alejandro mayorkas, the secretary of homeland security and shouldn't be. >> john: a bipartisan group of lawmakers from across the country escalating attacks against the dhs secretary alejandro mayorkas and the border policies. good afternoon to you. >> jacqui: good to be with you, john. i'm jacqui heinrich in for sandra smith. a group of two dozen texas lawmakers led by chip roy will lock funding from mayorkas' department unless biden addresses the worsening situation at the border. >> john: across the aisle, focusing of reports of texas separating migrant families and putting pressure to investigate state agencies for the alleged incidents. >> jacqui: and mayorkas has taughted the lower number of migrant crossings, the tide appears to be turning. in august, stopped 6,000. >> john: complete coverage. >> jacqui: casey stegall in el paso, texas. renewed debate about the border wall. >> there is. under president trump, $15 billion was allocated to build about 740 miles of wall and barriers down here along the southern border. and as you also know, when president biden took office he almost immediately pulled the plug on that project. and about 290 miles of fence was never finished. so, work sites were virtually abandoned and much of the unused materials have sat since then untouched. like on this new mexico cattle ranch we visited west of el paso this week where a gap remains in the wall and piles of taxpayer-funded supplies remain, some two and a half years later. >> if i ran my business like the federal government has run this project i would be broke. it's a simple fact. the waste is an agregious and the fiscal responsibility is very disappointing. >> now, a joint homeland security subcommittee held a hearing last month where we learned close to 21,000 unused wall panels stored in multiple locations. what's still not clear, how much is being repurposed and how much is being thrown away or just scrapped. >> we are talking somewhere around $2 billion worth of materials that have been just sitting down there, that was either allocated or purchased. these are contracts we continue to be able to pay every month. >> speaking of those monthly payments, the army corps of engineers says the government spends about $160,000 every single month just to store and secure these unused materials. jacqui. >> jacqui: casey stegall for us in el paso. thanks so much. >> john: as migrant crossings trend up heading into the fall, fox news has dramatic footage from the texas department of public safety showing agents involved in a high speed chase of a group of human smugglers before detaining them on foot. joining us now is texas dps spokesman lieutenant chris oliveras. the dps showed us the footage, it goes through a small rural neighborhood ends up with the two occupants of the vehicle, one whom appears to be a child in the orange t-shirt running through the brush, jumps into a swamp. how much more of this are you seeing? it seems to happen almost every day. what's the danger to the public posed by this? >> good afternoon, john. thanks for having me on. this is a daily occurrence every day on the border, not just us as also local and county, and with that, dangers are the fact you have the high speed chases where the smugglers have no record for the safety of the motoring public. they drive on the wrong side of the road, crash into other cars, crash into ranch fences then impacts the ranchers they have no regard for public safety at all. it's more dangerous. they are involved in a smuggling event and poses dangers to the people they are smuggling. cases before some illegal immigrants die because of the smugglers because they crash or last year in san antonio, they died in the back of the tractor-trailer because he were smuggled. and open borders you expose and allow criminal organizations to expand their enterprise throughout the united states, recruit drivers, even teenage drivers, it's not stopped. we see it every day and it becomes more dangerous as we encounter these individuals, these smugglers. >> john: we saw you folks chasing down the pick-up truck, not only off the road but on the wrong side of the road. obviously dangerous. chris, charges from democrats, specifically the democratic hispanic caucus, the texas dps is separating migrant families when they come across the border, specifically separating males from women and children. here is what they, part of what they wrote in a letter to merrick garland and alejandro mayorkas, after the fathers are incarcerated in state or local facilities, then transferred to immigration and customs enforcement custody with no reference to the families they have been separated from, and placed in expedited removal. mothers and children are traumatized and left wondering what happened to their loved ones. are you in fact engaging in these separations as democrats charge? >> absolutely not, john. and of course we put a statement out on that, and explained, i wanted to explain in detail what we deal with and what we encounter when we see these groups of illegal immigrants coming across the river. now, one thing to keep in mind also, we encounter the groups that present themselves as families, the reason why i say that is because there is no way to determine if there are actual family members, they don't have documentation or birth certificates, we have no way to determine if they are actual family members. we take their word for it and talk to the children as well, and if we see suspicious behavior or the child is in danger, we can further investigate and will not allow that child to move on with that