Doctors behind these reports and why they made a public call to the white house for a needed strategy overall. The president promised that his mission was to shut down this virus. Remember these . Im going to shut down the virus. Ill shut down the virus, not the economy. Im not going to shut down the country but ill shut down the virus. Martha now President Biden being told that people will need to learn to live with this as 49 of voters say the president is failing on his handling of the virus. Thats up 15 points since may. That was one of his strongest areas going through a rough patch where that is concerned. Dr. Michael olsterholm is one of the president s advisers urging him to make changes. Doctor, thanks for being with us today. I guess id like to ask you right off the bat what made you publish this strong group of letters . Well, first of all, lets characterize them for what they are. Were looking six months or a year from now or maybe longer. Were in a crisis state. Every country is in a crisis state. Every leader is dealing with this issue, even in china. What were trying to do is say, well, you know, its important to stay focused on now. Were going to have to live with this virus going forward. What are the steps that we need to take to be the transition to living with the virus. This is not a criticism of what were doing right now. This is not at all calling for a change in the program. Its talking about how after two years will we have to grow what we do to live with covid. Martha as you point out, you feel like in this current wave of omicron that youre borderlining too late for vaccinations that happen now to work for this. You also say that n95 are the only masks that make a difference and theyre not widely available and testing is inadequate. Well, lets take each of those. Theyre very important points. First of all, if you look at the issue of testing, every country in the world is in the soup. The United Kingdom and israel were touted as having the best Testing Programs in the world with the most availability and they have the same challenges that we have. This is a surge. Its like a level 6 Hurricane Hit us. Testing needs are incredible. We cant meet it. In terms at looking where we go with vaccines for the future, not everybody will get vaccinated. If i were on the show and it didnt exist in 1983, but if i were on this show in 1983, we would have talked about the Death Sentence that hiv posed. Being positive for the virus mean you didnt live long. But we developed drugs and therapeutics that made hiv a chronic disease. That is going to be part of the picture going forward. Its a combination of vaccines and drugs. When given to people in the earliest stages will help prevent them from getting seriously ill. What were talking about is all of those changes that can help. Get us to a point of the future. Martha understood. You talk about other countries that are in a similar boat. I think theres always a feeling in this country that we should be the people that know how to handle it the best. We do spend an extraordinary amount of money. Funding for nih, the department of health and human services, 50 billioning in funding for 2021. You point out in the articles that were put out by your group that you sort of are frustrated we dont have a modern data infrastructure. A lot of us are frustrated we dont. Why arent we doing better surveillance . Weve been doing this two full years now. Why are we always saying this study done in israel and this one in the u. K. , why arent we doing real surveillance with the billions in our Health Agencies . This is an important point. We have to do better here. Make no mistake about that we do. The money that we talked about bought us the new vaccines. I give credit to the previous and the Current Administration with what weve done with the vaccines. I wouldnt want to be in china and russia where the vaccines that they have dont work against omicron. Ours work. So in a sense, thats a success there. In terms of building the infrastructure or very simple way of saying how do we get case reports from the ground to some Central Location so that we can tell you whats going on, thats like trying to build a sky scraper. You cant do that overnight. We will build this and its critical it gets done as soon as possible but it wont be overnight. Martha yeah. I think a lot of people are frustrated by that. Sounds like you are, too. It cost 15 to do operation warp speed. We have four times that in the hopper in terms of money spent by these Health Agencies, dr. Osterholm, thank you for being here. Good to see you. Thank you. Martha the white house saying moments ago that they have finalized a contract with a Test Manufacturer as part of a promise to deliver a half billion tests to americans that want them. More contracts are needed. The Washington Post reporting that the administration and the u. S. Postal service are putting finishing touches on Distribution Plans for these tests. Theyre