we have got to say why is it in america's interest to potentially risk war with ukraine first or secondly it could potentially out with russia over just because we don't want to lead ukraine into nato which is we don't want to extend the nato membership. look, the nato charter says you have to have resolved all of your internal disputes from ethnic groups or religious groups and all border disputes, neither of which ukraine has done, so it would be not in our interest to bring ukraine in. that is the primary issue that is driving russia. so if we would just say hey, we're going to put a moratorium on that right now, that is the best way to deter putin from attacking ukraine and that woul be better for ukraine. if we stay on this path you're come out where becomes likely. >> are you suggesting that it's not in our interest to prevent putin from a takeover of ukraine ? >> no not at all, as a matter o fact, if we take this moratorium , putin will have no motivation to go into ukraine. the truth is right now if his forces were there, they can tak ukraine any time of their choosing and there's literally nothing we can do to stop it because they have all the force in place. we're not going to risk nuclear war with russia right away. but this could stop it. >> am curious to how this would happen because when i was listening to midpriced, i was keenly listening to any specifics that he would offer a to how we would stop the flow o gas through the pipeline and he didn't offer any specifics. he did say we would work with germany to make that happen. we know that germany has great interest in that energy to come to their country. they are highly dependent on russia. 50 percent of their gas comes from vladimir putin. are we certain that germany would join that fight? >> no, we are not sprayed as a matter of fact it's also important to understand, that pipeline is not yet opened its finished, but it's not yet open so gas is still coming there, but it's coming from elsewhere meaning this won't have any practical implications, but als that is what germany would be happening that putin wouldn't shut off the pipeline that are running from other places because it would be catastrophi not just for germany, but for all of western europe because russian gas goes all over the place. we have to be careful not just for ourselves, but for our nato allies because we could make a bad situation worse for them. right now this could go bad in so many different ways. >> colonel, we hear you. real quick. when you think something happen if vladimir putin decides to move in there? >> obviously no one can know fo sure, but i think within a few days from now, it may be a week or so some of these deployments that they have will be complete and then it final on that? >> look, american forces should absolutely under no circumstances get involved in this war. they're is nothing that would b worth their blood that is going on in ukraine. we need to floating that idea. tell us more about it, what are your wishes when it comes to th president filling the seat welcome? >> thank you very much for having me. as you may know, at this situation we are in today is about two years old. it was in february of 2020 that the president at the time candidate joe biden made the commitment that if given the opportunity, he would nominate the first african-american woma to serve on the supreme court's. i think one of the real blights and the history of this great country is the fact that over all these years, there has neve been a black woman even considered for the united state supreme court's. here we are, having had five women, to retired and one has passed away, when retired, and three sitting there now. but nobody has even ever talked about putting an african-american woman there. when i talk to that now president, then candidates, i asked him to take a look at that . and to pledge to do something about that. he took a look. a he pledge to do something. and he is now going to do it. he who is it specifically that you have in mind? i will read a quote from you verbatim. i want to make sure it is a black woman i want to make sure it is a woman that will get universal support. you said when i say universal i mean bipartisan support, who could garner that in your view? >> i suspect that i just know one who would. and that is michelle childs. when i first advanced her name, i saw the two republican senators from south carolina lindsay graham, and kent scott, and told them that i was going to advance her name, i asked them what they thought about her . both of them were very favorabl or. i think that that is a good signal. >> of course, she is the u.s. district judge, so you say that tim scott and lindsay graham would support her. i believe you described both as very high on my child child's. what is your vision to fill tha seat. there has been a lot of talk fo the president to give to the progressive crowd to felt that seat, someone to take a more centrist route. so describe child's and why she would be the best pick in your view. >> welcome it to be clear, i said they are favorably dispose toward her, they are high on her , i have no idea how they will vote if she were the nominee. i do know this, before she was at district federal district judge, she was as south carolin circuit judge. before that, a workmen's comp. charge. she was the director of a state agency. and, she has incredible credentials. as a federal district judge commission sheet is president o the federal justice association. when she was a circuit judge, the state chief justice of the supreme court went to her to si with a special judge and on the supreme court's. so she has had tremendous leadership wherever she has been . she has gone up there in detroit , her father died when she was 13 euros old. her mother move them to columbia , south carolina. she graduated from