commercial airline and no public school can impose the misguided policies of the past. the bill would also restrict federal government spending that would fund implementing any mask mandate. some scientists have advised wearing an n 95 mask properly and securely on individual level can help prevent transmission. recent covid accounts far less detailed than they were at the beginning of the pandemic. centers for disease control one week period in the middle of last month saw nearly 19% increase in covid hospitalizations. scientists say they are also watching a handful of new variants president biden's age. and now famed pollster nate silver writes if the expert class doesn't understand that biden's age is both a real concern for voters and a valid concern, they had better be president said is that he has not had a chance to break. we know, in fact, when he was in lake tahoe like two weeks ago, he extended his break. he was going to come back on a thursday. he came back on health of two key members. both minority leader mitch mcconnell and veteran california democrat dianne feinstein have had ongoing medical issues. chad pergram has the latest from capitol hill. good evening, chad. >> bret, good evening. senate minority leader mitch mcconnell was mum about his health problems during his return to the capitol. he only alluded to freezing up a few days ago. >> now, one particular moment of my time back home has received its fair share of attention in the press over the past week. but i assure you august was a busy and productive month for me and my staff back in the commonwealth. >> while mcconnell did not shed light on his health, the main congressional doctor did. attending physician brian monahan would not say what caused mcconnell to freeze. but monahan ruled out a stroke or parkinson's' disease. monahan's letter was the most information we have received about mcconnell's health. when the capitol physician comes out and puts himself on the record like this, i find that reassuring. it's not likely, very unlikely that he would fabricate anything. he has his medical ethics to be dealing with here. >> mcconnell did not answer two questions i posed to him in the hall, one, we update the public on his health and, two, does he know what's afflicting him. senator minority whip dick durbin says is he going through recovery from a concussion and that can take a toll. >> i told him i couldn't wait to see him back and i couldn't wait to disagree with him and i'm sure we will have that in the fear future. >> why he did not discuss his health did he talk about a government shutdown. >> need to address our nation's most pressing needs with timely appropriations and we need to keep the lights on from october 1st. >> the only way we will finish the appropriations process is through bipartisanship. >> there is no progress on an interim spending bill. the house doesn't even return until next tuesday. bret? >> bret: chad pergram live on the hill, thank you. james comer has subpoenaed homeland security secretary alejandro mayorkas. several department aides and secret service officials. is he looking for documents and testimony related to the secret service's alleged tip off of the biden transition team regarding a planned hunter biden tax probe interview in 2020. comer is also accusing the agency of obstructing the congressional investigation. ♪ breaking tonight within the past hour, the sentencing of the leader of the proud boys, political group implicated in the january 6th, 2021 capitol riot. correspond david spunt has been following this and tells us what happened an hour ago. >> this came down in the last 30 minutes. hearing was almost four hours to sentence proud boys sentence enrique tarrio thought to be the last major sentencing of someone charged in connection with the january 6th riot. tarrio the former leader of the proud boys extremist group sentenced to 22 years in federal prison by a judge. the government, bret, requested 33 years. ultimately judge tim kelly donald trump appointee 23 years fit the crime better. tarrio wasn't even in washington, d.c. january 6th, 2021. he was arrested two days before in washington for burning a black lives matter banner and possessing high capacity firearm magazines. a judge ordered him to leave the city on january 5th, 2021. federal prosecutors say he still planned the group's mayhem that unfolded on january 6th and charged him with sedition conspiracy. the 29-year-old faces very serious rarely used charge. the judge sentenced ethen nordean and biggs 17 and 18 for the same charge. zac relative got 15 years behind bars. all significantly less than the government requested. remember the queue than sham monday he was requested for 41 months. navarro. he is charged with contempt of congress after he refused to cooperate with a congressional investigation into the capitol riot. navarro has said that the former president invoked executive privilege. barring him from cooperating with the house january 6th committee. his trial is expected to last through the end of the week. stocks were down on rising oil prices. the dow lost 196, the s&p 500 fell 19. the nasdaq dropped 11. we will talk about those oil prices in just a bit. up next, why the man convicted in one of the most sensational trials of the year wants new proceedings. we'll >> yes. >> including this woman clerk of court rebecca hill who wrote a book on the trial which murdaugh's lawyer says prompted several former jurors to cooperate with their investigation. >> when the clerk of court wrote her book, published her book, that zone of silence collapsed. >> in a sworn affidavit, one former juror states before mr. murdaugh testified the clerk of court rebecca hill told the jury not to be fooled by the evidence presented by mr. murdaugh's attorneys which i understood to mean that