>> inside that minivan that was hit early saturday morning was a mother and daughter who marine veteran helped pull out of the car and get to the side of the highway for safety only to have a suspected drunk driver run into the van and almost into that mother and daughter. if it weren't for trey shelleding them with his own body. he leaves behind his wife an a two eared daughter. ice confirms the driver of the car, a 33-year-old was in the country illegally and is now being held on an immigration detainer. so far she is charged with intoxication manslaughter and intoxication assault with a vehicle. trey's family is speaking out for the first time since his death and his widow says she has never been more proud of her husband and forgives the woman who took his life. >> each time she gets to wake up in the morning, i pray that she asks the lord to forgive her and she sincerely mean it and not just mean it but get to know him. because i don't want her to go to hell. >> a lot of faith and inspiration coming from that family. a gofundme for trey's wife and daughter has raised more than $30,000. bill. >> bill: more to come. we'll watch this story. we'll see how it develops. thank you. garrett tenney there with us. >> dana: hunter biden's growing legal challenges are taking their toll on how people perceive him. voters think he did something illegal. mark meredith live with the polling. hi, mark. >> good morning to you. now that a special counsel has been appointed to oversi the hunter biden case it will drag on more months if not years. new polling shows where people think today about this case involving first son. fox news finding among registered voters 50% of people think something illegal did happen. those numbers up sharply from earlier this year when only 8% say nothing seriously wrong occurred. until recently the details of the case against hunter were kept under wraps because it was under investigation. remember he was going to plead guilty to failure to pay taxes just last month but that deal fell apart after a federal judge raised questions about the circumstances surrounding the plea deal. now not surprisingly the polling also shows political leanings also line up when it comes to this case with only 19% of democrats feeling like something illegal happened. those numbers are lower compared to republicans who feel the first son should be prosecuted. republicans continue to criticize the attorney general merrick garland and his decision to appoint david weiss as special counsel. they have growing concerns how the case has been handled from the start and whether or not president biden personally profited from son's overseas business deals. >> the american people need to know whether their president is crooked or not. we need to know there is an election coming, he is the sitting president. certainly he would want his name cleared if anybody would, i would think. >> the white house continues to brush off most questions when it comes to hunter biden or that possible talk about an impeachment inquiry being launched within the next few weeks. the timing is very much up in the air, dana. it is likely we won't know what steps congress is planning to take next until they get back from their summer recess. >> dana: mark meredith at the white house. thank you. >> i think putting america first means putting all americans first and yes i'm using the republican party as a vehicle to advance that agenda, not as a professional politician but as a successful businessman, outsider and yes, somebody who is a member of that different generation. >> 37-year-old vivek ramaswamy gaining ground in our latest fox polling right before the big debate next week. here is what we found. donald trump still has a clear lead at 53%, down a couple notches. but clearly over ron desantis he has a lead 16%. what we found right now and why we talking about vivek ramaswamy. you say vivek as in cake, how you remember his name. 37 years old. two months ago he was in single digits in the polling. at 5%. he has more than doubled that at 11%. big picture now. how do all these candidates stack up against joe biden? at the moment this is what we find. joe biden's lead among these match-ups as of now, he leads nikki haley. he leads tim scott, he leads ron desantis, he leads ramaswamy and he is up three points on donald trump. however, there is a caveat. the margin of error is 3%. could go either way between trump and biden. they are essentially tied in polling as of today. karl rove to analyze. good morning from austin, texas. what did you learn from our numbers, karl? >> well, first of all remember we -- things in a primary the end to change dramatically sometimes and vivek ramaswamy has got the mo, no ifs, ands or buts. will he be john carey 2004. the leader was howard dean and john kerry began to move up in the polls winning iowa and new hamp hampshire. it was a little bit of a surprise. he hung on. on the other hand, her man kane in 2012. it came and went. the question will be in the debate next week, this is a good poll for vivek. the question is, is he going to be able to build on it by a performance in the debate that says to people he really is exciting, new and different and i'm all for him? >> dana: what's interesting, karl. this is the question of your second choice for gop nominee. what i think is interesting in march desantis was 52%. now down to 37%. ramaswamy was at 0 but now up to 22% and pence was at 16 and now at 11. so both pence and desantis lost some with second choice preference and ramaswamy picked those up. what does it say about some of the other candidates in the race that are not even in that picture? >> right. tim scott and nikki haley primarily. look, these polls are a measure of how much name i.d. you have. that's why they change rapidly is because they aren't based in necessarily deep opinions about the candidates. it is what have i heard recently? vivek has been on fox news, for example, and he has gotten some good coverage there. he has been an energetic campaigner with a novel message. you heard it. i am a different generation, america first candidate and successful businessman and outsider. that's a good elevator speech. so again, though, let's be careful about putting too much in these polls because remember, rudy giuliani was leading at this point. jeb bush was leading at this point in 2015. rudy giuliani was leading at this point in 2007. these things have a way of playing out but what it really says is the debates on august 23rd and september 27th are going