believe we are still living in the united states. the america i grew up in was a place we don't put our political opponents in prison, we let voters decide who is best to lead the nation. nor did we politicize differences, that is what they do in. >> a russian court finding him guilty of founding and funding extremist organization. >> laura: after i read the latest indictment of trump, i found myself asking, how can we really say that we're any better than what we're seeing in old former soviet union? we'll get to the legal farce that is the indictment in a moment. right now, all of you need to know something important about the liberal da in fulton county, fani willis. after dragging this out for 2-1/2 years, she was suddenly in this huge rush, desperate to get the indictment out there, so much so, she took the rare step of keeping a new grand jury after regular business hours. she did this for one reason and one reason only, for maximum pr effect in prime time, no less. >> i can't believe this. this is not the circumstances i expected to be talking to. >> nor me, rachel. it is always good to talk to you, but i didn't think it would be under these circumstances, yet another set of indictments. >> this is trump's nightmare. he wants to be it is only arbitor of truth. >> instead of coasting back in, he is facing jail time in different places, crazy. >> it may be the first indictment carrying anything requiring mandatory minimum sentence. >> laura: lawyers, i know. we all know and they all know issue the goal here is not justice. the goal is to take donald trump out of political contention in attempt to throw the 2024 election to biden, to a man who is deteriorating in realtime before our eyes. if donald trump announced he had problem with the election, but he is retiring from politics back in 2021, none of these indictments would have happened at all. instead, they'd be focusing on investigating ron desantis on some bogus grounds. there is literally no sdripg to adequately capture what a pandora's box of horror democrats have opened up here. when political prosecutors are on a wild-eyed hunt for a former president and top advisors, a precedent has been set. with dirty work from alvin bragg to fani willis, no stepping back from this precipice now. the case boils down to criminalizing of aggressive lawyering. people like john eastman, offer the president a novel and controversial approach to challenging the electoral process and president trump agreed to follow their advice. willis charged them all with an array of state crimes. regime media help said in the lead-up to this with clever branding of the legal conclusions. >> tentacles from former president trump's big lie from the election continuing to squeeze american society. >> this all started with a big lie. trump's lie about massive voter fraud in the 2020 election. >> trump's big lie damaging democracy and embedded in the gop party platform. >> that hearing is supposed to center on trump's big lie about the election and the people who helped foster it and pedal it. how do you think trump's big lie continues to live on? >> laura: no matter what your view on the lack outcome, the ultimate big lie, you can seek to criminalize political opposition and not create a really painful boomerang effect. willis chose to charge trump and 18 others under rico act is another tale, it is dramatic. fulton county grand jury returned a true bill of indictment, charging 19 individuals with violations of georgia law arising from a criminal conspiracy to overturn the results of the 2020 presidential election in this state. >> laura: she's prime time, of course she's going to get hair and makeup, she's prime time. if you don't agree with legal analysis of the trump team post-election, the idea requesting new slate of electors can result to criminal conduct is obscene. ditto for president trump saying find me 11,000 votes, that is criminal? as if similar lines were not uttered by officials watching the pro-trump early election return on november 3, 2020. find me early votes. if agresively challenging outcome of an election is somehow a state or federal crime, i have a question tonight. where is the indictment against this woman? >> this is not a speech of concession. >> it was not a free and fair election, the machinery had broken. if it looks like it is rigged, it probably is. >> i didn't lose, we got the votes, they cheated. >> i have one affirmative statement to make. we won. >> laura: if organized effort to challenge ballot counting can result to conspiracy to subvert democracy, should george bush and al gore be slapped after the 2000 recount? what this full-court press against trump guarantees is during every election cycle for the foreseeable future, there will be some urging the party in power to seek indictments against leading candidate of the other party. >> it is excessive and i think it is also dangerous and criminalizes challenges to elections. there is no limiting principle in this document. we often, if not always have challenge, some are more supported than others. they are not crimes, they are