Congressional republicans are already saying weisss new status makes him a Fire Wall Insulating President Biden and his Justice Department and could actually impede congressional efforts to get to the truth. Look into that. Also tonight, the Justice Department has moved to officially dismiss the now defunked plea deal with the president s son. Correspondent dazed spunt has the details from the Justice Department. Good evening, david. Reporter bret, good evening to you. The legal jeopardy for the president s son only deepens now that this case has Special Counsel status, and we can say tonight that it appears hunter biden is headed for trial. I have concluded that it is in the Public Interest to appoint him as Special Counsel. David weiss, the u. S. Attorney who had been leading the Justice Departments probe of Hunter Bidens tax and Business Dealings now getting a new job title and new legal responsibilities. Reporter mr. Weiss has the authority he needs to conduct a thorough investigation, and to continue to take the steps he deems appropriate independently. Reporter a source tells fox news, the white house was not informed before the announcement. The Justice Department has declined to say whether President Biden is also under investigation. But weisss appointment strengthens his authority to expand his probe for what the doj says are, quote, other matters that arose or may arise from that investigation. That could mean new charges and new defendants, which could now happen in los angeles or washington, dc federal court. It comes as the Special Counsel notified a federal court that the plea deal to resolve two Misdemeanor Tax Charges against hunter biden had collapsed and that the parties are at a, quote, impasse. The government now believes that the case will not resolve short of a trial. Republicans attacked the original plea deal as a Sweetheart Deal, and have been pursuing their own congressional investigations. This was a political decision, not a legal decision. Theyre trying to put out a fire, and they just poured gasoline on it. Nobody in their right mind believes that making him a Special Counsel, mr. Weiss, cleans up the mess thats been created. Reporter a skeptical House Speaker Kevin Mccarthy posted order media this appointment by bidens doj cannot be used to avoid special investigations or whitewash the corruption. The Special Counsel role will likely stop cooperation with congress and possibly nullify his prior agreement to testify. But House Republicans say they expect him to fully cooperate. And Bret David Weiss is under no deadline to finish his investigation, it could stretch well past the 2024 elections. He is the Third Special counsel appointed by Merrick Garland. The other being robert herr looking at Hunter Bidens father joe biden the classified documents at properties connected to him and jack smith looking at two aspects of former President Trump Election Interference also classified documents found at maralago. Scombridae david spunt live outside the Justice Department. Thank you the federal judge overseeing the Election Conspiracy case is warning there are limits of what he can publicly say about the investigation as he campaigns for a second term in the white house. Correspondent Mark Meredith has details tonight from the federal courthouse here in washington. Reporter former President Trump was in the spotlight, but not physically in court today as his attorneys told judge Tanya Chutkan trump should be allowed to share the evidence being brought against him in the investigation into alleged efforts to overturn the 2020 election. Today, the judge agreed, but only to a point ruling trump did only share Nonsensetive Information which excludes recordings and transcripts. The judge also warning trump to tread carefully saying, i caution you and your client to take special care in your public statements about this case. Prosecutors under Special Counsel jack smith had pushed for a broad Protective Order barring all evidence from being disclosed. Prosecutors say they fear a jury pool could be tainted or that trump may even intimidate witnesses. But one former federal Prosecutor Says a full gag order would go too far. You dont want witness tampering but hes got to be able to respond. Reporter but prosecutors say they have real concerns, pointing to last weeks truth social post in which trump wrote, if you go after me, im coming after you. Trump, who will campaign in iowa this weekend, continues to attack the multiple criminal cases against him. These guys, what theyre doing with this Election Interference, and the senate has to step up and do something. The house is doing a lot of things. Reporter but chutkan says trump should not expect special treatment in her courtroom just because hes a president ial candidate. The judge telling trumps lawyers, hes going to have restrictions like any other defendant. The fact he is engaged in a campaign is not going to enable him any greater or lesser latitude. Federal prosecutors say they are ready