group. but the encounter with the family groups is very short and brief. once we encounter them we turn them over. the males that are with the groups, we arrest them, and arrest a driver with a child in a car and drunk driving, there is a separation. to say we are actively involved in separating families is completely false and if you want to look at family separation, look at over the 300,000 unaccompanied children across the border and 85,000 not accounted for that, is a severe form of family separation. what we are trying to do, stop the flow of mass migration between the ports of entry and some cases male adults that are with the groups, they will force children through the concertina wire so they can injure themselves and we have arrested the male adults endangering the child. our best interest to look out for the children and make sure it goes with a family member if we can determine that. >> john: texas dps has affected the rescues of more than 900 children who were suspected to be involved in child trafficking rings. there is one other issue, too, chris, that's cropping up, that's the border barrier that's down the middle of the rio grand in one section. the biden administration is taking you to court saying it's illegal. now the federal government says wait a minute, this is on the mexico side of the border that runs down the middle of the rio grande. what do you say? >> one thing we are looking at right now, john, the governor's official, and if that's the case, it can be moved or extended. but the fact of the matter is, john, it's there for a reason, stemming the flow of mass migration. there has not been a single illegal crossing in front of the barrier, not a single drowning as well. drownings taking place and the fact we are seeing illegal crossings taking place further away from the barrier, so the barrier is doing its job. it's actually stopping the flow of mass migration between the ports of entry. >> john: we'll check on whether it's on the mexico side or the u.s. side or right down the center and see what you do with that. lieutenant, thanks for talking with us. appreciate it. >> jacqui: virginia governor is firing back fairfax county schools for defying on pronouns. >> the district says it's complying with federal and state anti-discrimination laws and so fairfax county schools will remain in opposition of virginia's state guidelines. the superintendent writes any student who has a need or desire for increased privacy regardless of the underlying reason shall be provided with reasonable nonstigmatizing accommodations. that means fairfax county school staff will not inform parents if the student asked to change name or identification. also will address students by chosen pronouns and play on teams and use facilities that fit with their gender. one activist says the board is keeping parents in the dark. >> fairfax county public schools is keeping information and secrets from parents regarding really important things like their children's gender identity and i think -- i know it's parents who have the best interest of their children at heart, period. >> some parents say they support the district, like one pant addressed board and says she has two transgender children. >> very grateful for the support that they received at their school from their faculty, staff, and peers, but i'm worried. we are worried their names, pronouns and in fact their very identity will no longer be honored at school. >> spokeswoman for governor youngkin said the policies perpetuate a false notion that the fairfax public schools know what's better for the child than the child's parent. the school board is expected to follow the law. it's unclear if and when this might make its way to the court system. back to you. >> jacqui: thanks so much. >> john: north carolina legislature overriding roy copper's vetoes of three bills relating to transgender issues. the bills prevent biological males from competing in girls sports. bans medical transitions for minors and limits discussion of gender and sexuality in the classroom. the new law after the veto override will take effect immediately. that's one of the first times i think we have seen that happen, where the governor vetoes it and the legislature comes back with the super majority, overrides. >> jacqui: i think you are right and i don't have any kids so i don't follow these quite as closely as those, but parents like yourself, i mean, i'm sure you follow all the developments with a closer eye. >> john: this is something that has not gotten across our personal radar at all but certainly we have talked to plenty of people, riley gaines among them, and caitlyn jenner as well say it's not fair for the biological male to be competing in women's sports. advantage of the male who has gone through puberty is so great that no amount of hormone therapy will override that advantage. >> jacqui: when it comes to the kids, that's what gets parents involved no matter what position. >> john: as you will find out one day. >> jacqui: maybe. standing by for what's described as a significant development from police in florida on the death of microsoft executive jared bridegan. the husband of bridegan's ex-wife, 1 of 2 people, was already arrested. we'll have that live when it begins. >> john: new polling on the republican race for 2024. biggest news is not about who is in the lead but rather the candidate who has surged into third place. are we looking at a brand-new race? these are big headlines. >> yeah, it is a big headline. there was a lot of public scrutiny on gardner in the immediate aftermath of