across the board for the democrats based on inflation, rising crime and that open border issue towards mexico. it could be that the courts might provide a bit of relief for the biden white house in some ways. a judge's decision keeps title 42 in lays for now. that came late yesterday. that could change next month. the supreme court is currently picking up the remain in mexico policy to question whether or not it is supported by our federal laws. we'll break this down for you in just a moment with the arizona attorney general. bill melugin is standing by at the border as well and mark meredith is at the white house. we break this down with mark. hi, mark. >> good afternoon to you. a few minutes ago, the white house sent fox a memo written by the homeland security secretary, alejandro mayorkas, that outlines what the government plans to do when title 42 is lifted. it says the government has been prepares for months if not years to do this by making sure there's supplies and personnel on the border, they realize there's going to be a large influx of people and they realize there's a lot of work to be done and the world is going to be watching. this memo just came out. we are also waiting to see what happens with title 42 from the white house press secretary. as you mentioned yesterday, a federal judge in louisiana decided to pull a temporary pause on the lifting of title 42 because he wants to see more time about what is going on with this case. the white house insisted the cdc that is calling the shots whether to lift this and this is not being done by the department of homeland security but instead being done in coordination with them. either way, we've heard from a number of republican lawmakers that are urging the white house to reconsider. among those speaking out, senator mitch mcconnell. >> he wants to rip off the one remaining band aid that is preserved at least some shred of law and order. >> to me at this juncture, the conclusion is inescapable. that the biden administration believes in order borders. >> the white house is under growing pressure to find a solution that would pause the push-back from the republicans and also from a large number of democratic lawmakers that fear this could be a disaster before the mid-terms. but the spanish caucus says now is the time for title 42 to be lifted once and for always. >> we made it very clear that the title 42 policy is a public health emergency policy that was instituted under the trump administration during his hate and fear anti-immigrant agenda. >> as i mentioned, the white house getting ready to face questions this afternoon. the real show will be thursday on capitol hill when the homeland security general faces questions. there's a lot of people curious about what the department is doing and what it expects to happen once title 42 is lifted. >> martha: less than a month away and he will be on the hot seat for sure. thanks, mark. so let's bring in republican arizona attorney general mark bernovic. his state and others are suing the government over title 42. he's running for the gop primary for senate, and the winner will face mark kelly, which is a closely watched race. thanks for being here. i'm wondering if this decision yesterday by this federal district judge in louisiana that keeps title 42 in place at least for now isn't behind the walls of the white house a little bit of a relief for them? >> yeah, thank you, martha, for having me on. looking the consequences of a broken congress have been dangerous or devastating our community for years. now as a result of these failed biden administration policies and a democrat in the white house, people are literally dying. i can't worry about the politics of whether title 42, our office arguing that case, our office leading lawsuits whether that somehow helps the biden administration politically. i'm trying to protect hard working americans and hard-working arizonians about illegal drugs coming into this country. title 42 is one of the last tools in the tool box to keep the system from being overwhelmed more. >> martha: when you listen to this memo that mark meredith just reported on from alejandro mayorkas, the head of the dhs calling for more supplies and personnel to the border, does that give you any sense of confidence at this point? they've been -- a lot of folks and even democrats say we need to see the plan. how is this booing to work? >> this is cheap political theater. the reality is, you can hire more border patrol agents, but when you have an administration and enablers like cartel kelly that are allowing them to decriminal and incentivize people breaking the law, won't matter at the end of the day. yeah, we need more agents. should it be troubling to taxpayers that the biden administration wants to spend more money on green energy and bogus environmental projects than securing or border? yeah, that's troubling. at the end of the day, this country is about the rule of law. that means that we have to have people in public office following the law. so whether it's failure to deport people, deportation orders, trying to incentiize welfare or whether it's what they're doing now with title 42. there is a consistent pattern where what they're trying to do is undermine the law and i'm powter cartels. at the end of the day, i'm dubious about anything coming out of the biden administration and anything coming out of his spokespeople. >> martha: real quickly. i have to go. you are running for the gop senate nomination in arizona. a lot of people scrambling for the support and endorsement of former president trump. you think you will get that endorsement and do you need it? >> i'm not sure what will happen, martha. all i know is i grew up here in arizona, i'm a public school kid. i was a gang prosecutor. i worked at a free market think tank. i'm a principle arizona conservative. we were just talking about, i'm a doer. i've been involved in every major fight not only against the biden administration but the obama administration before. so if people want a principled arizonian and want someone that understands that washington d.c. is not the answer to our problems but is the problem, i'm the candidate. >> martha: do you think it will matter in your race who is supported by former president trump? approved. cool! hey, if bryan's not gonna be snake, can i be snake? -all: no. >> martha: so are we still in a pandemic health emergency or not? seems like there's some confusion on that question. attorney general merrick garland pressed on why the doj is suing to get masks back on airplanes. the same time, they say it's time to lift title 42. >> with respect to the mask mandate on the planes, i think this is quite transparent. cdc announced its assessment that was a program that