aiming at trying to get those out in mid january. A lot of folks have been meeting them over the past month. Once again, in terms of anticipating the need, watching what was going on in south africa and the u. K. , frustration about where the tests are. So still ahead, trey gowdy on the federal government exexerting its power to enforce Vax Mandates In The Name Of public health. This breaking just moments ago. The sentencing of the three men in georgia for ahmed arbery. The sentences just came down. What can you tell us . We heard a cheer from the courtroom. The judge hammering all three white men convicted of murdering Ahmaud Arbery with the most severe penalties possible under georgia law. The judge had a choice between Life In Prison without parole or Life In Prison with a chance of parole. For the first two convicted murderers, that would be travis mcmichael, the man that had the shotgun that pulled the trigger, he gets Life In Prison, no chance of parole and and additional 20 years for assault. His father, Greg Mcmichael also armed while they were pursuing arbery, he gets life with no chance of parole and an additional 20 years. The third person involved, roddy bryan, blocked arbery from leaving the scene, he gets Life In Prison but he has a chance of parole with an additional ten years. He will serve at least 30 years. These cases will be appealed. The judge giving the harshest sentence possible and a scathing rebuke from the bench. He rebuked all three men, convicted murderers going to jail for life as bad neighbors. He said after the shots were fired, they turned their backs on arbery. This was a killing, this was people taking the law in their own hands and it was callous. They said arbery was murdered by these young men. Martha steve, thanks very much in brunswick, georgia. And now parents are rallying against the chicago teachers strike that left thousands of kids at home. Some of the teachers are breaking ranks and showing up at school anyway to show solidarity with the parents. More parents are opting out of the Public School system disgusted by the function that theyve seen the past couple years. Nationwide, theres been a 3 drop in Public School enrollment. That number is even higher in some of the major cities where weve seen School Lockdowns over the course of the pandemic. Leo terrell says the virtual teacher walk out was indefensible. First to grady tremble on the alternatives. Hi, grady. Hi, martha. This is one of those School Districts where theyve seen a steep drop in Public School enrollment. Lets show you the numbers. In chicago, the Public Schools have lost 25,000 students from the 2019 school year to this school year. This is one of the options that parents are looking into. Micro schooling is what they call it. Smaller class sizes, fewer students. Were at Humboldt Park montessori. Tell me why parents are interested in this especially as youve been able to keep classes open. Yeah, i think parents are looking at what are some different options out there and what kind of learning would work best for my child. We offer things like playing outside for two hours a day and doing hands on work in the classroom. We also have lots of difference ages in one classroom, so it feels like family at home. We were here this morning and watched some kids come in with their parents. The dad did the swab in the nose for the covid test. This is a peace of mind for some parents, which youre able to do on a smaller scale here. Keep track of the covid cases. Yeah, were a small school. So we can know, okay, this child has a cough. So we can keep track on it on a small scale and shift to things like being outside more or having different ventilation really quickly. The cost is one drawback for parents thinking about this. Thats try. Our school does an equity based Financial Aid program. Some parents pay full tuition and some parents pay less. So martha, this is one of the options that parents are looking into, the Micro Schools as theyre able to stay open for inperson learning throughout much of the pandemic. Martha interesting alternative. Thanks, grady, very much. Lets bring in leo terrell, a former High School English teacher, Civil Rights Attorney and fox news contributor. Good to have you here today. Glad to be here. Martha looking at chicago and what has happened there. We see that parents have taken a lot of different options and states are providing them money now to take advantage of the options. I was struck by this teacher, a chicago teacher, who is defying the strike that is happening right now. Hes battling cancer. Hes refusing to not be in the classroom with his students. Watch this. So the kids suffer out of this Remote Learning a arrangement. So i thought i cannot be part of it. To think that my classroom, my students, theres 82 of them out of the i have five classes. Not one has covid. Martha were seeing some of these chicago teachers pushing back against the union. What do you think, leo . Im