government not shut down. we will put a clean funding stop gap on the floor to keep government open for 45 days for the house and senate to get their work done. >> house speaker kevin mccarthy moments ago saying that government will not shut down as a midnight deadline approaches. this as the house has gavelled in for a rare saturday session and a lot of questions about that deadline. welcome to fox news live, i'm griff jenkins. >> you'll jacqui heinrich and aishah is on capitol hill. there are a lot of them, why don't you start off. >> good morning, good afternoon to you, there's been a lot that's happened this morning and now we're all here outside the house floor waiting for a vote to take place on a brand new continuing resolution, which would fund the government, this one is 45 days long. it does include disaster relief. it does not include ukraine aid and it does not include border security. let's look at the house floor together as we await this vote. this is coming up under a suspension rule. if you're wondering why it's happening so fast, there's no 72-hours to read the bill text here. it was just sent out to both the democrats and republicans in the last 30 minutes here. it does not have to go through the rules committee. it does raise the vote threshold though, guys, now from 218 to two-thirds of the entire chamber, which means that speaker kevin mccarthy needs a good amount of democrats to sign onto this to get this through the house. so essentially, what you're watching here is republicans daring democrats to say no to funding the government and they might because in this bill there is no ukraine funding and we know that there are a lot of democrats that really like the continuing resolution, the bill that the senate is working on, to fund the government and it looks like some members are now heading in to vote once they get started. and what they're hoping for is that this passes. if it doesn't pass, but plenty of republicans sign onto it and democrats don't, and they can blame this on democrats and blame the democrat. and kevin mccarthy talking about why we're in this position. >> i do not believe our troops should be punished for not getting the job done in the house and senate. i do not believe the border patrol agents should be punished. i do not believe the american public should be punished. i tried yesterday with the most conservative stop gap funding bill you could find, that secured our border and stopped spending and couldn't get 218 republicans on. >> counting on democrats, guys, may result in congressman matt gaetz filing a motion to vacate the speaker and today mccarthy essentially said, bring it on. >> somebody wants to remove because i want to be the adult in the room, go ahead and try. but i think this country is too important. and i will stand with our military, i'll stand with our border agents, i'll stand with those that have to get their medicine from government as well. i think that's too important. >> so jacqui, griff. we now wait and watch the house floor to see what democrats and republicans will do, will they pass the 45-day clean cr to fund the government and send it over to the senate. i've got 70-page bill and trying to get a look at this. my question to you, you may not know the answer, but democrats because you'll need dozens to buy in, theoretically want time to read this. will they have time to read this? >> i would imagine republicans would want time to read this and they wanted the 72-hour rule, remember, when they were voting on speaker earlier this year. and that's one thing they wanted. but, yes, the democrats will want to read through it and they're on the house floor arguing over the bill and they believe that there's actually spending cuts in this bill and again, they're very upset over the ukraine funding not being in this. you can see actually on the house floor, some back and forth happening between congressman delauro, very much in support of the senate version. the senate's continuing resolution which again would include $6 billion of ukraine funding. so we really don't know how this is going to go. and the democrats didn't have much time to whip their votes. they got this thing probably less than an hour ago, not even that and now they're on the house floor debating. griff: aishah hasnie live for us in that busy house. keep us posted and break in if there's news we need to report. thank you, jacqui. >> president biden spending the weekend in d.c. as he faces increased criticism of his handling of the influx of migrants at the southern border. that being a key part of this debate to keep the government open this weekend. lucas tomlinson with the latest for us. >> jacqui, cvp officials tell fox there were over 260,000 encounters with migrants at the southern border in september and the month isn't over, i don't know if that includes today. that number is about the size of toledo, ohio coming in just in the last month and that's over 8,000 a day, for anybody has a calculator can confirm. many border patrol officials say there's no disincentive keeping them from coming into the country. >> there's no consequences at all. i would love to stay there's had a little bit. there's not even a speed bump. >> now, in eagle pass, roughly 5,000 migrants are now in custody held at the facility only designed to house a thousand. that's