can my child go to school? can my child even go outside? is omicron more deadly than other variants for kids? and we usually look to our public health experts for guidance. in this case she just admitted sort of on an aside those numbers were reported it was a small sampling of children. and the reason they did that was just increase vaccination rates among children so parents would get their kids vaccinated. but it was a misleading statistic. you cannot do that and expect people to continue to trust you. i think there is such a lack of trust with public health guidance and if president biden were smart, he would also pull dr. fauci off tv. nobody turns people off that don't agree with this quite like dr. fauci. if dr. fauci's goal is to get the american people vaccinated, he would voluntarily stop going on tv because he is doing the exact opposite of what he wants to do. when people see him they turn it off and say i am not doing what this man says because is he so politically partisan and i have had enough of him. joey: i always find it fascinating once these people get caught in trying to fear monger us to get to us do what they wants us to do. no, that's not what we were trying to do. it that's exactly what you guys were trying to do. anyway. we will continue covering that. carley: unbelievable. on to this. in virginia, you guys heard a lot about virginia when it comes to education they have been like the epicenter of the reforms and think rt and all this other crazy nonsense. virginia teachers are firing back after the school district implementing a more equitable grading system. in this system, just to set it up for you guys, there would be no more grading for homework. no late penalties for homework. unlimited redoes and retakes on assignments and no extra credit. so, to be clear, they feel like minorities and people of color and, you know, i'm a black man, i just got say, i find it very offensive that they feel like that we can't cut the mustard, that we need some type of extra standards when it comes to our education system. we need teachers to do their job. if they teach the kids the right way, no matter where they come from and give them the proper information, no matter if they are poor, black, white, hispanic, or whatever, then these kids can be successful. we have seen charter school after charter school be able to take those same kids, get them as and bs as well as full rides to college, so, it's not a race problem. it's a teaching problem. joey. joey: i have a different perspective here. i don't believe in grading homework. homework and assignments are for you the student to practice and learn. if you chose not to do and it you don't learn, they will find out on the test which is an aptitude test to see if you have retained the knowledge they taught you and if you get to move on in school. at the end of the day, this comes back to students doing their job, parents doing their job. i don't know that it's the teacher's job to instill work ethic into a kid. so if that were the reason, i would be all about it but to use this as some guise to further divide people and, like you said, under the auspice of equity like kids of a certain color can't do homework, that doesn't make any sense at all. i definitely have a big boy rules idealism on public education but in this particular instance, i don't understand where they are coming from. carley: teachers affected by this possible policy change think it's an awful idea. letter from wakefield high school teacher says he had quarts decades of experience we are extremely concerned with several changes proposed in the new grading and homework policy, changes if implemented will also result in the decline of high expectations in rigger in the classroom. given the emphasis on equity in today's education system. we believe that some of the proposed changes will actually have a detrimental impact towards achieving this goal. yeah, obviously. if you are not grating homework, you are not letting people fail, then there is no reason for feel try hard no treason got extra mile. i think it's extremely offensive. similar to no i.d. for voting like minders have trouble getting ids. why are we saying that certain races can't get ids and certain races can? i think it's extremely racist. the other issue, lawrence, is that we may be doing this, we may be mulling over these ridiculous equity rules in school, the one country biggest adversary china not doing this. joey: carley, i was just getting ready to pick up on that. how do we compete on the world stage with this nonsense? i mean, we are judging based on the numbers. even before the pandemic. i mean after the pandemic it's even worse. but we were not competing at all when it came to china, india, and other countries out there. so this is only going to push us back. the district spokesperson said this. they are still in the process of evaluating the current grading and homework policy. so they are not really confessing to it they are just saying they are evaluating. hopefully we push back. this won't stand. carley: yeah, i agree. i think that because teachers are speaking out against this and it's getting clearly international attention, maybe the school board will rethink this policy because students need to be held to account. they need to do their work and do well in school because, you know, then they will succeed. it's been working for generations. we don't need to reimagine everything in 2021. we are going to turn to some headlines now. beginning with, this a manhunt underway in texas for a 14-year-old who police say is armed and dangerous. authorities say the teen allegedly shot and killed three teenagers at a convenience store the day before christmas. he was allegedly driven to the convenience store by his father richard acosta. his father turned himself in to police. a $5,000 reward is being offered for information leading to enable across taps arrest. a second former cnn producer is under criminal investigation over allegations involving potential juvenile victims. fairfax county police confirming rick salby former senior producer for jake tapper is being investigated by the child exploitation squad major crimes bureau. this probe comes on the heels of the arrest