to move forward fairly quickly with this case. Theyre proposing starting a trial as early as the first week of january. That would be just a few days before the iowa caucus. Former President Trump thinks thats ridiculous. He says the trial should wait until after next years election. A judge could decide on when a trial could begin within a matter of weeks. Bret. Bret Mark Meredith live outside the courthouse in dc, mark thank you we will break down both of these big legal stories with our legal panel in just a moment. First an update on another major story the hawaii wildfires. The death toll has now risen to 55, but there are fears it could increase dramatically. We have some harrowing stories of survival as many residents wonder why they werent warned sooner. National correspondent William Lajeunesse is on maui right now with the latest. Good evening william. Reporter good evening, bret. That 55 number is likely to change because police say they located all those victims outside of buildings. We know some people died inside their home. But the big news here is what you see behind me. Just moments ago, the mayor opened the Roads Into Lahaina so people can find out the status of friends, family and their home. The smoke was so black and so thick, we were worried about getting killed. Blackout smoke, couldnt see. Reporter captain lydia lindermans Watch Lahaina Harbor and the boats inside go up in flames. None of the boats made it out of the harbor. Reporter she was aboard her own sailboat when forced to abandon ship. The coast guard saying there was a hundred people in water. Reporter one was gary savage. There was no real route to go north or south or towards the mountains. The only escape once the thing swooped in was to get in the water. Reporter savage jumped into the harbor with others as flames and smoke raced overhead. After eight hours on a shallow reef, they were rescued. Others were not. People were found in houses in a huddle holding each other because the fire surrounded their homes before they could even get out. Nobody had warning. Reporter questions are being raised why officials did not use the sa nami siren to warn residents when high winds began toppling polls. No a lairds, no emergency sounds they did not sound off the tsunami warnings. We do that every month on the first of the month. Reporter thursday officials moved 15,000 tourists off the island to make room for displaced residents and cadaver dogs arrived from the main land to determine how many of the 1,000 still unaccounted for can be found. People lost everything, homes, jobs, their cars, some their pets. Theres still people missing. Reporter and because so many have volunteered to help deliver toiletries, pampers and water, shortages have developed so the governor imposed a price freeze on goods and services on maui through the end of the month. Bret . Bret william thank you. You can help the victims of the wildfires, go to redcross. Org foxforward or text hawaii to 9 0 999 to make a 10 donation. On tuesday of this week, mr. Weiss advised mimi that in his judgment his investigation had reached a stage at which he should continue his work as a Special Counsel and he asked to be so appointed. Upon considering his request, as well as the extraordinary circumstances relating to this matter, i have concluded that it is in the Public Interest to appoint him as Special Counsel. Bret Attorney General Merrick Garland. Turning now to our top story the hunter biden Special Counsel. We get analysis now from George Washington University Law School Professor Jonathan Turley and fox news chief Legal Correspondent anchor of Fox News Sunday Shannon Bream. Good to see you both. You know, im trying to digest all of this. This is the u. S. Attorney, jonathan, who was agreeing to this plea deal that a judge essentially blew up because she found inside this broad immunity that the prosecution and defense were not talking about. Thats right. And that deal has been really ridiculed quite universally as a sort of a Sweetheart Deal. He just had two whistleblowers testify in congress saying that the investigation itself watts fixed. And so for many people this is like solving the mute any on the balance any by making Captain Bligh an admiral. It doesnt solve the problem. Hes been accused of an investigation where the bidens were tipped off and crimes were allowed to expire without any explanation. He came up with relatively minor charges while there were felonies outlet that could have been charged. So the question is, why would you appoint this person, a Special Counsel when youre supposed to appoint a Special Counsel whos una saleable someone outside the Department Of Justice, instead you appoint the person whos been the subject of these investigations. Bret the question is shannon why now . There was this argument that the Attorney General said that he had the power, all he had to do was ask for it. Obviously in Plea Agreement fell apart and it looks like theyre going to trial. Is that the why now . We