20/20 election. no surprise that former president coming out swinging against the charges and the special counsel. welcome to our brand-new hour of "america's newsroom." i am dana perino. what's my name again? >> dana murray. what's my name? >> build something. >> i can't remember. >> it's after royalty. as william and his george barrett >> i was going to say charles. >> here we go again now. that third indictment of trump under president biden's justice department. burned former president charged with 4 felony counts in a sweeping 45-page indictment. critics complain it is a crusade against free speech. >> my concerns me as many of the people celebrating their second indictment are just simply dismissing the implications for free speech. those are quite dire and real. this is criminalizing disinformation. but the department of justice is saying is that we recognize that politicians can save most things but just not trump because he was told they were false. >> begins anew -- brad baer has got the big picture in a moment coming up. >> our chief washington correspondent is live in d.c. on the political aftershocks being fell far and wide. >> good morning. florida governor ron desantis is calling for two reforms. the home districts of former president trump. washington, d.c., is a swamp and it is unfair to have to stand trial before a jury that is reflective of the swamp mentality. former vice president mike and says mr. trump is entitled to the presumption of innocence. but then added "anyone who puts himself over the constitution should never be president of the united states." south carolina -- while protecting democrats. "what we see today are two different drugs of justice. one for political opponents and another f for the son of the current president. as one candidate saying if you are going after a former president at potential future president, the standard must be higher. >> if you are going to try to indict a political opponent in the former president in the middle of an election, it better darn will not be based on an unprecedented, untested flimsy legal theory that is exactly what we have here which is dangerous. >> three candidates have come out blasting the former president's actions with governor chris christie saying "the events around the white house from election night forward are a stain on our country's history and a disgrace to the people who participated. this disgrace falls the most on donald trump. a trump campaign spokesperson said trump will not be deterred by this "disgraceful and unprecedented political targeting." >> thank you. >> congress -- that is not stopping lawmakers from weighing in. now from the hill with more today. good morning. >> the condemnation came in pretty fast and furious from the republican side. let's start with house speaker kevin mccarthy who came to trump's defense very, very quickly tweeting this. it is the doj's attempt to distract from the news and attack the front runner for the republican nomination. house judiciary chairman jim jordan adding when you drain the swamp, the swamp fights back. president trump did nothing wrong. republicans are taking particular issue with the charge of conspiracy due to probably u.s. when trump disputed the 2020 election results, they are saying that everybody from joe biden to nancy pelosi, they all made similar disputes back over the 2016 election. they are also raising questions about the timing of this. coming just one day after the bombshell devon archer test testimony. >> the american people see what's going on. whether or not this is a weaponize department of justice trying to divert attention away from biting corruption. for the oversight committee and plagiarize them. only they put them down for donald trump instead of joe biden. it is a joke. it is an absolute joke. >> democratic leaders releasing a scathing joint statement here accusing trump of personally orchestrating the attack on the capital. a call at the culmination of a months life and long criminal plot led by the former president due to fire democracy and overturn the will of the american people. democrats are calling for no outside interference as this case moves forward. several house republicans i can tell you are actively working to strip to undercut special counsel jack smith doj funding. any such measure would most certainly fail in a democrat-controlled senate. >> thanks. reaction there on capitol hill. thanks for that. >> "the new york post" covers shows this. it is conspiracy to defraud the united states with the photograph of president trump. this broke late yesterday afternoon. you had president trump's lawyer on this matter on special report last night. he was making the case that you can criminalize thoughts. i wonder as you have been able to think through this indictment overnight where you said to this morning. >> good morning. it is william bret baier. that case right after the special counsel jack smith made his case to the public. and he essentially said those two things. one is this is an effort of special counsel to minimize political speech and it's going to be impossible to prove what the president thought as far as web about 2020 election wasn't bag stolen stolen in his mind or not. interestingly, he also said one of that event strategies is going to use the power of the subpoena that he will have two relitigate that 2020 election. whether he will be allowed to do that whether the judge will give leeway to do that, held at the events out is going to be fascinating to see. >> we were talking this morning. we talk a lot. >> it will not be tired of hearing that. >> i don't have this printed out for the audience have to bear with us. indictment said mr. trump broke the law when he acted on the following lies. we will take that one of time for those i conclude to hunt fraud. by that attorney was arguing last night is that trump thought there was fraud. look into that. is that against the law? that is