hunter biden. now weiss says the agreement well apart in july along with hunter's plea deal on tax charges. team hunter disagrees indicating both sides signed the diversion agreement. meanwhile congress now is looking into whistleblower claims that the secret service tipped off hunter biden to a potential i.r.s. interview which foiled those plans for the interview one month after the election of 2020. jonathan turley telling us last hour congress has no choice but to pursue the evidence. >> this is going to end up with a confrontation between congress and the administration. the question is why the administration is doing this? it's like a game of chicken and they want to see if congress jumps out first. well, congress can change the game. they could start an impeachment inquiry and they could say look, we want these answers. >> dana: we're live in washington. last week we said this court hearing will be a week from today. here we are, david. high stakes for hunter biden? >> it really is because remember, hunter biden's plea deal collapsed on july 26th in a very public way in open court. technically the final piece to fall is this outstanding diversion agreement that bill just mentioned. a federal judge is waiting for updates due at some point from both sides on this agreement today. per the original plea terms hunter expected to avoid jail time for lying on a federal gun form as the diversion agreement. last month his attorney wrote to the judge and said the agreement, though, is binding and valid as both sides signed it. the defendant intends to abide by the terms of the diversion agreement. that was executed at the july 26th hearing. special counsel david weiss's team indicated the exact opposite putting up a clear roadblock to hunter biden's team writing first the government did not renege on the plea agreement as the defendant inaccurately asserts in the first sentence of his response. to reiterate the now withdrawn diversion agreement by its own terms is not in effect. what's not clear, dana, is what the judge will ultimately say as both sides could not be further apart on this issue. she dismissed the tax portion of the case which was expected. special counsel weiss indicated he plans to refile charges in california where hunter lives or perhaps washington, d.c. the fighting inside the u.s. capitol is getting more intense. yesterday homeland security secretary mayokas and others within his department including the secret service, which falls under dhs, received subpoenas for more information about the agency being tipped off from the i.r.s. whistleblower who was going to interview hunter biden in december 2020. since hunter was tipped off, it never happened. >> dana: david spunt. thank you for being on top of it. >> bill: state police will give an update in a couple hours on their manhunt for this convicted killer who escaped from prison last week. the search for cavuto expanding after trail cameras at night got a glimpse of him at a popular and very large botanical garden south of the police search perimeter. nate foye is in westchester, pa to give us an update. >> we just got off the phone with pennsylvania state police. they confirm cavuto is out there now and the search very much active. you can see behind me authorities have shifted the search area a bit farther south because just north of here there was a two mile search radius where cavuto snuck past police and they learned that through these surveillance images from that nearby botanical garden you mentioned. he was seen twice within the same hour monday night. the last known public sightings that have been communicated with the media by state police. he picked up a backpack, a duffel bag as well as a sweatshirt. state police say they wish they could have held that perimeter. the movement might lead to his arrest. listen to this. >> i want to push him hard. he have will make mistakes. he will show himself. he have has already shown himself, we believe, a few times. we'll contain him and eventually catch him. he is desperate and does not want to be caught. very little to lose at this point. >> cavuto is extremely dangerous. he established his former girlfriend 38 times in front of her two young children and received a life sentence for her murder and accused of another marred in his home country of brazil. he is an illegal immigrant and border patrol and f.b.i. are joining u.s. marshals and state and local authorities in trying to find him. residents here are urged to lock their doors for their safety and also so he doesn't get any more supplies. two local school districts canceled class for a second day because of this search. many roads are blocked off right now and that press conference from state police will happen at 3:00 today. >> bill: we'll be matching. nate foye in the philly area. >> dana: bring you more on this is a former commander for the fugitive task force in new york. what do you think about him and his state of mind on day six? >> good morning, dana. human instincts have certainly turned into animal instincts. sleeping with one eye open, hungry, tired. desperate people do desperate things. he is starting to break into homes. he needs provisions. more importantly law enforcement a full-court press. u.s. marshal service is involved. premier agency in this country in finding people. it's a joint effort. they are hitting on all cylinders and have the appropriate assets in place. aviation support, blood hounds, drones are flying. i think it's a matter of time. >> bill: the way you are talking sounds like a matter of time. the perimeter they set up, you believe they believe he is inside that perimeter. how large is that and what gives