Called. In huge groups with cars waiting outside. Then they just fill the Shopping Bags with everything that they can get their hands on. Hundreds of thousands of dollars of merchandise in some of thinks cases. This was in chicago. In illinois. Oak park, i believe. Then open shootings like this on the sidewalks of new york city. Crime is up and crime is up in cities all across the country. This latest grim count, this is the data that has come in from these cities a dozen cities have now hit their alltime annual homicide record according to an abc analysis of the data. Several of them broke records that they set last year. Rochester new york is on that list. They have a crime wave. Captain frank reno has called this worse than a war zone. He joins me now. Thanks for being here today. What goes through your mind when you hear people say that, you know, like a. O. C. , alexandria ocasiocortez from new york, she said the numbers are exaggerated of the smash and grabs. Its not the way it seems. Others that just blame the white house has done this. They say this is because of covid. Its because of the pandemic. Martha, its disheartening when you see leaders talking like that. To say this is not happening, theyre living in an alternate universe. Weve had a Record Number of homicides in rochester, new york. Over 400 people shot. Anybody saying this is not happening, theyre in denial. They dont want to face the facts. Martha what is the heart of it in your opinion . Youve been on the force 29 years. What is happening . You know, its chaos right now. To put your finger on one thing and say this is the problem, you cant do that. A lot of Different Reasons why this is happening. You have children having children. You have poor family structures, poor school systems, lack of programs to help kids that get in trouble with the law at an early age. Inefficient judicial system. Failure to provide individuals that are incarcerated with the tools that they need to succeed once they get out. You have terrible probation and parole policies that fail to help with reintegration. Lack of financial support, the crime labs, District Attorneys Offices and police departments. Theres zero empathy for victims of crime today, especially here in new york state. This is shown by the lack of legislation to help protect the victims and the witnesses. This includes Catch And Release policies. Probably one of the biggest reasons is a lack of proactive policing right now, which is a direct result of a lack of support from politicians as well as irresponsible reporting by some media outlets. Martha thats interesting. This is Mitch Mcconnell today. Weve heard a lot of different messages from leadership at the national level. Heres what he said. Smash and grabs, flash mob thefts and carjacking are increasingly Facts Of Life in multiple major cities. Against this backdrop, democrats want to get weaker on crime and softer on public safety. Martha before i get your reaction, i want to go to chicago and philadelphia. This is the mayor of philadelphia and then the mayor of chicago and whats going on here. Watch this. We dont have a crisis of lawlessness. We dont have a crisis of crime. We dont have a crisis of violence. Some of the retailers downtown in michigan avenue, ill tell you, im disappointed that theyre not doing more to take safety and make it a priority. For example, we still have retailers that wont institute plans like having Security Officers in their stores. Making sure that theyve got cameras that are operational. Martha that man in the middle that said there was not a Crime Problem in philadelphia, that was the d. A. What goes through your mind when you hear that, sir . Theyre out of touch with reality. What the problem is they dont want to face the fact that some of the decisions that theyve made and to policies that they helped institute have created the problems that were having today across the country. Martha what do you sense about the public in rochester and where they stand on what they see happening . You know, we have an Outstanding Community here. We have great people that live in rochester and great people that live in the city. Every time im on a homicide scene, i have people say hey, we support your guys. We need the police. We need you to be allowed to do your job. The calls, the letters, the emails from our community is outstanding. I know we have the community support. I know the Community Wants us to do our jobs. The biggest message i get is what can we do to help you guys. Unfortunately our leaders dont always hear that message that we hear. Captain, thank you very much. Captain frank umbrino. We thank you for being out there and all the members of the Rochester Police department that work hard to tub the numbers around. Its a tough job in a tough time and that you all need the support of the people around you. We thank you nor speaking out today. Thanks very much, captain. Thanks, martha. Martha thanks to captain umbrino. So we have a fantastic lineup this afternoon including bill hemmer, Kayleigh Mcenany and then betsy devos, the former secretary of education on a huge story at the Supreme Court today when the story continues. Martha Scott Peterson back in the news today. He will not be put to death for the killing of his wife, lacy, and their unborn baby. He has spent 17 years on death row. Californias Supreme Court overturned that sentence in court today. Saying the jury wasnt properly screened. Today a judge gave him life