indictment for the first time we're being told that news conference will take place in about 19 minutes. meantime let's get you live outside the courthouse to matt finn. he is in atlanta with the breaking allegations on this matter. what do we know? hydrates we are looking through the indictment documents right now, but they do read that donald trump and some of his associates, including rudy giuliani and mark meadows, have been listed and charged in this indictment. there's a long list of various charges, including racketeering, false statements and solicitation of violation of an oath by a public officer . we're reading through this right now will be able to update you much more throughout the coming hour or two. throughout the day. there was a lot of anticipation or questions. about who might be named in this indictment. if any of donald trump's associates would be listed, we now know that many of them are there's a long list, including some of his former attorneys, including jenna ellis. we are now waiting on that press conference from the fulton county district attorney fani willis. that is likely going to give us much more information and insight into this very long investigation, a centered around alleged misconduct and criminal activity on behalf of the former president and his associates regarding the 2020 general election here in the state of georgia now, earlier today, we saw a lot of activity outside of the courthouse. we saw several witnesses coming in or out of the courthouse, including georgia's former republican lieutenant governor jeff duncan. he testified today as he left the courthouse. he told us that this is an opportunity for the republican party to turn a corner. he called it the gop. 2.01 of our producers asked him how he felt the testimony today in the indictment would impact donald trump's 2024 presidential election campaign, and he gave no answer to that. i also talked to a journalist who left the courthouse a short while ago. his name is george chiti. he sat inside of the court. courthouse all day long today he was doing some live tweeting and i asked him if he felt like this was this process was sped up today and he says he felt like it was because initially he was supposed to come in and testify tomorrow. but then it was called in today he felt like this was speeded up. and earlier today, as we have been reporting, there were some documents that surfaced on the fulton county website. one of those documents, it was appeared to be the same exact indictment that we're looking at tonight. as far as the charges related to donald trump and those documents. began circulating and being reported on because it looked as if it was an indictment against donald trump. all of a sudden, the fulton county clerk's office came out and said, no, those are fictitious documents. don't pay attention to them. well, now we're looking at something rather similar tonight. so you know it had that event kind of raises the question of whether this this process was sped up today because somehow the indictment against donald trump was posted on the fulton county website much earlier today, so we are trying to kind of sort out how that may have impact. did the process here at the fulton county website. the big thing right now traces. of course. we're waiting from the press conference from the fulton county district attorney fani willis. we're likely going to get many more details into her investigation, trace and the details matter appear to have changed as we kind of go through the hours here. we were told earlier that what we anticipated was within three hours that the court clerk would come out and give us an idea of exactly what was inside the indictment. and then that changed and it was handed out again to reuters. that was who broke it first, reuters who again had this on earlier in the day, and then now we're getting nothing but a press conference. are you noticing the same thing? kind of a change of events along the way, matt well, um roughly three hours ago. give or take. the indictment was handed to the clerk. we saw that on video. we do have a team inside of the courthouse right now as well traced, um, and the clerk indicated that it could take up to three hours because our understanding is she had to manually enter the indictment documents into the system. and then we were told that there would be this pending press conference. that was our understanding throughout the day, so i'm not exactly sure what's going on behind the scenes, but everyone or nearly everyone involved seems like this kind of was sped up today. including that person, that journalist who was subpoenaed. he walked out of the courthouse tonight and told us on the record that he thinks that this process was sped up. so it seems like somehow there was some some clerical error or something that went very wrong to do that that those indictment documents ended up on the website much earlier today against donald trump trace yeah. matt finn back to you as the news breaks i want to bring in the anchor of special report. brett baer, brett and you know, just matt. he brings up a very good point in the whole process here in the tiktok all day long where you talked about it on special report. the fact that it seems like reuters kind of broke this early, and then you had the court coming back by the way it was on the fulton county courthouse website the dot gov website this indictment and then you had the courthouse coming out saying no, no, no, that was fictitious. pay no attention to that. then, of course when the release of the actual indictment a few minutes ago, brett it was broken again by reuters. i mean, it just seems to be, uh, oddly coincidental. yeah tracy, just bizarre, certain circumstances . the clerk saying that what posted on the website was fictitious, but not getting about how they got to the website, so it was very bizarre , but it did speed up and we saw witnesses that we're going to be called tomorrow get called today. they didn't get actually testify and everything sped up. and here we are at 11 p.m. eastern time for a press conference at a courthouse that usually closes at five pm so why the rush? who knows, but what we do know is now president trump and 18. others face dozens of specific charges here, including racketeering. um dozens of their felonies, solicitation of violation of oath by a public officer. conspiracy to commit forgery, first degree false statements. the indictment contains 41 criminal counts. it is 98 pages long. this is not a small operation here. and, um you just take a 30,000 ft view back and you say this is the fourth criminal indictment for a former president who is running to be president again. and the first trial. if it's agreed to august 28th would be january 2nd 13 days before the iowa caucuses, and as i read through the indictment bread, you