>> that is shameful that progressives, jen psaki, anyone would be saying that the president should be taking unilateral action here. we are a representative democracy. that is not how we do things in the united states. maybe how you do things in my mother's homeland of cuba but not here in america. we have representatives for a reason. and all republicans in the house voted against the build back better disaster because we know it is about more government control, bureaucracies, taxes, mandates, doubling the i.r.s. and amnesty. things the american people don't want. our constituents sent us to washington to have that voice and now they want to overstep congress? that is completely wrong. what i will say is that i believe joe manchin did the right thing here. we need more representatives like him in the senate willing to stand up against their own party and do what is right for the people in this country to save our democracy, save this country from socialism which is exactly what three trying to implement on the other side. >> there are parts of this package that have been popular with regard even to senator manchin. do you think there are pieces in the new year that can be brought forward in chunks that could actually pass? >> look, it's quite possible. at the end of the day republicans don't control the agenda. we have to see what nancy pelosi and the democrats bring up and that if it's something republicans can agree to, that's possible. i don't think that there is much in this build back disaster that republicans do support. at the end of the day there are some real egregious pieces here. moving forward with entitlement programs and implementing more welfare without work requirements at a time we are lacking workers, production is suffering and issues in the supply chain as a result. that is only going to ex as per bait the problem if they implement many pieces of this agenda. we need to stand strong against it. it is not just this that republicans have been able to defeat this year. they tried to push packing the court. they wanted to push radical election law changes and use taxpayer money for campaigns and we stood strong against it and those were the top priorities and we defeated them. >> you bring up the supply chain. we're all feeling the effects of it. not according to the white house. take a look what white house chief of staff ron klain was tweeting this about the supply chain crisis. merry christmas to all and to this overhyped narrative a good night. when asked if it showed the white house was out of touch with americans former chief of staff karl rove had this to say. watch. >> how disconnected is the white house to the american people? >> well, i think awfully disconnected. remember, these are the people who said covid-19 would be in the rearview mirror by the fourth of july and called the inflation that we're experiencing transitory and dismissing it as not needing any attention or action. >> your response. >> it is completely out of touch. people are paying record amounts for gas, for food, we're seeing everything across the board going up. certainly shelves are less stocked than they were last year. even when it comes to medications and things that we need to fight the pandemic. they are talking about the lack of having to tests available. what about monoclonal antibodies and what about medications? it is all being impacted by the supply chain issues. industry leaders say it will get worse if the president's vaccine mandates go into effect. it will lose more workers and there will be less production and we'll see a bigger issue with the supply chain if that goes forward. >> congresswoman you're talking about something we're all feeling regardless of what politicians are saying. there are many members of the media who are so focused on senator joe manchin you think it was the only thing going on. listen right now to msnbc host joy reid as she lashes out at joe manchin. >> a multi-millionaire colbert onwould fit right in. a coal baron, who is rich with a yacht and maserati saying the -- >> basically senator manchin is the grinch incar nat but other things we're thinking about right now, isn't there? >> this is exactly why they are such hypocrites. they claim to be the party of inclusivity, the big tent. if somebody has a different opinion than they do then automatically they need to be alienated. it is wrong what they are doing. joe manchin has a right to represent his constituents like i have a right to represent my constituents. he knows best what the people of west virginia and not anyone else and why he was elected to do the job. we have a lot of problems right now. we do need to focus on those. let's focus on continuing to stop some of the bad policies as we have this year. i look forward to 2022. i think it will be a good year but more so i look forward to 2023 when we take back the house and can have a balance in washington and not just this left wing extremism that you see being peddleed by people. >> people worried about crime. they are saying the videos of break-ins and a new report how several major crime categories have spiked this year in los angeles, including violent crime. this as a dozen democratic-led