what a jury has to decide. work with conspirators to stand up substitute electors in seven states. if you are working with them, defined substitute electors. it is not against the law or not? i don't know the answer. try to persuade the vp that he had the power to refuse that counts on the electoral votes. you may think all this stuff is shady stuff. no republican candidates and republicans are going to argue that does any of this amount to a crime? that is i guess when we are going to find out. >> exactly. i agree. it is really sweeping and what they are trying to do. a lot of legal experts say it seems like something else hasn't been dropped. we saw in the document states that there was this superseding indictment that came later that added charges. is it possible that the six coconspirators listed there, they are not charged. but they are making an effort to negotiate with them. for that they possibly testify against the former president. they drop others superseding indictment as they come after that. it seems like it's a tough hill to climb. in this case to make what you are just talking about. because it is politicized speech about concerns about the election. what he did, how he did it. there were 60 plus cases filed by trump attorneys across the country. there were were certifying elections by republican governors and republican secretaries of state that look at things and had audits. if there is, there was now very found enough evidence, fraud to overturn one state let alone 4. they are going to try to relitigate this. i will be fascinating. the judge in this case is tough for the defense. she is the one that open the files of the white house for the january 6 committee. >> i was thinking about it overnight. that was all happening in breaking news mode. the thing august 23rd for the first debate. you and martha are going to be the moderators. if i am resident trump and i have not committed to the debate, i might be thinking, i want to be at that debate to defend myself. i imagine he will be able to be in that room with all of his competitors and be able to ask each one of them, are you with me or are you not with me? mike pence might be on the stage as well in terms of this indictment being over the line. i don't know how that stands right now. i'm just thinking from a strategic standpoint if you have that commanding of a lead and you want these people behind you and you know the republican party faithful is behind you, why when you want to try to put it away that night? >> i totally agree. i think it would be fascinating if that happens. i don't know if it will or not. vice president pence statement yesterday that no person got but himself above the constitution on that person should not be president again. most of all of the other statements that with two-tiered system of justice and all of these candidates are walking a line. they know as you point out the g.o.p. primary voters look at this and say this is a raw deal. in fact it is a sympathetic figure in a lot of republicans are goals, the former president is. that is a tough question for that debate. >> he is on with martha on "the story." >> just think. you could have been a bell. because what happened and what did your dog do? >> so he is trained to specifically alert when my heart rate gets to an unsafe level. in that moment, he can smell that smell and he immediately jumped into action. he jumped on me and warned me and told me to sit down which i did. his responses he would go get my medication, go get water and pretty much anything i need to. he is willing to pick up and go. he has such a drive that nothing will get in his way. >> dana: how does he know your heart rate is up? >> it is all so when your body goes through a stressful situation and such a sudden change, your body gives off a pheromone. you teach the dogs how to pick up that certain pheromone. and that smell, they have that reaction. >> bill: that is amazing. so, he cut the bottle to help you, right? a bottle of water. >> yeah. >> bill: then he gave you deep pretherapy. what is that? >> what is pressure on the legs and help circulate blood flow. a lot of us, we have to deal with lack of blood flow in her legs. that is part of why you have fainting episodes is because of the fact that we just have blood flow. all of a sudden, all of our blood just dropped spirits of the deep pressure therapy allows for blood flow and this helps kind of relax and keep everything calm, you know, kind of in the heat of the moment. >> dana: how many years did he go through training in able to be able to do all of this? >> he is four years old now. i got him at eight weeks old and i did all the training myself. so it has been off and on for years. >> bill: that is amazing. >> dana: german shepherds are remarkably smart but this is an incredible story. for people out there that might have a story that might have a condition where a service dog can help them, what do you recommend and how do we go about finding them? >> you can look into certain organizations in your area. it is very difficult to find a service dog. so, a lot of research and, you know you can find a trainer that will help you train. it takes a very specific temperament of dog and a very specific mind-set of the dog. so you have to be cautious what you pick out. but as long as you have a good trainer and a good organization. >> bill: you picked a good one. >> dana: hey, bailey, good boy, bailey. see, he knows spirit lady, who has that lady? thank you, katie, thank you, bailey. >> harris: we begin with a fox news alert a third indictment for former u.s. president donald trump. but when it comes to presidential biden's family namely his son hunter, nothing but a crumpled suite heart plea deal. a resounding chorus now claiming a double standard, a two-tier justice system one for the biden polis and everybody for the right side of the how. i am harris faulkner and you are in "the faulkner focus," special
