by my cohost harris faulkner and kayleigh mcenany. hosts of kennedy on fox business, kennedy, and in the center seat, fox and friends cohost and author of the president of the freedom fighter, brian kilmeade a brian kilmeade. thankfully no one was hurt in the early morning arson attack and the suspect is now in custody but while police don't know what the motive was the crime is just another sad example of the senseless attacks plaguing cities run by democrats who have instituted some controversial policies. here is new york city's police commissioner dormant shape. >> it's the same old song in terms of what we are seeing, we are seeing mental illness, disregard for common decency. but when you have mass amounts of people put back on the streets that have traditionally been held in jail, we see some of that permeate here as well. that's just a fact and it's a fact that people don't want to talk about. >> emily: it's just a fact that people don't want to talk about it but we are talking about here on fox because it happened on our doorstep and we've been talking about it this entire time as we've been our cities destroyed preventively while elected officials let these guys go over and over again. >> and you are right to say that the tree is a bigger story, it's the lawlessness and what is traditionally one of the safest places to be in america. diagonal from the rockefeller tree, which also has security, but people then get even closer to that than they can to our tree. when i came to work this morning at 345, you think it was 12 noon between all the cop cars who responded so swiftly and the firefighters who were there and you could see the tree was just like it looks right now. in fact this guy was able to get close within a matter of seconds with what looks like newspapers in his arms and was able to put the whole tree up and are great security team, mike was able to tackle him to the ground and hold him there. he is now a guy with an arrest record. dermot shea in that interview said, we know this guy. we why they are helpless to keep these people in jail, obviously mentally ill and will be arranged in a matter of hours but it goes to show you that the normal places where crime happens emma is happening. but it's the abnormal places where it's happening that should have everybody unnerved. >> emily: and kennedy, brian mentions the pattern we keep seeing, these are people with arrest records out on no bail or limited bail or getting unfettered access to the streets after violent crimes. it has nothing to do in part with classifications or what they have done because they are just out on the streets. we have here a quote from the husband of a poor 50-year-old woman who is attacked and punched in the face by yet another free to suspect and he says, when does it stop? you keep giving him a more tries until they finally kill someone and then you lock him behind bars? he's out loose, he's going to do this to somebody else. this is what we keep seeing, the anguish of the family members who keep crying out for someone to do something because this keeps happening. >> kennedy: endings activist das are disconnected from police and they are the ones who helped declare war on the police and they are the ones who are just trying to do their job. many of them are retiring in record numbers, not only in new york but harris had a story last hour on the faulkner focus about portland and the crime problems they are having their and the difficulty that they are having re-staffing some of those police vacancies and you know, i say it on my show every night on fox business, this is not how you do criminal justice reform. there are ways to do it, and a kayleigh knows that, the lesser administration was one of the few that actually tried to make some meaningful improvements in that arena. but what they are doing right now, violent crime is going up and homicides are going up, shooting crimes are going up and all of these things, there is a massive disconnect. this should be to brian's point of safe place. this is a block away from times square at christmas. this is where people come for the trip of the year to see the lights and at the displays. red fox, the tree means so much to people because we have an incredible red, white, and blue declaration which is a nod to not only the season but also this incredible country that we live in. and i'll tell you this, we will build the tree and in no time it will be beautiful and massive and it will mean even more than it did before. so come see us and come celebrate. you firebug little -- he will not keep us down. >> today new york police released statistics of crime and we released homicides with one month left to still to go. felony assault of 10% and the most in history. and it's not just here, 2012 major cities, it's worse than a war zone around here. all around the country we keep profiling here on this couch not only those statistics on the percentages but also the names and faces around the is horrible violent crimes and bloating destruction of people's lives and livelihood. we have that young boy who was four years old who was shot in his bed while sleeping, murdered heinously. and federal law enforcement partnered with the states and not the color of legend taliaferro and many others. but let me make a side point here. this is more than a crime problem, it's a cultural problem. walking to the liberal democrats america where we bring christmas trees. where an olympic alternate dreams of having the flag dropped across their shoulder so they can, you sense and commonality? is our nation symbols and symbols that brought us together. and they are all under attack and different ways and in some ways it's a crime and in other ways it's using free speech, these are symbols that pull us together. but yes. kennedy, that tree will be built back and felt that stronger and as our ceo suzanne scott said we will use this time to send a message that there will be peace, light and joy even during a dark moment. what beautiful words and beautiful message. >> emily: the issue of people's responses to what so many of us saw as horrific one-off, they got people together and unify them toward criminal justice reform and toward the flight, complaint of criminal justice reform, this is not criminal justice reform, this is allowing unfettered access to violence in our streets while law enforcement are hamstring while elected officials surrendered to the progressive left, both in policy and in words. it law enforcement are retiring in droves and getting assaulted and attacked, and this is not restoring to "law & order" nor is this a compassionate return to criminal justice return that people can get behind. this is but however harris we do have some hope. >> before we get to the hope, let's talk about the work we have to do. brian, you hit the nail on the head, we are seeing places and types of crimes that we haven't seen in those areas before. 