to be very important to the republican contest because they will be the way that people get to know these candidates particularly if donald trump doesn't participate. a way for them to get to know the alternatives and make judgments about who they like. >> bill: that's a big point there. let's go to iowa. a little bit of what we picked up this past week at the fair. roll this. call for number three. >> i think trump is the only one to get us out of the mess we've gotten into. so i'm going to support him all the way. >> i like donald trump. i voted for him. this time around it's iffy. i guess. >> i would like to get a candidate that can succeed in beating biden at any cost. >> i do think that president -- former president trump needs to back away. >> bill: the theme of that was trump and what -- how you feel about him today. karl, if you were donald trump, would you show up at that debate in milwaukee next wednesday? >> i would even though there are dangers. if he shows up, he will be attacked by everybody in one way, shape or form. some will be hard and direct, chris christie. some of them will be glancing blows. some will be trying to move around him. i would show up if i were him. this is where you get the demonstrate i'm the leader and will remain the leader. if he doesn't show up this will be people who say to themselves didn't he tell us and mock joe biden for not debating and hasn't he said he is the world's greatest debater and maybe there is something that he doesn't want to talk about? and doubts will begin to grow. doubts are growing. we have now got depending on what poll a majority of republicans who say if he is convicted of something in one of the four lawsuits for indictments, they won't vote for him. he has to find ways to assuage those growing concerns and show up at the debates. >> dana: that's what we are paying attention, karl. >> bill: thank you, sir, nice to see you. talk again. karl rove in austin. next hour we'll talk to former governor of north dakota, doug burgum. he wants to make a mark for himself. he qualified for the debate. he has got something going. >> dana: i like his coat. the barn coat in the picture. my favorite picture of all of them. >> bill: back to weston county. >> dana: fulton county district attorney is requesting a march 4th start date in the trial of donald trump and 18 co-defendants. the timing is right into the political calendar one day before the former president competes in super tuesday in 2024 presidential race. that's when voters in more than a dozen states go to the polls. >> we aren't leaving this building, dana. we'll be here. >> dana: until when? the marine's name was collins. he pulled over to help a driver in an accident and that's when police say he was struck and killed. >> bill: donald stopped to help a driver of a van hit by a red tow truck. video shows the driver of that red truck fleeing the scene. garrett tenney has the story from the midwest bureau. what happened? >> inside that minivan that was hit early saturday morning was a mother and daughter who marine veteran helped pull out of the car and get to the side of the highway for safety only to have a suspected drunk driver run into the van and almost into that mother and daughter. if it weren't for trey shelleding them with his own body. he leaves behind his wife an a two eared daughter. ice confirms the driver of the car, a 33-year-old was in the country illegally and is now being held on an immigration detainer. so far she is charged with intoxication manslaughter and intoxication assault with a vehicle. trey's family is speaking out for the first time since his death and his widow says she has never been more proud of her husband and forgives the woman who took his life. >> each time she gets to wake up in the morning, i pray that she asks the lord to forgive her and she sincerely mean it and not just mean it but get to know him. because i don't want her to go to hell. >> a lot of faith and inspiration coming from that family. a gofundme for trey's wife and daughter has raised more than $30,000. bill. >> bill: more to come. we'll watch this story. we'll see how it develops. thank you. garrett tenney there with us. >> dana: hunter biden's growing legal challenges are taking their toll on how people perceive him. voters think he did something illegal. mark meredith live with the polling. hi, mark. >> good morning to you. now that a special counsel has been appointed to oversi the hunter biden case it will drag on more months if not years. new polling shows where people think today about this case involving first son. fox news finding among registered voters 50% of people think something illegal did happen. those numbers up sharply from earlier this year when only 8% say nothing seriously wrong occurred. until recently the details of the case against hunter were kept under wraps because it was under investigation. remember he was going to plead guilty to failure to pay taxes just last month but that deal fell apart after a federal judge raised questions about the circumstances surrounding the plea deal. now not surprisingly the polling also shows political leanings also line up when it comes to this case with only 19% of democrats feeling like something illegal happened. those numbers are lower compared to republicans who feel the first son should be prosecuted. republicans continue to criticize the attorney general merrick garland and his decision to appoint david weiss as special counsel. they have growing concerns how the case has been handled from the start and whether or not president biden personally profited from son's overseas business deals. >> the american people need to know whether their president is crooked or not. we need to know there is an election coming, he is the sitting president. certainly he would want his name cleared if anybody would, i would think. >> the white house continues to brush off most questions when it comes to hunter biden or that possible talk about an impeachment inquiry being launched within the next few weeks. the timing is very much up in the air, dana. it is likely we won't know what steps congress is planning to take next until they get back from their summer recess. >> dana: mark meredith at the white house. thank you. >> i think putting america first means putting all americans first and yes i'm using the republican party as a vehicle to advance that agenda, not as a professional politician but as a successful businessman, outsider and yes, somebody who is a member of that different generation.
