charges. lucas tomlinson kicks it off for us. >> reporter: devon archer, hunter biden's former business partner, friend and fellow board member on burisma, testified to congress that that company would have gone out of business if it was not for the help of then-vice president joe biden. now, in the last hour you had congressmen from both sides of the aisle who see this matter very differently. >> there's no question that that joe biden is helping his son's business, including getting a prosecutor fired to help his son's business. >> there's been no evidence whatsoever that joe biden is in any way implicated in the mistakes that hinter biden had made. -- hunter biden had made -- griff: wait a minute, hold on one second. >> reporter: now, one of the revelations to come out of this devon archer testimony is that he met with the head of burisma in moscow on the same day putin invaded crimea in 2014, a month later president obama made joe biden in the west wing and the year after that allegedly dined at a popular restaurant in the nation's capital with hunter biden's business partners including a russian billionaire and her husband, a former mayor of moscow who many accused of being corrupt. this morning the republican chairman of the house oversight committee leveled the following accusation about his democratic colleagues on the committee -- >> the one thing that drives me crazy is anytime i go down into a scif and get a briefing from the fbi or anytime we do a transcribed interknew like last week, you'll either have jamie raskin or dan goldman come out and tell the press complete lies about what we just heard. >> reporter: now, many republicans and some former justice department prosecutors want to see a special counsel named to investigate this case, and they want to see that happen very soon, griff. griff: and, lucas, has the white house or president biden weighed in on this latest news in. >> reporter: not since monday, griff. president biden was at his beach house in rehoboth, he flew on marine one here to wilmington where he's spending the weekend, and officials say the president's focused on bidenomics before the president heads out west to tout that program. griff? griff: okay, got it. lucas tomlinson live in wilmington, thank you. molly? ♪ ♪ molly: as the first gop debate right here on fox quickly approaches, candidates are out there courting voters. trump isallying in south carolina, pence hits the road in new hampshire while others are making the roads out in iowa. fallout there from trump's legal woes linger. alexandria hoff covering it for us. >> reporter: hi, molly. former president trump, as we know, no stranger to sounding off, but special counsel jack smith is hoping that a judge will order him to turn down the volume, so to speak. last night special counsel jack smith, he asked that a judge put forward a protective order, as it's called. it's a little different from a gag order. it would limit what trump could share about the election case that's against him right now. smith used truth social post as an example. trump wrote this: you go after me, i'm coming after you. prosecutors claim such statements could have a chilling effect on witnesses. the leading gop presidential candidate did not hold back last night. trump gave remarkses at a heavily-attended state fundraiser in alabama hours after pleading not guilty to his third indictment in four months. [applause] >> so this are ridiculous indictment against us, it's not a legal case, it's an act of desperation by a failed and disgraced, crooked joe biden and his radical-left thugs to preserve their grip on power. they want to do anything they can to preserve i. >> reporter: meanwhile in new hampshire, former vice president pence is making the push to meet the rnc polling and donor requirements for this month's debate. this week though pence capitalizedded, his campaign capitalized on being referred to as too honest within trump's latest indictment. last night he spoke about when his loyalty was undone. >> i stood loyally by president trump every single day, through the hailstorm of the media, democrat assaults, the phony russia hoax, the president being impeached for a phone call, i stood there, i never, ever waver. wavered. i never changed my commitment to him until the day came that my oath to the constitution required me to do otherwise. >> reporter: the constitution comes first. and although a trial date has not been set for trump's election results case, dozens of democrats are pushing for a policy change that would allow for cameras in the courtroom to cover that the trial live, molly. molly: alexandria hoff, thank you very much. griff: former president donald trump will not have to appear in person for the next hearing following this week's indictment regarding alleged efforts to overturn the 2020 election. this comes amid growing questions about the justice system in the midst of dozens of criminal charges against the former president in multiple investigations involving the biden family. congressional republicans are vowing a strong the response to what they feel is a two-tiered application of the law. fox news' senior congressional correspondent chad pergram has the story from capitol hill. >> you can't beat 'em, you persecute 'em. >> reporter: republicans believe there's something nefarious going on. >> it seems as though every time trump goes higher in the polls, he gets a new indictment. >> reporter: mccarthy suggests the timing is fish fishy. deafen archer sat for an interview with the house oversight committee on monday. the former president was indict on tuesday. >> it seems to me after you with learn of the real dealings behind the bidens, the next day he gets indicted. >> reporter: house republicans are threatening retribution. >> the devon archer transcript, i think, tells a lot about the corruption in the biden crime family. >> reporter: most democrats try to ignore gop accusations. it's unclear if the president