griff jenkins. merry christmas eve, julie. this is fox news live. united and delta airlines both claim staffing shortages for the wave of cancellations, combined out of covert protocols, long lines and weather delays, it could be a mad dash to get home for the holidays. david lee miller's live in new york city with the latest. high david lee. >> hi, griff. home for the holidays is taking on all new meetings with this christmas season. would be travelers, at least many of them, are stuck at home, because of as you mention, staffing shortages. at a number of major airlines that have caused flight cancellations. the spread of the omicron virus is to blame. united today, castle about 9% of its schedule. that's 175. the onset of micro, nationwide spike in omicron case this week has had a direct impact on our flight crews and the people that run our operation. as a result, we have unfortunately had to cancel some flights and are notifying the impacted customers in advance of them coming to the airport. we are sorry for the disruption of the working hard to rebook as many people as possible to get them on their way for the holidays. now, as for delta, it has grounded a hundred and 41 flights, 7% of its schedule. early this week on the airline's ceo warn about staff shortages and requested that the cdc reduce quarantine time for people testing positive. from ten days down to five. meanwhile, passengers and those concerned about the virus, feel safe enough to travel. >> i think the most part people going to do the right thing. there is always going to be people that try to put cracks in her that's why we have vaccines and masks and all those measures in place. >> i feel safe. i'm taking all the precautions. i have not had any difficulty. i think new york is doing the best out of all of the cities. >> coverts impact on air travel is not just limited to the united states peered worldwide not come about thousand flights have been canceled for today and tomorrow. a physician who advises an airline industry trade group says that the omicron variant makes it two or three times more likely that passengers will be infected with a virus. >> griff: we want them to be safe out there. david lee miller in new york for us. david lee, thank you. julie. >> julie: we want people to be safe out there, but be careful when you go shopping in malls across america. what horror has been spreading them all. yesterday, north hollywood california for example, a 14-year-old was accidentally shot and killed by police who were responding to reports of gunfire inside a burlington coat factory. and then later that day, at least four people were hurt when shots broke out inside chicago area mall. what is going on? lawmakers are coming face-to-face with america's crime crisis, nearly two years after the he found the police movement, remember that. after tico democrats who pushed police reforms were carjacked at gunpoint, just hours apart, it gets better. including, pennsylvania congressman, mary scanlon had this to say about the five juveniles arrested and on crime. >> we do not know exactly what they are using all of these cars for. some of them are to commit other crimes. like i said, there is a lot of juveniles involved in the spirit just half. i know so many other jurisdictions, such a place that chicago seen the same trends. we are just trying to get in front of it. >> let's bring in hugo gurdon, hugo gurdon, editor in chief of the "washington examiner." this does have defined the police movement written all over it. so here, you try to strip the place of their power, will them this is what you get. you get unruly criminals and violent offenders, including juveniles shooting and killing people in our nations malls. >> yeah that's exactly right. julie this is one of those everyday sad stories in modern america of a crime wave delivered to you courtesy of democratic policy. i've written in the "washington examiner"'s restoring america website, that the democrats green light crime by not prosecuting and by demoralizing and defunding the police. they may try to gaslighted the nation by pretending that this has got something to do with the pandemic. it has nothing to do with the pandemic. one of these carjackings was in philadelphia on the mayor was lamenting that it could happen in broad daylight is still a crime wave only suitable at night. the truth is, the adelphi is one of those cities where there is surging violent crime. gun crime et cetera. that is a result of demoralizing and defunding the police. in san francisco, the mayor recently acknowledged that the city has been destroyed by rising crime. she is the one who cut police and sheriffs budget by $120 million. what is happening now is the democrats are really, the ugly sound you can hear is them screaming in terror of what is going to happen to them. in the 2022 election. as much as the democrats try and hide it, the fact is that this crime wave is direct result of their policy. >> absolutely. i want to take a look at your article in the "washington examiner." your headline reads democrats, you turn on policing too little, too late. i will read part of it. "that screeching noise that here is not the sound of democrats wailing over they are collapsing popular support, it is also the squeal of their tires as they race away from their anti-law and order policies, in hope of avoiding an electoral smash against reality." here is representative nicole on the successful pushback billed to dems police reforms. >> republicans were successful in pushing back against taking away qualified immunity from our police officer taking away police resources for police officers. semi democrats have pushed on the floor this year. i hope they will reconsider, being that they are now victims themselves. we need to do more to protect our cities across america, it starts with giving power to our police to be able to do their job. >> julie: she makes an excellent point that democrats are now becoming victims themselves. will they change their direction on police reform? >> they will try to do it. there are certainly people who are invulnerable seats, democrats being very worried about what's happening in 2022. we will try to cover up. i don't think they will be able to do it. there are few mayors perhaps will be able to do it around the country and sort of reverse the policy. these are absolutely core democratic radical