five times over capacity. elon musk recently paid a visit to eagle pass last week, a guest of republican tony gonzalez and he livestreamed on x platform, formerly known as twitter. he wanted to show the unedited version, and some of them walking across the border and griff said he could have seen some of his live shots down there. here is what he had to say. >> if we don't do something soon, a collapse in social services, a guy came on face tattoos and including tears on his face that means they've murdered someone and they are so proud of having murdered someone that they tattoo, like one tear on their face for every person that they kill, is that correct? >> that's exactly right. >> and they these person claimed asylum and we let them in. >> let them in. >> just a point of reference, back in may of this year, there were over 169,000 encounters with migrants along the southern border, 260,000, that's 100,000 more in september alone, jacqui. >> all right. lucas tomlinson for us at the white house. appreciate it. griff: joining us now for more on the 45-day spending deal brought to the house. democratic congressman from pennsylvania, member of the mouse appropriations committee, matt cartwright. thank you for taking time joining us. i've got my co-host jacqui here and we've got a million questions for you. first, what are you going to do? have you read this? are you going to vote for it or aoppose it? >> nice to be with you, i tell you what, i'm leaning strongly in favor of voting for it. i fell tell you why. >> we've got democrats and republicans, we're always opponents and always at loggerheads, but you also have the kind of the extremes on both sides and, you know, it's how you handle the extremes that really matter. sure, you have to give them a chance to speak. you have to give them a chance to be heard. they got elected by american citizens to be members of congress. but you have to listen to them and consider what they have to say, but what you don't want to do is you don't want to let them call the tune. you don't want to let the speaker be led around by the nose by the extremists. you don't want them to shut down the american government and turn the lights off. you know why? because a lot of people get hurt. the economy gets hurt, some economists have said as much as 13 billion dollars a week when you shut down the government is what it costs the american economy and i can give you, you know, on a district level in my own district, in northeastern pennsylvania, we have the delaware water gap national recreation area. that shuts down during shutdowns. and so think of it, the first couple of weeks of october is leaf peeper season, that's when tourists come in there and that national recreation area is it on the eastern part of my district, northeastern pennsylvania, and it is dotted with mom and pop businesses, quickie marts and restaurants and motels, gas stations, they all get killed during a shutdown. that's black friday for them, the first couple of weeks of october and we saw it in 2013. >> sure. >> we calculated $400,000 a day it cost that microeconomy. we don't want to shut the government down. we want to come together and figure out our differences without going to that extreme. >> congressman, one of your answers intrigued me, you said you don't want to let the speaker be led around about the extremists in his party. if he gets a bill to the floor, largely mirrors the senate and both parties over there. are democrats going to save the speaker from what can be expected, which would be a motion to vacate from the right flank of his conference? >> okay, let me unpack that. there's a couple of questions there. number one, the speaker bringing forward this continuing resolution proposal, i lean very heavily in favor of it for all of the reasons i just said, including military preparedness, which also suffers during a shutdown. we have to remember that. without having read it, having heard the broad contours of it, it sounds like i'm very much in favor of it. right now on the floor of the house, jacqui, we have a motion to adjourn so that people can take some time to read through it and make sure it says what we're being told is says. and i'm in favor of that, but i want you to know i lean very heavily in favor of agreeing to this 45-day continuing resolution and as far as a motion to vacate, i would not take a position on that. i probably would vote present, this is not about the democratic caucus, it's about the republican conference and them choosing their leader. if they really want to throw out kevin mccarthy for doing what i think is the sensible thing, i kind of regret that, but that's their business. i would probably just vote present, jacqui. >> that's notable. griff: let me ask you this, congressman. you've been on this program and we love having you on and we know the exclusion of ukraine funding in here has to be an issue for you? >> yeah, i prefer to fund ukraine. i am absolutely in favor of a free, democratic and independent ukraine and i think that it's going well. i mean, it's working. it's not broke, let's not fix it. but if it's just 45 days, you know, i think we can probably live with that, by the way i usually do appear on saturdays with you, griff, from jenkins township, pennsylvania. which i would rather be there right now. griff: well, we send our