[laughter] will: people are saying that? rachel: feeling a little bad right now. will: you should be. pete: it's a lot of pain. think how often you use you are your shoulder. will: i've herald the two most painful things are childbirth and kidney stones. i've never experienced either. pete: neither have i. and i don't want to. will: where's wood? [laughter] pete: you could do two for two, you could be a birthing person and have a kidney stone, so both are possible. will: i can't be a birthing person, right? that's -- pete: it's the other way around. will: yeah. pete: but they'll figure it out. will: so rachel becomes a man, then she's a birthing person? presidentth that's how it works. sean, we were with you at the 6 a.m. hour, we were backing him up. as will properly said, ace of spaded it, haven't giving birth, couldn't be that hard. thank you, america, for backing us up. will: we feel for you, sean. rachel: but it didn't involve labor pains or nine months of carrying a child. i love you, honey, i hope you get better. i'm going to come home, and i'm going to take good care of you. will: all right, you've seen it, it's the mug shot heard around the world, the mug shot of former president donald trump. that mug shot is making its way onto t-shirts, onto mugs, into campaign fund raising. i said this on "the five" yesterday, there's two different kinds of mug shots, there's sort of the sad sack mug shot of, like, bill cosby or tiger woods, ask if then there's the mug shot of defiance. it's often seen in famous figures like janice joplin or jimmy hendricks or frank sinatra. you're looking at the second category. pete: a lot of people pointed out, he looks kind of like a bald eagle. rachel: yeah, i saw that -- we should put that up. there's a picture of him next to a bald eagle that's kind of looking down and, listen, this is an iconic -- this is becoming not just pop culture, it's becoming -- pete: we can't know how it will be used, but he knew the moment that picture was taken, it was for not just the moment for the history books, and it will take on a life of its own both for support us who are value van -- supporters who are galvanized by it and also detractors who have been wanting this photo since he came down the escalator. one guy who's become -- the pretending like he's seen one of it, not wanting to comment on any of it, press secretary can't talk about it, joe biden. he is on vacation as he almost always is these days in tahoe, california, and he came can shuffling out and was asked about whether he'd seen that mug shot is. and to a chorus of boos, seems his unpopularity's even made its way all the way out to california, this is what he had to say about it. >> have you seen donald trump's mug shot? [inaudible conversations] >> i did see it on television. >> what'd you think? >> handsome guy. wonderful guy. rachel: just the irony. the guy who should be in a mug shot, joe biden, who sold out his country to enrich his family, who's gotten us into, you know, the situation in ukraine and now we have a prosecutor, shokin, in a blockbuster interview that will air tonight on brian kilmeade's show saying, yeah, you guys are in the ukraine war partially because of these dirty deals that were being made by joe and hunter biden. certainly we can say that the money that we keep shoveling over there has a lot to do with it. this mug shot will, he rightly said, it's a look of defiance. and anybody in america who has felt they, that this government, that this deep state is being weaponized against them, anybody who feels like they've been censored, that they've been surveilled in the catholic church, protesters for the pro-life cause who have been, you know, taken down in their homes in front of their children, anybody who has a different opinion, a different point of view, if you consider yourself a dissident in your own country, this mug shot gives you chills. and it is a rallying call. pete: you know, i'm glad joe biden kind of chuckled. i'm glad he was sarcastic and said wonderful guy, handsome guy. it's better than the pretense that so many on the left want to play. this is such a sad, serious day. i never, never wanted to see this. of course you wanted to see this. this is exactly what you've pursued. it's what joe biden said had to happen, we've got to stop him. he'll never be president of the united states. well, three prosecutors agree, one down in georgia, one here in new york and a special prosecutor in washington d.c. and they're willing to gather whatever shred of nonsense they can, all of which has been at some level discredited or is allowed in this free country to prosecute a political opponent. so i'm glad he's laughing because if you watch other channels, this is, you know, this is a great day. they're excited about this. justice will be served against donald trump, how dare he attempt to take on the system. and it should only motivate anyone who truly loves the justice system and this process, who believes in america, and it will increase his numbers inside the republican primary and make him the nominee. so we'll get the showdown can america deserves. rachel: the bug shot's already backfiring on them. will: only fani willis, of those prosecutors, was the one delivering on their desire for a mug shot. nicole parker is a former fbi special agent,ed had the this say about her decision to pursue the mug shot. >> the politicization of the criminal justice system is just not acceptable. this is a county district attorney. fourth indictment, and now you're seeing a mug shot. why