there are some serious voices out there suggesting that perhaps president biden doesn't make it until the end of the year. one of those voices is his biographer, and he may drop out. >> if joe biden announces he's not going to seek a second term, how much of a surprise would that be to you? >> i would say it would be a surprise to me but it wouldn't be a total surprise. >> not a total shock. >> not a total shock. would it be a shock to you if that happened? >> it would be somewhere between a surprise and a shock. the big reason is i don't think joe biden is going to wake up one day and say you know, i'm too old to be president. he might say that his, he just feels too tired to do it, but this man has sought the presidency for decades, for 50 years. and he's got it and he's not going to just let it go. so, he has his democratic party lined up behind him to run for another term even though everybody knows he would be 82 years old when that term begins, and 86 years old when it ends and they have seen him slow down already. so, if the democratic party is lined up for that i find it hard to believe that president biden is just going to say gosh, i don't think i want to do it. >> anita: what about the democratic governors out on the campaign trail supposedly stumping for him but also introducing themselves to the rest of the country. could they be possible replacements? and let's put some of those people on the screen. gavin newsom from california, gretchen whitmer from michigan, wes moore, josh shapiro, these are high profile governors that are looking to be even may more high profile. what do you think about some of these folks possibly stepping in if biden steps out? >> interesting. we do have a new wall street journal story talking about them, going out and politicking, campaigning for president biden, and that's the thing that loyal democrats do, but the article is framed of them -- as if they are trying to position themselves to succeed biden in 2028 and you read it and think what about 2024. it's not absolutely guarantee that joe biden is going to make it all the way, so i think that all of these people that you mentioned, moore and newsom and gretchen whitmer, josh shapiro, think if they go out and are good loyal party operatives, campaigning for the president and something unexpected happens next year and joe biden does not run for president, they will be in a good position to take advantage of that. so, i think they feel any campaigning they do right now will pay off sooner or later. >> and where is the vice president in all of this, kamala harris. how come her name was not mentioned in that article? >> well, the interesting thing about that article, even if you talk about 2028, everybody is saying now the democratic world that these potential candidates are not going to defer to vice president kamala harris. they are not going to say oh, she is the rightful successor to president biden, i won't run against her. i think they are all planning to run against her because she's really done a very lackluster job and her job approval ratings are a bit below 40 right now, and they have been that way for a long, long time, and she's just generally not perceived as a popular vice president and that makes her vulnerable politically inside the democratic party. >> anita: we hear a lot of people making comments about president biden's age and recently he said something about his age. hear what he had to say. >> i tell you what, someone said, you know, that biden, he's getting old, man, i tell you what. well guess what, guess what, i -- the only thing that comes with age is a little bit of wisdom. but i'm -- i've been doing this longer than anybody and i guess what, i'm going to continue to do it with your help. >> anita: doesn't sound like he's dropping out right there. a quick comment what he had to say. >> i think he's telling the truth right there, and has also gotten some advice to make some jokes about his age, and you'll hear him referring to him doing something 2, 300 years ago, making a little joke about it. this he was actually serious and i think he's telling the truth. i think he thinks he's got wisdom of age and he wants to remain president. >> anita: sounds like it to me. i agree with you. thank you for your comments. >> thank you. >> anita: humor is the best way -- >> alicia: and there was a wall street journal poll and they talk about how voters are concerned about age for both former president trump and biden, but more concerned about biden. >> anita: president trump does seem a little more sharp, about you he's got lots of other issues and we'll see what happens there. >> alicia: we will continue to watch, for sure. just days before the annual g20 summit, tensions with china ratchet up. commerce secretary says she did not "pull any punches" when she confronted chinese officials about hackers suspected of accessing her emails. but is the biden administration doing enough to prevent all of china's espionage acts? we are talking about president xi and all the people underneath him. they are not going to tell her the truth. >> yeah, alicia, thanks for having me today. look, they really don't care. the level of disdain that they have, and you saw how with the secretary, and also with janet yellen, and before that with blinken, and before that the snub of our secretary of defense lloyd austin in singapore. so what they do, they just act and really don't care what happens because they don't have the respect for the united states. and why that's important. it shows to adversaries or anybody that may want to threaten us there is very little risk of pushing back on the united states and because of that, we really don't have a plan to counter china. we don't have a strategic plan at all, economically, militarily or diplomatically. i