very best to those jokes in jenkinstown, pennsylvania. no relation that i'm aware of. thank you for your time. i know you're busy and please keep us posted as always, we appreciate your insight. >> see you. so long. >> hopefully he can get back jenkinstown, pennsylvania, with a government that's funded, but it's an ongoing question. griff: you know, jacqui, it's fascinating, the first reaction from a democrat and cartwright is pretty much a middle of the road type guy, at least understanding how high the stakes are. we're going to talk a little more about this in the show. i have said privately all morning long, maybe no one is going to get hurt more than border patrol agents where i just came from this week, because they are in, as lucas reported, 260,000, the highest month on record, in what's essentially described to me by one border patrol agent in a cat 5 hurricane, because you don't get paid until the government reopens. >> border patrol has been part of the debate getting a bill to the floor. what was notable about the answers to me, he would likely vote present on a motion to vacate. typically democrats want to extract something if they're going to save kevin mccarthy from-- helping keep the speakership. you wonder if there was any sort of negotiation how that would work, but sounded look his answers was basically like we're not going to ding mccarthy for working with the middle to get the government funded and that's a notable answer from him, i think. griff: very much so. what we're going to find out, you know, look, we all have been paying attention, congressman matt gaetz seems to be leading the right flank to oust mccarthy and he was asked about it this morning. oh, i don't know. a cryptic answer. it's not clear exactly what it is that guys like gaetz wants in trying to remove the speaker. there's so much on the line as it relates to the border and then you've got the impeachment hearings, going to learn a lot, i think. >> there's a lot of dissenting voices within the republican conference. they had a meeting this morning and we want to bring in congressman don bacon now, a republican from nebraska, who i believe was in that conference meeting. >> i was. >> thank you for joining us. >> good morning. >> can you tell us how that went? what were your colleagues discussing in had a conference meeting that brought us to this moment here? >> well, the initial plan was to vote on the f.a.a. and ensure our military gets paid and more narrow provisions if we have a shutdown, but the overwhelming sentiment of the conference, we had about 200, 220 people in there, was that we wanted a clean cr with disaster relief. most of us do not want a government shutdown. 210 of us or maybe 200 of us somewhere on the republican side do not want a shutdown and a clean cr with disaster releif. and ukraine, but we've got to get this funded and the overwhelming on the conference today. the speaker said, i hear you, we'll do it. >> congressman, it seems to me, i just came to the border from eagle pass, i've been there the last eight or 10 days. the agents there are unbelievably worried about this government shutdown, they'd have to go without a paycheck, but have to show up to work because of the national security crisis, but yet, there are holdouts, 21 of them, it appears, of your party that many of them say that they're going to shut the government down in the name of border security. do you see an irony here? >> we don't have a governing majority here. we have five to 21 people, depending on the vote that will not support the republican majority. we put the most conservative bill ever for border security yesterday with a cr, a short-term cr with spending cuts and 21 voted no. in order you'll never get 218 republican votes to keep the government funded so my message, and i've had this since july because i've seen this, is you're going to have work in a bipartisan way and you're going to have to because you have the senate with two seat democrats, let's work bipartisan, and cut these are and follow up. >> congressman, why are the holdouts, they're saying it in the name of border security, are doing the most damage to border patrol agents, why? what is message? what are they doing it? >> some are doing it for noble reasons, some are social media, cable, some place, some areas want a shutdown. one guy calls himself a nilist in this group and i also like no one likes a cr. i've never had a continuing resolution, but in this case, shutting the government down is not the right answer. our border patrol deserves to be paid and for those who voted to shut down the government it's not the right answer, it's not the right answer for our border patrol, military, or folks at our airports, it's going to keep our airplanes flying. the only people happy with the shutdown are the russians, chinese, iranians and those who think that they can blame it on the republican party ifrments . >> congressman, how big of a lift to get two-thirds. that's a high bar. how likely that this passes? >> we'll leave a third on our side, who are fundamentally against a clean cr. i hope they reconsider. the democrats would consider this normally, but they're being pushed by their leadership to vote no so they can force ukrainian funding into the bill. >> now, i support ukraine, but we're going to have to deal with ukraine