>> bryan llenas in atlanta. brian, thank you. let's bring in george washington university law professor jonathan turley good evening, jonathan. >> good evening. >> bret: this is a little different. this is a processing that is handled different and it looks like a mugshot is going to happen here for the former president of the united states it does. this is going to be a particularly demeaning process for the president because of that there is going to be a mugshot. there is going to be bond. it's going to have all the elements of the criminal process. some of which he was spared in the earlier indictments. and in the end, it's going to, i think, reaffirm what people already believe about the case on both sides. you know, many on the left have gotten to a point of salute ecstasy in anticipation of this mugshot. there's a type of thrill-kill environment waiting for that mugshot to come out. on the right this is a frustrating moment. they view this as the weaponization of the criminal process by a democratic prosecutor. and that's why i think this is ultimately pretty damaging to our country right now. we are already very divided. and what happens about to happen, i think is going to push people further to the extremes. >> bret: you're right. listen, this image will be remembered through history, and both sides will look at it differently, but it will be indelible mark, a historic mark, whether you think it's really horrible what is he going through and shouldn't happen or you think it's really what he should face for justice. i want to listen to rudy giuliani former lawyer for the president, former new york city mayor. fani willis will go down in american history as having conducted one of the worst attacks on the american constitution ever when this case is dismissed. she has violated people's first amendment right to advocate. to say petition the government for grievances like an election they believe was poorly conducted or falsely conducted. people have a right to believe that in america. >> bret: there is this push to have a speedy trial on october 23rd is supposed to be the possible date for this trial to begin. >> bret: they have got these 19 people. >> yeah. >> bret: former president trump and 18 others. how is this going to happen? how? >> right. you had your hands full with 8 people in wisconsin trying to make their case. >> bret: very true. >> you could double that add three and put their liberty at stake and can you imagine what that courtroom is going to be like. i can't, honestly, see how that date is even possible. i think it undermines the credibility of the prosecution to set such a date. what's the interesting factor here is the request for a speedy trial by one of the defendants. that defendant has a right to a speedy trial. most defendants waive that right because time works to the advantage of the defense in terms of getting more evidence and try to figure out what the best defense may be. so, for those defendants that are seeking a speedy trial, they may have to be severed, in order to fulfill their constitutional rights. >> bret: the last thing, quickly, i mean, won't they have to do batches of them? i mean, i don't think we have ever seen 19 people in a courtroom, have we? >> i think that it would be a circus, frankly, i think it would do an injustice. there are bunches of defendants here, that is defendants who are leaned to critical acts, things like accessing voting machines, or putting together alternative elector lists. things of that type. you can bunch them together. i just don't see the value of having this mass trial. i think it's going to just add to the really uncomfortable feeling that many people have about this. that it has -- looks like a political trial. there is some legitimate, you know, there is some strong charges here. some of these defendants are looking at a really tough going in court when you deal with some of these insular crimes. but i don't think that they are all need to be tried together. in fact, i think it would -- really undermine all of the trial to try to get it all done at one time. >> bret: jonathan turley, as always, thank you. >> thank you. >> bret: well, no shortage of emotion, aggressiveness, confrontation during last night's first republican debate of the 2024 election cycle. the candidates trying to make the most of the fact that the clear frontrunner in this race, former president trump, was not on that stage. chief washington correspondent mike emanuel joins us now with highlights. good evening, mike. >> bret, good evening. a feisty debate as eight republican candidates tried to stand out in a crowd. >> as republicans, i'm the only person on the stage who isn't bought and paid for. >> i've had enough already tonight of a guy who sounds like chatgpt. >> we don't need a president who is too old and we don't need a president who is too young. >> some of them are now trying to maintain the momentum while others are clarifying their remarks. >> there was kind of a lot of cross chatter that was going on and, you know, my thing is like, look, we are auditioning to be the president of the united states. >> tonight -- >> the morning after the first g.o.p. primary debate candidates were out putting an exclamation point on their main themes from the debate stage. the only woman candidate in the debate called for being honest and realistic on abortion. >> all americans do agree we shouldn't have late term abortions. i think they do agree we should encourage more adoptions and good quality adoptions. >> south carolina senator tim scott said there must be federal action on abortion to avoid liberal states offering abortion on demand. >> we have to create a culture of life in this country, and that starts with the 15-week limit. seven out of 10 americans agree with that position. >> today, former vice president mike pence emphasized his resume. >> what we need is leadership that has the experience and the proven conservative credentials. >> last night, pence launcheds this attack on political newcomer vivek ramaswamy. >> now is not the time for on the job training. we don't need to bring in a