>> it is so unusual. but we've been saying that for years right, and we've said that there's never been an indictment of a former president before. we're way past that potentially number four out of georgia that's a possibility, and there are doubts on both sides of the aisle that president biden is actually going to be the nominee for the democrats. i think there's a whole lot to play out in the next 16 months or so it will be a wild ride. pete: it is part that have wild ride are indictments which will turn to trials right now "the wall street journal" pointed out that democrats want cameras in there. here's apartment what have they said in op-ed precisely what democrats want a long running o.j. simpson style trial that consumes attention if it takes place before election and tv cameras make it likely to accept a verdict highly unlikely given polarization and nature of that prosecution. is there precedent for cameras in a courtroom? >> it does happen but there have to be exceptions in a federal courtroom like a couple of court proceed injury rules and exception, you know, that a lot of people are going to push for this but it would take a lot to actually make that happen. listen there are people that think both sides could benefit because you get it "unfiltered" and you actually can watch and see it for your eyes you'll see the witness and evidence and people on both sides who think it might be a good idea. i'll ask the president's attorney whether they would support this move. rachel: you talk about televising it but in general, amount of energy -- and money that donald trump has to expend attention on this versus running and so many ways they're tieing a hand behind his back. i mean, frankly i think they like to have him in a cage in a trial. if they could -- you know, i don't know what to make of this. >> well, listen, to prepare a defendant for any trial is very labor intensive. you've got to prepare them for every nook and cranny the possibility to take a stand or cross examines there's a ton of prep and to have multiple state and federal trials is a real thing and what we've seen this weekend you've been reporting with this back and forth to delay this protective order this judge in d.c. doesn't seem leak she's interested in any delays in this process. i think she's going try to keep it moving potentially get that trial done before the election which -- would be very speedy for a federal trial but not out of the norm. >> you know shannon one of the few hurdles that's stood in the way of the progressive agenda of not just a political party but increasingly all of the institutions within washington, d.c. has been the institution of the supreme court. will: now many people can look at that as the supreme court is the saver of the united states others see the supreme court then therefore, as a problem for their vision of the united states. and as a result we've seen unprecedented tabes on justices we've seen people in their lawns we've seen threats on their life. we've heard talks of packing the court. and then, of course, there's big investigations into ethics or into -- what they do when they're not sitting on the bench. well, you know this on july 28th justice alito said that congress has no power to relgt the ethics or impose a code of ethics on supreme court he wrote in wall street journal, i know this is controversial. but i'm willing to say it no provision in the decision gives them authority to regulate the supreme court period then to that now justice alania kagan has responded. >> of course congress can regulate what the supreme court does. congress funds the supreme court. it just can't be that the court is like the only institution that somehow is not subject to any checks and balances from anybody else. i mean, we're not imperial. so can congress do various things to regulate the supreme court? i think the answer is yes. will: what is the answer shannon, people point out there's little in the constitution that suggests that there is a way for congress to impose a ethics code on the supreme court. >> uh-huh. we talked a little bit about this last week she hits on that point justice kagan that it is about funding because they do decide funding measures for the judicial branch and that's where the usually try to exert control and often call in justices when they're having these hearings on what funding they get to say things like we're all going to force you to put cameras in the courtroom and tie that to the funds. so far the justices have been able to waive that often say it is not good for the court. chief justice over there said unless everybody agrees on this we're not going to do if but it comes up in a context of pngding. there have been measures for years about doing things to regulate the court. talking about adding seats, talking about limiting terms to, you know, certain years not lifetime. nothing has gotten through capitol hill yet but the constitution allows them to change the makeup congress has that power and funds and imposing an ethics canon on them there's not bipartisan agreement about that and nothing in the constitution technically about something like that. will: interesting. actually not clear what she said either that it has no checks and balances. there are checks and balances on the court. >> you can impeach a court justice or elected official like a president. so there are other, you know -- will: executive chooses who sits on the supreme court and to your point they can change the number of people that sit on the supreme court. rachel: fascinating usually the person sitting in that branch of government isn't advocating to have their own power -- pete: a group in the minority is advocating for oversight there's that dynamic they don't have the votes. >> it was interesting caught my eye this week there's polling that shows few years ago with the legalizing same-sex marriage across the country back then 75% of the democrats approved the job the court was doing. so you've got to think a lot of what happens on approval of the court -- based on the left or right has to do with how you feel they line up with their decisions with your personal beliefs and so -- you know, court is going to be in and out of favor with different groups over time. pete: no doubt but your show is not out of favor who do you have on this week? >> well good morning first of all. and my initial thoughts was, you know, obviously, it was painful and disturbing to hear about it, and that made me quickly think about two justice system that it's been around for a long time and two tier justice system is divided by class and privilege and other side of that is those who are not privilege and nonclass so it was disturbing. to hear about it -- will: to tell me a little bit more about what you mean by class and privilege here you have the first son his father's president of the united states. his tax evasion charges by the way -- i think compared to yours yours roughly over 67,000 dollars his well over a million dollars. unpaid taxes -- you know, what in your estimation led to the difference in your treatment? >> i just honestly feel that something needs to be done about whole thing about prosecutortorial discretion in any case the prosecutor made me feel like i was an animal in the courthouse like worst person in the world. in the case of mr. biden hunter biden's case it seems like it's -- a plea deal that's, you know, like a sweet heart of a deal two tiers of that and allow and dct advocate i would say lady justice should be fair across the board for everybody despite wherever you come from, color of your skin, social economical background, your job, whatever the case is. thought that you were supposed to i thought this system is supposed to be fair for everybody that's what millions of americans want. will: or your last name prosecutors gain reputation bulldogs those that take it easy on criminals seen prosecutors in different jurisdictions you faced the same prosecutor. in your case, what was the attitude i know you said he treated you like an animal legal wise what was your impression of him back then no nonsense going to throw the book at me? >> absolutely. yeah that's the whole philosophy and mindset i had was that he's going to throw the book at me he doesn't care. despite, you know, my 30 years on a job yeah, and i have to say that, you know, i own up for my responsibilities and i hold myself accountable. but at the same token, are you doing the same thing for others? are there any other cases similar to mine that's out there that's happened in the past orb to happen in the future where this whole thing with prosecutorial discretion there's no oversight or accountability. will: you know if i might my response that would be -- you know, many would say the way it was handled with you is the right way it should be handled or very least it should be handled consistently it's this case that's the aberration. if wise is a bulldog and prosecutions why all of a sudden are you not a bulldog this one case? it makes you look fairly unprinciple and less like bulldog more like a politician. >> absolutely. you said it perfectly well. yeah. i think again, you have to hold yourself accountable. i was the chief of baltimore police department commissioner of the police department. and absolutely got to hold myself accountable someone else can learn from same lngsz who is will learn from the lesson that a plea deal is like what mr. biden gets?
