under president biden's justice department. the latest round of charges are coming out of special counsel jack smith's investigation into the 2020 election and the january 6th attack on the capitol. the former president now faces new federal counts including conspiracy to defraud the unite states, conspiracy to obstruct official proceedings, obstruction of official proceedings, and conspiracy against the rights of the pe people. well we now know that special prosecutor jack smith's case against the former president. what is unclear is how the unprecedented set of accusation will hold up in indictment hunge obviously this is a very seriou issue. but it also reminds me that we talk to jonathan turley and a mccarthy and the legal specialists over the course of all of this, they have always felt that this actually will be very difficult to prove. there's nothing in this indictment to go to the issue o incitement hunger they are very broad in terms of the accusations that are made here for conspiracy and obstruction, and i think it's a big question about whether or not it will hold up. and we can talk with the judge in a little while. but one of the other things i think is at issue here is the issue of presidential powers. what does the president have th right to do? what does he have the right to say? so you are looking into statements that the president said he would be convinced by his attorneys, and obviously listen to attorneys she wanted to listen to because other people were telling him the exact opposite. but is there a crime here? that is the question wrong and one of the fascinating things t me is that there had been so much legal peril and legal activity around all of this tha what you find voters doing, 7 71 percent of republican voters say that they think that they need to stick by president tr trump. they say it is feeding into his strength. and because of the two-tiered justice system that mark meredith was just reporting on, i think people have acute have become somewhat inured to all this, throwing their hands up i sankoh looking let's have an election in 2024 and let the people decide. so i don't think that politically this changes 43-43 on the head-to-head. that's a national poll of registered voters. is not that informative, i don' think at this stage of the game. but when you break it down to the independent voters biden is an independence order 2-37. this is an area that i think th nominee, if he becomes the nominee, president trump would really have to focus on these independent voters. which is why i think will be extra for them to show up at th debate on august 23rd, because think it's a real opportunity t reach out to those independent voters in a way that is difficult to do in other environments. this obviously shows a huge lac of enthusiasm. i'll say one more thing: every election i have covered the summer before the year of election year everything might look like it's all sort of shaping up to be what it's goin to look like. and every time there is a switcheroo because there is something that happens that is unexpected. and 90 space that we will see something. i cannot predict what it is, bu that changed the game in one wa or another but if there's a hug hunger for someone else, and ye none of those people seem to be cutting through at this point. can any of them come through?