of former cnn producer john griffin who is facing federal sex crime charges involving minors. wow. now to a fox news exclusive. several active duty marines say they are witnessing a political purge by the biden administration over the president's vaccinate seen mandates. military spokesman saying not a single religious exemption has been approved. a lieutenant colonel saying officials are discharged, service members, quote: as fast as they can. and as brutally as they can. damaging every marine as much as they can on the way out. and the knicks emanuel quinnly suiting up slightly different name under the pistons, take a look. >> yeah, it's like he gets it backwards. there is a federal response to covid. it's just not what he's doing so what he's doing is imposing unconstitutional mandates, the osha mandates that would require businesses to fire workers who aren't vaccinated. that's the opposite of what he should be doing. what he should be doing is aiding our supply systems and aiding our healthcare systems so how do you do that? well president trump did it by engaging in operation warp speed , by creating a testing regime that was really second to none by the time it was up and going, all biden had to do was continue to do those things, continue improving upon those things, and he sort of washed his hands of it and instead tried to take this hammer to the situation instead of the scalpal that's been needed by the federal government to actually get things going. in texas we are one of the states that doesn't have these monoclonal antibodies any more, we've run out and complaining to the administration about how these formulas are distributed not just before monoclonal antibodies but also for vaccine distribution as well so this administration just hasn't had the organizational where with all to really deal with this and they're learning the hard way that they probably owe the trump adminitration an apology because as i recall everybody called trump a murderer just because there was a global pandemic coming through and the first time we dealt with it. >> yeah it's amazing just how things can change so quickly. you know, you're in congress, you're sitting there, you're a texan but you're in d.c. it's probably hard, a little bit , to see this happening to the people you care about and represent, to not be able to go get a test or to just have an administration seem lazy on-the-job. what can congress do, what can you do as their congressman now and i don't mean to point it directly at you but what can congress do to help your constitutents to maybe get tests or feel better about this? >> well, we'd love to be able to give you better news but the reality is congress has already appropriated tens of billions of dollars to this specific problem, right now it's a management problem. the executive branch is not executing these dollars in an efficient manner. that's what's going on, and again, look. i'm a conservative. i always make sure people know, there is only so much government can do, and the moment that it starts doing more than it should be doing, you start to see un intended second and third order consequences that everybody is worse than you wanted to so what the federal government should be doing again , using their fema resources to bolster a lot of these testing sites open up new testing sites this is what we saw happen during the trump adminitration. they should be using our resources to increase those supply chains to get those monoclonal antibodies out to people faster, and president biden announced this , we just haven't seen results from it, helping us get more healthcare workers from the military or from fema, to aid in some of these hospitals that are feeling a little bit overwhelmed. still worth noting that at our height of hospitalizations right now, it really doesn't even compare to the height that we had before in 2020, so i don't want people to panic about this , but look, take the same precautions you've been taking for two years. lawrence: i think you're right, congressman, we've gotta live with this and learn how to protect the vulnerable, and if we do that, i think we're going to be just fine. i want to shift to some foreign policy news. president biden is expected to speak with russian leader vladimir putin ahead of the geneva talks, so what should the president project today? it seems like after that last chat that he had, putin really didn't get the message. he sent more troops so what does he need to do today to project strength? >> so president biden has to make clear that there will be costs and consequences to whatever putin does with the ukraine. now i think everybody knows that we're not really willing to send troops to the ukraine and fight the russians and eastern europe for this , and there's a lot of people on our side, a lot of people saying that these war mon gers had are just trying to get us into war. well just holdup a little bit. there's a lot of options in between doing nothing and in between war. lots of options out there. mostly economic sanctions, but that's what president biden has been talking about. it seems he needs to be a bit more specific and maybe hit putin a little bit more personal ly with his own finances , if there's going to actually successfully deter the ukraine. i think taking a page out of the trump play book would actually work quite well here. what trump did which was different than the obama administration was actually give the ukrainians defense weapons as oppose to say logistical supplies and that kind of aid. that sends a pretty clear message to the russians that this fight will not be as easy as you want it to be. doesn't mean america is going to come in gun slinging going to war. that's not what this means at all. what it does mean is there will be some minimal amount of support that makes the costs too high for you to do this. >> one of the more concerning headlines affects your home state of texas. in harris county, 113 people charged with capitol murder, so the most serious crime there is, they were granted bond, released back into the community, and some of them re-offended. when you're talking about 113 people, this isn't just a one- off. this seems to be the system that's in place. what needs