columbia hig school with the valedictorian o her class, president of the student body, got a scholarship the university of south florida. in honors college, and that is good credentials it seems to me. she has two master's degree a doctorate. >> great to get you on on that. i am looking to the statement that nancy pelosi issued a few moments ago and i think it notable that and i'm reading through this very quickly, that nowhere in there did i see her back the call for president biden, which he has said many times in his wishes that this b a black female that fills the vacant seat by briar. i thought that notable, just give me a quick final thought there. >> i have no idea whether nancy pelosi even knows any of these candidates. i know several of them, and i know judge child's very well. i don't think she's to pay their respects at st. patrick's cathedral until 8:00 p.m. tonight. it's open to the general public. a procession of nypd vehicles lead the way for his casket to arrive here at the cathedral from the bronx earlier this morning. he was well greeted by bagpipes and honored by 200 nypd officer who saluted him as his casket was brought into the cathedral, flag draped with the nypd logo. rivera and his 27 -year-old partner were ambushed, shot and killed responded to a domestic dispute. since 1:00 p.m., hundreds of fellow officers and new yorkers have been lined up. reportedly up to 1800 mourners per hour were led inside the cathedral to pay their respects to the 20 two-year-old officer and his family. new york city mayor eric adams of former nypd captain himself arrived this afternoon just after 3:00 p.m. and delivered this message before he arrived at the cathedral. listen. as our city mourns the loss of two officers two days week one and the funeral tomorrow of bot of these officers, we sit under the tree of public safety because they watered that tree with their blood. we should never forget that. officer rivera was the first an his dominican american immigran family to wear that uniform. the rookie had just joined the nypd in 2020. he said he wanted to join to rebuild the relationship betwee the police and the community. rivera had just married his wif in >> look, what the biden administration is trying to do in transporting a lot of these migrants from the border to places like new york and elsewhere it shouldn't be occurring great if it does occur , they obviously need to coordinate with local law enforcement which they're not doing. they are compounding bad decision upon bad decision. this is what it looks like when you have an open border policy, when you don't enforce the law, and you have record number of illegal apprehensions every single month. they have nowhere else to put these individuals. they have broken the system and this is what it looks like. they have chosen to do this, this is an intentional strategy. >> i didn't hear jeff at s in the briefing room, we didn't have anybody in their, to space out the chairs and there's less reporters in the room, but this is the only that footage was only obtained because of a freedom of information act. the lack of transparency being provided by the administration is something. >> it's not only a lack of transparency, a lack of leadership. wins last time you heard the white house from the president to the vice president or even the press secretary talk about what's going on, the crisis on the border today. they don't talk about it, they don't visited, they want it to go away. they don't want to axley what they are doing because most reasonable americans would say this is crazy. how could you not enforce the law? >> absolutely. again, what occurs on the borders whether it's the illega narcotics are the illegal individuals coming across goes to any community across the country. it doesn't stay there. local officials are having to deal with that and local communities are having to deal with that. when you talk about border security it's not just for the communities along the borders, it's for all americans and we know the cartels are using the crisis we see today to smuggle more and more individuals, someone very criminal records that individuals, national security threats and others across the border. when we talk about operational control of the border which is dhs is bailar required to do, but yet you see 170,000 illegal apprehensions in one month alone , it's anything but that. the department, because of political leadership and decisions being made are not enforcing the law, not adhering to the responsibility that congress has gave them. it is affecting every community in the country. >> the stats that the governmen about the event know that are receiving. that was a very powerful moment. final thoughts on that, the recruitment and the tik tok mentioning that they are using social media venues like tik to to recruit. what can be done to shut that down? to get their short answer is ye it will, and especially with th policies that president biden i pushing that really discourage up to 2 million americans from reentering the workforce. so you have got a recipe i thin for more inflation, including build back better which is stil out there somewhere in the senate has over $1 trillion of taxes on businesses that create disincentives for investing in new plants, new equipment, new technology that could help us work through this very the othe thing the report say that confirm all of this to be fair, the president finally met one o his quarterly economic projections was the first since he took over the white house an the numbers have been dumbed down to the minimum so that is some improvement, but there are red flags in this report today reading inflation and massive drop in disposable income for families, that is another red flag great and then of course you've got really just build up of inventories in this report that you