cities have set homicide records earlier this month. and all this as the surge in violent crime hits close to home for two democratic lawmakers who supported police reforms in illinois a state senator and her husband were carjacked at gun point just outside of chicago. fortunately they were unharmed. then less than a day later pennsylvania congresswoman scanlon was also carjacked at gun point. this time in philadelphia. while she was unharmed the thieves did get away with many of her personal belongings. it was less than a month ago that philly's d.a. insisted there was no crime crisis. >> there is not a big spike in crime. that is not true. there is also not a big spike in violent crime. neither one of these things is true. basically we don't have a crisis of lawlessness. we don't have a ciels is of crime. we don't have a crisis of violence. >> this isn't something that lawmakers are just seeing happen on the news and hearing about reports in the office. ist is up front and center and very personal now. >> i'm sorry to hear about those crimes. what i will say is when i put a resolution on the floor to condemn attempts to dismantle the police these people voted against this. republicans were successful in pushing back against attempts to take away qualified immunity from police officers and take away resources from our police officers. something the democrats pushed on the floor this year. i hope they will reconsider it being that they are now victims themselves. we need to do more to protect our cities across america and it starts with giving power to our police to be able to do their job. stop taking away their tools and give them more resources. no new york we need to refund the police and restore the plain clothes unit. we need to take away -- put back that immunity protection. we're seeing less people wanting to join the police force. we're seeing record retirements. i hope the new mayor takes action to fix these issues so we can once again restore public safety in new york and the politicians in albany need to fix that disastrous bail law once and for all. >> you bring up a good point about the police and staffing shortages. i know here in the state of colorado where i'm located, the city of aurora has just approved $8,000 apiece retention bonuses for their police officers there just to get them to stay for the rest of the year. very good point there. congresswoman, thank you for joining us today. we appreciate it. >> thank you. >> the white house taking a supply chain victory lap ahead of the holiday weekend. >> christmas gifts are arriving on time this year, good news. we've saved christmas. >> even as jen psaki claims the supply chain crisis is over americans are facing another big surge in covid cases. some families have been forced to dramatically change their holiday plans and critics say maybe the white house should wait before celebrating. >> is that saving christmas? that's hardly comforting. >> alicia: we actually have that piece of the interview he did with abc news on the covid testing. take a listen. >> we're nearly two years into the pandemic, a year into the presidency. no test kits in some places three days before christmas when it is so important. is that good enough? >> president biden: no, nothing has been good enough. but look where we are. last christmas we were in the situation where we had significantly fewer people vaccinated. >> alicia: should they have known better? >> yes, you have to have testing. how could you forget about testing? you go back to december 2 the president saying you will be able to get it for free and go to your pharmacy. that's not happening. nor "the new york times" to report they haven't ordered the test. mr. president, if you think about it, what has joe biden done on covid? you really struggle to think about it and then he says well, we forgot to order testing, probably number one thing we need to do for people to understand to go out. whether vaccinated or not you can still spread covid. >> alicia: it's incredibly frustrating. i can tell you myself in order for me to come to work today i had to get tested. and i had to find a family friend who knew someone who had some tests. that was the only way i could get tested to come to work. there are small businesses out there having the same issue. desperate to try to get themselves tested so that they can get their employees in. i will move to washington, d.c. following the footsteps of new york city, chicago and boston, d.c. mayor is imposing a vaccine requirement for most indoor venues including bars, restaurants and gyms. listen. >> so beginning on january 15, 2022 certain establishments will be required to verify that their patrons 12 years old and older have received at least one dose of the covid-19 vaccine. >> alicia: this decision is already facing intense pushback from critics who say this will kill mom and pop stores and small businesses across the district. also in adding to all this i want to put up with the d.c. residents's vaccination rate is. it is really high. 84% of d.c. residents were partially vaccinated and 66% were fully vaccinated. those who received the vaccine, only 1 1/2% have gotten breakthrough cases. so why these