without parole. Lacy peterson was eight months pregnant when she vanished on Christmas Eve of 2002. Her body was found four months later along with the body of her unborn son, that would have been named connor. Her mother spoke at todays Sentencing Hearing Say i still feel the grief every day. Closing arguments close to wrapping up in Jussie Smolletts trial. He took the stand. He denied that he statemented a hate crime against himself. Now were seeing new photos of smollett with one of the brothers who claims that he paid them off to fake the attack. This photo comes from tmz. The report is the pictures were taken months before the incident. Matt finn reporting live from the chicago courthouse today. Hi, mass. Hi, martha. The prosecution is in their final rebuttal to the jury right now. We expect this case to go to the jury at any moment. In closing arguments, dan webb went first, the special prosecutor. He said he had six points that destroyed Jussie Smolletts ability. Number 1, that smollett withheld Critical Evidence from the police like his phone data because the prosecution said that smollett never wanted the case solved. There was overwhelming evidence that smollett misled police that the attackers were african american. He said they were white and then later said they were light skinned. Smollett faked evidence in part tampering with the noose, a symbol of hate. Smollett claims he took it off and put it back on so police would see it on him. Smollett testified that he doesnt know who attacked him and happened to be at the exact enter set of the osundairo brothers to get eggs. The prosecution said that they corroborated the osundairo brothers a they didnt punch hitch. Jussie smollett never signed a criminal complaint against the brothers. Smolletts defense told the jury that Jussie Smollett had an anti motive here. He had a historical gay marriage on tv and a pending music video shoot. He didnt want his faces damaged and paid the osundairo brothers 3,500 for training. The defense reminded the jury that a Security Guard backed up smolletts testimony that he said he say a white person run in a flash. Jussie smollett is charged with six counts of lying to the police. The judge has kept the jury until 8 00. So its possible that they will be charged late in the evening hours. Well keep you updated. Martha thanks, Matt Finn Covering that story in chicago. Lets bring in mike eiglarsh. Good to see you. Listening to matts report and taking a look at the closing arguments, what is compelling to you. What stands out in the seat of this jury . Youve got two completely different versions of events. Either they can go with option number 1, which story is extremely bizarre or option number 2, which is really bizarre. Both stories are incredible. Either that he faked his own beating or his version where he explains everything away and it just seems so bizarre. I think that what will help the prosecution is the corroboration of what theyre alleging and how they discredited the defendant. Martha when you look at this and you think about this jury, right . You just wonder where their sympathies will lie. They had a chance to hear this from Jussie Smollett himself. Do you anticipate that theres likely to be somebody on the jury that believes jussie that thinks that hes telling the truth . Anything is possible. The guy is an actor. He wants the big award here. Okay . Hes the best that you can get in terms of a defendant. He does it for a living. I will corroborate your version if youre suggesting that maybe one juror might go for him. Anthony moore, a Security Guard that has no bias at all. He said that he thought the attackers were white. He gave that report to Law Enforcement and said he felt pressured to change his testimony. But in court, he said no, no. White. That seems to be inconsistent with the prosecutions theory. Martha yeah. Jussie smollett worked hard to raise credibility questions about the two brothers and whether or not theyre believable. Well see if this is a quick turn around or not. Mark, thanks very much. Good to see you. My pleasure. Martha all right. So President Biden hits the road nor an Infrastructure Bill victory lap. Martha not good news in the latest poll numbers for President Biden. Hes visits kansas city. An interesting shot of the ceiling there. Theres the podium as we wait for the president in kansas city, missouri. Hes pushing for his big spending bills. The infrastructure one he got already. The other one is bigger and thats the one he really wants. A new Wall Street Journal survey shows his Approval Rating among independents, the folks that count, is 30 . 66 of those independent voters that were the major reason that he got elected in the first place are going to other way. They disapprove of the job this president is doing. Bill hemmer is watching this closely. Good to see you. Good afternoon. Turn that beat around when it comes independent, if they can. Yeah, thats the goal. Have to figure out what is upsetting them, what is driving those numbers, what are they unhappy about and one of the things that is interesting, he continues to push this build back better program. Poll after poll, one in four people think the program will help them economically. 