isn't that out of -- why is it that out of four indictments, the fourth one thousand you're seeing the mug shot? it appears this is for political reasons, this is a claim to fame for her, and she had campaigned on going after president trump. that is extremely dangerous. that is not what the purpose of the criminal justice system is for. those of us that were out there truly fighting crime, it is necessary to have the support and trust of the american people, and when you abuse it and go after your political opponents on the eve of an election, it ruins it for everybody. rachel: the whole purpose behind the democrat party at the moment donald trump won was to separate he came town the escalator -- down the escalator, was to separate donald trump from the his supporters and using the media, hollywood, big tech, whatever they could the make people embarrassed to support donald trump, embarrassed to put out a sign in front. and we saw so many people who wouldn't even tell pollsters that they were voting for donald the trump until, you know, he won. and then they said, oh, there were a lot of silent trump voters. this mug shot was about trying to embarrass republicans again and conservatives and to supporg donald trump, and this is just not working. with each indictment, his support has increased. and i believe that this mug shot is actually the end of the primary. everyone is gathering around because they the realize that donald trump is the stand-in for them. pete: most establishment republicans are embarrassed. and, you know, i don't -- i like ron desantis as the above of florida. i have no beef with him. but ultimately, he's running against a wall. and so the day that donald trump is getting indicted, he's playing baseball at the field of dreams and unwilling to comment on it. that's not going to cut it in this moment. at least vivek ramaswamy is able to -- willing to come out and say here's why it's an injustice, i'll pardon the guy. that's why his numbers are raising. and and is most people in washington unwilling to take the strong stance. there are some congressmen on the republican side who are doing a nice job with their committees, there ought to be more of it, and i think there's going to be more of an outcry for that. rachel: one of the things i learned when sean was in congress is just how powerful that bubble is in d.c., and i just think so many of these leaders just don't understand, as you said -- pete: the moment. rachel: they don't get how people are viscerally feeling about this. will: here's a story that you couldn't believe a little earlier, pete, elon musk sued by the doj for failing to consider noncitizens of the united states or green cardholders in his hiring practices at spacex. the doj said they failed to hire refugees or asylees because of their citizenship status and imposed what amounted to a ban on their hire in violation of federal law. pete: wait. so if you come to the country illegally, the doj is saying you deserve a job at spacex? will: you deserve a a job -- pete: i'm just trying to put it together. [laughter] rachel: not even at a restaurant illegally. will: the the argument is you deserve the same chance as an american citizen. pete: so citizenship doesn't matter. will: right. pete: is the doj's position. rachel: did you not get your george soros e-mail? pete: it's in my junk mail. elon musk tweetedded spacex was told repeatedly hiring anyone who was not a permanent resident of the united states would violate international arms trafficking law, which is a a federal offense. will: so what he's talking abou- pete: i don't get -- yeah, help me out. will: so there's -- he is making the argument there's another law that says -- rachel: elon is. will: -- hey, if you're a rocket or space company, you're not supposed to hire noncitizens because we don't want that technology to get out to other people. pete: i can see that. will: he's, like, i'm abiding by that law, and is you're persecuting me by this other law, which isn't a law, by the way, which is kind of nonsense. brian claypool, a criminal defense attorney, was on with us earlier, and this is what he had to say. >> elon musk needs to change his legal strategy. his legal strategy should be that the doj through biden is trying to legislate a new law. they're trying to expand title vii to now cover somebody who has an immigration status issue. immigration status is not a protected class under title vii. so this is flat out fiction by the doj. to elon musk's defense, he's an employer. let's say he starts going to employ people that have never been vetted, right? in the u.s. before you hire somebody, you vet them. you get their social security number, you check their criminal background. he can't even do that if you have somebody coming in illegally in this country. what if that person then goes and commits a crime? elon musk is going to be on the hook for that crime. rachel: this is so interesting because of the the open border, we've had an 800% increase of chinese citizens coming across our border, we'ved had a spy balloon, we now have a spy base in cuba just off of our coast. it's just interesting to me the prioritieses of the doj, the priorities of our federal government are not in protecting us at all. pete: yeah. and when you look at that statement, i mean, he feels like it's also the weaponization for political purposes. maybe he, you know, his buying of twitter -- will: yeah. pete: -- his reinstating donald trump, the his nature of being with a free thinker the. even though he did all the electric car