faces a blind spot. >> the only thing that the biden administration could try to do is be cooperative and get the facts out as best they can. >> reporter: some republicans demand impeachment. >> when we get back in september, if there's not a clear path and a clear timeline for impeachment, i'm going to pull the trigger on that. >> reporter: democrats accuse republicans of a diversion. >> they have to change the subject, and they have nothing to offer the american people in terms of jobs. >> reporter: republicans want information from delaware u.s. attorney david weiss about hunter biden's plea agreement. weiss says he's in control of the investigation, but the gop suspects there was pressure from above. >> which is it, many weiss? do you have full authority to bring where, when and whether, or just in your with u.s. attorney's district. so he's changed his story, but the whistleblowers haven't. >> reporter: the gop could try to clip money for the doj and trump prosecutor jack smith. that could emerge as a major issue as congress tries to avoid a government shutdown in september. on capitol hill, chad pergram, fox news. >> we need one more indictment to close out this election, one more indictment and this election is closed out. nobody has even a chance. [applause] molly: that was from trump's remarks in alabama a just last night saying that the latest federal indictment is bolstering his campaign as other hopefuls make pitches in key states as well. to discuss more, let's bring in our political panel. joining us today is the vogel group principal matt keyland and fox news contributor richard fowler. thank you both for joining us this afternoon. the week started out with this remarkable, unfortunately behind closed doors, testimony of devon archer, the business partner of hunter biden, as republicans in congress continue to probe just how close president biden was to hunter's dealings. and by thursday afternoon, president donald trump facing another indictment yet still holding a solid lead, really an understatement, a formidable lead in the gop primary. reflections on in this week. matt, to you first. >> absolutely. well, you made a point earlier in the show, molly, that all the other opponents in the primary are really not able to get any air time based on the fact that he just controls the airwaves even over president biden. it's kind of strange to watch the former president outshine the current president in the news cycle. but i think what we're going to see with this upcoming debate on fox and also ron desantis' proposed debate with governor newsom is some people actually get a chance to hear from those other candidates and maybe one or two get traction. finish right now desantis is at 20 the in the polls, everybody else is in the single digits. will somebody arise from that debate to take desantis on, or does desantis become the primary opponent to trump. the stuff on the house side with devon archer, you know, one of the things that the i keep saying is follow the money. where did the $50 million come from, and what did they get for that $50 million. molly: richard, not just your reflections on this rebacker bl -- remarkable week in washington, but a quick dive into that archer testimony where he talks about contact points, interaction that president biden had with hunter biden's business contacts, attending dinners, calling in to business dinners. what are your thoughts on that? do you have any concerns about this ongoing gop if probe exit shedding right light on these kind of interactions, what that could mean on the other side of the aisle as president biden himself also runs for re-election, richard? >> thanks for having me, molly. number one, i think matt is right. in this moment of the media landscape, you'll find that trump seems to be dominating the media on the republican side and to some extent, i would argue, the media overall. and you could say that's a good or a bad thing, but what you're seeing is that's resulting in him being higher up in the polls. now, let's get to what i think seems to be a false equivalence that republicans are trying to make. they're trying to i say there's this sort of doomsday cloud over the justice department versus how they're treating hunter e biden versus donald trump, and i think we have to really level set as a country on the two different nature of charges. i think in all likely hood, it is very likely that hunter will be found guilty of tax evasion, he will be found guilty of this drug charge. -- gun charge. but what there doesn't seem to be after six or seven months of investigation by the republicans is a clear connection to the white house. in devon archer's testimony he says over the ten years in which hunter biden and him were business partners, there was only 202 calls made. that's about -- 20 calls made. that's about 2 calls a year. and they have not been able to link biden to any form of bribery. nobody's wearing a hunter biden t-shirt saying hunter biden for president. and just because somebody's child does wrong does not mean that the father or the mother does wrong. when it comes to president trump, this indictment, this most recent one speaks to his actions on january 6th. actions that we know based on the january 6th committee, based on mike pence's book, based on all the evidence that was laid out just this week seems to be pretty damning. we'll have to find out if he'll be found guilty, but there's no question. we all watched it on live television as he urged on his supporters, and his supporters took over the united states capitol. molly: richard covering a ton of ground, matt. i want to bring you back in. some republicans floating the possibility of impeaching president biden based on these connections. richard pointing out there were a certain number of calls, but this is one person's testimony, archer's testimony. if we're going to see more testimony and other people, who knows what other people have seen and what