20 or 30 people going into a home depot, you know how dangerous that makes it? >> kennedy: and cnn reliable sources like the biden administration would be happy with them, and also "the washington post" have met with ridiculous op-ed suggesting bidens press isn't worse than trumps press. >> brian: you should be doing this whole segment yourself, you lived this and it's all in your book due to chronicling and going of your book reminded me, if president trump fell asleep in a paris climate meeting or a climate meeting in glasgow, do you think they'd forget about, especially when he said build this whole administration around the meeting? what about the iranian deal, the way we are begging to get in? crime and inflation are fundamental things that we never even report. if you look at the other channels it's 45 minutes and an hour on january 6th, that's all they got. mark meadows, that's what's happening. they don't even want to report any other things and so it's nonreporting by omission. there are too many people walking around saying you just say you wanted to get 500,000 jobs last week? didn't you just get 200,000? they didn't exist where the massive quit off didn't happen and people were quitting their jobs and its core comical that dana milbank's expect to sell us that that he rode that trump gets worse coverage, are you kidding? look at the press conference, peter doocy asked tough questions but he asked them politely with respect. >> emily: exactly, that's a great point and you are exactly right. it takes a lot to be a democrat president and got really bad coverage but it's not the media's fault. to that end, "the wall street journal," we have some more numbers that will pop up. they ate there is 61% of the economy is heading the wrong direction, 63% say that country has gone off track, 46% expect the economy to get worse. so this is in the media, this is the american people saying we are rejecting this. >> kayleigh: at the president doesn't need to reshape coverage, he needs to reshape policy. stop questioning jobs, but the pipeline back. lift the regulations on the mandates that are choking business owners who can't afford to hire employees to execute on their supply chain. you want to talk about opening the economy, lift the regulations and open the economy. how about you shut down for us we stop having a flood of people that are depleting our resources and driving up cheap labor? all of this stuff translates back to the decisions of the policy that this administration has been putting into place and what they need to do is spend less time worrying about the messaging that is, if it's accurate, showing them exactly the critical life that they need to be shown in. this is a perfect example of how the government and how biden and his administration have their priorities always in the wrong place. it's always about how they are being viewed rather than how they are serving the american people who pay our salaries. >> harris: and its formative because it takes that to bring a party that so divided together. they are performing for that loud, far left part of the party and they are trying to keep it together and actually govern through that process. i want to know how it really went down because having it off the record with people of the media, i mean presidents always have that lunch and anchors like bret baier will go to the white house. if you go to the white house and you sit down and talk you talk about is off the record but is not to curry favor, it's to submit the access that you've been promised, which president trump did a great, he gave lots of access. but part of the problem for reporters right now with the way that this drip, drip, drip is coming out, it makes it look like they were called to task like, come in and take you our comeuppance because you were not kind about the president. and it's hard to call afghanistan a winning success when that's a lie is the bigger problem is my study with what you just said about afghanistan, they want us to get over it. we are never getting over it and i'm not just saying about justice five, i'm talking about the country because democrats and republicans have families that served in that war, you are looking around and legs are missing and arms are missing, and we say what was that for? who else was carrying for our elders? who else was harvesting our food? who else was stocking ourselves except immigrant labor in the united states of america? >> the squad members remarks, as new york city has set to allow some 800,000 noncitizens the right to vote in local elections. you only have to be here for like a month. this will be the big apple chance to be the largest jurisdiction in the country to expand the right to vote. brian kilmeade. >> brian: it's pretty amazing. accurate just saying to yourself we have to work out immigration reform and approach this with an open mind, and then we have aoc come out and say we have to have a legals of vote. people who don't belong here, they have snuck into the country and let's let them vote in elections. they don't know the language and let's make sure that they get licenses and now if we accept that, immigration reform will not happen. this is their greatest fear. >> harris: just to put a fine point on it, these are people who may have gotten married in the country or maybe have a visa. within 30 days they are able to do kind of the central point of our democracy and vote in