i mean, people are going to go absolutely crazy and bananas. >> hopefully, as we come out of covid, hopefully a day will come soon when masks are no longer required because the science says it's safe. >> airline industry has also been vocal in criticism of white house mask policies, top health officials say the mandates needed to help americans as new covid cases are on the rise once again across large swaths of the country. >> what i'm counting on their assetment of this. they say that 15 more days will give us a much better sense of whether these cases are leading to severe disease, hospitalizations and deaths. and i think 15 days is pretty reasonable amount of time to collect more data and make a more durable decision. >> so the next big question is whether the white house will move to appeal this decision or simply allow it to remain unchallenged. 15 days left between now and when the extension was set to expire. >> bret: as you were talking, administration officials telling peter doocy that the cdc' public transportation masking order is not in effect at this time; therefore, tsa will not enforce its security's directives for the masks on public transportation. that's significant if you are sitting in an airport somewhere. >> it is, bret. it's also interesting so you just laid that position out from tsa. right? they are not going to enforce the biden administration policy. but then again, the cdc is still recommending that beam continue to wear masks in indoor public transportation settings per the administration straight up conflicting items from the cdc and the white house. >> bret: gillian, thank you. the u.s. supreme court again rejected an emergency appeal from a member of the u.s. military who has refused to take the covid vaccine, jonathan dunn is in the air force reserve. the military rejected his religious objections to taking the vaccine and removed film command. three conservative justifiables would have granted the request to put his dismissal and any further punishment on hold while the litigation moves forward and continues; the justices separately had rejected # a similar appeal from members of the navy seals. meantime, president biden's border crisis is reaching new and dangerous levels. fox news has learned nearly two dozen known or suspected terrorists were caught trying to enter this country from mexico in 2021. this comes as we also learn more than 220,000 migrant encounters were reported just last month. correspondent bill melugin is live in eagle pass, texas with the latest on this, good evening, bill. >> bet, good evening to you. that's right. federal documents obtained by fox news revealed that last month in march alone there were nearly a quarter until. now for the first its first time we are getting an idea how many potential terrorist suspects tried crossing in the u.s. last year. >> cbp records obtained exclusively by fox news through a freedom of information act requests revealed nearly two dozen known or suspected terrorists were at the southern border last year. specifically 23 hits on the fbi's database. including central, yuma, tucson, el paso, del rio and rio grande valley border patrol sectors. and with cbp sources telling fox news there have been 300,000 got-aways at the border in the last six months alone. critics say it's time for alejandro mayorkas to treat the border crisis as homeland security issue. >> at what point does this man have enough integrity to tell the white house i cannot keep this border open no matter what because we have created a massive security issue of the highest proportions. >> fox news obtained federal court filing from dhs which reveals there were over 221,000 migrants encountered at the border in march. that's the highest number since president biden took office. the filing reveals dhs also released over 80,000 migrants from federal custody into the u.s. in march. and expelled more than 109,000 in march using title 42, a growing number of democrats urged the biden administration to keep the public health rule in place. >> we know 221,000 people this last month and migrants are looking at title 42 the moment they lift that you are going to be seeing a lot more people coming across. >> meanwhile mass releases continued in eagle pass, texas monday morning. that's where fox news cameras 500 single adults released to custody to local ngo. some of them released into vans and brought to a border patrol check point and free to travel anyone into the interior of the u.s. only some of them issued government-provided cell phones or ankle monitors for tracking. bret the dhs inspector general put out a new report last spring ice inappropriately sent about $17 million of taxpayer funds on a no bid contract to house illegal immigrants in hotels all along the border. hotels that mostly went completely unused. the ig concluded that ice ended up wasting millions of taxpayer dollars with that have been killed in lviv following what appears to be a series of missile attacks from the russians. this comes as russia increases its targeting of ukrainian infrastructure and ukraine's president vows he will fight to the end. correspondent matt lviv tonight. >> city of lviv was terrorized by four russian missile strikes according to officials causing the first war time deaths within the city. 15015 to 20 people were on the property of this large tire shop when it was hit. four people were killed. this worker tells us he was still alive because he was arriving when the attack happened. >> managed to mark the car and there was an explosion. i didn't even understand. didn't understand what happened. >> i didn't know really. i must have been a lucky one that i'm still alive. i still have young children. is he still in shock that his co-workers died. >> i just can't, understand me. that every day we drink coffee, every day