so-called sweetheart deal for hunter biden. that the president's son received preferential treatment. >> sandra: welcome, everyone, sandra smith in new york. this is "america reports." fox has learned attorneys for irs whistleblower gary shapley contacted the doj about the hunter biden case earlier this year. shapley's lawyer says the top doj official was initially open to hearing him out on claims of obstruction. but quickly changed his tune after meeting with hunter's lawyers. >> john: weeks later, whistleblower protections were tossed, and the irs investigative team was pulled from the case. putting in question whether the doj meddled in the criminal investigation. let's kick things off with david spunt. live at the justice department. have doj officials commented on the new allegations, david? >> john, no, and unlikely that will change. this furthers the narrative of critics of the doj that there is this dual system of justice at play here. the headline as you just mentioned in the intro to me is the fact the whistleblower attorney claims that one day after he met with a top doj official who's really a career doj official, they claim the official met with david weiss, the u.s. attorney and hunter biden's attorney, chris clark. remember, gary shapley, the whistleblower, first to come forward, hold up the red flag about hunter biden's investigation and say listen, this was slow-walked multiple times. shapley's attorney says after he talked, and now they met at the justice department and promises from whistleblower protection suddenly disappeared. listen. >> in just two, about two short weeks, my interactions with mr. wineshiemer went from the office of deputy attorney general would like to hear about any wrongdoing or any allegations of improper conduct, to just two weeks later go talk to mr. weiss. >> on september 20th, john, the attorney general, merrick garland, will testify on capitol hill before the house for oversight hearing, expect hunter biden to be a big, if not the biggest topic of the day. meanwhile, the fight over the proposed diversion agreement to help hunter biden avoid jail time for lying on a federal gun form that, is heating up. the federal judge in delaware who oversaw the failed plea agreement is giving both sides to september 6th for update there. hunter's team says the diversion agreement is in place and valid because both sides signed it but special counsel david weiss said the enter deal is void when the plea deal fell apart at the end of july. john. >> john: david spunt, david thank you. we are going to be joined to talk more about that, and former attorney general bill barr will be with us to talk more about the hunter biden investigation and concerns that he shares with vivek ramaswamy about an epidemic of fatherlessness in the united states and what the implications of that are. >> sandra: important stuff, and the hunter biden investigation and the doj and how they handle the investigation, this could lead to some really important questions in the white house press briefing room. we expect karine jean-pierre to take to the podium, and we will be listening for that. john. >> john: we'll see who actually is interested in this. >> sandra: indeed. >> can he didn't lose our whole home but lightning struck and lost a lot of it, about 15 years ago. >> i don't want to compare difficulties but we have a little sense, jill and i, what it's like to lose a home. almost lost my wife, my 67 corvette, and my cat. we had to be out of the house about seven months while repair because so much damage was done to the house and half the house almost collapsed. >> sandra: as communities in florida, georgia, and south carolina assess damage from idalia's trail of destruction, president biden is facing criticism for the overembellishing of a kitchen fire in order to relate to victims of recent natural disasters. peter doocy is reporting live at the white house for us at this hour. peter, how is the administration responding to the storm and to that criticism today? >> sandra, president biden phoned ron desantis again in this political ceasefire to let him know federal funds are on the way. other republicans in town less nice things to say about the administration, likes james comer writes as recovery efforts continue, the house oversight committee has responsibility to ensure taxpayer dollars are being used efficiently and effectively. >> i welcome a federal response in maui. i think that they should go out and talk to elected official from the mayors, the governor, to united states senator, the congresspersons, i welcome and once they good out and see it then i'm sure they will provide the money. thank you all very much. >> this hurricane did intensify quickly but the fema director and president biden are on different pages what exactly to say concerning the cause. >> i'm not going to attribute the cause of the storm. >> i don't think anybody can deny the impact of the climate crisis anymore. >> the maui wildfire response was widely panned, but the hurricane response so far seems to get bipartisan praise. why is that? >> did you guys realize that the initial hawaii wildfire response was not that good? or is it just easier for people to get help from the white house when the president is not on vacation? >> so the premise of your question and the way you pose the question i disagree, speak to the governor of hawaii, the senators of hawaii, the folks on the ground, they would say that the president reacted in record time. >> nothing on president biden's public schedule today. tomorrow he is scheduled to return to the beach house in delaware. sandra. l>> sandra: okay, peter doocy, we will dig into that, thank you. john. >> john: sandra, the storm pulling away desantis from the campaign trail but in turn he showed leadership skills from the national stage. will it give