counsel to look into the investigation against the president's son, hunter biden. lucas tom lynnson has the latest on this story. >> reporter: it was just a few weeks ago that hunter biden thought he was minutes away from freedom are from any further charges. of course, that that's not what happened. the plea if deal fell apart, and now it could be going to trial, according to federal prosecutors in a filing yesterday. a special counsel has been named. >> mr. weiss has the authority he needs to conduct a thorough investigation and to continue to take the steps he deems appropriate independently are. based only on a facts and the law. >> reporter: that special counsel, david weiss, of course, has been investigating hunter biden for the past five years now and negotiated with -- what many republicans call a, quote, sweetheart plea deal. president biden left the white house yesterday for the beach, he did not take any questions before boarding marine wunsch the president -- one. the president has long maintained his son did nothing wrong and has insisted he never spoke to him about his overseas business dealings. but after that unverified fbi informant document alleging he and hunter both pocketed $5 million each from the that ukrainian energy giant, some speculate until be joe biden also going to trial, perhaps, in addition to his son after that plea deal fell apart. here's john yoo with more on that. >> it almost comes two years too late because as we get more information from the hill, it looks more and more like president joe biden is at least a witness if not more in an ongoing federal investigation. >> reporter: the justice department is not commenting when asked if president biden would also be under investigation, and and for those keeping score at home, griff, this is now the fifth special counsel to be named in the past five years. griff? griff: lucas tomlinson kicking things off for us at the white house. lucas, thanks. molly? molly: the appointment of david weiss as special counsel sparking concern over the prosecutor's ability to remain unbiased during the probe. weiss helped to draft the plea deal that fell apart last month can some criticized as a sweetheart deal. alexandria hoff is live with the latest on this. >> reporter: hi, molly. there have been republicans who have long been against a special counsel being assigned in this fearing it would limit the house's investigative power in the ongoing biden family probe. others like senator chuck grassley have taken more issue with who has received this new title. >> i was one of those that sent a letter saying we should have a special counsel. end offer -- on the other hand, i have some question about weiss doing it. >> reporter: grassley said that's because misconduct in the long-up running investigation was allegedly irs whistleblowers. former agent gary shapley testified that attorney david weiss previously sought special counsel status because he felt limited in his powers to fully investigate hunter biden. weiss and attorney general merrick garland disputed the claim. a spokesman for jim jordan stated we will continue to raise facts as well as weiss' inconsistent statements to congress. committee member, congressman mike johnson, weighed in. >>'re all scratching our heads here. they're not hiding the wall anymore. we have good reason not to trust mr. weiss with. remember that over the course of about five weeks this summer, he changed his story three different times. >> reporter: u.s. attorney weiss requested special counsel status this week despite previously stating he did not need it, and to gary shapley that sounds like vindication. >> this announcement yesterday is absolute, unquestionable vindication of special agent eegler and i coming forward, because this is the crux of the issue we brought forward to the house ways and means and oversight committees. >> reporter: critics also argue appointing a sitting u.s. attorney goes against doj regulation which states that a special counsel should come from outside of the justice department. molly? molly: much more on that ahead. alexandria hoff, thank you. griff: and for reaction to garland's appointment of special counsel david weiss, we are joined by democratic congressman from california, tammy bear are a -- ami bera. you heard in alexandria's report that irs whistleblower, one of two, gary shapley saying this is vindication now of the appointment. what is your reaction? >> yeah, i think it's just the judicial process taking place, you know? i don't think this is good for the country, investigation of hunter biden, but let the legal process take place. if there was wrongdoing, let's see what happens. if it takes a special counsel -- griff: and what do you -- oh, go ahead. sorry. >> if it takes special counsel, i think that's what the attorney general's doing right now. griff: what is your reaction to your colleagues on the other side of the aisle that are so critical of the appointment of david weiss because they say it, on the one hand, this investigation by weiss should have already brought more charges, gone further, and so now to appoint him is simply a political decision and not one to put someone in there who will be a fresh set of eyes, unbiased to go wherever this investigation takes us? >> you know, i don't know special counsel weiss. i'm going to assume as a u.s. attorney he's going to follow the letter of the law, follow the facts to where they lead, you know? if attorney general garland thinks a different special counsel would be more appropriate, again, that's up to them. i think we should just met this play out and met the legal process take its course. griff: the attorney general did not specify whether or not the scope of this special counsel investigation would include president joe biden as it relates to any of this influence peddling. do you believe that it should include the current president as well? enter yeah, i think this has been -- >> yeah, i think this has been an investigation that's gone on for five years. this is never been any evidence that president biden did anything illegal or unduly used his influence. so again i would just let the legal process play out, but i don't think any of us are concerned that president biden did anything wrong. griff: and, obviously, we are on two tracks. we see former president trump back in court this week with a sort of nuanced decision about what he can and and cannot share in the discovery process of the case as it relates to the alleged efforts to overturn the 2020 election results which, of course, the third indictment of the former president. what do you say to those they say there's two systems of justice, two tiers of justice? one that produced the so-called sweetheart deal for hunter biden, the other that has now brought a total of 78 criminal charges against a former president is? >> i mean, my hope would be that former president trump would be able to work out a plea deal with the special counsel, with the attorney general. i don't think it's good for the country to see a former president on trial or, you know, a president's son on trial. i just would hope that there's a way to resolve these without putting the country through any one of these cases. griff: that's an interesting point. do you believe then, congressman, that they should try to avoid having trials before next november's election in -- election? >> i would hope there's a deal to be cut. again, it doesn't heal this country to have constant investigations with form ther presidents, family members -- former presidents, family members, etc. so i do think the attorney general tried to do everything, at least certainly in the classified document case, to try to get that resolved and, you know, again, i'm not in former president trump's head, so i'm not sure why there wasn't full cooperation. but, again, i would hope there's a way to resolve this without i putting the country through