coming up. >> the biden family had an inside man, a biden family insider worked in the u.s. attorney's office in delaware. >> macler was in the office and that's the most problematic part of the plea deal from the judge's perspective. >> he was involved at almost every juncture of joe biden's political life for the past 15 years. >> sandra: new details about what appears to be a cozy relationship between a former delaware prosecutor and the biden family. hello, welcome everyone, sandra smith in new york. hi, john. >> john: we made it to thursday, friday eve around here. i'm john roberts in washington, this is "america reports." a new report reveals long time biden ally alexander mackler reportedly sent messages to a secret email address to then vice president biden shortly before joining david weiss's office. >> sandra: dating back to 2007 as biden's days as a senator. >> john: congress wants to get to the bottom of it with biden's personal email addresses. >> sandra: what does all of this mean to you, and what should it mean to people at home? >> actually, i don't think it means very much. the broader problem is that the hunter biden investigation should have never been sent to the delaware u.s. attorney's office precisely because of the bidens' influence in delaware. the influence of a senator on any u.s. attorney's office in his or her state. all of the particulars there, and i've said this before, i'm a big fan of bill barr but made a mistake when he sent it there and should not have been kept there. as for mackler himself, i think he was gonna month after the investigation began. so unless we find out there was some kind of secret channel with him after he left or that he had some influence we don't know about, i think that part of the story is just not a big story. >> john: but certainly there seems to be evidence of a cozy relationship between mackler and the bidens in the years and months leading up to the investigation. they mail from july 7, 2015, to the entire biden clan after the death of beau biden from mackler saying losing beau has been particularly difficult no one believed in me like he did. the thought of going through life without his guidance feels like climbing a mountain with no rope. july 18, 2018, i believe was shortly before weiss's office, he was u.s. attorney for delaware, shortly before the investigation of hunter began, email from mackler to hunter biden, love you, hope you're good, call some time. you know, kerri was on the other day talking about the delaware way, which is the cozy relationship that people in power in delaware have with each other. this would seem to be an indication of that in practice. >> well, as an example of the delaware way, it's an example of the kind of political appointments that you have and a lot of u.s. attorney's offices around the country, large or small. the u.s. senator from the party in power in the white house will often have an effect on who gets hired in u.s. attorney's offices. i saw it happen back in my day in a very big office. but there's nothing inherently unethical about the fact somebody close to a senator gets a job as assistant u.s. attorney. it would have been a real scandal if mackler had any kind of say in the hunter biden investigation, but like i say, it's not unethical he got a job, but it's indicative of why it never should have been sent to a small district like delaware where, you know, president biden visited the office and chatted with staff during the investigation. it just is a recipe for a nonaggressive prosecution. now, there has been a report that mackler was close and did some cases with leslie wolf, as you know the ausa in charge of the investigation, and who the whistleblowers complained about. if it turns out there was some kind of communication going on, back channel communication after he left and that was going to the bidens, that's a big scandal. but we have no indication that that happened. >> sandra: we'll keep watching. >> i know it's sexy to talk about it but he was gonna month after the investigation started. >> sandra: certainly big questions swirling around that. meanwhile, ask you about hunter biden sol travelling to 13 countries with his then vice president father, and when he was leading the defunct company, and they found video footage along with secret service records and messages previously reported from hunter's abandoned laptop, show hunter, co-founded rosemount seneca in 2009, accompanied by then vice president joe biden during official trips to europe, central america, africa and asia. and during the obama administration hunter attended several state dinners. and hunter biden in 2020 decided to drop secret service protection. could this have been for any reason other than concern that his father might be implicated in some of these business deals? >> well, it's incredibly sleazy to have been doing what he was doing, basically accompanying his father on business repeatedly official u.s. government business and then using it as his own business opportunity. and i would think that