jared's murder, remember, she moved 2800 miles away to washington state after the murder, did not attend his funeral, and the presser right now, guys. >> spending time with your family. your siblings miss you every day. there is a pain in our hearts that will never go away. your parents miss you, your wife misses you. your children miss you. to every single law enforcement officer, agency, the district and state attorney, we could never express our gratitude adequately. we are grateful for your sacrifices and your support. to every reporter, podcast show, producer, thank you, thank you for writing about jared's story. thank you for caring, thank you for helping us fight for justice. to every person who shared a story, liked, commented, posted fliers, about the truck, those who shared a prayer or sent words of positive encouragement, thank you from the bottom of the bridegan family heart. we love you all. thank you. >> for 547 days we have hoped and prayed this day would come. our hearts will always be full of deep gratitude for the men and women who have worked tirelessly to bring justice forward in jared's case. we are also deeply grateful for the prayers offered on our behalf. shana's arrest ends one horrific chapter of our pursuit for justice for jared and now we open a new one. this next chapter will be excrutiating. but we are confident in the ability of the state's attorney's office and law enforcement to bring truth to light. we expect to see justice carried out to the fullest extent of the law. our hearts and minds -- have been with liam and ali since the day of jared's murder but especially for the past year and a half liam and abby have been isolated and kept away from us while they lived with their mother, their step dad and maternal grandparents. despite my constant request to see or speak to them i have been denied and continuously ignored so i will take this opportunity to do it again. i plead with the gardners to put the emotional and mental well-being of liam and abby above all else and allow them to reconnect with us. we are their family, we love them, we have prayed for them every single day the last 547 days. since they were ripped away and isolated from us. the kids deserve all the love and support possible as we work through this next chapter. please do not continue to add to their pain, let our children be siblings again, and put them first and do what's right. thank you. >> anyone up for any -- >> you and your family members, parents, siblings, never gave up hope. you are standing here today talking about what the state attorney says is the final arrest in this case. what does that do? you said you are moving into the next chapter. but what's the feeling right now? >> i think i can speak for all of us. we have had every single feeling the last short time. there's been anger when we think about what was done. gratitude, deep gratitude that we are here today. happiness that we are finally seeing this day and just a lot of heartache, especially for the twins. so we are very grateful to be here and we know we have to buckle up and be ready for what's coming. >> as a family, did you guys ever think that shana would ultimately be arrested for this incident? >> from very, very early on everything in my soul and body told me that she was behind it. >> deeply emotional day like this. what do you tell your children about today and the results of today? >> london is too young to know anything. bexley is older, she was there, she's been part of this since they decided to kill her father in front of her. i have to keep in simple terms because she's only four. she knows that two bad guys have been put in jail and this morning i was able to tell her that who she refers to as the mean mom is going to be in jail as well. >> did you know this was coming today? >> we were given a little bit of a head's up. >> adam, you spoke directly to your brother. do you think he had a hand in keeping this family together and so strong through all this? >> i think -- there's not a doubt that jared has been working overtime amongst the family, but also helping in the investigation. there's been a lot of really incredible breaks that had to happen for this day to come and if you knew jared you knew that he does not give up. he's very focused and he would make sure that our family got justice while we are still living. so very, very grateful for that. >> i'll say this. his presence has been felt but i got to be honest with you, it's been a broken world. february 16th was a broken -- seemed like everything just broke, and today it feels a little bit better, it feels like we can do this, and i know jared has a heart and he's been in it and it's a step in the right direction. it feels right. >> state attorney melissa nelson said the state intends to seek the death penalty against shana and mario. does anyone from the family have a comment about that? >> a life was taken and countless lives were impacted by that. so i believe that the harshest punishment is justified here. >> thank you, guys. appreciate it. >> thank you. >> john: so there you have the family of jared bridegan, including his older brother adam and his widow kirsten talking about the latest bombshell development, the fact that jared bridegan's ex-wife, shana gardner fernandez has been arrested in richland, washington, where she moved to where she said to escape the scrutiny of the case. she will be extradited back to florida to face the death penalty of the first-degree murder of jared bridegan who was killed after he stopped his car because there was a tire in the road. the