pete: welcome to the final hour of "fox & friends" on sunday, october 1st. year of our lord, 2023. and we've got a whole festival on fox square and that's pumpkin chili. rachel: i can't wait to try that. it looks amazeing. pete: have you had pumpkin chili. rachel: i have. joey: i've had stuff with sweet potatoes, i bet it's similar. pete: it is fall. it's on. summer is over, rachel. rachel: it's officially over. the fox square setting, the set design is just so incredible. as you said, pete, one of the best we've seen it's beautiful. joey: as long as it's pumpkin chili and not pumpkin spice chili, i might have to you draw the line. rachel: you just had a pumpkin spice dairy queen. joey: president biden signed the stop gap bill into law last night, just hours before a midnight deadline would have triggered a government shutdown. rachel: it's just a temporary fix, funding the government through november 17 and leaving congress with 45 days to pass a full spending bill. pete: senator mark markwayne mun was the liaison between the house and the senate. he joins us now. thank you for being here p. it turns out what was happening between the house and senate became very important there at the last minute. democrats trying to stall, we'll get to what happened while that was happening in the house as well but break down the house/senate dynamic and how it played out yesterday. >> unfortunately, the house and senate really -- they don't understand each other's rules. i had the privilege of serving in both houses. what was going on, was the democrats in the house was trying to stall to allow procedure motions to begin the senate. one procedure motions begin on the schumer bill it can't stop they had have to continue through which would have led us to a shutdown. the democrats knew you that. that they tried to vote slowly. we were trying to communicate with the white house, tell them to relieve the democrats and allow them to vote on the clean cr. the white house held up what the democrats were voting on on on friday. we said you would go to a shutdown if you do this. if the schumer bill gets passed, there's zero chance the white house will get it. this is what has to happen. while the negotiationses were going back and forth, senator john thune and speaker mccarthy allowed me to go back and forth and communicate with both people to give them time to work it out which actually happened and why none of us are happy with the clean cr because we like to see things change, at least we didn't shut down. joey: on this whole process, americans are hearing terms like cr and stop gap appropriations and it's a hard to give an education in two minutes about this but the house is going to pass -- they're in the process of passing 12 bills, these 12 bills fund a portion of the government. most of it is not sunset anyway. so each of these 12 bills will come through the house and make it to the senate. will any of these bills in the way they've been written by the republicans in the house have a chance in the senate or is there a chance that it's going to get rewritten by democrats. >> they have a chance. but what will happen is we both pass our 12 appropriation bills. to break it down, cr is a continuing resolution, meaning we continue to the fund and a operate government the way it is. none of us here talking right now believes that government is perfect and we shouldn't make changes. we need to make the changes. the only way we make changes is through the 12 apro bill 12 appn bills. 75% of the government is called mandatory spending on automatic pilot. we're never going to balance the budget off the discretionary spending which is what we're doing with the 12 appropriation bills. the bills in thousand and senate are exactly the same with just different eye balls looking at them. when they're different, what we do by constitution, we go to conference and the house will assign their conferees and the senate will likely take their whole committee and go to conference and we work out our differences and have a unified bill that comes to the floor which is what we're doing with the nda, national defense authorization act. i'll try to break the acronyms down if i use too many of them. rachel: senator, you make it clear, they were in this conscongaline, slow walking thee trying to make the government shut down because they thought it would be advantageous for democrats. one of the squad members on the house side, decided -- his name is jamaal bowman, he's from the bronx in new york city, a loud and boisterous member of congress who has never been shy before to speak his mind. here's what he has done. he was caught on tape. he pulled a fire a alarm which is now claiming he thought was a door and we know of it's a lie. could you explain two things. one, again, why he was doing this. and what kind of investigation is going to go into this? because members of congress need to the investigate and get to the bottom of why -- what he did, why he did it, if he was coordinating with other people because he interfered as you will explain with an official proceeding which many people are in jail for right now. >> listen, if you believe what bowman is saying, you're just going to the blinding light of what he's saying. by the picture, there's a sign there that says door closed, alarm will sound. it's very clear. it's red even. beside that alarm, it says fire alarm, very clear and there's usually a ribbon across the door that he had to cross to get to the point so there's no question that he knew exactly what he was doing and there's no question that he was trying to slow down the process because that's what they were trying to do. and if you remember too, they had went to conference. then they came out, did the conga line and you had what a hakimjeffries go in and take whe call a magic minute. as