>> carley: you are watching "fox & friends first" this thursday morning and i'm carley shimkus. >> todd: i'm todd piro and arrested nine times in new york and three times in new jersey and charged with two counts of harassing threat in the mid-'90s but found guilty and only one year probation. a troubling post online and never fled on social media. >> good morning, frank james is in federal lock up charged with the subway shooting and a massive manhunt involving hundreds of detectives and police after tuesday morning's chaos and in the end james himself helped to bring an end to the chase. and 62-year-old called stoppers hotline after plastered across tvs screens and want to post her. he told the tip line it was at mcdonald's in manhattan and have gone in the area and the witnesses saw him and called the cops. >> he was walking in the streets, i tell you, i see the police come from the streets. this is the guy. we will catch him today. this is the guy. and we catch him. thank god. >> the events began tuesday morning during rush hour when witnesses say a train pulled into a brooklyn subway station. dark skin, heavyset black man with neon vest and gray hoodie donned a gas mask set off a smoke grenade and began firing. ten people shot, two dozen wounded and no one was with life-threatening injuries but james became suspect number one after link to u-haul rental van and a gun found at the scene. james has had health issues but a long rap sheet dating back to 1995. petty car theft, and disorderly conduct. and despite james open his own capture, they bring into the search. >> >> we were able to shrink his world quickly. there was nowhere left for him to run. >> now james is expected to be arraigned later today here in brooklyn and federal courts. he is likely to be charged with some form of terroristic threat against a transit system. todd, back to you. >> carley: lauren green live and let's bring in joe, the new york councilman joins us live, good morning to you. what are your overall thoughts on his arrest and the fact that the crime occurred in the city that you serve? >> hats off to the police officers and the citizens who identified this guy. and lead to a safe conclusion, if you will. this is the kind of thing new yorkers are afraid of new yorkers occasionally live in fear of. we are a target constantly and not for the robust police force we would suffer these kind of attacks more often. >> todd: joe we are a national season in the city. as it gets underway, why would anyone watch us right now and watch what is happening in new york city come here this spring, this summer, until the woke city leaders do something about safety? >> you are right, todd, this is isolated and happen frequently but sort of run-of-the-mill subway crime needs to be addressed by the police. you can't forget it was democrats who in 2019-2020 constantly waved the flag of not putting more cops on the subway systems. now, fast-forward a couple of years we have this crime spike and the same city throwing hands up and need social justice and housing to solve the problems. if you are a tourist coming here and see a change in leadership, i'm not sure coming here is the right move. >> carley: frank james is someone with extensive rap sheet including nine prior arrests in new york for criminal acts, theft possession, burglary, three in new jersey and this is another example. although states, crimes is another example of repeat offender walking among us. and there are people in the democratic party that say that is a good idea. prosecutors that continually give out lenient sentences. what needs to change so something like this doesn't happen again? >> they are focused on the gun but you pointed out accurately this person had a long, long rap sheet purity filling, the prosecutors put him behind bars if they charged him with the full extent of the crime, he might not have got a gun. so before we talk about ghost guns, this, that are of the other thing with firearms, let's talk about prosecuting that we know already arrested for and most likely repeat offenders in these situations are in the petty crime. >> carley: he has never charged with a felony and if he was he would have never gotten a gun. >> what is new york city doing to make itself look safe? >> i guess this two nypd officers will reportedly be fired in the next week. obviously a resolution to try to stop that with the city council demanding mayor eric adams and rehire these unvaccinated city workers. how can this city fire cops over this? yet let professional athletes get an exemption? >> i want every play were to be on the field, i'm a yankee fan. but the yankees have the best doctors money can buy and they are okay with players being unvaccinated around fellow players who were ground, coaches. new york taking that league when it came out and made an exception to the rules, you lost the moral high ground into scientific high ground. no one is more dangerous bronchi re-irving playing basketball then they would be the hot dog vendor or the ticket stand. so you lose that posture of blaming science and how you are being punitive on people. >> carley: yeah, so you have introduced a resolution to get these people who were fired or are going to be fired because they refused to get the vaccine here you want them to be rehired. and understand resolution is receiving bipartisan support. will people get their jobs back? >> we hope so. it's not just public employees but private employees and we have a mandate in the city as well. you go through neighborhood by neighborhood and you see some neighborhoods 20% of adults are actually ineligible to work in new york city. factor that into the idea that we have doubled the national average of unemployment and those two things are related. so you have