was continued to be necessary in the confines of airplanes and public transportation. the only question for us is that a lawful and they asked us to appeal. solicitor general concluded it was lawful. so we have appealed. with respect to title 42, it's the same analysis from our side, from the justice department's side. the only question here is the cdc's program. if the -- and the cdc's announcement and assessment. we defend that program as long as it's lawful. we don't make the public health determinations that you're speaking of. >> and i understand that. i think that the cdc has put the justice department in an untenable position of arguing one position in one case and a completely conflicting position in another case. but i understand that you don't make the public health determination. >> there's susan collins of maine. we bring in dr. robert redfield from amllc. dr. redfield, good to have you with us. i understand merrick garland's take on we're just trying to figure out the legality of both issues. there's a conflict between these two ideas, is there not? >> i think they confuse the american public. you know, the importance of title 42 when i requested that we institute it was really that we weren't prepared at the border to provide a safe environment for the migrants that were coming across the border. they were basically then being housed in space that didn't allow them to have adequate spacing at a time that there was transmission. so it was for their own public health safety that really drove my decision to implement title 42. i do believe that it's premature at this point to terminate it if it is to be terminated. i think it's critical that the cdc and our border teams make sure there's adequate facilities to house these migrant workers in a way that is safe and responsible at a time of on going covid transmission. the airplanes, it's clear it's one of the safest places in the world you can be. the airline industry invested a lot of money to improve ventilation on airplanes. one of the key issues for tran mission for covid is ventilation. so again, i think -- i've been an advocate that they should move away from mandating masking on airlines. you know, in the trump administration, we didn't do that. we didn't feel we had the legal authority to mandate masking on domestic airlines. the individual airlines chose to do that. and so i was happy to see a movement towards moving away from these mask mandates in transportation like the airline industry. >> martha: so just to be clear, you as the former cdc director would be arguing the absolute opposite of what we're seeing now? you'd say it's okay to take the masks off on planes and you can still wear a mask on a plane. it's your choice. and you say that you would not lift title 42 given the current conditions coming in to the border. now, you have been warning about more variants to come. here's dr. ashih that was on this morning. here's what he had to say about what is coming. >> we don't know when the next variant will hit. obviously all of us hope that we don't get anymore variants. but hope is not a strategy. we have to prepare for future variants. >> we're learning that most americans have had covid, three out of four kids have had it. quick thought for you on what is to come. >> well, i think martha, it's very clear this virus will continue. we will have additional variants. those variants will continue to have certain characteristics. they're more transmissable than the previous variant. i know it's hard to believe. but i used to think nothing could be more transmissible than delta. the other thing they're going to do, they're going to have really less ability for natural immunity and vaccines to prevent those infections. so to be less susceptible to our vaccines and previous infection, natural immunity, so this is what is going to continue to happen. and i think, you know, in the next three, four, five, six months, there's another variant that surpasses the omicron 2 variant in terms of its transmissibility. that's just the nature of how this virus will continue to evolve. >> martha: one last question, quickly. the reason this is so super charged and variant prolific is because it was created in a lab. that's why it's so good at mutating and producing variants. you still believe that? >> yes. this virus was educated to be an efficient virus for human-to-human transmission as posed to some of its similar members of the family, sars and mers that never had that education. that education occurred in the laboratory. one of the most important things that we can do now is to move on, this virus will be with us the rest of time, we have to accelerate the development anti-virals and the availability of anti-virals. it's going to be treatment plus vaccines and targeted use of testing. it's going to allow us to keep our economy open, keep life moving in the future, which is going to be a life with covid. we'll always be at risk for intermittent surges and we have to be prepared to respond with maintaining vaccination and maintaining testing capacity. what we're lacking right now is much more resilience in our anti-viral portfolio. we need a very aggressive private public partnership with this private sector to expand anti-virals. >> martha: makes a lot of sense. it's unfortunate because of what you believe happened in a lab, we'll face this for some time. thanks, dr. redfield. always good to talk to you. see you soon. going straight to the white house now where jen psaki is getting the briefing underway. let's listen in. >> is there anything you can tell us about the president's schedule today? there wasn't anything publicly announced. >> policy meetings, planning meetings. more that he can preview on that from here. if there's more, i can tell you after the briefing. i'm happy to do that. >> i'll start with something else senator manchin said. he said today we need an immigration policy and title 42 should not be done away with until we get an immigration policy. he says basically until we no long very a health crisis. what does that say about members of the president's own party that senator manchin believes that title 42 is an immigration tool? >> i can't speak to that. i can tell you what it is and isn't. it's a health authority and one the cdc our health experts of course do have authority to make a decision about. they've made the decision that the conditions no longer exist to keep title 42 in place. we do agree with him absolutely there should be an immigration policy. there should be immigration reforms and they're long overdue and we would love to work with him and any other members moving forward. >> does it concern you that he's saying that title 42 should not be done away with until there's an immigration policy? >> that's not how it works. 