look at outgoing mayor bill de blasio's parting shot. a sudden, wide-ranging vaccine mandate affecting more than 180,000 businesses before the end of this year. good evening, eric. >> good evening. new york city mayor bill de blasio, with less than four weeks to go in office, ordering all private businesses to demand their employees get vaccinated. >> we need to take bold and aggressive action address these new threats. >> he calls out a preemptive strike. as a term once down, bill de blasio winding up restrictions, clamping down on more than 180,000 businesses and nearly 4 million people with his vaccine mandate. >> vaccination is a central weapon in this war against covid. if one thing has worked every single time across the board, on the strategic level, it is the reason new york city is back in so many ways. >> the city already has a vaccine mandate for city workers, and/or dining, gins, and entertainment. but as business groups are angry saying they were blindsided in companies could suffer. >> it came as a surprise. there was no forewarning, and i think most employers who have been working as hard to get their people vaccinated for the last year, were caught off guard by suddenly having a oral mandate. >> the city has a high vaccination rate, married than 80% of new yorkers have at least one job in a low covid positivity rate. it has been climbing. at 2.88% but that is vastly lower than states with the highest best foul positivity rate. iowa and kansas. new jersey just over 37%. idaho near that. and south dakota at just over 30%. new york officials say vaccine mandate can't crush covid. >> vaccine mandates work especially -- provide incentives and improve assets. >> de blasio is expected to run for governor in new york state next year and some seem impact your business with just a couple of weeks to get this thing together? >> of course we had no idea this was coming here this guy has been ruining the city by the cuff of his shirt for eight years now. we had no idea it was coming. and honestly, makes it more difficult to stay alive as a business in new york city. if not for -- the and restaurants. trying to run for governor. does he not wake up in the morning, look in the mirror, and realize that everybody hates him? who in their right mind would say i'm going to run for governor when you have the least favorable reception from anybody in new york city. we need a covid against him. >> shannon: i know business owners are going to be a mounting legal challenges because just within days, he is not going to be the mayor anymore. so it's be interesting to hear with the courts have to say about her. in the meantime, doctor, talked about this idea. there is a report out about linking vaccinations with how people are doing with covid cases and they say increases in covid-19 are unrelated to level vaccination across 68 countries and 2,974 counties in the u.s. they look and say it is not that the higher rates meaning there are pure covid cases at least according to their estimation but what the mayor said tonight is that vaccination is tried and true. it works every single time. so where is the truth? somewhere in between? what do we need to know about vaccination and fighting this new variant and what do we know about that tonight? >> well, again, this is a manifestation of how terribly this vaccine has been handled. this vaccine is a marvelous as head of technology but under the policy front, it has completely mishandled. here is an of healing and prevention that is being used to divide us even further. and i think the politicians who are making this mistake, it is not necessarily the public health experts who hope to prevent the spread of infection. now, certainly, one of the big issues that is going on, this conflation between vaccination and immunity. and you have i have had multiple discussions about this where it is very clear that not 100% of folks who get vaccinated are immune, and those are the people who are most susceptible. so the correlation is with immunity and not necessarily vaccination. there are plenty of folks whose vaccinations wayne, plenty of folks who did not get ultimately vaccinated on the initial vaccination. so the conflation between immunity and vaccination -- it also has to do with that. so low-hanging fruit for the public health officials to make sure people are optimally immunized. i think people would agree with that and not to force people who are vaccinated who are already immune to get vaccinated. >> shannon: you have said there are increasing numbers of study that show natural immunity needs to be part of the conversation it were talking about making sure people are immune against the virus. pizza come with america is talking about is not only getting all of your employees vaccinated no questions asked regardless, but it is also this idea you guys are going to have to start enforcing checking vaccination cards for 5-year-olds. how is your staff going to do that? >> that's the thing. as a parent myself, all we want to do is make sure that our kids are protected and that we don't make any mistakes. so now we have to take the burden to vaccinate our kids not knowing if this vaccination is safe long term. so think about a parent who later on weak sub ten years down the road and realize that their kid is sick because of vaccination -- so i disagree with this. we have people coming to the restaurant now and we have to ask for cards. that is not our job. i didn't grow up wanting to be the vaccination police. i grew up wanting to own a restaurant in new york city and serve people with great food. the city is so bent on vaccination, have them hire to sit on my sidewalk on a chair and ask for vaccination cards. that is not my job. but we need is a vaccine against de blasio. get him out of here. he is like covid. he does not go away. we need him gone. >> shannon: dr. come i want to give you a chance to answer that because i hear from a lot of parents who are afraid we don't -- the data i don't have information whether this is safe. what is your advice? can they check the immunology of their children, should they move forward? we are told it is safe for kids. the parents have questions. >> in my opinion, i think a child who has had covid would be a hard stop, particularly if the kid is -- i think it's reasonable to look at the number and say one in several thousand kids -- the kid have had covid and millions have in their positive, they should forego the vaccination of the time. with respect to vaccinating kids, i think it is safe to say that the risk of a natural infection, in every age category including kids, is substantially higher than it is with a vaccine. so i think in that sense, the vaccine is reasonably