that they have gone through, frankly, are continuing to go through. this crisis is far from over. there's so much frustration, there's so much suffering, you know? the real mourning has not even been able to begin to start because of people really looking to how do i just get me and my family to tomorrow. joey: yeah. and even still firefighters are working to pull ily contain some fires burning on the island. officials calling it the worst natural disaster in hawaii's history. to a fox news alert, attorney general merrick garland appointing a special counsel to the hunter biden criminal probe. rachel: but republicans and if even some democrats aren't happy with who he selected. will: alexandria hoff joins us live washington. >> reporter: good morning. it is an interesting turn of events or at least title, right? now special counsel david weiss and the attorney general, they both previously maintained weiss did not need special counsel powers in pursuing charges against hunter biden. of course, the probation-only deal he fosteredded over federal tack charges that has now fallen atart -- apart, and this move shows a trial could be on the horizon. garland gave no reason as to why special counsel the status was needed other than it falls under extraordinary circumstances. here's hunter biden's attorney. >> you have five years, pain painstaking investigation looking at every possible transaction that mr. biden was involved in concluding that the only appropriate charges were two misdemeanors and a diverted gun can charge. what could possibly change after five years in the answer is not the facts, it's not the evidence, it's not the law. [inaudible conversations] >> i'm confident. >> reporter: that was back in 2020. the white house says they were not informed before the special counsel announcement was a made. the president offeredded no response as he depart for delaware yesterday. [inaudible conversations] >> reporter: mr. president, are you urn investigation? >> reporter: house republicans are skeptical that by elevating trump-appointed weiss, the doj is taking investigative power into biden family business dealings out of their hands. >> well, this is another example of the department of justice stonewalling and on instrumenting our -- obstructing our investigation. i've been complaining about this for months. this is an investigation if act joe biden. i don't think we need any more evidence to show the department of justice is trying to obstruct our investigation. i think merrick garland made that argument for us today. >> reporter: critics also argue that urn justice department regulations the special counsel should be selected from outside the u.s. government and that a u.s. attorney should not be the one to take the lead on this. as special counsel, david weiss will be under no deadline to conclude his investigate, it all could stretch well past the 2024 elections. guys? will: thank you, alexandria. rachel: so this is really, like, we've beening talking all morning, it's so blatantly political that it almost is head-scratching, right? like you would try a little harder to make it not look so political. last weekend we had a really big discussion about this, the obama book that came out ott, the biography about barack obama that came out a couple years ago that sort of resurfaced x there's been some recent articles going over this again. and the reason why it's resurfacing is because a lot of people are finally starting to notice that we have kind of a shadow government. they're noting that. and the reason i bring that up in the context of this is, you know, joe biden is clearly faltering. he's on his way out in many ways mentally and in terms of his own power, but he is being proppedded up by really powerful forces. no surprise merrick garland, of course, connected to the obama white house, he was somebody that they want to appoint to the supreme court. he didn't make it in, but there's, there are, there's a lot going on here. there is a reason why very powerful forces want to keep joe biden in place and not have him face the consequences of the corruption. and and it could be, it could have to do with the stuff that's going on in ukraine, it could have to do the with a lot more than that. joey: yeah. i think -- i don't know, merrick garland, to me, comes across as almost looking a little lit like a yes man. it doesn't look like he's pulling big strings, and he doesn't have great criminal over the justice department. rachel: precisely. he's taking order from someone somewhere with. joey: exactly. or allowing his subordinates to kind of go the direction they want to go. it really just comes down to with where you fall and what you think david weiss' intentions are. i guess from garland's perspective, what he's putting out there is david weiss has done it by the book, i have no reason to doubt him, i'm going to give him what he asked for originally which is special counsel designation so there are no more questions about whether or not he is doing what he wants to do as opposed to what he's allowed to do. that really doesn't answer the questions raised by the whistleblowers, because the real questions after whistleblower testimony isn't is david weiss allowed to do what he wants to do, it's why is david weiss saying this is as much as he wanted to do? why is david weiss saying he didn't need to interview this person or go looking for evidence here or charge on these can counts. and so this doesn't answer that question. and so if it is an attempt to kind of squash the criticism, it falls much short. will: former president donald trump said this on truth social, i have a great idea, why don't they use deranged jack smith? wise has been investigating -- weiss has been investigating hunter for four years, but a brilliant judge in delaware saw through it. now i read the department of injustice wants a new judge and jurisdiction but so do i with far stronger reasons than hunter and crooked joe. maga, make america great again. rachel: can you unpack that for me, what he means? why is he saying bring in jack smith -- will: he's being sarcastic. joey: i think he's drawing the contrast between who's going after him and why -- rachel: i got ya. joey: bring in something with the ferocity that smith has come after me on. will: right. the 2024 presidential candidates are on the campaign trail. here's what they had to say. >> on the face of