separately along with border security and we've got to deal with these. to put it in a cr is the wrong answer. in the end the democrats have to decide and republicans, do you want to vote to shut the government down because you want to fund ukraine? i don't think that's what the american people want. they want the government open and let's deal with ukraine and the border in the weeks to come. >> one more follow-up for you, congressman, we heard from matt cartwright from pennsylvania he would likely vote present if there's a motion to vacate. you're a member of the problem solvers, and you on the democratic side would be votes targeted for a motion to vacate. are any of your democratic colleagues considering the same to save mccarthy and his gavel if matt gaetz brings a motion to vacate to the floor. >> i do not some will do it, i don't know what the number is. a few will vote present or to support tabling a motion to vacate bill, so it's-- there's going to be some democrats that will help and i don't know what the numbers is. i don't think as republicans we should run away from this. this threat has been hanging over the speaker's head since january. i say let's hit it head on and let's be very clear. the individual involved here has no alternative plan. he has nobody who he wants as speaker that would be acceptable to more than maybe 20 people in the conference. let's call him out. he has no alternative plan. he is an undermining the republican majority. let's tackle this vacate the chair head-on. we can't run from it, let's hit it head-on and win. griff: i don't mean to keep putting you in the math box, so to speak, congressman, but going back to the cr, what's happening on the house floor behind you, do you have a sense for what the democrat buy-in number needs to be. the number roughly 290 that you would need under the suspension rules for this to pass, which is two-thirds of the house. and yet, you're talking about you might need as many as 90 to 100 democrats, is that correct? >> i'm hoping to get two third of both sides on this or better. hey, this is going to be a hard vote for people to vote no on. you're voting to shut down the government and doing it because you want to get money for ukraine. i support ukraine, but let's tackle this coming week, next week, let's not shut down the government. it's the responsible vote and i hope we can get two-thirds of both conferences on board. i know the folks i talked to last night on the other side of the aisle, my friends, they were torn. many of them said they're going to vote yes and some say no, we need to get ukraine money. i'm not sure how it's going to turn out. i think it's the right vote for our country. let's get this done. >> one more question, congressman, you want to fund ukraine, how will you do that? bring ukraine money separately and explain that for folks. i look at the numbers on the last ukraine funding bill and you have now half of republicans in the house voting against ukraine aid. that's an uptick in opposition from just a few months ago when you had roughly a third of republicans opposing it. so, if you're suppliesing out ukraine and planning to vote on it later. what are the mechanisms for doing that and are you concerned that you won't be able to get that done later on? >> i know a lot of republicans who voted no this week on ukraine funding and they regretted it. they felt pushed into doing it. those are the phone calls coming in, but i believe we've got to stand on the truth. if russia prevails in ukraine, our world security is worse. they will threaten the baltics, moldavia. and we've got to stand on truth, the i think the truth will win. the fact is, we're going to have a hard time doing this if it's republican-only. the democrats, plus half of the republicans will support this, but the best way to do this is in tandem with a border security bill that the republicans desperately want. we have fewer democrats in support of that. i feel we've got to have a tandem and i'm for better security at our border and for ukraine. i see thats at landing space to get both of these done. >> congressman don bacon from the problem solvers caucus. griff: great insight as a guy in the middle as a republican. >> he's one of the most vocal proponents of ukraine aid so to hear that he's not concerned necessarily about what this means for future ukraine aid, even if this bill that ultimately comes to the floor of the house does not have ukraine funding in it, you're hearing from someone who wants to see ukraine funded who is not balking at a bill that would not include that, i think which is a reflection of where things are right now in the house. they've got to get something done so we don't enter a shutdown because of the conservatives who want to pass individual appropriations bills, you can't do appropriations during a shutdown. your staff goes home. >> right. >> so i think there's been some come to jesus moment within a part of the conference there on realizing that that might logistically might not be as simple as you think. >> it's a great point you bring up, jacqui, the worse case scenario, where you get these things out and shut down, they can't get 0 the cr. matt gaetz is able to vote to vacate a speaker. you could have the government shut down without a speaker in a worse case scenario and you can't bring in a