set together. >> behind the tire shop, this hotel where many refugees were staying was also blasted by the attack. fox news went inside and spoke to this refugee dmitry. he arrived from kharkiv over a month ago and was staying here. he tells us he came to lviv because he thought it would be safe. his sister and his nephew were sent to the hospital. >> they dressed up. it was the first explosion. kids ran to the window to see what's going on there and then was the second explosion. >> there were missile strikes outside of lviv city center last month, but the city has been considered relatively safe until today. the mayor called today's attack genocide. in the east, russian shelling also intensifying in cities like kharkiv. moscow is also warning it will increase its missile attacks in and around kyiv. >> a short while ago in ukraine, president zelenskyy normally announced that russia has now begun second massive phase of this war targeting the east, which he calls the battle of donbas. bret? >> bret: matt finn live in lviv, thanks. let's bring in roy blunt member of the senate intel and the defense appropriations subcommittees. he has just returned from a trip to the war zone, senator, thanks for being here. >> great to be here. >> what's your assessment of where we are now in ukraine? >> well, i think it's hard to tell exactly where putin is. in his own mind, but what we just saw is really out of the putin playbook. what they did in chess nia, what they did in syria, what they have been doing to terrorize urban populations as much as they can. they clearly lost the first part of the war. it would be interesting to know whether putin was more surprised by the ukrainian resistance or the turn around nato back to the original purposes of nato, including germany, now very willing to do what nato is designed to do or the lack of effectiveness of his own military on the ground, so i think now they are just continuing to try to terrorist people. and intimidate people. i don't think the ukrainians are going to be easily intimidated. >> bret: here is president zelenskyy about russian nukes. take a listen. >> when rush gives information and says if something goes not according to plan, they can use chemical weapons. and then nuclear potential. and that why s. why i believe these are dangerous claims of untrustworthy people. and if we believe some of them are already untrustworthy, then they can use nuclear weapons. >> bret: how much does that factor in, do you think, to our policy decisions about how we as a u.s. are operating in this zone? >> >> i think our policy decisions are we don't have the title 5 commitment that we have to the nato countries allied with. but also there is an attack here on freedom. there is a build-up that started when in 2014 the russians were able to just seize territory in eastern ukraine and and seize the crimea region. i think we can't be intimidated by what putin says he might do. there are things he can't do as well. he doesn't want to start a nuclear war. he may use chemical weapons. i think he has done that before. but we can't built our policy around that i think our policy is continue to give the ukrainians everything they need as wick as we can get it to them. they are not asking them to help them fight. they are asking us to give them what they need to fight and so far they have been doing a tremendous job of pushing back on what i was told when we were in poland is about 85% of all russian forces are now either in or around ukraine. so they have put their entire army there. the army didn't perform very well. but our policy, i think, needs to be to be as supportive of people who are willing to fight for their own freedom as we can be and that can include training, probably outside of the country, i believe that training is beginning it but it needs to include all the equipment they need and all of the other supplies they need for a population that's being terrorized by an invading enemy. >> bret: you are on senate intel. we just heard the cia director william burns over the past few days say that china is the biggest threat, the biggest issue the cia has ever dealt with. we don't know how china is factoring into ukraine other than supporting russia. what's your response to that statement? >> i think china is in the long run our biggest challenge and the immediate run, i think we need to be sure that we're not sending the wrong signals to china that we aren't willing to step up and protect our friends, protect those who are willing to fight for and protect themselves. obviously a lot of concern about taiwan. china needs to start thinking about the effectiveness that taiwan would have on the ground as well. you know, even if russia was somehow able to subjugate ukraine temporarily. they are not going to be age to take over that country like they thought they would. they believed they were going to be able to come in without a week and displace the government, have intended ukrainians owho they thought would want to be part of russia again. what ukrainians, who know what is they thought in 2014, but between the seizure of crimea and the constant fighting on the eastern part of the country, ukraine knows they don't want to be part of russia again. you got people that look like you, that understand your language that all have an ak-47 in their closet somewhere. this is a big mistake for putin and he needs to figure out how to back away from that mistake and the chinese need to be watching that as well. the world is not as docile as either the russians or the chinese think they are. and we're seeing how much people prize their own freedom. >> bret: last thing, senator. you are retiring at the end of this year. >> yep. >> bret: you have been up on the hill for a long time. you commented that president biden's inauguration, you were one