understand what the commerce secretary said how forceful she was, but the other side, you have to have them react to it and they don't. they say okay, we are going to keep doing what we are doing, they don't see pushback from the united states, and that's the lack of strategy. we just need to keep expecting this to happen, we are in an election year, one year from today we start the national election, it's a little late to have a strategy. the national security strategy of the united states, we call china a competitor. france is a competitor, china is an adversary. >> alicia: and the news is scarier, wall street journal, chinese gate crashes at u.s. bases spark espionage concerns and chinese nationals sometimes posing as tourists have accessed military bases and other sensitive sites in the u.s. as many as 100 times in recent years, according to the u.s. officials who describe it as a potential espionage threat. so you have the threats, you have the military build-up and being menacing toward taiwan. you have chinese companies buying u.s. property, land in the middle of the united states. is there anything that the biden administration actually can do? >> you know, alicia, first of all, pretty brazen what they have been doing. you can do something when it comes to national security if you start with the premise this is an adversary. the problem you are running into, we are in the fourth year of the biden administration and they don't have a strategy to counter that. and almost going to be too late to do anything about it and they have built up tremendous capacity capability to do this and they don't see any pushback, and what you have do as a nation when it comes to national security, be able to push back on an adversary or threatening nation early on, and set your limits early on. we have not done it, so this is just going to continue. >> alicia: john bolton is warning americans need to fight back and pay attention in a totally different way, listen to what he said in a radio interview this weekend. >> what their strategy is, use what people call asymmetric warfare to engage in cyber attacks, try influence operations to undercut us economically, never to confront us militarily because they know ultimately what the outcome would be, but to weaken american resolve. weaken faith in our institutions. >> alicia: general, how does that work? americans are aware of china's attempts to undermine the economy but talking about something different there, talking about public opinion. >> yeah, that's a clear strategy that the chinese have got. when you talk about asymmetric warfare, they are moving into symmetric warfare you see what they are doing around taiwan. the chinese way of operations. they have always done it that way. and military operation, fight fight, talk talk, fight fight, talk talk, and that's how they operate. it's like a slow moving water that getting into the seams, and that's how they operate, they know what they are doing, they have been around a lot longer than we have been. xi is a determined, pragmatic individual, his third term, he's going to be around a while, it's just the way they operate. but how do we operate? we have to be very forceful. the problem is, we should have done it 1 or 2 years ago with the strategy and again, i go back to the national security strategy, it does not bring up china as a threat but as a competitor. the only one that is a threat russia. russia is a threat and so is -- >> alicia: president zelenskyy dismissing his defense minister, how does it change the offensive here? impact? >> it's a huge impact, removing the sent of defense, a clear signal to the united states, because the united states is the largest contributor of military aid to ukraine, and there has been a concern about corruption and you see what is playing out in the united states where this is going to be the largest national security issue we are going to face in the near term politically and worried about the aid keeping coming into ukraine, and right now you have the huge offensive in the south, and you are seeing some incremental work by the ukrainians to punch through the solid russian defensive lines. they have gone through the first defensive line, they want to get through the second and the third, if they can penetrate all three of those lines, they have a clear lane of approach to the sea of azov and if they do that, they cut the russian forces in half, separate them. and it will force major reactions by the russians. so zelenskyy sees this and he says if we don't get the offensive moving, united states will say wait, all the aid, what good has come of this? his way of signalling to the united states it's important we continue the offensive is remove the secretary of defense and replace him with a guy who is a friend of his, so he was basically put to the side, they used corruption as an issue, clear signal to the united states. i think the offensive, this is something to watch. why it's important, they can break through, they can get to the sea of azov, it changes the whole fight on the ground between russia and ukraine and takes it to a different stage, a different step. >> alicia: lieutenant general keith kellogg, great to talk to you to say. thank you so much for being here. >> anita: a piece of berlin wall is now right near the u.s.