glad. Bravo to that teacher. I have my teachers license. I volunteered to teach Substitute Classes in california. Heres the problem. The unions have a strangle hold on public education. I applaud the 8 to 10 of those teachers that are saying no. Education, martha, is a key to breaking the poverty cycle. What you have here is a union that controls the Public Schools. A union that basically provides money to democratic candidates, and they basically are the agents of the union. You have to break the power cycle of the unions and alternatives of private schools, charter schools, is the only way to go. Martha i think youll see this be a huge issue in the midterm elections. Governor doocy in arizona is giving money for people to use anyway they want for education. Youve been fighting for this in california, where its an Uphill Battle. Its an Uphill Battle but it committed 24 7. You know ric grenell, he started a fix california and put a School Ballot hes working on getting a School Choice initiative. Its the only way in the deepest blue state. The unions control californias politics. They gave Gavin Newsome 2 million. Im working with ric grenell and working on a ballot initiative. You break the control of the teachers union, im talking about democratic independents, republican parents, people of color, you give them a choice to go to any school, take the money outside those zip codes, i guarantee you youll break the power of those teachers unions and have competition and youll have the unions not thinking that they control public education. Martha yes. I mean, theyre losing their power. People are voting with their feet out of the Public School system. You have florida, for example, i dont think that Governor Desantis might be in office if he didnt support School Choice. People from minority communities that crossed over from them being democratic voters and voting for him because of that. Well see this as a very active issue given whats going on the past couple years. Thanks for being an advocate for kids and students. Good to see you. My pleasure. Thank you. Martha coming up here, the federal Governments Authority to enforce vaccines for private Sector Workers has been called a breathtaking assertion of authority. Now its before the court. The justices of the Supreme Court are hearing this case today about thatindependence and that choice on the part of private employers and their employees. Trey gowdy joins me next. Some of my best memories growing up were cooking with mom. So when she moved in with us, a new kitchen became part of our financial plan. Find a Northwestern Mutual advisor at nm. Com people with moderate to severe psoriasis, are rethinking the choices they make like the splash they create the entrance they make, the surprises they initiate. Otezla. Its a choice you can make. More delicious, farmfresh taste. Plus, superior nutrition. Which is now more important than ever. Martha showdown at the Supreme Court over the president s Vaccine Mandate that could affect millions of workers and employers across the country. The question, what is the reach of the federal government. Can they require a private company to compel their employees to get a vaccination against their will. Or to get tested and wear a mask as an option. Heres some of what we heard from the justices today during these arguments. Listen. I wonder if its not fair for us to look at the court as a general exercise of power by the federal government and ask the questions, why doesnt congress have a say in this and why isnt this the primary responsibility of the states. More and more people are dying every day. More and more people are getting sick every day. I dont mean to be dramatic. Im just stating facts. This is the policy that is most geared to stopping all of this. Martha that sums up what is going on here. Lets bring in trey gowdy, the author of doesnt hurt to ask and sunday night in america. A great show here on fox sunday nights. You have the Chief Justice saying is this a question that has to fall to the court or is it a question that can be better answered by congress or states. Then you have Justice Kagan saying because theres a compelling need in the country, its incumbent on the federal government to step in with this mandate across the nation and for, in her opinion sounds like, the court to uphold it. What do you think . I think those two clips you played, thats the perfect dichotomy of the issue. You may agree that we want to end covid. How do we get there . Who has the power to require what and to whom and of whom. That is the way we need to look at these two cases. Who has the power. I think what Chief Justice is argumenting is the federal government, the Executive Branch Cannot Go Agency By agency. On one case it was osha. Another hhs. You cant go agency by agency to affectate this countrywide mandate. States may can do it. Yoloyer and my employer, martha, can probably make us get vaccinated. But can the Executive Branch or should