if he had secret service protection while he was -- while he was on burisma's board and doing business with them it would look even too bad for hunter. there's not much that embarrassed him, apparently, but that would look even too bad for him. that's a very good guess on your part. and i think congress should keep digging. i'm going to tell you something. you are not going to get anything from the u.s. -- from the investigation by david weiss. it doesn't matter whether you call him special counsel or special pubah. it was a mistake to have him do it. and something nobody else seems to be talking about. hunter biden's lawyers think the pretrial diversion agreement, they think it's still in effect and let me tell you something. that is not a frivolous legal point. so even if david weiss somehow wanted now to indict hunter biden for felony tax evasion, a very strong argument because of that diversion deal they entered into with him it ain't gonna happen. if congress doesn't do it, if the house doesn't do it and use their subpoena power, i don't think anybody's going to. >> john: that's a point, certainly that hunter biden's attorneys are making saying the diversion program on the gun charge, that was signed by both sides, still in effect. the doj begs to differ, we'll see how it goes. in terms of what sandra was talking about, hunter flying around the world on air force two for some business meetings, email from april of 2010 from hunter biden to his business associate mark doyle he says how about we go over around may 10th. jrb, assume joe r. biden will be in madrid, i can catch a ride with him and fly over to serbia and back with you, that obtained by fox news digital. is that evidence to your mind, sol, that he was using air force two like a private airline? >> it sure seems like it. again, there's a lot of what you can do in washington if you are part of the political class or a family member of a politician that unfortunately is not illegal. but it's definitely part of the picture. and look, this is something that our own government officials in the obama administration were concerned about. the diplomat, i think his name was george kent in ukraine, he raised concerns about it and basically nobody could talk to joe biden about it. he apparently would get upset when you talk about it. an official high in the energy department that raised, they both raised the concern that wait a minute, we have an anti-corruption message that we are trying to portray in the ukraine and the vice president's son is working for the most corrupt company so that's a problem. >> sandra: sol, thanks for joining us on all of that. appreciate the analysis. >> thanks for having me. >> john: thank you, sol. >> i'm the only person on the stage who isn't bought and paid for. >> i've had enough already tonight of a guy who sounds like chatgpt. >> under your watch you will make america less -- you have no foreign policy experience and it shows. >> i wish you well in your future career on the boards of lockheed and raytheon. >> john: the fur was flying last night, the first spirited republican primary debate, most pointed attacks toward vivek ramaswamy and no shortage of president joe biden's policies. how did ramaswamy handle the repeated attacks, grady? >> he went after everybody on the stage, john. you know, he took on a lot of the attacks and created some of his own fireworks by going after all of his opponents, all seven of them, calling them professional politicians and you just heard there, bought and paid for by special interest. at least based on their positions in the polls before the debate, florida governor ron desantis and ramaswamy were the top two candidates on that stage. desantis, for his part, pointed to his record in florida, while ramaswamy touted his lack of political experience. >> i made promises and i delivered on all of those promises. 2024 is make or break, we are not getting a mulligan, no excuses, i will get the job done and as your president i will not let you down. >> do you want a super pac puppet or a patriot this speaks the truth. incremental reform or do you want revolution. >> and it wasn't just fireworks. there were some substantive discussions on issues as well, including the border, crime, and education. the candidates also tried to contrast their vision for the economy with bidenomics. >> gas is up 40%, your food is up 20%, electricity up 20%. we can stop that by turning the spigot off in washington. >> we cannot sit by any longer and allow the kind of spending that's going on in washington because every dollar they spend is a dollar that these people are not allowed to spend on their children and their grandchildren. it's robbing our country and it's wrong. >> while they are all saying this, you have ron desantis, you have tim scott, you've got mike pence, they all voted to raise the debt and donald trump added 8 trillion to our debt. >> the candidates are wasting no time getting back on the campaign trail. senator tim scott will be in new hampshire tomorrow. also tomorrow ron desantis