bipartisan support with any stripe, color, creed, see their constituents not able to work. spoon finally, joe tucked away in a record-breaking 220 billion with a b budget medicaid for illegal migrants. take a look. this is what it will cost you $220 million at the new york taxpayers to cover all this. this is getting incentivized illegals in the state? >> that is $220 million today and that's not a giant budget by new york standards, believe it or not, but when you are the only state, remember they don't allow medicaid dollars to be spent on undocumented people but only new york state. so $220 million today but it will be more when you see more people getting bused in and flown into westchester county like we have seen. they are not going anywhere. who can blame them, frankly? >> i don't know. i wish i had an answer, but a little bit american university decided to come back with a mask mandate again but what is more concerning is hypocrisy, plano hypocrisy. the president of the university told us to wear masks. and human services secretary for barack obama a few years ago. she was invited for that reason to the white house last week and get-togethers with joe biden and kamala harris without a mask let's say and told us to wear a mask. i think joe biden is more dangerous of covid and we students. my peers and myself are pretty healthy teenagers, and we are more than 95% vaccinated in the university and 5%. >> todd: isn't this just yet another attempt to divide us? >> yeah, thank you for having me on this morning, todd. i couldn't agree more. the essence what is happening on my campus george washington university, by the way couple of blocks of washington, d.c. we reinstituted the mask mandate after eight days of being mask free. a key part of the policy here is that it is caring for the community get there seems to be disregard for community when subsequent section in that policy called noncompliance which in my opinion is a phrase that has airy associations with utopian cliches. the university is showing division by deputizing students to turn on one another. and we have to understand that just about every decision and adult makes involve some degree of risk-benefit analysis. we are adults, not children, and we can make our own risk assessment. many aspect of covid response has been nonsensical and often proven redundant in retrospect. that may be just my opinion, but that is the point here. everyone has a different opinion how to weigh various factors when in a risk/benefit decision. we should be ashamed, chest chastised or reported on different aspects what is now an everyday decision. >> todd: forcing you to tattletale on your classmates reeks of east germany. nobody wants that and maybe they don't. i don't know anymore, daniel. what do you make of the latest attack on freedom, especially coming from a place that wasn't free lake in venezuela? >> look, he came to america because the land of the free. i think it is unfortunate that we are being controlled by small minority of administrators who think they know better for the students who at night will go partying regardless of wearing masks in the classrooms are not. if they want us to just have a safe campus, they already did appear they forced everybody to be vaccinated regardless of their health, regardless of anything yet, they want to force us to wear masks. what i'm concerned about is this is just about power. i'm concerned this is imposing their will on us and i'm honestly really tired appear to want to be free and live in a normal country. i want to live in the america that i know and not somewhere else. >> todd: jp are the liberal classmates getting very frustrated? governor abbott scenting migrants to washington, d.c., like he said he would. >> good for governor abbott. i strongly encourage governor ducey in arizona to do the same. look my pen down there for three days in california and arizona. this comes after exactly one year ago when i led the oversight committee to texas and new mexico. i can tell you, it's only gotten worse. then todd, title 42 goes away, it will be worse than it is now. everybody knows it. this is terrible policy. i don't think joe biden or vice president harris has any idea how bad it is, and they are going to see with all of these people invading washington, d.c., like they completed our border states. it may make them realize how bad it is. what they were going to see over the coming days in washington, d.c., is what all the border community c. because of joe biden's policies on the border last year, every state, every border states come every state flooded with illegals, which is bringing along with it fentanyl, human trafficking, and increased crime. >> carley: the white house is brushing this off. jen psaki was asked about this yesterday. she said it is good that governor abbott is helping these illegal immigrants get to their final destination. she also talked about how they are in the process of immigration proceedings as they await their court hearing. you have to wonder, will they be? and if they stay in the country under this administration, is ice going to be going after them and taking them back to their home country if they don't have the immigration trial? >> no, remember, 3% of the illegals actually are showing up for their court date. ice has overwhelmed peer the border patrol, their hands are tied to. we learned the border patrol spending overwhelming majority of their time doing paperwork, processing the people that are coming across illegally and once they get through processing, they are letting them go. they are just doing busy work while these illegals keep flooding the country. and another thing i learned down there, especially when we were in arizona, just this year, 300 over 160,000 people this year. over 