other documents will be found as this continues. so the possibility of impeachment, what could that mean for democrats? >> well, i think it would be the first time that a lot of people in the american public actually hear anything about this case, cbs, nbc and abc news has covered zero minutes on hunter biden's scandal and the $50 million that came in to the biden family. and again, i say follow the money. where did the money go? how did joe biden become a multi-multi-millionaire post his vice presidency? wasn't for giving speeches because nobody was hiring him. wasn't for selling his book because nobody bought the book. so i think for the first time you may actually get a chance for the american people to hear exactly what's going on. and as far as the special counsel, smith, he was in charge of the public integrity section of doj all during this, while flags were going off. by the way, the obama state department raised flags on hunter biden at the end of the obama presidency. that's to not me talking, that's to not jim comer talking, that's not jim jordan talking, that's the obama state department. so what was going on? i think the american people have a right to know. moll hol there's going to be more digging. i want to get to this, you both touched on the 2024 race. trump surging in the polls after every indictment, and he says he just needs that one more to insure his election. meanwhile, this huge field, gop competitors, a lot of them qualified to get on the debate stage later this month. martha maccallum, bret baier are going to ask a lot of tough questions. quickly, your thoughts on how any candidate can break through when president trump is dominating the news cycle going into courtrooms and raising in the polls? your thoughts, richard, first. >> i mean, i think that's a dilemma for republicans at this moment. if you look at the number two contender, ron desantis, who is, i think, trying to go to a lane to the right of donald trump which i don't think is possible, he's tried to use this woke this, anti-woke that, and that doesn't seem to be beating trump. anything they seem to say seems to break through the trump wall which which at this point if i was a betting man, i would say it's very likely that trump will be the nominee, and all these other candidates are go to the wayside. it doesn't seem to break through from the gop support of donald trump. this used to be the party of working people, but now it's very clearly the party of donald trump, and donald trump is shaping this party in his likeness, and that's just an objective view. molly: matt, your thoughts. >> i think richard makes a great point. somebody on the debate stage needs to get trump one-on-one. and if they ever get that chance, and i don't blame donald trump for not debating, why risk it, but someone's going to say to him all these problems that you're pointing out, marley at the department of justice, you were president for four years. why didn't you take care of it? why didn't you actually drain the swamp like you promised? and i think if somebody has that chance to have a conversation with him, you may see somebody moving up in the polls. i found interesting out of iowa for the first time in a long time, donald trump is below 50% which shows you that if somebody were able to run against him one-on-one, they might be able to take him on. molly: i love debates. >> molly, i think the one point that he made is comer rarely says this, but the special counsel in the hunter biden investigation was one that was appointed by donald trump. and this investigation started at the end of the obama administration. so i think we should let this investigation pan out before we allow republicans to politicize this on capitol hill. molly: all right, we are running out of time. matt, richard, appreciate your time this saturday. tomorrow on "fox news sunday" shannon bream sits down with donald trump's attorney, john morrow, also interviews with democratic congressman from massachusetts jake of coursen claus and republican congressman from texas chip roy. set your dvr or, of course, check those local listings for time and channel. and fox news, as we mentioned, set to host the first 2024 republican presidential primary if debate august 23rd in milwaukee. that is something you will not want to miss. you can catch it right here on fox news channel. griff: meanwhile, a crowded new york city -- a crowd in new york city descending into mayhem yesterday e after a popular twitch streamer and is youtubeer toll his massive following he would be giving away free playstation 5s at union square park. thousands of people gathered, and the situation quickly became unruly with over 60 people getting arrested. c.b. cotton is live from union square there in new york city with more. hey, c.b. >> reporter: hi, griff. officers say this ruckus shows the power of social media. as you mentioned, influencer kai told his millions of followers there'd be a huge giveaway friday afternoon at the new york city park behind me. but officer as say he didn't tell them. >> this was not preplanned with the police department, this was something that was spontaneous. we're not against young people having a good time, we're not against young people gathering, but it can't be to this level where it's dangerous. a lot of people got hurt today. >> reporter: by 3 p.m. friday afternoon, thousands had gathered for the giveaway, and that's when chaos broke out. people climbed on top of subway station structures, up statues, traffic and lamp posts and some even jumped on cars. a a construction site was also damaged, and officers say people took items from the site like paint cans, bottles, axes, shovels, some even started to throw some of those items around. nypd's highest ranking officer, who you just heard from, said some people were even lighting fireworks and i throwing them towards each other and towards police. officers had to use metal barricades to push the crowd back and loud