[laughter] alexis mcadams thank you. eighty people are confirmed dead now in maui as devastating is devastatingwildfires continue hawaii. hundreds of people remained missing his search and rescue teams comb through the destruction. the fire in the city of lahaina hawaii's deadliest natural disaster since the tsunami killed more than 150 people back in 1946. max gorden has more from maui, max. >> right now we are about 13 miles away from the town of lahaina that was destroyed by these fighters. as you can see people are lined up trying to get back in. some of these folks waiting for 12, 15 hours waiting for a curfew to be lifted early this morning and for folks who have gotten in, scenes of destruction and shock from residents. >> and what builds what other people here suffering. we need donations. we need people shipping things out here. we need families fed. yeah we need so much help. >> home after home and lahaina gone one estimate from the property aggregate puts the destroyed homes that more than 3000. the rising death toll now at 80 people as rescue crews searched for more victims. thousands of people have left the island around 1400 are currently staying in emergency shelters here. each is still unclear how the fire started but when they did ignite, the island was ripe for an inferno. extrema dry conditions. [inaudible conversations] seventy -- 80 mile-per-hour winds caused in part by passing hurricane dora fueled the flames created challenging battle for the islands firefighters. residents and lahaina said they were given little warning of the approach and blazed the islands emergency sirens did not go off. with text being sent out instead many escaping with just their lives. some in lahaina jumping into the water to save themselves as this town was raised by far the coast guard said it rescued 17 people. >> they were fortunate to have been there during the rescues at a time when the smoke lifted for them to be able to see the people who needed to be rescued. the helicopters that were launched were not able to approach closely enough during the worst of the fire to see through the smoke. >> the power and cell service is slowly being restored on the west side of a maui now another challenge for people who live here the water unsafe to drink in some places because of contaminants from the fire. john, back to you for. >> max gorden thanks. for more on this let's bring in jeff hickman public affairs officer for the hawaii national guard. jeff, it's good of you to join us it's a very busy time for you. it is my understanding those 80 or so people who have been found dead all of those victims were found outside on streets and in yards and so forth. because you have not been able to get into some of the destroyed homes yet, is that the case? works thanks for having us that is the case. we also have plus sing up the numbers of search and rescue personnel per the national guard and 48 search and rescue personnel yesterday didn't have an additional 70 this maui first responders who have been working around the clock. we are hoping that would speed up the process, finding people's loved ones and those missing in to get into the buildings we do fear the count will rise. jon: is there an accurate count on how many are missing? >> no, there is no official count. a lot of lists out there in the public they range from 1000 or higher. none of that is an official couch. there is a lot of people missing red cross is working really hard for family reunification. their efforts it's really easy to find the reunification to system center. jon: the numbers could be into eric, you could be expecting a few more casualties? that could be dozens, maybe more? >> yes, the casualties we are fearing is going to jump a lot. we are anticipating that. we are preparing for the worse and hoping for the best but we are going to do our best to find maui find closure i'm really helping get to the process. jon: what you need right now? what can americans do to help out? >> right now the aloha spirit is amazing not just here in hawaii were receiving support from all over the world actually. e-mails directly coming that they can help i have a truck on this island elect to ship it over. the amount of donations coming in are overwhelming some the donation sites. the donations are getting to maui there's so much donations on a maui it's taking up a school gym for the donation center in the school is closed. there also housings on the displaced residents from maui. the donations are coming for the number one thing maui needs now is money to help but the donations you can see a video there it is amazing the aloha spirit and the town of lahaina is a valuable place a lot of hawaiian historical elements to it. home of the world's largest banyan tree the whalers village and neighborhoods just leveled and places people love it. it's a very special time for us in hawaii everyone is pitching in to help them get through this. jon: a lot of people know and lovethat tree there was concernt got pretty scorch during the fire. do you have any status update on that? >> you know what, we are trying to get the treat status from maui county we would love to have that update. i grew up on maui my mom taught elementary which is right next to the banyan tree. on so i have swung on his vines. i have been there there has been numerous people on maui and lahaina that tree is very special. i'm really hoping everybody is hoping it pulls through and can be a beacon of hope and a true survivor during our worst disaster we've ever had. jon: