >> at the same time that it's so absurd to say it's not two standards when we are living flew every single day and flippant response. >> complete propaganda piece for the doj. and it's so nice that it's so even handed. >> a real threat to the republic what we are going through. people have lost confidence in our department of justice. that's a very serious problem. the fact that donald trump is doing so well not just in the republican primary but even in head-to-head matchups against joe biden shows that the american people do not view these indictments as legitimate. >> laura: that's the damage they have done. the damage fauci did, david, to the public health system in our country and everything we had heard about the pandemic, now that was called into question. and now they are doing the same thing with the doj. but mueller's former buddy andy wiseman he doesn't believe trump has a defense in this case. watch this? >> in many ways this trial is over. the judge has already ruled on the first of the claims against donald trump and his sons and his businesses. he has already lost with huge financial consequences the judge has imposed. >> david, you could sense the glee coming from that odious creature's voice. your response? >> i don't credit anything that andrew weissman says. i have had experience with him. he is the most ethically bankrupt prosecutor i have ever personally ever dealt with in my view. i don't cred anything he says. this judge has usurped the role of experts in this case. the judge lost all credibility which he said mar-a-lago should have been vau valued at $18 mil. he left off a few million dollars. there is not a few. overvalued on stated value that just one example. back to the timing, you mentioned in your opening monologue. that's what proves the point. donald trump has been for decades. built his brand around the world. it's not coincidental that this case is brought with the four criminal indictments that are now brought during election season. there is nothing coincidental about it. it's all intentional. we see all of the rules suspend you had. there is case law, ganz ler case and others that say a prosecutor can't speak this way to influence the public all of the time. they get -- this attorney general james and the district attorney in new york have gotten away with anything they want to say and then they, you know, scream bloody murder and want a gag order. they put out these speaking indictments in the cases. >> laura: trump can't speak. they never shut their mouths. mollie, it's staggering. >> all based on this belief that donald trump needs to have not just his own income but the income of all these different people in his family destroyed because they politically disagreed with him. that's not american. >> laura: he doesn't deserve to have a company or address in new york. they want to drive him out of new york city and drive him into bankruptcy and then put him in jail so he can't become president. this is crazy land. the people are on to this. great to see you both. fox news alert, moments ago, fantastic news, 9-year-old charlotte sena who vanished while camping with her family in upstate, new york has been found alive. fox news molly line is live from wilton, new york with all the details, mollie? >> laura, just the best possible news at this point in time 48 hours into the investigation, we are getting word from the new york state police that charlotte sena has been located and is in good health. a suspect is in custody. they say this is still an active investigation. they will be releasing more details when they come. i also have word that her family is on the way to reunite with charlotte. so tremendous, enormous good news at this point in the investigation when sometimes things can look very grim. hundreds and hundreds of people have poured out everything they have. have hit the ground here in this area of upstate, new york to search swamps and waterways. some 400 search and rescue personnel. the new york state police, fbi, mountain rescue teams. all out there in the forests have been looking for her since saturday evening when she had gone out on this bike ride at 6:15 p.m. with friends with children that she knew. she. ed to take one more loop around this campground that she was staying at in the morose state park here in this area of new york when she disappeared within 15 minutes her family was looking for her. 15 minutes later they find that bicycle. her mother calls 911. and in the best possible outcome, charlotte is found alive. a tremendous outcome at this point in time. the governor was up here giving a press conference yesterday. state police. they talked about all of the assets that were being poured in and we have watched them arrive throughout the day and disperse bus loads and bus loads of people. 34 different volunteer fire agencies involved in going through this really thick brush and wood and water lands and one of the things the governor said in the press conference yesterday, she talked with the communications they were analyzing. in that time, around the disappearance and the very beginning of this investigation we know those first minutes and hours can be so critical. and we don't know specifically, what led investigators to this suspect or what the specific charges will be. we're waiting to hear that. but the best possible outcome at this point in time that charlotte sena has been found alive. the amber alert has been canceled. laura? none of them, none of the four were born in california. now, at least adam schiff and barbara lee moved there as children and they both went to college there. so i'm kind of curious if schiff and lee are going to make it an issue against her if she decides to run in 2024 that butler is not really a californian. moved their later in life and moved away. she is a ping-pong ball. now she is back. >> laura: chris? >> this something i'm envious the gavin newsom