mr. murdaugh would lie when he testified. >> if the defense can prove the blockbuster allegations that they make in this motion for a new trial then i think there is a reasonably good chance that murdaugh might actually get a new trial. >> prosecutors allege murdaugh killed his wife maggie and younger son paul to distract attention millions of dollars in drug fueled financial crimes. murdaugh's surviving son buster told martha mccallum he believes his father is not the murderer and that extensive pre-trial publicity in their small community convinced jurors otherwise. >> it was predetermined in their minds prior to whenever they ever heard any shred of evidence that was given in that room. >> and murdaugh's attorneys also allege the clerk of court pressured jurors to come up with a speedy verdict and held private conversations with the foreperson. we reached out to the clerk's office for comment but have yet to hear back. bret? >> bret: jonathan serrie in atlanta. jonathan, thanks. >> bret: also breaking tonight, the search intensifies for an escaped murderer who broke out of prison last week in pennsylvania. state police say calf ceant has obtained clothing did duffle bad other supplies. nate foy has update from new york. >> the search expanding tonight. joining the manhunt as police said the escaped murderer slipped through troopers who previously had him surrounded. they learned that through these surveillance images at a botanical garden about five thils south of chester county prison. cavalcante seen twice about an hour apart new sweatshirt, backpack and duffle bag. >> they found that he could squeeze through that perimeter and he traveled south. we'll now expand that perimeter and move it so that we can try to incapsulate him again. he will slip up. we are making him move and that's a good thing. >> brett, just days before his escape he received a life sentence for murdering his former girlfriend back in 2021. prosecutors say he stabbed her 38 times in front of her two young children. the convicted killer is also accused of another murder in his home country of brazil in 2017. u.s. marshals say he entered the united states illegally. he has been seen six times since his thursday morning escape including by a state trooper sunday night who tried but couldn't catch him. authorities are using a recorded message from cavalcante's mother to try to convince him to peacefully vurend. broadcasting that message from helicopters like this as they search the area. two school districts canceled class because of cavalcante. deb ryan calls him extremely dangerous. authorities are urging residents to lock their doors not only for their protection but also to stop the escaped murderer from gathering more supplies authorities are offering $10,000 for information leading to his arrest. state police say he is desperate which makes him even more dangerous. bret? in the short-term and long term higher prices. -opec and russia checkmark to the global oil market. they are sending a message to the biden administration that they are in control and that you better not mess with them anymore because they're going to reduce supplies. and this is coming at a very critical time here in the u.s. bret we are seeing u.s. splice fallen over 30 million barrels since july and tighten more with this cut. >> bret: put up the charts crude oil cuts futures contract. crude oil prices rising above $87 for the first time november -- since november 2022 last time oil neared 90 da dollars the u.s. strategic petroleum reserve had 250 million more barrels of crude oil than it does. if you look at the last three months it's a steady rise here. so, consumers are feeling it, right? >> they are going to be feeling it and probably more than ever and it's great that you pointed out the strategic petroleum reserve. because the releases from the strategic petroleum reserve, bret, gave the markets this false sense of confidence that everything was okay in the global oil market by releasing this oil the artificially lowered prices. they discourage investment. oil production starting to plateau at a time where it normally would be rising to meet demand. that's not happening. that's leaving a void. now saudi arabia and russia are taking advantage of this trying to stick it to the united states by cutting production and there's not anything that we can do about it. >> bret: yeah, let alone the oil producers who say the biden administration has tied their hand on regulations, et cetera. i want to put up another scary chart. this is about what debt americans are holding. this is total household debt in the u.s. at a record high of 17.6 trillion. americans borrowed more than ever on their credit cards in the last quarter with balances surpassing 1 trillion with a t for the first time. and credit card delinquencies are at 11 year high. this chart is a scary chart. >> it's a very scary chart. a lot of that, bret, is caused by inflation and government spending. right? competing in the invictus games started by prince harry in 2014. fox news spoke with several american athletes between their practice sessions at fort belvoir, virginia about overcoming near fatal illnesses and injuries. here is chief national security correspondent jennifer griffin. >> sergeant first class lauren montoya joined the army at age 19 and served on elite team of u.s. special forces in afghanistan. in 2014, a rom bomb struck her vehicle causing the loss of her left leg in a traumatic brain injury. a decade later, she has learned not just how to walk but to run she is 2023 is almost always the number one thing they bring up. the thing they bring up is saying you don't want to vote for joe biden today and not being willing to vote for joe biden next november if it is ultimately him against donald trump is a different equation. a lot of