i look at the footage and hear the accounts of the survivor the oil thing i can sort of compare it to is pompeii and the eruption of mount vesuvius. it just came upon you so quickly. >> he mentioned 80 mile-per-hour gusts that blew the fire. we thought we were safe with it being so far south of us the national weather service in our emergency managers knew the high winds were coming. it was a possibility but we have never had a fire like this before. and it came quick. the commissions were right for it. maui is now dealing with at the worst disaster we've ever had. we've got the hurricanes, tsunamis, two lava flows in 2014 and 2018. but the images coming out of lahaina and the stories is devastating and hurting the island so much. jon: of covered a lot of wildfires in writing by never thought to be seeing what i'm seeing there on maui. jeff hickman, thank you for joining us. >> aloha sir, thank you. supporting of the victims of the wildfires go to redcross.org/foxforward or text hawaii to tran eight. that will make a 10-dollar donation. the att attorney general america garland yes rate limit u.s. attorney david weiss as special counsel in the investigation into hunter biden. weiss has been on the case since 2019. he initially but brought charges against the presidents on garland's announcement came nearly two weeks after the plea deal that weiss oversaw with hunter's legal team fell apart in court. lucas tomlinson's live at the white house with the latest. >> john, but now the white house is helping hunter biden would have his legal woes behind him. those before the plea deal fell apart and more charges could be coming for it but although do t on it. does not necessarily mean this as special counsel will actually exercise that greater authority. maybe this special counsel is change his tune and will found religious and take a different view of the case so far the evidence does not suggest the special celt's counsel thanks there's other felonies out there waiting to be charged. on john, because both sides cannot agree on a plea deal the case could be going to tropic tp president biden left the white house for the beach yesterday without taking any questions about his son. joe biden has long maintained his son hunter did nothing wrong. he has also insisted he never spoke with him about his overseas business dealings but after the testimony for those two irs whistleblowers the unfair fight informant document he had hunter both pocketed $5 million from the ukrainian energy giant some speculate will be joe biden on trial in addition to a son of the plea deal fell apart. now capitol hill everyone is excited david weiss was investigating hunter for the past five years. was of course i'm special counsel. >> he denied access to subpoenas along the way. he gave updates to attorneys. he has shown his hand to really just be on the same team as teen hundred he will follow the facts to where they lead. >> georgia former lieutenant governor announced he will be testifying for the grand jury on tuesday and ahead of a possible fourth indictment. when trump was sworn into office in 2017 there were two republican senators from geo georgia. today there are none. jon: lucas tomlinson from the white house. lucas thanks. for more on this let's bring in texas congressman pat fallon is on the house oversight committee on the house armed services committee bread congressman thanks so much for being here. the chairman of the oversight committee james comer said he suspects a cover-up and the appointment of david weiss. he thanks it's part of an effort to stonewall congress. how do you see it? >> i think chairman cromer's on to something for what i would love to resent david weiss he's agreed to come and testify to the judiciary committee in september i would love to ask him several questions one of which is why do you think justice was served in a man who do not pay income tax on eight half-million dollars was able to walk? you negotiated that deal did you know about the existence of the fbi at the 23 form and if so, wwiden to ensure investigative agents had access to it? why didn't shut the agents pursue who died was who the identity of the big guy was questioning writing to let them contact under biden when they wanted to trust him questions? why didn't did leslie wolf the assistant u.s. attorney took off hunter biden's legal team when they wanted to serve a search warrant on a northern virg virginia -- met a storage unit in northern virginia. a u.s. attorney tipped off a subject of an inquiry their lawyers to say we might want to go look there you might want to i don't know, clean it up. >> david weiss is the guy who supervises plea deal that everybody -- republicans said was a sweetheart deal. anybody else who had not paid that large a tax bill and also have this gun charge hanging over his head would have done some prison time. david weiss apparently signed off on a deal that was pretty lenient. it did not go through obviously the ends. but it was a lenient deal. >> jon, not just republicans a federal judge would not accept the plea deal anyone who looks into this and sees people that had done this prior, other folks like you and me would have served jail time somewhere between two and five years most likely. hunter biden was going to get probation? that is ridiculous. and also david weiss dragged his feet on the statute of limitations on a lot of this had also run out so yes i would love to see special counsel but not david weiss. what are we going to seat next hunter biden is aware the going to