and vivek ramaswamy will be in iowa. we are also looking forward to the next debate, posted by fox business at the reagan library simi valley, california, september 27th. john, mark your calendar. >> john: yes, and hopefully for you folks there outside all day it will be a little cooler when you get to simi valley than in milwaukee. >> we would appreciate that. >> john: i thought, sandra, the line of the night belonged to nikki haley, quoted margaret thatcher, if you want something said, ask a man. if you want something done, ask a woman. >> sandra: all the candidates had a moment, asa hutchinson will be joining us later this hour, his thoughts how he thought he performed on the stage and how he thought his opponents on the gop primary stage performed as well. so, we look forward to that. >> john: spoiler alert, a columnist in the boston globe thought he was one of the highlights of the night. >> sandra: fox news alert for you, news coming into us right now as we are learning in the georgia -- the trump georgia election case as more trump co-defendants have surrendered in that georgia election case, that the trial has now been set. we know the campaign lawyer for trump issued a motion for a speedy trial. the d.a. in that case has now requested the start date, and this is the news, for all 19 defendants in that case to be, john, october 23rd, that is the trial date, october 23rd. >> john: so we'll see if trump's attorneys accept that or not. that would certainly put that trial well ahead of the primary schedule, we didn't think it was going to happen maybe until next year, but trump already has certainly enough things on his plate for early next year in terms of legal hurdles he has to get over and the whole primary schedule as well. so, we also are still awaiting to see if trump surrenders today to authorities. fox digital obtaining new bodycam video showing the dramatic moments when police arrested the woman accused of orchestrating the fatal shooting of her ex-husband and microsoft executive jared bridegan. where that case goes from here. >> sandra: the russian president speaking out about the plane crash that killed the top leader of the wagner mercenary group. what he was saying and morgan ortagus will join us live next. >> the russians have made it known that you cross putin and you are not going to be around very long. owing money down the rent drain, so to speak. after watching the admiral that just made up my mind, i said, i'm calling newday usa tomorrow. 70 more dollars over my rent. i'm actually owning my own home because newday usa focuses on the va homeloan benefit. that's their expertise. i felt like i would definitely get a better shake. the admiral said that my service is, you know, my down payment. for us that was important not to be able to have to put anything down. i was aviation in the marine corps, 30 some million dollar aircraft. if the country, american people can put that kind of trust and confidence, the equipment that we fix, literally $200,000 home. can you help me? can somebody put a little bit of belief in me? and i felt like i felt newday did do that. if you can afford rent, you can afford to own. to maximize that va loan benefit and not pay anything out of my pocket was tremendous. i had my doubts, but i don't anymore. directv sports central gives you access to every game. but terry doesn't have directv. come on. work for dad- here... now, you can find the game easy. my barbecue is saved! get in the redzone with sports pack. call 1-800-directv my barbecue is ruined. arthritis pain? >> well, i looked up an old quote from putin. he once said something very timely and relevant today. he said that the only thing that is unforgivable is betrayal, and so he clearly has lived up to that moniker. but listen, putin is somebody -- not someone that operates in the community of civilized nations or should be treated as such. right, this is someone who has gone off reportedly former british spies in the united kingdom, trying to poison them, kill them. he's on par with like kim jong-un who poisoned his brother in an airport. this is a despicable regime that should be treated like north korea like kim jong-un. and it's like isis and al-qaeda fighting with each other, you root for them both to win. >> john: where do we go from here? after the failed mutiny, russian military tried to absorb some wagner forces into regular troops. wagner forces, looks like -- looks like morgan may have lost her ifb. so, i think rather than trying to reestablish connection we will just bid morgan a fond farewell and adieu, and we will go on to the next thing. so, soaring mortgage rates have home buyers thinking small properties, shrinking, as builders cut back on their budgets and maybe cut corners, our economic panel sounds off on that. doug holtz-eakin and robert wolf. >> sandra: like shrinkflation, they make the cereal boxes smaller but charge the same price, doing it with houses announcement thank you. a new warning for parents. are your kids hiding vape pens in plain sight? are we seeing