build something for migrants. bill melugin is in mission, texas. >> a major update to a cartel story we brought to our viewers last week. let's get into the photos which we showed last week showing several armed cartel gunmen crossing illegally here into the rio grande valley in the texas area. texas dps confirms to fox news two of those gunmen have been arrested crossing illegally in the same area while armed with guns again. right into the new photos courtesy of law enforcement sources showing two of the cartel gunmen in handcuffs after a joint operation between texas dps and federal government. they had six magazines full of 556 ammo on them including one magazine with military-green green tip ammo for extra armor penetration. who rifles were found. one an m-four, other ak-47 ditched in the rio grande. both of those weapons were loaded. the n4 had a round in the chamber. texas game warden canine sniffed out the guns that were ditched in the river. law enforcement sources telling us that these two cartel gunmen are confirmed members of cdn. that is the northeast cartel. this was a joint effort between texas dps ranger special operations, u.s. border patrol and texas game wardens. texas dps released a statement saying there is no greater public safety and national security threat than the mexican drug cartels who have exploited security vulnerabilities due to an unsecured international border. this joint effort highlights the importance of collaborating with local, county, state and federal agencies for one common goal, keep our state and country safe, end quote. back out here live the point texas dps is trying to make is last week we heard texas democratic congressman castro call on the biden administration to end all cooperation at the border between border patrol and texas dps. he is upset with governor greg abbott's operation lone star. he doesn't like the razor wire or buoys into the water. texas dps says if that happens guys like this don't get captured. >> dana: thanks goodness they caught it. worried about who they weren't able to catch. >> bill: president wall candidates on both sides of the aisle slamming the handling on behalf of the president by the border. in new york city the democratic mayor plans to build a huge migrant shelter on an island on the edge of the city to handle the huge influx of asylum seekers. madison is at the site live on the new shelter today, madison, good morning. >> good morning, bill. this plan was announced just last monday and you see behind me they have done so much work in just one week. we see beds carried in now. the estimate it will be up and running before the end of this week, just a week after it was announced. these are the kind of solutions that new york city is looking at. turning soccer feels that service thousands of city kids that don't have access to green space and turning it into a shelter for 2,000 migrants. when you look at the southern border the crossings there are impacting cities and towns across the u.s. this is now becoming a national issue. republican presidential hopefuls taking that issue head on this weekend like senator tim scott who said he would add more agents to the border and add more immigration judges to review these asylum cases. >> starting at our southern border. we should all be exercised about the crisis on our border. every county in america is a border county because of the number of lives lost to fentanyl. >> this is why the southern border was a common topic in iowa this weekend. that's 1,000 miles away from p border. putting his barrier there. his job is to protect the people of his state. he needed to do that because president biden wasn't doing anything. we have to start doing that. >> both miami mayor suarez and vice president mike pence stood on the need to classify cartels at criminal and terrorist organizations to address the human smuggling and drug trafficking problems. former president trump has been outspoken about the issue at the border calling it is catastrophe. florida governor ron desantis promising to end birthright citizenship. finish the wall and send u.s. forces to mexico. rfk former military airfield to house migrants. "new york post" says governor kathy hochul pitched the floyd bennett field as a migrant shelter. the white house told her there are operational and legal issues with the proposal. hochul said yesterday it has been a long journey. something i've been working on for 2 and 3 months and intensely the last few weeks. today was a call to talk about logistics. i did not take away a hard no. it will be an he involving process. i bet it's a no. >> bill: a new ballgame? special counsel david weiss begins his first full week on the job today. has authority in a case that could send the president's son to prison after a plea deal fell through last month. >> it makes it sound like they were never going to charge this case but then because the whistleblowers were coming forward, they decided to just see if they could get this thing resolved quickly. they moved too quickly and made a bunch of mistakes like they've made mistakes throughout the investigation. >> bill: andy mccarthy standing by with the big picture. first let's go to the department of justice and david spunt. could be in for another big week. good morning. >> always a big week at the department of justice. good morning. late last night hunter biden's attorneys filed a new motion in the court in delaware with the judge and said essentially if the government says the plea deal is off and that's what the government said in a filing on friday, so be it. let me read from the filing last night. while counsel for the defendant are still prepared to respond to the questions your honor posed at the july 26th hearing in light of the decision to renege on the plea agreement those issues are mute at this point. they say the diversion program, the gun charge is valid and agreed upon by both parties. weiss begins his first full week as special counsel this morning. the same one who sat in a courtroom with hunter biden three weeks ago and prepared to enter into the plea deal with him. it will move to trial in washington, d.c. or california where hunter biden lives or both. hunter's attorney yesterday said he doesn't