the, you know, what again would be really divisive for us. griff: well, it seems that there are possibly going to be trials before then. we'll have to see where it goes. as always, congressman bera, thank you for coming on and giving us your insight. >> thanks unfor having me on. griff: molly? molly: and from the other side of the aisle we are joined by republican congressman from pennsylvania dan meuser. thank you so much for giving us a little bit of your time on this saturday afternoon. another very interesting week in washington. we just heard from your colleague on the other side of the aisle, congressman bera, saying that this is just the judicial process taking place. gary shapley, the irs whistleblower, calling this vindication. but here we are, we're looking at the same prosecutor who took roughly five years to get to minor charges in this now-defunct plea deal, gone now. tuesday of this week he goes, mr. weiss goes and asks a.g. merrick garland to appoint him special counsel. your thoughts on that and why now? >> thanks, molly. great being with you. weiss has already shown his hand. he created this plea deal which you never -- everyone in the legal system will tell you, you do not seek the lower conviction, a misdemeanor, when a felony is what should be brought to the courts. and he also engaged in passing by the statute of limitations for the felony over that 5-year period. he denied access to subpoenas along the way, he gave updates to attorneys, he has shown his hand to really just be on same team as team hunter and team joe. so, look, the evidence here is unbelievable, and i agreed with what much of representative bera rah said, let's let the legal process come out. but for them to continue to deny that there is a tremendous, a mountain of circumstantial evidence and, by the way, anyone in the legal community will tell you most convictions result from circumstantial evidence. i can go through it from the the laptop to the phone calls, to joe saying, hey, son, you're in the clear, to the 20 plus phone calls. you know, if this were a murder if case, let's say, wouldn't joe be looked at as an acome police -- accomplice as opposed to say there's no connection whatsoever? 20 the bank account, $18 million, all kinds of money going to his grandchildren and him. you know, when you call it a crime family, you know, that kind of fits. molly: you know, well, when this happened, when the special counsel and and that announcement was made, it started new, like a departure point there this years-long path of investigation. but weiss is the guy that's been on the job already, he's had five years. here's senator lindsey graham, also your side of the aisle. >> well, i think they're trying to make it harder, but this was a political decision not a legal decision can. they're trying to put out a fire, and they just poured gasoline on it. nobody in their right mind believes that making him a special counsel, mr. weiss, cleans up the mess that's been created. molly: your thoughts on that. do you think there's going to be an image problem when all of this work is done when weiss is supposed to give garland a report as we've seen in other similar cases if? >> molly, terribly, terribly. and if there was any attempt at the truth here, he wouldn't be the special prosecutor. there'd be an independent. you know, my constituents are shaking their heads in disgust as is most of americans who have some knowledge of the potential crimes and all this money and the type of people that they've been, that hunter's been extorting. and that's a fair word, getting payoffs, stating my father is sitting next to me. all -- these are international crimes and misdemeanors and bribes that, look, if hunter's guilty, joe's guilty because of the level of eyewitnesses and other accounts and voice e-mails and bank records. voicemails. when you have a guy like weiss who's a democrat, right? by the way, these are all democrats working against for, to desperately keep biden away from his son at this point. not even trying to the protect hunter who was more a bagman and at the same time doing everything to put, to hurt president trump's campaign. molly: before we run out of time. on that issue prosecutors specifically in the january 6th case against the former president have said they want to set a trial date for january 2nd. now, the iowa caucuses are slated to be january 15th. so your thoughts. >> well, the timing on this is not coincidental, right? every time archer, for instance, comes in and says, oh, yeah, we talked to joe with 20 plus times on business, the following day there was another frivolous indictment. the timing on this -- the he almost has stated if you listen to jack smith's statements, he's stated he wants this for political purposes. he, you know, the truth does come out at times x that's what's being done here. speedy trial to, because the number one goal here, a, is to keep joe and hunter out of jail, but also to destroy to the best of their ability the campaign of donald trump who's going to be their opponent. that's crazy. that's not america. molly: congressman dan meuser, thank you so much for giving us your insights. >> thanks so much. appreciate you. molly: griff? griff: a ravaging fire has devastated lahaina, a historic town on the maui island with 80 now confirmed dead as uncertainty looms about hundreds of people still unaccounted for. max gorden is live from maui with us now. hi, max. what's the latest? >> reporter: hey, good morning. well, right now we're standing next to one of two main entry points into the town of lahaina. we're several miles away, but people here have been waiting in their cars ever since, some of them, 9 p.m. last night, waiting for the curfew to lift this morning. that curfew has now lifted, some people now getting in to see the devastation for themselves. those who are in la high that that we've spoken to -- la hine ma say they are shocked. take a listen. >> it's kind of sad to see everybody going without things. we want to help as much as we can, but we have just as much as everybody else. and it sucks, because we can't do nothing about it. >> our streets are gone. the whole town is gone. our life is gone. >> reporter: home after home in la hine that, gone. one estimate from the property data aggregator core logic puts the is estimate of destroyed homes at more than 3,000. the rising death toll at 80 people as rescue crews search for more victims. thousands of people have now left the island, and around 1400 are currently staying at emergency shelters here. it's still unclear how these fires started, but when they did ignite, the island was ripe for an inferno. dry conditions and 70- 80 # mile-per-hour winds fueled the flames and created a challenging battle for the island's firefighters. residents say they were given little warning of the approaching blaze and that the island's emergency sirens didn't go off with texts being sent out instead. many escaping with just their lives, some jumping into the water to save themselves as the town was razedded by fire. the governor just announcing a new relief program to rehouse the thousands who have now no home to go back to. >> this means we will be able to get people into hotel rooms, airbnbs and so on so that they are safe. look out for your neighbors, love them. that that's what we will be defined by in the future, how we take care of our ohana. >> reporter: power and cell service is just starting to return to some parts of west maui, but now another challenge for people who live here on the island, drinking water. unavailable in some areas, and the water that comes from the taps now tainted by these wildfires. back to you. griff: max, let me just follow up, because i can see the cars behind you in line. >> reporter: yeah. griff: early in the morning there in la hine that. are you also seeing first responders and others going in to try and help this