kind of you pointed out exactly what's in it and who's being indicted and who's being named and it points out that all of these are felonies, but on the first violation, which is the violation of the georgia rico racketeer influenced and corrupt organizations act, it says, serious felony and there's been a question brought up numerous times tonight. whether the rico charge is a basis to get this thing sped up to get this thing in trial before the election happens. what's your sense on that? yeah well, i've listened to a lot of legal legal experts talk about that tonight and alan dershowitz and others said that rico can get you to the courtroom can get you to the trial, but really doesn't help you wanna peel perhaps, and sometimes falls apart. um you have to look through all the specifics inside this indictment, and we're just getting to the 98 pages. right now. there was some reporting that they have some communications between the trump legal team and the trump folks with this, um breach of, um, um election machines in coffee county, georgia. that was an effort to get evidence about false claims that could be one of the actions were looking at. we're going to dig into the 98 pages. but what we can say is that there are not just not just the former president, but you have a lot of other named, uh people who are being charged here. yeah, and lastly, before i let you go , bro. we talked about this with some of the legal minds earlier. but you bring in the trump camp in this and throughout the evening that kept saying we haven't gotten any documents. we haven't gotten any notice about this, and that's kind of unusual if you go through the rest of these four indictments, the president being indicted the fourth time tonight, but the other three there was notice. i mean, he knew and he posted on on social media that the indictment was coming and now the campus saying we didn't we didn't get any notice about this. this. yeah not formal. but they did have a feeling that it was coming down either . today or tomorrow. this is a different operation. this is a state operation and we're going to hear from fani willis very shortly as she lays out this case, but this will lead to an arrest. the sheriff there says there's going to be a mug shot , which would be different than we've seen in any of the federal cases or in manhattan and that they're going to play it by the book as they do, however, if they do want to speed this up up, you're going to have to give the defense a chance to make a case and to make motions to a judge. it will go through the similar process that we've seen in the other almost 10. minutes past the hour, fani willis will address the media in about 10 minutes. let's bring in former house intelligence committee, national security adviser cash patel and article three project president mike davis cash to you first. i mean, kind of we're brett and i were talking there about this this rico charge in here they note on the indictment. serious felony against all the other charges. it says felony. this one says serious felony. is it an effort to get this thing? fast? tracked cash. it's great to be with you trace and look as a former federal prosecutor and a public defender, probably the only person who's done both sides of the aisle. this is a hatchet job by the fulton county d. a and i remind your audience at fulton county's 90% inclusive of the town of atlanta, which is an overwhelmingly majority district against donald trump, and i focus on a couple of things that came out of the indictment one the repeated mention of the word corrupt. corrupt corrupt well. they have stigmatized and made it illegal in state court to declare a federal election outcome result that is a federal law violation that they have taken the state court. so anyone out there saying that this doesn't have any federal implications does not understand the process and the fact that they the court at 11 pm at night to put this out. shows the urgency behind it. but more importantly, a rico case which usually does dozens of defendants, as is now being shown here is a case that takes 2 to 4 years at minimum in state court to adjudicate and that they are racing shows you that they wanted the indictment out. but there will be interlocutory appeals along this way that president trump's defense team should file starting with the a legal disclosure of grand jury information in all 50 states and the federal courts that is a felony. for the district attorney or any court officer to disclose grand jury information prematurely or at all, which, now we have confirmed they did to media outlets and other people along the way, so there needs to be an investigation by them. and i'm calling on congress because as a committee staff at the house intelligence committee and former doj guy i know that federal funding goes to these county prosecutors for the prosecution of crimes and that is your jurisdictional financial nexus to get a review. by the gym, jordan committee or commerce committee , or what have you for a federal taxpayer dollars? and the intent requirement here, something that needs to be focused in a rico case. when you say someone is being corrupt, there needs to be the objective. subjective standard . donald trump has said repeatedly he won the presidential election. he believes that firmly in 2001, 5 and 17 when hillary clinton, senator barbara boxer hakeem jeffries and speaker pelosi declared those elections unlawful. and the outcome of those elections, not the appropriate results. none of those people were prosecuted in state or federal courts. so you're seeing a two tier system of justice here. play out in this 98 page indictment. let's move on to you, mike davis, because it really is. i mean cash brings up a good point on the whole concept where i was talking with brett about this earlier where the president's camp didn't seem to be getting this information. this notice that the indictment was coming down today or tonight, and yet you had reuters kind of releasing what appeared to be an official. indictment document on the court website. the court never said it was hacked. it said it was fictitious. and now later tonight, the indictment comes down and they look eerily similar. mike. yeah this indictment is loud, long and lawless, and it is part of the democrats law fair campaign and several different jurisdictions across america. several different democrats hellholes across america, including d c. new york and atlanta to take out president trump through the legal system because they fear they can't beat president trump on november 7th 2024. this is essentially they're alleging a conspiracy of 19 people. or violating 50 41 different felonies for the non crime of objecting to the presidential election, which is allowed by the electoral count act of 18 87 and twisting arms politically is allowed by