committee about the biden brand. it's unclear exactly what the first family is selling but it appears to be worth a lot. the senior national correspondent kevin corke is live in dc with the very latest on today's block buster appearance. kevin good evening. >> reporter: good evening my friend. former hunter biden business partner devon archer testified that, yes, hunter put his father, then vp joe biden, on speaker phone while meeting with foreign business partners at least 20 times. archer making those claims during testimony before the house oversight committee al callingss which comma mid a month's long investigation which republicans say has yielded evidence related to the biden family's alleged foreign business schemes, including that the biden family and its associates created more than 20 shell companies and received more than $10 million from foreign nationals, again while joe biden served as vp. in a statement, oversight chair james comer says devon archer's testimony today confirms joe biden lied to the american people when he said he had no knowledge about his son's business dealings, and was not involved. joe biden was the brand that his son sold around the world to enrich the biden family. but over at the white house, pursed lips and eye rolling indignation. house republicans keep promising bombshell evidence to support their ridiculous attacks on the president but time after time they keep failing to produce any. meanwhile a source familiar with the testimony tells fox digital that hunter along with top executives at burisma called the obama administration to ask for help by firing a ukrainian prosecutor investing the company. of course that call they argue came just before then vp joe biden made his trip there. of course, a lot to still unpack in this back and forth. house republicans tonight, trace, tell us there's more to come. we'll keep an eye on it but for now back to you. >> trace: kevin corke live in dc. let's bring in deputy assistant general john yoo and kash patel gentlemen welcome to you both. kash to you first former fbi official who led the fbi's criminal investigations told me this about the biden brand. watch. >> you sell access or something of value and you get something back in return, but it's not an express quid pro quo, it's just an understanding, but if you can match up the services within a reasonable period of time with the thing of benefit, in this case $10 million or whatever it is, then you have bribery. >> trace: i guess if you put joe biden on the phone kash it proves you have access right. >> reporter: look as a former national security prosecutor who handled a lot of fraud cases let's contextual eyes this. if you put the former vice-president on the phone where his sons are dealing in foreign nations with millions of dollars in remunerations and he calls to say hi, that is a flex, a fraud, a corruption. look at it this way if president donald trump was in the white house and don jr. or eric were working at a foreign international company based out of ukraine for seven figures to lobby the us government and put president trump on the phone we wouldn't even be having this conversation or wondering when the propers cues is coming. this is exact will i the nature of what foreign agent registration's act is about and we're seeing why there's a two-tiered system of justice. the question isn't really whether joe biden was involved, he was. the question is, why hasn't hunter biden been prosecuted for violating the same foreign agent registration act so many others have been prosecuted for like paul manafort and company. >> trace: it's a fair argument, if you had access to the vice-president doesn't matter where you are or what you're selling, it matters the level of involvement you have. what do you think about this? >> that's a good point trace and kash makes an excellent point. that if you are really selling influence and getting some kind of money in exchange for above benefits like getting a prosecutor in ukraine fired from american pressure, then you have the painingings of a bribery case. now, we've got to be clear that we don't know yet. we've got to take the investigation slowly. but at least what devon archer's testimony makes cheer now and it's worth emphasizing is that joe biden is now a witness, not scombluft hands-off guy watching his son get in trouble, he's an actual witness, and that is why we need to have a special counsel, because it's impossible for the justice department to interview and investigate someone who's the head of executive branch. >> trace: but it's selling what is what i keep asking kash. the whole concept here is $17.3 million, we learned from the irs whistleblowers came the bidens way. i go back to the old dire straits song, money for nothing. i don't know what in the world you're getting for all this. >> money doesn't lie and that's why i think the suspicious activity reports that chair man co-mer's committee is after and the banking records show us that the millions of dollars, i don't think we have to show exactly what tend point was, just that there was a transaction, a foreign entity, a ccp affiliated company or ukrainian company paid an american company under devon archer and hunter biden's auspices to conduct government negotiations of any kind. that is a foreign agent registration act maneuver. and whether or not it led to bribery or fraud, that's another criminal act. so i think the department of justice has miserably failed the american public for not even initiating this action or at least halting it which would be even worse but that's what gray and garland have done with the two-tiered justice steam quick question on former president trump, the new allegations, january 6th would be the big fish but very hard to prove, the thinnest of cases. your thoughts? >> ar making a good point again trace. the january 6th case to me is the most important from a public interest perspective. we had an attack on the capitol are the count ever of electoral votes. but what showed from the hearings, there's no link between president trump on the one hand and the riders. so now we're hearing stories that the special council here is thinking of very aggressive interpretations of federal untried in our history to try to get trump which guaranties is going to take months and months if not years to resolve the issue. >> trace: yeah, these cases are all lined up. kash, john, thank you gentlemen, appreciate it. >> thank