alleged triggerman has been in jail along with mario fernandez, shana's husband. paul mauro, you heard kirsten say from the very beginning they expected gardner was behind this. clearly the state agrees and soon she will be facing justice for her alleged crimes and if found guilty could face the death penalty in the state of florida. >> right. so, you know, this case somewhat demonstrates the value of having the death penalty on the table, even ultimately if it isn't used. i'm sure one of the levers they used to get henry tenon to flip on mr. fernandez was the fact the death penalty was on the table against him, according to the reporting looks like he was likely the triggerman. there is no indication, however, that mr. tenon has any information relative to miss gardner, and so it looks like who likely happened is tenon flipped on fernandez and they have been working the case ever since. the question becomes could they flip fernandez against the ex-wife. and according to that press conference and i was waiting for the language, they are reporting, that is the head attorney, d.a. is reporting the death penalty is still on the table for mr. fernandez pictured there. that tells me they might not have gotten him to turn and might have put the case together other means and a couple of tells in the press conference may indicate how they did it. >> jacqui: we didn't hear a whole lot of new details how they' rived at the conclusion or the indictment came ab-- arrive at the conclusion, but you think they have good evidence there? >> surely they feel they have it. they took their time, it's a good long time since the event. so, they had the time to put it together. what you notice is that they had what sounds like something of a task force. now, they were gonna need help because gardner decamped to the pacific northwest, apparently she is comes from a wealthy family, so had the resources to put a wall around her and shielding herself and her two kids from the investigation. ultimately that crumbled. i'm sure they had help in washington. if you notice, the prosecutor name checked not only the atf but atf analysts. analysts have become more and more important in law enforcement. people don't realize a lot of detective work is done in a cubicle in front of a computer screen and i have to think regarding what i heard there there was a lot of work done as we have seen in some of the other high profile investigations we have been seeing recently. kohberger in iowa, the murdaugh case, phone digital stuff, phone pings, dumps of emails and texts, various other means what went on and how it went on and to build a narrative. and it might be enough to make fernandez flipped. the way it was couched does not sound like he has. right now they are holding the indictment close to the chest. >> going back to february of 2022, and the murder, you heard kirsten bridegan mention the name bexley, their 4-year-old daughter, she was 2 at the time of the murder. she was in the vehicle that jared bridegan was driving and even though she was two years old she witnessed the whole thing. we have talked to nancy grace about this so many times, paul, and she said from the very moment that she heard about this, nothing added up in terms of this being any kind of a random crime. this thing was planned from the get-go. and put your investigator hat on for a second. so if mario fernandez did not flip and they had to discern shana gardner fernandez forensically, if the two of them talked electronically there would be a trail. but how do you put it together if there were no electronic communications? >> it could be very, very tough. it's possible they have another witness we don't know anything about. you can do stuff with video, you can look at where she was at the time, we all know her actions subsequent to the event were suspicious, she did not attend the funeral, and as we have said, she moved 2800 miles across country. but at the end of the day here i think it's gonna be one of those things, look, a whole bunch of little piece that is add up to the big picture, probably built it little by little and feel they have enough and to go right to the top at the death penalty tells me they are probably looking to put the pressure on fernandez if they haven't gotten it already. mentioning the death penalty in relation to his name and if you are sitting where he is and comes out hey, they got her anyway, then you may say to yourself. what do i have to lose because they arrested her anyway and they are going for the death penalty, i might as well save myself. there could be some gamesmanship in there, listen, fernandez, we got her anyway, come to the table. i don't know that, that's purely speculation. one other thing here you don't hear very often is that the fact that the family thanked the media and you know, i feel that's very telling here. that tells me there was a lot of responsible reporting here, they felt -- you don't hear -- usually hear the reverse and so foxnews.com has done great reporting, other outlets have and i think it kept it front and center and also helped keep the pressure on and the resources in what sounds like a difficult case. >> jacqui: a lot of details that need to come out, see a lot of them in the indictment, but paul mauro, appreciate your expertise. thanks for coming on. >> john: a different topic now, economists are sounding the alarm on mortgage rates, predicting it could reach 8%. right now the 30-year fixed rate at the highest level in 22 years. charles payne is the host of making money on fox business. i want to put up the freddie