he was talking, you look behind him, as soon as we got the deal struck between the house, senate and white house, as soon as that happened the white house released the democrats to vote and all their faces went blank. we had bowman in the meantime trying to stall the whole process, my lord, the guy's a principal. knows better. i would like to go back to check to see if he's done it at a school that he's a principal of to get out of work for a day or two. rachel: it's against the law. what are republicans going to do. they've thrown the book at january 6 protesters for the offense of interfering with an official proceeding. that is exactly what this congressman was doing. so what are republicans going to do? >> speaker mccarthy made it very clear that he's going to hold him accountable for this. and just imagine this a republican, you know the democrats wo would be going all out, every news outlet in the country would cover this. speaker mccarthy came out very strong immediately and said we will hold him accountable, we'll investigate and hold him accountable. the video i'm sure tells the whole story. it will be interesting if he pulled the fire alarm and went through the door or if he pulled the fire alarm and walk away, it looks like he's pulling it with the arm a closest to the door and angling away from it so looks like he'll be walking the opposite direction so the story of going through the door is such a lie. pete: absolutely. i want to be clear about this. ultimately, democrats believed it would have been politically expedient for them shut the government down and point at republicans. >> yes. pete: that's the ultimate outcome they were aiming for. >> 100%. we told them very clear that if the schumer bill passes the house p isn't going to pick it up and it's going to lead to a shutdown. why would you argue against this clean cr. we were having the argument with the white house until late, late, late friday night, going back and forth, letting them know there's no chance for the schumer bill to pass. if you'll allow the clean cr, we made the point what is your argument about a clean cr, giving us 45 more days to work out the differences in if the bill. and they were just 100% wanted to blame it on house republicans because joe biden's numbers are in the tank and they think it would be better for them much like it was for obama in you 2013 when we had the government shutdown. rachel: this is jamaal bowman talking about president trump and the law. listen or i'm sorry, it's a tweet he wrote. he said no one in this country is above the law, including president trump. so what does the law say about pulling an alarm and interrupting an official proceeding and trying to affect the outcome of this vote. >> it's a federal crime. it's absolutely a fe federal cr. those words hope a any he belies --hopefully he believes and he'l confess to this instead of continuing to make up lies. you see this from far left democrats who act completely childless when it comes to something they believe is wrong and they accuse the republicans of doing exactly what they do. rachel: yeah. pete: senator, you're in the senate now but you were in the house as mentioned. on another network, representative matt gaetz just said he will move a motion to vacate speaker mccarthy. your reaction to that? >> matt gaetz is not a principal guy, not a policy guy, he's about self promotion, it's all about matt gaetz. he's accusing speaker mccar this of working with the democrats which the irony of this, the only way he can possibly remove speaker mccarthy is that he has to work with the democrats. speaker mccarthy will have 200 votes all day long and probably more from the republicans. so that means the most he's going to get is 20. so he's going to have to work with 198 democrats to remove the house republican speaker. matt gaetz is all about himself. remember, none of the networks would give him the time of day after he was you accused of sleesleeping with the underage . now he's found fame because he opposes speaker mccarthy and he's going to ride this horse as long as he can. joey: direct and thank you for that. pete: thank you very much. appreciate your time. rachel: thank you. i hope you gibb us an update on what happens to jamaal bowman. all right. thank you, senator. turning now tour headlines. starting with a fox news alert. at least 13 people are killed and four more are hurt in a spanish nightclub fire earlier this morning. firefighters are still searching through the rubble for any survivors in the southeastern city. officials say the fire started in one of the adjoining nightclubs and later spread. the cause of the fire is being investigated. the city's mayor announced three days of mourning to honor the victims. former new york city worker is suing the district attorney, alvin bragg and nypd for racial discrimination after his controversial prosecution for acting in self-defense after being attacked behind the counter in june of 2020. the attorney representing alba joined us earlier to discuss their case. listen. >> it seems like the racial equity policy by bragg is that they want to have equality of outcome and that's impossible, everybody should be treated equally. rachel: the suit comes about two months after bragg reversed his decision dropping the second degree murder charges and lowering alba's bail from $500,000 to 50 of thousand $50,. california governor gavin newsom facing a difficult decision over who will fill the late senator dianne feinstein's seat after her passing friday at age 90. the governor suggested it would be a black woman and yesterday i floated this name as a potential option. >> i was just going to say, could be meghan markle and you can be sure that meghan markle when -- you laugh at that. but you can be sure that a she is lobbying for herself right