local elections. >> kennedy: here's what they need to do. they need to create an appropriate immigration process, so people become legal and then they can vote when they become united states citizens. i do agree with her, and we do need immigrants, they come to this country from other parts of the world because i want to live the american dream. what is the american dream? it's actually a meritocracy. you see that time and time again, some of the most inspiring stories that we have are people who came from nothing and sacrifice everything and made something great. half of the fortune 500 companies are immigrant founders. actually look higher and broader, and why do you want people to come to this country and get phds? we perform miracles and will make it even better >> harris: many of them do. >> kayleigh: aoc, sometimes the ignorance is just confounding to me. we have a crisis on our southern border. when you have nearly 12,000 or 13,000 migrants, there are push and pull factors, and when you see, when you cram mass amnesty into a bill that's a massive pull factor. the "washington examiner" reported last week that we have seven times greater the number of immigrants coming from countries outside of mexico and these are outside that perimeter. seven times the greater this year than last. let's open the doors and pull everyone in come mass amnesty. what an ignorant proposal. if >> harris: we know from our own reporting that they are not able to test anybody. without our border patrol to do everything except for fly with a red cape on. they are having to do it all. so they do what they can. they've got a tremendous amount of people and then those that are positive, they break their quarantines and go all over the country. from a legal standpoint, what can be done for what kennedy is saying and you become a citizen so you can vote. >> maryland alone has 11 cities that do this and this could be the largest metropolis that has a right to grant to noncitizens because obviously it's not federal elections. i just want to be clear for viewers so they understand the argument on both sides. when tony brought up the need for immigration reform, is why that's not happening. for one reason that councilman rodriguez who author of this bill specifically said these people who are against it are the same group of people who have been donald trump supported, never on the side of immigrants and they are the same people would be fine with legislation on the south that's reducing voting rights. the bill will pass and instead of diluting anything it will strengthen our democracy. my point is illustrating that those talking points are hyperbolic and negative, there are absolutely incorrect, and they overgeneralize and demonize the g.o.p. that's demonizing the counterargument to this bill which is the right of citizenship, the right to vote, excuse me, under assistantship is so sacred and important as councilmember joe borelli said. the stakes are too high in this country and in the city to give it away to someone who's only been here lawfully for 30 days. so that's my point about, is demonizing the other side and saying like your heart and your four years with trump, the demonization rather than engaging, saying let's work with this, let's work together in here. but even with this policy voting and why are you if it's been there for residents 30 days? >> harris: it's o molly page flow model, don't let her near your child. if she disagrees with you, she is a case for murder. and i think that's pretty simplistic no matter what the issue is. and then there is speech for insight. if you are in a crowded theater and there is no fire and it you yell fire, that is not protected speech. she technically is doing that. anybody who doesn't agree with her, kill them. and she has access to our nations best resource, our children. i like the word fire but not for firepower, fire her. >> emily: it well said. and she's on the board of directors or was at least, this is the nation's largest union it. it didn't just end with that, she went on to write, i don't know why the g.o.p. doesn't take those guns that profess to love so much and start -- this is sick stuff. >> brian: but it's not unusual. maybe st. the anger that people have towards people that are unvaccinated is unbelievable, off the charts. on the other side is resentment for people saying i don't want to be told what to do. i think it all comes down to this. there is a view that the unvaccinated are getting the vaccinated sick when the stats do not reveal that and they say that -- that's what the stats say when anthony fauci is speaking at at harvard or talking chuck todd, it might be the same thing. and you get hospitalized and at 99% of vaccinated people don't, so what are you worried about? instead you walk around angry and also know that she considers herself a semi pro wine drinker and union advocate. so it sounds like a really well-rounded life. >> there has been a lot of drinking. but it's important that our viewers no, civil rights activists in 1964 so a worker can request an exemption for a sincerely held religious beliefs practices in the sincerely held part is what we have seen litigation around and that's why that's while part of the application process that usually involves a letter or statement by your priest or rabbi or the like and some type of illustration from your practice of observance. that's requesting religious exemptions and that has been the public's reaction to it. in part, many of the progressive left had said it, this is an example of the government being, for example, to liberal. if 70% of those in the hospital, their requests were, the liberals were acquiescing in approving these requests, the reality is this is a deeply personal, deeply individual application and belief. and for this to become just another right field that the progressive left can use to attack those people of faith to me is hideous. but depending on the place of employment, sometimes it's been 90% approved and others as low as 65%. >> kayleigh: at the school district this woman teaches in, they will investigate the matter of accordingly. do you want this woman teaching your kids, kennedy?