the american dream shrinking? i mean, at least with these housing sizes that is happening. they are charging the same amount and you are getting less. >> well, you adjust on the margins you can and this is a very tough environment. you can't really look for apartments, you know, apartment rents are going up at over 5% a year still, we have high interest rates, we have, you know, the fallout of the great overstimulus, left us with inflation and real wages down 6% since the start of the biden administration. so what margin do you have left to make it cheaper? shrink the house, that's what they are doing. >> sandra: that's really interesting. wall street journal, good-bye to the bathtub and the living room, smaller homes can help cost constrained buyers facing high mortgage rates. also boost the bottom line for builders who are contending with spiralling labor and construction costs and that's a really interesting concept. we have had folks like that, plumbers, carpenters, on this network and beyond saying it's hard to find work. demand so out there but they cannot find the skilled workers to fill it. so, what are we seeing happening with the housing market and is this a shrinking part of the american dream, robert? >> sandra, you have been spot on on this a few months if not longer i saw a phenomenon i'm not sure i've seen in my 40 years of finance. we have new home sales up over 35% year and year, 30%. where a majority of them are first time buyers. we have existing sales almost down 20%, much larger market over the past year. so i think to douglas's point and your point, what we are seeing, there is a complete lack of mobility for those with existing homes because of where they are in their interest rates so a lot of them have 5, 10, 30-year interest rates at a low price, there's no mobility for them to go somewhere. and so now you have new home buyers where as you said, wages are tougher, and home prices are higher, so they have to find ways to cut costs. i have not seen this kind of, you know, lack of correlation between existing and new homes, i don't know, douglas, you know, is an economist, he may have a better insight, probably not since the 1980s. >> sandra: there is something going on here, doug. i'll let you respond to that while i put the pictures up. published in the wall street journal and then went to a website of the builder as well, a semi custom new home builder operate near indianapolis, they recently launched this new neighborhood concept with detached homes, 3 to 400 square feet smaller, cheaper than a typical build, expanding the kitchen area, taking away the dining room all together in some cases, taking out like bathtubs, you'll still have the bathrooms but not as big, and whaty are doing, much smaller lots to save on the cost as well, and increasing landscaping to try to provide privacy because you are, you know, you are smooshed in there in a lot of cases. is this the way we are going, doug? >> well, i think robert is on to something. think about how the home marke was for a while, builders were building big homes, not small starter homes for first time buyers. they could make more money on a big house. now all of those potential buyers are in a house with a low interest rate mortgage from the past couple years and they are not giving up the house and not putting it on the market and not buying anything. they had to move to building starter homes and to make them affordable, it's a recipe we have seen before. you have to increase the density, often we try to do apartments, these are single-family detached but smaller lots, smaller houses so they don't cost as much, and that's where the builder can now make a sale. and it's the only market available to them. >> sandra: and the estridge builders, the first time buyers and the empty nesters, a couple downsized from a 7200 square foot home to a 3200 square foot home, and the furniture market, they are adapting to this new normal in the housing market. they are making much smaller furniture as well. final thought from you, robert. >> listen, i think we have not really seen the shift and i'm nervous about the resale value of the future of these types of homes, smaller ones on top of each other, that's still the best asset someone has usually of their wealth, right. as you said, it's the american dream, and i think that you know, we are in the very nervous environment with this. >> sandra: you can ask people all over the country right now, if you need to move you are really hesitant to because you are in a home that you got into in a free money environment to leave to pay 7, 8% interest rate. that's game changing. so the number one thing you hear from realtors, there's no inventory. people are not leaving their homes, it is a fascinating dynamic that is happening. thank you so much to both of you. we'll have you back soon. >> john: a live look outside the fulton county jail in atlanta where former president trump is expected to turn himself in at some point today. a live report coming up. plus this. >> the truth is, that biden