is the way society works, stuff you learn when you are 5 years old but look at the world we are in 2021, the images you see on your screen, all the result of these liberal policies we see in these liberal cities from bail reform to defund the police, you name it we have it now and as a result we have to say things like if you don't incarcerate criminals crime is going to go up as john kennedy said. this is the one we live in and it is insane. >> there's incentive to smash and grab robberies, you don't get put behind jail. san francisco is a disaster, open drug use, robberies you are seeing on your screen and as marianne laid out in herpes yesterday, the mayor there, she unveiled the plan to tackle the crime crisis and it includes increasing police funding, police presence, allowing police officers to watch surveillance video while the crime is occurring was a good idea, they were not allowed to do that before but when she made this speech it was not all hands on deck, the mayor was there, the head of the police department, a lot of city leaders. the one person that wasn't there was district attorney jessup bodine. you can at all the additional police officers you want but he's not on board with this, for him not to be there is a statement in and of itself you can arrest all these people but if they are just out on the street the next day the crime problem isn't going to be solved. todd: great point with regard to the da but what was the first thing you mentioned? increased police presence. if you didn't do what you did in the middle of 2020 to defund the police are responsible botched political movement that tried to get rid of police in cities across the country would likely not be seeing the images you are seeing on your screen right now. it was in overresponse to what they saw in the george floyd situation. it was a proportionate response and as a result cities across the country that had nothing to do with the george floyd situation are suffering. todd: peter doocy is asking what are the root causes of the crime crisis, she says she's not going to go there but it happened during the pandemic. also what happened to the pandemic defund the police movement but they can't say that because it will implement their own party and being responsible for the crime wave we see here. in the meantime speaking of jen psaki, she appeared to have no answer when asked about president biden's greatest foreign-policy achievement. >> what does the administration consider the biggest achievement in foreign-policy? >> this is a great question. i want to talk to the president about it. >> biden official denying claims the administration is not helping americans evacuate afghanistan. >> why are there still americans stranded in afghanistan? >> if americans in afghanistan wanted to leave we would help them get out and that is something we have delivered on. todd: the state department saying there are less than a dozen americans stranded in the television control country. todd: raising the debt ceiling by $2.5 trillion. the vote was along party lines. adam can figure the only republican to vote with democrats in favor of the limit increase. voting on the debt ceiling just hours before that september 15th deadline. the democrat-controlled house voting last night to hold former white house chief of staff mark meadows in, contempt of congress. it is to the justice department to pursue criminals charges. meadows is the second for trump official after steve bannon to be referred to the doj. the vote was 2-to-to-208 with liz cheney and adam can figure voting with democrats for the resolution. >> andrew cuomo lashing out as he is ordered to return more than $5 million in profits on his book on pandemic leadership. todd: i'm assuming he's not happy. >> new york state ethics panel says andrew cuomo must return $5.1 million hear from his book american crisis:leadership lessons from the covid 19 pandemic. cuomo's spokesperson says the move is political hypocrisy and duplicity at its worst but and 12-1 vote the state of expelled cuomo, quote, lacks the legal authority to engage in outside activity and receive compensation in regard to the book. the panel saying cuomo violated a pledge that he would write the book on his own time without using state resources or government staff was cuomo's order to return those profits within the next 30 days. attorney general latisse a james will decide how to distribute it. assembly when ron kim applauded the news yesterday say as cuomo chased down publishers he was suppressing life-and-death information from lawmakers. especially how the pandemic was impacting state nursing homes. >> this led to thousands of unnecessary deaths. he took our ability to legislate and took away families ability to make decisions for themselves to take their loved ones out of nursing homes and still needs to be held accountable. >> reporter: it is not over yet. cuomo's attorney is vowing to go to court over money calling the order unconstitutional and driven by political interests rather than facts and law. todd: it is so crazy to think of where we were a year ago where the governor was still the governor, getting in these, had the book deal, he was the love government which is disgusting to think about and look at what has happened since, unbelievable, and only did he lose his job but he's losing his nest egg if they get their way, the governor's people say they will fight it looks like he has to return $5 million from the book deal. todd: none of it would have happened if it were not for brave people like janice dean and the survivors who spoke out against what andrew cuomo did, the sexual harassment scandal which led to what we've learned about the nursing home scandal. cuomo, this is not going to bring back all those individuals who died in these nursing homes but to provide the level of solace the governor was not able to profit off of actions he took when he should have been protecting -- todd: if you look at when he covenant nursing home death it was around the time he was making the book deal so those two things are linked. 's attorneys say it's going to be hard to give this money back because he gave some of it to charity and he has $1 million in a fund for his daughter so they have to square that way but this is another huge loss for the governor. people who have been fighting against him and what he did for nursing homes are very happy this morning. todd: in response to the lawyer, it is a clawback, it happens in bankruptcy court all the time. it can happen to the governor. it is called a clawback. it can happen. 