stuff for them, not good enough. so they're finding one narrow spot which advances their open borders agenda to try to come at him. rachel: of course. pete: citizenship does still matter per the law. so i think he'll win out here. this is a, this is an ideological doj attempt. rachel: it's a signal to other ceos, you run afoul of this government, we'll find something on you. so don't you care -- dare cross us. again, this is what communism looks like. wake up, america. anyway, turning now to some other head headlines. a former ph.d. student in florida is accused of pumping hazardous chemicals under his neighbor's front door. they had trouble opening the door and smelling a strange odor. police say the liquid used tested positive for meth done and hydrocodone. the suspect allegedly used a university of south florida lab to mix the toxic chemicals. pete: need more information on this. rachel: this is a weirdo can. okay. to a fox weather alert, florida lead are orers keeping an eye on a potential hurricane moving towards the gulf of mexico. it's only a tropical system for now, but the national hurricane center says it could impact florida's coast as early as tuesday. and there's an 80% chance the system strengthens into a a named storm. and now to a heart-warming surprise for a little boy. oops, oh, they cut that off. oh, well, we're going to move to your to headlines. pete: okay. those are your headlines. all right, coming up, is america going backwards? a new study finding chronic wellness and less overall wealth are leaving our middle class to worse off when they retire than two decades ago. nicole saphier and taylor riggs are here with what this means for your wallet as well as your well-being. ♪ ♪ and i try, and i try and i try. ♪ i can't get no, i can't get no ♪ the day you get your clearchoice dental implants makes every day... a "let's dig in" day... mm. ...a "chow down" day... a "take a big bite" day... a "perfectly delicious" day... - mm. 69% of all americans are overwight or obese. we know -- overweight or to bees. when you look at the lower income, why is their life expectancy starting to come down? they have higher smoking rates, they're less likely to use preventative measures, cholesterol screenings, mammograms, less likely to get access to health care, but also increased stress and mental illnesses. you have lower income leads to poor health outcomes, poor health leads to lower income. so it's hard to get themselves out of there. so we aren't strong economically, we're not going to be able to get them to the healthier place. will: we turn to you on the economic side of this. you have all of these essentially costs adding up, and an inability to pay for those costs. >> and this is why the election could be the pocketbook election. i think americans, if you is can them, they feel poorer than they did 4 years ago, than they did 20 years ago. we've talked a lot about real wages, your wage after inflation. up until two months ago, 26 straight monthses of negative, so you really are poorer than you were. there's sort of huge economic consequences to all of this as well. will: how to do the we get both the health outcomes and the economic outcomes on the right track? >> their message is despicable. i mean, there is more and more evidence to the contrary, the mistakes that they made are definitely coming to light. certainly when biden had no trust this his military and intelligence community that was giving him information about not leaving bagram, and here's the reasons why, can if -- he chose to ignore that, and it came back and bit him in the rear end and, unfortunately, cost our 13 families their kids. i think their legacy is certainly going to be tarnished by this massive blunder, and the fact that they keep doubling down on it is only making it worse for them. they should have just come clean and admitted their mistakes, and we could have all moved on. pete: absolutely. mark, you're going to be a round table on the 29th, we had colonel mike waltz on the program as well. you said you're not going to hold back. what is your message? >> well, i'm going to speak directly to biden and the other leaders that i feel are on our hit list. and hit list, i mean removed from their positions. they don't deserve to be there. you don't make these kind of mistakes and and still have your job at the end of the day. these guys should have resigned, and i'm honestly rather disturbed that the generals didn't slap their stars on the table and resign before this even happen. that's what should have happened and it didn't. and thousand they're going to pay the consequences for it as well. so we're not going to stop fighting until we get the accountability that we deserve and the rest of the veterans that served in this 20-year war, i feel, deserve as a well. i mean, they -- everyone there did such a wonderful job, but their leadership fail them. pete: you're right. i mean, the -- it's still staggering to this day to think the only person held accountable was a a marine colonel, stu sheller, who spoke the truth. no one involved in that devastation of that mission at all has either resigned or been held accountable. and you still don't have answers on a lot of things too, right, mark? what questions do you still have? >> well, for one, it's been two years to the day and literally almost to the minute when i lost my son, and i still don't know how he fell. i know that it was, obviously, the suicide bomb. did my son suffer? did he bleed out like some of the others did and were talking and handing out