-mexico border and the government of mexico put it there to make a point. the message it's trying to send. we will tell you about it comingp next. frustrated by skin tags? (soft music) >> fox weather alert on the clean-up from hurricane idalia, it will take weeks especially in hard hit areas like cedar key, florida. the storm surge flooded most of the island. nicole is live in cedar key. hi, nicole. >> at 1 point, 1 place at least seven feet of storm surge. now, where i'm standing is actually the low key hide away and tiki bar, and we saw the storm surge move in through here and nearly covering the entire bar you see to my left. just the sheer force and pressure of all of that water moving in from the gulf shattering the glass wall that was once filled with memories and momentos that made this tiki bar such a special place for this small community. i'll show you video from the moment that that storm surge started to rise, really just after hurricane idalia made landfall along the big bend of florida. you see nearly five feet of water there. the owner of this business, scott larson, allowing a nearby friend to set up these cameras to give him a live look at the destruction as it was happening. he and his wife actually evacuating cedar key after the orders were issued by local officials. recognizing the threat there, but meanwhile as much of the destruction there still is, the bar is standing, but he has weeks ahead of him to pick up the debris, everything inside, not only the bar but the motel that's connected to it and even his personal home destroyed. thankfully, there is progress across the state of florida. just over 27,000 people still without power that, is significant progress from where we were this time last week. fema and the florida national guard very much at work trying to help clear roads and pick up the pieces. we know it's going to be several weeks for local business owners like scott larson to make a dent but he has support from his community. hundreds over the weekend helping to slowly pick up here and hope to rebuild what was their beloved bar here and they are hoping to at least open in some fashion by the end of the week. >> alicia: still thinking about all the business owners and homeowners, absolutely. thank you. anita. >> anita: the mexican government sending a clear message to the u.s., a small piece of the berlin wall was placed outside the u.s.-mexico border in tijuana. may this be a lesson to build a society that knocks down walls and builds bridges. vice president of the national border patrol council joins me on this. chris, thanks for coming in. what do you make of this gesture or maybe it's a strong suggestion by the mexican government comparing the berlin wall to a wall for national security. is that like comparing apples and oranges, what do you think? >> you know, i think mexico is being a little melodramatic here. we are doing what we can to secure our country, our borders like every country is supposed to do, and i think what mexico is trying to do is draw attention to the fact they are a failed state, the government is not in control and the cartels are in control of their country regardless of how many plaques they put up around the border area. >> anita: it seems as a slap in the face, but the u.s. is trying to expand the barriers across the border, it seems like this has pushed back against that, and something interesting on the screen, according to the border report, independent publication, look at this. migrants are being offered instructions on how to cross the border and these instructions are being delivered right to their phone via special app. so, you know, this is -- they know this is happening and yet they are putting this message out to the united states. >> yeah, it's very hypocritical of them. i think what they are feeling now is the pressure that's being put on by governor abbott in the state of texas as far as securing the border. the biden administration is not concerned about securing that border but the governor of texas is, and i think it's starting to hit the cartels and the mexican government in the pocket book. >> anita: something else that is aiding these migrants in crossing the border, some of them, are spending 10 to $15,000, look at this, for travel packages sold to them by smugglers. these migrants are selling everything they own and it's a complete package to get them from south of the border right to the border. all the way to tijuana. you can imagine how dangerous that is. have you heard anything about that, can you tell us more about what's going on there? >> you know, we have not heard about the actual packages, but you know, for years people do sell what they have to make that journey north. we see that every day that people come and they are desperate to get in, because they know that right now the laws are lacking, the enforcement is lacking and they know if they can get in now they can disappear into the country and never be found again. >> anita: and this is not just a problem for the border and the states that border mexico, there are problems now all over the country, mayors all over the country are dealing with an influx of migrants. they are living in shelters, they are living in schools, gymnasiums, out on the street. how do you see an end to this? what is going to help solve this situation? >> we have been calling for years this was going to happen. the folks that are crossing are not staying here, and the drugs are not staying here, they have been headed today the rest of the country. the only thing that's going to stop them is mandatory detention, removal and for congress to come together and get something done. it's been years they have got together and accomplished anything. if something needs to be done, this is it, it needs to be as non-partisan as they can possibly think. there are lives on the line here, innocent women and children are caught up in this, that need this to happen. >> and also drugs pouring into the country killing americans, a sad fact also. i mentioned that message from the mexican government, from the mayor of tijuana put up that slab of the berlin wall. this is happening as the u.s. is continuing to try to expand the barriers along the border. they are not building a wall, so what