1 in 4 does not get you reelected. Lets look at this from joe manchin, the man that is the big decider in this decision. Watch this. We got three major changes in this build back better bill that we should all be very careful what we do. Theres a major change in our tax structure, major change. Theres a major change basic in the social services that we provide. And theres a major change in our whole approach to climate, the energy sector. That is major. We get any one of those wrong, were in trouble. I think he nailed it. Its a transformational bill. One of the read About Manchin is the programs that are build in the bbb we need a build back better tomorrow. Martha i knew you would say that. Theyre rebuilding our torched christmas tree. I promise it will be better. For the viewer at home, when i look over your left shoulder, i see the empty space that was beautiful. We will build back better starting tomorrow. The thing About Manchin, some of these programs last for three years. He says you have to make it work for ten years. Well, three and ten, theres a huge divide there. I dont think hes anywhere close to being a yes vote on build back better right now. Reminds me of the anecdote on the hill a few weeks ago. Senator romney was in the elevator and senator manchin got in. Senator romney said president manchin. [laughter] which he is right now. Martha absolutely. He is making a lot hes holding the line in a way that a lot of the independents are supportive of and hes reading the tea leaves better than the white house is. Im thinking a couple things about this visiting kansas city that youre waiting on. Joe biden needs to sell, sell, sell. I think ten years ago, 20 years ago for sure, he would be that guy to be the salesman in chief. When youre doing an event maybe once a week, i dont know what the impact is. I was on the phone with peter doocy. He said theres about 100 people in the room and maybe local tva that. What are you getting for that . In a survey it showed infrastructure was one of the best scores for this administration. 48 to 43 favored it. Thats the reason why you go to kansas city. The money is another thing. 1. 2 trillion was involved in that bill. But you had 660 billion that was going to be spent on the highway trust fund. Its renewed every five years going back to the 50s. The other 550 billion is not going to be spend for another nine years after the midterms. Well have close to five elections between now and then. You wonder what the impact is. One other observation. I dont know if this is a trend, martha or something that im seeing. You wonder about the impact and the effect of the election outcome in virginia and new jersey. Its hard to see, i think, except about two weeks ago when the remain in mexico policy was reversed by a court order. The mexican governor had to agree to it, to, in order to make it happen. And then the withdrawal from yesterday. She should have never been nominated to begin with. She was withdrawn. You had jen psaki yesterday flat out Dismissing Aoc on the issue of crime. Doesnt happen very afternoon. Yesterday it did. The Democratic Senators that are sour on the Vaccine Mandate. Just a few things here. They might be significant or might be subtle. Some things to watch. Martha they brought in reporters to try to get them to tweak their stories and focus on the things that they want focused on. So theyre trying to turn this ship a little bit. You can feel it. They have time. They do have time on their side. So well see if it works. Bill, thanks. Good to see you. Merry christmas. Well be better tomorrow. Martha the tree that was over my shoulder that was burned it was horrific. It was lick a horror movie. Torched it. Martha were putting it back up. Maybe by tomorrow. Thanks. We appreciate you rebuilding the tree. Its going to be a long dale. Thanks. Bill hemmer. Right now, the head of social media Giant Instagram this is fascinating. Hes answering questions On Capitol Hill right now about his social media behemoth on how it left an impact on a generation of kids. What is it doing to them . Kayleigh mcenany next. So right now youve got the head of instagram for the first time facing the music, so we see, On Capitol Hill after damning reports on the sites impact on children, particularly teenage girls. A whistleblower said they had their own research that showed these dangers that they sat on. In moments, Kayleigh Mcenany will weighin. First, Hillary Vaughn who was recovering this hahn capitol hill for us. Hi, hillary. Hi, martha. Lawmakers today, republicans and democrats On Capitol Hill say have heard over and over from parents that they think instagram is toxic for their kids. Lawmakers grilling the head of Instagram Today said not only do they think instagram is not doing enough to protect kids on their platform, but that the algorithm instagram uses entraps kids in this poisonous content. Earlier this week, instagram announced new tools for teens to take breaks, limits on contents and tags that limit teams. The top republican, Marsha Blackburn, says he doesnt think the changes are enough to give parents peace of mind. Is that enough to really feel or for parents to feel like kids should be safe on instagram . It isnt enough. Theres a lot of things that i think it sounded great to say, okay, in principal we can do this. But a timetable and how they do it and when they do it, they didnt check those boxes. The head of Instagram Today, adam mosseri told lawmakers that child safety is not about one company. He pointed out rival apps like tik tok and youtube are used by kids more than instagram and also deferred to an outside group to call the shots on child safety. He told lawmakers someone else should decide how to verify