expect new charges. listen here. >> everything else had been thoroughly looked ate. will it be possible to revisit it? if the now special counsel decides not to go by the deal, then it will mean that he or they decided that something other than the facts and the law are coming into play. >> basically weiss will have an expanded staff. republicans are complaining about the pick of weiss. >> david weiss has to be held accountable for what he is going to do now as a special prosecutor but also has to be held accountable for what he has already failed to do starting in 2018. >> it's unclear if weiss will now testify before congress. everything seems delayed. >> department of justice, david spunt. >> dana: let's bring in andy mccarthy. i resisted calling you this weekend because i was trying to figure all this out. you knew you would write about it and you have and we get a chance to have you here so our viewers can understand why do you say that this is farce? >> well first of all, he keeps being called a special counsel. he is not a special counsel. not under the regulations. he is now -- let's be clear. the attorney general of the united states can pick whoever he wants to investigate whatever he wants. i am not saying that the appointment or the picking of weiss to do this investigation is invalid. however, he is not a special counsel. a special counsel under the regulations is supposed to be an attorney who is brought in from outside the government to investigate because the justice department has a conflict of interest. he didn't do that here. >> dana: such as for people to understand what robert mueller was in the trump investigation. >> correct. and what i think there were problems with that appointment as well but with respect to this one, what he is doing, what garland is doing, is assigning the case to weiss, which is no change. it has been assigned to him since 2018. and labeling him a special counsel but he is not a special counsel under the regulations of the justice department for that process. and the reason he is doing that is trying to convey the impression to people that there is some kind of independent integrity to this investigation, which is laughable given the way it has been conducted to this point. >> bill: andy, if joe biden is the democratic nominee, and if he is standing up before 60 million americans and gets a question about this, the investigation is still ongoing. sometimes they take years, can he defer? secondly, if jim jordan and gyms comer on the house side want to hold a hearing on this and call key witnesses before them, can they decline at this point? >> they can decline, bill, because it is political. you know, they won't be able to make them answer questions. but i do think what they ought to be asking questions about is how much of the case is lost? you just have a report about hunter's lawyers kind of confidently saying if the deal is gone, so be it. i don't blame them for that. remember the whatsapp message that everybody got spun up about about a month ago? i will remind people the sequence is hunter does this extortion message where he says his dad is sitting with him and pressuring the chinese guys and within eight days they start sending $5 million that gets into the biden family coffers over the next number of weeks. that call, that whatsapp message happened on july 30th, 2017. the $5 million went on august 8th, 2017. today is august 14th, 2023. the statute of limitations for most federal crimes is five years, for tax crimes six years. all of that stuff is time bar evidence at this point because weiss never indicted the case. all he needed to do to preserve this case was file an indictment. a statute of limitations would have stopped and you could negotiate a plea agreement from a position of strength because if they didn't agree to plea you could file the felony charges. >> bill: since dana didn't call you over the weekend. tell us now and tell our audience what was the incentive to make this decision? what is the effect of it? >> well, it's a two-fold decision. on the front end, weiss makes the case against hunter disappear by not charging it. the statute of limitations is eating all of these charges. this behavior goes from 2014 through 2018. almost all of it is gone. on the back end the special counsel designation allows him to write a report. at some moment during next year during the election season he will drop a report and i looked at it and president biden had nothing to do with it. >> dana: i want to be correct. what should we call him if not special counsel? >> not me. whoever did the deed is the one who is getting any earnings from that work. >> bill: there are a couple of things. one from amazon from a group called good reads. they say this. we have clear guidelines on which books are included on good reads and will quickly investigate when a concern is raised removing books when we need to. we continue to invest and improve to quickly detect an take action on books that violate the guidelines. do you believe that to be the case so far, jane? >> well, i don't think they have adequate systems in place today to stop this. i know countless authors who have been dealing with this for months. there has been an avalanche of a.i. generated content going up on amazon whether credited to real authors or not. their systems haven't kept up. >> bill: amazon says we invest heavily to provide protect customers and authors from misuse of our service. when you try to reach amazon you are reaching into a black hole snow >> yes. i attempted to contact them during their infringement forum. because it is a.i. generated work i wasn't able to show that i had copyright protection over this and wasn't able to show i own a trademark. most authors aren't trademarking their name. i was quickly turned down as far as my request to remove this material. >> bill: last point. you actually got someone with what you say some measure of sense to understand. so i imagine there are other victims. what advice would you have for them? >> the biggest crowd they've ever had, they say. i love them and they love me. >> are you going to come to the debate? >> are you going to come to the debate in milwaukee? >> that's a good question. >> desantis was here for hours