speaker without. >> and would like to bring in matt gaetz. >> give a phone call. >> we can check in with aishah hasnie. what are you hearing after that vote just happened, and chatter behind you. bring us up to speed. >> yeah, so let me just tell you what's happening on the house floor right now. we have it pulled up for our viewers. drama is going on on the house floor right now. the democrats basically filed a motion to adjourn, they want to go home until tomorrow and they're mad because they got the bill text an hour ago and don't have time to read it and they want to piece through it and make sure they know what they're voting on and tried to adjourn the house, that motion just failed by 212 nos, i believe. that means we're here and stuck in the chamber and we're not going anywhere until a vote happens on this continuing resolution that the speaker is putting forward. this 45-day clean cr, to fund the government. no ukraine aid, no border security, but would include disaster relieve. speaker mccarthy just left the house chamber and went back to his office and stopped to talk to reporters. i was able it ask him. look, people are frustrated right now feel like they haven't been given a minute to look this over. i asked him why didn't you bring the cr up on the floor maybe a week ago? it would have given republicans that 72-hour period that they've wanted to be able to read this text and it would have allowed democrats some time as well to huddle together and figure out what to do? and he basically shifted the blame back onto some of these holdouts saying, look, i have tried to pass everything. i have tried day in and day out and we've all watched him. he said that he's tried to pass a very, very, very conservative cr that would have included border security, would not have included ukraine aid. he tried to do what the holdouts wanted and they didn't go for it and the republicans didn't have enough votes so now that we're just now hours away from a government shutdown, this is all he can do now to avert a government shutdown. that was kind of his answer as to why we're doing this now and why we didn't do this a week ago. but again, folks feel rushed in this moment and so we will see what happens. it looks like democrats are headed back into the house floor after huddling on the side. and now we're just waiting for the vote to actually come up. and then we'll watch it live together here. >> aishah, let me ask you. our viewers are watching and hearing a lot about the holdouts and as you mentioned, speaker mccarthy seems to be unable to make them happy, to put one way. and yet, we just had a republican congressman on, don bacon, who said that they put forth essentially the most extensive border legislation ever put on the floor of the house. is it not enough? do we know specifically what the holdouts are drawing the line in the sand on? >> yeah, yeah, they don't want a cr, griff. simple as that. there are members that simply do not want a continuing resolution which for folks at home, a cr, continuing resolution, we use the terminology a lot. all it is is a stop gap bill, it's a bandaid, it keeps the government functioning under 2023 fiscal levels and so for some of these folks that are on the conservative end, they come from very deep red districts, what that means to them is that that is nancy pelosi's budget and the last thing they want to do is they don't want a vote on nancy pelosi's budget. they want their own. so the process of taking back the house when they came in in january. they were going to pass a brand new budget and cut spending and wanted to do it the proper way pan pass 12 appropriations bills, one by one, line item by line item and pass a fiscally conservative budget. that hasn't happened. so far out of the 12 bills only able to pass four and the government runs out of money tonight, but neither side has been able to do that. >> aishah, real quick because we've got to let you go, just for your audience, even as kevin mccarthy, he could pull a rabbit out of the house and pass this in the house. >> he can. >> can it go to the senate and pass the senate before a shutdown at midnight? >> that's the leverage. if they can pass this out of the house and speaker mccarthy has the leverage and basically looks at chuck schumer, now what are you going to do? today the senate is actually supposed to vote on their own version of a cr, and includes ukrainian funding which a lot of the democrats are for. that's what he's trying to have. the leverage to say you haven't done anything, we have a bill passed in a bipartisan fashion, what are you going to do. >> got it. aishah hasnie on capitol him. thank you so much, aishah. i know you'll keep watching the developments throughout the day. >> you've got it. >> meanwhile, hundreds of flights delayed or canceled in new york and new jersey this weekend as rain drenched the state, even leaving some passengers to wade through ankle high water in flooded terminals. cb cotton is at laguardia what it means for travelers. >> cb, my flight was canceled and had to take a train back to d.c. has anything i mproved today? >> and things are back to normal after serious setbacks for travelers. perhaps the worst one of the terminals started to look more like a swimming pool. check this out. a record rainfall closed terminal a just after 11 a.m. at