are they doing to secure the border? >> the mexican side, they are playing politics when they should be helping us be in our partner to the south and keeping people from just parading through their country however they wish to get to our country. if they were truly good neighbors they would do that. we are doing the best at what we have, unfortunately, our hands are tied as far as border patrol agents, the administration is not letting us get to work. they are using the regulation against us, but with mexico, i think if they put, even a quarter of their attention with the silly plaques into stamping out crime and corruption in their country, things would be better for both of us. >> anita: and our hats off to the men and women of the border patrol who work so hard to keep us safe. appreciate it. >> alicia: attorneys for alec murdaugh say they have brand-new evidence and are pushing for a new trial. that's next. every piece of land has a story - written by those who work it. like the caggianos, who are brewing their own legacy. or the wrens, with their drama free plot - tranquil and serene. the upshaws? >> i mean, normally what that means is that after the trial ended some new evidence became apparent and they want to present that new evidence. i would be shocked if there was any credible new evidence in this case given all of the stones that were turned, all of the evidence that was uncovered in that case. i believe their main crux will be about juror bias. >> alicia: and juror bias? a small town, everybody knew him? >> they made the argument at the trial. it was discussed with the judge and that's a very frequent argument when people are looking to overturn trials. i would be surprised if the argument flies but we do know his attorneys had been talking to the jurors over the past week or so to try to get some foundation for this motion. so i would be expecting to see a strong argument with respect to juror bias and maybe some stab in the dark argument about some newly discovered evidence. >> alicia: when you are talking about the jury, are they going to try once again to connect a juror, wa that work, connect a juror to their client? >> it would be difficult to work because it was discussed and argued unthe original trial. however, these conversations with jurors that the attorneys had since the trial, maybe one of the jurors said yes, i was very biased or the guy next to me was very biased and could not make a fair decision and strong argument that a new trial should be had but it's a tough argument to make. it had already been argued and maybe that's the new evidence they are going to bring up. but i expect that to be very thoroughly argued by the prosecution and the judge is not going to be inclined to overturn what they have already done. >> alicia: so we have a news conference coming up tomorrow by his legal team. what is the level of success of them being granted the motion? >> very low, very low. i mean, we know the argument, especially if it's about the juror bias, it has been discussed but i expect they will continue to try to appeal. we know murdaugh does not think the rules apply to him, he's gotten in trouble for jail for using another inmates pin number and interviews for the do you want tear on fox, so he's already breaking some rules. i think he is adamant about pursuing the appeal. and his attorneys who are his friends are adamant supporting him. i don't think it's going to go away soon but i also don't see it resulting in a new trial. >> alicia: and his son buster is offering a certain level of support, he gave an interview for a fox nation special. take a listen. an when you look back at this trial, they didn't find a murder weapon, they didn't find any bloody clothing, there were no witnesses, a lot of digital evidence. >> yeah. >> you think it was a crappy motive, and yet 12 jurors all agreed that your dad killed your mom and paul. >> that's right. >> what do you think about that? >> i do not believe it was fair. >> alicia: how important is buster murdaugh in this specific instance, does he play any role? >> no, this is why sons and daughters of the accused are not on the jury. we need people who are arguably impartial. it's understandable he doesn't want to believe his father did that but i have a lot of faith in the jury system and the jurors that served and 12 came to the decision based on quite a bit of strong evidence and he has little to no role to play in the legal part of this case going forward. >> alicia: it's his dad, of course he's going to say that, most kids would do that to the bitter end. however, he did do something kind of interesting. he did agree with the assessment that his father does have some psychopathic qualities. what is that? >> listen, i feel bad for this entire family. his mother and his brother have died and allegedly and by the jury's verdict at the hands of his father. so he's, i'm sure, you know, my psychology degree would tell me a battle between wanting to blame his father and his father one of his only remaining family members and has to be very difficult and as you said, it's why we don't involve children in deciding the fates of their parents in these types of situations. it's a terrible situation to be in. he has his own legal allegations against him, so i'm not feeling jealous of buster in this situation at all. >> alicia: and back to alec murdaugh, if he fails at this motion, is that it, is he done now, time to stay in prison and stop it or other avenues he can take? there are some serious voices out there suggesting that perhaps president biden doesn't make it until the end of the year. one of those voices is his biographer, and he may drop out. >> if joe biden announces he's not going to seek a second term, how much of a surprise would that be to you? >> i