can only speculate that there has been a lot have political pressure and the two whistleblowers the professor mentioned coming forward, you and i have talked to them and interviewed them and they have said all kinds of things about the investigation and that david weiss they dont think handled it fairly. Also when you ask them about that 1023 form which has allegations about hunter biden, about money flowing in, unverified but whether it was ever investigated, Attorney General bill barr, former Attorney General, told me that was it went to the pittsburgh office, they developed it further, it was given to david weiss. Yet when you talk to the whistleblowers who are Investing Hunters income and the trails there, they said they never saw it. So the fact that theyve gone public recently i think added some public pressure on the doj to do this. Bret heres some republican reaction to this. This is house ways and Means Committee chair man jason smith. This is an attempt to whitewash the biden family corruption. I mean, mr. Weiss is the single architect over that sweetheart Plea Agreement deal that the judge, in delaware, threw out just a few weeks ago as saying it was awful and unfair. Bret thats the similar argument youre hearing from republicans from Chuck Grassley to jim jordan and james comer. Is there another side to this . That there is a lot of jeopardy potentially for hunter biden, or is this does this sound like it is about protecting and preventing republicans from getting information. Theres no question this magnifies the danger for hunter biden. His attorney told the prosecutor in the courtroom, well, lets just rip it up. That doesnt go over well with most prosecutors, and there are some major charges out there, like a fara violation with an unregistered foreign agent. They can up some of these accounts to felonies. He is not in a good place. The problem i think for people on the hill is that garland didnt expand the mandate. Hes still talking about Investing Hunter biden, not his father. Department of justice refused to answer whether President Biden could be investigated. Thats going to add pressure on the hill to say, all right, then were going to have to go forward with this. Bret the other thing, shannon, broke when i was anchoring americas news room, you were on as the judge in the donald trump case on the Protective Order said, you cant say everything, but he can say some things. And we now have the Protective Order in writing from the judge late in the day saying, yes, if it comes to sensitive materials, and she defines those, the professor i think maybe too amburg woeful but she identifies what qualifies as sensitive materials but she said they can use other material they have publicly, this is not a gag order that would stop him from talking about the number one thing he likes to talk about on the Campaign Trail which is the indictments against him but it limits who can see the sensitive material and how much he can talk about it publicly which is nonon the sensitive stuff. Bret august 28th we supposedly hear about a trial. January 2nd, 13 days before the caucuses. Thank you so much. Thank you. Reporter the candidates also reacting to the big news out of washington. What is your take on the Attorney General appointing a Special Counsel in the Hunter Biden Investigation . Well, i think its about time. The American People deserve to know what hunter biden and the biden family were up to. For republicans this is welcomed news because for a long time they felt there was a twotiered system where it seems like the Justice Departments only focusing on the former president. Reporter still the main focus is on these fair grounds as i iowans want them to work for every vote it could be a make or break moment. Locals tell us the fair is the heartbeat of the midwest. Its small, iowa, like to say its a flyover state. I lived here my whole life so im proud of iowa and i wish everybody would be. I like that we get that exposure. Yeah. I like getting to know the candidates, just all of them. Theres just its a great opportunity. Reporter and voters will have the opportunity to see the partys front runner tomorrow. Trump will not speak with Governor Reynolds but will be Walking Around with nine Florida Republicans who have backed him over his chief rival and fellow floridian Governor Ron Desantis who will also be at the fair tomorrow. And bret its been an action packed day here at the Iowa State Fair and voters we talk to say although the massive size of the crowds here its really about the one on one interaction, were not in washington, dc, were in the heart of the midwest so they want to see how those candidates interact with everyone here at the fair. Bret. Bret Alexis Mcadams at the state fair in iowa. A lex as thanks. God bless the United States of america and every way, lets let iowa continue to be number one. Lets do it let us do it now now now yes boy, i almost fell off. Bret very fired up there. Tonight we introduce many of you to perry johnson. He is