continuing resolution, defund the federal government, for 45 days in early on the brink, and no later tonight tonight hello this is "fox news" live and i am eric shawn. arthel: hi and i am building a are considering, could mean ditching money for border security in ukraine, minority leader, and there's hakeem jeffries there getting a standing ovation, from his supporters there on his side of the aisle, meanwhile, there is drama within the republican race, net gates will he is hinted that he would kevin mccarthy, has house speaker if the government shuts down congressional correspondent, is live on capitol hill, with the latest and aisha and mccarthy seems to say, bring it. reporter: hey good afternoon to you, this pretty much what he said, when he was asked if, what would happen if mask gates are some of the else file the motion to vacate any's absolutely not worried about it and he said bring it on and meanwhile what is happening right now, with that i would have if it ever even having this weight and were all waiting anxiously for this vote on the continuing resolution and people of the house for, what is happening now is a stared down. not only between house democrats house republicans, but also now between the house and the senate. this is very interesting so the leader jeffries is speaking on the floor and you see the democrats are cheering him on and he is going to talk about leave as long as he possibly can, to delay this vote on a cr, the speaker mccarthy just put forth and you were remember speaker mccarthy, said a record it, for hello summa because be on the floor and i think it was about ten hours prayed so we are watching to see, how long leader can go here and democrats are frustrated that mccarthy just dropped the bill on him plus i can, this is a 45 page bill that includes disaster relief, no ukraine funding no border security and democrats have been alleging, in the last hour here all sorts of things, they say the republicans had removed it provisions in this bill that would essentially open the door to giving themselves pay raises and republicans are calling all of that a lie. here's speaker mccarthy, just about two hours ago, telling why he decided to bring this particular bill up now. >> this particular cr, why didn't you bring it up earlier. >> will i tried every different way, day after day after week after week. and so i try to past it was conservative, and the venting bill to keep us going to secure the border and they did not get enough votes and here we are, hours away before government shuts down. reporter: so guys, basically mccarthy what he has done is he has dropped this government shutdown problem on the democrats heads. so is he can get a majority of his gop conference, to vote yes on this cr today, tonight, and no democrat votes yes on it then he will just blame the shut down on the democrats and meanwhile, so that's the stared down going on now and we the house and the senate are in a stared down because house democrats want the senate to bring up their version of the cr, which includes ukraine funding about $6 billion. they want the senate to go first assertive out on that in the senate is not moving right now, leader mcconnell in just the last couple of moments here, recommended to his conference, a no vote on procedural vote today, the move the senate and a cr, they're both slow things down in the set aside so it is a stared down to see which chamber will go first in passing, a continuing resolution to fund the government. eric: but the question that we had mass gates on, the steps of the capitol earlier saying that the motion to vacate, and speaker mccarthy, from his job is not foremost on his mind. but clearly, this part of the motivation behind that and if the speaker does cooperate with the democrats, get something done with democratic votes, wouldn't up with the speakers job in jeopardy and what we have a motion to vacate at that point from the hardliners. >> it sounds like were headed direction eric emma mass gates has not changed his position from day one and they keep saying that's exact same thing and he said the same thing today that speaker mccarthy made the republicans certain promises, that he's alleging mccarthy has not fulfilled and among those promises, is that you would work with the republican conference and so putting this kind of cr, clean cr on the floor, which requires democratic votes right, this is being sped up, this is not going through the normal rules process and so it is no longer required that you meet 20 and now you have to have two thirds of the chamber, and a threshold has moved up and so now he needs the democratic votes, so if he wants is thing to pass, that is the democrats will have to go for this, the mass gates, will likely do what he has been threatening which is file a motion to vacate. >> will see if he's out of a job, there being mentioned as a potential successor if we get that far. we'll see thank you and. >> okay arthel neville and eric shawn will bring an associate better for the wall street journal and so, we will most likely be here again and 45 days perhaps something is rectified. by midnight but, you know the big ticket item which we just heard aisha's report of the senate bill, it is 6.2 the senate bill will seek to enter and funding for ukraine no border for the maker under speaker mccarthy basically said to the upper jibber said that provision will not find that also them to delete them from the belt, we have a deal meanwhile, if you could john time of the real-world detriment or consequences, have a shut down, and a 45 day continuing resolution. >> i don't think you're going to get a lot of movement in the senate particularly on ukraine. look, a lot of republicans in the house support continued aid for ukraine and they see the sales, a major important part of the u.s. foreign policies and so i don't think there's kind of anyone thing arthur welcome that if you drop this and then it is going to pass never but he will be happy but i think what you see