have him be special counsel to represent himself? >> it is conceivable this investigation could be held essentially under wraps until after the election. do you see that potentially happening here? clicks it's clearly the biden strategy there with the kick the can down the road to get there in november of next year. that is in the strategy along with think of at this with joan hunter biden had nothing to hide particularly joe biden why not just release your bank records question of why not cooperate with the investigation and this could be over in a week or two if you are clean, if you have done nothing wrong but if you were trying to hide things they are doing every thing in their power, it appears anyway they are trying to delay, delay, delay. >> the irs supervisor ray shapley testified david weiss told him he had asked to be appointed special counsel much earlier in this investigation and was denied. now if that is true what has changed? why did america karl and all the sudden side special counsel status it was worthwhile? >> it does not make a lot of sense and does not add up because they voice a month ago things when i'm although he needed to pursue the case if that were true why would he need to now be appointed special counsel? i believe the irs agents, zigler and shapley were highly credible they knew their stuff at 27 years of combined investigative experience there some the best people in the world with forensic and everything they said ring true and was consistent with the things coming out of weiss' office, make your head scratch. jon: your committee released evidence that suggests the biden family at large has collected something like $20 million from governments that hate america generally. where does this go? >> that is a great question. i think what you are doing is doing a disservice to the next generation of america's leaders doing a disservice to the country by having them in a four-day school week. but also you have paid their taxes to the local municipality on the bargain they're going to send their kids to school for five days but when the parents are working. now at the school day's turn to for, do the parents get a rebate? do they get a tax refund? they're going to have to get childcare they're going to have to do something on the fifth day. they expect to send their kids to school five days a week that affects school districts are saying four days a week does not just hurt the kids does not distort the longevity of our innovators and our entrepreneurs going forward it also hurts the parents as they try to make ends meet. jon: the school district say they're having trouble recruiting qualified teachers under the current system. under the five day week they get more applications if they go to a four-day week does not make sense? >> certainly if you're going to paid the same amount of money for working four days as opposed to five days then who would not take that deal? you are also seeing a teacher shortage imagine being a teacher you want to go in there and educate the next generation of leaders. but instead you have to spend all of your time going to these woke indoctrination seminars. if johnny comes to school wanting to be judy you have to indulge johnny and his delusions you cannot tell the parents. and oh, by the weight you need to apply equity grading which means you cannot give somebody too high the score that's going to make someone else feel bad and discipline is off the table two. you do not want to discipline somebody at a different rate than anyone else that may have disparities that will look bad on the school. being a teacher is a tough place to be right now. >> had would make it better? usa today quoted a state education professor that says there's nearly 170,000 underqualified teachers working in the school systems across the country right now. how do we make it better? >> quite frankly you have to make it more competitive the answers that a school choice. i'm not saying it's a panacea's going to cure all problems in our education system but the more competition that you have, the more choices you afforded parents to send their children to schools that best fit them. not every school is going to be the same but not every child is going to be the same. they're going to have different talents, different skills if we ushered in a new era of school choice i think what you're going to see is a burgeoning new generation that is different skill sets i can really compete in the world. because right now china, taiwan, south korea, finland are lapping us on the field and education. we are going to pay the price generations on the road. jon: with that the greatest country in the world better education system does not rank in the top 10. >> that is right. we have let this life for so long. it really has been since coalbed education has become such a top issue for parents prefer the most part people assume you send your kid child to school they're going to learn the basics. the going to be prepared for college or what is next but that is not what is happening right now. what is happening right now as they are spending so much time on social justice for their setting to help so much time on transgender ideology. that time could be spent on math or science or the arts or history. things that could actually do some good for these children later in life. jon: ian a prior sobering discussion, thank you. >> thanks for having me. jon: still ahead fox report will take you around the globe. do you struggle with occasional nerve aches in your hands or feet?