community? >> reporter: yeah. we've been seeing national guard members, a lot of police officers going in, firefighters. we were in lahaina yesterday seeing the recovery operations. it's still a relatively active seen in some areas, firefighters still trying to to douse hot spots. they have most of the downtown area still closed off as they continue to recover bodies. griff: max gorden live for us in maui, we'll check back in with you as news develops. >> reporter: thank you. molly: for more on the fall ponce to the devastation in hawaii, we are joined by director for operations division in fema's response directorate, jeremy greenberg. thank you, sir, for giving us a couple minutes of your time. i know you must be very busy there on the ground. what is the most important thing, the most important work that you're doing right now for the people there? >> good afternoon and thank you for having me on. the most important operation right now is insuring the safety of all the people that are in hawaii that are impacted by these tragic fires. fema administrator, the sba administrator, u.s. fire administerrer and over 150 personnel are on the ground with more coming in to support the state and insure they have everything during these difficult times. molly: the devastation is just unbheeivel, these pictures so remarkable, and i think incredibly sadly, there are still over a thousand people missing. how can people work towards finding those loved ones? >> the most important guidance for those who have been impacted is to immediately register with the state of hawaii and also with fema and the american red cross. they can register with fema using our 1-8000-621-3363 or disaster assistance.gov. or if they have cell service, they can download our mobile app and using the american red cross number of 844-782-9441, we'll immediately start a process to help them identify any resources that they need as well as reunification with loved ones. molly: max gorden there reporting on the ground showed us this long line of cars, people waiting to get back to their homes to view the devastation. some 3,000 homes at least have been destroyed. what is happening there on the ground to even bin to work towards rebuilding as they continue to still battle hot spots in areas? >> over the past several years through our pacific area office, fema works with the tate of hawaii for these -- state of hawaii for these types of incidents. we've deployed federal interagency partners and fema resources for search and rescue, health and medical capability, the environmental protection agency to insure safety, and as you indicated, the search and rescue operations are still ongoing. survivor, security and safety is their number one priority and then working toward supporting the state into those recovery operations starting with restoration of critical infrastructure so people can get back to the homes that were still inhabitable and then move on to their recovery. molly: you know, fema is often the heart of something when there's a big disaster like this. it does a lot of the coordination. we know that our u.s. military in hawaii, this is a big military family there. how is that coordination happening? live in la joya, texas, with more. heying, bill. >> reporter: hey, griff. as you are very well aware, it's the cartels that run the show down here. they are the ones who decide who does or does not cross our border illegally. this video is a reflection of that. take a look at these images courtesy of a texas dps drone showing suspected cartel members armed with machetes threatening and extorting migrants essentially telling them you better pay us, you'll see one of the migrants get smacked in the back back with a machete. you'll see a bigger group of migrants goes running in all directions as these suspected cartel members approach them and start threatening them. some of the migrants ended up telling texas dps, yeah, these guys were threatening us, but once we paid them, they let us cocross. we often see these people down here with cartel wristbands indicating they have paid a cartel off in thousands of dollars to cross. it has been very busy out here in the rgv. three in the morning in texas, a group of several hundred migrants we witnessed all at once. a lot of family units, a lot of kids with their participants with their kids and toddlers. a lot of babies as well, new born infants, you could hear a lot of crying. border patrol sources telling me a lot of these family units, the majority of them, are being released after they are taken into custody. these familieses know that, that is why they are turning themselves in to border patrol and are not fearing deportation. lastly, we'll take you do brownsville. earlier this week a mass of several hundred migrants apparently trying to rush a port of entry, this was the gateway international bridge after false rumors spread if amongst the migrants that the border was going to be open to asylum seekers. cbp deployed personnel, ultimately nobody ended up getting through. that rush was repelled. and back out here live, very busy, the rgv sector is back to being number one in terms of illegal crossings. border patrol sources telling me yesterday alone there were more than 1,500 illegal crossings, and that does not include any of the known or unknown gotaways. send it back to you. griff: numbers republican caucus early next year. alexis mcadams is this on the ground. she's in des moines, iowa, with the latest. alexis, to you. >> reporter: hi, molly. yeah, it's it's been a buzzy day here at the iowa tate fair. we've seen lots of hopefuls moving through, most notably the two front-runners, florida governor ron desantis and also former president of the united states donald trump, or both here on the ground and really trying to get voters' attention which is going to be a faceoff here if those two run into each other because they've had hecklers at both of their events either on their side or against them. it's been an interesting day at the fair and definitely one of the busiest. we did catch up with the9 florida governor. take a listen to what he had to say. >> well, i think what we're hearing the people understand that our country's in decline, and we need to reverse this decline and revive what's great about america. we need an economy where middle class families have a chance to get ahead again. we need a secure southern border. we can't let let the drug cartels keep eating our lunch. we need to insure that we rein in this out of control federal bure rock to city and end the -- bureaucracy and end the weaponization of federal power, and we need to restore our military to its proper place. >> reporter: so take a look here, florida governor desantis walking around at the iowa state fair. his team confirms to us this afternoon that he's bringing a gaggle, molly, of iowa legislators with him to the fair today after trump announced on wednesday that he was showing up with nine florida republican members of congress who endorsed him over desantis this his home state. so both here on the same day, those front-runners competing for voters' attention. vivek ramaswamy and nikki haley also walked around taking pictures, shaking hands. that's what it's all about. also talking to the iowa governor trying to show off their personalities and explaining what they would do for america. the two front-runners, as we mentioned, are working hard to get that attention. back out here live, we're going to the try and catch up with the florida governor but he is mobbed with not only voters, but media. we're also hoping we can get a little bit closer to former president trump when he is in the area. molly, back to you. molly: alexis mcadams, great work out there on the campaign trail. you've got pork chops, butter and everything else to keep you going, but we appreciating your work. griff: great reporting, alexis. we're joined now by ceo of disrupter or capital