in congress right now, is low, when we have elections, we hire a manager and you are having a really bad example of management of the government and for speaker mccarthy coming to suggest the somehow, he is going to be able to rain this in on the democrats, his a real stretch because if i am not mistaken, in the by election, the republicans won control of the house. any speaker the house and so what he is dealing with, is an internal fight within his own party. dissidents within the republican party, a small number of them essentially holding hostage of this bill, and the leadership of speaker mccarthy. what is the main real-world, a lot of federal employees, would be for load as of midnight tonight. mind you, they would get pay retroactive when the government comes back online. a lot of federal contractors may not be so lucky the contracts may not give them back pay when the government reignite. and it is not as if we have not had one of these before, we have had several government shutdowns of the last 20 or 30 years and we know how to manage through them but it is not a good example of how these elective officials are supposed to be managing the administration of our country. arthel: right and i know we've had a before and you had some people who would be furloughed, it was money aside but let's be real about this, not everybody can wait for another 30 days, 60 days, you know 90 days to get paid. regardless if they put something on the site but you are talking about management. meanwhile john from there such distrust in congress that you have democrats, asking release 90 minutes to read this proposal in the gop side brought to the floor this morning and you know the democrats are saying that they want to read it line by line to make sure that nothing has been stuck in and again, he goes back to your point of the lack of management on their part and so how long can congress survive with such distrust and erosion of decorum and frankly indecency some might say. john: i think there's no indication this way to get better anytime soon and if anything, the polarization that we talk about, basically what is happening as you have these district gerrymandering in such ways of people do not have to compete for the middle line moderate voter, i can very successfully get reelected and appealing to the more polarized, all right far left, the voter in their district. some likely to get any better anytime soon. and you're right arthel l, people are worried about inflation in prices have gone up as a result of all of the dislocations caused by the pandemic it, and the supply chain problems desperate inflation and well low, the consumer is unhappy about inflation, the only way to really make them even more and happy, is to not give them a paycheck you know for a period of time and mitch mcconnell came out and said get government such down sir not good for anybody are republicans. and so let's not have one and i think that he is thinking of the election around the corner. >> mitch mcconnell also said we need to find ukraine card. john: yes he did and he has joined by a lot of it is contemporaries in the republican party, and certainly a lot of democrats. and it's odd that this is become a sticking point on wonders whether it is just being uses kind of a political tool in the past, you had speakers are still who were always 500 for five outliers and people with either you know, particular intense ideas and some individuals might call them kind of you know, crazy ideas and there always a small element in congress and now, it is larger. and he went 21 people but against the speaker of the house. on this latest iteration of the bill. >> will you know, it is what, to 14 or 211 rhino east coast time, will see what happens to midnight if you started out by saying that you do not think there's going to be put into savings were to be a shut down or will they get the 45 day continued resolution passed and would you. >> yes well i don't know, anil, deadlines into focus the mind. the political repercussions of this potentially focus the mind as well and you can very easily have, i continuing resolution maybe not a 45 days, and maybe it is seven days or three days, there's plenty of them in the past pretty that's entirely possible, at this point and regardless of what particular types of theatrics are going on in congress. >> there's a lot of theatrics going on for sure and john, i have to leave it there but always appreciated your reporting, thank you john bu bussey. eric: the biden administration is not getting ready, for his part, and if indeed the government does shut down later on tonight and lucas thomas is on the north lawn of the white house with what the administration is doing to prepare a lucas. reporter: pro president biden speaking into a retirement ceremony for the outgoing chairman and joint chief of staff joy in general are fairly issuing the following warning about a shut down. biden: the house fails to fulfill the most basic function, and appeals to fund the government by tomorrow, we will have filled all of our troops, enter service members and the people holding their open showing up for work and standing stations around the world and keeping our country's concern for they will not get paid. it's a disgrace. sue and president biden's hear the white house this weekend and no doubt, keeping tabs on the looming government shutdown. lucas: and it appears all but inevitable barring last-minute hail mary we just heard from mrs will be impacted by the national park service close and passports it will take a lot longer reaching the irs by that what happening and americans rely on social suit if an assistance including food sales could be denied and in some government workers say the tsa agents in protest over not getting paid, maybe even call out sick printed now speaking of traveling, some would say the traveling illegally into the country, earlier gop candidates vivek ramaswamy discussed the situation on the border with her own neil caputo. >> we have