the first amendment. i hope president trump moves forward and immediately with a motion to dismiss this lawless indictment. he has presidential immunity of his acting within his presidential powers or if he's acting within his private capacity. he has the first amendment defense. so i want to get your take on this, mike. if i can very quickly because we've got the charges here. it looks like 11 or 12 of these charges. and i just want to put a couple of names on there. you have. donald john trump, rudy giuliani, charles eastman, mark meadows, kenneth chesbro, jeffrey clarke, the list goes on and on, and i'm wondering why the long list and why the number of charges do you group them together? do you try them separately? what's the process here? and what can we look forward to in the days and months to come? this is a mess of a case. it's this will not hold up in if this will not hold up under the law, if it if it is not reversed by the georgia court, it will be reversed by the supreme court of the united states. the question is when whether it's before the presidential election on november 7th 2024 or after but this is a shotgun approach by a democrat prosecutor who is campaigning on taking out president trump through the legal process through law fair, she set up a website. she's raising money off of this. this is a joke of a complaint and back to you now. cash patel is the ease your take. same as mike. i mean, is it one of those things where you think you know what? they've got a lot of names on this list. they get a lot of charges on this list. what's the goal? do you put them together? and you just told us earlier getting the is cases in state court is a lot longer than in a federal court. it just takes longer. so what's the hope? here with this case? the hope is that they have issued what we call as prosecutors is speaking indictment and, as mike said, it's loud and lawless and it shocks and all the conscience when you read it, but when you go to the underlying counts, and the people involved are we to believe that the united states justice system and the state court system in georgia is going to indict counselors, lawyers and legal scholars who are advising the president of the united states of his constitutional right of free speech to challenge an outcome that is the bedrock foundation of our society and our constitutional republic. are they going to start prosecuting and piercing executive privilege and attorney client privilege as they need to do to get this indictment passed muster, and there's one other thing that we need to focus on. this is what 12 14 defendants. if any. one of these defendants request a separate trial because they have statements that cross muddle between the defenses of one or the other than they have to be siphoned off, tried separately and beforehand before the rest even go. this is what we used to do in heavy narcotics trafficking cases and human trafficking cases that i defended and prosecuted. and so we are now threatening to set the constitution on fire because a politicized government gangster in fulton county, georgia wants to take out donald trump, and i think the american public has seen it in indictment 123 and now four that president trump is a target. he is not an unlawful arbiter of the law. he is standing up for everyone's constitutional leaves and every neighbor in america is now seeing and saying, i whether i disagree or disagree with president trump. i should have the free speech right to say my voice about the election outcome. very quickly cash you while you were talking. i was counting its 19 people named in the indictment 19 along with the charges. my question to you is, can you can you prioritize these in any capacity? you as a prosecutor have now opened the investigation. you have invited the defenses that all 19 individuals can bring collectively individually or, in part, they can sign joint defense agreements. good luck getting all of these folks arraigned in the next coming months, and that's just the instigation of the process. then discovery comes in and every individual has the same constitutional rights as donald j. trump, even though he's the lead in this indictment because he's currently going to be the republican nominee. for the presidency of the united states , the amount of evidence that has to be challenging pretrial litigation is going to be so heavy for one defendant now you have 19. we should note the clock. it's about 18 minutes past the hour, almost 18 minutes and 30 seconds past the hour. we anticipate this news conference will begin with funny willis, the fulton county d. a in about one minute and 30 seconds. we'll see if that timeline holds up. but back to mike davis very quickly because mike my questn these things is it's a lot of names right? it's a lot of names to put in this indictment and cash was laying out that's a lot of names and a lot of retribution. they have my question to you is the hope of the fulton county d. a that one or many of these people. flip on the former president. is that kind of what they're driving at here? that's a possibility. i think the bigger hope is that democrats are sending a very clear warning to republicans for 2024 if you dare to question elections in america, which had been allowed to do up until this point, we're going to come after you as the democrats were going to prosecute you. we're gonna we're gonna try to put you in prison. this is a very chilling and i'tm. it's it is it is more than crossing the rubicon. it is only illegal to object to elections in third world marxist hellholes and now in new york, d. c in atlanta, as far as presidential pardons go, mike, this is different. right? this is this is set aside a state indictment. estate conviction is a different um, as a different animal than a federal conviction. is that a fair assessment? it is and under the georgia law. there's a statute that limits the republican governors ability to pardon and i think that the legislature in georgia needs to amend that statute and give governor kemp the ability to pardon and the situation because this is clear election interference is clear. democrat law affair by democrat prosecutors where they're trying to have democrat prosecutors, democrat judges and democrat juries and democrat hellholes decide the next presidential election instead of the american people. yeah it really is. it's one of those things where there's so much involved in this back to you very quickly cash to tell. because the news conference we anticipate we just saw a couple of the staff people walked by. we anticipate the what would it be? how does she convince the american public that the justice system is not corrupt. at first. she will try, but she will fail because she is going to go out there and reach chapter and verse from this indictment. she's not going to have an original