to change here, congressman? >> this is some great local reporting done in my hometown, which showed us what we already knew, that a lot of the crime being committed is being committed by the same exact people over and over and over again. they just keep getting released out on bail. now, for violent offenders you really gotta scratch your head and wonder how that's possible. these are people who are being charged with capitol murder and then released on bond, no problem, left out into the streets, and big surprise they actually committed another murder and killed again. there are people who should be alive right now, were it not for these liberal judges who they operate off of this false sense of compassion. they think they are doing the world a kindness of some sorts by letting these criminals get out but in the end they are doing the opposite. they go out and they hurt people , they harm people, these are violent people and a reason we have a system the way we have it. this is happening not just in houston, of course. this is the story across all major american cities where you're seeing murders spike. the bail reform, the false compassion of da's and prosecutors funded by george sor os to be in those positions that is the story of crime across america right now. the good news is for america we can vote them out. da's, judges, in texas we vote for judges we can vote them out, and get our streets back. >> you talk about voting them out. i know that texas, i live in texas for a little while for a couple years and i think i'm 18 years from being able to call myself a texan, i was told it had to be 20 years to claim the title but i was around a lot of people moving in from southern california, the tech industry was there, and i know texas, like where i'm at in georgia, the balance of power is kind of evening out and 50/50, is this a part of that? are taking over today with the beautiful carley shimkus in the center. carley: that's right. i had forgotten both of your names -- not that i forgot your last name but i forgot that today is a jones sandwich. love that lawrence, i was off yesterday. i watched "fox & friends" from home. you did a great job. yesterday weirdly felt like saturday. today feels like monday. it's neither of those days. i believe it's thursday. i feel like the week between christmas and new year's everybody is confused what day it is. joey, i'm not alone on that front. joey: not at all. it's a gray day, i don't know what it's like for you guys up there but it was raining so glad on the way in today. i'm glad i got here safe and ready to have a couple of great hours with you guys. carley: three hours to go. big breaking news last night. we begin with a fox news alert. guilty of five of six counts. a jury convicting jillane maxwell of sex trafficking, recruiting and grooming underaged girls for jeffrey epstein. todd piro is live with the details on this front, todd, good morning. todd: good morning. maxwell's accusers rejoice. those inside the courtroom said maxwell showed no emotion as verdict was read. 60-year-old now facing up to 65 years in prison. her crimes conspiracy to entice and transports minors for sex acts plus the actual transportation of those minors for those sex acts, conspiracy to commit sex trafficking and sex trafficking of minors. she was acquitted on one charge though enticement of a minor to travel for sex acts. on this charge jurors earlier in the week needed more clarity. the prosecutor says the ruling was still a big win for the brave women who, quote: stepped out of the shadows and into the courtroom. listen. >> road to justice has been far too long but today justice has been done. todd: meantime maxwell's defense attorney says the once popular british socialite will fight these charges, watch. >> we firmly believe in ghislaine's innocence. obviously we are very disappointed with the verdict. we have already start wanted working on the appeal and we are confident that she'll be vindicated. >> that ♪ stopping maxwell's accusers from acknowledging their triumph. they are relieved and grateful at this verdict. back to you. lawrence: thanks so much, todd. let's bring in fox nation host nancy grace. nancy, thank you so much for joining the program. a couple questions for you just to kick this off. we know that the prosecution honed in on four cases focusing on those minors. they decided not to go -- widen the scope to those other victims. the defense tried to make the case about her being a victim but she did not take the stand. so my question for you, nancy and i know this from being a prosecutor investigator for criminal defense. most of the time they do their own investigation and they find out things about their clients that they probably didn't want to know before but they want to know it so they can defend themselves when the prosecution goes after them. was it wrong for her not to take the stand, to show the jury that she was a victim? she is going down for 60 years. that feels pretty good to me. tell you something a lot of adult victims of child molestation, ruins their lives. they go on, they look normal and may act normal but they are never the same. i hear what you are saying, there are other people to be held accountable, and it will be over hell or high water that the state doesn't prosecute other men that had underaged sex. do you know what? that's a euphemism. that's putting perfume on the pig under age 6 that's raping a little girl. it. joey: more than 100 supposed victims. only four of them had a chance to have their case heard. what do you do with the other, you know, almost 100? how do they feel right now? you spent time talking to victims of crimes like this. how do the other victims feel? do they feel vindicated and this is only the beginning? that's really where my question was going. >> well, it's a mixed bag. they feel vindicated because ghislaine maxwell is behind bars. thank heaven. they never got to tell their stories. they may have had other perpetrators and other men take advantage. today another big day we are learning that the civil agreement between another victim virginia and epstein a civil agreement she wouldn't prosecute. it's going unveiled today. i want to find out if that civil agreement for