would say it would be a surprise to me but it wouldn't be a total surprise. >> not a total shock. >> not a total shock. would it be a shock to you if that happened? >> it would be somewhere between a surprise and a shock. the big reason is i don't think joe biden is going to wake up one day and say you know, i'm too old to be president. he might say that his, he just feels too tired to do it, but this man has sought the presidency for decades, for 50 years. and he's got it and he's not going to just let it go. so, he has his democratic party lined up behind him to run for another term even though everybody knows he would be 82 years old when that term begins, and 86 years old when it ends and they have seen him slow down already. so, if the democratic party is lined up for that i find it hard to believe that president biden is just going to say gosh, i don't think i want to do it. >> anita: what about the democratic governors out on the campaign trail supposedly stumping for him but also introducing themselves to the rest of the country. could they be possible replacements? and let's put some of those people on the screen. gavin newsom from california, gretchen whitmer from michigan, wes moore, josh shapiro, these are high profile governors that are looking to be even may more high profile. what do you think about some of these folks possibly stepping in if biden steps out? >> interesting. we do have a new wall street journal story talking about them, going out and politicking, campaigning for president biden, and that's the thing that loyal democrats do, but the article is framed of them -- as if they are trying to position themselves to succeed biden in 2028 and you read it and think what about 2024. it's not absolutely guarantee that joe biden is going to make it all the way, so i think that all of these people that you mentioned, moore and newsom and gretchen whitmer, josh shapiro, think if they go out and are good loyal party operatives, campaigning for the president and something unexpected happens next year and joe biden does not run for president, they will be in a good position to take advantage of that. so, i think they feel any campaigning they do right now will pay off sooner or later. >> and where is the vice president in all of this, kamala harris. how come her name was not mentioned in that article? >> well, the interesting thing about that article, even if you talk about 2028, everybody is saying now the democratic world that these potential candidates are not going to defer to vice president kamala harris. they are not going to say oh, she is the rightful successor to president biden, i won't run against her. i think they are all planning to run against her because she's really done a very lackluster job and her job approval ratings are a bit below 40 right now, and they have been that way for a long, long time, and she's just generally not perceived as a popular vice president and that makes her vulnerable politically inside the democratic party. >> anita: we hear a lot of people making comments about president biden's age and recently he said something about his age. hear what he had to say. >> i tell you what, someone said, you know, that biden, he's getting old, man, i tell you what. well guess what, guess what, i -- the only thing that comes with age is a little bit of wisdom. but i'm -- i've been doing this longer than anybody and i guess what, i'm going to continue to do it with your help. >> anita: doesn't sound like he's dropping out right there. a quick comment what he had to say. >> i think he's telling the truth right there, and has also gotten some advice to make some jokes about his age, and you'll hear him referring to him doing something 2, 300 years ago, making a little joke about it. this he was actually serious and i think he's telling the truth. i think he thinks he's got wisdom of age and he wants to remain president. >> anita: sounds like it to me. i agree with you. thank you for your comments. >> thank you. >> anita: humor is the best way -- >> alicia: and there was a wall street journal poll and they talk about how voters are concerned about age for both former president trump and biden, but more concerned about biden. >> anita: president trump does seem a little more sharp, about you he's got lots of other issues and we'll see what happens there. >> alicia: we will continue to watch, for sure. just days before the annual g20 summit, tensions with china ratchet up. commerce secretary says she did not "pull any punches" when she confronted chinese officials about hackers suspected of accessing her emails. but is the biden administration doing enough to prevent all of china's espionage acts? we are talking about president xi and all the people underneath him. they are not going to tell her the truth. >> yeah, alicia, thanks for having me today. look, they really don't care. the level of disdain that they have, and you saw how with the secretary, and also with janet yellen, and before that with blinken, and before that the snub of our secretary of defense lloyd austin in singapore. so what they do, they just act and really don't care what happens because they don't have the respect for the united states. and why that's important. it shows to adversaries or anybody that may want to threaten us there is very little risk of pushing back on the united states and because of that, we really don't have a plan to counter china. we don't have a strategic plan at all, economically, militarily or diplomatically. i understand what the commerce secretary said how forceful she was, but the other side, you have to have them react to it and they don't. they say okay, we are going to keep doing what we are doing, they don't see pushback from the united states, and that's the lack of strategy. we just need