seeking judicial review, ensuring public there is someone watching over the elections. >> laura: how can it be untested application of laws by prosecutors against a political opponent are celebrated, even when they impact the future election as this could in 2024. when republican lawyer working for trump advance aggressive, novel legal theories, they are all indicted. i know a lot of people say this to me, they wonder why better people don't go into politics? with all this, you see the reason why. they don't want anyone to work for a republican issue let alone run for office. politicians stretch the truth all the time with theories while representing clientses, this happens regularly. that is the way it has been. bill clinton committed perjury while president, he wasn't indicted, you didn't need a legal theory. and chose not to convict hillary clinton. you don't try to remove a political candidate by indictment in a political fight, you let voters decide. from all rhetoric from the left about how this is effort to protect democracy, why can't trump's team have legitimately believed that it was they in seeking state challenge to outcome, they were protecting democracy to make sure every vote was counted and fraudulent ones, they believe, weren't. recall problems in so many states, election laws were changed in the 11th hour to help democrats with lawyers testing legal view that because of the covid pandemic, every voter needed access to mail-in ballot, drop boxes, extend hours, etcetera, was that novel and unusual? you bet it was. be clear, this may be the last indictment of trump, it won't be the last indictment of its type. this will repeat itself any type a conservative who rattles the cage gets too close to winning. this should be a wake-up call to serious republicans, you will be in the cross hairs next, we'll ask governor desantis about this later in the hour. you might be saying the following, okay, if they get away with this witch hunts, we'll do the same thing next time to get power. sorry, even if a republican attorney general wanted to play corrosive games against a candidate, the fbi and career staff of the d.o.j. would resist and make it impossible virtually. this dynamic will always and only work one way, to disenfranchise voters across america who would like to vote for the conservative candidate of their choosing. it is the ultimate in election interference through corrupt venal indictment? who are defenders of democracy again? that is the angle. joining me now is josh hawley. senator, this sets us on a precipice for, i think, a very, very dangerous period in our society and our elector at processes. at this point, the fulton county da indicated that they will seek higher bonds against any defendants convicted and processing would include mug shots. what does that tell you here? >> what this tells me, this is latest effort to keep the ruling party in power, that is what this is about. this is indictment what, 200? there may be more indictments to come. this is effort by ruling parties, the democratic party to make sure anybody who criticizes them gets indicted and it is not just trump, it is catholics who had parishes infiltrated and had swat teams sent to their door and protested peacefully and had fbi show up at their door, it was parents labeled terrorists. i never thought we would see this. we have seen it all. if you challenge the ruling parties, ruling elite, they will use force of law against you thchl is crossing a rubicon, defeat this attempt to rig an election in realtime. they are making sure there is only one outcome in 2024 and it is the democrat winning. >> laura: i don't think they would have a problem with a different republican, like a mitt romney style republican, he wouldn't rattle the cage like trump, desantis, maybe glenn youngkin or vivek ramaswamy, someone like that. this is message to anyone who would even think for working for a conservative administration going forward. don't you agree? if you can get indicted as a lawyer, giving untested legal theory to a president or urging action not taken before post election, but theory number of peep elt agree with, some don't, all bets are off. why go into government service? >> absolutely, the message they are sending loud and clear, don't go after us. trump challenged them, he challenged pro-war policy and on ukraine and globalist agenda that ripped off the working class, hollowed out this country and made workers slaves compared to china and other nations that have taken away jobs and technology. trump challenged that. if you challenge them on this stuff, if you challenge them on policies they hold dear, they will come after you. if you challenge them on their pro-abortion religion, they will come after you. the message is real clear, don't challenge us. don't go to work for anybody who will challenge us. don't vote for donald trump or anybody like him, or we will treat you as a domestic terrorist. this is recipe for one-party rule in this country, if that is the case, this is not the united states of america anymore, constitutional authority does not exist