it, one would think that's actually a good step forward. i am deeply skeptical of an administration that has systematically lied and tried to hide the facts from the public that i think in reality this is more likely just a fig leaf to provide air cover. if. >> to be honest with you, i can't relate to what his son was doing when he was vice president. when i was vice president, my son was flying an f-35 in the marine corps defending this country. but i think it's about time that we saw the employment of a special counsel to get to the bottom of what not only hunter biden was doing, but the the family was doing. >> i don't trust it, i don't think the american people trust it. i don't think the american people trust the department of justice or thinking this is going to do. i think this was meant to be a distraction. will: vivek ramaswamy, who you saw in those clips, will be on the show a little bit later at 8:40 a.m. eastern time. meanwhile, to another legal case and investigation going on, this one into president trump. a judge issue a protective order in the case looking into january 6th. the protective order is design to protect evidence related to the case. it is designed to, again, protect, quote-unquote, sensitive materials. here's what the district judge, tanya chutkan, had to say. mr. trump, like every american, has a first amendment to free speech, but that right is not absolute n. a criminal case such as this one, the defendant's free speech is subject to the rules, so thinking trump may say when it comes -- anything trump may say when it comes to this case, not anything and everything, but -- anything and everything will come under her purview for her to look at and say whether or not it is a violation of this this protective order. rachel: here's what president trump add had to say about this first amendment case. >> the case is a ridiculous case. it's a first amendment case. but we don't want trump to speak. so they want me -- they take away your rights on first amendment, now they sue so now i have one of these lunatic reporters back there saying, sir, we'd like to talk to you about your case. or, i'm sorry, i'm not allowed to talk about it. somehow that's not good for votes, do you agree, when we say i can't -- i will talk about it. they're not taking away my first amendment right. [cheers and applause] rachel: it's kind of funny because a lot of politicians like to hide behind i can't talk about it. donald trump's the opposite. he's, like, i want to talk about this. this is an a injustice, and he sees what this judge is doing as election interference. and i think he's right. and, by the way, we should look at this judge a little closely. if you look at some of the statements that she made in sentencing which, by the way, she's sentenced very harshly and went above and beyond what if many people thought was just and fair in the cases of many of the january 6th defendants. she actually in many of these cases said, you know, these people are just too loyal to donald trump, and i can't believe he's still free. and that is the woman who is now in charge of this case. so it's an interesting situation. joey: yeah. if i understand this right, what she basically said is i think prosecutors are asking for, basically, a hush order. like, trump can't talk about in this at all in any way -- will: so as to not intimidate witnesses. joey: exactly. trump's defense come to the judge and says, listen,s this is unique from any other case like it because this guy's running for president, his popularity among people matters. if the justice department put out charges which are not proven, they're charges, not convictions, if they can put out charges that leak or paint a narrative, we should be able to push back on that. rachel: of course. joey: so the judge says you can, but there's certain pieces of evidence the prosecution's can asked for you to not talk about. so you can look at it as a mixed ruling, or you can look at it as her trying to find a way to uphold what might be a legitimate legal request by the prosecution but also provide president trump his ability to push back on some of these charges -- rachel: because it's kind of vague. it's kind of vague, so you kind of don't know when -- joey: you don't know until you do. will: i said last night in a normal situation you would say, yes, a criminal defendant can have their first amendment rights limited. in other words, you can't say whatever you want to say because it could impact a trial, and a criminal trial takes precedent. in a normal situation her order would be expected. and then you would say, again in a normal situation, well, that really reflects on the wisdom of the prosecutor who decides to bring this type of case in the middle of a presidential election. joey: yeah. will: you'd say why would they do the that because it so clearly could interfere in a presidential election. but this isn't normal because it's don frump, is so you don't -- donald trump, so you don't give them the benefit of the doubt that it's a lack of wisdom. it's done with purpose. it is the designed to limit his speech, so it is designed to -- by the prosecution side, by jack smith's side -- to limit a presidential or to affect a presidential election. joey: yeah. will: the judge will have to look piece by piece. the illustration the everybody's using is mike pence. mike pence is a potential witness. mike pence will say things on the campaign trail about january 6th, and according to this order, donald trump can't respond if. he can't say something, for example, in that illustration. now, he will, and it will be interesting to see what the judge does about that, how she attempts to enforce or this protective order. rachel: i think this is actually a really big deal in terms of election interference. and i think we've seen so many cases of election interference going all the way back to russia hoax really, because that affected the election. and then the hunter biden laptop suppression story. all of this stuff, i hope we're not becoming desensitized to all these things that are happening to our country that just aren't normal. joey: it really does add legitimacy to the argument that this entire thing is an attempt to stop president trump from running again. turning now to your headlines, terrifying body cam footage capturing the moments after a florida deputy was exposed to fentanyl. >> i just got