to keep expecting this to happen, we are in an election year, one year from today we start the national election, it's a little late to have a strategy. the national security strategy of the united states, we call china a competitor. france is a competitor, china is an adversary. >> alicia: and the news is scarier, wall street journal, chinese gate crashes at u.s. bases spark espionage concerns and chinese nationals sometimes posing as tourists have accessed military bases and other sensitive sites in the u.s. as many as 100 times in recent years, according to the u.s. officials who describe it as a potential espionage threat. so you have the threats, you have the military build-up and being menacing toward taiwan. you have chinese companies buying u.s. property, land in the middle of the united states. is there anything that the biden administration actually can do? >> you know, alicia, first of all, pretty brazen what they have been doing. you can do something when it comes to national security if you start with the premise this is an adversary. the problem you are running into, we are in the fourth year of the biden administration and they don't have a strategy to counter that. and almost going to be too late to do anything about it and they have built up tremendous capacity capability to do this and they don't see any pushback, and what you have do as a nation when it comes to national security, be able to push back on an adversary or threatening nation early on, and set your limits early on. we have not done it, so this is just going to continue. >> alicia: john bolton is warning americans need to fight back and pay attention in a totally different way, listen to what he said in a radio interview this weekend. >> what their strategy is, use what people call asymmetric warfare to engage in cyber attacks, try influence operations to undercut us economically, never to confront us militarily because they know ultimately what the outcome would be, but to weaken american resolve. weaken faith in our institutions. >> alicia: general, how does that work? americans are aware of china's attempts to undermine the economy but talking about something different there, talking about public opinion. >> yeah, that's a clear strategy that the chinese have got. when you talk about asymmetric warfare, they are moving into symmetric warfare you see what they are doing around taiwan. the chinese way of operations. they have always done it that way. and military operation, fight fight, talk talk, fight fight, talk talk, and that's how they operate. it's like a slow moving water that getting into the seams, and that's how they operate, they know what they are doing, they have been around a lot longer than we have been. xi is a determined, pragmatic individual, his third term, he's going to be around a while, it's just the way they operate. but how do we operate? we have to be very forceful. the problem is, we should have done it 1 or 2 years ago with the strategy and again, i go back to the national security strategy, it does not bring up china as a threat but as a competitor. the only one that is a threat russia. russia is a threat and so is -- >> alicia: president zelenskyy dismissing his defense minister, how does it change the offensive here? impact? >> it's a huge impact, removing the sent of defense, a clear signal to the united states, because the united states is the largest contributor of military aid to ukraine, and there has been a concern about corruption and you see what is playing out in the united states where this is going to be the largest national security issue we are going to face in the near term politically and worried about the aid keeping coming into ukraine, and right now you have the huge offensive in the south, and you are seeing some incremental work by the ukrainians to punch through the solid russian defensive lines. they have gone through the first defensive line, they want to get through the second and the third, if they can penetrate all three of those lines, they have a clear lane of approach to the sea of azov and if they do that, they cut the russian forces in half, separate them. and it will force major reactions by the russians. so zelenskyy sees this and he says if we don't get the offensive moving, united states will say wait, all the aid, what good has come of this? his way of signalling to the united states it's important we continue the offensive is remove the secretary of defense and replace him with a guy who is a friend of his, so he was basically put to the side, they used corruption as an issue, clear signal to the united states. i think the offensive, this is something to watch. why it's important, they can break through, they can get to the sea of azov, it changes the whole fight on the ground between russia and ukraine and takes it to a different stage, a different step. >> alicia: lieutenant general keith kellogg, great to talk to you to say. thank you so much for being here. >> anita: a piece of berlin wall is now right near the u.s.