continue weighin . Thats what was on the docket this morning. What can be required of whom and by whom. Yeah. Its a Classic Question of federal power versus state power and the freedom of individuals to make a choice with regard to their own health or decide to go work somewhere elsewhere its not required. I want to play this sound bite from jeff landry the Louisiana Attorney general. Get your reaction. Whether or not the federal government can mandate federal procedures like a vaccine on you and then they can do it in a course, a manner of threatening your job, that is the basis under which were here today. If the answer to that is yes, then america that we grew up in no longer exists. Martha do you agree with the Attorney General . How do you think this is going to go . What do you expect based on what you heard today . For the first time in my life, i understood every word that jeff said. We served together a number of years. That accent is hard for me. Hes talking about the hhs. Can hhs require their employees through medicaid and medicare to get vaccinated. Theres no mask alternative. Its pure vaccination. I wouldbe surprised if the court doesnt do what it always does. We heard the case. Were not ready to rule. Lets let it play out in the lower courts. Its not an emergency issue. Play it out and see you in two years. Martha thanks, trey. Well look for you sunday night. Thank you. Martha coming up, a big exclusive ahead with the former Communications Director for Congress Woman alexandria ocasiocortez. Hes now calling out President Bidens age in his words and unpopularity as a reason that he says democrats will probably get demolished in the midterm and probably that the president will find himself up against the primary challenge. Well talk about that. Very interesting. Brian claypool joins me on the multistate effort to get ahold of alex baldwins cell phone. The investigators say he cannot be considered as a cooperating witness at this point. Hes not cooperating. That is next. I dont know. I think they look good, man. Mm, smooth. Martha the parents of the teenager accused of killing four students at his high school in michigan just lost their bid moments ago to get a lower bail, lower than half a Million Dollars worth. Thats james and Jennifer Crumbley pictured before you there. Theyre behind bars on charges of involuntary man slaughter. Prosecutors went after the parents because they bought him a gun and refused to take him home on the day of the shooting after concerning images he drew in school. And crumbley is charged with murdering four classmates at Oxford High School whose families continue to mourn them through this difficult period of holidays and the new year. Well stay on that story for you. Despite the warning issues three weeks ago now, alec baldwin has still not cooperated with authorities. New mexico authorities have not gained access that they requested and put a warrant out for his cell phone and the messages and the texts on the cell phone that could pertain to the case and the background of what happened in the shooting and killing of heleyna hutchins. First, we go to christina coleman. Martha, its been three weeks since the warrant has been issued. The d. A. Said that Santa Fe County Sheriffs Office is working with the Suffolk County new York Sheriffs Department and mr. Baldwins lawyers within restraints to obtain any materials from mr. Baldwins phone that pertain to the rest investigation. Authorities out of new mexico are working with authorities out of new york on this effort. We reached out to baldwins attorney and have not heard back. Nobody has been charged with the deadly october 21 shooting. Baldwin was holding the gun when it went off killing hutchins. Baldwin denies pulling the trigger. You have this colt 45 and youre holding on to the handle. Does that work . You see that . She said yeah thats good. I let go of the hammer and the gun goes off. Some gun experts question baldwins account of how the gun went off. More than 500 round of ammunition and what appeared to be live rounds were found on the set of the movie. How they ended up there are part of this i dont know going investigation. Martha . Martha thanks, christina. Attorney Brian Claypool joins me now. Good to have you with us. Theres a lot of frustration by those of us that have watched this case about whats going on. Theres a warrant for his phone, information on the phone. Why havent they received it yet . Hi, martha. Happy new year. Great to see you again. I dont know if you remember that movie going up, but you remember Bad News Bears . Martha i do. Yeah. It was a funny one. But this criminal investigation mirrors the Bad News Bears. It has been an atrocity. You and i talked about a month ago. You had a great point then. Why wasnt a Search Warrant issued immediately for his phone . And then a delay to issue a Search Warrant. Now were weeks later and they tonight have the phone . Are you kidding me . Last time i