guidelines when they are actually doing so well on the vaccination track? >> i think at pace if not ahead of the rest of the nation in terms of percentage if those are accurate. but it is still hypocritical. just on saturday night the mayor there was pictured at a gathering indoors without a mask. and for her to put this in place. it is so urgent that she needs to do it three weeks from now. it does not make sense. i think these mandates once they get into place they never, ever go away and to have to show your papers in the united states of america to walk in to get a hamburger, it is just devastating. i don't think it's sustainable and it will hurt minority communities more than some of the other communities. i think this is bad public policy. again chalk it up to the list of things democrats are trying to do that is more theater than it is actually solving the problem. >> alicia: you bring up a good point. it devall oous the good news they have about the vaccination rate. we're doing great on vaccinations, it is not enough. speaking of it's not enough, take a listen to what california governor newsom had to say about the standards of what is considered fully vaccinated. they are changing. >> but we recognize now that just being vaccinated fully vaccinated is not enough with the new variant and we think it's important to extend this requirement to getting that third dose. to getting boosted. >> alicia: basically he is saying it will continue to change. i need to shift gears to a story that's getting a lot of attention on social media. a liberal arts dean at the san diego university getting blowback. she said just so we're clear racism good, abortion bad. money good, women bad, capitalism good, sustainability bad, stupidity good, science bad. power good, equality bad. white people good, non-white people bad. stench indeed. she has also called the acquittal of kyle rittenhouse a win for white supremacy and pointed to the new members of the supreme court to sexual predators, a white lady and some white racists. the school is standing by her saying this is her first amendment right to say these things but i just think about what about the students in her class, not all of the students will fall in line with this professor's beliefs. >> this is a government-run institution paid for by taxpayers. this dean should be fired. to express those types of things. it shows how stupid she is and how uninformed she is. if she really believes those are the policy positions of republicans and conservatives they hasn't talked to one evidently in a long time or spent any time. she can call me if she wants to understand conservatives. but because she is totally 100% off base. she have is so stereo typical and prejudice in her approach and i think she is outright racist in what she is doing. other than that i think she is doing a great job. boy, if i was spending my money and sending my taxpayer dollars in and having my student or my son or daughter go there, i would be outraged. why go there? this is the kind of education they are going to get? that's just wrong. >> alicia: thank you so much. good to see you and have a merry christmas. >> merry christmas, thank you. >> alicia: jurors in minneapolis at this hour are continuing to deliberate manslaughter charges against former police officer kim potter. >> you should discuss the case with one another and deliberate with a view toward reaching agreement. if you can do so without violating your individual judgment. >> alicia: with no verdict after three days could the signs be pointing to a jury that is deadlocked? (crowd) business! >> alicia: deliberations are underway in the trial of former minnesota police officer kim potter. she is charged with manslaughter in the death of daunte wright during a traffic stop in april. potter saved she mistook her gun for a taser. prosecutors said she felt -- the jury on tuesday asked the judge what they should do if they can't agree on a verdict fueling speculation they may be deadlocked. jurors will recess until monday if they do not come up with a unanimous decision today. for more on this let's bring in fox news legal analyst mercedes coleman. what do you make of what is happening there? what do you think has them stuck? >> it is not good news for either the prosecution or the defense that there are these troubles during the deliberation. it is the struggle between the manslaughter one, the recklessness standard. the fact she exhibited such reckless disregard for human life by being so careless versus the second lesser included charge which is the manslaughter second which is culpable negligence. that's the struggle between the two. you can see how a jury can say of course it's negligence. he died as a result of her mistaking her gun for the taser. so that is the struggle between the two laws and then you couple that with her agonizing testimony. officer potter, anybody that saw that knew she was agonizing on that stand and it was authentic. tears flowing. the pain in her voice, the pain in her face. the jury struggles with someone who looks incredibly contrite and agonized and anguished over what happened on april 11. it is clear she had no intention whatsoever to take the