you a level of confidence for that? >> from what i understand i did speak to somebody down there a rough terrain. the underbrush is very thick. little advantage to him that way. he is five feet tall. 120 pounds. the perimeter is set up within two miles. he is only a couple miles from the jail. i have think he is within that perimeter and the bigger question is what is his mindset. once that noose and perimeter tightens up. is it suicide by cop, does he get into a house, a hostage situation, law enforcement needs to react appropriately and hopefully this thing gets put to bed without incident. >> dana: we don't know about how he broke out of that jail. there was another one within the last 6 to 8 months who broke out of that jail. the cost of trying to track him downs. kids not going to school when school gets back. parents figuring out how to care for children and missing work and all for somebody that had a life sentence he was serving. in terms of his mindset, when somebody like that breaks out of prison, do they think they are going to survive it? what is it that they want to give back to the world? and that's what we do at the forest school and how i kind of fell in love with the model and thought this is where i need to be. this is where i need to be pouring into the children. >> dana: you are also a teacher? >> yes, i am. we call them guides, not teachers. >> dana: marcy, what drove you? was there a breaking point that made you decide i've got to get my kids a different situation? >> yeah. we -- within the public school we have had a great experience. we have four children and range over eight years. there was a decision for us that when one of my daughters was in a place having trouble making her own decisions and choices. she would do whatever it is you told her to do and we knew we wanted to equip her to be a leader in the world to make her own decisions and know who she is and be able to be empowered for making the choices. the forest school is the model that had the ability to think for themselves, disagree with one another in a loving and respectful kind way and to contribute to society in a more meaningful and impactful way. >> dana: people think it might be good for my kids. what sets forest school apart and i'll let people read the thing at your website. one of the things i thought was interesting is number ten. apprenticeships begin in middle school. amber, tell me more about that. >> yes. definitely. in is one of the things that kind of helps us stand out. how do you know what you want to do in the world if you haven't experienced it? so our starting at six grade our middle schoolers have to do one apprenticeship a year. in sixth grade and seventh and eighth and then throughout high school they do four apprenticeships a year. before they leave the forest school they have had a chance and opportunity to really dive into different fields and see what it is that inspires them. >> dana: one of the things that was so troubling across the nation, marcy, is the rise in school absences. let's pull this up here. this was in the "new york times" on tuesday and you can just see here that some people are missing more than 10% of school, up to 40% of students there in michigan. i wonder about one, what you would require at the forest school in terms of attendance, and also tell me just about the contract that you sign with yourself as a student to deal with discipline and punishment. >> for me or for my kids. >> for marcy. >> we don't have an attendance policy. it is a wonderful way of if your family is on a trip or they can experience the world. as a family you can travel and your kid can still do school wherever you are. now some of our -- community based and we need to be on-site for some of those things. we have an online school that's 100% online. a lot of flexibility as a family, as a student. and being able to kind of do school from where you are. and the kids do lesson and homework. >> dana: the last word from you, amber, how you deal with discipline and behavior in the school. >> if you think about it, we have to self-govern and we start that at the youngest age. we teach them about ways that they can make rules, decide on consequences together so at the beginning of the school year we do a cool thing. we have experts come in and give feedback on contracts that heroes themselves, our students, have created. once they have signed and created this contract, that is the thing they live by. they hold each other accountable when they do break those rules. we have a counsel in each of our studios upholding our rules for our students. >> dana: incredible stuff. very interesting and i'm sure there are a lot of parents thinking about these things for their children as well. amber and marcy, great to have you on the show. thank you so much. >> thank you. >> thanks for having us. >> bill: 22 past the hour. senate minority leader mitch mcconnell back before the press today. what will he say about his health? that was the last line of that thing there. 