speakers to warn that the gathering had become unlawful. you know, as police tried to regain -- can rein in the chaos, rather, several people and officers were injured. now, the influencer has been charged with inciting a riot and unlawful assembly but could face other charges according to police. he has a following of over 13 million people across all of his social media platforms. now, jeffrey imagery with nypd says he saw at least four people being taken from the scene in ambulances, others walked away with bloodied heads. update arrest totals this morning, more than 60 people were arrested and, griff, about half of them were juless. back to you. griff griff -- juveniles. griff: wow, c.b., thank you. molly? >> i'm not prizedded at -- surprised at all. in may the administration ended title 42 which was the covid-related authority they could use to just bounce people back across the border. but in ending it, they also said we're going to get tougher on asylum seekers. so if people passed through mexico and didn't apply for asylum, we were going to get tough on them. what i think happened, the numbers did go down in june, the numbers at the border patrol. part of the reason for that, a lot of people were like, well, let's wait and see. let's hold off and see what the story is. obviously, the new rule was full of loopholes, it doesn't really do much of what they said it was, and so the smugglers said, okay, we got a green light again, let's start it up again, and the numbers for july, the arrest numbers, are way up from what they were back in june. griff: the administration points to this cbp one app a, actually began under the trump administration because of covid. now the administration has tried to do it. it essentially allows asylum seekers to apply before they cross the border, and then they come through a port of entry and are paroled for two years. critics say they just disappear into thin air. but now we're learning there are reports out there that the cartels are taking advantage of that app and gaming the system. >> yep. griff: your thoughts. >> the app, basically the administration wants to use it to schedule illegal immigration so that instead of people crossing the border illegally where the border patrol is, they just walk up at a crossing point and are let in. the administration has no legal authority to do it. they're still illegal aliens. but what recently happened with this cartel issue is that it is only supposed to be for people who are in northern or centralling central mexico, from third countries to use it. cartels are just using a vpn, you know, from anywhere in the world and scheduling the illegal immigration of their clients, and the administration doesn't know what to do about it. it's, like, what did they expect cartels were going to do? griff: and let's talk about who's coming across this border. you can't overstate this because that's what years of covering the border has taught me. the new chief of the border patrol, chief jason owens, tweeting this yesterday. take a look. it's fascinating. he says this: yesterday border patrol agents in el paso arrested a foreign national who was identified as the head of a violent gang in panama linked to homicide, narcotics, trafficking. this year alone we've arrested 531 individuals with gang affiliations. that's a lot of gang members, mark. >> oh, absolutely. and it's not even just mexican gang members. there was a gang member from brazil, apparently, cartel person but from a brazilian cartel. and so see a lot of the people who are criticizing the administration's lax approach to immigration are pointing out that you can't pick and choose who gets, which illegal aliens get across the border. if you're opening up the border, as these guys have, you're going to get cartel people, you're going to get people on terrorist watch lists, you're going to get people human trafficking because once the pipeline is open, all kinds of people are going to be rushing through. griff: let's talk about an unlikely critic of the administration on immigration is new york city mayor, mayor eric adams. because his city's overwhelmed with these asylum seekers outside the roosevelt hotel. now there's reports he's going to try to move them to a brooklyn park. what do you make of the situation in new york? >> what did new york expect? they're a sang knew ware city, so in a sense, they're getting what they asked for. and it's interesting that, having gotten it, they're responding by trying to bus people upstate new york, bus people to the suburbs. the mayor is complaining, he wants more money from washington to cover these costs. the fact is the one service that that he could do actually to the country that would also help him is to come out openly and say, mr. president, as a fellow democrat, i am demanding that you start enforcing immigration laws at the border, because this is just unsustainable. he hasn't said that yet. he's sort of hinted at it. if he actually comes out and says we need to go back to actually enforcing immigration law, not releasing these people, then, you know, that will be a real change and, i think, a real benefit to the country politically. griff: mark, we've only got like 30 seconds here, but as we get closer to the election next year, do you think this is the an issue? >> oh, this is absolutely an issue. and it just piles on top of all the other issues the administration has to deal with. this administration has taken into custody and then let go into the united states something like 2.5 million illegal aliens. this is unprecedented, and it's going to create problems for us years into the future. griff: mark, always great to have you and on set. thanks for coming in on saturday. >> thank you. griff: molly? molly: thoughts and prayers for them. we hope, wish them a speedy recovery. jeff paul, thank you. ♪ ♪ griff: devon archer testifying to the house oversight committee this week with the transcript from the closed-door