you so much. >> thanks trace. >> trace: in oakland california the naacp is sick and tired of criminals not being held accountable saying it's not racist to want safety and the statement is getting big-time national attention. matt finn is live with the latest this. good evening. >> good evening trace a growing sentiment across the country people fed up with violent crimes in their neighborhood. tonight's story takes us to a packed meeting in the bay area in california where oakland residents say they've had enough. >> while i'm driving, and pull me out of the car at gunpoint. what are we doing to address this? and how do we solve this? nobody feels safe. >> they just drive around and pick a victim and it's just, it's getting scary. i'm fearful. >> pamela price needs to understand that there must be consequences when there are a soltice on people in this city. >> reporter: those people are blasting alameda district attorney pamela price for the rise in crime in the city. even naacp is slamming price writing in a scathing statement failed leadership including the movement to defund the police, our district attorney's unwillingness to charge and prosecute people who murder and commit life threatening serious crimes have created a hey day for oakland criminals. at that time meeting price was asked in particular about not charging nine juveniles recently taken into custody for robberies. price says the victims were not able to id their attackers and so far seasoned deputy says they can't prove their case. trace. >> trace: matt finn live in studio. let's brick in district attorney john mckinney, great to have you on, the naacp of oakland we the following, there's nothing compassionate or progressive about allowing criminal behavior to fester and rob oakland residents of their basic rights to public safety. it is not racist or unkind to want to be safe from crime. no one should have to live in fear in our city. i mean, it's spot on, john. your thoughts. >> it absolutely is and it's very refreshing in that this is coming from the naacp, a tried and true civil rights organization, with a long history of supporting people and having a core value of protecting the community going back, you know, the 1960s civil rights movement. this letter is nothing short of a you cry for help. and, as a black man and a prosecutor, i had a visceral reaction to leading this letter because you can feel the frustration in every word that was carefully crafted into that letter. >> trace: you're exactly right. i want to play some more sound, matt finn played a little bit of this. i want to play a little more of the residents because john talking about the visceral feeling. people are fed up. watch a couple more sound bites. ten seconds and we'll get back to you. >> they just drive around and pick a victim. it's just, it's getting scary i'm fearful. >> how do we stop this hamster wheel of crime? because that's really the question. >> trace: i mean, people in oakland are fed up. people across california, across the nation, are really speaking out the same way because this has gone on long enough. >> absolutely. i mean, we've been watching the collapse of law and order in a civil society for quite some time now. it is a good sign that in san francisco they voted out a progressive da, dean, and replaced him with a sensitive district attorney in brook jenkens. i think this letter from the naacp is yet another sign people are fed up and want change. >> reporter: you talk about brook jenkins getting push back in san francisco, let's put the video up because of this carjacking, violent carjacking by two suspects. the video went viral, car goes down up and over a stair rail and then lands and then you have to two car jackers who escaped, later arrested and they are not charged. they are let go, john, because they said, well, we just didn't have really enough witness participation, we couldn't hold them. and you think how is that possible in san francisco? >> well, i think this case is still under investigation. you know, prosecutors are ham strung with a limited amount of time to make an initial decision and all the facts can't be gathered in that time period, then we have to request further investigation. i think we might see this case come back and, if so, we should have a lot of confidences in this new da up there. >> trace: do you see, when you see these kinds of carjackings, and you tack about brooke jenkins do you see changes coming in san francisco because seems to be we look look at the video all the time and see cases like this, seems to be they're trying, they're scraping and scrapping but they don't have the resources to you will p it off. >> right, she was a pointed first and then she got elected so she hasn't been there very long but i do think we are seeing incremental changes, hearing a different attitude, different tone even from the mayor of san francisco. the people there are resilient. and i think we're going to see san francisco pull out of this. now, for us down here in southern california, we have to pay attention to what's going on up north, both in san francisco and alameda county so we can take care of the progressive da george gascón who we have down here. >> trace: john great to have you on as well. >> thank you, thank you. >> trace:. >> trace: first up in tonight's crime crisis round up another weekend of gun violence in chicago, nearly 50 people shot in chicago the past few days including nine women at a birthday lieu ow party early sunday morning, one woman a 24-year-old mother of two shot in the face and later died. meantime illinois governor jb pritzker signed more than 130 bills just on friday. one of those new measures will allow non-citizens to apply to be a police officer. a hospital in columbus mississippi was on lock down for about an hour this afternoon after four people were shot nearby. police believe people in two vehicles were firing at each other and the shooting victims came from those vehicles >> new york city is turning out to be a very bad sanctuary city. the city mayor is telling illegal migrants not to come. they can't house the ones already there and now the streets are fill wind asylum seekers, jackie ibañez is live in our new york city news room with more on this. jacqui good evening. >> reporter: good evening trace. over 50,000 migrants are currently in new york city's care with even more arriving on a daily basis. many of them have remained camped outside