of the leaders of that ceremony about bipartisan andshp and get things done. wondering your assessment now as we get ready to head to the midterms, boy, it's been pretty split in country. >> well, it has. i would say though on the trip i was just on, the trip organized by the majority leader in the house mr. hoyer, he and i were whips in the house together. had a long-term relationship of trust even though we seldom agreed on policies. you couldn't tell of the nine people that were on that trip who were republicans and who were democrats. i think this is one of those moments when you do have the opportunity to look at what binds us together. what we stand for as a country. in the narrow division of the country now for over a decade, has led to every day politics thinking that it was a difference in whether your side was in charge the next time or not. we clearly need to get over that and get to where we g.e.d. focused on the work we need to do and frankly do as much as we can in a leaders locked in a room somewhere that involves the members of the house and senate trying to work out things that their job is to understand the details, not to investigation. it turns out the intelligence community, the cia specifically, has more to say about evidence in this case. correspondent kevin corke is here to explain. good evening, kevin. >> good evening, bret. we are exactly a month away from a highly anticipated federal trial that could finally offer some definitive answers to this simple question. what role, if any, did the 2016 hillary clinton campaign have in trying to tie donald trump to russian interest? special counsel john durham lead the prosecution former campaign lawyer michael saysman claims part of the data sussmann was peddling to the government in 2016 and 2017 was not technically plausible. did not contain jute any. conflicted gaps and conflicted with itself and user-created and not machine-tool generated. you recall sussmann is charged for lying to the fbi denying he worked for the campaign while offering up data he said convertly then tied trump to a bank. sources tell fox news it's the cia had examined her data provided by sussmann back in 2017 and found it was not accurate; however, the special counsel has made it clear his office has not reached a definitive conclusion in this regard. still, the government wants to use the evidence at trial to establish whether successman's alleged lies influenced or impaired government functions. in case you are wondering for his part sussmann has not yet responded to these latest allegations from durham. has already repeatedly denied lying to fbi. pre-trial motions to have much of the evidence against him suppressed. it is also worth noting, however, mass shootings this weekend. one at a bar in the town of fuhrman that left at least 19 people injured early sunday the other at a busy shopping mall saturday in the town of columbia where 14 were hurt facing a number of charges including aggravated assault u. attempted murder and unlawful carrying of a pistolment on sunday a few hours after his arrest. a judge set duane pryce's bond at $25,000 and said he could be under home and under house arrest with an ankle monitor though he has those charges were ultimately dropped. new york city mayor eric adams reiterated that gun violence is a national technology and crypto currency industries. at least three people have died in china's largest city as shanghai battles a coronavirus resurgence. the first reported deaths in the latest outbreak. shanghai's 25 million residents continue to live under strict pandemic protocols. and there are questions tonight about whether the government strategy of lockdowns is working. here is senior foreign >> continuing to recommend people wear masks. i don't have any update. that just came out through the courts just this afternoon and as soon as there is an update. we will provide that. >> bret: and, just after that news conference, there was an update. senior administration officials saying the tsa is not enforcing its security directives and emergency requiring masks on public transportation. transportation hubs at this time. while the cdc still recommends it essentially the mask mandate is not in place after that federal ruling. let's bring in our panel. senior political analyst brit hume. and guy benson and harold ford jr. former tennessee congressman, co-host of "the five." harold, what about that? kind of puts the administration in a bind if this judge rules one way or they are still considering things now it's not in place. >> well, thanks for having me. the law and the courts speak louder than what the white house and those of us can say. i follow the data and the law and i'm comfortable with this judge sees fit that this should not be imposed. the fact that more penal are vaccinated that fewer people are being hospitalized and thankfully prayerfully, fewer people are dying. i think is a positive thing. i think the administration would be better suited to focus their energies and political pursuits elsewhere, including inflation, ukraine and crime in the border. >> guy? >> i got an email from a democratic group. i'm on their list just to see what they're up to. they are already fundraising off of this saying it's a trump judge that's done this do you support this? give us money. and it's, i think, a tricky situation for them. because on one hand, many travelers and the airlines themselves for the most part want these mandates gone. but this judge has decided otherwise. has actually agreed with them. and the administration is stuck, as you say, in a bind. of choosing between what most people, i think, especially the traveling public supports and when a lot of their base supports and at least some of their scientists say. >> bret: here is the white house covid -- the head of the covid strategy over the weekend. brit, take a listen. >> we don't think that a zero covid strategy, which china is pursuing is one that is likely to work. i think it's very difficult at this point with a highly contagious variant to be able to cure tail this lockdowns alone. >> bret: particularly about shanghai. >> they are. did you hear that eye-popping number in the report? 