a swiss cheese of her sudden portable has proven to be enough the cartels are building and the cartel fans, tunnels on trucks are able to drive underneath the ball and so perfectly legal, legally morally and ethically justified and the military to seal our own border also also a pragmatist prayed. lucas: no casey steagall down the southern border will have reporting later this hour but the record-setting number of it migrants entering entering our borders legally is month. eric: thank you. arthel: . good bad and piggybacking on lucas reporting government should and could halt a lot of federal worker paychecks who would be put on for low, and john bussey and i spoke about that moments ago and that includes the border patrol, just as customs border and protections telling fox news, september has set a new record for margaret encounters and more than 260,000 this month alone. and senior corresponding, casey steagall who is live the border in eagle pass texas with more the migrants more the numbers and situation down there casey. reporter: hey good to see ortho come the previous record that you mentioned, it was last december when more than 252,000 migrant encounters were reported then for further contacts, and perspective on this, this august talley was close to 233,000 and so for the month of symptom or now, cdp sources are saying, the 27000 more migrants, that entered the country which ironically, his about the entire population of this very community eagle pass, texas. and it is a community essential become the epicenter of this border crisis and part of the del rio border patrol sector, where day after day, we continue to see images like this, the migrants rundown the banks of the rio grande river, on the mexican side and then across the waterway, climbing up onto the u.s. side. larger groups like we saw this morning of more than 250, foreign chain intern form change at times tried to navigate this with moving water however, they are not turned away like the white house has insisted, would happen if they do not do it properly at a border entry using the app so it is easy to see, how quickly these border towns and cities get overwhelmed. >> this has impacted the city of eagle pass and not only, do we have thousands of people, coming into our community, and it's affecting our local resources, pd, fire, two for the meantime thune 20 miles to the south and front and, texas, this our county, west of mcallen, the elite texas dps rangers operation group, has begun clearing this are elated that you see video of a comedy set up a operational security there and is an island, that had been under control previously by tco's or transnational criminal organizations, so essentially, the work continues around the clock and out here and out of the frontlines, and even as we have been saying with a government shut down looming, meaning, order patrol and all other federal agents out here, be essential employees, coming to work but not receiving a paycheck. our sale. arthel: that is not right in casey, thank you and eric. eric: while long to the break nicole case the group the nation arthel neville, decades ago in the first russ, 1996 shooting, of the popstar tupac on the las vegas strip and outside of las vegas police say they have a suspect duane davis this long been on the radar but they recently stepped up the investigation, the case just in the last three years, live in the west coast bureau with more including some exclusive details on the investigation into tupac skilling sina. reporter: hi yes that is right in a did an exclusive interview with bob one of the two lead homicide detectives who investigated this famous case and 1996 and he testified before a grand jury a month and a half ago, and also made multiple arrest during the ten-day gang important often, following his murder and take a look at this photo, the base fox news producer jimmy brennan, he is the daughter of timber and then the is controversial about that and finally, he said these one to see with the senate with you when the senate republicans got together we said we would bring it down when that happened, the hakim jeffries let everybody go in the white house finally said let them vote for it and was well over 300 votes and i think the 91 knows. reporter: you know they made a phone call within the last hour here and basically gave permission to the democrats to go ahead and vote yes because they were trying to delay this we heard all source of stories sure you've heard about a certain congressman who may pull the fire alarm while still trying to figure that that was the reason why he did that they were trying to delay this is much as possible and that it just turn within the last couple of moments. >> we were up against the clock in the senate because once a procedure stars, you cannot turn it off in the senate. and so in that would've teed up the schumer bill. what hakim jeffries was doing over here for this magic minute was trying to run the clock out and he did not think that the republican's would actually think i'm and procedural vote and once we said that we will bring it down and mitch went to the comedian said were going to bring us down and he did a look unimpressed face. and hakim mistreated about sweeper they won the stare down today and can you talk about what happens next with us cr which by the way for our viewers, includes disaster liberty does not include crane funny insincere it is not include border security what happens now, that is headed towards you. >> will i do believe there's well i think it is clean and so i will bring up the three separate bills and we still have to deal with ukraine funding and disaster relief and we still have to deal with the military and firefighters pay so there's a few things that we have to sort of work through going to get this one going and will this continue this voting this week and getting the rest of the stuff taking care of. >> people at home wondering in our anchors resting anybody in the setting so this down because it takes