10:30 here in new york. questions over senate minority leader mitch mcconnell's health in focus today. he will make his first appearance in front of the press corps since he froze up in front of them in july. chad pergram is live in d.c. good to see you. good morning. >> bill, good morning. mitch mcconnell froze up the last time senate leaders met the press corps in late july. the first time reporters can ask him his health since then. most senators stand behind mcconnell. >> i'm not qualified to assess why mitch mcconnell has lost 20 seconds twice but there are another 86,000 plus second ounce in a day he does a fine job. i'm confident this is just happening in the times that he has been in the public because everything is public when you are in the kind of position he is in. >> attending physician for the capital says mcconnell is not suffering strokes or showing signs of park insan's disease. his kentucky colleague rand paul. he is skeptical and has questions about what's going on. >> with my medical background, this is not dehydration. there is something else going on. do we only have two episodes or one episodes a day that we don't know about and that's not happening in public? >> there are whispers in the capitol and kentucky about mcconnell's long-term viability and questions about the health and age of president biden and senator feinstein of california. >> john fetterman who is relatively young but he has a challenge that he is working through. the voters in pennsylvania made the decision based on -- knowing his challenges and he won and gets to serve. >> mcconnell only alluded to his health problems in brief remarks yesterday. we'll see if he fields questions about his health later today. >> we'll be watching. chad pergram on capitol hill. >> abortion poised to an issue in next year's presidential election. it is the top priority for democratic voters topping the economy and climate change. here to talk about it is kayleigh mcenany, co-host of "outnumbered." you had a chance to talk to ron desantis about all this. >> i did. one of the things we talked about was supporting women during pregnancy. you didn't hear a single candidate on the republican debate stage including governor desantis talk about supporting vulnerable women. a lot of good answers on the debate stage but that has to be a key tenet. he committed to supporting child support mandates for states. men must pay women during pregnancy. we know a lot of women don't have choices in the matters and financially dependent on boyfriends or whoever else and not their choice. this would give women options. a choice if you don't have options. >> dana: let's play a little bit of your interview. >> senator rubio proposed the child protection act that would give child support from the moment of conception. is that something you would consider to force men to give women? >> most of these women don't want to have abortions but feel they have no other options because they get no support because a lot of these men are nowhere to be found. they should absolutely be providing support. >> dana: do they have that law in florida? >> no, not currently. he did extend maternal healthcare coverage up to a year after birth. he has done reforms for foster care incentivizing adoption. i would love to see that nationwide and senator rubio, kramer have a proposal. commit to it and support women. >> bill: it's been on the ballot in deep red states and it has lost. kentucky is one, kansas is one, a big vote in ohio in two months. what did you find out about that? >> every pro-life ballot initiative has lost. pro-choice has prevailed. they are having two problems on the ground. education, voters read the language that it's fluffy that talks about contraception and individual rights and don't understand the repercussions. when you have the health exception you allow abortion until birth. an individual having a right to abortion. adult. you are opening the door for minors. pro-choice ballot initiative passed. there is an education problem and enthusiast many. young women are going to the polls. how does a pro-life ballot lose by 25 points? republicans are not enthused and not turning out on the issue of life and it has to change. >> dana: former vice president pence said this last hour. >> i called for a minimum standard. once a child in the womb can feel pain, i think we ought to ban abortion as cross the country at that point. if i'm president of the united states they will have a champion for the right to life in the oval office. >> dana: when you talk about pro-life audiences and voters. they pick up on the code words. the feel pain piece. >> it's very smart for the vice president to reorient the discussion around pain. when does a baby feel pain? if you are for abortion you must answer that question. dr. ben carson told me it is around 15 weeks. make this about pain, compassion, supporting women, and i think you can change the conversation. may take time but republicans have to get better. the ballot initiatives are in eight states in the 2024 election. >> dana: including arizona and nevada. >> bill: if candidates can't put out a response we're not going to win. she runs the rnc. >> nikki haley can you get 60 votes in the senate? probably not. majority of the house? probably not. she is pointed to reality and other candidates are pointing to principles. competing values here. >> bill: more interviews with governor desantis. >> dana: thank you for doing these things and great to have you here. what do you have? >> not just that. there is a lot that is in this statement that they put out yesterday that they claim becky hill did. we've only heard their side of this story. but they have two possibly three jurors who wrote sworn affidavit testimony saying that she said a number of things to them. don't let him fool you when he is up on that stand. watch his body language. she said we will wrap this up very quickly once we start deliberating. they say she wouldn't allow -- six smokers on the jury taking regular smoke breaks. don't let them go out until you are done deliberating. the most crazy story is this facebook-related removal of one of the jurors, one of the people who signed the affidavit where they said her ex-husband had posted something during the trial that indicated that she had already made up her mind about the