rookie. >> ramaswamy was clearly the light any rod of the debate. >> the problem that vivek doesn't understand is he wants to hand ukraine to russia. he wants to let china eat at this taiwan. >> ramaswamy fired back at haley. >> wish you well on your future degree on the boards of lockheed and raytheon. >> when asked if the support the former president if he is the g.o.p. nominee. christie and former arkansas govgovernor asa hutchison did nt raise their hands facing a chorus of boos from the audience. >> here's the bottom line, someone has got to stop normalizing this conduct. >> desantis is still polling second in most polls. the gap between him and former president trump has been growing but the candidate who took the most heat was ramaswamy. his campaign has been surging in recent polling, suggesting candidates may no longer see desantis as their most immediate threat. bret? let's bring in our panel fox news senior political analyst juan williams. katie pavlich news editor at town hall.com and jason riley "wall street journal" columnist senior fellow at the mid-atlantic institutes. a lot of policy to talk about. we spent the first hour really on a number of different policy issue and the top of the second hour mentioned the former president for the first time. jason, your overall assessment of what you heard? >> i thought it was a very useful debate. i'm glad you did spend that first hour talking about policies. trump wasn't there. he'll come under criticism for not being there. i understand that criticism. and probably didn't himself any favors by choosing alternative forum where he was not going to be challenged on his views or record and so forth. the voters will decide on that. i think he did the party a favor, in some sense, by not showing up because we got a chance to hear the views of other people running for the nomination, how they would take the country forward. and i thought you and martha did a great job of not letting trump dominate both hours of the debate. and people got a chance to hear what other people, who are running for the nomination would do. and so i thought, over all, it was very, very useful, useful two hours. >> bret: yeah. when they got to hear. obviously the candidates took control at some point. what you didn't see is they have these lights that face them. that's a green light. a red light. a green light, yellow light, red light and their time is heading towards being finished and then you heard the bell. well, you know, vice president pence definitely rolled through the bell a number of times. there was a lot of interchanges where it was tough to herd the cats, katie. your thoughts overall on that? >> well, my favorite part of the debate was actually you and martha opening it up by mentioning the song rich men north of richmond. because it's such a cultural moment that song, which has gone global. it's the number one song on the billboard charts. took over all the charts here in the united states and every chart it's number one. and it really is a reflection of how washington, d.c. and democrats and some republicans, mostly democrats over the past two years with all the extra spending they have done have really inflicted serious pain on american families and made it much more difficult for them to get ahead. and it's on everybody. inflation is a permanent tax. the biden administration keeps trying to claim that inflation has come down. it hasn't come down it. just means that prices are not going up as quickly as they were before. in terms of the debate and the results of it, i thought that mike pence looked a little bit desperate. he was punching up in terms of polling at vivek ramaswamy but he really looked like he was punching down because he continued to go back and forth with the interruptions. but, ron desantis kind of, right in the middle, president trump was not there, and, according to the polling that's come out post debate he has actually made some headway when it comes to consideration from voters and, according to the polls, 50% of g.o.p. primary voters could be undecided. so a little bit of movement for him and for nikki haley as well. >> bret: yeah, nikki haley as well. i think i heard a number of pundits for him having some big moments on abortion, on foreign policy and kind of hitting her marks, juan. take a listener to this. g.o.p. candidates. a couple other moments clashing in milwaukee. >> if you want something said ask a man. if you want something done, ask a woman. [cheers] >> i'm the only person on the stage who isn't bought and paid for. >> you have never done anything to try to advance the interest of this government except to put yourself forward as a candidate tonight. >> i think the american people deserve to know whether everyone on this stage agrees that i kept my oath to the constitution that day. >> mike did his duty. i got no beef with him. is this what we're going to be focusing on. >> i'm relieved. >> democrats would love that and they will win if we let them get away with it. >> bret: obviously at that point we had spent the whole hour before that talking about policy. politico writes: desantis was ignored by g.o.p. rivals. ron desantis expected to take the brunt of his opponent's fire instead he faded into the crowd largely ignored for two hours by his lower polling rivals on webs. the florida governor watched as the first debate of the g.o.p. primary turned into a pile on on vivek ramaswamy. juan, what do you think? >> well, i think that's about right. mike pence gave you a lot of trouble, bret, but he got the most of the time, the camera time as a result. you know, and he had some good points to make on abortion, for example. i think he was very resolute in his evangelical point of view. but, the real focus of the evening turned out to be ramaswamy and it's clear that the other candidates see him a threat. otherwise they would not have been so loaded forebare when it came to going after him. i thought nikki haley though when it came to ukraine she made mince meat of his argument and pence went at him again. the entire stage seemed to be saying he was amateur. he was called chatgpt candidate. a