take it out, those are temporary and volatile. take that out, the economy grew by less than 2 percent, there i a lot more work that needs to b done to get this economy moving. >> you could dig into any history book and see that any inflationary times that we have seen in modern hysteria history if you add spending to equation it only drives prices higher pe eight east that's is also not politically popular, and we are seeing the president continue t drop to new poll close in the polls. >> i am stunned, and i think th american public's as well. they made a number of mistakes to make the economy worse, especially in inflation. i think driving trillions of ne government spending as we were already coming out of the worst part of the pandemic economically at least. policies that instead of people stay home, i think was a major problem. i think everything he did to yo ignite inflation was there and to continue to try to put more money into the economy, which h is continuing to do in this build back better, all of it drives inflation and a big way. what i worry about is between president biden and the fed acting to slowly into weekly, i really worry that at some point this year, you and i will be talking about a wage price spiral that is going to be very very hard to end and that is where i don't think anyone in the country wants to go. >> that would be very harmful t business and at the same time they are dealing with spiking energy prices. congressman, before you go, i wanted to ask you about the you state's governor, he very pointedly blamed the biden administration for what is goin on at the southern border. as we get more video showing th mass release of migrants. he was fired up and he was listening to ag's of states who are dealing with this crisis. why is more not being done to tackle it? >> you know, it is just politic and that's what's sad. states like ours are paying a huge price for this, trafficking , drug trafficking, crime, and all the other elements. watching the video of the borde as you turn it back on the secretary, i am surprised more don't because when i am down there visiting with them, these border agents don't just work there to protect our border, many of them grew up there. these are their communities in their neighborhoods, and they are watching this crisis go and the president who won't do a thing about it, not acknowledge it, will jump on his plane to fly 3,000 miles to conference changed, but won't turn that plane south to come to the border to see the real crisis that is happening it is so frustrating in the border agent will tell you there is no end i sight. i am with the governor on this and a whole lot of other texans who are just fed up with this denial of a real crisis. >> they have got a lot of challenges in front of them. we appreciate you joining us, thank you very much. >> we are getting brand-new statements the current supreme court justices on their retirin colleague stephen breyer. of them we have the chief justice robert saying that breyer is an energetic jurist, he has rendered nearly half a century of distinguished public service to our country includin 40 to years as a federal judge, 27 is a member of this court. his pragmatism, and. government extremes have enriched the during oral argument has befuddled counsel and colleagues alike. that does go on, but went to ge a couple more in here. for more than 40 years, justice breyer serve the judiciary with integrity and grace, and deep knowledge of our laws, history in our government is profound prior to his good humor is legendary i will very much miss his wisdom and his weight at ou conference table. he and joanna have been fast friends and we hope to see them often as friends for many years to come. we wish them and their wonderfu family every happiness. they're are other statements as well, and they justices weigh i on his retirement that was just today made official with his speaking at the white house wit the president. the white house today saying being a judge is not a prerequisite for the president' supreme court pick, so how will that affect things the assistan u.s. attorney anna mccarthy joins is now. and become a great ses. you joined as yesterday, so how does that affect things? >> i think he is going to obviously pick a judge, i think it is clear that what the president wants to get done her is a confirmation before the midterms, i believe it will be confirmation of somebody who ha already been confirmed because that makes it a stronger case, so a judge he was already been confirmed to the court of appeals in recent times for example would help to get this done. it is correct that you don't have to be a judge, you don't even have to be a lawyer, but i think it helps. >> it is remarkable that by the way, childs was the prediction and seem to be the wish of dave's fiber and when he joined us at the top of the hour. it appears there are some front runners, but it appears there are some that are wishing that the person to fill the seat of breyer, we'll be a gout garner more by the partisan support have you given that thought, andy? >> i really think, i hear all kinds of stuff all the time. every time we get an opening, people talk about there is precedent that there is involve in their rules that are involve and we need to get a moderate, they need to get to 51, that's what they need i think whoever gets picked is going to be pretty much a replica of justic breyer. i don't think in 20 however man years it was that he was on the bench, i don't think he surprised us many if any times with how he voted. the progressive judges because they have a different philosoph of what the point of the court's , and that is to advance progressive pieties, they are pretty predictable in how they're going to vote great as long as they are reasonably satisfied that when they put on the bench will vote