running for president as a republican. Hes described on his web site as a self made businessman, Problem Solver and quality expert from michigan who helped save the American Auto industry. Mr. Johnson, thanks for joining us. Well, delighted to be there, bret. Bret i ask every candidate on this show, and ive asked all of them who have had a chance to be on the debate stage, whats the most important issue facing america . The economy. We are literally 33 trillion in debt. In fact, for the first time in history, we have Interest Payments that are larger than what we spend on defense. Its 900 billion which amounts to about 610 per month per family. Can you imagine a situation where every family is having to pay now 610 a month just in the interest in our debt . And, lets keep it in perspective. Right now if you were to take a family with an income of 70,000 a year and they were 450,000 in debt, theyre going to have a meeting and theyre going to say, look, lets cut back. Next year what do you say we only spend 91,000. Its nutty. And it puts everything in jeopardy. Bret a lot of people have seen your ad, number different channels, and the plan that it talks about is a two percent plan. Explain that. 0. 02. Well, right now the government goes out of its way to spend every penny in the budget every year. They start in april to make sure theyre broke at tend of the year. I say they have to change the way theyre doing business and freeze the budget and cut 0. 02 of every dollar of discretion area spending. In fact we are going to bonus the management on doing just that. That way were in a position where we encourage savings instead of trying to make sure were broke every single year. And, lets face it, some of the things we do are ridiculous. To hire an extra 87,000 irs agents . Absurd. When we take a look at the money that is spent, it almost makes me sick. And we have the greatest country the worlds ever known. What do you say we keep it that way. Bret mr. Johnson, its an Uphill Battle because youre facing some big head winds here, the former president obviously has a huge lead if you look at the polls you dont track in some of these polls. Real clear politics average poll, youre not on there. So how do you break through . Do you think you can even make that debate stage . Well, im very confident im going to make the debate stage. We now have 52,000 donors. We are 1 in a number of polls and im confident we will be on the debate stage. Im the only one with a plan. In fact its amazing when you think about it. Here we are five months from the caucus and im the only candidate that has a plan to solve the debt crisis. I think its kind of nutty. But we wrote a book 0. 02 to save america, i have a plan, obviously ten points to that plan but lets face it i built 80 companies, we have 80 Companies Operating in 61 countries, none of my companies have ever gone under or have any debt and have been bringing quality and efficiencies to companies my whole life. So literally what maybe 50, 60 thousand companies . Now i want to bring it to the federal government and its about time we have a ceo who actually runs the country. Bret perry johnson, we appreciate your time and well be tracking your progress. Thank you, sir. Thank you. Bret please join Martha Maccallum and me, we host the first Republican Debate of the primary season, well see whos on that stage. It it will happen right here on Fox News Channel august 23rd 9 00 p. M. Eastern live from milwaukee wisconsin. The second debate can be seen on fox business September 27th toyota, that will be from the Ronald Reagan president ial foundation and institute seemy valley california up next, what the Biden Administration is saying and has said about a Special Counsel for hunter biden. Bret Recapping Our Top story President Bidens Attorney General has appointed a Special Counsel for the investigation into the Business Dealings of the president s son hunter. This comes amid growing scrutiny over the president s knowledge of and alleged participation in his sons scandal. A certain White House Correspondent asked about that on the road the other day. Here is White House Correspondent peter doocy. Reporter President Biden is returning to Rehoboth Beach its worth revisiting his administrations comments about the possibility of a Special Counsel. Would the president support the appointment of a Special Counsel . Well, first the president has never had a conversation with the Department Of Justice about any investigations into any member of his family. Reporter the president himself has long insisted hunters problems are his own and that he never profited from his sons business deals. Wheres the money . Im joking. Reporter mr. President its a bunch of malarkey. Ive never spoken to my son about his overseas Business Dealings. Reporter once weiss was elevated to Special Counsel, the New York Times reported, quote, the decision is likely to anger the president and democrats. They have privately complained about the Attorney General who they