anymore. >> laura: as noted, fani willis indicted handful of lawyers working for trump for offering legal argument to the president. how dangerous precedence does this set? here is sol wisenberg. couldn't this just chill the future work for a republican in any aspect of government service going forward given people like jeffrey clark. jeffrey clark is indicted here? one of the most respected, brilliant legal minds, john eastman, clerk for a supreme court justice. people might disagree with their theories, but what? >> interesting you mention jeffrey clark and i know this from sources i absolutely trust, high inside the justice department during this period after the election. jeffrey clark absolutely believed that the election was stolen. now why is that important? because you have to have a certain level of intent. there are allegations people knowingly stated lies and falsehoods. more importancely, you have jeffrey clark, presidentially appointed and confirmed by the senate and head of civil division of d.o.j., went to harvard and georgetown law school and he is telling the president that the election has been stolen and the department of justice can do something about it and other equally prominent lawyers agree with him. other lawyers on the, side are saying you can't do that. is the president, for picking one set of lawyers over the other is a criminal? he's got, at least on this part of the indictment, the former president has very good potential attorney reliance defense. to your other point, that is problem with this indictment and the jack smith indictment in d.c. there are narrow allegations and discreet allegations in the georgia indictment that are potentially very dangerous for certain defendants. what is so disturbing about these two indictments, d.c. and georgia, is how much traditionally protected speech is referenced in the indictment and considered to be part of criminal activity, that is what i find disturbing. >> laura: mark meadows was not mentioned in the jack smith indictment. in the atlanta federal indictment, but mentioned as a co-defendant in the rico conspiracy by fani willis. he has now moved to change the venue to federal district court out of fulton county. is that a legitimate claim he has here given the parallel tracks they are moving in with smith and willis? >> i think it is a very viable claim. it's certainly not frivolous. it is legitimate. it is based on a federal statute that says if you sue or indict at the state level, somebody based upon their actions in federal office, that can be grounds for removal. i think that is a very valid point to raise and it can be raised by president trump, as well. if you will notice, that is one reason that willis added charges from september of 2021, so she could say this goes beyond when he was president. clearly the bulk of abivity alleged against the former president, based on his activity in office. i think it is quite possible. >> laura: sol, you can indict presidents for lying and lawyers for giving aggressive advice, this is a new world in politics and the law. great to see you. coming up, governor ron desantis will join us live at the end of the show with his thoughts on this and more. first, what do we need to know about this da, fani willis. marjorie taylor greene and buddy carter are here next and they have a lot to say. ow! uh oh. you, ok? no... i mean yeah. -just hit my melon. -yikes! should we see a doctor? i can't tell a doctor i slipped on a toy. i'm a triathlete! i had a concussion. most happen doing ordinary things. sometimes the tough thing to do is to get help to prevent serious damage. i like your sensitive side. don't mess with your melon. if you hit it, get it checked. >> laura: here now with the view from georgia, tell us more about da fani willis, congresswoman marjorie taylor greene and congressman buddy carter. congressman, you are demanding an investigation into this indictment on what grounds? >> absolutely. obviously, this is drummed up charges, first of all. there are 159 counties in the state of georgia. if you ask me where did indictment result from? i would have told you fulton county. these drummed up charges here. we have a former president indicted by a system that is weighed against him. no one is above the law, we understand this, but this is about revenge, not about justice. >> laura: former lieutenant governor now works for cnn and let slip what this is about. >> president trump did most damage in georgia, he sucked morality and fiscal responsibility out of the republican party, sucked winning percentage out of the republican party, he took everything from us and it is our turn to take it back. >> laura: congresswoman, that is the funniest thing i have heard in politics. take it back, we have to take it back, wow. okay. >> yeah, who does he take he is taking it back from? the american people that voted for president trump in record numbers? president trump got the most amount of republican votes for any presidential candidate in history. on behalf of people in georgia, i want everyone to know, we don't listen to a word jeff duncan