ammunition? you know, our families are being told one thing, and the marines that were on the ground right there in the mix of it all are telling a completely different story. you know, i don't know anything about it -- pete: why wouldn't they just level with you, mark? why won't they communicate9 and just be straightforward? your son, he's a hero, why not just be honest in i don't get it. >> i don't either. i think that it's coming from the top. they don't want to talk about afghanistan, they don't want to even deal with it whatsoever. they just keep thinking it's going to go away. i'm sorry, that's not going to happen. president that's right. and you've started an organization called the freedom 13. folks can look it up. what does the freedom 13 do? ♪ ♪ rachel: well, the hispanic vote is up for grabs in 2024. a recent fox news poll shows president biden only leads former president trump among hispanic voters by just 9 points while in 2020 the biden took the voting bloc by 28 the points. this as many working class latinos express increasing satisfaction with democrats' economic and social policies. so is the voting bloc shifting right this let's bring in our panel, reverend rubin diaz, president of the new york hispanic clergy association and a former lifelong dem democrat who served as a state senator, correct in and also on city council. and -- [inaudible] rodriguez is a are republican from new jersey. he is a business other than and the host of the sergio rodriguez show. i'm going to start with you, sergio. how much -- by the way, of all demographics, the most dissatisfy ifed segment of the united states population are hispanics with joe biden. so how much of that is about the economy, and what are hispanics upset about? >> i think it's all about the economy. if you really look at it, the toughest thing for hispanics to do right now is to the plan. they cannot plan their children's education because of how expensive it's gotten recently. they cannot plan to buy a home. i mean, we know how the rates is have gone in the last -- rachel: yep. >> and to be the fair, you can't even plan the 21 meals of a week because people are skipping meals because financially since biden's e been president of the united states, hispanics are suffering economically. rachel: yeah. it's hitting the working class really hard. it's hitting small business owners which, as you know, hispanics make up the greatest percentage of small business owners as well percentage wise. so let's go to you, rubin. he's talking about the economy. we know it's hurting people at the kitchen table, but there are some really serious social issues that are at odds with the democrat party that it seems like over the last few years are really been laid to bare, right? really basic stuff like what's a woman, what's a a man, etc. >> i am the president of the new york hispanic -- organization. we are an organization composed of 150 # hispanic ministers. so so the evangelical community is very, very upset with the way that the democratic party have been treating us and treating the community and treating the nation. rachel: how do they feel that that they're being treated? >> our children have been indoctrinated in school. the conservatives have been persecuted. rachel: yes. >> our teaching -- [inaudible] because now they want womans, mens and children -- rachel: and is what's happening and this feeling of persecution for their values and the way they feel about these issues, is that going to be enough for these democrats to vote for a republican? in the next election? >> i believe so is. i believe that that the evangelical community is moving, it's very disgusting, and now with the way they're treating the immigrant, these open borders -- rachel: yes. >> -- it's a mess. they're abusing children. rachel: right. they're part of the problem, yeah. >> so we are very disappointed, very angry, and i think that we are moving. we're moving, and if the democrat don't do something next year -- rachel: yeah. i think it's going to be hard for them to reverse their position on so many of these social issues. do i have a few more minutes on this or are we wrapping? enough for one more question. sergio, maybe we can do it quickly. how much does what we see happening to the justice system, so many hispanics move because of rule of law and the idea of equal justice, and we're seeing some very -- things that we used to see in latin america happening here. we just saw the mug shot of donald trump come out yesterday. >> and look, i think the fact that you could even fathom that this would happen to a former president and that they would just almost use him as a pawn in what they're trying to do is just embarrassing. it's embarrassing to our country. rachel: yeah. >> it's -- i end mean, i can't, i still as a 48-year-old man cannot believe that i have spent my life in this country and that this is where we're at right now. rachel: yeah. criminalizing the opposition, going after them politically in ways that we saw in latin america so often. thoughts? >> this is becoming a dictatorship. we're even afraid to speak, and they trying to shut them up, us up. and we are tired, and i as a minister, as a form form state senator and city council member, if election were held today, i'm willing to campaign for the republican party. rachel: fascinating conversation. these things are not shocking to hispanics in many ways. they're familiar ask they scare us. so thank you for joining us. what a great conversation. >> thank you. thank you too. rachel: all right. will?