checked, when you issue a Search Warrant, you take it, go to somebodys house. You dont say hey, since you rep a bigtime celebrity, we want to arrange the Search Warrant. Why hasnt that happened . What im sensing in your piece, you mentioned jurisdictional constraints. What baldwins later is saying, you have a Search Warrant from another state. Theres a legal document called comedy. One jurisdiction might honor an order from another jurisdiction. Some dont. They might have you get a warrant from the courthouse. Why dont they do that and get their own court order in new york to serve a new york Search Warrant to get this phone . Its ridiculous. Martha all of what you just described seems like it should have taken place on day one. Then it could take place over a 24 to 48 hour period to get that comedy, to get that agreement. As you say, to just show up with the warrant. Alec baldwin has said through his attorney, im not just turning it over. You need to send a warrant. So theyre dragging their feet. Well see where it goes. Clearly theres some responsibility. This accident happened. If it was purely an accident, which is part of the investigation, but clearly there was some fault here. We need to get to the bottom of it, a woman is day. Brian claypool, thanks very much. Well see you soon. Happy new year to you. Thank you. Martha coming up well speak to the aide of alexandria ocasiocortez. She called President Biden old and unpopular and ineffective. His words. He says hes vulnerable to a primary challenge. Org today. Martha more than two years ahead of the 2024 election, some Progressive Democrats are looking at the possibility of a primary challenge to President Biden. His approval has dropped about 13 points since he took Office Nearly one year ago according to the real clear politics average of polls. One of my next guests told politco, hes deeply unpopular, hes old as bleep and hes largely been ineffective and he will probably get demolished in the midterms. Lets bring in corbin trent, staffer for alexandria ocasiocortez and the founder of the no excuses pact. And joint by jim ogreen, founder of truth. Org. Great to have you with us today. Corbin, those are strong words. What is behind them . Well, one thing polling is behind that. Were seeing with my version of the midterm outcome is not just my version. Were seeing that the polls show the republicans have a slight edge. That may be getting worse. We see bidens Approval Ratings going down and moving in the wrong direction. What were seeing right now is a Democratic Party that has done a lot for the American People and has largely been unable to articulate what its doing and what its done. That is a real challenge. Martha and who would you expect those primary challengers to be, corbin . If anybody sort of traditional were to pop up, it would be a wide variety of people. You have a guy that is pushing 80, right . There wasnt even certainty that he would run for a second term when he first ran. So if theres if we see a midterm outcome where democrats lose the house and god forbid the senate, too, all bets are off and well see the Democratic Party trying to go in a different direction and truncate their losses. Martha very interesting. And Kamala Harris would be the obvious choice in most scenarios. Shes had struggles p. R. Wise and shes had a number of people that have left her team, seven of them over the last six months. Do you think she is a viable Potential Replacement for President Biden if that turns out to be the case . Well, first, martha, we have to start with reality. There will not be a serious challenger to President Biden for the democratic nomination. Point blank, period. Anyone who says or speculates anything different is basically how we look at this down in texas, all hat, no cattle. So i have to say that corbin, bless your heart. I understand that, you know, this is the one thing that folks on the far left and far right agree with republican challengers in 2024. They want this to be a story. It not a story. Were seeing a record economic recovery. Were seeing the Great Recession as folks are calling it as being driven, fueled by American Exceptionalism as so Many Americans are starting businesses under the biden administration. Yes, weve got work to do in 2022 to keep the house, to keep the senate. Yes, there will probably be fringe candidates that jump in to the race as thats going to be for name recognition, for an attempt for relevancy. But theres not going to be a serious contender. Vice president harris is not going to be martha we have looked at some tough job numbers and polling numbers are real. You can say you dont care about polling. The real clear polling is an aggregate of a lot of polls. What is your response to jehmu . She says youre all hat no, cattle. People guaranteed that donald trump wouldnt be the nominee for the Republican Party. We cant predict the future. Hopefully youre right, jehmu. Were in a great economic position but were unable