thought in her head because she hasn't had one since she instigated this investigation some years ago. this is her hollywoodization and weaponization of the justice system, and she's going to use this speaking indictment and have the fake news media come in behind her to carry her weight for just like they did with russia gate and just like they did with jan. six and every other indictment that president trump is involved with, she needs to justify how a state court official can come into a federal election and declare in a state court that a federal law has been violated regarding the challenging of election outcomes, and that constitutional right embedded in the first amendment embedded in the president's executive privilege and embedded in the constitution for freedom of speech cannot be vitiated because of district attorney has chosen to politicize and that's another point. all of these issues are not state court issues. they are federal court issues. this case case, no matter how long it runs will end up in federal court 345 years down the road. any convictions resulting in this case will immediately be challenged to the federal circuit court of appeals in the united states supreme court because it involves quote unquote corrupt activities of a federal election cycle. she is not the legal officer to adjudicate that decision. she will supremely fail, and this will catapult donald trump for the republican nomination and in my opinion, the presidency of the united states cash stand by if you will. mike davis standby. i want to give our audience kind of a roadmap of where we're going here. we are waiting for finding well as the fulton county d. a to come out and address the media. the indictment against the former president, his fourth indictment this one in state court. it's a little bit different might take a little bit longer, says cash patel to actually adjudicate and can it happen before the election? those are all unknowns we are going to talk about after this. the legal aspect of also the also the 2024 aspect. the president the former president is leading in the holes in the gop primary by a long way. i mean, he's up by 30 points in some 38 points and others it kind of depends who you ask, but he's up by a wide margin. we want to find out where he's going in 2024 and what this all means. we have lee carter, the pollster who can give us some insight, caitlyn jenner, who actually played golf with the former president at his bedminster golf club this weekend, can give us some some time about. you know indications of how the president was feeling. was he aware of this was he was he ready for this fourth indictment because everybody pretty much knew it was coming back down. if we can get live to matt finn, who is live outside the courthouse. any information that you know of that is kind of trickling out prior to this news conference. trace. we've been reading through the actual indictment, so we are getting much more firsthand information, the summary or the first page introduction reads. donald trump lost the united states presidential election. trump and his other defendants knew this and refused to accept that trump lost. they knowingly and will willfully joined a conspiracy to unlawfully changed the outcome of the election. now here's the manner of the trump enterprise. according to the indictment, there was false statements to the state legislature. all statements in solicitation to high ranking state officials. there was alleged creation and destruction of false electoral college documents, harassment and intimidation of the fulton county election worker ruby freeman, solicitation of the vice president and doj officials and unlawful breach of election equipment in georgia. we're assuming that's related to coffee county and ultimately an obstruction and cover up. so those are the elements that the indictment alleges against donald trump and his enterprise, including mark meadows, rudy giuliani and many of president trump's form. attorneys were coming through the indictment right now trace and we'll get back to you with much charges here, but i'm sure you are, too. i mean, we've got a list up to 41 perjury being the last one. the first one, of course, being the violation of the georgia rico racketeer influenced and corrupt organization act. i was kind of talking with this with mike davis and cash patel earlier in case you were you were listening in on that you wonder what finding willis is going to say when she comes out. we've got the indictment. we've got the charges. there's got to be a point. so this with alvin bragg. we've seen this a couple of other times. it didn't seem all that compelling and a lot of the lawyers at least on the gop side had knocked those down . those news conferences is not being really what you know not being the sales pitch they were intended to be. what do you anticipate? funny? wills will say. well first of all, she started this, uh, the earliest event of the investigations. february 2021. this has been a long building process, which is kind of bizarre when you get to the end here, and it's so sped up after that thing. we talked about midday and the reuters reporting and then and it shows up on the county website and then suddenly everything is sped up. and now, here we are, um you know, almost to midnight , and we're gonna have a news conference. it's kind of a bizarre timing of the whole thing. i do want to talk. we talked about the charges, but some of the other big names in here also indicted. i mean, you have rudy giuliani that trump attorney former new york mayor mark meadows, white house chief of staff for president trump john eastman, his lawyer that was talking about this particular effort to overturn the election. jeff clark, the top justice department official , who was set to take over protect, potentially for bill barr, jenna ellis trump campaign lawyer. other names on here. sidney powell, who obviously was a trump lawyer during that time, other gop officials from georgia and publicist but you have 18 people, including the former president facing these charges , and the specifics in here is really what i was trying to read. need in as you. you all were talking to see how funny willis is going to string it together because the part of the rico is that you're going to have 234 criminal acts that you're going to string together in a narrative that is going to paint a picture of a conspiracy to overturn the election, and that's what those charges. do what backs up those charges and how you make that case in court is likely what she's going to lay out tonight, at least in her first public statements, and i wonder if politically bread because we're going to talk about this going forward 2024 because so far, i mean, this is only given the campaign juice right. he's got three indictments and every time he's indicted it