150 so 95% were from countries other than mexico. we went out on a night ride border patrol, brandon judd on fox all the time and we had two groups apprehended that night. two largest countries represented in those two groups were cuba and use becca stand. so this open border policy is an invitation to the world now. come to the united states and the border patrol under joe biden is a welcoming committee for these illegals and it's mind-boggling how bad it is on the order and when title 42 goes away it will get worse. >> carley: a lot of people come for economic reasons and you can't blame them although they break the law. and what you have said. and we are securing people from iran and syria. that is the big issue here. this does present a national security issue. >> it is a national security issue. liberals will try to compare what is going on now to 100 years ago when immigrants came to the united states. the difference between then and today is today we have a welfare system. so, you have what i noticed on the border this time and a year ago when i was there is you have just a large number of children appear those children are automatically become on welfare. they get medicaid, which is free health care. they are going to get free education. they will get free housing, free food, and you know, this is a burden on the american taxpayers. that is why the welcome committee, this is a cost to the taxpayers. this is putting illegals ahead of the line of hardworking taxpaying americans. taxpaying hardworking americans have to pay for the their health care. these illegals do not. they are getting free phones now from president biden. it is a slap in the face of every hardworking taxpaying american. >> carley: congressman, we were talking to joe borelli a councilman in new york and he was talking about the new york city budget, it is tucked away but it was uncovered that there is money for health care for illegal immigrants above the age 65. this is exactly what we were talking about. but you mention cell phones and the fact that biden administration giving out cell phones to illegal immigrants, which also reminds me of the fact there are images of illegal immigrants taking selfies when they get to the united states. i'm sure they are happy to be here, but what does that say to you about how concerned they are about being so open about breaking our laws? >> i saw the illegals taking selfies across the border. this particular group of the illegals they were primarily from the use pakistan and cuba and they had nice clothes. i saw louis vuitton bags. i saw very expensive nike shoes and i saw a lot of nice cameras not given by the government because they already had it. these people came across and they were posing for instagram and there is no fear of any type of consequences for crossing that border illegally but remember they are here illegally, breaking the law and taking selfies. the cartel will use these selfies to advertise for more businesses because everyone of those people that are being apprehended at the border are paying the cartel between $4,000.8000 per person to cross to mexico. when all of these get apprehended at the border it is a distraction for border patrol, then the cartel since they are drug packers across the line illegally at different points to bring fentanyl in to the united states. so the drug problem, 100,000 deaths over the last year of fentanyl overdose. this is a direct result of biden's border crisis. they continued to turn a blind eye and continue to encourage it. every american should be outraged over this. >> carley: you know, congressman, yesterday the biden administration extended federal mass mandate on planes because they said that covid is still a real and present danger. and yet, they are still removing title 42 at the border because apparently covid is not a concern down there. what do you make of that? >> that is just hypocrisy. i didn't see any illegals wearing a mask when they came to the united states. i was in the detention facility and san diego and yuma and i did not see anyone wearing masks in there, the illegals wearing masks. but title 42, one in the toolbox this administration have left to ship people back to the country where they came. over half of the successful deportation that occurred in the united states came to the title 42. now, you are giving that away. at the same time you continue to extend mask mandates and the united states. everybody in the airport, i landed in chicago, phoenix, san diego and of course louisville, kentucky, every single person in the airport wearing masks. yet, illegals to the tune of over 2 million crossing the border and detention spread out across america, they are not wearing masks here they have not been vaccinated. >> carley: congressman, i'm looking at the screen right now the immigrants that just got off of this bus, obviously the second bus arrived in washington from texas. and it is a lot of single, young men. we were told that it would be family units that would be allowed to come into the country and stay, not single men. so what do you make of the fact that this is demographic that we are seeing coming into the country and being allowed to stay here? >> look for my for think the administration says when they defend their open border policy is not true. it is fiction. the people coming across the border, many are here for the right reasons, trying to find a better opportunity, but many of these people are criminals. many of these people are drug dealers. many of these people are human trafficking. nothing good is happening on the border. you know come everywhere where they were as major crossings that we saw in california, arizona, same thing in mexico is where the wall ended. why can't we finish the border wall?