age, how to design age appropriate experiences online and how to build in those parental controls. He admitted that that policy will take time and the top democratic on the committee, Richard Blumenthal said theres not time. We all know that facebook saw a significant threat to its growth or add revenue, they wouldnt wait two months. Why does it take months for facebook to act when our kids face danger, when time is not on our side . Martha, there was an interesting moment. Senator blackburn had her staff create a fake Instagram Account of a 15yearold child. Instagram says that they make sure those accounts default to private. When they tried it out, that 15yearold account went immediately to public. So theres some questions that instagrams protocols are not practicing what theyre preaching. Martha . Martha thats a shocker. Thanks very much. Hillary vaughn. Joining me now Kayleigh Mcenany former White House Press secretary, cohost of number and author of such a time as this, my journey through the white house and beyond. Congratulations. Glad to have you here. Thank you. Martha what do you think . I think its rare to see bipartisanship On Capitol Hill. You have Marsha Blackburn who has come out, we heard about the fake account and the problems it incurred and blumenthal, senator blumenthal of connecticut who has been vocal. Hes been on the forefront of this, of a 13yearold girl. He said within one day, 24 hours, this young girl was to being fed material that would fuel an Eating Disorder leading him to say this. Instagrams recommendations will latch on to insecurities and drag young women into dark places. Two senators, separate parties, calling out this industry. Big problems for instagram. Martha i really think as a parent that this is such a wild west and i think it is absolutely equivalent to alcohol or to smoking. I dont think that kids under the age of 18 should have these accounts. Thats what happened with cigarettes. Shea slapped an age on them. Made it harder to get them. Instagram says theyre trying to do that, put up barriers for kids. But you know, honestly, i have to say, the thing that parents are the ones that need to step in, right . Yeah. Martha you can get your kids a phone that doesnt have the ability to have any of these apps. But they can call you if they need you, right . I mean, i think the older you the more the longer kids can go without it in their life, the healthier they are going to be. Totally. My daughter is two. Ill do my best to keep her away from these accounts. To the point of instagram and facebook and their culpability here, they had internal data. They had a slide in 2019 showing this contributed to depression, showing that in british students that had a desire to committed suicide, 13 blame instagram. 6 of americans Young Children blame instagram. They had this data. Mark zuckerberg gets out there in 2021 and says its healthy for the public discourse. Martha we know its not. Any parent knows its not healthy. Its a Destructive Force in kids lives and a huge distraction to them. I think about mothers against drunk driving. It has to come from the public and from schools and communities and churches who say just say no. Just say no to social media. Lets all band together with our kids as families and say were not going to let them do this until 16, whoever age you can push it off to. The problem is that susie gets a cell phone when shes 9. Tommy gets one when hes 7. Then everybody all the other kids want 1, too. Thats it. Its over. Staring at their phone until theyre 19. Well said. Good luck. Martha theres still time. Thanks, kayleigh. Congratulations on the back. Thank you. Martha if you have School Choice, should your state allow you to pick a Religious School . Big day at the Supreme Court on this issue. Betsy devos joins me after this. As a professional bullrider im used to taking chances. But when it comes to my insurance i dont. If youre feeling anxious about the future, youre not alone. Calhope offers free covid19 emotional support. Call 8333174673, or live chat at calhope. Org today. No, i dont think its mandatory. Martha that was december of 2020. We all know where we are now. A year from that. President biden, his Vaccine Mandate for private businesses with more than 100 employees faces a bipartisan road block. Its had problems at the courts. Now you have two Senate Democrats that say that they indicate that they will side with republicans in opposition to President Bidens mandates on vaccines for those companies. Chad pergram joins us with the very latest on this from capitol hill. Hi, chad. Good afternoon. The two democrats in question are joe manchin and john tester. Both opposed an effort last week to repeal the mandates. That could have triggered a government shut down. But not on todays vote. The gop says the Vaccine Mandate cost workers their jobs. The United States of america is a free country. The federal government, elites in washington, cannot micro manage citizens personal choices. Democrats accuse gop members of bowing to their base. Some of the antivaxers here in this chamber reminds me of what happened 400 years ago when people were clinging to the fact that the sun revolved around the earth. But for the gop, its about getting the government out of peoples lives. C. S. Louis said the biggest deal of authoritarianism is when the government tells you to do something even if its for your own good. The gop Cannot Force A Vote in the house as easily. Even if