tends to kind of infuriate his supporters, more and more, and they become more emboldened, and they stand behind even more. and i'm wondering. this just appears to be kind of part and parcel of a bigger picture of people saying, listen, there is a two tiered justice system here, and this just gives us more reason to stand behind donald trump. there's a lot of that trace a lot of trump supporters who are more fired up because of this. they think that the biden administration democrats are going after him for a specific reason, because he's the guy that can really shake things up . you still hear some of the other candidates making the case and effectively in some circles that hey, listen, i like trump policies as much as the next guy, but you don't have to have the chaos. luggage um, but. more and more your people in the middle of the road who were ready to not vote for trump. this guy because they're giving them enough charges to put him away for 1000 years. why is that? and what are these cases look like ? and when some people dissect them, they don't see as much there there. there's two sides of the coin to look at this. i do think it's tough in the general election to imagine that independent voters and suburban women are going to look highly on. you know all these charges and indictments, but, you know, we'll see how this plays out. it's going to play out real time in a surreal way during this entire election. yeah, there are we see just coming in brett, so i'll stop you if he wills comes to the podium, but but as it plays forward, you talk about different reactions. what about that the candidates themselves , rhonda santa's has come out many times and say, you know, this is this is not justice and the other candidates have supported him as well. and it seems like every time they come out and support him, they tend to drop uh, a couple of points. you had mike pence. come out and say you know things that get in favor of these indictments. and so you wonder how the candidates are going to handle the fourth indictment breath. well, i think that that's a fascinating part of this election because the gop primary writ large looks at this as unfair in some level, so how do the other candidates talk about that but also the distinguished themselves and say, but i'm the better person to run for president in the general election, and i think it's a tiptoeing through the tulips here for these candidates because they want to side with him on the two tier systems of government and justice, but yet, say you don't need the chaos and i'm the person the man or woman that can take the reins and listen. it's going to be a factor in next week's debate in milwaukee . whether the former president is there or not, he will be there, in essence, because this is a part of this gop primary. and so one of the buckets clearly is going to deal with all of this and how it affects the people on that stage, whether again he's in milwaukee , or he's not well. brett was mentioning the fact they're trying to fast track the case. it looks like they're kind of slow walking the news carver prince, which was supposed to be at 20 minutes after the hour. i just want to stand by. i want to bring in caitlyn jenner very quickly if i can, because caitlin played golf with the former president at his bedminster golf club this weekend and while waiting for the press conference because we're all looking for mindset, the former president's mindset clearly caitlin, he knew this was coming, and i'm wondering if you know there was some anxiety there. so a little bit of, or just you know what another day it didn't show because his team beat my team, so that's not good president trump. i love being around him. he is the nicest is a gentleman . he's so nice to people and he was exactly that way. i mean, he's obviously been through this before. um and he's just a wonderful person to hang out with. by the way on this list is my name on that list of all these. not yet. not yet. not yet. not yet. they're working on it. but ah, no, he's just a wonderful human being to be around. and you know, i am a proud american. i love this country. um i am the child of a world war two veteran. i grew up a patriot. i was the first person to put up a flag at the finish line. the good old us of a y because i was so proud of my country and i have to say today. and watching all this. come down. this is the first time i've ever been ashamed of my country and what is going on ? i mean, we look at elections in venezuela and other places in the world. these third world countries and we are turning into that person. we are turning into that country, and that's a shame because this is this indictment is yet another sham. um. we've been through this before in order to defeat the leading political opponent to joe biden, and he's the you know, he's the former potus donald j. trump and you know, in the past, his numbers have gone up, and i just hope people are watching because we cannot let them prevail. um if we do, we're done as a country we are done as a country. we have weaponized the judicial system in the united states. um i think right now, i was listening today. i mean, this is how many indictments we've had, but as far as the cases, it's like 100 and 17 cases again. it is ridiculous. no other president nobody else in history. and these things happen 2.5 years ago. why are they bringing them up? now this is the weaponization of our government. and it's a shame to see it happening here in the united states. timing is a very big factor in all this, because a lot of people in the gop a lot of trump supporters bring up the fact that this case could have been brought a couple of years ago. and maybe , you know, maybe be done done and said, well, we just want to note we've gotten we've got a one minute warning one minute ago. so we're still running a little bit late. certainly are and, um, i just want to say i know that the people are seeing this out there. i mean, they're doing it over and over again. they're seeing what the democrats are all about. uh and the weaponization of our government. donald trump has taken the heat right now. but to be honest with you next person they're coming after is the people right there. on the other side of this tv, they're gonna come after you. if they can succeed. we have to change this around. we are at a turning point in our country. um and we have to elect the right people. people have said they've already come after us. i mean, people have already said when you read things like the twitter files, you know, x, formerly twitter. you read things like the facebook twitter files, and you see the government coming in kind of trying to guide the covid narrative and trying to censor different things. so in a lot of people's estimation, you have had the fbi and organization from the top of government down already