didn't do this to us, donald trump added 8 trillion to our debt and our kids are never gonna forgive us for this. you tell me who are the big spenders. i think it's time for an accountant in the white house. >> sandra: that was a big moment when white house hopeful nikki haley at the gop debate placed the blame for washington spending on president biden and her fellow republicans. so, who has the solution? >> well, we expect to qualify for the second debate which will be in simi valley at reagan library, very excited about that. we accomplished everything we wanted in last night's debate as the columnist indicated, we showcased that i'm ready to be president, i can take on joe biden, i can attract independents into my column, and we can win again. i also made the point that we need new leadership in the party. as the future of the campaign, nobody thought i was going to get on the first debate and we surprised them, we are there, and we for the first time presented ourself to a national audience. so i was thrilled with last night and the contrast that was made and the clarity of my mission going forward that we can win as a republican party if we have new leadership. >> sandra: when you say thrilled, i assume you give yourself an a on your performance there, governor? >> oh, i'm not that bragy, i would downgrade a bit. clearly i was not prepared for a food fight and so -- >> sandra: is that what you think it was? >> well, you know, it was out of control. i mean, there was a lot of yelling back and forth and as you can see, i got less time than others. we'll change that. >> sandra: there were some who jumped in, that's for sure, a lot more than others. of your gop -- the other gop candidates on the stage, who surprised you the most up on that stage? >> well, i think what surprised me was how ridiculous many of vivek ramaswamy's ideas were. i knew about them, but he doubles down on those. >> sandra: like what? >> well, for example, his theory that we should give in to russia and secondly, that somehow we ought to, you know, have term limits for federal officials, not elected officials, but those in office. i mean, you go on and on down the list and then he declares everybody else on the stage as in the pockets of, or bought and paid for. so that's why nikki haley took him off, we applauded her on that. but that was a little bit of a surprise. i was surprised ron desantis could not be clear on whether he supported ukraine or not. it was still ambiguous and that's his problem from day one, first call in the territorial dispute and then say that was wrong, i'm for it and now not clear whether he wants to support them again. so those are some surprises to me. >> john: yeah. you know, it's often said that the person who takes the most fire at these debates is the person the other candidates are most worried about and ramaswamy is really coming up on the inside very quickly. i wanted to ask you about what you want regarding former president trump. you and chris christie were the only candidates on the stage to not raise your hand to say you would continue to support his nomination, if he gets convicted of crimes. and you said in your statement there from the debate stage that you believe that it would potentially be disqualifying if he were convicted of a crime. i've done some research and found nothing i could see that would disqualify him. if he were convicted of federal charges he could pardon himself. might be a constitutional question, but state charges, is it better to have him in jail or would the fact that you need to have him as president supersede that and any jail sentence after he ceased being president. but you made a pledge, governor, to support the nominee but your pledge clearly comes with a caveat. >> well, john, first of all, you are correct that just because a candidate is convicted of a crime doesn't prohibit him from being president. but the 14th amendment of our constitution does if you have engaged in insurrection, and that's what's being tried currently, but it doesn't even take a trial, you know. any secretary of state could determine that former president trump while he was a federal official engaged in an effort to overturn the election and could disqualify him, obviously it would be tested in court. that was my point, and under rnc rules, that's not -- that's not going to prohibit me from supporting the nominee of the party. it would prohibit that candidate from being a qualified one. we need to be aware of that. >> sandra: very, very interesting stuff. i think i said good morning, we saw you on the stage so late last night, governor, i'm sure it's been a long day indeed. thank you so much for joining us today governor, appreciate it. >> john: governor, we'll see you on the trail. thank you. >> thank you. >> i think it's a mistake when a corporation tries to silence anybody. i think you let everybody speak. >> sandra: espn stephen a. smith on the high profile departure of sage steele from the network. is there a double standard when it comes to free speech at that network?