mac graph of where mortgage interest rates have gone since joe biden took office. and other than a slight dip earlier this year, look at that, a steady race to the top for the 30-year and the 15-year firm. if it hits 8% with another fed rate hike, charles, is that a psychological barrier that really could slow things down in terms of home sales and new home construction? >> it's a psychological and monetary barrier. john, i think the great thing about that chart is how fast it went up. inflation come, 40-year inflation had not seen in a generation from all the money poured into the economy and unnecessary, dealing with the consequences of that. the federal reserve, looks like they are going to continue to raise rates, don't know how many times, but not unreasonable 8% would be the key. what's so unique about this. because rates went up so quickly, a lot of folks own homes and they are paying mortgage at 3% or less. so now you are talking about mortgages at 8%. it's good if you have a house and paying 2% and you bought a $500,000 and love it but you can't move. you can't move. even if you maybe a profit you can't move, your ensuing mortgage would be so much it raises the gains. the housing market is critical to the economy. people cannot move for new jobs and psychological aspect you are talking about. right now this very moment, goldman sachs says housing affordability is the worst it has ever been in this country. that hurts new house developments, people are not going to get married -- no starter homes out there, so the overall impact of this directly and indirectly is mind boggling and worse every day. >> john: i'll tell you, real estate places are off the charts at so many places. charles, think of you and your beloved dodge t-rex truck, 3.87 a gallon is the national average. a week ago 3.82. a month ago, 3.56. that's putting a big crimp in people's budgets. >> it is, and should not be happening at this time but it is. and it may get worse. we dodged a few bullets last year, a warm winter in europe, china's economy did not bounce back to the degree we thought it was but china will have to do a major stimulus plan, and it could be a harsh winter, every now and then we get those. this might be the beginning, and hurricane season here in america, we pray and hope it's a mild one. all of those things conspire to push gasoline prices higher and higher. >> john: and we think 3.87, approaching $4 a gallon is a high price to pay, but i put together, according to aaa, the highest prices in the nation. california leads 5.18 a gallon. followed by washington, 5.03, oregon, 4.69, nevada, 4.42, utah, 4.23. when gas prices got this high in the early days of the biden administration we heard people screaming about it. we don't hear that same scream at this point but assume if it keeps heading north we soon will. >> you will, you will. speaking of the dodge ram, i went to the gas station once last year, 150 bucks to fill it up, and people lost their minds. when that #thanks joe was going around, we get above four bucks, you will see #thanks joe on social media. >> john: wall street journal says for real relief americans will have to wait until the end of 2024. by that time the energy information administration estimates gas prices will drop to roughly 3.09 a gallon, near 50% price break from today's prices. but we are going to go through an election before then. see how it works out. >> correlation between high gas prices and getting elected, very few things that affect people more than getting in the voter's box than high gas prices and other inflationary ills. high gas prices really, really, really anger voters. >> john: and we'll start up a gofundme page for you and your t-rex. >> jacqui: parents beware, back to school shopping is expected to cost you more. the latest report on consumer prices show supplies and clothing are more expensive as americans continue to feel the pain of inflation. fbn lydia hu is standing by. how much can families expect to spend on back to school shopping this year? >> quite a bit. elementary through high school, average of 890 this year on back to school items. a new record from the national retail federation. $25 higher than last year. all in, unprecedented $41.5 billion this year. last year, 39.6 billion. higher spending driven by increase in demand for electronics and also higher prices, check this out, prices for girls and boys clothing up, stationery and i have my back to school backpack ready to go for my daughter. a pattern is showing prices for basics, mechanical pencils, higher in price by 16%. composition books, 9% higher, and index cards, notebooks, folders, all of this is more expensive. while people are spending more this year, they are also hunting for more bargains. the national retail federation says 45% of shoppers are going to the discount stores this year. that's up from just 40% last year. it means people are working to stretch the dollar. back to you. >> $800 plus, you better find a discount store somewhere. new fox news national poll shows donald trump maintaining a large lead in the gop primary. gaining momentum, though, is vivek ramaswamy, whose double digit polling numbers on track toward challenging ron desantis. david avella, and kevin walling, thank you for being here. >> nice to see you, jacqui. >> jacqui: bring up the polls to start and look at what we are looking at. stunning. call for number one, donald trump obviously still in the lead, but the biggest jump here, you had between june and now, vivek ramaswamy go from 5% to 11%. david, what do you think made that happen?
