judge really wanted clarity on a lot of things. your thoughts to on how things played out in court and if the judge made the right decision to essentially put a pause on everything for now. >> i think the judge did make the correct decision. first of all, there was disagreement between the doj lawyers and hunter biden's lawyers on how far immunity stretched. the doj lawyers were saying, well, this takes care of the tax and drug and gun issues but not his failure to register as a foreign agent under the fara statute. whereas hunter biden's lawyers were saying, oh, no, this plea deal takes careful all possible criminal charges against him -- care of all possible criminal charges. the other thing was this bizarre diversion agreement that was put in on the possible gun charge, the essence of which said if hunter biden didn't comply with the requirements of the diversion agreement, rather hand the justice department -- rather than the justice department then filing criminal charges against him, they were going to give it to the judge to decide what to do about it. and the judge said, uh, there's a constitutional problem with that, separation of powers. i'm not a prosecutor, i can't make a decision like that. and when she asked the doj lawyers, is there any precedent for this kind of an agreement, they said, well, no, there isn't. molly: yeah. you know, judge noreika really said that he didn't pay between $1.1-1.6 million, yet they're charging him as a misdemeanor, and they're recommending probation. these very same lawyers just a couple of years ago prosecuted a former baltimore police commissioner for exactly the same thing, except that commissioner didn't pay between $40,000-100,000 in taxes, a fraction of what hunter biden evaded. they recommended jail time for point in time may not necessarily come to pass? you know, it could -- could they, could there be more of an intertwining now? >> oh, or yeah, they could. and remember, there was an amicus brief filed with the judge in this case by the house ways and means committee asking them to take a look at the irs whistleblower's sworn testimony that said that doj did everything they could to stop this you had the police officers putting all this time in there. i guess my question to you is what happens the next time somebody comes forward and they say they were kidnapped? will the police investigate it as a aggressively? will they suspect that the person is lying? it's not a victimless crime, i hope they throw the book at her because she deserves it. by give and i want to to get into the charges. just for our viewers who may just be hearing about this, what set this off was a 91 # call on the evening of thursday, july 3th, when carlee russelling made this call. listen. >> hi, i am on interstate 459, and there is a kid that's walking by theirself. >> how old do they look? >> yeah, you know, alabama has a felony disorderly conduct charge, and i think that's what she deserves because she's not going to get prison time. she has a clean record. at least according to her side, this is going to be a victimless crime. i think alabama legislature needs to change the law. it won't apply to her, but i think this needs to be a felony in all states. if you report a crime and it really wasn't a crime, that should be a felony punishable by five years in prison. there's a to prophylactic, depersistent impact by charging these people with felonies and having them serve jail time. and already her supporters are coming out and saying, gee, she shouldn't spend time in jail? that that's b. suspect, she should. griff: i hope somebody in alabama's legislature or governor might be watching, that's a good suggestion. i guess in the last 30 seconds or so, what impact this has on people who are real victims of kidnapping? >> griff, that's the real damage. jussie smollett did the same sort of damage here in chicago when he claimed he was racially profiled and targeted. it cast suspicion on real victims, and that's a problem. that's an issue. that's not something we want to see because there are so many real victims that they shouldn't be questioned when something happens. griff: yeah. and, you know, the next time someone starts thinking about doing something like this, hopefully they will think twice because the pain they cause and the resources they waste, like hoover's police chief laid out so eloquently. andrew, thank you for taking time on saturday. have a great rest of your weekend. >> thanks, griff. griff: molly? what unfolded this week where the hunter biden plea deal seemed to dissolve right before the eyes of journalists. the expectations that it would take minutes, it goes into hours, and it seems like the judge really wanted clarity on a lot of things. your thoughts to on how things played out in court and if the judge made the right decision to essentially put a pause on everything for now. >> i think the judge did make the correct decision. first of all, there was disagreement between the doj lawyers and hunter biden's lawyers on how far immunity stretched. the doj lawyers were saying, well, this takes care of the tax and drug and gun issues but not his failure to register as a foreign agent under the fara statute. whereas hunter biden's lawyers were saying, oh, no, this plea deal takes careful all possible criminal charges against him -- care of all possible criminal charges. the other thing was this bizarre diversion agreement that was put in on the possible gun charge, the essence of which said if hunter biden didn't comply with the requirements of the diversion agreement, rather hand the justice department -- rather than the justice department then filing criminal charges against him, they were going to give it to the judge to decide what to do about it. and the judge said, uh, there's a constitutional problem with that, separation of powers. i'm not a prosecutor, i can't make a decision like that. and when she asked the doj lawyers, is there any precedent for this kind of an agreement, they said, well, no, there isn't. molly: yeah. you know, judge noreika really seemed to be seeking clarity about this. >> yes. molly: and there was an indication almost that all of this seemed to be a little bit unusual, the diversion agreemen- >> oh, it is. molly: -- the tying of the taxes and the gun charges. wait, clarify for me just how unusual all of this is. >> oh, extremely unusual: for example, the two doj lawyers who were in court, the tax charges -- remember, they said that he didn't pay between $1.1-1.6 million, yet they're charging him as a misdemeanor, and they're recommending probation. these very same lawyers just a couple of years ago prosecuted a former baltimore police commissioner for exactly the same thing, except that commissioner didn't pay between $40,000-100,000 in taxes, a fraction of what hunter biden evaded. they recommended jail time for that commissioner and, in fact, he got jail time. given him probation so he just walks away from this? that is, that is very unusual. molly: you know, before we run out of time, i do want to look ahead and get your insightses into what potential testimony from devon archer, a business partner of hunter biden, before congress, what that could mean. that's expected to the happen on monday. we are expecting to get a transcript which should be pretty interesting. your thoughts. >> well, look, there's been a lot of allegations that joe biden actually not only knew what his son was doing, but actually was participating in and profited from the business. and obviously those are the questions that are going to be asked of hunter biden's former business partner who would have intimate knowledge of that. and this could be devastating testimony against, you know, not just hunter biden, but against joe biden himself. molly: could it affect the hunter biden plea deal which at this point in time may not necessarily come to pass? you know, it could -- could they, could there be more of an intertwining now? >> oh, or yeah, they could. and remember, there was an amicus brief filed with the judge in this case by the house ways and means committee asking them to take a look at the irs whistleblower's sworn testimony that said that doj did everything they could to stop this investigation and to minimize it. and i think the judge needs to take that into account. molly: very interesting. hans von spakovsky, thank you so much for joining us this weekend, we really that that's b. suspect, she should. griff: i hope somebody in alabama's legislature or governor might be watching, that's a good suggestion. i guess in the last 30 seconds or so, what impact this has on people who are real victims of kidnapping? >> griff, that's the real damage. jussie smollett did the same sort of damage here in chicago when he claimed he was racially profiled and targeted. it cast suspicion on real victims, and that's a problem. that's an issue. that's not something we want to see because there are so many real victims that they shouldn't be questioned when something happens. griff: yeah. and, you know, the next time someone starts thinking about doing something like this, hopefully they will think twice because the pain they cause and the resources they waste, like hoover's police chief laid out so eloquently. andrew, thank you for taking time on saturday. have a great rest of your weekend. >> thanks, griff. griff: molly?