to sell that to the American People. Thats not the sense that people get for whatever reason. Specifically on the economy, which i think were doing a great job as a party, were getting beat. 56, 57 of people polled think that biden is doing a poor job. So thats record stock market, record jobs numbers and trailing in peoples minds. Thats my concern. What the American People are seeing and feeling. Martha im curious we have to tell martha one second, jehmu. So ted kennedy ran against jimmy carter. Theres parallels here. I dont see a ted kennedy in the list of people that are floated at this point. We can put that up. Alexandria ocasiocortez, stacy abrams, Cory Booker A Bunch of names there. Corey, can you envision a scenario on candidate that could create a situation that was a tremendously difficult situation for democrats in 1980 where ted kennedy said i dont think think guy can pull it off. Im going to run against him. Im imagining a president ial cycle like we had in 96 and 92 where we had Third Party Candidates that allowed president clinton to win tennessee twice. I dont know what will happen. But were not connecting. Right now the American People are divided in how they feel about the economy, divided about how were handling the covid pandemic. We have to do a better job uniting the country. For whatever reason, President Biden has not been able to do it. One of the problems is weve tried to align ourselves close with the Republican Party that has little agenda. 13 republicans out of 12 voted for this bipartisan infrastructure package. Roads, bridges. If you cant get behind it martha well leave it there. Maybe well kick it forward and smash it in 2022. Martha interesting to talk to you both, a big midterm year. Thank you, corbin and jehmu. Thanks nor being here. Coming up, Mollie Hemmingway and joe concha respond to President Bidens Support Levels and the potential for someone running against him in his own party. That is next. Trent was, corbin trent, about the need for some to do just that . Well, i think the problem for joe biden is he has these really low poll numbers, but theyre mostly a reflection of his policies, its not his personality. Democratic policies tend to be less favorable right now. Hes governed quite progressively. Thats the Democratic Party, pretty much in agreement that they want to be this far left party and they have control of the senate and the house so hes done things that are very radical. That is the nature of his problem. I wouldnt worry about him getting a challenge from a progressive wing when hes so progressive contrary to how he claimed he would be when he ran. He might have a challenger that is competition or that can pull off that game of pro tending to be more moderate like he did in 2020. Martha like, for example . I wouldnt even speculate. I kind of agree that the Democratic Party understands that it would be very bad for them to have an intraparty challenge. I wrote in rigged that the trump team now they wanted to ward after any Intraparty Threat and avoided that. It tends to be true when you face an intraparty challenge, you lose your reelection effort. Everybody knows that. So theyre probably going to work hard from happening that. Martha thats what happened in 1980. Joe what do you think . I think besides 80, which was close, kennedy almost did successfully primary jimmy carter. Then its kind of like the nfl. You have a quarterback that is struggling right now. If you had this great number 1 pick backup that could jump in and same the day but the democratic bench is so profoundly mediocre. When you look at plan b. , if thats Kamala Harris, she was at 28 approval. Thats not good. Pete buttigieg still is not 40 and he has a Supply Chain Crisis on his resume now. You go down the list in terms of who could pickoff joe biden . The only person that i think of that could give him a run for his money, hillary clinton, the 2016 nominee. Who knows if she would want to run at this point in her life having run for president twice and lost. Hes right for the plucking with the right candidate. Hes 72 disapproval on inflation. In the 30s on crime. In the 20s On The Border and afghanistan. This is key. Cnn poll out recently, 2 3s say hes not a leader that we can trust. If you had the right challenger, yes, its a real possibility. Right now the bench is so thin i dont see who can do it. Martha molly, you think biden and harris run together again in 2024 . I thought he was too old to run in 2020. Im not sure how good my prognostication is. He will be at such an age that is a problem and youre seeing the issue with his age and how he talks and again, that level of competence that isnt there. Martha thanks very much. Great to see you both. That is the story of this friday, january 7. We look forward to seeing you monday. Thanks for being with us this week. Well see you then. Your world gets started in a few minutes from now. Have a great day, everybody. Neil get the jab or lose your job.