on the ground, bill. then trump flew in creating quite a buzz at the state fair surrounded by secret service and big crowds of voters in a hot and steamy des moines. nine florida republican members of congress who endorsed him over desantis. desantis walked around with his family and shaking hands and trying to show off his personality. he says he is ready for the debate stage and thinks trump needs to show up. >> fox news debate is coming up in milwaukee. do you think the former president should be there, too? >> i think people should debate. that's something that you owe it to the people to do. i also think all republicans should commit to support the nominee. at the end of the day, i'm running to reverse the decline of the country and stop biden and i think i will be the nominee. you can't take your ball and go home. you have to be willing to support the larger effort and ultimately this whole effort is bigger than any one person. so i will be on the team no matter what happens. >> other presidential hopefuls were here on the ground trying to connect with voters in iowa. tomorrow asa hutchinson and tim scott will be on the ground and they all head to milwaukee. >> bill: nice to see you today in des moines. >> dana: three reporters covering the race in iowa know the hawkeye state inside and out. the three are here. all right, aaron, let me start with you. did anything surprise you? you have covered many of these. was anything different? do you have a sense of things? >> i don't know if i would say surprise, but the spectacle was about what we expected yesterday with two of the top candidates both being there on the same day reminiscent of eight years ago when donald trump, bernie sanders and hillary clinton all came to the fair on the same day. so just massive crowds to see both those candidates. and former president trump definitely was the main event. he was masses wherever he went. he made a few stops. he spoke to supporters inside a food pavilion and it was just shoulder to shoulder as far as the eye could see everywhere he went. >> dana: john, what did you see on the desantis side of things? >> trump obviously did have huge crowds. the lines to see him were much longer than the lines to see the thousand pound boar in the barn. his airplane flying over the fairgrounds was very dramatic before he got there. we have to keep in mind. desandt was doing the work that needs to be done the days before he arrived at the state fair. he was out doing campaign events across the state for two days before he got to the fair meeting voters one-on-one. fairgrounds are impressive but his real open question how many of the people are caucus goers? a lot of democrats and independents people from other states who show up at the iowa fair. it is more of a media spectacle than a great gauge of support in the caucuses. >> dana: steven, aside from trump and desantis, were any of the other candidates that made a dent in some of the coverage? they were all there. we've seen coverage from nikki haley and others. anything else to report aside from trump and desantis? >> the ones lower in the polls are there. they are putting in the work trying to spend a couple days at the fair. i followed mike pence around for a day on friday shaking hands from dawn to dusk basically. so they are trying to meet those people. like john said, those people might not all be caucus goers but a chance to meet a wider audience of iowans and get in front of people. vivek ramaswamy wrapped on stage and got him a little attention. they are all hoping to have that moment where they can make a dent in iowa's consciousness and try to break thr a quiz of fair asking them name three candidates running for president and the lower polling candidates might not be encouraged to know most people could only name trump and biden. >> dana: that's pretty interesting. they have been there a lot campaigning. ron desantis said donald trump should not have dismissed the very popular governor, kim reason -- reynolds in iowa. do you think it matters? >> i don't know how it might affect a voter, the people who are supporters of donald trump aren't going to be moved by the fact that he is having, you know, this little disagreement with governor reynolds about her endorsement. for the people who may be moved by that they were already looking for another candidate anyway. >> dana: are the people excited about the upcoming presidential election or does it feel too soon? what was it like? >> i don't think there is broad excitement about a potential trump/biden rematch. there is a lot of people wishing they had some other choices here. of course, they may. especially on the republican side. we don't know that trump will be the nominee. caucuses are five months away. the race in iowa is known for dramatic changes at the end. that candidates polling in single digits in the summer times win this thing. so we all have to keep open minds on this. we'll see what happens. trump does look dominant and much better organized in the state than he was eight years ago. he had volunteers all over the fairgrounds. talked to one woman spending 10 out of 11 days at the fairg fairgrounds volunteering for him. >> the first republican primary debate is fast over a week away on august 23rd. fox news is hosting the event in milwaukee and you can be sure we'll be there covering the debate itself as well as looking at the biggest takeaways the next day. we will be there. >> bill: looking forward to that. >> dana: i'm already thinking about what i'm going to wear, are you? >> thanks for having me on. i have to preface this by i'm a -- to write this story was very hard. i think part of the big problem is the today's politics. pittsburgh has been a one-horse town, a one-party town since 1933. however, our former mayors have all been pretty good managers. they understood that ideology was not the driving force but governing and managing the city was. there is a problem right now within the city government where you don't see that sort of same understanding. the understanding the governing has to eclipse politics. and you also see other democrats in town elected officials, civic leaders, ceos, afraid to say anything about what is happening because of the pushback that you