-mexico border and the government of mexico put it there to make a point. the message it's trying to send. we will tell you about it comingp next. frustrated by skin tags? (soft music) >> fox weather alert on the clean-up from hurricane idalia, it will take weeks especially in hard hit areas like cedar key, florida. the storm surge flooded most of the island. nicole is live in cedar key. hi, nicole. >> at 1 point, 1 place at least seven feet of storm surge. now, where i'm standing is actually the low key hide away and tiki bar, and we saw the storm surge move in through here and nearly covering the entire bar you see to my left. just the sheer force and pressure of all of that water moving in from the gulf shattering the glass wall that was once filled with memories and momentos that made this tiki bar such a special place for this small community. i'll show you video from the moment that that storm surge started to rise, really just after hurricane idalia made landfall along the big bend of florida. you see nearly five feet of water there. the owner of this business, scott larson, allowing a nearby friend to set up these cameras to give him a live look at the destruction as it was happening. he and his wife actually evacuating cedar key after the orders were issued by local officials. recognizing the threat there, but meanwhile as much of the destruction there still is, the bar is standing, but he has weeks ahead of him to pick up the debris, everything inside, not only the bar but the motel that's connected to it and even his personal home destroyed. thankfully, there is progress across the state of florida. just over 27,000 people still without power that, is significant progress from where we were this time last week. fema and the florida national guard very much at work trying to help clear roads and pick up the pieces. we know it's going to be several weeks for local business owners like scott larson to make a dent but he has support from his community. hundreds over the weekend helping to slowly pick up here and hope to rebuild what was their beloved bar here and they are hoping to at least open in some fashion by the end of the week. >> alicia: still thinking about all the business owners and homeowners, absolutely. thank you. anita. >> anita: the mexican government sending a clear message to the u.s., a small piece of the berlin wall was placed outside the u.s.-mexico border in tijuana. may this be a lesson to build a society that knocks down walls and builds bridges. vice president of the national border patrol council joins me on this. chris, thanks for coming in. what do you make of this gesture or maybe it's a strong suggestion by the mexican government comparing the berlin wall to a wall for national security. is that like comparing apples and oranges, what do you think? >> you know, i think mexico is being a little melodramatic here. we are doing what we can to secure our country, our borders like every country is supposed to do, and i think what mexico is trying to do is draw attention to the fact they are a failed state, the government is not in control and the cartels are in control of their country regardless of how many plaques they put up around the border area. >> anita: it seems as a slap in the face, but the u.s. is trying to expand the barriers across the border, it seems like this has pushed back against that, and something interesting on the screen, according to the border report, independent publication, look at this. migrants are being offered instructions on how to cross the border and these instructions are being delivered right to their phone via special app. so, you know, this is -- they know this is happening and yet they are putting this message out to the united states. >> yeah, it's very hypocritical of them. i think what they are feeling now is the pressure that's being put on by governor abbott in the state of texas as far as securing the border. the biden administration is not concerned about securing that border but the governor of texas is, and i think it's starting to hit the cartels and the mexican government in the pocket book. >> anita: something else that is aiding these migrants in crossing the border, some of them, are spending 10 to $15,000, look at this, for travel packages sold to them by smugglers. these migrants are selling everything they own and it's a complete package to get them from south of the border right to the border. all the way to tijuana. you can imagine how dangerous that is. have you heard anything about that, can you tell us more about what's going on there? >> you know, we have not heard about the actual packages, but you know, for years people do sell what they have to make that journey north. we see that every day that people come and they are desperate to get in, because they know that right now the laws are lacking, the enforcement is lacking and they know if they can get in now they can disappear into the country and never be found again. >> anita: and this is not just a problem for the border and the states that border mexico, there are problems now all over the country, mayors all over the country are dealing with an influx of migrants. they are living in shelters, they are living in schools, gymnasiums, out on the street. how do you see an end to this? what is going to help solve this situation? >> we have been calling for years this was going to happen. the folks that are crossing are not staying here, and the drugs are not staying here, they have been headed today the rest of the country. the only thing that's going to stop them is mandatory detention, removal and for congress to come together and get something done. it's been years they have got together and accomplished anything. if something needs to be done, this is it, it needs to be as non-partisan as they can possibly think. there are lives on the line here, innocent women and children are caught up in this, that need this to happen. >> and also drugs pouring into the country killing americans, a sad fact also. i mentioned that message from the mexican government, from the mayor of tijuana put up that slab of the berlin wall. this is happening as the u.s. is continuing to try to expand the barriers along the border. they are not building a wall, so what are they doing to secure the border? >> the mexican side, they are playing politics when they should be helping us be in our partner to the south and keeping people from just parading through their country however they wish to get to our country. if they were truly good neighbors they would do