and ron desantis the surrogate pete snyder and strategy group co-ceo and vivek ramaswamy surrogate, ben yoho. you guys have been there many times before, that iowa state fair is really the kickoff of the political season. i've seen the butter cow many times, i've eaten pork chops on a stick. now you have all the candidates out there. but one thing that stood out to me was that the former president, trump, not meeting with governor reynolds, not doing that fair-side chat that both vivek and desantis have done earlier today. some just hours ago. you had one of the leaders in the iowa, bob vander platts, he's a kingmaker out there, talking about, you know, despite how far ahead donald trump may be, there may be an opening for one of the other candidates like desantis or ramaswamy. here is a little bit, listener here. listen here. >> obviously, supporters for the former president, donald trump, there's also a lot of them kicking the tires on who could be the alternative to trump. and so there from desantis to ramaswamy, to nikki haley, mike pence, tim scott, the race is wide open right now. griff: pete, what do you say, what is the case ron desantis makes that a changes mindsesome. >> sure. i think ron desantis is doing beautifully in iowa right now. no one has a better ground game, he has 120 county cochairs, there are only 99 counties in iowa. he just had talk maker steve days endorse him the other day. you know iowa, griff, you've got to put in the work, and right now the person putting in the most work is ron desantis, and that's why he's going to win come january. griff: now, one thing ron desantis has not yet proved he can do, and that is to rap pretty solidly to eminem's "lose yourself." this was literally just a few hours ago when ve celeb ramaswamy took the stage with governor reynolds, if we can bring that up. just sort of impromptu, vivek -- ♪ opens his mouth but the words won't come out. ♪ he's choking now, everybody's joking now. ♪ time's up -- snap back to reality -- griff: impromptu and i nosed on the pool feed -- noticed that a guy in a trump jersey was cheering and rooting him on. ben, what's the case that vivek makes to change minds and get ahead of the two front-runners? >> i think vivek, once again, shows that he's clearly an outsider, not a career politician. we have been floored with the bottom-up grassroots movement that we have seen since vivek got in this campaign back in february if. and if you look at the crowd sizes alone in iowa is have quadrupled in size as other candidates see, you know, see smaller crowd sizes and struggle to have their message resonate. his, you know, his message of uniting this country and bringing people back together, putting faith back into the conversation, american pride, american excellence, her tock a rah city, it's resonating with the grassroots, and we're seeing that pay dividends. griff: i've run out of time, but just to give each of you ten seconds each, will it matter that former president trump does not have plans to meet with or really working hand in hand with iowa's governor, rich reynolds? pete? >> i don't know why. you have a campaign focused on the future, you're not embracing the very popular conservative governor of iowa who's gotten a lot done. it just makes no sense to me what so far, and i'm also begging governor desantis not to rap at all. please don't do it, don't try to do it. [laughter] the guy who sings the rich men north of richmond and maybe hum along with that -- griff: ben, the last ten seconds. >> yeah. we're not running away from something, we're running towards something. and vivek is focused on introducing himself to the american people, speaking hard truths and uniting our country. griff: pete, ben, great stuff, and we will be continuing as this campaign gets underway. thanks, guys. >> thanks, griff. molly: as part of our families in focus serious, harris faulkner is speaking with the families of the gop presidential candidates, and this week she sat down with vivek ramaswamy's wife. [laughter] >> reporter: the ramaswamys met at a party in graduate school. she was studying medicine, and he was studying law. >> i don't even remember what he was talking about, but he just has this energy, and i went up to him and, you know, actually i have to tell you the truth, harris, that conversation did not go very well because the first thing i said to him was i just met another vivek. >> reporter: no! [laughter] were you serious? she wasn't kidding. u vivek walked away. >> we saw each other later, and this time we realized that we had so much in common. we've been together ever since. >> reporter: wow. >> before we were engaged i told my mom i'd met someone, and i'm pretty sure he's going to change the world. >> reporter: married eight years with two children, 3 -year-old and -- a 3-year-old and a baby who just turned 1. >> oh, there you go. >> reporter: oh, my goodness. where did you grow up? >> reporter: hi. well, listen to this, griff. sam bankman-fried's attorney told federal judge louis kaplan that he was going to appeal the revocation, and the judge told him he wasn't going to sit around and wait for a decision and sent sbf to jail. this all happened on friday after prosecutors laid out multiple examples of sbf violating terms of his bond including attempting to contact witnesses who have pled guilty and are working with the government. in one instance, accused of providing writings by his ex-girlfriend who cut a deal with the feds to the new york times in an attempt to discredit her. in december the 31-year-old ftx founder pleaded not guilty to stealing billions of dollars from customer funds to cover losses as his hedge fund, alameda research, and until yesterday sbf was allowed to live with his parents in california under house arrest and a $250,000 bond. here's an associated press reporter who was in the courthouse. >> he was under strict decisions that the judge said he repeatedly violated, and he said he'd had it, the that not only had he concluded that he tamperedded with these two witnesses, but the judge said it was quite possible he's tampered with other witnesses that we end don't yet know about. >> reporter: sbf's attorneys argue the prosecution is misrepresenting their client's intentions when he shared information with the times. observers said bankman-fried's mother who was in court attempted to approach her son after the ruling but was turned away by authorities. and, griff, the judge has placed a gag order on this case, so we're not hearing much from either side in terms of members of the media. trial is set for august 2nd. october 2nd, sorry. october. griff: sbf behind bars for now. alicia acuna, thank you very much. molly: recently released body cam shows witnesses explaining to deputies what happened when a child fell from a roller coaster in orlando and sustained very severe injuries. matt finn has all of this for us. matt, to you. >> reporter: molly, if you've ever been on a roller coaster, sometimes your mind just wanders to all the things that can go wrong, and unfortunately we have this new video and 9 # 11 audio after a 6-year-old boy fell an estimated 15-30 feet off a roller coaster. >> he's bleeding from his lips, on his top left corner of his head. it's very swollen, and i believe something with his hip, but i'm not too sure. >> reporter: that 911 call from last week described the boy's injuries after he was thrown from a fun spot roller coaster in oral to. fire -- in orlando. firefighters found the child suffering, lying on the ground underneath the tracks. he is reportedly back home and recovering in louisiana. in this new police body camera video, two of the witnesses describe the ride as being very jerky and say the small boy might have slipped out of the roller coaster cart. >> it was simply an accident. he double checked, but the seats, he's tiny, and the seats can only go -- there's so little gap. he's a tiny