the 2024 presidential election trump biden rematch a lot of voters holding their nose and voting for someone they might not personally like and not want to be president but they like them better than the other guy. >> bret: you heard karine jean-pierre, charlie say can't keep up with the president, so much energy. every day there is something. just moments ago at this medal of honor ceremony the president delivered the speech and then, before the thing was over, before the convocation, we know they do the prayer at the end, he just walked off. and people didn't know whether he was going to stay or go. and he walked off and then everybody stayed and they did the convocation. my point is that every day there is some thing. >> yeah. no. he just wandered like he wanted to call in a silver alert. he just wanders off. the age thing is a real problem. and i think that, you know, when you look at the polling, today, the matchups between biden and trump, you know, first of all, the idea that you get 77% of americans who agree to anything is pretty extraordinary these days and to have 77% think that joe biden shouldn't run again is fairly extraordinary. but, when you look at the parody that's just sort of on the age issue and the trump fatigue issue. once you get into a campaign, it's going to be about i. and once you get to the issues, i think biden is going to lose even worse in a head-to-head matchup against trump or probably any republican for that matter. but, when you get to talking about things like inflation and the border, and these other issues, it just compounds the age issue. so the age issue is a terrible place to start. and then it just kind of goes worse from there. >> bret: so, just we'll end on this. and this is senator minority leader mcconnell today. barely mentions his recent health issues. >> one particular moment of my time back home has received its fair share of attention in the press over the past week but i assure you august was a busy and productive month for me and my staff. >> bret: obviously referencing the freezing moments in the last couple of months. senator cornyn about mcconnell's return says i'm glad they were able to rule out some of the things people speculated might have happened. it appears it's harder to recover from a concussion when you are 81 years old than he thought but he feels like he is up to the task. obviously you have got senator mcconnell. you have got senator feinstein. these folks with their health concerns do they reflect back on president biden in some way politically? >> once taps concern we have this gerontocracy running the country you have a conversation about that. the thing about it it's being used as leverage by republicans to try to somehow say oh, you know, biden shouldn't be running. look at the high percentage of democrats who would like to see someone else. but, overall, i think voters are saying they would like to see change. they would like to see a new generation of leadership. a new vision. they don't want to get locked into the same contest that we had in 2020. and i would also add this: that when people talk about biden and his age, boy, it's different if they could focus on trump who is only three years younger they would say wait a second look at our concerns have more to do with corruptions, malfeasance, all those kinds of things. with biden, i disagree with charlie. they are not talking about the economy. they are not talking about hunter biden. that doesn't seem to be sticking in the way that would have given advantage to biden's opponents previously. so they come back to age, age, age. and that's where democrats do agree that he is old. but to pick up on susan's points. if it's a binary choice come november 24th. democrats and you can see democratic establishment candidates not running in the primaries, they are saying oh no, we think he is the guy to beat trump. >> bret: it is striking those differences between president biden is he too old? president trump is he too old and the difference in a poll is striking. all right, turning topics to covid. here we go again at the white house karine jean-pierre talking about this today. >> since the president was with the first lady yesterday, he will be masking while indoors and around people in alinement with cdc guidance. you can expect both of them will get their updated vaccines like all americans who are eligible should do so. >> the various shots that people are getting now it differently as a country, aren't we? >> of course. we're in a radically different place than we were one, two, three years ago. most of the country has some form of immunity either through vaccinations or a lot of people had covid already. the attitudes about covid policies have changed. absolutely. i think there is going to be a difference in the distinction between communities or institutions or businesses that might decide that they want to have mask rules put back in place. i'm very skeptical that you are going to see it from any government agency. certainly the governors seem to have very little interest in it regarding of party. governor patri pritzker was askd about mask mandates and dismissed it out of hand. many of them still believe in the policy of masks. they recognize that the policy of mask mandates aren't on their side and the public doesn't want to do it again. >> bret: not only that, the science may not be on their sides either. j.d. vance, republican from ohio, wants to put a law in place to make mask mandates illegal. >> yeah, this is one of those things where i think it's probably a great idea. it's very smart politics. but, you know turning to for example the vaccines. no one would have thought you needed to protect people from being forced to cake vaccines but that's where we wound up in all of that. i hope we do it differently. >> i hope