lot of that fire indicates where people see movement in the polls in the g.o.p. primary other than that the key point desantis the number two to donald trump in all the polls, again, he came in losing support in terms of the polls. he has been sliding. losing donors. and even losing staff. and, yesterday, he, again, it did look like he was an after thought on the stage. he was standing there. but i can't tell you that he made an impression. some of the fallout from that section of the debate last night. this is on cavuto today. the question is if he is a convicted felon owhy want to support him? i don't believe it's right for a convicted felon to be the president of the united states i don't think any republican should want our standard-bearer, let alone our president of the united states, to be a convicted felon. >> bret: yeah. jason. that was the hand raise and kind of was like one side of the row raised their hands and everybody looked at everybody else and kind of made it down to christie and asa hutchison who didn't raise their hand. what about this? we're going to talk about the former president on the other side of the break it wasn't just everyone looking down the row. i think this is probably ron desantis' weakest point of the evening. because he looked to his left and his right before he decided whether to raise his hand and answer that question. and that did not come off well, i think. he should have anticipated that question coming. should have anticipated it coming. vivek ramaswamy did steal a lot of the thunder of the evening. he got most of the attention. that's who we're talking about today. but i didn't find his argument particularly substantive. he came off to me a little congress sure for someone only polling at 7, 7 and a half percent nationally. so i did think that compared to him, the nikki haleys and the mike pences had a pretty good night. and i think they were able to answer a lot of the sort of glib responses. i'm the only one not bought and so forth with some substance. i think people were looking at that and that will resonate. >> bret: a lot of people tuned in. it was a big, big night for viewership about 12.8 million combined the viewership. so, thanks for tuning in. when we come back, in just a few minutes, the former president is going to land in georgia and is he going to make his way to the fulton county jail. there you see the airport. and he is going to be processed, including a mugshot there we'll talk about that and what comes next in all of this. and, later, a special first day of school. ♪ ♪ age is just a number, and mine's unlisted. try boost® high protein with 20 grams of protein for muscle health versus 16 grams in ensure® high protein. boost® high protein. now available in cinnabon® bakery-inspired flavor. learn more at boost.com/tv >> bret: if former president trump is convicted in a court of law, would you still support him as your party's choice? please raise your hand if you would. [cheers] >> bret: all right, there's the moment we were referring to earlier in the show. as you look live at hartsfield international airport, we are waiting for trump air to land there. the former president's plane coming from new jersey, as he lands to be processed at the fulton county jail. and we're back with the panel. katie, this is different. there's going to be a mugshot. there is a full-on processing in fulton county and we talk a lot about moments and images. no matter what you -- how you look at this, it is indelible image. >> state charges so the president cannot seek a federal pardon either from himself from a republican or presidential candidate. stacey abrams ran for governor in the same state of georgia. she lost to brian kemp. she filed a lawsuit contesting that election. she lost. she pushed money into a group that funded false information about voting machines. and, yet, she is not in the same position of indictment as president trump and his election attorneys. so that's really the crux of the issue here, not mention the d.a. who has brought these charges, fani willis campaigned on going after president trump himself fundraising off what she has filed. >> bret: we are looking live just outside the jail there. there's a lot of security already. juan, your thoughts? this the real world answer the question that you posed last night at the debate with the candidates raising their hands. you know, only two didn't raise their hands, as you pointed out, christie and asa hutchison but there was also the roar from the crowd. the crowd apparently, you know, most republicans are still backing trump even after four now indictments. this is historic, unprecedented and real world. this is where it's playing out. >> bret: juan, obviously they have a chance to make their case in all of these courtrooms and a lot of those g.o.p. voters, jason, are saying he is wrongly being accused and charged here and every indictment his poll numbers have gone up, his fundraising has gone up. sure, but we saw a bunch of people on the stage last night that i think could beats a very vulnerable joe biden in terms of his popularity in the polling and job performance and so forth. the question is will republicans go with someone like donald trump who will have all this baggage with him while is he running to replace joe biden versus someone who does not have this baggage? and i think it's something we'll see. but, to me, i think that republicans might re-think if there is actually an a conviction of whether to go with donald trump as the nominee, baggage and all? >> bret: we'll see. he is obviously up 30, 40, 50 points depending on the poll you look at. as i mentioned to governor desantis last night in the debate. panel, thank you, as we continue to look like at the airport and all these transport things. we take them because it's a moment. it's the 45th president of the united states that's going to all these courtrooms. tomorrow on "special report," our whatever happened to segment we'll have that thanks for inviting us into your home tonight. please remember if you can't catch us, set your dvr 3:00 3 p.m.west coast and 6 p.m. on e east coast.