boy. >> reporter: workers told police the roller coaster was operating like a regular day and they weren't sure exactly where the boy fell out of the ride. fun spot america theme parks writes in a statement that the florida department of agriculture inspected the ride and found it to be in normal operating procedure and that the ride was following all safety protocols. molly. molly: wishing that young man a very swift recovery. matt finn, thank you. griff? counsel to look into the investigation against the president's son, hunter biden. lucas tom lynnson has the latest on this story. >> reporter: it was just a few weeks ago that hunter biden thought he was minutes away from freedom are from any further charges. of course, that that's not what happened. the plea if deal fell apart, and now it could be going to trial, according to federal prosecutors in a filing yesterday. a special counsel has been named. >> mr. weiss has the authority he needs to conduct a thorough investigation and to continue to take the steps he deems appropriate independently are. based only on a facts and the law. >> reporter: that special counsel, david weiss, of course, has been investigating hunter biden for the past five years now and negotiated with -- what many republicans call a, quote, sweetheart plea deal. president biden left the white house yesterday for the beach, he did not take any questions before boarding marine wunsch the president -- one. the president has long maintained his son did nothing wrong and has insisted he never spoke to him about his overseas business dealings. but after that unverified fbi informant document alleging he and hunter both pocketed $5 million each from the that ukrainian energy giant, some speculate until be joe biden also going to trial, perhaps, in addition to his son after that plea deal fell apart. here's john yoo with more on that. >> it almost comes two years too late because as we get more information from the hill, it looks more and more like president joe biden is at least a witness if not more in an ongoing federal investigation. >> reporter: the justice department is not commenting when asked if president biden would also be under investigation, and and for those keeping score at home, griff, this is now the fifth special counsel to be named in the past five years. griff? griff: lucas tomlinson kicking things off for us at the white house. lucas, thanks. molly? molly: the appointment of david weiss as special counsel sparking concern over the prosecutor's ability to remain unbiased during the probe. weiss helped to draft the plea deal that fell apart last month can some criticized as a sweetheart deal. alexandria hoff is live with the latest on this. >> reporter: hi, molly. there have been republicans who have long been against a special counsel being assigned in this fearing it would limit the house's investigative power in the ongoing biden family probe. others like senator chuck grassley have taken more issue with who has received this new title. >> i was one of those that sent a letter saying we should have a special counsel. end offer -- on the other hand, i have some question about weiss doing it. >> reporter: grassley said that's because misconduct in the long-up running investigation was allegedly irs whistleblowers. former agent gary shapley testified that attorney david weiss previously sought special counsel status because he felt limited in his powers to fully investigate hunter biden. weiss and attorney general merrick garland disputed the claim. a spokesman for jim jordan stated we will continue to raise facts as well as weiss' inconsistent statements to congress. committee member, congressman mike johnson, weighed in. >>'re all scratching our heads here. they're not hiding the wall anymore. we have good reason not to trust mr. weiss with. remember that over the course of about five weeks this summer, he changed his story three different times. >> reporter: u.s. attorney weiss requested special counsel status this week despite previously stating he did not need it, and to gary shapley that sounds like vindication. >> this announcement yesterday is absolute, unquestionable vindication of special agent eegler and i coming forward, because this is the crux of the issue we brought forward to the house ways and means and oversight committees. >> reporter: critics also argue appointing a sitting u.s. attorney goes against doj regulation which states that a special counsel should come from outside of the justice department. molly? molly: much more on that ahead. alexandria hoff, thank you. griff: and for reaction to garland's appointment of special counsel david weiss, we are joined by democratic congressman from california, tammy bear are a -- ami bera. you heard in alexandria's report that irs whistleblower, one of two, gary shapley saying this is vindication now of the appointment. what is your reaction? >> yeah, i think it's just the judicial process taking place, you know? i don't think this is good for the country, investigation of hunter biden, but let the legal process take place. if there was wrongdoing, let's see what happens. if it takes a special counsel -- griff: and what do you -- oh, go ahead. sorry. >> if it takes special counsel, i think that's what the attorney general's doing right now. griff: what is your reaction to your colleagues on the other side of the aisle that are so critical of the appointment of david weiss because they say it, on the one hand, this investigation by weiss should have already brought more charges, gone further, and so now to appoint him is simply a political decision and not one to put someone in there who will be a fresh set of eyes, unbiased to go wherever this investigation takes us? >> you know, i don't know special counsel weiss. i'm going to assume as a u.s. attorney he's going to follow the letter of the law, follow the facts to where they lead, you know? if attorney general garland thinks a different special counsel would be more appropriate, again, that's up to them. i think we should just met this play out and met the legal process take its course. griff: the attorney general did not specify whether or not the scope of this special counsel investigation would include president joe biden as it relates to any of this influence peddling. do you believe that it should include the current president as well? enter yeah, i think this has been -- >> yeah, i think this has been an investigation that's gone on for five years. this is never been any evidence that president biden did anything illegal or unduly used his influence. so again i would just let the legal process play out, but i don't think any of us are concerned that president biden did anything wrong. griff: and, obviously, we are on two tracks. we see former president trump back in court this week with a sort of nuanced decision about what he can and and cannot share in the discovery process of the case as it relates to the alleged efforts to overturn the 2020 election results which, of course, the third indictment of the former president. what do you say to those they say there's two systems of justice, two tiers of justice? one that produced the so-called sweetheart deal for hunter biden, the other that has now brought a total of 78 criminal charges against a former president is? >> i mean, my hope would be that former president trump would be able to work out a plea deal with the special counsel, with the attorney general. i don't think it's good for the country to see a former president on trial or, you know, a president's son on trial. i just would hope that there's a way to resolve these without putting the country through any one of these cases. griff: that's an interesting point. do you believe then, congressman, that they should try to avoid having trials before next november's election in -- election? >> i would hope there's a deal to be cut. again, it doesn't heal this country to