15 after the hour, despite his terrible poll numbers president biden is making a big midterm prediction. >> now we look at 2022. i want to tell my republican friends get ready, powell, you are in for a problem. carley: we have joe conjured and medal of honor recipients dakota meyer joining us live coming up. ♪♪ todd: kentucky investigators will probe the mayfield candle factory is workers say they would have lost their jobs if they had gone home early during the deadly storms. andy bashears is it is a miracle more lives weren't lost in the factory's collapsed. >> just eight ultimately lost. if you saw it in person you would believe it is a miracle. the level of absolute destruction in one place is hard to describe. todd: a forklift operator in the factory was inside the building as it came down. we are so glad to have you on this morning and see you safe and sound. can you tell us what your experience was like in the candle factory when the hurricane hit? >> it was more so like the movie twister. there wasn't a lot of a train sounds, just a lot of wind. when i was looking outside i saw the ice cream cone and started bagging up and as the thunderhead it wasn't -- it was like a big boom and the thunderhead and people started running towards me. laura: you fell to the ground and the concrete slab fell on top of you. how are you this morning? i think we may be losing mark. his story is unbelievable. he set a concrete slab fell on top of him. you heard his retelling of how he was outside the candle factory, witnessed the cone-shaped tornado coming, started running inside and people were screaming around him. he said he thought he was going good -- we are so glad to have him on and hopefully we can get this glitch fixed because we would love to do this. todd: to your point think of the bravery all these people endured in the face of seeing this funnel cloud come at them not knowing if they were going to survive, some didn't survive. >> his cousin was one of them who didn't survive but his wife was at home with their 6 children. she actually passed out during the tornado because she has a heart condition. i believe she's okay this morning but their home suffered significant damage. one of the many faces of the aftermath of this horrific tragedy and we are so glad he is okay but so many people did not fare as well. todd: the governor said look at the devastation, how did anybody survive? carley: democrats and the media has moved on from the christmas parade horror but the people of waukesha have not and some say they feel abandoned. todd: our next guest think the tragedy is being ignored because it doesn't fit the media narrative. >> o.j. simpson is a totally free man, granting early release ahead of schedule. following a prison sentence for a 2007 robbery. simpson was trying to get personal items stolen from him after they gave him his acquittal in the 1994 killing of nicole brown simpson and ronald goldman. the first time since he was free in over a decade. the panel that conducted jussie smollett opens up about a key piece of evidence was andres available media, after attackers put it around his neck. he can't understand why smollett put it on except to say as an african-american person i'm not putting the noose on at all. awaiting sentencing for those with the state a crime hoax. >> senator ron johnson is pressing the department of justice to update data on people charged with violent felonies. the water separator taxes the attacker was on bond after being charged in another violent attacks. this is not a singular issue. numerous reports from across the country, johnson says the doj has not updated trial released data since 2007. the mainstream media for a few days after the deadly waukesha christmas parade tragedy, and does man's of the chin know why the suspect was allowed on street. why do you think the mainstream media abandoned the story? >> what i'm doing is a person who should have been in jail never should have been out on the streets and murdered 6 people, and no one seems to care. when you put the tension back on what happened in waukesha, we need violent felons in prison and not on the street. todd: you are a state rep involved in politics, will this treasury force a change in the soft on crime policies in wisconsin and throughout the nation, do you feel this is not a turning point and will be more of the same as we go forward? >> won't be more of the same in wisconsin. we have a liberal governor that vetoed many bills we put forward trying to be harder on criminals to make sure citizens are safe. to sign some of this, people in wisconsin are tired of being afraid to go out at night, turning the background to the republican governor to put conservative values in front of her or him and make people feel safe again. todd: that fear is something you hear about not just in wisconsin but every one of our 50 states and a sad state that we are here in 2021. how morally repugnant is it that race play such a role in deciding what is important in our society and this day and age? >> don't think race is the issue. don't think anyone in waukesha or where i live is racist. i think the media is trying to make that out to be an issue. people were violent or not safe to be around, should be locked up. don't care if you are black, white, green or people bad people note -- need to go to jail and make sure communities are safe. todd: how is the community coping with christmas. >> everyone knows the high school bands that are there, we all grew up together. someone knows someone who was affected by this parade and over $4 million for the victims and we will be stronger. of waukesha has anything to do with it we will make sure milwaukee turns there criminal around. >> representatives allow things like this to happen through their policies and actions or lack thereof. what else needs to happen to prevent the next waukesha tragedy for happen whenever in wisconsin or somewhere else? >> a constitutional amendment to set bail. in the state of wisconsin, look what it takes financially to get back to court. the past criminal history and how dangerous you are, gives judges another tool in making a decision who should or shouldn't be out on bail. todd: seems like an obvious step so many cities and towns in our great country have gotten away from and it is sad because our streets are less safe because of it. we appreciate your time this morning. >> merry christmas. carley: what is president biden's biggest foreign-policy accomplishment? >> i think first off i'm surprised and happy to see someone finally and shut jen psaki down. it is telling. even as his press secretary i'm sure it is tough to find one of his accomplishments in this area. carley: president biden said he is a foreign policy expert. when you have trouble answering that question there is something wrong. i want to get to this. the air force remove 27 personnel for not being