one member right, they can so this process down and then we might miss the deadline. >> what we already have an agreement from the republicans nobody's going to do that and if it happens, it will be on schumer and so the democrats in the house republicans, senate republicans were together, speaker mccarthy get to an outstanding job in communicating his point and really calling the democrats on the bluff and he was communicated with mcconnell, and with john thune to make sure they make sure were on the same page and this is what happens when republicans were together in some perfect, and any republican i don't think it would say the barre never keeping the government-funded to give us time to work out the differences to get the best bill we could see full capacity one more question because i know you have to work on this now, on the senate and everybody that's been watching this at home, and the drama the back-and-forth and the constant have horses that were failing over in the house, you know people are wondering, what did you guys take so long and why did she wait until the final hour in the final day, to get something done and why does congress function what he wanted to this people and there's we wanted to see appropriations bill initiative in the budget and there should've been any fiscal year 2024 budget and where we doing cr why did this happen if they happen. >> the good work and allies mostly have to go back to border and confounding fathers said to have a voice never. they to have representatives and we also have an by design, design to be on chaotic and slow, we saw the government was working it didn't work perfectly we've never had a perfect build the constitution is been amended so we voice at this back-and-forth met with the you that i congress does usually come together and find some solution but it just takes right at to that deadline and it was you did not but that's the way it works. reporter: we so appreciate your time senator mullen i know you'll be busy on the senate side will be watching that part next we appreciate it and thanks so much so hard sell this interesting speaker mccarthy, actually on his way into the chamber be for this vote, came over and whispered to me and said, did you see with the senate just did and he was be making in talking about the fact that mcconnell leader mcconnell had basically said, okay, will going to stand back and we are going to wait and were not going to move under senate bill is going to watch the houses which literally just put all of the pressure back on house democrats and you just heard senator mullen say, it was the white house and fairly they made a call in the last few moments here until the democrats take the deal. arthel: plus such a political hot potato there and neither side, wants to be the one to hold up the progress here and so they realized then i thought it was interesting in your interview with senator roland he said the founding voters designed it to be chaotic and maybe slow moving perhaps but i don't think they were anticipating such chaos that we are currently witnessing. reporter: while i think what people want think with senator mullen also was trying to say is but a lot of house republicans hidden in democrats have been saying, is we need this process of birth weight that it supposed to work which is through the 12 appropriations bills i make a budget supposed to happen every single year in congress has a really bad track record of trying to make that happen we almost always have to put together a cr less i can become a bible time is what will happen it seems like now by 45 more days and then hopefully, we'll have a budget at the end of that. arthel: i hope so, may be argument in japan. eric: about the ukraine and, once the senate gets into ukraine aid will be back in. seaport know, it is not sound like ukraine will be part of this and speaker mccarthy was very clear to the senate that there is no way that we will go for that and also, gary coming in the senate tries to change the thing in this cr, has more time so we are under a deadline been under the clock itself and they went to a verdict government shutdown which they do absolutely, think this offenses they've obviously work it out behind closed doors the white house is on board and apparently theater schumer is a swell up and going to take this up quickly and tested as quickly as possible before the deadline because if you start to change things have to spend this back to the house. arthel: of right and left the mission, that aid to ukraine, possibly most likely not being in the revision of the next bill enemy that also weighs heavily speaker mccarthy on his position perhaps c4 it weighs heavily in a lot of moderate republicans and democrats especially these house democrats, were trying to buy time today because they really wanted chuck schumer to start the process as on their version of the cr because it had the $6 million for ukraine aid in their this one did not add what it sounds like is going to happen, is that ukrainians going to be a separate vote pretty which is what the folks in the house on the right conservatives have wanted to make it separate and we don't want about dante that we don't want to put it together and cr defend the government we don't want it attached to that's what looks like is going to be a completely separate measure there will be taking up at some point in time we know the leader mcconnell supports for ukraine funding we know that there are senators, and the republican party that you entered were the majority of the majority, support ukraine funding. arthel: thank you so much and go-ahead. eric: will ten seconds, do we know if matt gates will follow through on his motion to vacate because democratic votes were part of this. reporter: will it's as good as anybody's guess harry, but he has repeatedly said that he would follow through in democrats help speaker mccarthy pass a cr which is exactly what happened today. eric: okay more news atwe 4:00 p.m h. eastern. we're not an