have constant investigations with form ther presidents, family members -- former presidents, family members, etc. so i do think the attorney general tried to do everything, at least certainly in the classified document case, to try to get that resolved and, you know, again, i'm not in former president trump's head, so i'm not sure why there wasn't full cooperation. but, again, i would hope there's a way to resolve this without i putting the country through the, you know, what again would be really divisive for us. griff: well, it seems that there are possibly going to be trials before then. we'll have to see where it goes. as always, congressman bera, thank you for coming on and giving us your insight. >> thanks unfor having me on. griff: molly? molly: and from the other side of the aisle we are joined by republican congressman from pennsylvania dan meuser. thank you so much for giving us a little bit of your time on this saturday afternoon. another very interesting week in washington. we just heard from your colleague on the other side of the aisle, congressman bera, saying that this is just the judicial process taking place. gary shapley, the irs whistleblower, calling this vindication. but here we are, we're looking at the same prosecutor who took roughly five years to get to minor charges in this now-defunct plea deal, gone now. tuesday of this week he goes, mr. weiss goes and asks a.g. merrick garland to appoint him special counsel. your thoughts on that and why now? >> thanks, molly. great being with you. weiss has already shown his hand. he created this plea deal which you never -- everyone in the legal system will tell you, you do not seek the lower conviction, a misdemeanor, when a felony is what should be brought to the courts. and he also engaged in passing by the statute of limitations for the felony over that 5-year period. he denied access to subpoenas along the way, he gave updates to attorneys, he has shown his hand to really just be on same team as team hunter and team joe. so, look, the evidence here is unbelievable, and i agreed with what much of representative bera rah said, let's let the legal process come out. but for them to continue to deny that there is a tremendous, a mountain of circumstantial evidence and, by the way, anyone in the legal community will tell you most convictions result from circumstantial evidence. i can go through it from the the laptop to the phone calls, to joe saying, hey, son, you're in the clear, to the 20 plus phone calls. you know, if this were a murder if case, let's say, wouldn't joe be looked at as an acome police -- accomplice as opposed to say there's no connection whatsoever? 20 the bank account, $18 million, all kinds of money going to his grandchildren and him. you know, when you call it a crime family, you know, that kind of fits. molly: you know, well, when this happened, when the special counsel and and that announcement was made, it started new, like a departure point there this years-long path of investigation. but weiss is the guy that's been on the job already, he's had five years. here's senator lindsey graham, also your side of the aisle. >> well, i think they're trying to make it harder, but this was a political decision not a legal decision can. they're trying to put out a fire, and they just poured gasoline on it. nobody in their right mind believes that making him a special counsel, mr. weiss, cleans up the mess that's been created. molly: your thoughts on that. do you think there's going to be an image problem when all of this work is done when weiss is supposed to give garland a report as we've seen in other similar cases if? >> molly, terribly, terribly. and if there was any attempt at the truth here, he wouldn't be the special prosecutor. there'd be an independent. you know, my constituents are shaking their heads in disgust as is most of americans who have some knowledge of the potential crimes and all this money and the type of people that they've been, that hunter's been extorting. and that's a fair word, getting payoffs, stating my father is sitting next to me. all -- these are international crimes and misdemeanors and bribes that, look, if hunter's guilty, joe's guilty because of the level of eyewitnesses and other accounts and voice e-mails and bank records. voicemails. when you have a guy like weiss who's a democrat, right? by the way, these are all democrats working against for, to desperately keep biden away from his son at this point. not even trying to the protect hunter who was more a bagman and at the same time doing everything to put, to hurt president trump's campaign. molly: before we run out of time. on that issue prosecutors specifically in the january 6th case against the former president have said they want to set a trial date for january 2nd. now, the iowa caucuses are slated to be january 15th. so your thoughts. >> well, the timing on this is not coincidental, right? every time archer, for instance, comes in and says, oh, yeah, we talked to joe with 20 plus times on business, the following day there was another frivolous indictment. the timing on this -- the he almost has stated if you listen to jack smith's statements, he's stated he wants this for political purposes. he, you know, the truth does come out at times x that's what's being done here. speedy trial to, because the number one goal here, a, is to keep joe and hunter out of jail, but also to destroy to the best of their ability the campaign of donald trump who's going to be their opponent. that's crazy. that's not america. molly: congressman dan meuser, thank you so much for giving us your insights. >> thanks so much. appreciate you. molly: griff? griff: a ravaging fire has devastated lahaina, a historic town on the maui island with 80 now confirmed dead as uncertainty looms about hundreds of people still unaccounted for. max gorden is live from maui with us now. hi, max. what's the latest? >> reporter: hey, good morning. well, right now we're standing next to one of two main entry points into the town of lahaina. we're several miles away, but people here have been waiting in their cars ever since, some of them, 9 p.m. last night, waiting for the curfew to lift this morning. that curfew has now lifted, some people now getting in to see the devastation for themselves. those who are in la high that that we've spoken to -- la hine ma say they are shocked. take a listen. >> it's kind of sad to see everybody going without things. we want to help as much as we can, but we have just as much as everybody else. and it sucks, because we can't do nothing about it. >> our streets are gone. the whole town is gone. our life is gone. >> reporter: home after home in la hine that, gone. one estimate from the property data aggregator core logic puts the is estimate of destroyed homes at more than 3,000. the rising death toll at 80 people as rescue crews search for more victims. thousands of people have now left the island, and around 1400 are currently staying at emergency shelters here. it's still unclear how these fires started, but when they did ignite, the island was ripe for an inferno. dry conditions and 70- 80 # mile-per-hour winds fueled the flames and created a challenging battle for the island's firefighters. residents say they were given little warning of the approaching blaze and that the island's emergency sirens didn't go off with texts being sent out instead. many escaping with just their lives, some jumping into the water to save themselves as the town was razedded by fire. the governor just announcing a new relief program to rehouse the thousands who have now no home to go back to. >> this means we will be able to get people into hotel rooms, airbnbs and so on so that they are safe. look out for your neighbors, love them. that that's what we will be defined by in the future, how we take care of our ohana. >> reporter: power and cell service is just starting to return to