censoring going on for years. this is not new. we're just learning was in iowa and you see him there, and he's happy with everybody's signing autographs, and he's honestly i really loved the guy. i mean, and he did a phenomenal job. the first four years he was in there. i think he got a raw deal. but you know , i support him and a lot of people. i know. i hope they see through all of the fog that's out there right now and get behind donald trump. well here we go. the news conferences about two is about to begin. let's uh let's listen. thank you for joining us. i'm here with the prosecutors and investigators who have worked diligently on the investigation of criminal attempts to interfere in the administration of georgia's 2020 presidential election. today based on information developed by that investigation. a fulton county grand jury returned a true bill of indictment. charging 19 individuals with violations of georgia law. arising. from a criminal conspiracy. to overturn the results of the 2020 presidential election in this state. the indictment includes 41. felony counts, and it's 97 pages long. please remember that everyones presumed innocent. specifically the indictment brings felony charges against donald john trump. rudolph william louis giuliani. john charles eastman. mark randall metals. john cheese, bro. jeffrey. clark. jenna lyn ellis. raise stallings smith, the third. robert david chili. michael, a roman. david james shaffer. sean micah treasure steel. stephen cliff guard lee harris , unknown william prescott floyd. trivia on c. kuti. sydney, catherine powell. kathleen austin latham. scott graham hole. and misty hampton , also known as emily misty haze. every individual charged in the indictment is charged with one count of violating georgia's racketeer influenced and corrupt organizations act. through participation. in a criminal enterprise in fulton county, georgia. and elsewhere. to accomplish the illegal goal of allowing donald j. trump. to these the presidential term of office beginning on january 20th 21. specifically the participants in association took various actions in georgia. and elsewhere. to block the county of the votes of the presidential electors who were certified as the winners of georgia's 2020 general election. as you examine the indictment, you will see acts that are identified as overt acts. and those that are identified as predicate acts, sometimes called x of racketeering activity. overt acts are not necessarily crimes under georgia law in isolation. but are alleged to be acts taken in furtherance of the conspiracy. many occurred in georgia. and some occurred in other jurisdictions and are included because the grand jury believes they were part of the illegal effort to overturn the results of georgia's 2020 presidential election. the acts identified as predicate acts or acts of racketeering activity are crimes that are alleged to have been committed in furtherance of the criminal enterprise. x of racketeering activity are also charged as separate counts in the indictment against those who are alleged to have committed them. oh elections in our nation are administered by the states. which are given the responsibility of ensuring a fair process and accurate counting of the votes. that includes elections for presidential waiters. congress state officials and local offices. the state's role in this process is essential to the functioning of our democracy. georgia, like every state. has laws that allow those who believe that results of an election or wrong whether because of intentional wrongdoing or unintentional error to challenge those results in our state courts. the indictment alleges that rather than by abide by georgia's legal process for election challenges, the defendants engaged in a criminal racketeering enterprise to overturn georgia's presidential election result. subsequent to the indictment, as is the normal process in georgia law. the grand jury issued arrest warrants for those who are charged. i am giving the defendants the opportunity to voluntarily surrender no later than noon. on friday, the 25th day of august 2023. remind everyone here that an indictment is only a series of allegations based on a grand jury's determination of probable calls to support the charges. it is now the duty of my office to prove these charges in the indictment beyond a reasonable doubt at trial. i would like to take a moment to thank thank the superior court clerk shea alexander and her staff for staying late and making sure that this indictment was process. i would also like to thank the men and women of sheriff labatt's office for keeping the courthouse open, but most importantly for keeping us safe over the weeks and months that have led up to this indictment. and for what i know they will continue to do to keep us safe. we also want to thank the atlanta police department and other law enforcement partners who have worked with the sheriff to keep us with the sheriff to keep us safe. i will now take a very limited number of questions prior to going to sleep. i'll go first, if you don't mind. surveillance 11 love. quick question. can you clarify in georgia, the mandatory minimum when it comes to a rico charge, it is whether it's served by probation or how that might play out the rico charges half time that you have to serve. so it is not a probated sentence, not a district attorney. >> what's timetable for your trial? >> what is the timetable for the trial? as you know, in this jurisdiction, trials are set by the judges. and so it will be the judge that sets the date of the trial . this office will be submitting a proposed scheduling order within this week. however, that i'll trump. do you believe you need to be the fourth one to try them? or could you move it up? do you want to be the first to try it? i don't have any desire to be first or last. i want to try him and be respectful for our sovereign states. we do want to move this case along, and so we will be asking for a proposed order that occurs a trial date within the next six months. contact earlier today there was a fictitious document, according to the fulton county clerk's office that was circulated online, which charges against former president donald trump those that fictitious document matched exactly the charges that we now see in this indictment. can you tell us more about that document leak? because now you have the former president's lawyers who are saying that this is emblematic of a serious problem. with your office? no, i can't tell you anything about what you refer to what i can tell you is that we had a grand jury here in fulton county. they deliberated to almost eight o'clock if not right. after eight o'clock and indictment was returned. it was true build, and you now have an indictment. um, i am not an expert on clerks. do these or even administrative