42, the 30 was given to the cdc by congress. they made a decision. if congress wants to decide -- make any decisions an't the next steps for title 42, they can work together on that. that is an authority or decision that would have to lay in the body that he works in. >> follow up on what dr. ja said. what is the administration doing to expand those sites? including converting some testing sites that have a treatment component. what are the challenges to that and do you have any time frame for when you expect to ramp up those facilities? >> a really good question. we'll have to talk to dr. ja and others from the healthcare team. next time he will take more questions, i promise. you're right. there's some challenges like any aspect of applying covid policy or covid treatment policies or covid efforts to fight covid policies in that we have to educate a large swath of the public including healthcare providers about how this works or how it would work. there's continued efforts to do that. i'm happy to check with them on expansion plans or how that might work. >> one more quick one on vaccines for children under 5. this is one of many groups that are urging the fda to look at moderna's application for an eua before june, which is on pfizer will also submit theirs. what is your response to these groups who are concerned -- that a -- it appears the administration is doing pfizer a fay-to wait for them when moderna's data is already ready for review by the end of the week? >> i'd paint you to the fda for their decision-making process. as a parent of a child under 5, i'm eager to have vaccines approved and available and want to make sure that they go through the proper protocols. i point you to the fda. >> there's 18,000 prescriptions pending. so the president's plan as he talked -- and also there's a consideration about permanent review process to institution naturalize this process going forward. >> it's important to note that the president has issued more commutations than the last five predecessors. we're far ahead of anyone, any of the last five presidents. that is because this is a priority to the president. as i noted when -- at the top of the briefing, he feels this is -- second chances are important and he believes this is absolutely a right step in our justice system. he's going to continue to review clemency petitions and that will be an ongoing process run through our counsel's office. so it doesn't stop here. it will be on going and more in the future. >> on title 42, this is a public health order, it's not an immigration order. yesterday members of the congressional hispanic caucus that met with the president relayed to some of what he expressed in that meeting. one said the president told the group that he was looking forward to lifting title for 2 describing it as an excuse to get people out of the country. is the president really wanting title 42 to go away because it was a trump era policy? >> the president has never felt that title 42 was an effective immigration policy. he talked about that during the campaign. the authority has always rested in the cdc to make that determination. he left the cdc to make that determination unlike his predecessor. the president has never made a secret of the fact that he thinks immigration reform is necessary and title for 2 and there was never a replacement for immigration reform. that would put in smarter security, an asylum system that worked. that is something that he would be eager to work with them to get done. >> if the conditions warranted it, would the white house want to see the cdc reimpose title 42 in the sense that cases are up and the metrics that they use to warrant that decision? >> the cdc has the authority to make a decision what the health conditions warrant. we'll leave it to them. >> with the vice president being out, she's broken a lot of ties for votes. is there any concern about the ability to get confirmations through this week with her absence? >> i would say there's some democrats that have announced that they have tested positive for covid. you may be referring to the federal reserve nominees or others. that is something that members and leaders will work through in congress. we're confident we have the votes to get them confirmed. we're eager to have them in place. of course we need all members there to do that. >> one follow up on dr. ja. something that he said earlier. we talked about the administration's surging resources to the border including resources to vaccinate migrants. the last time i asked about this, i believe your answer was something along the lines if we have enough funding and supply to take care of the 23 sites that dhs will be running to get migrants vaccinated and also take care of uninsured americans. sounded as if the answer might not be the case anymore. are we in a place now where there might be a choice for people to choose or the administration to choose between supplying resources to migrants coming across the border versus taking care of uninsured americans? >> i'm happy to check on those resources, jackie. our broad concern about covid funding is based on ordering ahead. a lot of different treatments that will help ensure that we have the best vaccines, the best booster. enough supply once individuals under 50 are eligible and certainly all of our programs running across the country. >> one more on the hunter biden reporting that we've seen come out. does the president still maintain that he never spoke with his son about his business dealings? after their done, they have to send it off to the district attorney. they have to review it to determine whether charges get filed. at the end of the day, let's discuss that video by alec baldwin. i heard him say, i shot the gun. then later on, he said he cocked it and the gun went off. that's one issue. another issue is, did you see how he pulled it out when he was rehearsing? it would be great to break that video down piece by piece. you can break it down like to centimeters, see when he pulled it out, if it was cocked. why is that important? if he's rehearsing and it's cocked and didn't go off, that suggested that maybe he did pull the trigger when it went off to kill halyna hutchins. at the end of the day, i've been saying this all along. even though we don't know where the ammunition came from, we know that the state department of new mexico environmental department concluded that this was a safety hazard. that the film makers had reckless disregard for firearm protocol and the safety of the employees. if you have that finding already, martha, why isn't the sheriff's department making a recommendation that either mays, the associate producer, gutierrez reed or baldwin should face charges?