some parts of west maui, but now another challenge for people who live here on the island, drinking water. unavailable in some areas, and the water that comes from the taps now tainted by these wildfires. back to you. griff: max, let me just follow up, because i can see the cars behind you in line. >> reporter: yeah. griff: early in the morning there in la hine that. are you also seeing first responders and others going in to try and help this community? >> reporter: yeah. we've been seeing national guard members, a lot of police officers going in, firefighters. we were in lahaina yesterday seeing the recovery operations. it's still a relatively active seen in some areas, firefighters still trying to to douse hot spots. they have most of the downtown area still closed off as they continue to recover bodies. griff: max gorden live for us in maui, we'll check back in with you as news develops. >> reporter: thank you. molly: for more on the fall ponce to the devastation in hawaii, we are joined by director for operations division in fema's response directorate, jeremy greenberg. thank you, sir, for giving us a couple minutes of your time. i know you must be very busy there on the ground. what is the most important thing, the most important work that you're doing right now for the people there? >> good afternoon and thank you for having me on. the most important operation right now is insuring the safety of all the people that are in hawaii that are impacted by these tragic fires. fema administrator, the sba administrator, u.s. fire administerrer and over 150 personnel are on the ground with more coming in to support the state and insure they have everything during these difficult times. molly: the devastation is just unbheeivel, these pictures so remarkable, and i think incredibly sadly, there are still over a thousand people missing. how can people work towards finding those loved ones? >> the most important guidance for those who have been impacted is to immediately register with the state of hawaii and also with fema and the american red cross. they can register with fema using our 1-8000-621-3363 or disaster assistance.gov. or if they have cell service, they can download our mobile app and using the american red cross number of 844-782-9441, we'll immediately start a process to help them identify any resources that they need as well as reunification with loved ones. molly: max gorden there reporting on the ground showed us this long line of cars, people waiting to get back to their homes to view the devastation. some 3,000 homes at least have been destroyed. what is happening there on the ground to even bin to work towards rebuilding as they continue to still battle hot spots in areas? >> over the past several years through our pacific area office, fema works with the tate of hawaii for these -- state of hawaii for these types of incidents. we've deployed federal interagency partners and fema resources for search and rescue, health and medical capability, the environmental protection agency to insure safety, and as you indicated, the search and rescue operations are still ongoing. survivor, security and safety is their number one priority and then working toward supporting the state into those recovery operations starting with restoration of critical infrastructure so people can get back to the homes that were still inhabitable and then move on to their recovery. molly: you know, fema is often the heart of something when there's a big disaster like this. it does a lot of the coordination. we know that our u.s. military in hawaii, this is a big military family there. how is that coordination happening? live in la joya, texas, with more. heying, bill. >> reporter: hey, griff. as you are very well aware, it's the cartels that run the show down here. they are the ones who decide who does or does not cross our border illegally. this video is a reflection of that. take a look at these images courtesy of a texas dps drone showing suspected cartel members armed with machetes threatening and extorting migrants essentially telling them you better pay us, you'll see one of the migrants get smacked in the back back with a machete. you'll see a bigger group of migrants goes running in all directions as these suspected cartel members approach them and start threatening them. some of the migrants ended up telling texas dps, yeah, these guys were threatening us, but once we paid them, they let us cocross. we often see these people down here with cartel wristbands indicating they have paid a cartel off in thousands of dollars to cross. it has been very busy out here in the rgv. three in the morning in texas, a group of several hundred migrants we witnessed all at once. a lot of family units, a lot of kids with their participants with their kids and toddlers. a lot of babies as well, new born infants, you could hear a lot of crying. border patrol sources telling me a lot of these family units, the majority of them, are being released after they are taken into custody. these familieses know that, that is why they are turning themselves in to border patrol and are not fearing deportation. lastly, we'll take you do brownsville. earlier this week a mass of several hundred migrants apparently trying to rush a port of entry, this was the gateway international bridge after false rumors spread if amongst the migrants that the border was going to be open to asylum seekers. cbp deployed personnel, ultimately nobody ended up getting through. that rush was repelled. and back out here live, very busy, the rgv sector is back to being number one in terms of illegal crossings. border patrol sources telling me yesterday alone there were more than 1,500 illegal crossings, and that does not include any of the known or unknown gotaways. send it back to you. griff: numbers republican caucus early next year. alexis mcadams is this on the ground. she's in des moines, iowa, with the latest. alexis, to you. >> reporter: hi, molly. yeah, it's it's been a buzzy day here at the iowa tate fair. we've seen lots of hopefuls moving through, most notably the two front-runners, florida governor ron desantis and also former president of the united states donald trump, or both here on the ground and really trying to get voters' attention which is going to be a faceoff here if those two run into each other because they've had hecklers at both of their events either on their side or against them. it's been an interesting day at the fair and definitely one of the busiest. we did catch up with the9 florida governor. take a listen to what he had to say. >> well, i think what we're hearing the people understand that our country's in decline, and we need to reverse this decline and revive what's great about america. we need an economy where middle class families have a chance to get ahead again. we need a secure southern border. we can't let let the drug cartels keep eating our lunch. we need to insure that we rein in this out of control federal bure rock to city and end the -- bureaucracy and end the weaponization of federal power, and we need to restore our military to its proper place. >> reporter: so take a look here, florida governor desantis walking around at the iowa state fair. his team confirms to us this afternoon that he's bringing a gaggle, molly, of iowa legislators with him to the fair today after trump announced on wednesday that he was showing up with nine florida republican members of congress who endorsed him over desantis this his home state. so both here on the same day, those front-runners competing for voters' attention. vivek ramaswamy and nikki haley also walked around taking pictures, shaking hands. that's what it's all about. also talking to the iowa governor trying to show off their personalities and explaining what they would do for america. the two front-runners, as we mentioned, are working hard to get that attention. back out here live, we're going to the