400 million people under lockdown in cities across town? we have been reading about shanghai for weeks now but now this is apparently all over the place. great swaths of highway are empty and so on. china has been in large part is paralyzed. and the damage to the economy is extraordinary. can xi jinping addicted to tendencies in lockdown can he survive this? on paper you say who is going to overthrow him? this is the stuff on which uprisings are made. >> bret: meantime, here in this country, domestically, a lot of issues facing a people as we get ready to head harold to november and big terms. the biggest among them inflation. take a listen. >> think the president has richly descreerved his approval ration. it's hard to find anything that's going in the right direction. he has not governed as a moderate but if i become the majority leader he will be a moderate he won't have a choice. >> no sign that inflation is slowing down. if anything it's going stronger and stronger that could lead to a big sharp downturn in the economy at some time in the future just the way it did under ronald reagan in 81 to 82. it will be the worst of all worlds. high inflation and high unemployment. >> now, there are some pundits over the weekend, harold, who said well, the president can't really do anything about it there is nothing he can do about it. this is a "wall street journal" opinion from fedex founder fred smith saying the sky is still the limit. quote. had we passed the build back better bill that biden wanted. my guess now we would be jamar right now. we would have 25% inflation rather than 9% or 10%. you can't print money without regard to the fundamental laws of economics. tough spot. >> fred smith runs the biggest company in my former district in memphis. he knows a lot of what he is talking about. i think those in my party whom are suggesting that inflation is not an issue, i mean they need to stop reading harvard papers and start listening to those in hartford and harrisburg who are actually experiencing the day-to-day life of what it means to pay higher prices, i think the president i have said for a long time should acknowledge it i don't think he needs to take all of the responsibility for it. but he has to take responsibility for what we are going to do going forward will. reposition known from what we spent on covid to help small businesses there is a plan out there to divert money from small businesses to help healthcare missions. they should not do that just add to it if you need it. don't take money from middle class families and main street in the country. two, you have to be smart about taxes. people are aren't afraid -- don't want -- i should say not to put rich people paying more taxes tell people what we are going to use the tax money for which means fighting crime and protecting our border. i would give back to the bread and butter kitchen table issues on the minds of every day voters in all of our battleground states. if you do that we have a chance of perhaps not losing as many seats and perhaps even saving face and maybe even gaining a few seats somewhere along the way. until and unless we do that bret, democrats are going to have a hard time come noe. >> bret: i should point out fred smith fedex founder will be a special guest on "special report" wednesday as we look at the supply chain that is still happening around the country what about this thought the administration trying to find some path on the way to november? >> i don't think it's going to do them any good this they try to do it. inflation effects everybody. it effects people in the lower income ranges the most because they richer people can afford the gas and food prices. and they can cut back on luxuries. i'm talking about people who don't spend on luxuries food and fuel many of them on rural areas. these people administration. the administration gives up on it and says he can't do anything about it or argues that it can't. that's not going to work. people don't want a government sol the problem they want a government that can and lots of things the government can do despite some pundits' argue. fots contrary. >> bret: guy, putin price hike not doing tnchts not sufficient. it's one part of the broader puzzle. i think people generally understand that is a pivot. that is a political talking point. and what the biden administration struggles with here is credibility. they want to spend 5 trillion more dollars on build back better which every house democrat except one voted for raised taxes on middle class hold holds. they can try to talk a better game. it's not going to serve them well because their voting record and overall policy record is speaking loud and clear and the polls are, too. >> bret: all right, harold. you are the head of the dnc or the dscc. what do you come up with ahead of november? what's the pitch? >> we reform bail reform law in the country. we do not revoke title 42. we say no new taxes on small business all across this country and we reposition and re-purpose every dollar that we have not spent on covid. the small businesses in small communities and rural communities across this country and say whether we win or lose, we are for america and for communities all across our country. >> bret: get aoc and progressives to come along. >> i get joe manchin and get him to get the rest of them and win with a majority. even if we have to have a few republicans we gain them, too. >> bret: possible plan there, brit?