policies. there is more than 90 members of congress and the progressive caucus. the democrats hold the house only by virtue of having that progressive caucus. they are very powerful and they exchange their votes for progressive policies. it's not the nancy pelosi disagrees with them, she knows that this is not were the american people believe policy should be going. so there's a really dangerous thing, frankly it's dangerous for the democrats but entirely preserved for democrats. republican polling numbers right now, are the best they've been for 40 years. it is because ordinary people, for example, he saw in the virginia governor race, glenn youngkin seem like a normal american and seem sensible. everybody realized that the left and the democrats were radically left-wing. it's a terrible position for democrats to be in. i don't think they can get out of this jam. >> julie: hugo gurdon, thank you very much. merry christmas to you. >> merry christmas. >> julie: griff. >> griff: julie, some tragic news out of baltimore. a police officer is shot in an ambush style attack last week. died yesterday mike rohn. workers will now have to dilate for seven days instead of ten after returning to work after testing negative. we are live in olanta with these new guidelines. hi, charles. >> hey griff. the cdc says that they're making this new move to prevent staffing shortages and health care facilities, as omicron continues to rise cross-country with these new guidelines mean is that health care workers who have covid-19 and are not showing signs of symptoms can return to work after seven days with proof of a negative test to prevent staffing shortages. the cdc says quarantine times can be that the updated guidance is meant to help ease the stress on the health care community as it prepares for an anticipated surgeon patients. now indiana's largest health care system is already seen that as it struggles to increase the omicron cases make shortages pretty situation is so dire that the u.s. navy is sending a team of 20 navy personnel to annapolis to assist front-line workers at indiana university health system's largest hospital. >> health care that's what you're seeing with us reaching out to the department of defense. >> the fda has given merck's pill, molnupiravir significant increase in demand at testing clinics in the dallas-fort worth area. folks are running into long lines and they are even being turned away as health care workers struggle to keep up. >> stomach putin blames the u.s. and europe for raising tensions and demanded a so-called security guarantee from nato. alex hogan is live in london with the latest. hi, alex. >> high dr. vladimir putin confirmed a test launch of a hypersonic missile that took place just last night. all this is part of a new generation of what he calls a farm system here this is a tensions rise in the region. all of the u.s. and its allies to make that promise. >> we, without any tricks, openly said that there can be no more nato further moving eastward. the ball is in her court. they have to give us an fiscal year 2020. florida's attorney general state of white house needs to step up. >> i can tell you, and 40, we are dedicating millions to deal with the effects of this disastrous immigration policy. we are trying to determine how we can control those that are coming into our state since the federal government has abdicated all responsibility for that. >> griff: florida congresswoman george may not purchase a member of the house and homeland security committee. congressman, first, merry christmas eve too. thank you for taking time. i think it's really fantastic that he took time. i've come to the border extensively. one part of the border that people will talk about is what is happening in your sunshine state. what is the situation? >> merry christmas to you. i have leave a special merry christmas to all of our front-line workers and first responders. as the wife of a first responder, it is important that we all take a minute to be grateful for their service on holidays like today. you are right. we've talked about this. even i have the capital, we see, all across america, that the biden administration pestering every single town and state in america into a border town or a border state. florida is no exception. here in florida, we are seeing firsthand account of the disasters and dangers of the effects of the open border policy. in just this year alone, we have been able to track down 74 overnight flights from the border to our state. then you see, now these boats that opponent on the beaches. unloading, bringing chaos in dangerous situations. of course, when i took my sheriffs down to the border, they recognize immediately the narcotics that were being confiscated at the border are the same narcotics, with the brands and stamps that they are finding in our community. it is unacceptable. i agree with ag moody here in florida. this is because the federal government has abdicated their role in border security. which we all know, if you do not have a secure border, you do not have a secure nation. >> griff: congresswoman tlaib frustration with us a administration appears to be bipartisan. your colleague, democrat congressman from texas, henry cuellar, is speaking to "the new york times." i want to read your quote and get your reaction. he said, about vice president harris, of course she has been tapped as a border parts. i say respectfully to her, i have moved on. she was tasked with that job, does not look like she's very interested in us. we are going to move on to other folks that work on this issue. your reaction? >> you know, henry and i have had this conversation. in fact, i have had this conversation with multiple democrat colleagues. they agree, however, because of the fear and retaliation from speaker pelosi, they won't speak out. which is extremely frustrating. i myself have questioned in secretary mallorca's who's in charge of homeland security and he has said, that vice president harris is not the borders are, in fact he is in charge of that matter. there is already chaos and confusion amongst those in the administration of who was responsibility it is. but as american people pop, we do not care whose responsibility it is, needs to be fixed. we need to secure the border. right now instead of having a commander in chief, we have a tractor and cheese. because these policies have allowed for