that way, than i think what they are goin to go for it is youth and credentials. >> i spoke with our republican senator tom cotton earlier toda and here is what he had to say about the timing of the announcement. >> they have a lot of political crises and i imagine it might b in the back of his mind that if he made it much longer there would be a republican majority in the senate after this november because of rising inflation and rising crime and weakness are broad and general dissatisfaction with the joe biden presidency. >> okay, what about that, andy? nato. russian officials say they are still reviewing the full u.s. response. also today u.s. officials say they invasion into ukraine stil could come at any time. at least 8500 u.s. troops remai on alert to potentially deploy to eastern europe. it would be assisting nato nato. today jennifer griffin rest officials of weather the u.s. was waiting too long to provide much-needed support to ukraine. >> it seems like this is the 11th hour. what is taking so long? >> we have been providing comin in the last year alone we have provided many millions of dollars worth of capabilities t in russia a lot of money for today german foreign minister joined u.s. officials and suggesting an invasion coul have major applications for the pipeline. that pipeline will remain controversial it this very great to se you and great to have you here. >> thank you for having me. >> is this opening of the pipeline is this an effective strategy for us? >> you know, if you are to dete putin, it's not going to have any point at all. he has calculated that in and can handle that. but we have got to stop and jus kind of look at this from a little larger just to what is happening on the ground and we have got to say why is it in america's interest to potentially risk war with ukraine first or secondly it could potentially out with russia over just because we don't want to lead ukraine into nato which is we don't want to extend the nato membership. look, the nato charter says you have to have resolved all of your internal disputes from ethnic groups or religious groups and all border disputes, neither of which ukraine has done, so it would be not in our interest to bring ukraine in. that is the primary issue that is driving russia. so if we would just say hey, we're going to put a moratorium on that right now, that is the best way to deter putin from attacking ukraine and that woul be better for ukraine. if we stay on this path you're come out where becomes likely. >> are you suggesting that it's not in our interest to prevent putin from a takeover of ukraine ? >> no not at all, as a matter o fact, if we take this moratorium , putin will have no motivation to go into ukraine. the truth is right now if his forces were there, they can tak ukraine any time of their choosing and there's literally nothing we can do to stop it because they have all the force in place. we're not going to risk nuclear war with russia right away. but this could stop it. >> am curious to how this would happen because when i was listening to midpriced, i was keenly listening to any specifics that he would offer a to how we would stop the flow o gas through the pipeline and he didn't offer any specifics. he did say we would work with germany to make that happen. we know that germany has great interest in that energy to come to their country. they are highly dependent on russia. 50 percent of their gas comes from vladimir putin. are we certain that germany would join that fight? >> no, we are not sprayed as a matter of fact it's also important to understand, that pipeline is not yet opened its finished, but it's not yet open so gas is still coming there, but it's coming from elsewhere meaning this won't have any practical implications, but als that is what germany would be happening that putin wouldn't shut off the pipeline that are running from other places because it would be catastrophi not just for germany, but for all of western europe because russian gas goes all over the place. we have to be careful not just for ourselves, but for our nato allies because we could make a bad situation worse for them. right now this could go bad in so many different ways. >> colonel, we hear you. real quick. when you think something happen if vladimir putin decides to move in there? >> obviously no one can know fo sure, but i think within a few days from now, it may be a week or so some of these deployments that they have will be complete and then it could be at any moment. >> general keane last hour saying he thinks we should already have troops moved in there. should have done it a while ago he said. great to have you here. did you have a quick final on that? >> look, american forces should absolutely under no circumstances get involved in this war. they're is nothing that would b worth their blood that is going on in ukraine. we need to floating that idea. tell us more about it, what are your wishes when it comes to th president filling the seat welcome? >> thank you very much for having me. as you may know, at this situation we are in today is about two years old. it was in february of 2020 that the president at the time candidate joe biden made the commitment that if given the opportunity, he would nominate the first african-american woma to serve on the supreme court's. i think one of the real blights and the history of this great country is the fact that over all these years, there has neve been a black woman even considered for the united state supreme court's. here we are, having had five women, to retired and one has passed away, when retired, and three sitting there now. but nobody has even ever talked about putting an african-american woman there. when i talk to that now president, then candidates, i asked him to take a look at that . and to pledge to do something about that. he took a look. a