safe. and i have several children and the youngest one of them is nine years old and he got the first shot. in the calculus in my mind was he hasn't had covid, he is not in my mean, we check that, he was negative for a covid test. and we went ahead and give him the vaccine uneventfully. so i think the bulk of the evidence is pointing in the direction of aiming for immunity, and the pathway to that is an immune people to vaccinate them, i think that's a reasonable thing to do. what is at stake here is the health of our nation and our economy as well. frankly, although vaccine mandates and all the ruckus that has created in places like new york city is really more full of flexion of the political errors that are being made instead of medical errors. this vaccine is probably one of the most effective medical miracles that we have created in quite some time. the fact that is an mrna based vaccine makes it a minimal to changing very rapidly to adopt to these variants, and omicron vaccine registrar of voters. that is the easy part. i recall organize have a hundred 60 days to collect 580,000 signatures of registered voters and that is a heavy left. just a few months ago, never to recall testimony by two direct eye witnesses saying they conspired with him to commit this hoax. there is no physical evidence that seem to support smollett claim. i think smollett is making a terrible, terrible decision testify on the stand prayed when he gets cross-examined, he is going to be on guard for perjury and for lying to the court which is going to make his case much worse than if he pled guilty and got the plea bargain. spew and he's deftly doubling down on his story multiple times today. he said this is not a hoax, alleged crime. how many of the jury is reading this russian mark and as john said, once cross-examination starts, that is a difficult fine line to walk. >> yeah, i don't know how we can surround this idea that he evidently testified that he not only got an injury under his eye but that he still has that injury. the jury can look at him and see that he doesn't have the injury. and if a doctor from northwestern testifying that he examined him and could find no injury. those types of basic facts that are right there in front of the jury are not doing himself any good to try to continue to perpetrate, perpetuate this in such a manner. i think it is a very different when you don't get to see a camera in the court. but i have to tell you, over the last few high-profile cases, i really believe in the jury, and dive all the confidence that the jury will make the right decision. >> shannon: and looking forward to matt finn's tweets from that tomorrow. another trial when there is also not a camera, the elaine maxwell trial. people keep asking why aren't their chemist question mike in 1994, the u.s. traditional conference which sets policy federal courts voted down an amendment which would've allowed cameras in criminal proceedings. do you think will be helpful for there to be more transparency if it were possible for the judge to allow a camera in the ghislaine maxwell trial? >> i've been quite a skeptic about glowing embers in the courtroom. the supreme court doesn't allow them. some federal appeals courts do and some state courts do. but what you worry about -- sorry, lawyers and witnesses and even the defendant playing to the crowd, playing to the public. and by doing that, trying to influence how things look to the jury. i think it is much better to keep cameras out. on the other hand, i think the bands are broking. going to be a steady advancement for chemist. i bet you the supreme court someday will how to allow cameras. >> shannon: for those who don't understand all the procedural rules and they feel like kyle rittenhouse, a tweet from tim young said wall-to-wall coverage, nonstop covered terry -- live video from the court seen the entire time. ghislaine maxwell, sketches and newspaper articles. a lot of people feel like there is some hedging of bets and not really talking about her trial as much because there is potentially powerful people involved. is that reading too much into it? >> so part of this is they are comparing this to the regular oreo cookies. and i did some investigating today at the grocery store and i do have to tell you that the regular cookies do have the oil in them. the material differences that there is not at milk in this, which could be attributed to the mint cream or the fudge. as a matter because that means there is less calories, then i'm going to eat a lot more. but we did have some taste testing here. and the overall consensus is that it doesn't taste like wax. that this is fudge. that will tell you, just like during the commercial break, it took me three stores to find a box of these, which tells me that consumers are not buying this because it says fudge, they are buying it because of the taste. spew and i am eating one right now, and i'm going to lie. this is an awesome combo. now, this -- this is the list of ingredients that are on the package. people want to know what is in there and debate about it, it is not like these guys are hiding it, it is right there. >> yeah, but the key is we want truth in advertising. and product packaging when it comes to food is a regulated industry. so if we call something fudge, we want it to be fudge. and if it is not fudge, which in the complaint they lay out very clearly the origin, the beginning of fudge come all the way through which wikipedia defines it as, and it contains butter, it contains dairy milk fat and sugars. now, i love my double stops oreos. of course. but i did get it on good argument from a teenage boy who might happen to be my son who loves the chocolate covered oreos. but he said that his chocolate, it is not fudge. so truth on the label matters. so it if is chocolate covered, college chocolate. don't call it fudge. >> shannon: i am thinking these in a milk shake or an ice cream crumbled up would be very good. to listen on their own as -- i don't know what they call it hamburger helper. just fine on its own paired same with oreos. exhibit c. this is all folk from the plaintiff's argument. reasonable consumers are misled by the statement "fudge covered oreo mint cream." in the picture of the cookie being coated with what appears to be fudge because they expect fudge to mean a food made of dairy ingredients containing milk fat. sarah, is that what you expect with fudge? these plenty of say it is not the truth. >> i want to know what damages they are suffering based on this because i don't see any damages. i don't see any merit. i think a judge tosses this case. >> shannon: you think it goes nowhere. again, who decides what the definition of fudge is?