the cycle of trafficking continue on check. griff, you and i have had this conversation. the human trafficking and is taking place the border, the human rights violations, the tragic story that we have seen firsthand, heard firsthand, they are heartbreaking. and now, we have a situation, as i said, every town in america it's a border town. this of mensuration need to put action their words. as title 42. a policy that actually secures our border. >> griff: i will tell you, cartels have never had a bed of her last week i went into him mexico interviewed a cartel smuggler. he said that they are trying to just help the migrants but they are making money doing it. congresswoman, thank you for taking time. thank you for pointing out that our first line of first responders and front-line workers and border patrol agents and law enforcement are working this holiday weekend. thank you, congresswoman. >> thank you so much. merry christmas. >> griff: merry christmas. >> julie: well nobody wants to get this package for christmas. a hawaiian woman got a surprise box from fedex. she thought was another gift to go under the tree, but instead, it was filled with thousands of covid testing samples. >> i opened it up, in the box was a fedex package of a tom melvin files of covid testing. with biohazard bags. i tried calling the fire department health department, no one wants custody of this box that has testing results and it for hundreds of people. >> julie: so here's the mixup. apparently it was shipped to the testing site. it was bound for chicago, the manager of the test site was stunned to learn that the samples travel an extra 4,000 miles. >> i'm so confused as to how that happened. i'm just mad that people are not getting the results, especially right now and the surgeons going up and labs are already delayed. >> julie: fedex says that the shipment was labeled mistakingly, obviously. they pick up the box earlier this week. >> griff: in a traffic stop that led her basket with bottles of liquor and threatened employees to try to take away. no one was hurt by the pickax willing woman. at this point, she has not been arrested. this homeless man, 21-year-old simon lopez, already had a warrant out for his arrest when he was taken into police custody on monday. he's accused of kidnapping, domestic violence, and engaging in intercourse with a minor. police say he was in a romantic relationship with a minor, younger than 15 years old. but, glendale police say that due to l.a. county's emergency $0 bail order, the d.a.'s office recommended bail be set at $0 for lopez. fox news reached out to the d.a.'s office for a response and a spokesperson denied that a prosecutor recommended zero bail for lopez. a judge ultimately set bail for the suspect at $100,000. this situation still led to more criticism of l.a. county's liberal d.a. george gascon and his criminal justice reforms which include preventing prosecutors from seeking enhancements and cash bail for many low-level offenses. earlier this month, some of his critics announced they are launching a second effort to try and get him recalled. >> there is no way to share this guys. gascon merry christmas. >> we, the jury, on the charge of manslaughter in the first degree, while committing a misdemeanor, on or about april 11, 2021, and hennepin county, state of minnesota, find the defendant guilty. >> julie: it is just a state of shock. a jury finding former minnesota cop kim potter guilty on two counts of perch he faces up to 25 years in prison for the shooting death of 20-year-old daunte wright during a tense traffic stop. she says that she mistook her gun for her taser. activists say that she had her former police colleagues violated rights and civil liberties. terminal and civil rights attorney for brian claypool joints now. this is a very rare case, one that we do not see often. a high-level source of mind with within the nypd told me this hour, regarding his further, that this is a dreadful decision for the future of policing. what will this mean for the future war on cops? >> hey julie, great to be back with you. merry christmas. i tend to disagree with that comment. i think this verdict is not a condemnation of all police officers nationwide. what it is, is a validation that we as citizens expect and deserve more from well-trained police officers. that's what this verdict means. i think we have that in place, a set of consequences, if a police officer like kim potter with 26 years, cannot distinguish between a gun and her right hand out of her holster that clicks, and waste twice as much as a taser. she can decipher the difference between the two? we have to have some degree of consequences. >> julie: absolutely. there should be accountability. you've been on the fourth or 26 years. i'm not saying there's any excuse for appeared obvious that, if you are on the force and carry a weapon, it is a responsibility to use that weapon safely and know the difference between a taser and a gun. my question though, is the charges that were brought against her. this is a very difficult decision for jurors to make. which is why took them four days of deliberation perching on faces not only up to 25 years behind bars, she was also found, and this is work is competent, found guilty on first and second-degree manslaughter. some people believe that that perhaps, those charges necessarily apply because she claims that it was an accident. therefore, may be the charges should have been lessened. it certainly does not give cops the free range obviously, to go and shoot and kill people. speak all right. let's talk about that. the language of the minnesota statute, for first degree manslaughter, says that potter would have had to use such force and violence that death is reasonably foreseeable. a jury said yes to that. why? because they did look at the totality of the circumstances. and how, like you said earlier with his traffic stop, it started with the traffic stop. officer potter said that i would not have pulled over the sky. she said that on cross exam hurt so did you pull over daunte wright for a infraction for his license plates? that it led to other incidents of, he is out of the car, he is handcuffed by a trainee. how does he get back in the car? proper procedure would have been the pole into the back of the car. he jumps back in a car, and then you have an issue of pointing a gun at him with a