has to say, as a matter of fact, nobody cares what he has to say except the viewers on cnn. >> laura: this idea, congressman, you can politicalize opposition, aggressive legal theory, challenges state election law on how it was determined in the 11th hour in some states, that is now a crime? that will only go one way and be used against america first republicans. >> absolutely. that is a valid point you make there. why shouldn't we be questioning it? let's not forget this is not the first time elections have been questioned. first time stacey abrams ran for governor, she was questioning and alleging inkconsistencies ad it was stolen from her. she said that, was she indicted? no, she's not been indicted. there is double standard, justice system for those named clinton and biden and for everyone else and that is sad state of affairs for us. >> laura: yeah, congresswoman, there is credible evidence that the biden family was pedalling influence, maybe takes bribes when he was vice president and everyone is you can't connect the dot and here we have people making legal claim and the president taking their advice, political trash talk that happens all the time and that is a crime and the biden family crime syndicate get away with it? >> that is right, conspiracy, racketeering and rico charges and we are seeing the democrats all the way down to state daytime emmys conspiring to stop president trump from winning the 2024 election. it is outrageous and you are right, i serve on the oversight committee, we have real evidence it is biden family made tens of millions of dollars with wire trabz fers from country after country, in fake llc's and working hard to link this with proof to joe biden. we have devon archer that came out and said joe biden was on the phone and in in-person meetings over 20 times. 1023 form says joe biden took a bribe from the oligarch that ow owned burisma while he was vice president of the united states. >> laura: that is nothing. >> admitting he got the prosecutor viktor shokin fired. these are real crimes. >> laura: thank you both. if you want to see where climate radicals are taking fanaticism next? i'll tell you about a story coming up that is shocking. plus an update on the utah man killed last week after making threats against joe biden temperature is interesting, so stay with us. ♪ >> laura: last week we t >> laura: last week we told you about 75-year-old craig robertson, man shot and killed by fbi agents after making multiple threats against joe biden's life. we had unanswered questions, ones the fbi wouldn't address promptly, including did craig robertson brandish a weapon at the agency? we have an update. late yesterday fbi said they were serving search warrants on the morning of the shooting, robertson resisted arrests and pointed a revolver at them. seems like a major detail and one that would have been easy to provide last week. this raises new questions we put to fbi, why did it take five days to reveal the cause of the shooting and that is what happened, release body cam footage. what happened when agents approached house before the sun came out. the fbi declined to comment to the angle. we will monitor this story and we won't stop. it is really scary seeing what you care for disappear in front of your eyes. >> makes me feel like the state is prioritizing profits over people because they know there is visible harm coming to the land and to the people and they are choosing to make money instead of care for montanans. >> laura: well, montana just sided with that group of young environmental activists, well spoken. one popular was five years old, i wonder if her parents put them up to that, maybe. they claim the state infringed on constitutional right to clean and healthful environment by promoting the use of fossil fuel. the judge found state emissions have been a factor in affecting the climate. this montana case will face a pretty big appeal to the state supreme court. the montana a.g. offices know montanna not can be blamed for changing the climate. alex is joining me. alex, people that celebrate momentary wins, they don't think about the repercussion for business in the state, how dangerous would this ruling be if upheld? >> really dangerous. we already have a terrible problem of projects being stopped for climate considerations. right now, if you want to approve pipeline, drilling, anything, you can be stopped because the government thinks any project that emits co2 should be stopped. everything emits co2. it is a reign of terror over business and this case makes it worse. government can shut down what they want if they say climate change. >> laura: this is the road map, is it not, the play book of the soros type globalists who know they can't win in public opinion, they will not win and go to liberal judges and courts and try to change the country via litigation. that is what this is about, is it not? >> there is front of trying to do it through judges and front of doing it through esg and corporation and people need to know how damaging this is and we need more places like montana saying do not have climate