and the democrats right now. i wish republicans could take a lesson on how vicious this is. senator dianne feinstein has been dead for 24 hours and they appoint a black lesbian who is devoted her life to killing babies in the womb. so say what you will. they please their constituents. they take care of their voters. and take care of people who give them money. look at republicans who do we get? you know, if you are a u.s. senator, you need to wait two years before can you become a lobbyist. now we can have a lobbyist who can immediately become a california senator. and in this case you have somebody who is a lobbyist who believes in abortion right up to the day before the hour before birth. that's what emily's list does. the group that she ran. they are the most radical of the pro-abortion groups that are out there. but that's in tune with the modern day democratic party. smarry abortion candidates you get senator butler. >> laura: the possibility that democrats such a whole on the border question that there would be some movement or some perhaps policy tweak on the part of biden that they could point to as oh, we're hearing you. we are addressing the problem. and, yesterday's, i believe it was yesterday, hochul spoke out and i want to play this soundbite about what democrats are doing on immigration. >> we want them to have a limit on who can come across the border. it is too open right now that is a real problem for new york city. 125,000 newly arrived individuals. and we are being taxed. >> laura: chris, i mean, they can't take anymore, they say he. they want all to go to south dakota, north dakota, montana all the red states. >> what they meant -- she was fame -- infamously emily lazarus rest's pony poem at the bottom of the statue of liberty saying new york is open. what she meant by give us your poor and hungry. she meant give texas, give mexico, give anyone except for us. illegal immigration is an easy thing to stand on the' soapbox about. right thing what our built on et cetera et cetera. much more difficult than the reality on the border. that's why we had elon musk going down there and livestreaming from the border. you had reporters from other networks saying how dare he go down there. how dare he? is he a citizen and people are lying about what going on there the reality being felt in new york. on the way to the studio today there was an obvious biker gang hanging out of what used to be the d.c. homeless shelter. clearly all new illegal immigrants. whole face of the city in that area is starting to change even washington, d.c. it's being felt in the blue cities. >> laura: the penal are now making their voices heard. ari, maybe a few years ago people didn't think this was going to bubble up to become one of the sen mall issues of 2024. i think that's changed. i think people feel the change. i think people don't want it and they said we didn't vote for it. this is not what we thought. meaning kind of mainstream democrat voters that they were going to get when they voted for biden. >> actually, laura, you, of course, you were at the forefront of that. you were one of the people who did see that very early in a republican party that was changing on this issue. it's absolutely right. it's a moral issue. i mean, either we are a nation of laws with borders or we are not. and the democrats have lost the ability to make a moral distinction between someone who comes here illegally and legally. to them, it doesn't matter. to most americans it does matter and that's why this is assailant issue. >> laura: 8 presidential people probably 14 million. quickly gaetz challenging mccarthy for the speakership. >> newt gingrich pushed back really hard over the weekend on social media saying this is a self-inflicted wound on the part of the republican party. agreeing with gaetz on the spending issue but saying you don't have the votes yet. so what is this ultimately going to accomplish? your view? >> i'm not too sure it's going to accomplish that much. there is a lot of real principled opposition to mccarthy. go someone like chip roy. what is going on between mccarthy and gaetz seems like a personal grudge. >> laura: thoughts on that quick? >> i think it's nihilistic. i don't know what they seek to accomplish. whoever is going to be the next speaker they are going to try to vacate that person. anybody who has to make any agreement or compromise, they are against. you can't vote with a five vote majority and speak like you have a 50 vote majority. republicans only have five. >> laura: you have to have more votes. you have to get power back. until you get the votes, you can't make a lot of these seminole decisions. ari, and chris, thank you. we got our hand on congressman jamaal bowman on ways to defeat future house votes we will reveal that list. what did skipping the debate actually could to trump's support among the voters? [explosion] [laughter] >> laura: that's some special adjustments for certain members of congress here. we always knew most members of congress were full of hot air. we should be clair to congressman bowman. don't try these things at home or in the house. you know the saying whatever doesn't kill you is going to make you stronger. so far that seems to be the case with donald trump. the more that they indict, the more the country seems to turn right. and now, another indicator, trump's decision to skip the second g.o.p. debate not only didn't hurt him, it boosted him in at least one poll. that according to a new morning consult survey. ahead of the debate trump was pulling at 58% of g.o.p. primary voters. but after the debate he pulled at 63%. as for the other candidates, desantis, ramaswamy, haley, pents, their numbers dropped after the debate. so much for those breakthrough moments. joining me now tom bevan, co-founder of real clear politics. the conventional wisdom, tom, is that trump was taking a big risk for not showing up but he