he pledge to do something. and he is now going to do it. he who is it specifically that you have in mind? i will read a quote from you verbatim. i want to make sure it is a black woman i want to make sure it is a woman that will get universal support. you said when i say universal i mean bipartisan support, who could garner that in your view? >> i suspect that i just know one who would. and that is michelle childs. when i first advanced her name, i saw the two republican senators from south carolina lindsay graham, and kent scott, and told them that i was going to advance her name, i asked them what they thought about her . both of them were very favorabl or. i think that that is a good signal. >> of course, she is the u.s. district judge, so you say that tim scott and lindsay graham would support her. i believe you described both as very high on my child child's. what is your vision to fill tha seat. there has been a lot of talk fo the president to give to the progressive crowd to felt that seat, someone to take a more centrist route. so describe child's and why she would be the best pick in your view. >> welcome it to be clear, i said they are favorably dispose toward her, they are high on her , i have no idea how they will vote if she were the nominee. i do know this, before she was at district federal district judge, she was as south carolin circuit judge. before rivera and his 27 -year-old partner were ambushed, shot and killed responded to a domestic dispute. since 1:00 p.m., hundreds of fellow officers and new yorkers have been lined up. reportedly up to 1800 mourners per hour were led inside the cathedral to pay their respects to the 20 two-year-old officer and his family. new york city mayor eric adams of former nypd captain himself arrived this afternoon just after 3:00 p.m. and delivered this message before he arrived at the cathedral. listen. as our city mourns the loss of two officers two days week one and the funeral tomorrow of bot of these officers, we sit under the tree of public safety because they watered that tree with their blood. we should never forget that. officer rivera was the first an his dominican american immigran >> look, what the biden administration is trying to do in transporting a lot of these migrants from the border to places like new york and elsewhere it shouldn't be occurring great if it does occur , they obviously need to coordinate with local law enforcement which they're not doing. they are compounding bad decision upon bad decision. this is what it looks like when you have an open border policy, when you don't enforce the law, and you have record number of illegal apprehensions every single month. they have nowhere else to put these individuals. they have broken the system and this is what it looks like. they have chosen to do this, this is an intentional strategy. >> i didn't hear jeff at s in the briefing room, we didn't have anybody in their, to space out the chairs and there's less reporters in the room, but this is the only that footage was only obtained because of a freedom of information act. the lack of transparency being provided by the administration is something. >> it's not only a lack of transparency, a lack of leadership. wins last time you heard the white house from the president to the vice president or even the press secretary talk about what's going on, the crisis on the border today. they don't talk about it, they don't visited, they want it to go away. they don't want to axley what they are doing because most reasonable americans would say this is crazy. how could you not enforce the law? the biden administration would lead you to believe this is the only reasonable explanation, there are other ways to secure the border. we showed the ways that you can do it under the trump administration. they are choosing not to do that . they are choosing to embark on this strategy for a very specific reasons. >> all of this, chad, as we are getting audio from a very tent meeting that was initially reported, but now we have it between border patrol and dhs secretary where one agent turne his back reportedly on the secretary. take a listen here. >> it may appear that everythin is hunky-dory, but we know better, i know matter. let me just say you can turn your back on me, but i will never turn my back on you. >> that's a very powerful moment , and an intense exchange. >> it is remarkable. i can't tell you, having been i that position, to have dhs law enforcement to turn your back o the secretary, just tells you they have a complete lack of leadership, there is a competence issue going on there. in the secretary could no longe lead the men and women of dhs a least the border patrol in that capacity because they know they have been in this crisis now fo almost 12 months in there is no end in sight and no policy changes being made. dhs leadership can go down to the border and talk to them, bu border patrol officers and law enforcement want action. they don't like words, they wil listen to the words, but they want action and this administration is not deliverin any actionable policies to secure the border and border patrol knows that and i think they are tired of empty promises . >> by the way, we did call the secretary to join us, and he is welcome anytime. an ice spokesperson confirming that oscar was alice, the man accused of killing the houston deputy this week has illegally entered the u.s. will this bring intention to th importance of securing our borders? >> absolutely. again, what occurs on the borders whether it's the illega narcotics are the illegal individuals coming across goes to any community across the country. it doesn't stay there. local officials are having to deal with that and local communities are having to deal with that. when you talk about border security it's not just for the communities along the borders, it's