life of daunte wright. the struggle with the whole issue regarding whether this is criminal negligence or not. >> alicia: what i'm wondering is how much exactly how much her testimony can play to them because it was so emotional. it was an emotional moment for anyone watching this. it was really difficult to watch. so when they are trying to make that distinct between the charges and figure out culpability here, how much are they allowed to have that play? i don't know if i'm even asking the question correctly. it was so overwhelming to see what she had to say and the way she had to say it. >> it's a great point and great question. it boils down to -- there are instructions to the jury that sympathy cannot play a part in their decision. so there is an actual admonishment to the jury because of course we're all human beings and we watch something like the testimony from officer potter and her heart breaks. they are instructed by the jury instructions not to allow sympathy to seep into their decision making which is why it goes back to if you take out the sympathy and the fact that officer potter's anguish at the result of what took place now you are struggling between the two standards. the easier way out to say we can't make a decision which means this whole trial against anew. i can't imagine the prosecution, given the fact a life is lost by the actions of officer potter, whether criminal or not, i can't imagine the prosecution will say we won't retry it. if there is a hung jury this trial will go again in the future. >> alicia: do you think just from your experience if there is a hung jury we'll hear about it today before the christmas holiday? >> i think there will be a real push for a final decision to be made but if i were a betting person i can't imagine they won't try to return after the holidays on monday and make a final decision then. i'm sure -- you heard the judge say to the jury really try to make a decision if you can. there might be another instruction wait until monday and see what happens. but if they rush to judgment now it will be a hung jury if it comes to the end of this day is my guess. >> alicia: we'll continue to wait and watch. the supreme court is set to hear arguments early next month of two of president biden vaccine mandate. the vaccine or test mandates affects healthcare workers in businesses with more than 100 employees. the white house responding with a statement saying at a critical moment for the nation's health the osha vaccination or testing rule insures that employers are protecting their employees and the cms healthcare vaccination requirement insures that providers are protecting their patients. we are confident in the legal authority for both policies and d.o.j. will vigorously defend both at the supreme court. what does it say to you that they even took this? >> pretty extraordinary because generally the u.s. supreme court does not get involved in these temporary restraining orders. this is what the issue right at this moment whether there can be a stall to the implementation of this vax mandate. interesting that they're doing it. looking at the case the two buckets, one bucket meaning healthcare. if they make any decision regarding healthcare most probably they will uphold the vax mandate for healthcare. we've seen it in the lower courts. a lot of the lower court decisions coming down on that path meaning that yes, if you are a healthcare provider you can mandate that your employees are vaccinated. i will set that aside. the real focus on the controversy and we've seen the sixth circuit talk about this is whether or not there can be a mandate to employers that have 100 or more employees. that's the real crux of the argument that will be before the u.s. supreme court ultimately. not just now during this temporary restraining order phase. looking at that and we can already see what the sixth circuit said. they said the underlying federal court said osha has the power to do this, why? because they are the agency that governs the safety of workers in the workplace. so the fact that this is an emergency standard, it is needed and critical it is something that the u.s. supreme court may-up hold and if they will pass. they'll pass it to the states to make an ultimate decision. >> alicia: so good to see you. thank you. parents in one virginia county are not backing down from critical race theory being taught in their schools. what they are doing to fight back. plus this. >> i think the atmosphere, the environment for a mid-term correction is going to be dramatic. >> alicia: with the possibility of a huge g.o.p. victory in the 2022 mid-terms the left is sounding the alarm amid president biden's plummeting approval ratings. the power panel on that next. mom, hurry, our show's gonna start soon. won't be too long. i'm leaving work now. ♪ people around ♪ ♪ christmas ♪ oh no. seriously? ♪ deck the halls ♪ ♪ but it's not like christmas at all ♪ mommy? that's mommy. whoa. ♪ and all the fun we had last year ♪ ♪ pretty lights on the tree ♪ ♪ i'm watching them shine ♪ watch the full story at xfinity.com/sing2 >> alicia: parents in one virginia county still fighting against critical race theory suing their school district