believe moved too slowly to investigate mr. Trumps attempts to overturn the 2020 election, and should not have appointed a different Special Counsel to investigate whether President Biden has mishandled classified documents. President biden is promising not to use the powers of the presidency to interfere with a pardon . Is there any possibility that the president would end up pardoning his son . No. Reporter or a pressure campaign. I promise you my Justice Department will be totally on its own making its judgments about how they should proceed. Reporter however, he has publicly prejudged this case. Im confident. Reporter and we have reason to believe now that they realize how serious this Special Counsel announcement is because, first thing this morning, officials that worked here put out a memo really really critical of congressional investigations into the biden family. But, by this afternoon, once the Justice Department announced that they had reason to expand their probe, crickets, even from the president who did not come over to talk to us on his way to the beach. As many students head off to college this weekend, we look at how many schools are on a decadelong spending spree. Some of the countrys most recognizable public universities are dumping millions of dollars into costly renovations, new sports teams, and armies of administrators. Fox Business Correspondent lydia hoo has details tonight good evening. Reporter good evening bret. As University Spending splurges students are footing the bill, division and fees have increased more than 152 between 2001 and 2021 according to Education Data initiative. A Wall Street Journal Analysis found that the median spending at flagship State Schools rose 38 between 2002 and 2022 even though enrollment increased only by 21 . There are Three Million fewer College Students now than there were about 10 years ago, and thats caused a great deal of Competition Among institutions. In an ordinary industry, you might say, gee, we need to cut prices because were not selling our product. In higher education, theyve mainly done the opposite. Reporter what are they spending money on . Well, many times projects unrelated to academics, dorms, rec centers and sports venues. The journal concluded that spending on salaries and benefits spiked 40 . Much of that pay for faculty, coaches and administrators. And now some republican lawmakers are proposing legislation that would require more transparency from colleges about what is charged and why. We want the schools to be more honest about what theyre going to charge the students when they come to college. Many schools hide the true cost of going, and we dont want taxpayers to be on the hook. Reporter federal student loan balances also swell reaching 1. 6 trillion in total. Now the pricey projects by university are in focus as the Biden Administration looks to forgive billions of dollars in student debt. Bret back to you. Providers are blaming Medicare And Medicaid Reimbursement Rates. This is leaving many families in a tough spot. Heres Senior Correspondent a le l lisa. Its emotional. Carmen peek is the mother of two autistic children who will no longer receive care at one of ten autistic providers for services in colorado all siting low medicaid Reimbursement Rates and high inflation. In many cases physician Repayment Rates have not kept up with inflation. Take medicare inflation rates. According to ama Research Since 2001 theyve dropped 26 below the cost of running a doctors office. Experts, however, point to instances where reimbursements may actually be too high, particularly with some medicare services. And private insurance plans. Its not about medicare rates being stuck. Its because commercial rates are out of control because theres no Market Discipline when providers have monopolies. Reporter congress and State Lawmakers are looking at legislation to adjust rates and more closely tie physician pay to inflation. Medicare rates have contributed to the closing of air ambulance bases. It doesnt even come close to properly, you know, reimbursing us. Reporter primary care, nursing and geriatrics among other specialties are facing shortages in part due to Reimbursement Rates and inflation. Wait times to see a doctor also impacted, especially for older people and patients with disabilities as some physicians opt out of Medicare And Medicaid. The motion is adopted. I think the bidens are on a sinking ship and i think this is our opportunity to make sure not only do we get a new president in the white house but that we go and we clean house in the Department Of Justice while were at it. This really isnt about hunter. This is really about President Biden himself. There isnt a sin tell a of evidence to show President Biden did anything wrong in connection with hunter biden. I was one of those that sent a letter saying we should have a Special Counsel. So the short answer to your question is its about time. Bret Attorney General Merrick Garland appointing a Special Counsel but the Special Counsel raising some eyebrows in republican circles at least. Its the u. S. Attorney in delaware weiss. The House Oversight Committee Chairman james comer had a statement saying the Biden Justice department is trying to stonewall Congressional Oversight as we have presented evidence to the American People about the biden familys corruption. Well start there with our panel, lightning round. Harold ford jr. , former tennessee congressman cohost of the five. Axios political reporter steph kite and byron york chief Political Correspondent of the washington examiner. Byron, National Review points out that the Special Counsel regulations, section 600. 