the roosevelt holt here, you can see. the hotel opened back in may as the city's main arrival center. now dozens of migrants have been told there is no space inside, and many waited in a line. you can see wrapped around a city block, while others, they slept outside. >> we feel bad. everybody is not happy. i'm telling you, the people are not happy. you see too many people sit outside, no drink, no food, anything. >> reporter: today mayor eric adams says the city has run out of space and the current situation is not sustainable. >> it's not going to get any better. from this moment on, it's downhill. there is no more room. >> reporter: the mayor again repeated calls for more assistance from the state and federal government and is continuing his fight against the state's so-called right to shelter law. trace back to you. >> trace: be careful what you wish for, jackie ibañez live in new york. jackie thank you >> new polling shows former president trump crushing ron desantis his closest contender by nearly 40 points. meantime the florida governor is on defense about how he is running his presidential campaign. we are joined by chief political anchor and host of special report bret baier who had an exclusive one on one with governor ron desantis. bret, it was a great interview. thank you for joining us. we appreciate it. i found it compelling and i want to play this sound bite. this is the governor talking about trump in the general election against biden. watch. >> you don't believe the former president trump could win a general election against joe biden. >> i don't think so. because i think that there's too many voters who just aren't going to vote for him going forward. the polls that come out, i beat biden in georgia, trump doesn't. i beat biden soundly in arizona, trump doesn't. those are just the realities. >> trace: did you find, because it appears that, you know, the governor says this a lot, bret, that the whole, it doesn't seem to me like biden and trump, it's not a match because biden is going to beat trump. do you think that's enough for governor desantis in this? >> you know, trace, it's interesting. good evening. i think that the governor is trying to make his stand here. he's resetting his campaign. he fired a third of his campaign workers. he's having some ires, you know, the media are covering all the issues about fund raising et cetera and he's here in new hampshire to say, listen, this is what i'm really about. i pressed him on a lot of these issues, but his main point is that donald trump cannot win a general election. and when republicans realize that, and he said state by state they will, that he will gain in the polls. he doesn't think the national polling is accurate and he believes that he's going to fight it vote by vote in new hampshire living rooms and iowa farm houses. >> trace: we're going to talk about the polls in a moment but i want to go back to your interview. ron desantis's campaign clearly has been criticized. as you point out he's made some changes and you talked with him about some of these course corrections. watch. >> i'm not a political operative. i'm not a campaign proechlt you know, you set out the vision and you execute on it and if it's not being executed you make the course correction. >> trace: is it just course correction at some point the candidate has to stand up and say the candidate also has to gain some traction in this. >> yeah, and, no, trace i read to him a quote from ed rollins political operative we know well who was with former president trump, jumped to desantis, was running his political action committee and came out with this really scathing quote in the rolling stone magazine saying that essentially he's not warm and fuzzy and it's the candidate himself and it's not the campaign to blame. he pushed back on that. he said that he's going to stand by his principles. he doesn't think that he's all about culture war. there's much more to him and he points to his election last time in florida, how he won places like dade county, miami dade county, that were historically republican. you couldn't do it. i think he's starting to get back to that campaign style and less about focusing in on those culture issues that he has at the beginning of the campaign. >> trace: yeah, he needs to pick up a win or two because the new york times sienna poll, put this up on the screen has trump at 54%. just one poll, you have desantis at 17%, everybody else is losing. it seems the more that trump is indicted, has legal troubles his numbers keep going up and everybody else's just keep going down. >> yeah, of the republicans who say former president trump in this poll, the new york times poll, says former president trump committed one or two serious felonies, of those, 22% say they're still going to vote for him. imagine that environment being an opponent trying to get traction even as the president is facing a lot of legal woes and may face more indictments each time his numbers have gone up. so i think you're going to see a lot more head on head, you know, confrontation, but desantis says it's not personal, he's going to make it policy. >> trace: lastly karl rogue told me today people will realize trump has too much baggage and they're not going to vote for him. is that a fair assessment? >> i don't think so. i mean at least right now that's the pitch that all these other candidates are making but if you look at what people are saying, it's not tracking in anything that we're seeing. now the former president's going to make a decision whether he goes on that deate stage in milwaukee or not, hasn't made it yet. but it is going to be fascinating to see, as this develops, whether he feels like he needs to ghat the fight and kind of push people away, or he's just going to hold the lead. some political operatives say, you know, it's like an nba team that goes on prevent defense. sometimes, you know, somebody gets traction and they make some baskets. so we'll see what he decides. either way i can tell you governor desantis is doing a full reset of his campaign and we'll see if that has traction, too. >> trace: yeah, it was a great interview bret baier thank you for joining us. we appreciate it. >> you bet. >> trace: coming up learn more about the american nurse and her daughter kidnapped in haiti while working with a faith-based ministry. and later in the nightcap are you often late for thing like doctors appointments or plans with friends?