try and catch up with the florida governor but he is mobbed with not only voters, but media. we're also hoping we can get a little bit closer to former president trump when he is in the area. molly, back to you. molly: alexis mcadams, great work out there on the campaign trail. you've got pork chops, butter and everything else to keep you going, but we appreciating your work. griff: great reporting, alexis. we're joined now by ceo of disrupter or capital and ron desantis the surrogate pete snyder and strategy group co-ceo and vivek ramaswamy surrogate, ben yoho. you guys have been there many times before, that iowa state fair is really the kickoff of the political season. i've seen the butter cow many times, i've eaten pork chops on a stick. now you have all the candidates out there. but one thing that stood out to me was that the former president, trump, not meeting with governor reynolds, not doing that fair-side chat that both vivek and desantis have done earlier today. some just hours ago. you had one of the leaders in the iowa, bob vander platts, he's a kingmaker out there, talking about, you know, despite how far ahead donald trump may be, there may be an opening for one of the other candidates like desantis or ramaswamy. here is a little bit, listener here. listen here. >> obviously, supporters for the former president, donald trump, there's also a lot of them kicking the tires on who could be the alternative to trump. and so there from desantis to ramaswamy, to nikki haley, mike pence, tim scott, the race is wide open right now. griff: pete, what do you say, what is the case ron desantis makes that a changes mindsesome. >> sure. i think ron desantis is doing beautifully in iowa right now. no one has a better ground game, he has 120 county cochairs, there are only 99 counties in iowa. he just had talk maker steve days endorse him the other day. you know iowa, griff, you've got to put in the work, and right now the person putting in the most work is ron desantis, and that's why he's going to win come january. griff: now, one thing ron desantis has not yet proved he can do, and that is to rap pretty solidly to eminem's "lose yourself." this was literally just a few hours ago when ve celeb ramaswamy took the stage with governor reynolds, if we can bring that up. just sort of impromptu, vivek -- ♪ opens his mouth but the words won't come out. ♪ he's choking now, everybody's joking now. ♪ time's up -- snap back to reality -- griff: impromptu and i nosed on the pool feed -- noticed that a guy in a trump jersey was cheering and rooting him on. ben, what's the case that vivek makes to change minds and get ahead of the two front-runners? >> i think vivek, once again, shows that he's clearly an outsider, not a career politician. we have been floored with the bottom-up grassroots movement that we have seen since vivek got in this campaign back in february if. and if you look at the crowd sizes alone in iowa is have quadrupled in size as other candidates see, you know, see smaller crowd sizes and struggle to have their message resonate. his, you know, his message of uniting this country and bringing people back together, putting faith back into the conversation, american pride, american excellence, her tock a rah city, it's resonating with the grassroots, and we're seeing that pay dividends. griff: i've run out of time, but just to give each of you ten seconds each, will it matter that former president trump does not have plans to meet with or really working hand in hand with iowa's governor, rich reynolds? pete? >> i don't know why. you have a campaign focused on the future, you're not embracing the very popular conservative governor of iowa who's gotten a lot done. it just makes no sense to me what so far, and i'm also begging governor desantis not to rap at all. please don't do it, don't try to do it. [laughter] the guy who sings the rich men north of richmond and maybe hum along with that -- griff: ben, the last ten seconds. >> yeah. we're not running away from something, we're running towards something. and vivek is focused on introducing himself to the american people, speaking hard truths and uniting our country. griff: pete, ben, great stuff, and we will be continuing as this campaign gets underway. thanks, guys. >> thanks, griff. molly: as part of our families in focus serious, harris faulkner is speaking with the families of the gop presidential candidates, and this week she sat down with vivek ramaswamy's wife. >> reporter: hi. well, listen to this, griff. sam bankman-fried's attorney told federal judge louis kaplan that he was going to appeal the revocation, and the judge told him he wasn't going to sit around and wait for a decision and sent sbf to jail. this all happened on friday after prosecutors laid out multiple examples of sbf violating terms of his bond including attempting to contact witnesses who have pled guilty and are working with the government. in one instance, accused of providing writings by his ex-girlfriend who cut a deal with the feds to the new york times in an attempt to discredit her. in december the 31-year-old ftx founder pleaded not guilty to stealing billions of dollars from customer funds to cover losses as his hedge fund, alameda research, and until yesterday sbf was allowed to live with his parents in california under house arrest and a $250,000 bond. here's an associated press reporter who was in the courthouse. >> he was under strict decisions that the judge said he repeatedly violated, and he said he'd had it, the that not only had he concluded that he tamperedded with these two witnesses, but the judge said it was quite possible he's tampered with other witnesses that we end don't yet know about. >> reporter: sbf's attorneys argue the prosecution is misrepresenting their client's intentions when he shared information with the times. observers said bankman-fried's mother who was in court attempted to approach her son after the ruling but was turned away by authorities. and, griff, the judge has placed a gag order on this case, so we're not hearing much from either side in terms of members of the media. trial is set for august 2nd. october 2nd, sorry. october. griff: sbf behind bars for now. alicia acuna, thank you very much. molly: recently released body cam shows witnesses explaining to deputies what happened when a child fell from a roller coaster in orlando and sustained very severe injuries. matt finn has all of this for us. matt, to you. >> reporter: molly, if you've ever been on a roller coaster, sometimes your mind just wanders to all the things that can go wrong, and unfortunately we have this new video and 9 # 11 audio after a 6-year-old boy fell an estimated 15-30 feet off a roller coaster. >> he's bleeding from his lips, on his top left corner of his head. it's very swollen, and i believe something with his hip, but i'm not too sure. >> reporter: that 911 call from last week described the boy's injuries after he was thrown from a fun spot roller coaster in oral to. fire -- in orlando. firefighters found the child suffering, lying on the ground underneath the tracks. he is reportedly back home and recovering in louisiana. in this new police body camera video, two of the witnesses describe the ride as being very jerky and say the small boy might have slipped out of the roller coaster cart. >> it was simply an accident. he double checked, but the seats, he's tiny, and the seats can only go -- there's so little gap. he's a tiny boy. >> reporter: workers told police the roller coaster was operating like a regular day and they weren't sure exactly where the boy fell out of the ride. fun spot america theme parks writes in a statement that the florida department of agriculture inspected the ride and found it to be in normal operating procedure and that the ride was following all safety protocols. molly. molly: wishing that young man a very swift recovery. matt finn, thank you. griff?