him a leg-up in the polls? guy benson, richard fowler, both are fox news contributors, good to see both of you. the primary process, it's been said, more often than not, is an ongoing job interview. last year people around the country got a chance to see ron desantis reacting to hurricane ian, and now him planning for and reacting in the aftermath of hurricane idalia. richard, do you think this will serve him well going forward? >> i actually do think this will help ron desantis in a way, look at him versus his field of contender, the only person dealing with a natural disaster, and getting as much free air time versus other opponents because he's the person you see giving press conferences, news updates, talking about a natural disaster. this is the beginning of the recovery. where ron desantis struggled has been his ability to be empathetic and touch real people. in this moment i'm sure his people are trying to figure out how can we show people he's a real person and touch real people, and pull it off, benefit him into the second debate. >> john: if you make plans and then you respond, they are very appreciative of all of that. president biden also appreciative of the florida governor, listen to what he said yesterday, guy. >> governor desantis is also running for president. you are running for re-election. you sense any politics in your conversations with him about this issue? >> no, believe it or no. i know that sounds strange, especially how the nature of politics today, but i was down there with the last major storm, i spent time with him, i think he trusts my judgment and my desire to help and i trust him to be able to suggest this is not about politics. >> john: he gets high marks from the president saying he trusts ron desantis, but you've got to wonder, guy, is there a danger of desantis getting too close to biden when it comes to this response? remember this famous scene from back in 2012, hurricane sandy, when then new jersey governor chris christie was very close to obama, the two of them were even caught in a bit of embrace, not sure how you would put it two men embracing each other when they are politicians but he got hammered for that. does desantis need to say thank you but we are handling this? >> i think that's essentially what he's done, and he's approached this the same way that he has previous natural disasters in florida, desantis, and he has exhibited competence, extreme competence, where they were prepared for this, they had everyone and assets in line ready to go, to go in and basically help as soon as was safe, and that's exactly what they have done, restoring power, getting the airports back open, fixing bridges, we saw that in hurricane ian as well. and desantis has pointedly declined to get sucked into politics, the way the president, to his credit, did there. someone asked desantis yesterday about former president trump and sort of the social media spree he was on, not talking about the hurricane, attacking desantis constantly and desantis said that's not my concern. my concern is keeping people safe here in florida, he's doing his job, that is the job that he swore to uphold when he ran for re-election and won by 20 points. if he handles this well, the risk is if you blow it, then it becomes a negative for you. but if you handle it well, he absolutely has, there might be a side benefit politically but that does not seem to be his driving motivation here. he wants to do the job properly. >> allow me to say this. i was raised in florida, i lived through hurricane andrew, a number of hurricanes and i saw at the last debate where chris christie got beat up by his opponents for hugging barack obama. i think when you are somebody who is a victim of one of these natural disasters, you don't want people to say i'm a democrat or republican, you want help. so it's going to be a democrat that helps you so be it. if it's republican that helps you, so be it. when you see politicians put their partisan d.r. on the ropes and help people in trouble, people like that. and i think it's really important. anybody beating up on that, they are the ones that are problematic in the moment. >> john: it is nice in the united states we can put politics aside for a moment. but back to politics, less than a month away from the second republican presidential candidacy debate. qualifiers so far ron desantis, vivek ramaswamy and chris christie. haley, pence and scott insist they are going to make it but questions whether hutchinson or burgum will be on the stage. guy, it's said many times if anybody hopes to mount a challenge the field needs to consolidate. is this the beginning of that process? >> very well could be. the first effective dropping out of the race, suspension of frances suarez, ok, there is one. i would imagine if other people don't qualify for the upcoming debate, and we have weeks to go, the field on the screen will grow a little bit, the question is how much. if you miss it this time or go through the elaborate systems you have to pay people 20 bucks to give you $1 to show up at the edge of the podium or the stage, what's the point of that. it's early, i guess that, i grant that. but as we get closer and closer to voters voting, republicans who don't have traction i think need to start thinking hard and looking around for the exit sign. >> john: final question to you, richard. the average age of that crop of gop candidates is probably about 55, vivek ramaswamy helps bring it down a little bit, about 25 years less than president biden. who people, a.p. poll described to a large degree as old, outdated, retired, elderly, aging, senile, dementia, slow, ignorant, gaffe, bumbling, bad, terrible, joke, profanity. i mean, the contrast is there. >> yeah, and 22 years younger, 22 years younger than donald trump in this moment, so i think this is the contrast the