>> will you talk to us on the way back, mr. president? >> probably not. >> griff: prosecutors deciding not to indict him for efforts to overturn the numbers there. trump seems to be embracing this, writing this on truth social. i need one more indictment to ensure my election. now the next court day is august 28th, we expect the judge to set a trial date sometime next year. guys, back to you. >> steve: thank you, griff. there you go. >> brian: that's all we have. >> carley: never going to gettole. >> steve: set the scene yesterday in the courtroom. imagine donald trump at the defendant's table. the prosecution is according to "new york times," 12 feet in front of donald trump and 15 feet to the right is prosecutor jack smith. now according to the "new york times," trump looked over at jack smith a number of times and never met eyes. however, politico has a view, inside the courtroom, donald trump, jack smith and a historic glance. smith said nothing audible, but repeatedly shot glances at trump, who shot them back until their eyes briefly met. >> carley: they did briefly meet apparently and this whole arraignment was 45 minutes to an hour long. the judge and president trump were respectful to each other. historic nature of this was heightened by how mundane this truly was. >> brian: did anyone bring hung jury up or what about senator menendez, he was overcharged by jack smith in court. cases that have gone arwry. fo formerly of -- nobody talks about jack smith's record. to think jack smith would be chosen by merrick garland knowing he had to bring him back to do it is bizarre, his track record is not strong, unless goal was to keep donald trump in court and off the campaign trail and derail his hopes of getting the nomination and wening the presidency. jack smith has fans at other networks, watch. >> they are sitting across from each other, jack smith competed in over 100 triathlons and was reportedly hit by a truck and 10 weeks later, he ran another triathlon. this is a man of grit and determination and what we have seen in these indictments is just a sliver of what they know in his prosecutorial team knows, right? >> his exercise correlates to his prosecution and strategy. >> steve: you have color about the prosecutor, look at his abs. >> carley: they did this with the subway sandwich, people were saying metaphor for how he was casual and felt confident and he was eating a sandwich. >> steve: there he goes, toward the sandwich shop. the judge said these are conditions of your release. keep in mind, i can throw you, we will throw you in jail if you do the following. you have to show up for your court dates and said don't commit any crime, do not intimidate a witness or obstruct justice. i heard a prosecutor say i've never heard admonition from the bench and it was directed at donald trump and for the first time ever we thought, wait a minute, donald trump could wind up in jail before the trial, that's new. >> carley: there was conversation about whether or not a judge would issue a gag order. can you imagine if he can't speak about this trial. that is all he does. his message is they are not coming after me, they are coming after you. i am just getting in their way. when he says that, people believe it and they feel he is standing up for them. a lot of people may see the former president as divisive, but when something like this happens and people weigh how the biden family is treated versus donald trump, they think, i'm going to stick it to them and they support the former president. >> brian: what michael waltz was saying during the break, a lot of people were never trumpers, they are so angered about all this, they flip to his side and that could be reflected. governor desantis said this is weaponization of government. stick donald trump in court for six months and joe biden can stay in his basement. people go, look how old he is, look how inept heat is, he wouldn't be able to get away with that in a dead heat race, including with barack obama. the only way joe biden could get away with not campaigning is say, i'm president and this guy is not doing anything anyway. donald trump would do 18,000 people rallies per night. the calculus has changed. i would love to see interviews with donald trump and not talk about 2020. >> steve: that would be great. >> carley: look forward not backwards. >> steve: look at joe biden and the way they are prosecuting their campaign is what we heard the campaign was going to do six months ago, let the chaos on the republican side remind people of the alternative if they vote for joe biden. in the meantime. three, two, one. you ready?