vaccinated. this is the military's first dismissal of those people who did not get the shot. jen psaki was asked about this yesterday. listen here. >> the first group of servicemembers who have been discharged for refusing to do that. >> i refer you to the part of the fence. my understanding is 99% of your force has been compliant. carley: your thoughts on this, they are losing their jobs for not getting vaccinated. >> it is absolutely incredible. the first thing i want to point out is religious exemptions, the military, i keep hearing in the military you have to do this, the military making religious exemptions for so many things that make no sense as far as dress where or so many exemptions they made for people who have religious beliefs or whatever it is, this should be another one if they have religious beliefs they should do it but i want to check out this. if our military is the healthiest of our population, they are screened before they are brought in, the least at risk and i don't understand why we are turning away men and women who raise their right hand to go out and defend the freedoms of the united states of america especially in a town like we have right now? i don't think this is smart for good move. it shows you the priorities of this administration are not to protect the country but to push their agenda. carley: each branch of the military has a different deadline to get vaccinated and all in, 40,000 members of the military could get kicked out for refusing to get vaccinated. 40,000 sounds like a massive number to me. if that happens what happens to the safety of the homeless? >> reporter: 40,000 is a large number that we are pushing away for something like this. i think it again i go back to again the agenda of this administration is to push their policy at whatever cost it is even if it is at the cost of putting america at risk across the globe. carley: defense secretary lloyd austin expect 100% vaccine compliance call the covid vaccine mission-critical and said people, military members have been required to get vaccinated since the beginning of the military. even going back to george washington. does he have a point there? >> i think going forward he has a point absolutely. i don't know how this is pushing as far as putting our military at a better standard. i got so many vaccinations like anthrax and things like that, that might have been a risk but here's what i will say. the vaccinations i was getting was only before i deployed, i wasn't getting vaccinations, wasn't getting those vaccinations that were added on, wasn't going to be deployable or needing to deploy to other countries where those threats were so i don't understand, i get it on one side of it that coming, going forward, for men and women to have the vaccine they have to know that before they were in the military but i don't think this is something they could not at least give a religious exemption for. we have exemptions all across the military. carley: the top story of the week, deadly tornadoes that rocked kentucky, you're from that state, do you have any reflections on the tragedy that occurred on friday? did anybody prevent you from leaving? >> know, nobody prevented me from leaving because our supervisor was out for the whole week so there was nobody. carley: did you hear anybody else in the candle factory say anything like you can't leave, you have to stay here? >> no, ma'am. i worked in the warehouse. production is about 100 plus people. we don't interact unless they bring product to the floor. neil: light of what your colleagues said about these reports of them -- can you think why the company would have said that? >> yeah, because production, getting the product -- sometimes the product, the emergency. todd: you think it could be related to the fact that we are so close to christmas and there is a rush to get things out? >> we are close to christmas, people need money together christmas products and the only way to get that money is important. carley: the candle factory spokesman is denying this happened is more to come on that front as the investigation unfolds. we want to talk about your wife and your children. apparently she collapsed during the storm as she was protecting your children. how is she and how is your home? how much damage did suffer? >> we have a home. we lost the roof and most of the bedroom. the only place that wasn't damaged was the bathroom and the closet. we got to rebuild all the way. my wife is traumatized because at the same time i was called and the wall was on top of be my wife had passed out. she has a pacemaker on her heart. they thought she died because she has a heart condition. it was traumatizing. todd: we are praying for you and your entire family. if you want to help mark and that family they have go fund me set up. mark saxon is his name. if you can help please try to do so. carley: do you know the name of the go fund me? >> it is infuriating as we are in chicago in a hearing on specifically gun violence and gun traffic in chicago and i'm trying to talk about underlying factors specific to gun violence and to become off like that, this is not time, place and manner to talk about these underlying problems in chicago, when is the right time, place or manner? to become off in this way other witnesses including chairman durbin himself, implicated similarly other public officials, other individuals who are not present, they were not cut off or told that was inappropriate, that is how these hearings work, we talk about people regardless of whether they are there and to become off again is appalling, infuriating as it cuts at the heart of what this was about in the first place if we can't talk about the underlying factors. todd: why do you think he wouldn't let you speak freely? >> you look through the weight of the evidence going into this hearing it has become public knowledge that certain senators who wanted to attend the hearing held in chicago, they wanted to attend virtually, they were told you can't participate in this, you have me, the loan minority witness trying to push back against these common there it is being told we are not going to let you speak to these narratives or these underlying issues, to me it is hard to look at that and not say, to see this reality where the people running this hearing are not actually interested in saving the lives of people in chicago. they are interested in using chicagoans as political ponds and it is sad. todd: nothing will prove the democrats don't stop and acknowledge the real cause of violence. appreciate your time this morning, thank you very much. carley: in the next hour of "fox and friends first," sean duffy, doctor marty macarrie and sean duffy. do you struggle to fall asleep and stay asleep?