the package did go to President Biden, it would likely meet his veto pen. Martha . Martha thanks, chad. Two jabs was once the ticket for freedom. Now Pharmaceutical Company pfizer says its the third dose of the vaccine that is the charm against omicron in this case. Possibly more. President bidens Chief Medical Adviser dr. Fauci who touted the twoshot regimen says this. I dont know if a third shot is it. Whether it officially gets changed, that will be considered daily. That is always on the table. Its going to be a matter of when, not if. Martha so you remember when dr. Fauci touted the two shots and youd be fully vaxed. The goal posts keep moving. Heres dr. Amos from johns hopkins. His focus is emerging infectious diseases. Good to have you with us. I want to play this. Id like to start with this from the pfizer ceo. Heres what he said today. Watch this. When we see real world data, we will determine if the omicron is well covered by the third dose and for how long. The second point, i think we will ned a fourth dose. So hes talking about a fourth dose, doctor. What do you think about this . We have to get clear on what the goals are with covid19. For me the goal has been prevention of serious illness, hospitalization and death. From the pfizer data, they announced that two doses, the original regimen is what is matters. Nod this idea to boost mild illness. The omicron variant is something to deal with and i think the vaccines are holding up where it matters. Martha at some point does the Herd Immunity that we talked about throughout the course of all of this, when you have so much of the country vaccinated and you also have so many people that have had covid and different variants of covid. At some point will that be protective . I do think it will be protective against severe disease. Theres four other coronaviruses that cause a quarter of our colds. In those cases reinfections are common. We need more people to get immune to get vaccinated. It will always mutate and cause mild illness. Its the best situation for us. The virus cant be put back. Its with us. The goal is to live with it, with a tamer version. Thats what vaccines do. Were moving forward in a world where covid is always going to be some risk but a lower risk than the past. We live with the fear of all kinds of mild things that you might con front throughout the course of the year. I love that line about cut put it back in to the bat. That opens up another side of this crazy story. But i guess this question to get to a point that everybody has a runny nose needs to be tested for the omicron variant. What do you recommend . Right now because of the Public Health emergency, i do recommend symptomatic people get tested. Eventually were going to be much more focused on severe disease and testing might be something is something that we do normally, because we need a prescription for a covid antiviral or flu antiviral and that will be good. Were going to get to a point that we dont isolate people for ten days with a positive test. That we may shorten that on when theyre contagious that well learn how to risk calculate. Well manage this the way we manage other viruses. The problem is we have hospitals that are inundated with patients that are worried about capacity. Until that creases, this will be different. Well get there. Martha good advice, doctor. Always good to hear from you, sir. Martha look at this. A car ended up yards from the brink of Niagara Falls. Now were learning from the police that the driver of that car has died. They say she was a woman in her 60s. Theres no word on how she got stuck out there in that rushing water. This was a massive rescue effort and an incredible Helicopter Rescue attempt of this woman. The a. P. Reports that there was light snow in the area and the roads were slippery. Well continue to find out what we can about this awful case and the sad news that we learned. On the righthand side of the screen is the top of Niagara Falls in new york. So should parents have a choice to send their child with public funds to a Religious School . This is the question that is before the Supreme Court and it is a big one. Betsy devos on that and also on the dramatic loss in learning that we now have determined and understand more from covid and from kids being at home. She joins me next. Veteran homeowners. While some banks and lenders are raising their rates newday is holding the line with their two and a quarter refi. Thats 2. 25 , with an apr of 2. 48. This is their lowest rate in history. The newday two and a quarter refi can cut thousands of dollars off your mortgage payments. Theres no money out of pocket and no up front costs. Martha breaking moments ago, for ant ten minutes now, the jury has the Jussie Smollett trial. They have instructions and theyre deliberating. Well keep you posted. Meanwhile, when a state offers School Choice, can they be permitted to block parents from choosing a Religious School . That is what maine did. This is a huge test for School Choice that is before the Supreme Court right now. It will be closely watched by the big Teachers Unions that want to protect the private school option. More than charters or other options and Religious Schools watching closely as well. Betsy devos is here in moments. But first, Gillian Turner with the back story. Gillian . Hi, martha. This case comes before the court today as millions of parents across the nation are asserting their authority. They claim they want more say over