republicans are going to have to make and i think in this debate hopefully you will see them make some contrast between themselves and donald trump. before you can get to joe biden, talk about joe biden's age you have to win the republican primary and right now the primary was going to happen today, donald trump would be the winner of that primary and that's the problem that all of these rubicon tenders have. >> john: quick final word. >> i definitely agree with that. how do you run against joe biden and donald trump without ticking off trump supporters, that's the dance the republicans are trying to do with mixed success, i would say. >> agree there. >> john: richard, guy, good to see you. mark your calendar for the second republican presidential debate hosted by stewart, dana, and ilia. they'll be moderating from the reagan presidential library wednesday, september 27th. >> sandra: new york city mayor eric adams pleading with the federal government to help with the migrant crisis that is taking over the city. >> we need the national government to stand up. this is not a new york city issue. this is a national issue. so don't critique what we have done. don't tell us how we could have done it better. >> sandra: adams holding a rally calling for expedited work authorizations for the city's asylum seekers, plus this. >> what is the granholm plan to increase oil production in america? however, may not sit well with the united auto workers union which has already approved a strike at three major car companies over the administration's e.v. push. let's bring in charles payne, host of making money on fox business. charles, because the automakers are saying this is not working. they are not seeing the demand they were told they would see, so this means job losses, pay cuts, so they have shown up and they have said we are not for this, at least not right now. >> uaw sees the money going into this, right. to you point, the future is uncertain when it comes to all this and the amount of money being put to this and saying hey, you know, we are concerned, we are concerned about this transition, we want to make sure we have a secure place there. ironically, in a similar fashion to even the actor strike with respect to artificial intelligence and those things, it's a murky thing. they just keep throwing more and more and more money at it. >> sandra: $12 billion in funds for the automakers. this is brand-new, announced just today, the united states is making $12 billion available in funding for automakers and suppliers to produce electric vehicles. charles, i know because you've been reporting on it, the companies tied to this e.v. push have not been doing well. so will throwing money at -- will this increase the amount of e.v.s being requested? >> it doesn't increase demand. you can increase supply. by the way, we have them piled up. they are going to be piling them up and you are going to see e.v. graveyards that never sold an e.v., they are piling them up. ford says hey, we went with you on this, and we are losing, you know, i think ford said it lost 3 billion already, the numbers are staggering. some independent companies like lucent and the rivians are the world, even tesla stock has come down a whole lot. the worst performing stock is a company called dollar general, you know it. stock, second time it's been hammered, annihilated. think about that for a moment. they represent the heartland, they represent so many households and families in this country, it's a proxy. americans, i did this thing yesterday, families with ebt cards with children, 65% say they have enough money to last 1 or 2 days and you are pushing e.v.s? no one can afford these, even with the subsidies, no one can afford them, no demand for them, they are doing it in the way that's hand fisted -- >> sandra: and the factories are not set up for them, so the new plan to retool the existing factories, 15, $16 billion to transition to an e.v., that should be noted as well. the factories are not ready for it. we will keep covering that. meanwhile, there are gas station signs like this one popping up, obviously hurricane idalia is having an impact on the gas market. regular unleaded almost $8, this is a florida gas station. i mean, there is obviously brand-new accusations of price gouging, but prices have been on the rise. what are you hearing about this? >> you know, some of it is price gouging and some may be logistical. overarching message to your point, we are going to have a serious crisis. yesterday we got inventory numbers. oil inventories are down dramatically, the lowest level since 1958, strategic petroleum the lowest level since 1983, listen, if -- it's nuts. we don't have refineries, we have fewer rigs out there and we were lucky last year that china's economic revival never really kicked in to the point they thought it would. i think we will be over $4 some time soon and people will be hurting really bad. and guess what, how can we refill the strategic petroleum reserve? west texas is over $80, what if it goes to 95, or 100 -- >> chuck schumer was the main blocking point. >> sandra: he said it was a blocking point for big oil. a big conversation about whether or not this administration is stifling our ability to produce more gas and oil here at home in the middle of what is a very much a rising the full contact sport. fight the battle with us. >> sandra: new york city leaders speaking at a rally earlier today calling for the federal government to authorize work authorizations for immigrants, as the city continues to struggle with an overwhelming migrant surge. bryan is live at foley, a lot of news coming from. what do we hear? >> sandra, hi. exactly, it was an embattled, passioned new york city mayor eric adams calling out fellow democrats, governor kathy hochul as well as president biden imploring them to do more