consideration in anything. you cannot stop individual projects because of a global issue. if you care about human life, you want more energy, the earth has too little energy. this whole thing is wrong headed and i'm glad montana is fighting, it is embarrassing a bunch of kids are being put in front of us to destroy american industry. >> laura: what does john tester think about this, he is claiming he is a reasonable democrat, is he leading the charge against this? >> i'm not sure about his role, this is opportunistic, they go after every front they can. i try to do in my work, including my book "fossil future." >> laura: alex, thank you. you will not believe what people are doing in driverless cars now, you couldn't do it if you had to focus on the road. jimmy failla is up next, stay there. and if you're taking a multi-vitamin alone, you may be missing a critical piece... preservision. preservision areds 2 contains the only clinically proven nutrient formula recommended by the national eye institute to help reduce the risk of moderate to advanced amd progression. preservision is backed by 20 years of clinical studies. so ask your doctor about adding preservision and fill in a missing piece of your plan. like i did with preservision. now with ocusorb better absorbing nutrients. we moved out of the city so our little sophie could appreciate nature. but then he got us t-mobile home internet. i was just trying to improve our signal, so some of the trees had to go. i might've taken it a step too far. (chainsaw revs) (tree crashes) (chainsaw continues) (daughter screams) let's pretend for a second that you didn't let down your entire family. what would that reality look like? well i guess i would've gotten us xfinity... and we'd have a better view. do you need mulch? what, we have a ton of mulch. goli, taste your goals. a literal ton. >> laura: now it is time for wtf, what the failia, joining me is jimmy failla. how are you, good to see you. driverless cars, driverless cars. they are popping up all over and in san francisco, jimmy, some are using them for a different kind of ride, okay. >> oh, boy. >> megan took her first robo-taxi ride on a recent late-night excursion, if you catch my drift what we're talking about. >> as a former cabdriver, okay, i like this is going on in driverless cars because as a human driver, people hooking up in your cab are never couples you would want to see. if they made a movie about people hooking up in be cas, it would be called debbie does weightwatchers, these are big horse-faced disgusting people, like 50 shade says of hay. i like there is no human around to watch these slobs go at it. it can't be germier than other places in san francisco. >> laura: how often -- >> go ahead. >> laura: how often did this happen when you were a taxi driver? >> jim: not enough, not like i had a vibe, not like i was a love coach, not dr. ruth on wheels. i would throw on a nice jam which might make the move happen. >> laura: barry white. >> thank you. >> laura: that was strange, i have another strange one. a florida woman suspected of murdering her roommate tried to get rid of the evidence by dumping mountain dew on her body and hair in front of police. >> you are in a bad relationship if your first question was, did it work? that is where i found myself reading the headline temperature is florida, if the guy was still alive, she could have doused herself in bud light and he would have left. admire the hustle, strange. >> laura: i don't know what is in mountain dew, crazy reaction with people. apparently and i've noticed this, i'll have a doughnut or two. doughnuts at dunkin donuts taste different at every location, we may know why, watch this. >> as dunkin donuts franchisee, you have three options to get doughnuts, bake them in your kitchen inside the restaurant, have them delivered from a central kitchen, cml, or order disgusting frozen doughnuts, which don't do that. >> laura: jimmy, frozen? what? >> exactly thchl is tough for me, i appreciated the intel. it is a slippery slope if they tell us how fast it is produced. they are telling us how whistleblower castle cooks rats, i don't know if i want to be there. this is a weird one. i think your staff picked this story to get me to stop eating doughnuts, i think this is prime time intervention by you and i don't appreciate it. >> laura: i need it for myself, i like the blueberry glazed and butternut crunch, only when they are fresh. i don't like the frozen. don't ask, don't tell, i will ask which franchises have fresh doughnuts, come on, ridiculous. >> i love this. thank you. >> laura: to be part of jimmy's fox nation special, in huntington new york, performing on friday the 13th, get tick oats there now. coming up, governor ron desantis is here live on status of his campaign, on the trump indictment and a lot more. stay there. ah, these bills are crazy. she has no idea she's sitting on a goldmine. well she doesn't know that if she owns a life insurance policy of $100,000 or more she can sell all or part of it to coventry for cash. even a term policy. even a term policy? even a term