that. we are doing the best at what we have, unfortunately, our hands are tied as far as border patrol agents, the administration is not letting us get to work. they are using the regulation against us, but with mexico, i think if they put, even a quarter of their attention with the silly plaques into stamping out crime and corruption in their country, things would be better for both of us. >> anita: and our hats off to the men and women of the border patrol who work so hard to keep us safe. appreciate it. >> alicia: attorneys for alec murdaugh say they have brand-new evidence and are pushing for a new trial. that's next. every piece of land has a story - written by those who work it. like the caggianos, who are brewing their own legacy. or the wrens, with their drama free plot - tranquil and serene. the upshaws? >> i mean, normally what that means is that after the trial ended some new evidence became apparent and they want to present that new evidence. i would be shocked if there was any credible new evidence in this case given all of the stones that were turned, all of the evidence that was uncovered in that case. i believe their main crux will be about juror bias. >> alicia: and juror bias? a small town, everybody knew him? >> they made the argument at the trial. it was discussed with the judge and that's a very frequent argument when people are looking to overturn trials. i would be surprised if the argument flies but we do know his attorneys had been talking to the jurors over the past week or so to try to get some foundation for this motion. so i would be expecting to see a strong argument with respect to juror bias and maybe some stab in the dark argument about some newly discovered evidence. >> alicia: when you are talking about the jury, are they going to try once again to connect a juror, wa that work, connect a juror to their client? >> it would be difficult to work because it was discussed and argued unthe original trial. however, these conversations with jurors that the attorneys had since the trial, maybe one of the jurors said yes, i was very biased or the guy next to me was very biased and could not make a fair decision and strong argument that a new trial should be had but it's a tough argument to make. it had already been argued and maybe that's the new evidence they are going to bring up. but i expect that to be very thoroughly argued by the prosecution and the judge is not going to be inclined to overturn what they have already done. >> alicia: so we have a news conference coming up tomorrow by his legal team. what is the level of success of them being granted the motion? >> very low, very low. i mean, we know the argument, especially if it's about the juror bias, it has been discussed but i expect they will continue to try to appeal. we know murdaugh does not think the rules apply to him, he's gotten in trouble for jail for using another inmates pin number and interviews for the do you want tear on fox, so he's already breaking some rules. i think he is adamant about pursuing the appeal. and his attorneys who are his friends are adamant supporting him. i don't think it's going to go away soon but i also don't see it resulting in a new trial. >> alicia: and his son buster is offering a certain level of support, he gave an interview for a fox nation special. take a listen. an when you look back at this trial, they didn't find a murder weapon, they didn't find any bloody clothing, there were no witnesses, a lot of digital evidence. >> yeah. >> you think it was a crappy motive, and yet 12 jurors all agreed that your dad killed your mom and paul. >> that's right. >> what do you think about that? >> i do not believe it was fair. >> alicia: how important is buster murdaugh in this specific instance, does he play any role? >> no, this is why sons and daughters of the accused are not on the jury. we need people who are arguably impartial. it's understandable he doesn't want to believe his father did that but i have a lot of faith in the jury system and the jurors that served and 12 came to the decision based on quite a bit of strong evidence and he has little to no role to play in the legal part of this case going forward. >> alicia: it's his dad, of course he's going to say that, most kids would do that to the bitter end. however, he did do something kind of interesting. he did agree with the assessment that his father does have some psychopathic qualities. what is that? >> listen, i feel bad for this entire family. his mother and his brother have died and allegedly and by the jury's verdict at the hands of his father. so he's, i'm sure, you know, my psychology degree would tell me a battle between wanting to blame his father and his father one of his only remaining family members and has to be very difficult and as you said, it's why we don't involve children in deciding the fates of their parents in these types of situations. it's a terrible situation to be in. he has his own legal allegations against him, so i'm not feeling jealous of buster in this situation at all. >> alicia: and back to alec murdaugh, if he fails at this motion, is that it, is he done now, time to stay in prison and stop it or other avenues he can take? >> there are different legal arguments, but once he goes through this process, he's hard pressed to find another. and don't forget, he still faces federal charges of fraud, which if he were to be convicted on those charges, up to over 400 years in prison. i think there's very little chance that anyone is going to see him on the streets of south carolina any time soon. >> alicia: you make a very good point. heather hansen, thank you for joining us today. >> anita: we hope you are enjoying your holiday, be it at home, at a barbecue or the beach. but do you know why we have the day off today?