duties. i wouldn't know how to work that system and so i'm not going to speculate next question. have you had any contact with the special counsel about overlap between these cases? and do you attend to try all of these defendants together? do i intend to try the 19 defendants in this indictment together? yes yes. you had any contact with the special counsel about the overlap between this indictment and the federal indictment? i'm not gonna discuss our investigation. at this time. many conversations made by former president trump that this is a politically motivated indictment. i make decisions in this office based on the facts and the law, the law is completely nonpartisan. that's how decisions are made. in every case to date this office has indicted since i've been sitting as a district attorney over 12,000 cases. this is the 11th rico indictment. we followed the same process. we look at the facts. we look at the law and we bring charges about the terms of surrender. will you try this case yourself, miss willis cleared down down. well, there you have a funny will spoke for about seven minutes, took a few questions. they're one of the questions that she would not ask, was brought up about this indictment that appeared on the fulton county government website today that was also broken and posted by reuters and the county came out and said that was a fictitious documents and to ignore it. and as one of the reporters kind of mentioned there, the document the actual document that came out earlier this evening actually matched that document . i want to bring in the anchor special report. one more time. brett baer brett baer, what did you hear? did you hear anything unique or significant from the d a. well a couple of things trace one is that she wants everyone in this indictment again. that's 19 people, the former president and 18 others to turn themselves in by friday , august 25th and that's you know, two days after the debate, milwaukee so we'll see how that goes. the other thing is she wants to speedy trial, and she wants this trial within six months. now let's just do the math. here, um september, october, november, december, january february that's right in the middle of the primary caucus season, and, um, it is a judge that makes that decision when the trial will go forward . i think the most interesting thing is the thing you just pointed out, and that is the question about this document that ends up being posted midday. reuters gets a grab of it. they do a story that the former president appears, has been charged because it's on the fulton county clerk's website. then the clerk comes out and says that is a fictitious document. don't go don't go by that, but doesn't explain how it ends up on their website. she won't answer a question about it, saying she doesn't understand how clerk duties work, but it's the exact same charges as the charges that the grand jury voted. in true voting form to go forward with now, how would they know that that was the exact same charges and that the grand jury would vote? how they voted? that will be a source of much discussion in the trump legal camp? i'm sure but fani willis thinks that she has the racketeering charge and she wants to try them all. together which is also interesting, right? and then you have 19 different sets of attorneys and you have all of these charges and you're trying to get this thing within six months. it seems like a bridge too far, but but going back to that thing, yeah, as you notice it was before the grand jury voted, so these charges were up on on the website before we actually knew that the grand jury was had voted to indict. and so the question becomes. we're not getting we're not getting the honest story from somebody. yeah and you know she's calls it a clerical error. she doesn't know how the system works. of course, he knows how the system works. it's a system that she deals with all the time about how a grand jury delivers these documents, how it goes to the office, how it's recorded and processed and then it's unsealed and she talks about it. she knows exactly how it works. so this is a question that's going to continue to come up about how that happened during the day. but the bottom line is the bottom line. the former president, united states , the 45th, president of the united states, now has been charged four times. four indictments. with now about 90 plus individual charges against the former president. and there you see the charges in this particular case that stems around the 2020 election and there are different elements to this. there are different parts of how they make their rico case, but there are a lot of people that are already trying to punch holes in this yeah, indeed. there are bred barrett. thank you, sir. great stuff. appreciate it. i want to go back if i can not to cash patel and mike davis, if you gentlemen are both with us still, i want to know your thoughts on this because the whole concept here is 19 individuals. she wants them all tried together cash, and she wants this done within six months. what do you take? that is a constitutional farce and illegality as a former federal prosecutor, public defender who's defended cases involving 10 and 20 defendants. there's this thing called the blockbuster ruling if one defendant is using a statement against another defendant in the charged indictment, that case has to be split and tried separately. all 19 can go separately. or there can be a combination of the two. either way. there is no way under the constitutional rigors of due process to get six. uh to get this to trial in six months, and, more importantly, the fulton county d a just made a representation to the world. she just lied to the universe as the district attorney. your name your stamp is on every single indictment. you do not have loose copies of indictments floating around and blame the clerical system and the judicial officer in the clerk's office for a mishap. she just said she has no idea how that indictment was presented in posted online. she just lied to the world. that should tell you everything you need to know about her weaponize system of justice, her personal animosity towards donald trump and the destruction of due process and the continued election rigging that goes on at the state level . now, it centers around atlanta, georgia, this fulton county d. a congress must investigate and subpoena her immediately for lying to the world about how this judicial process unfolded and that phony indictment that was put up it was done with her approval through her hands and through all of her assistant district attorneys. she's response. double. she just lied to the world. mike davis. something cash left out that you'd like to expound on i would just say this. they waited. jack smith and fani willis waited 30 months to bring these bogus charges against president