policy! find out if you're sitting on a goldmine. call coventry direct today at the number on your screen, or visit coventrydirect.com. >> laura: we're just eight days from the fox news republican debate in milwaukee, where do things stand? a voter summed it up this way, he likes both trump and desantis. he says more indictments trump gets, the better his numbers do. what does that mean? governor ron desantis joins me to respond from tallahassee. governor, thank you for joining us. that does seem to be so far at least, inescapable truth. if i'm you, how do i convince the gop voters that while these indictments are political law fare, that you are still the one that is most electable. how do you make that argument? >> i think going forward, the question is, what are we going to do about all of this, laura? get a president that can beat biden and actually end weaponization of federal power through the doj, the fbi. for example, with me as president, on day one, christopher wray gets sent packing. you will see the doj cleared out and we will ensure single justice in this country and i can say that with credibility, i've done that in florida. we've drained the swamp issue not rid of supervisors and removed two different progressive prosecutors funded by soros, i've taken action and got the job done and as president, i will do the same thing. our country is in decline for a number of different reasons, economic, cultural and our constitutional system is totally out of whack. we need to get it back in order, i know how do it. be disciplined, focused, got to have attention to detail because the swamp will not give up power voluntarily. >> laura: so do you think that if trump were to win, that he wouldn't fire wray or wouldn't try to reform the fbi, seems like he has a personal interest, no? >> he had three years to fire christopher wray and he didn't fire them. i went to rallies in 2016, lock her up, holding hillary accountable. he said, never mind i said that and let her off the hook. i give him credit, even though we are competing for the great things he did do. one thing he did not do is drain the swamp. the swamp got worse in his four years and you had people like wray and people in power not getting the job done. you have to take swift action and make it happen. >> laura: now strategists, this is a piece in the hill, predicting on the senate side and house side, a turnout disaster somehow if trump doesn't become the nominee, saying core supporters, 25 to 35% of the base will take their ball and go home. in georgia, we saw this, during run-off elections, governor. are you other than canned about that and how will you spur turnout if indeed you win the nomination? >> i would also say 2022 in georgia, you saw governor brian kemp win thumping reelection better than a lot of people were predicting. donald trump opposed him in that election and even suggested stacey abrams would be a better governor and in -- donald trump attacked me three days before the midterm election. when you are talking about voters in our party base, that may be a problem if you nominate some rockefeller republican, it is not a problem if you nominate somebody like me with a proven record of delivering on america first policies. how many people get elected, they overpromise and underdeliver. i can say i met all promises made to people in florida and i overdelivered on promises, whether holding china accountable, illegal immigration, all things weed we'd do, we got done. >> laura: one of the best things, send migrants to martha's vineyards it showed eshg lites for who they are not. one of the best, smaller moments, that mattered. governor, chris christie is out there sticking his chest out, i'm number two in new hampshire, are you worried about him? >> no, look, i think the end of the day, we're doing what we need to do on the ground in iowa and new hampshire. we'll be back this weekend and we'll get the job done. i think a lot of guys are doing this and that, we'll get on the debate stage and hash it out and i think i'll be able to show i have vigsz, i'm the guy that can get the job done electorally and get this stuff done. we have been talking about all this stuff from illegal immigration and the board, dealing within choo, all this stuff. now is the time to do it. do it in 2024, i don't think we'll be able to get the job done in our lifetime. this is a key election, we can reverse the decline of this country and give us new birth of freedom. >> laura: time to restore it. governor, great to see you tonight. thank you so much. thank you all for washing, it is america, now and forever and pete hegseth in for jesse watters and he is next, so tune in. >> todd: a fox news alert, 106 people confirmed dead in the devastating maui wildfire and president bidens he's planning to visit maui, some americans are shocked and outraged over the money the white house is contributing to this disaster in our homeland compared to u.s. taxpayer dollars sent to ukraine. >> carley: homelessness in america is up this year, we are live outside an encampment in los angeles. >> todd: and president and vic