laguardia. people walking through inches of water to get inside only to find drenched floors by ticketing counters and people even standing on benches to avoid getting wet. as flights through terminal a were canceled, travelers shuffled on the buses to get to other terminals to try to get their flights because the water kept rising and saw the small waves as cars tried to move through the mess. before midnight on friday, nearly 200 departing flights were canceled and nearly 2,000 more flights were delayed according to tracking site flight aware. and check this out. captured a plane landing in flood waters. by friday night terminal a opened in laguardia, hit the hardest compared to others in the city. still, governor kathy hochul reminding new yorkers, this weather set records across the city. >> there are some new yorkers who have never seen the likes of which we experienced yesterday. their entire lives. this event was historic and in some areas record shattering and it is the most rain ever recorded in a single day in a place like jfk ever. >> now, governor kathy hochul is talking about more than eight inches of rain that full at jfk effort which sets the record by hurricane irene in 2011 according to the national weather service. >> all right, cb cotton for us at queens, new york. thank you so much. >> u.s. border officials facing record numbers of migrants as lawmakers on capitol hill are trying to hash out the spending deal and avoid a government shutdown that could lead to agents without a paycheck. our senior correspondent, casey stegall live in eagle pass, texas. i'm guessing it's another busy morning? >> another busy day, indeed, griff. you know too well from your time out here. we've watched time and time again this morning, groups of migrants, illegally crossing the rio grande river. let's get you straight to the flight team drone. they queue up on the mexican side of the river and then they sort of gather on the u.s. side and you're looking at the u.s. side as they come up across the razor wire at times, which is being cut over and over again, and then it is rewired back up. that's a controversy all in itself. but the volume is just off the charts, which was unfortunately to be expected, considering back in may, they average about 3500 daily encounters and recently they're averaging some 10,000 a day, according to the data with more than 260,000 encounters, a new record for the month of september according to cvp sources. that rounds out the fiscal year with more than 2.4 million migrant encounters since last october 1st. you compare that to some 2.3 million for 2022. and about 1.7 million in 2021. the community of eagle pass has been hit especially hard. here is the mayor. >> as you know, last week i issued an emergency disaster declaration, the reason being is that this has impacted the city of eagle pass, so this emergency declaration is one of the prerequisites many times for us to get funding from the federal government. >> that emergency declaration continues until further notice. meantime, about 220 miles south of here, down in fronten, texas, look at this, the elite dps rangers operation group began clearing an island to use for operational security. an island under control previously by tco's or transnational criminal organizations. so the work continues around the clock out here even as we face this looming government shutdown, meaning the border patrol agents, all of the federal workers out here, working so hard to try to do their jobs would be going without a paycheck and on the same day, that we learn of this new monthly record being set for the month of september, more than 260,000 migrant encounters. it's the largest number we've seen this year. the previous record was december, griff, and this is well over that. griff: just stunning numbers. an agent told me i feel like i'm in a category 5 hurricane and my wife asking me if we're going to be okay, without a paycheck the answer is no. casey stegall, thank you. all right. now to the campaign trail. joining us is kirsten, a nikki haley surrogate, and a vivek ramaswamy surrogate. ladies, i suspect you want to weigh in and tell me how well your candidate did in that debate this week. it was fiery. it was exciting, but there's been a little bit of, shall i say, reaction from the guy that wasn't there, former president donald trump. so i've got to start right now kirsten, with you and get your reaction to former president trump with nikki haley, bird brain, he said about her and she's pushing back. kirsten, let you respond to that. >> i'm sorry, i didn't know if you were rolling something. no, i'm happy to respond to that. president trump is known for nickname, i don't know that bird brain is going to stick, as a former governor and ambassador to the u.n., i think that people know just how smart nikki haley is. i think that we're wearing it as a badge of honor that the former president is -- he knows that we're solidly in second place behind him and you know, this is going to be a really good conversation as this field continues to get closer to iowa. so, i think we're very happy with how she performed in the debate and i think it's a really good thing for nikki that the president is weighing in. griff: and trisha, let me ask you. nikki haley here in the second debate as well and saw it in the first one, really