potential cross fire, because you have another police officer on the passenger side who should not have been reaching into that car. you are only supposed be over there to look for weapons or if somebody else is in the car. the jury felt that all of that, the totality of the circumstances led to a conclusion that her point a gun. here's another key, julie. here's the key i think for appeal. she pointed that gun and it was more than a split second. it was at least a couple seconds and that was enough for the jury to find that she used the force and violence. >> julie: lawyers for the family are also pushing for the harshest penalties per day using the conviction force for police reform through the defense will most likely see dissent, file an appeal. we know the appeal is coming. the question is, i guess what difference would make in in the end? >> that's a good question. if you look at the recent conviction of mohammed nor come around but i was a black officer recently convicted. same courthouse, for actually killing he was once interesting, julie. he was convicted in that case of third-degree murder. an appellate court and second demands on. this is important, the appellate court recently throughout that conviction. it's just what you get into. the appellate court said there, wait a minute, we don't think there's enough evidence that nor come in that case exhibit human indifference towards life. so that is important. i suspect lawyers for potter to file an appeal to toss out the first degree manslaughter charges on the same basis. that what evidence is there that she exhibited. human indifference toward daunte wright's life when she said and both sides agree that it was an accident. they do have a reasonable shot on that appeal. >> julie: right. the lawyer representing her has basically said, it is an accident, she admitted to it. certainly cannot deny it. there is a video. but nonetheless, we will have to wait and see how this turns out with the appeal. which should be expected in the new year. brian claypool, thank you very much. chris. >> griff: julie, after holiday season rebound all signs point to an economic slot on her and how long can we expect high prices to stick around in the new year? that's next. >> griff: troubling new signs that the economy could be heading for a downturn after the hide of the holiday shopping season wears off. a new poll shows that confidence the economy is at its lowest level since april of 2020, when we were all still getting used to the lockdown. she locks his certified public accountant present of the marks group. jean, merry christmas to you. i think this news though, may not sit well with our viewers. how bad are we expecting things to get in 2022, after the holiday high has passed? >> hey griff. merry christmas to you as well. like everything, it's really going to depend on the type of business that you're in. what part of the economy are in. if you're in the restaurant business, retail, travel, theater and arts. the next three or four months are going to be tough. some of our major cities in the country, like philadelphia where i'm from, they are already upping their mandates and they are requiring restaurants to only serve people that are vaccinated here in some cities like new york are only requiring people, employees have to be vaccinated as well. it's going to have a big impact on a lot of small businesses. those sectors, that will hurt the economy. however, the good news is that there are other sectors that are still going to weather the storm pretty good. construction for example. e-commerce. parts of the economy are going to be tough for the next three or four months. other parts are going to come through it okay. >> griff: jean, this index is really important. it basically shows how americans view the economy, from fair to good to poor. when you look at what we showed our viewers there, april 2020, negative 33. april 241 plus two. now we are back to negative 33. the president just this past week said that we are not going to act in march of 2020. in some areas, it will take the economy is starting to do so. >> yet. it really depends on what the buyers think. i'm going to counter that with other indexes that i look at. i cover small businesses, we have a lot of clients in small businesses in my practice. the national federation of independent businesses, u.s. chamber of commerce, just in the past two weeks came out the small business optimism indexes and what they were looking forward to in the coming months and in 2022. there optimism is not so bad, in fact it is strong. you are absolutely right. consumers are not in a bind mode, that will be a problem for the economy. remember, the economy is not just about retail and restaurants. it is also about a lot of other industries that are, particularly house in the construction trade some of those industries are still going strong. i'm expecting him to continue to be strong 2022. it will be a mixed bag. >> griff: speak in a mixed bag's, one thing that seems constant and not going away is this inflation. if you look at the rise of consumer prices of the last 5.7% health advisor surveys on the energy prizewinners, there is a 5.7%. i want to just zone in on that. how big of a problem and how long lasting of the problem is that going to be? >> it's a big problem. it's not the 5.7% which is the consumer price annexed for the number we should all be focusing on is the producer price index. that's what it's costing to make the stuff that was going to buy. it was at 9.6% this past month. we are telling our clients that producer prices are going to be going up significantly. john mackey the next six months. why, because if you drill down at the core components of what it costs to make things, construction materials, chemicals, lumber and plastics, transportation, iron and steel. griff, those prices have been going up on an annualized basis of anywhere from 30 to 100% in this past year, even compensation costs have gone up 10% in this past year. that's what it is costing american manufacturers and service providers to produce the products and services. that's our leading indicator. we think being a 9.6% now, looking forward to going up even higher over the next three to six months pair that is going to start filtering down to us. inflation is going to continue to be a significant issue for at least the first half of 2022. if not longer.