now. rachel: yeah, i think she's on the phone a lot over the last 24 hours. calling people. an anonymous major democrat donor with close ties to the governor gavin newsom says megan is a long shot but in the craziness that is u.s. politics these days, it is not an impossibility. crazier things have happened. for sure. so we'll see what happens there a new dating app uses your face to figure out compatibility. sci-fi match uses artificial intelligence to scan your face to figure out your personality strtraits and match you with a potential date. it's free to use. you can find more features like having the app pair you with someone who looks like your celebrity crush and those are your headlines. joey: so your face determines your personality. rachel: is that true? >> well, we understand he's doing as well as possibly could be expected. his sense of humor is intact. he's writing letters, he wrote a letter to emma tucker, editor in chief, made her laugh and cry. he's being treated well so far. he had a lot of access to books, he can write letters, he is writing hundreds of letters. his parents got to visit him over the summer. so far, his state of mind, state of health is apparently quite good. joey: i know the u.s. government designates this a wrongful detention, leading the way trying to get him back. he was working with the wall street journal in russia. is the wall street journal able to provide evidence or show, listen, he was on a legitimate assignment and be part of the process? >> first, he is not a spy. everyone said that. the government, we have said that, his family said it, everyone. there's no evidence to be shown. he was doing his job and that's it. the russian government provided no evidence to t the contrary. espionage in russia is done behind closed doors. they've presented nothing whatsoever. the trial has not even be begun. his pretrial extension has been scheduled over and over again. this is a monkey trial, entirely a political move by putin who clearly wants to exchange evan for something. joey: that's my next question. it seems -- timing would be blind not to say does this have anything to do with diplomacy with what's happening in ukraine. has there been any talks of give us this and we'll give you him, is there anything we know about or have heard? >> we don't know. the government will do this obviously very quietly so they're not doing this publicly. we're not privy to how the government is handling this. we know the administration is making this the highest priority and we do understand they're moving mountains to free him. we understand, we believe that this will be a long game. putin has effectively -- he's taken an a american. he's charged him with spying, bogus charge. he put a certain price on his head. what exactly putin wants to extract from that, we don't know. we'll have to see when he holds his hand, if he has with the american government, we don't know yet. clearly, it's a long game that putin is playing here. joey: he's detained. he's not convicted, he's not been convicted. if convicted, i believe it's up to 20 years, an insane amount of time for someone who is innocent. has the administration shown, do you believe, they'll get him back? >> yeah, good morning, rachel. thank you for having me. you're exactly right, fox does an amazing job covering it, griff and bill melugin are giving us firsthand looks at what's happening. this was the goal behind being able to host elon at this visit is for him to see it for himself and for him to see -- he's a concerned citizen like everyone else and to see it unfiltered, untapped, to frame the problem and in eagle pass alone, the del-rio sector, just one sector, there's nearly 50,000 people coming over illegally a month and the part that really kind of shocked him where we have zero people getting sent back, zero people getting deported. he didn't understand that at all. you can talk a big game all day long but you've got to have action with it. the other part of it, i wanted him to hear directly from the people on the front n lines, the local sheriffs, randy brown from medina county and the local mayor, these type of real, raw, uunedited discussions is how we frame the problem and now we need to talk about solutions. rachel: sometimes it's hard for us to understand just how many these are, it's over 6 million, that's the size of two los angeless since joe biden was elected. it's important for people to understand that visual. we've got a report that joe biden is looking to give aid to countries before they reach the border. we know the ngos are really at the heart of a lot of this policy, that they pushed this policy, they get millions of money from our taxes to fund them as well as from other international organizations. so my question is what do you think of that policy and also what are you doing to help defund ngos who are pushing this policy that is hurting your state and your district in particular so much? >> yeah, rachel, it's a great point. let's talk solutions. right now, you have an administration that is throwing money at the problem that never solves a solution, ever. if anything, it only makes it worse in many caseses. you can't just put money and expect it to go away. a prime example, we're asking mexico, last week there was a deal, arrangement made where mexico was going to be deporting different people. well, they're not doing that. of course we can't farm out our national security to a foreign government and expect them to do a good job. so the foreign aid piece to it i think without any other details is failed on its face. the solutions are this. i dropped this act yesterday because the communities in america don't feel safe. this is three things that it does, it's a nonpartisan, could get the job done immediately. one, we have to raise the credible fear standard. right