jury. then it turns out the person who was her ex-husband didn't really post it. she was removed from the jury based on this. and there is also speculation that she may have been waivering in her feeling about alex murdaugh's guilt and that maybe she was targeted by becky hill as someone who needed to be removed. all that needs to be proven still. there is going to be a hearing on all of this and this case is looking like it could very well be reopened. >> dana: call for number four. the attorney general saying -- of georgia. we're reviewing the defense's latest motion and respond through the legal process at the appropriate time. there will be an investigation. i wanted to play this clip. i knew you went down to do the interview of buster murdaugh, the son of alex and this was interesting. this clip goes directly to what we're talking about today. listen here. >> 12 jurors all agreed that your dad killed your mom and paul. >> that's right. >> what do you think about that? >> i don't believe it was fair. >> why? >> i was there for six weeks studying it and i think it was a tilted table from the beginning. >> dana: you imagine that he hears all of this today about becky hill and the book and the rest and might agree? >> the crazy thing is that nothing that came up yesterday has anything to do with the evidence or the murders or the case itself, which those 12 jurors did agree he was guilty of, right? but this is the way the american justice system works. this woman had to be completely unbiased. she has a very influential position and oversees logistics for the jury. she had to completely separate herself from this case. if she did not, if they can prove she did not, alex murdaugh is going to have another opportunity potentially to have this trial go a different way. he has 120 some financial charges against him as well. he is very likely to spend the rest of his life in prison on those as well what he admitted guilt to on the stand. this is a long way from over. i talked to judge jeanine and said it could take 4 or 5 months and likely they'll have to move the venue. the clerk and everybody else is cozy in hampton. >> dana: the fall of the house of murdaugh is available now on fox nation and you can see martha there. >> bill: thank you, martha. see you at 3:00 this afternoon. thank you. >> dana: president biden masking up after jill biden tests positive for covid. is it necessary? >> first of all that's right. cdc has been an international outlier, the rest of the world has followed the science done on masking. many people are acting as if there has not been a formal scientific evaluation of masks during the pandemic. of course it's been study and the cochrane analysis done of the 150 other studies done on masking came up with the conclusion that some people just didn't like, that the masks had no impact on the trajectory of the infection. i didn't like it. i was hoping masks were going to help, but you have to listen to the scientific studies. you can't ignore it. why are we doing scientific evaluations if we are going to ignore the results if it doesn't fit some policy agenda? >> you have some elementary schools in the state of maryland requiring students to wear a mask. here is the quote now. students and staff in identified classes or activities will be required to mask while in school for the next ten days except while eating and drinking. masks will become optional following the 10-day period. apparently they had three individuals test positive and that note went out to parents. fauci just said what the cdc is saying is a recommendation, not a mandate. that sounds like a mandate to me from that school. >> it does sound like a mandate and it's amazing how we're holding onto a couple really scrappy studies that have been debunked that the cdc put out to justify masking. we've ignored the entire experience in europe. we've ignored -- we basically have had a clinical trial with schools masked and unmasked in the united states. amazing how masks have become a political badge. naked allegiance to a partisan agenda and not paying attention to the data. if schools are closed or have to wear masks, have parents ask for the research and present the cochrane analysis to the school boards. >> bill: people who have gotten the vaccinations and boosters and still getting covid. in some cases like the first lady they are getting covid twice. so i guess i would ask you what have we learned through this 2 1/2, 3-year process. >> there will be another covid vaccine and broadly recommended later this week. you can take six doses of the vaccine or you can take 100 doses. we've learned it won't stop this highly contagious, this very sticky virus from jumping into your nose and starting to replicate before your immune system can respond. it has no impact on infection. the severity of disease is downgraded from prior infection and prior vaccination. we have to accept it's a seasonal virus now. we are making a mockery of the scientific process and fda regulatory process by ignore data and not requiring new data for things like the new vaccine. >> bill: i respect your opinion. don't you think if we will get more cases you will find corners of america that go back to masks. they'll just do it. >> people will reach for masks because they've been told for 2 or 3 years they're effective. the cochrane review is clear. you put two people in a room with a high quality n-95 mask tightly fitting and for a brief interaction you can reduce transmission. on a school level when people are wearing masks on a community level there was absolutely no benefit. why are we even doing these research studies if people aren't listening to the results?