her not to sue included prince andrew and others. because that's a bombshell. if it included andrew or royalty, he might as well go ahead and hold up his hands. >> you know, nancy, that's the per segue, she released this tweet i hope today ♪ the end but rather another step in justice being served. maxwell did not act alone. others must be held accountable. i have faith that they will be. do you think they will be, nancy? can my child go to school? can my child even go outside? is omicron more deadly than other variants for kids? and we usually look to our public health experts for guidance. in this case she just admitted sort of on an aside those numbers were reported it was a small sampling of children. and the reason they did that was just increase vaccination rates among children so parents would get their kids vaccinated. but it was a misleading statistic. you cannot do that and expect people to continue to trust you. i think there is such a lack of trust with public health guidance and if president biden were smart, he would also pull dr. fauci off tv. nobody turns people off that don't agree with this quite like dr. fauci. if dr. fauci's goal is to get the american people vaccinated, he would voluntarily stop going on tv because he is doing the exact opposite of what he wants to do. when people see him they turn it off and say i am not doing what this man says because is he so politically partisan and i have had enough of him. joey: i always find it fascinating once these people get caught in trying to fear monger us to get to us do what they wants us to do. no, that's not what we were trying to do. it that's exactly what you guys were trying to do. anyway. we will continue covering that. carley: unbelievable. on to this. in virginia, you guys heard a lot about virginia when it comes to education they have been like the epicenter of the reforms and think rt and all this other crazy nonsense. virginia teachers are firing back after the school district implementing a more equitable grading system. in this system, just to set it up for you guys, there would be no more grading for homework. no late penalties for homework. unlimited redoes and retakes on assignments and no extra credit. so, to be clear, they feel like minorities and people of color and, you know, i'm a black man, i just got say, i find it very offensive that they feel like that we can't cut the mustard, that we need some type of extra standards when it comes to our education system. we need teachers to do their job. if they teach the kids the right way, no matter where they come from and give them the proper information, no matter if they are poor, black, white, hispanic, or whatever, then these kids can be successful. we have seen charter school after charter school be able to take those same kids, get them as and bs as well as full rides to college, so, it's not a race problem. it's a teaching problem. joey. joey: i have a different perspective here. i don't believe in grading homework. homework and assignments are for you the student to practice and learn. if you chose not to do and it you don't learn, they will find out on the test which is an aptitude test to see if you have retained the knowledge they taught you and if you get to move on in school. at the end of the day, this comes back to students doing their job, parents doing their job. i don't know that it's the teacher's job to instill work ethic into a kid. so if that were the reason, i would be all about it but to use this as some guise to further divide people and, like you said, under the auspice of equity like kids of a certain color can't do homework, that doesn't make any sense at all. i definitely have a big boy rules idealism on public education but in this particular instance, i don't understand where they are coming from. carley: teachers affected by this possible policy change think it's an awful idea. letter from wakefield high school teacher says he had quarts decades of experience we are extremely concerned with several changes proposed in the new grading and homework policy, changes if implemented will also result in the decline of high expectations in rigger in the classroom. given the emphasis on equity in today's education system. we believe that some of the proposed changes will actually have a detrimental impact towards achieving this goal. yeah, obviously. if you are not grating homework, you are not letting people fail, then there is no reason for feel try hard no treason got extra mile. i think it's extremely offensive. similar to no i.d. for voting like minders have trouble getting ids. why are we saying that certain races can't get ids and certain races can? well president trump did it by engaging in operation warp speed , by creating a testing regime that was really second to none by the time it was up and going, all biden had to do was continue to do those things, continue improving upon those things, and he sort of washed his hands of it and instead tried to take this hammer to the situation instead of the scalpal that's been needed by the federal government to actually get things going. in texas we are one of the states that doesn't have these monoclonal antibodies any more, we've run out and complaining to the administration about how these formulas are distributed not just before monoclonal antibodies but also for vaccine distribution as well so this administration just hasn't had the organizational where with all to really deal with this and they're learning the hard way that they probably owe the trump adminitration an apology because as i recall everybody called trump a murderer just because there was a global pandemic coming through and the first time we dealt with it. >> yeah it's amazing just how things can change so quickly. you know, you're in congress, you're sitting there, you're a texan but you're in d.c. it's probably hard, a little bit , to see this happening to the people you care about and represent, to not be able to go get a test or to just have an administration seem lazy on-the-job. what can congress do, what can you do as their congressman now and i don't mean to point it directly at you but what can congress do to help your constitutents to maybe get tests or feel better about this?