interview revealing more about hunter biden's business dealings and the extent to which president biden was involved. for more on the legal fallout and what could be next for hunter biden, william jacobson joins us now. he's a professor at cornell law school and the founder of equal protect.org. william, thank you for taking time today. your once you saw -- your reaction once you awe this testimony from devon archer. how significant are hunter's legal woes? >> well, they're very significant. he is being cut a sweetheart deal by the department of justice. that fell apart in court because it was structured in a way that made the judge feel very uncomfortable. she didn't reject it, but she wouldn't accept it, the way it was structured with the diversion deal and a factual recitation that looked like it was written by hunter's hours that might tie her hands, could give him universal immunity to future chargeses. so it looked really bad. and then it all made sense when devon archer testified and the transcript was released which is that hunter biden's scandal is not really about hunter biden. hunter biden's scandal is really about joe biden and the dealings that he had to assist his son while joe was vice president. so if you view in the context of what archer said the proceedings in court, hunter biden almost was let off the hook for everything he's done in his life that's questionable whether it's illegal or not through a deal the judge would not accept. griff: and so if you view the details coming out of archer's testimony, as you said, as dealing as much with joe biden as it does hunter biden, do you believe then a special counsel would be warranted? >> well, i think there's a question right now when it comes to hunter biden whether the department of justice can act in a neutral manner or whether they are feeling pressure to to protect joe biden. certainly the plea deal that they tried to strike with hunter biden leads us to have a lack of confidence in the independence of the department of justice for the son of the president. so i think it's something that's got to be seriously considered, and it probably should be considered. griff: let's drill into that, william, because i was actually the reporter in wilmington when that plea deal fell apart, and i was stunned -- and i'm not a lawyer as you are -- but watching in realtime with judge maryellen noreika there challenging the prosecutor, saying so could hunter biden be charged with things like a fara charge, a foreign agent registry act, charge for the money he got as stated in the deal, upwards of a million dollars from a chinese communist company, ukrainian money and the like, and the prosecutor said, yes. the defense counsel, chris clark said, whoa, we're done here, no deal. then it fell apart. so my question to you is, as we wait for the, both sides to get back to this judge on the plea deal -- because she gave them 30 days -- is there any deal that could be structured now in a plea deal with hunter that wouldn't give the american people the impression that there's two tiers it is of justice system and hunter gets the sweetheart deal? >> i think it's really damaging to her reputation, you know? she has a reported $40 million net worth, and a big part of that comes from the perception she has as a highly progressive, non-body-shaming individual. the allegations in this complaint are absolutely devastating, and it reads like a fabio novel. i mean, you guys just touched the tip of the iceberg. it's serious, serious stuff. now, you can allege anything you want in a complaint. if these allegations end up being true and proven, i think her reputation's going to the take a gargantuan hit. pol moll you know, lizzo's not apologizing, she calls them former employees who have already publicly admitted they were told their behavior on tour was inappropriate and unprofessional. and it's not just one person making the allegation, there are three. your thoughts on that. >> yeah, absolutely. the more people making these allegations, the worse it is. now, the $64,000 question is will she settle this thing quickly or let it play out? the longer this thing lingers, the more potential victims -- and, again, we don't know for certain if these are are victims, but they've alleged to be -- the more that can come forward. and that's a potential huge issues. we've seen so many hollywood stars, singers, actors, people like that, the longer these lawsuits linger, the more people that can come forward and further damage her reputation. molly: the attorney representing lizzo's former dancers reacted to her statement, what lizzo had said, saying this: the dismissive comments and utter lack of empathy are quite telling about her character and only serve to minimize the trauma she has caused the plaintiffs and other employees who have now come forward sharing their own negative experiences. your thoughts on this, their reaction, and how lizzo is handling the situation. >> look, she's entitled to defend herself, and i think the plaintiffs' lawyer wants her to sit back and simply become a punching bag. of that's not going to happen. molly, i think what's really interesting though is when the same allegations that have been made against male stars in hollywood, right, and people who have been canceled, guys like kevin space i, you know, matt lauer, whether the same thing will happen to lizzo. i don't know the answer to that, these are just allegations, so i think everybody needs to take a deep breath and before she gets crucified, let's see if the actual allegations are true. molly: yeah, there's a report in the daily mail that she lost a few thousand instagram followers, but she has 13 plus million. we'll see what happens. you talk about the allegations, really graphic stuff in all honesty, but some of the accusations also claim that lizzo raised thinly-veiled concerns about her dancers' weight gain. is that particularly problematic given, you know, her body positivity image?