separated how she would be different from donald trump. how her positions differed, her honesty on things like abortion. vivek sounds much more in line with trump policies. how does he separate himself? how is he different than the guy that's polling at the top of the list. >> honesty is a funny world when you talk about nikki haley. thank god for double standards or she wouldn't have standards at all. she ridiculed vivek for using tik tok, and her adult daughter is posting them dancing, and maybe talk to your household before criticizing on the national stage and upset that donald trump called her bird brain. and then she called the smartest guy on the stage dumb. and she drew blood this debate and i'm glad it was her own, and "the washington post" and other establishment felt she did well, let's listen to what the people have to say. griff: i didn't intend to draw blood here. >> i think that happy calling people and holding them accountable for their positions and what she did with vivek on the stage and with tik tok and foreign policies and frankly going to be putting more americans in danger and called out ron desantis for his economic and energy policies, from drilling and fracking. she's shown that she's willing to call republicans and democrats out for their failed policies and for their, you know, positions and so, i think that's why she is come out of both of these last two debates in a really strong position and why we're looking forward to the next debate in november. griff: and real quick, only 30 seconds here, looking forward, what-- i'll let you start, trisha, what does your candidate and campaign say what we're watching on capitol hill about the potential government shutdown? >> i feel like it's clear we go through this annual at most. it's a farce, and these people get back pay and vivek talks about led with specifics, slashing 75% of the federal head count the american people experience every day the regulations, the vast taxpayer dollars that the deep state is impacting americans with and he actually has a way to shut it down and let's not have a fake government shutdown, let's have a real one. griff: kirsten, the last word. >> of course, look, i don't think that the border agents who are protecting our border, military personnel, i don't think that they want to see a government shutdown so i don't think we want to make light of that. i do think that the dysfunction in washington is something that i bet my money on nikki haley being able to fix so we're not swinging from cr to cr and shutdown to shutdown every year. griff: thank you very much. good luck to your campaigns and please come back soon. >> thank you. >> thank you. >> griff, the united auto workers union is expanding their strike. we will have the latest on negotiations coming up right after the break: it's because of tiktok that i had to go out and get a website. i'm at a point now where i've outgrown my house. growing up, every me i'd get out of the shower, i would itch. my first experience with goat milk soap, it kinda was like a light bulb moment. tiktok is a fantastic platform for diy. if you'd have told me three years ago that i would own my own business and be expanding into a separate building, i would've told you you'd lost your mind. from pep in their step to shine in their coats, when people switch their dog's food to the farmer's dog, the effects can seem like magic. but there's no magic involved. (dog bark) it's just smarter, healthier pet food. it's amazing what real food can do. >> the united auto workers union now expanding their strike and demanding improved protections against plant closures as electric vehicle production increases. jonathan serrie is live with more. hey, jonathan. >> griff, this week, michigan auto workers received visits not only from president biden, but also former president trump. grabbing a bull horn at a picket line near detroit, president biden said they deserved a substantial pay raise. >> and mr. trump visiting a nonunion factory criticized biden speeding to electric vehicles predicting it would lead to layoffs. >> and one of the things the uaw is to assert we need to preserve some of the jobs that might be lost because electric vehicles don't require as many people to build them. >> nevertheless, ev revolution is creating tens of thousands of new jobs in the south, including georgia where tax incentives and mostly nonunion labor pool have lured foreign automakers kia, hyundai and rivian to expand in the state and earlier i asked governor kemp about ev on auto workers. >> i'm not worried about people displaced from their jobs. there's other opportunities in states like georgia and in the south where gdp is now outpacing the northeast. so my message to them would be, hey, don't worry about it. come to georgia, we'll put you to work. >> state officials say in just the past five years, georgia attracted more than $25 billion in ev related investment and that translates to about 30,000 new jobs, griff. griff: jonathan serrie covering all things auto workers, jacqui. jacqui: for more on this i'm joined in the studio by the former u.s. trade commission chief economist and university of maryland emeritus business professor. thank you for joining us. >> good to be you. jacqui: i want to get to the amazon lawsuit, but let's begin with your reaction on this strike