really light headed. call ems. >> breathe in. breathe in, breathe in, breathe in, breathe in, breathe in. >> yes, sir. joey: so that means the atlantic ocean side as opposed to where i would go which is the gulf side, is the water much more dangerous on that side, are beach goers that come to to florida for vacation or spring break, is that something to be nearly about or cognizant about? >> it is blatant, rachel, and we're all scratching our heads here. they're not hiding the ball anymore. we have good reason not to trust mr. weiss. now, remember that over the course of about five weeks this summer he changed his story three different times. first he said he had all the power he needed for indictment and everything else he was working on and didn't need special counsel designation. a couple weeks later, to fit merrick garland's narrative, he changed that tune and said, oh, no, no, please do. then he changed the story again, it's back and forth. remember, he's the one that negotiated the sweetheart deal to try to whitewash hunter biden's felony gun charges. s this is someone who's in on it. we see and the american people see that there's a cover-up going on here. merrick garland's department of justice is guilty in this, and appointing mr. weiss does nothing but help fuel that fire. rachel: yeah. i mean, he's proven over many years his loyalty to the biden pa family it's very clear why they've done this. but now the house investigation continues into joe biden, but now with this move in appointing weiss as the special counsel here, does this in any way push more momentum towards impeachment? >> well, listen, rachel, impeachment is a very important and very serious or power of the congress. next to declaring war, i think it's probably the biggest power that we have. and so we end don't wield that for political purposes. remember, we all argued a thousand times during the sham impeachments of donald trump that it should not be used for that purpose. so what you're seeing to the frustration of some of our supporters and people in the base is a slow and methodical building of the evidence. we are performing our constitutional responsibility, but, yes, at some point as speaker mccarthy said before we left for the district work period, an impeachment inquiry is call called for here. it does look that way, and i believe that it is, rachel. rachel: ray yeah. >> if we do that, it gives us enhanced subpoena and discovery pairs. buck move this -- powers, we can move this stuff forward. rachel: really quick, is what happened with this appointment in any way going to thwart your ability to investigate if in order to maybe pursue this impeachment? >> well, we hope not. i mean, there's a potential that it would impede our investigation further, but i will tell you we are fully committed on oversight, judiciary and our special committee on the weaponization of government to move forward in earnest. we have to. we are following the evidence where it leads, and i think we all have a suspicion where that's going to be. rachel: we're very proud of the investigation. it's gone much better than i think people thought. well, it looks like the gop has sent a letter to fbi director christopher wray after reportedly uncovering evidence that multiple fbi field offices coordinated to prepare anti-catholic memo. is so here is senator rick scott writing to fbi director wray. he says the most recent revelations of frequent and repeated abuses of the fbi raise concern for the american people that there are no limits, legal or otherwise, on your investigative power even when it comes to spying on american citizens. the american public's perception of the lack of accountability is dangerous and must be immediately addressed. so so obviously i'm catholic, this is really close to heart for me. our fbi, let's make it very clear, prepared memos that that christopher wray said was only one rogue office k and now we find out there's multiple offices, so it looks systemic. in order to spy on traditional catholics for what, like accusing them of, again, white supremacy which makes no sense at all. so what's going to happen? he's clearly per perjure himself. >> it looks that way. jim jordan and i sent a letter to mr. wray right after his testimony. what happened was on july 12th he appeared before our judiciary committee because we have oversight responsibilities over the fbi, and he told us very clearly and emphatically there was only a single office involve in that infamous if memo that, as you said, rachel, targeted traditional cath will licks as -- catholic as potential violent especially treatmentists and domestic terrorists, it's unbheeivel, just because of our religious beliefs, right? he either per jr. injuredded himself because we know it involves multiple offices or he's lost control of the bureau, and i think either one of those scenarios are alarming, and i think director wray has a real problem, and i think congress has a real problem with him. the next question is what do you do about it. rachel: right. >> we're trying to hold him accountable, and i think he may be one of the cabinet officials who committed impeachable offenses, but we only have so many days on the calendar, and it's a real challenge right now because this entire cabinet, there's so many officials in so many different divisions of the department of justice alone that are committing egregious offenses against the people. the very agencies that are designed to protect and serve the people are now encroaching clearly upon their constitutional rights. every stone we overturn there's a new scandal. it's a real problem. rachel: yeah. sounds like that's the point though, just so many things, overwhelm the system, overwhelm the congressional calendar and their ability to investigate everything, and then they get away with it. this is a serious issue. we're going to continue to follow it. i hope we get lists. who are the people, you know, the catholics on these fbi lists. i wonder if i'm on it. bee need to get to the bottom of these massive implications for anybody of faith. thank you for continuing to investigate. >> thanks, rachel. rachel: all right. thank you, congressman. still ahead, musk versus zuck, elon musk teasing an epic italy location for his upcoming fight with meta ceo zuckerberg. he says you shouldn't trust these plans for the billionaire battle, next. ♪ -- are you ready for this?