now, anyone can come in and basically get through. we have to raise that critical fear standard. the other thing is we have to sesurge immigration judges to te border, at least 150. that way people can get their cases heard immediately. they're called rocket dockets. the last person that comes over is the first person that gets their case heard. you do that for a month and the word gets out that you're not going to qualify for asylum and the third piece, arguably the most impo important piece, we ho turn on repatriation flights, deportionation. you don't bus them across the country. you send them back to country of origin. those aren't all the things republicans want. i believe in a wall, more technology, more border patrol agents. the three things i just laid out are things that democrats, the white house, the senate can all get behind. that's how we solve the problem. rachel: we need to go back to remain in mexico. it was effective and also i think more money just means more money to process, more money -- i think the r use, send money to panama, for example where we know the ngos are sta stage allf this ininto our country. this is -- invasion into our country. this is about laundering money through ngos and using our money a pretending it's for security and we know it's for processing. i hope you keep an eye on this. i appreciate this. i think it was evidence ebbing e elon musk and for you hosting them. >> it's gotten over 100 million views. it's incredible. thank you for having me. rachel: it's a new audience and that's important. thank you. all right. coming up, a fox news alert, congressman matt gaetz says he will try to oust kevin mccarthy from the speakershop this week as -- speakership this week. t this comes as the government avoids a shutdown prior to jamaal bowman pulling a fire alarm before the vote. plus, it's our annual fall festival on fox square, autumn activities for the whole family coming up. ♪ hey, let's party like we're on vacation. ♪ aah, it's a good day to cough. oh, no! bye, bye cough. later chest congestion. hello 12 hours of relief. 12 hours?! hmmm, ok. not coughing at yoga. antiquing not coughing? >> no, no. pete: tractors don't have horns. >> i bet some of them do now. pete: if they're street legal, i bet. >> that's true. that's a good point. pete: what about driving from the field, you might need a horn. in my town i see tractors on the road. what do they do. joey: from the field to the barn. tractors don't go down my road. >> thanks for your support. pete: i support you and our farm knowledge. now a fox news aall right. moments ago, congressman matt gaetz makes a major announcement on his plans for house speaker kevin mccarthy after last night's vote on capitol hill. >> i do intend to file a motion to vacate against speaker mccarthy this week. i think we need to rip off the band-aid, move on with new leadership that can be trustworthy. pete: our own jacqui heinrich reporting that house gop members are seeking to expel matt gaetz if the ethics committee report comes back with findings, one member says the report is mostly written but don't know what it contains. following threats to vacate mccarthy, no one can stand him at this point, a smart guy without morals. maria, this is a mess right now even though they got the bill passed. maria: you would think this would be something that the gop would be celebrating, that they averted a government shutdown but this fight is about spending first of all. matt gaetz wants the congress to deal with single subject spending bills. each individually. rather than an up and down vote about funding the government all at once because obviously if you're dealing with single subject spending bills, then you will have an opportunity to make those single deals smaller, rather than coming up with an overall number, 1.47 trillion, $1.5 trillion in spending to fund the government as a whole. he does not want an up and down vote overall government funding at once, instead he wants those 12 appropriations bills done separately and he claims that kevin mccarthy breached his promise by not getting all of the 12 appropriations bills done by the deadline of september 30th. now, president biden of course pushed b back, pushed back, didt talk to kevin mccarthy for half the time that mccarthy was trying to get it to his office to try to get up with ways to you cut spending, talking about $33 trillion in debt for this country and the interest payments alone are getting more and more expensive as interest rates go up so this is the fight. there are many people who also say this is a personal vendetta because kevin mccarthy did not push back when the ethics investigation started around matt gaetz. he said he didn't know, he didn't want to get involved. you know, president trump said -- made a comment about matt gaetz says he's a good man, he got involved, kevin mccarthy did not get involved. so some people say that this is a personal vendetta, that gaetz has against mccarthy. whatever you believe about all of this, the bottom line is, this is going to play out in an ugly way t upcoming week. it's about the single spending bills versus an up and down vote for the government, obviously they averted a government you shutdown. kevin mccarthy was able to rally enough democrats to actually pass something, to keep the government open. let me say one thing. some of this on matt gaetz's part is a bit hypocritical. who do you think he is going to be able to get to push kevin mccarthy out? he's going to need democrats. kevin mccarthy's going to get 200 votes to keep him as speaker. matt gaetz is going to be forced to work with democrats to get kevin mccarthy out of the job. so when he says oh, kevin mccarthy worked with democrats on keeping the government open. well, who are you working with to get the speaker out?