for all americans and we know the cartels are using the crisis we see today to smuggle more and more individuals, someone very criminal records that individuals, national security threats and others across the border. when we talk about operational control of the border which is dhs is bailar required to do, but yet you see 170,000 illegal apprehensions in one month alone , it's anything but that. the department, because of political leadership and decisions being made are not enforcing the law, not adhering to the responsibility that congress has gave them. it is affecting every community in the country. >> the stats that the governmen about the event know that are receiving. that was a very powerful moment. final thoughts on that, the recruitment and the tik tok mentioning that they are using social media venues like tik to to recruit. what can be done to shut that down? to get their short answer is ye it will, and especially with th policies that president biden i pushing that really discourage up to 2 million americans from reentering the workforce. so you have got a recipe i thin for more inflation, including build back better which is stil out there somewhere in the senate has over $1 trillion of taxes on businesses that create disincentives for investing in new plants, new equipment, new technology that could help us work through this very the othe thing the report say that confirm all of this to be fair, the president finally met one o his quarterly economic projections was the first since he took over the white house an the numbers have been dumbed down to the minimum so that is some improvement, but there are red flags in this report today reading inflation and massive drop in disposable income for families, that is another red flag great and then of course you've got really just build up of inventories in this report that you take it out, those are temporary and volatile. take that out, the economy grew by less than 2 percent, there i a lot more work that needs to b done to get this economy moving. >> you could dig into any history book and see that any inflationary times that we have seen in modern hysteria history if you add spending to equation it only drives prices higher pe eight east that's is also not politically popular, and we are seeing the president continue t drop to new poll close in the polls. >> i am stunned, and i think th american public's as well. they made a number of mistakes to make the economy worse, especially in inflation. i think driving trillions of ne government spending as we were already coming out of the worst part of the pandemic economically at least. policies that instead of people stay home, i think was a major problem. i think everything he did to yo ignite inflation was there and to continue to try to put more money into the economy, which h is continuing to do in this build back better, all of it drives inflation and a big way. what i worry about is between president biden and the fed acting to slowly into weekly, i really worry that at some point this year, you and i will be talking about a wage price spiral that is going to be very very hard to end and that is where i don't think anyone in the country wants to go. >> that would be very harmful t business and at the same time they are dealing with spiking energy prices. congressman, before you go, i wanted to ask you about the you state's governor, he very pointedly blamed the biden administration for what is goin on at the southern border. as we get more video showing th mass release of migrants. he was fired up and he was listening to ag's of states who are dealing with this crisis. why is more not being done to tackle it? >> i think he is going to obviously pick a judge, i think it is clear that what the president wants to get done her is a confirmation before the midterms, i believe it will be confirmation of somebody who ha already been confirmed because that makes it a stronger case, so a judge he was already been confirmed to the court of appeals in recent times for example would help to get this done. it is correct that you don't have to be a judge, you don't even have to be a lawyer, but i think it helps. >> it is remarkable that by the way, childs was the prediction and seem to be the wish of dave's fiber and when he joined us at the top of the hour. it appears there are some front runners, but it appears there are some that are wishing that the person to fill the seat of breyer, we'll be a gout garner more by the partisan support have you given that thought, andy? >> i really think, i hear all kinds of stuff all the time. every time we get an opening, people talk about there is precedent that there is involve in their rules that are involve and we need to get a moderate, they need to get to 51, that's what they need i think whoever gets picked is going to be pretty much a replica of justic breyer. i don't think in 20 however man years it was that he was on the bench, i don't think he surprised us many if any times with how he voted. the progressive judges because they have a different philosoph of what the point of the court's , and that is to advance progressive pieties, they are pretty predictable in how they're going to vote great as long as they are reasonably satisfied that when they put on the bench will vote that way, than i think what they are goin to go for it is youth and credentials. >> i spoke with our republican senator tom cotton earlier toda and here is what he had to say about the timing of the announcement. >> they have a lot of political crises and i imagine it might b in the back of his mind that if he made it much longer there would be a republican majority in the senate after this november because of rising inflation and rising crime and weakness are broad and general dissatisfaction with the joe biden presidency. >> okay, what about that, andy?