where they kids go to school and also what theyre being taught. In this case, the Carson Family alleged that the state of maine violated the constitutions religion and equal protection clauses when they denied them to use the Tuition Assistance program to send their daughter to a Religious School. John roberts says the federal government should be neutral when it comes to religious and nonReligious Schools. Youre discriminating religions based on their brief. Justice brier countered that argument. Listen. Theres 65 religions or more in this country. They believe a lot of different things. What is worrying me is that if the state must give money to the schools, theyre going to get in to all kinds of religious disputes. Parents that have yanked their kids out of Public Schools say that School Choice right now is more important than ever. Listen. We saw what was taught in the classrooms. Parents are not happy. It was an eye opener for a lot of parents that just assume when you send your kids through the two doors every day that its focused on math, science, reading, writing, history. Now, nationwide enrollment in Public Schools is down 3 . More than 1. 5 million kids taken out of the Public School system. Martha, Public Kindergarten Enrollment is down 9 . Preschool enromment is down 22 . Martha thanks, gillian. Betsy devos joins me now. Great to have you with us. Thanks for being here. I want to start by getting in this piece of audio from justice kavanaugh. Listen to this. I understand theyre seeking equal treatment, not special treatment. Theyre saying dont treat me worse because i want to send my children to a Religious School rather than a secular school. Treat me the same. Martha thoughts, betsy. This is a very importants cause and one being watched closely by all of those that have been long advocating for parents to have that power and control over where their kids go to school, where they go to learn. This last 1 1 2 years has brought millions more to that table. In is an important issue and an important case that will be decided soon, but its already been decided by many families that could make that decision based on the resources that they have to afford it. What we have been long advocating for is that all families be able to make those decisions. Contrary to what i heard justice brier say, the money doesnt go to the schools. The money goes through the families and the families make those decisions. So this is the important piece of it that parents, families need to be able to have that control and that power and to make those decisions that are the right fit for their children based on their own families needs and values. Martha i would imagine it would go to a credited Religious Schools, that they have to meet a measure. If hes concerned about some sort of really offbeat or some a school that is not a credited or able to give the equivalent of a public education. Well see where it goes. Very interesting. With regard to the loss of learning that we talked about a lot, its tragic what happened during covid. The studies are out that show that students that were forced to learn at home are in the worse shape. Those that had more exposure are in better shape. Look at the numbers of students that scored proficient or above in math, that number dropped 14 in math and 6 in language arts, betsy. I was so struck by this. You know, in this environment, you have some schools that have announced that theyre going close fridays and be remote just because its nice to be home on that day of the week. They took all of thanksgiving off in a couple of these school systems. Shouldnts they be in a position that theyre adding hours to make up for what was lost . Absolutely. The results are tragic. Were only beginning to understand the full depth of the problem. Defense of Freedom Institute did a study of the 12 Largest School districts. Not surprisingly, the ones with the strongest unions kept kids out the longest. The ones where the kids needed to be in school the most, absolutely. They were theyre the ones you cited the Learning Loss averages. The reality is the kids at the bottom ends of the spectrum were hit worse than those numbers even relate. Again, were only beginning to see the real results of this. Its unconscionable to me that any district or any Teachers Union would be advocating for taking more time off and Distance Learning when theres no reason to be doing it. Kids need to be in their classrooms and need to have that hands on learning time. The ones that have been hurt most are the ones that will pay the price the longest. Martha just a few seconds. If you were still in your job at the education department, what give me one thing that you would do to catch these kids up. 30 seconds. I would give families the power to make the choices for their kids where theyre going to go to school, where theyre going to get tutoring if they need it, where they get additional services. Give them the resources that are already attributed to them and let them make those decisions. They knee their kids best. Martha its pretty shocking that we dont hear about this from the highest levels of the white house. This isnt a National Push to catch these kids up and to get them up to speed so they can advance to the next grade. Its never discussed. We dont hear anything about this Learning Loss and what the advice is. Wed like to hear that. Thanks, betsy. Thank you. Martha that is the story of the wednesday, december 8. Moving along here.
