the u.s. attorney and talking feds podcast host, center for life in the present attorney, welcome back, gentlemen. >> thank you, shannon, glad to be with you. >> shannon: okay come i want to play a sound bite. this is a waitress on fox & friends. >> i was told by a shift manager right after the filming and the table was done and exiting the restaurant that anything over 20% would be taken by the restaurant to be divvied out. >> shannon: now, the people who arrange the dinner wanted specifically the tip to go to her part of $100 dinner challenge where you invite a bunch of people and they agree to pay what their bill is an $100 each for the servers. so they want this to go specifically to the people that waited on them. david, this is not x with the story, they did not fire her for not giving up the tip. >> shannon, obviously the optics on this are terrible. these patrons wanted to be generous towards the ladies but from a legal standpoint, arkansas is a state that allows employment at will. so when left she can assert there was some illegal motivation and that they were discriminating against her because of may be race, religion, disability, gender or any other protected category, she would have a hard time asserting a case. i do think them taking the money when it wasn't an established arrangement ahead of time would be totally inappropriate, but the restaurant is saying that she got all the funds but they chose to terminate her. >> shannon: okay, harry, the guys who set this whole thing up, the guy who arrange for the group said he actually called ahead of time because he wanted to make sure. this is how it works $100 dinner challenge. ahead of time he said the money would go directly to the server. apparently, they were someone contesting that and said that we never made that deal. does it matter? >> no, david is right down the line. by the way, a group of 44 and apparently they busted their chops serving them. but you know, there is too much law and too many lawyers most people agree. this is one that was settled without a because that same guardian angel, she was fired and probably nothing to do about it but set up a gofundme that is up to $9,000 and may be growing. so maybe everybody comes out okay and a lot doesn't have to be trying to push anybody around here. >> shannon: "the washington post" i think today reporting on this and said friday, the restaurant the owners threatened to sue the waitress and a letter in which permanently damaged the restaurant's reputation. the people have never been to the restaurant leaving countless one star reviews and outpouring of negative reviews, which undoubtedly will impact the restaurant's business. and wrote in the letter and now casted a restaurant that treats its employees poorly. a word from you on that, david. >> they put themselves in that position. the lady has free speech. she is sharing widely and loudly how she was treated in her opinion. there is not a lot they can do. they have to live with the consequences of their actions. >> shannon: harry, do you think it goes away? >> it goes away, loopholes and stuff of that you should not be knowing it will go away. >> shannon: merry christmas and thank you both very much. >> good to see you. >> merry christmas shannon and harry. >> shannon: the frigid waters of the maryland lake caught on tape. the corporal sanchez sr. deputy tatum and corporate frederick being called heroes after pulling a woman from a frigid creek after her car rolled in and originally showed up the car was partially submerged and wound up fully under water. the woman jumped out of the car into the freezing waters and the sheriff's department quickly weighed in and got her to those great and brave efforts and they are tonight's midnight heroes. >> impressive. just saying i love you and just not enough. and certainly not enough when it came to lisa james' oldest child trying to go back to college. he couldn't leave without letting his little brother know how much he adores him and how much he would miss him. this cute little baby. totally focused on his next but the moment he were those three words: nothing else matters. bye-bye and i love you. they went back and forth, they would say bye-bye i love you and the baby would say i love you. very adorable. and that is what we should all hope for in our lives, somebody to say "i love you and i miss you too." >> shannon: you have brothers? >> i do. >> we just punch each other. they when i have brothers so i know what you mean. thank you very much. that is it for us from washington, busy news night and we will see you tomorrow. i am shannon bream. frequent heartburn?