trump. but now they both want to rush to try president trump . when these are complicated factual cases, they're easy legal cases. these are non crimes but complicated factual cases with a lot of witnesses across a lot of different states. they want to rush to try president trump within the next 6 to 8 months that just happens to be during the presidential election. this is obvious election interference by democrat prosecutors to take out president trump before the 2024 presidential election. i will also note that fani willis refused to say whether she is cooperating with the biden justice department, including jack smith. there obviously cooperating there, obviously colluding to take down trump and cash kind of touched and then a little earlier. i want to bring this in every individual is charged with one count mike overt acts predicate acts. what's the difference? she said, some clearly overt, not as serious as the predicate acts. what are we dealing with here? we're dealing with a legal stew here. she's coming up with a organized crime theory to go after president trump and his lawyers and his other advisers to try to criminalize the political process, and that's what they're doing here and again. this isn't just about 2024. this is a warning shot to republicans that if you dare question elections, democrats are going to unleash the full force of the criminal prosecution at the criminal, the criminal system they have. they're going to unleash it against republicans who dare raise questions about elections going forward. yeah mike and cash if you'd stand by. i appreciate this. i want to bring in lee carter because she is kind of our other election voting polling expert in this and leah. i'm you know, i'm looking for fallout as you go down the line because i think it's fascinating. you move forward, and i touched on this with brett a little bit earlier. as you move forward, it seems and caitlin was kind of some kind of stay with us and point this out, it seems as if every time there's an indictment and every time a prosecutor gets up there and kind of reads this thing and people tend to be underwhelmed by the actual appearance of the d a. in the president. the former president's numbers just keep going up. what do you think? well, that's definitely what we've seen. i mean, when all of this started with the manhattan indictment trump's polling was about 30 to 40% now he's well over 50% we've seen an increase in his polling numbers between 14 and 18 points. just since that first indictment. it's somewhat counter intuitive, but it starts to make sense. if you look at some of the numbers underneath it. eight in 10. americans right now believe that there is a two tier system of justice that is meant to benefit one side over the other 80% americans feel that government is not there to fight for them. only two in 10 americans trust the department of justice in this moment, and so what we're seeing unfold in front of us is not people saying that i'm not sure what i believe about donald trump or i'm really going to listen to this. they're saying, i think there's something about this is really unfair and it's not right. 18% of republicans are more likely to consider donald trump as president today than they were 22 before the indictments, and it's really about this issue of a feeling that government is only one sided at this point, only there to protect one side of america , not both sides and really, i think there's a huge rejection of the notion of unity that the democrats before saying that's not what's happening. yeah and i think from a polling perspectively, it's kind of interesting. and we've talked about this at nasim tonight. the whole concept that earlier a piece of this indictment appears to have gotten online. it was on the clerks website, the dot gov website and reuters broke the story. and then the clerk's office came out and said, no ignore that. that is a fictitious documents, and that document matched the actual indictment. but the document earlier was actually processed and put out prior to the grand jury voting to indict and that's the key thing here because you talk about fairness and you talk about, you know, talking to people about these issues. everybody in the country has got to be thinking that just doesn't seem right. yeah and there's no doubt about it when you heard that, and we saw that. it really raised a lot of questions when you think that 86% of republicans right now are saying that they believe that these charges against trump or politically motivated and then you see this kind of activity happened. it just reinforces that belief, and it's going to be hard for anybody to hear anything beyond that to say or trust anything they had to say, because they're going to look at this and say it was predetermined. the legal system is rigged, and that's what people already believe. and it's gonna be really hard to shake that, and so many people are out to criticize the why republicans believe the way that they do, but i think it's really, really important that people do understand that this is where we are as a country. we do not trust our government. we do not trust the systems of government that are meant to keep us safe. we don't trust the department of justice, and in particular, republicans are really ready to fight back. 70% of republicans say they want someone in a leadership position who is going to fight take this country back from the ruling class elite. and many people believe that right person is donald trump. despite all of these indictments, despite all of these charges, and despite all this activity yeah, and i think it's a fair assessment of caitlyn jenner to you because it it really i mean, i was talking to a friend of mine who's who leans left who was saying? yeah, you know some of the stuff that comes out of the doj and the fbi and the things we have seen in previous years. it's not proper. it's not proper already botched it. i mean, you were saying earlier about this leak beforehand, and some of the things that came out from that they've already messed it up. they honestly they wanted to get this out very quickly because they want all the attention on donald trump instead of trump. >> tension on donald trump instead of the biden campaign. i mean, things are coming out now with the biden family that are just horrible, the amount of money that they made. i mean, look at it this way. >> donald trump was president for four years. he never even got paid. he took his salary as the president and donated it to veterans organizations. that's the type president i want, not somebody that's in there scamming the system, making money on the side like the bidens have. it's clearly coming out right now like the bidens have done. donald trump is a stand up guy . it's a shame to see what our our weaponized judicial system here in the united