expanding. it doesn't look like things are headed in the right direction. as of a few days ago, they were not targeting ford. they said that there had been some progress with ford, which is why they only went to gm when the president was there, looks like things are back sliding. >> they can't come to and conclusion with either automaker for a reason. although they made a lot of money during the pandemic on gas powered vehicle, both cannot make money at the present wage rates and rules on electric vehicles. add another 40, 50% to labor cost you might as well shut down detroit and say the automobile industry is going to be in georgia and japan. jacqui: turning to the ftc amazon lawsuit for our audience who may not know about this. can you explain what's going on and for the stakes for anyone who has a prime membership and buys a lot of groceries or household products through amazon. >> when you go to the amazon website, for example, to buy a camera, you type in a certain type of camera, you get a bunch of choices. amazon gives preferential treatment to suppliers that promise know the to sell for a lower price on another website, and that use their logistics service, their fulfillment and their warehouse and delivery. those take up about 50% of the purchase price. so they're not in a position to say, offering the same camera someplace elsewhere, frankly, the costs are lower. what this does is bloat amazon's profits and raise the prices that you have to pay. the ftc really has a point here. this kind of tying requiring you to basically, forcing you to buy their warehousing and delivery services to list is what we call a tying practice. jacqui: so ftc is obviously trying to clamp down on what looks like a monopoly. they're trying to say this this is a monopoly and amazon is putting businesses in a tight spot. amazon says well, all of you people who buy your household products online you should oppose this effort from the government because you're going to end up paying more. what's the truth between those two perspectives. >> first of all, they have a monopoly, 70% of the online marketplace and the reality is, by prohibiting the top ranked people, the people you see when you do a search, from offering the product someplace else, where their costs of delivery and fulfillment would be lower, raises the price to consumers, it doesn't lower it. >> interesting. all right, thank you so much, peter, we're out of time, but i appreciate your perspective. thanks for coming out on a sat saturday. griff: great discussion. meanwhile, more than 25 years after the high profile murder of tupac shakur, an arrest had as been made by las vegas officials. more on the suspect right after the break. (vo) in three seconds, janice will win a speedboat. (woman) bingo! i'm moving to the lake. gotta sell the house. (vo) ooh! that's a lot of work. (woman) ooh! (vo) get your competitive offer at opendoor dot com. >> a man has been arrested and charged with tupac shakur's murder. during a news conference yesterday las vegas place say duane davis orchestrated the plan to kill tupac. christina, more than 25 years later. >> i know, griff. a big breakthrough. i did an exclusive interview with bob ladd one of the hmd detectives who investigated this in 1996. ladd testified before a grand jury a month and a half ago. here is his reaction to an arrest in this case, nearly three decades in the making. >> it feels great, man. i can't-- i cannot believe it. i was so happy that las vegas decided to go forward with it because back, like i said, 26 years ago, we told him who did it and sure enough, that's who they arrested with the case and they're going forward with the c case. >> 60-year-old duane davis was arrested one of the last living witnesses to the incident. and they say that his nephew was bought up in a fight in davis and in revenge davis orchestrated the plan to kill tupac. he didn't pull the trigger, but davis admitted in his tell-all memoir, he was in the vehicle where the shots were fired from and admitted to providing the gun used in the shooting. davis remains in custody without bail. now, coming up on fox news live today at 2 p.m. eastern, why it took so long to make an arrest in the murder of one of hip-hop's most influential rappers and also a quick look and some of the compelling evidence collected from the compton gang wars that followed tupac's murder, griff. griff: i remember that time very well. very fascinating to hear more on that. 2 p.m. eastern, christina coleman, thank you very much. jacqui: well, griff, the deadline for a government shutdown is now less than 12 hours away. we will have the very latest from capitol hill coming up right after this. personalized financial advice from ameriprise can do more than help you reach your goals. i can make this work. it can help you reach them with confidence. no wonder more than 9 out of 10 of our clients are likely to recommend us. ameriprise financial. advice worth talking about. hi, i'm michael, i've lost 70 pounds on golo. i spent thousands on other diets that didn't work. on golo, i spent a couple hundred bucks and got back down to my high school weight. you're not gonna believe this thing is possible but it is. ♪ ♪ >> welcome back. the house is now in session expected to vote on a 45-day spending bill to avoid a government shutdown as the deadline