3 states without ambiguity, quote, the Special Counsel shall be selected from outside of the United States government. Well, theres one exception to that, which happened in the case of john durham. Bret true. Who was selected and for a few months served although he left office when the Biden Administration came in. This is really an outrage in the sense that this is the u. S. Attorney who accepted, who approved of this Sweetheart Deal for hunter biden. It fell apart when it came before a judge, but he approved of this deal. And now hes going to be the guy to be the Special Counsel going forward. Bret yeah. Harold it is hard to not say what the republicans are kind of all circulating, that this is a Stalling Mechanism and will likely prevent republicans from either hearing from weiss or going down certain interrogation and investigation routes they were going to go down. First, thanks for having me on. I differ a little bit. I dont necessarily disagree with the thinking around this should be a fair investigation but here are three things we should consider. First, the plea deal is off between the Justice Department and hunter biden. Which means that these charges and problems for him could metastasize. Two the Department Of Justice said that they wouldnt answer whether or not President Biden was under investigation so if youre at the white house tonight, this is not necessarily a good evening. Three, this Special Counsel that has been a point, mr. Weiss, has investigated this for a while. So the idea that this could go on for a longer period of time is unlikely and, if it does, bret, it gives the republicans and those who are opposed to President Biden, his political opponents, an opportunity to point out things and say things that would have a lot of credibility not only with republicans but with democrats and even independents. Reporter fair enough but steph, number one issue is that david weiss was behind that original plea deal that was broken up by a judge who kind of discovered the broad immunity that was inside the plea deal. It blew up at the last gnome court. And this is certainly the concern were hearing from a lot of republicans on the hill. Ive been on the phone all day with various people involved until this Watching Statements come through, and republicans who, you know, at one point wanted to see weiss named as Special Counsel wanted him to have that authority now that theyve been digging into what they see as bias within the Department Of Justice and the Justice Department overall weiss isnt the right decision. They would have rather seen a separate person brought in to be Special Counsel over this investigation. But, of course, it is important to note that this isnt a good day for the Biden Administration either. Theyre looking at hunter biden again being in the spotlight right when they thought that this investigation was going to be wrapped up and theres certainly concerns that that is going to impact bidens campaign as well. Bret the other legal thing today, judge delivers mixed ruling on judge Protective Order on 2020 election case in a close decision. Chet kin the judge said she was not persuaded all information would fall under the Protective Order, only information designated as sensitive should be protected however she agreed with the government every Single Person interviewed by prosecutors is a potential witness and is sensitive. Bottom line this is incremental but august 28th shes going to make a decision on this trial date which could be january 2nd, 13 days before the Iowa Caucuses. January 2nd is an astonishing trial date. As far as the order it isnt a big deal, i dont think it would affect Anything Trump has said publicly about this trial so far about this judge and prosecutor. It just concerns evidence that his side receives going forward. And besides some of that can come out the Old Fashioned way by leaking it to reporters. January 2nd just seems insanely early. The judge knows when the Iowa Caucuses begin and the whole process and i would be stunned if it were if they succeed in getting that date. Bret we are going to take a trip today down a place we call candidate casino. Love to hear the ball around the roulette wheel. This is gop primary. It is early again, and obviously you have A Hundred Dollars in chips, you have to bet them. Here we gofundme harold ford jr. , youre first.