with the migrant crisis in the city. >> new york city makes up .05% of the land mass yet we have 99.5% of the asylum seekers here. the solution is not just new york city. the solution is new york state and the united states. that is what the solution lies on. >> mayor adams holding a rally today, calling on the biden administration to expedite work permits for migrants. the city says the faster they can get migrants working legally, the quicker the 60,000 migrants currently living in the overcrowded shelter system can get out. governor hochul met with homeland security secretary alejandro mayorkas and president biden's chief of staff at the white house demanding expedited work permits through executive action. the white house promised to surge staffers to new york to identify, text and email migrants eligible for the work permits. the blame game among democrats continues. mayor adams wants governor hochul to force suburban communities to shelter migrants. hochul has criticized adams slow pace response to the crisis and both hochul and adams are blaming the biden administration for not doing enough to stop the flow of migrants at the southern border. while the white house says this is ultimately congress's problem, yesterday new york congresswoman alexandria ocasio-cortez admitted immigration is arguably the administration weakest issue, and all of this as critics are saying the expedited work permits will give incentive to more to come to the city, they already are seeing 10,000 a month, they will have to start cutting services to taxpayers, sandra. >> sandra: and clear to anyone who lives or works here the city is filling up. we see them wrapped around buildings like the roosevelt hotel here in new york city, it is a lot of people who have come in a short period of time. bryan, thank you. john. >> john: the circular firing squad of blame is just remarkable to watch there. supreme court justice clarence thomas has made public his first annual financial disclosure report since facing a flurry of ethics attacks. democrats have criticized justice thomas after a report earlier this year revealed he had received gifts from republican mega donor harlan crow without reporting them. his defenders have argued he has followed the court's reporting guidelines. a fox news legal editor and former counselor to attorney general bill barr, with us in the next hour. so a couple things on clarence thomas's disclosure, that crow paid for his transportation on a private jet to a conservative conference in dallas in may of 2022, and some involvement in a trip to the adirondacks in new york state in july od a real estate deal, what do you think of this? >> breaking news. clarence thomas has some wealthy friends who have been generous over the years, and i think this narrative has been just so relentless against clarence thomas. there's really only one fact that matters if you cut through the noise that harlan crow and the friends in question had no business before the supreme court, full stop. >> john: and as long as they didn't have business before the supreme court, that absolves him of any perception of wrongdoing? >> look, i think again, if you look at the facts here, the fact that he had some wealthy friends who occasionally hosted him on a nice vacation or paid one tuition payment or two tuition payments for his nephew, that's what we are looking at, and even, even by the way, even if they had business before the supreme court, that's not an automatic recusal. there would have to be discussion, meetings with ethics folks, etc., etc. i think what it's knocking clarence thomas out specifically with 2024. >> elliott burke said that, i'm confident there has been no willful ethics transgression in any prior reporting errors were inadvertent. thomas and sam alito asked for 90 days extension to release the disclosure forms. i think originally they were due in the spring. but also indicated they may go back and amend previous disclosures. >> and that happens. other justices have had to do that as well. originally the guidelines, and still are to some extent, they are fairly murky, they are discretionary. what thomas has said through spokes people and a statement, etc., and a lawyer, he has complied with these guidelines throughout the years. consulted the appropriate people and feels confident in what he disclosed and if there were mistakes or inadvertent nondisclosures they are happy to make them. >> john: he has had dozens and dozens of law clerks, more than 100 ever them penned an open letter in support of clarence thomas saying different paths led us to our year with justice thomas and we have followed different paths since. along the way we saw with our own eyes the same thing. his integrity is unimpeachable. among the signatories was our laura ingram, clerked for him in 1992. >> he has a reputation among clerks as a mentor, a friend, one part that struck me, when i call, when we call, he picks up. and i really encourage our viewers to take a look at this letter, it's on foxnews.com, it's a beautiful letter. >> john: we'll keep watching that to see where it goes. meantime, the drip drip drip with the hunter biden investigation continues. daily mail has a report out that the associate deputy attorney general bradley wineshiemer was going to investigate gary shapley's claims the doj was slow-walking the hunter biden investigation and all of a sudden the plea deal comes out of nowhere. mark liddle his attorney said in two short weeks, he went from expressing an interest in the claims of the wrongdoing by the irs whistleblower to dismissing the claims of retaliation when the irs agents were pulled off the case. this is a many-layered onion and we see it pulled back layer by layer. every time there is something brand-new. >> it seems like every day. it's a minimum a mess for doj and i say that as