jumps. so is he kind of like the gladiator and all the other characters in the arena are kind of the b team? is that what the voters are seeing or what? >> i think so. i mean, look, in hindsight, obviously he made the correct decision. and his decision was look i'm not going to get on a stage who is are polling 50 points below me and have to mix it up with them. it didn't hurt him after the first debate and as you mentioned in this one poll, he actually even went up. and i think in the second debate, skipping that second debate was ivan smarter on his part because the counter programming was so effective because all those candidates are squabbling on the stage and then there is trump at a rally talking about the auto workers and trying to sort of make that connection about the economy, electric vehicles, all those things. he has been very savvy and very smart. i think that's why his lead has been as strong and durable as it has been. >> laura: that line of his no matter what you get in the next week or two or three, they are coming to assassinate you and they are going to take your jobs. that was chilling. i mean, people the speech -- i didn't think so. that line was devastating. and that kind of cut to the very heart of the auto industry which is, you know, the lifeblood of michigan and frankly so much of our industrial base. >> yeah. and that, again, it's one of the reasons that i think trump has -- we have seen as you mentioned the indictments. did you go back and look at our real clear politics average on the day that he was indicted back in the first indictment, which was march 20th 30th. at 46% in our average, ron desantis was at 30%. two weeks later, he was over 50% and his lead ballooned up over 20 points and he has gotten stronger progressively ever since then. and the data supports that the "wall street journal" poll that came out last week said that every successive indictment is being seen by the american public and republican voters in particular as being more political and having less merit. >> laura: now, wouldn't it be very odd if by this time next year the democrats are kicking themselves that they went down this road of election or campaign prevention by indictment? this idea that indict, indict, tie him up in court? what if it just backfires? could be the biggest miscalculation if you view this all of a piece one of the biggest miscalculations in american history? >> it could be. and certainly had hasn't hurt him in the republican primary. now, i think democrats think in the general election it will be a different matter and they will be running ads but, again, we will see how that all plays out. so far and there were people in the democratic party who were warning against this. they saw this coming. that trump has broken every political rule. every political convention thus far. >> laura: r.f.k. getting in the race can run as an independent, could that cut both ways hurt and help trump? >> yeah. we don't have any data and i'm dying to see exactly if the poll pollsters have going to put him an independent and see who he draws from. the conventional wisdom biden. biden's numbers are so much softer than trump's. again, his version of liberal populism could pull some votes from trump and in a race that's going to be this close in some of these key swing states a few thousand votes could make a difference. >> laura: r.f.k. thinks he will actually pull some of the trump voters on his side is that possible? >> yeah, sure it absolutely is possible. we will have to see how this plays out. i'm waiting to see. we don't have any data on this yet. we only have data showing that r.f.k. is only about 15% in the democratic primary. are all those voters -- if all those voters that, are self-described democrats, vote for him, that will really hurt biden. >> laura: they are scared of cornell and scared of old r.f.k. this is wild, tom. great to see you in person. beautiful pink tie. taylor swift takes over the nfl, but is she really the antihero? >> you know, i do my reporting on the issue of censorship and it's a rapidly growing problem in the west, i would say one of the most significant developments is countries including the united states are looking more more aggressive ways to control the flow of political content on line but when i read this in canada even i was shocked. it just orders every platform that allows podcasts to be heard above a certain revenue register with the canadian government fill out a form telling you what you're doing and the purpose is to allow the board to control the content to insure compliance with canadian law. it's about regulating the content these podcasts are offering. >> stands against creators and we believe the canadians can succeed around the world. in a digital world we need to insure the same way canadian producers are held and that's what it does. >> oh and you call it c-11. why could that be a problem? it sounds so innocuous. >> no leader ever stands up and says hey i'm a tyrant here to control political expression. they always say we are trying to keep you safe from disinformation and hate speech. we are trying to promote canadian art. that's what the government is saying but if you look at the context of the trudeau government they punish peaceful protestors against covid mandates and obsession with controlling political expression that's where they is heading. >> during the covid situation he was threatening to shut down people's bank accounts. they went to even jail people that was the thing. i remember the bbc did a big piece on that but fast forward to what we are seeing in the united states with what the biden administration obviously in a second term wants to resurrect in a meaningful way, censorship this disinformation board which got a huge slate of national negative publicity but do you doubt that that's the direction we are going to see this administration going if they got a second term?