get from the left. and that's not the tradition that we have in this city. >> bill: what you are saying all politics have gone progressive is the picture you are painting here. allegany county is biden blue. >> yes. >> bill: i remember a city that has fantastic universities, that has great hospitals, a lot of good medical innovation there. they made that conversion from a steal town to a hi-tech town. it was all very impressive. >> yeah. it was incredible. it was the philosophy where using the universities and the outstanding health facilities you can see allegany health network, but also the amazing universities. we are rich in all of those cultural touch stones that are very important to making a city vibrant. however, at this moment the current mayor isn't even speaking to upnc because of his belief that it should be unionized, which was done by a great report. >> what is upmc. >> the university of pittsburgh medical center. >> bill: you said people are afraid to speak up. why? >> because there is this sense that you will be the mob will come after you. i don't believe this is in talking with people in pittsburgh, that this is acceptable, whether you are a democrat, republican or don't care about politics at all. but civic leaders don't step up and tell this current administration to step up and do something. because they are afraid of the attack. progressive politics, i'm not -- has sort of taken over the city and the county and these races are often won in primaries, not in general elections. and so there is just this sense that you can't say anything without being attacked, without being called a bigot because you disagree with the handling of the city. >> bill: we'll see if it continues along that trend. thank you for coming in today. it is your piece and wanted to hear you out. thank you for your time. >> dana: always good to see her. a very odd moment over the weekend in a woman's semifinals open canadian tennis tournament. there was a song blasting through the speakers on why or how. it forced the umpire to call for a do over, bill, watch. >> oh, wow. cotton eyed joe came on mid rally. >> bill: i saw that online over the weekend. i think i had to rewind the thing three times. what are they talking about? "the faulkner focus" top of the hour. >> bill: thank you, harris, news regarding ukraine today. a moment ago the state department confirms that the united states will now send an additional $2 hundred million in new security assistance to ukraine. what this entails is not necessarily clear just yet. $2 hundred million, a lot of money. what it pays for is not exactly known here. just scanning the wires to try -- we'll try to get a good scope on that and let you know what this $2 hundred million will go toward. stand by. dana. >> dana: troubling trend across the u.s. as more and more hospitals shut down labor and delivery services especially in rural areas. the march of dimes recently reporting more than 2.2 million women of childbearing age live in maternity care deserts. dr. michael cruz is an operating officer for a health agency. what is the scope and scale of the problem? >> in the last five years, there has been 21 hospitals that discontinued ob services in illinois alone. it's a huge issue. a lot of reasons for it. so it's impacting the moms and also moms with their children and how they receive care. >> dana: what are the top three reasons for these places shutting down? >> our top reason is quality because we need to execute on excellent delivery and care. otherwise the risk, as you are well aware, maternity mortality rates are pretty high for this developed country. so our job one is taking care of the mom the best way we can and i think creating that model of care, recruiting obstetricians, having competent nurses for all the emergencies is job one. i do think there is maintaining and recruiting those clinicians in our communities and i think the impact that the pandemic and finances have had to execute that model are probably the 23 or 4 reasons. >> dana: does pay for the doctors maybe even the nurses and staff, is that an issue that they are looking to find a place that will pay them more for the things that they are good at doing? >> well, you know, there are two pieces to this. physicians expect their work and their art and science and fair pay. that's very reasonable. there is less obstetricians going into the residency programs today. and part of the reason is the pressure that's put on and part of it is the medical malpractice, lack of cap in certain states. some states are very difficult to recruit to that. if you don't have the clinician, the doctor, sometimes the nurses won't follow because you are closing. so if you close 21 ob acute care delivery units in the state of illinois in five years, how does that look for a provider and attending or nursing staff who want to practice that art and science? >> dana: what would you do to try to fix it if you could wave a magic wand? >> i think we have a ton of opportunity. we don't speak too often. the digital capabilities, the whereables, mobile care. sometimes virtual. we are doing something with the medicaid innovation collaborative. use of community health workers. so i think there are a lot of opportunities in the crisis and it is forcing us to figure out how to deliver that care safely. because women aren't healthier now. we have issues with obesity that is affecting hypertension and instantly puts moms at risk and high-risk deliveries and those children. >> dana: the trend in america, as you pointed out in your first answer, in our country you would think that infant mortality rate and mothers being in danger would actually be a small tiny amount but it has been growing in some places in recent years. give you the last word. >> yeah. i think you are spot on. we aren't healthier. we are less healthy. the demand for the general ob practitioner is substantive. we have to be connected to the maternal fetal medical specialists and people are delivering earlier and aren't as healthy because moms aren't. we have a lot of work ahead in taking care of the mom and ultimately the baby. >> dana: part of that is raising awareness as you helped us do today. dr. michael cruise in illinois, thank you. >> thanks.