someone who used to work there, i loved working there, and lived and breathed working there, i think they got wind of the irs whistleblower testimony and i cannot emphasize enough how unusual it is for career bureaucrats at a different agency like the irs to make an allegation against the department of justice that they are slow-walking, stonewalling an investigation and deviating from protocol. i'm sure it was somewhat of a five alarm fire at doj, and what happens afterwards is murky again. my guess, speculation, probably called over to the delaware office and said guys, it's five years, if you are going to bring something, bring it now, this is a problem but leave the details to you and then we saw the plea deal, that was unprecedented, falls apart, and now we have a special counsel and we need to hear from merrick garland. >> john: and the clock keeps ticking and the statute of limitations runs out. we will hear from washington state business owners hope electric fences will drive down homeless camps and crime. in tacoma, the number of permits has tripled in the last year and a half. critics are saying they are a commander's football team will not be changing their name back to redskins, despite a viral petition calling for the team to do just that. the non-profit native american guardians association started the petition which received more than 120,000 signatures. but the team's president put the kabosh on the move saying it's not being considered, period. washington opted to change its name in 2020 after critics called it racially insensitive. that appears to be the end of that. >> sandra: interesting that happened, we remembered the initial steps to change the name and the resistance, but there they are. >> and pulling a weapon during a nonviolent environmental protest at black rock on sunday. demonstration blocked the entrance to the burning man festival caused a massive traffic jam. critics are going after the police for their response. let's bring in paul mauro, really looking forward to talking to you about this today, paul, we have seen the video by now and what you told us, it's really important to watch the longer version of this video because it's important to have the context of what led up to the event. we will put it on the screen and talk over it as it plays out. a minute long. >> another video out there shows these protestors blocking off the road and then resisting the efforts of the drivers, before the cops get there, to try to remove it so that they can get to burning man. as you have seen, the trail of cars goes on for miles, in the baking sun in the middle of the desert, right. so the people tried self-help and they are told by the protestors too bad, call the police. now the cops show up, they are outnumbered, they get there, there's a metal thing, looks like a large boat trailer and the cop made the assessment the only way he can move it is by using his car. nobody got hurt, what kills me, sandra, if you hear the earlier video, they are yelling about the fact that civil disobedience is the only way anything ever gets done at the protests. civil disobedience means we are here to get arrested and then when they get arrested they fall apart. one of the protestors literally gets bumped off of her beach chair, right, she's in the middle of the desert on a beach chair, she starts screaming like her hair is on fire. two of the protestors from new york, one from l.a., one from washington state, one from the isle of malta, he has an access, he's the most aggressive, again, in an earlier video. so you know, these are boutique protestors, it's all funded by celebrities and when they get what they want, the arrest, they scream, they yell police brutality. >> sandra: the one police officer in the video, he raises his weapon, pulls his weapon. did you feel that was necessary in this moment? i don't know that there's any evidence that anybody here was carrying a weapon. >> one of the things we should understand, that piece is the only -- that's out of context. we don't see what happens before he does what he does with that truck. that video may be out there. the fact we don't see the whole thing makes me a bit suspicious. i don't know what went on between the police and the protestors before he did that, is it possible he could have done this thing maybe a different way, sure. but as i said, nobody got hurt, there's this big implement, he's outnumbered, and he did not shoot, can't use deadly force unless you are confronted with deadly force, that's the general rule. doesn't shoot but if he feels outnumbered endangered, sure he can pull his weapon. >> sandra: pull out and look at the big pictures of the civil disobedience, seems to be more and more disruptive incidents. we put together sort of, strung together a series of them that we have seen over the summer, including these protestors, remember, infamously, yeah, destroying art in the major museums, that there have been many of them, paul. >> again, this is what they want and all kinds of tactics you don't see, they use sleeping dragons, chain themselves together and no way to disconnect them, right. they are not adverse to destroying art that's been around for centuries, they feel justified in doing all of this stuff. >> sandra: nantucket. >> of all places. they will go as far as they can go and then get arrested. it's what they want. one of the things that happens here, kind of maddening, that they are never really prosecuted to the extent that they could be. that's the fault, the fallacy in the system. one of the charges they could face in nevada, it happened on tribal lands, so they can have different charges. false imprisonment in that state has right in it restitution. that's where you hurt them. go after these folks and tell them you know what, all those people waiting online, the lost money at burning