over what they claim is a curriculum that is racist at its core. aishah hosni joins us live with the details. >> good morning. the lawsuit was filed this week and claims the anti-racist curriculum taught to their kids is racist at its core. the parents claim the county school board adopted a policy in 2019 to eliminate racism. instead the suit alleges it is indoctrinateing students with an ideology that fosters racial division and racial stereotyping and hostility. it claims teaching materials like this tell eighth graders racism only affects people of color and that if they don't make anti-racist choices they are simply supporting white supremacy and the suit alleges this particular graphic describes white talk as verbal and personal intellectual as task oriented and process oriented speech as color commentary. so the suit states it was filed by a diverse group of plaintiffs including a family that just immigrated from panama. another from turkey coming as parents are fighting to take back their schools. it was a key issue in the recent virginia governor's race. voters handed that win to glenn youngkin. we reached out to the district for a response. they say they have no information about this suit. alicia. >> alicia: president biden shedding support from a key demographic that helped him win the white house, indpen dense. polls show that over half of independents disapprove of his job performance. real clear poll particular average shows biden's disapproval rating has jumped 17 points since he first took office. mitch mcconnell said he knows what awaits president biden if those numbers continue to slide. >> i think there is a great likelihood the house will flip and likely the senate will as well. the good thing about that for the american people is that will insure that president biden for the last two years of his term is indeed the moderate he claimed to be when he ran for president. >> alicia: power panel is here. alex vogel former deputy council for the rnc and laura fink, ceo and founder of rebel communications and democrat campaign consultant. welcome to both of you. laura, i'll begin with you. the numbers i just mentioned. it's not a great year for a president to wrap up his first year in office. >> i'll say this. he is at 41 percent. ist is not a great way to end the year. it matches donald trump's average polling numbers but i would like to make an analogy since we are oef about to enter one of the biggest sports weeks of the year. americans are feeling right now like college athletes a month into training camp. we're sore, we're not seeing any gains and we're really, really angry at the coach. when that changes and we move forward and we start to see the gains in 2022, that could all change. yeah, he is at his low and we'll see biden working hard to get out of that. a lot ofist is a feeling. unemployment is low, paychecks are up and if we make it through and as we make it through the omicron virus the poll numbers will creep up in the new year is my bet. >> alicia: also there is mid-terms. >> exactly. look, i think a team angry at its coach is probably not a recipe for a winning season. you have gas prices high, you have inflation at record levels, you have crime and you obviously have a real resurgence of covid. it is not just that the president's numbers are bad or that there are external factors helping to drive that. this is a disaster for democrats looking at the mid-term. i think mitch mcconnell is right. i think the house majority is in grave danger and i think the senate is very much in play. it is about how people feel and when people think about crime and the economy and covid, they don't feel good and that's going to urge them to make a change. >> alicia: one of the questions that has been coming up time and again for this administration is whether or not president biden will run for reelection and he did say that there is one big factor that will decide if he runs for reelection in 2024. watch. >> do you plan to run for reelection? >> president biden: yes, but look. i'm a great respector of fate. it has intervened in my life many times. if i'm in the health i'm in now, if i'm in good health, then i would run again. >> if that means a rematch against donald trump? >> president biden: you're trying to tempt me now? sure, why would i not run against donald trump. that would increase the prospect of running. >> alicia: alex, that's the longest answer that i have heard from the president on this topic. >> yeah, it is interesting. obviously that debate and conversation has been getting louder. certainly it was raised the other day in a "new york times" piece about the president's age and his health. and those are real considerations. they were -- people were shocked when ronald reagan was asked in his late 60s if he was too old to run for reelection and somehow that is supposed to be off the table now. but i do think it's a challenge that the president has to deal with. the longer that conversation continues, it positions him as a lame duck even now. it is one i think they should address directly. >> alicia: laura, is this the president's way of just warming people up to the idea that he is probably not going to run?
