begin tomorrow with proceedings against three white men charged in the killing of ahmaud arbery. an unarmed black jogger in georgia mcmichael shot and killed him in february 2020. they took to the stand in his own defense last week. charles watson has a recap on the prosecution yet the defense has been saying so far. >> less than 24 hours the murder trial concerning the death of ahmaud arbery will continue at the courthouse behind me. the three defendants on trial, travis mcmichael, his father greg and william bryant have a list of charges including felony murder, the prosecution will get another opportunity to lay out why a conviction is warranted in this case with three hours present closing arguments. counsel for the defendants will have an hour to present their case which puts the defense at three hours as well. there is a lot of speculation of when deliberations will begin at how close that will be to the thanksgiving holiday this thursday. the defense attorney for travis mcmichael says he is not worried about that at all. >> if the jury gets the case a day before thanksgiving, the concern they might be so ready to take a break, so ready to bond with their families that they rush through the deliberation process. this jury however, has a solid intent to get to the bottom of the truth. >> 25-year-old ahmaud arbery was shot and killed while jogging through a neighborhood in brunswick back in february 2020. travis mcmichael shot him saying on the witness stand that he attacked him and that he was forced to shoot. under cross-examination, the prosecution poked holes through his testimony trying to point out discrepancies in his story that ahmaud arbery was a threat to mcmichael. >> he also demonstrates he is a threat to you, he doesn't plot a gun. >> that's correct. >> he hasn't said one word. >> he has not. >> not threatened you in any way verbally or physically. >> no ma'am. >> we heard from the attorney for travis mcmichael who said that his client is remorseful and regrets the any of this ever happen. we will know in the coming days whether the jury agrees. eric: thank you so much. arthel: ahmaud arbery in the rittenhouse trial sparking a heated debate about recent self-defense. protest broke out over the rittenhouse verdict. one declared a riot, he was acquitted because he is white. meanwhile the ahmaud arbery case is about to go to the jury. we now welcome chamber former prosecutor leslie, we will start with ahmaud arbery case. what would you expect or what can we expect to hear in the closing arguments, what questions will the jurors be looking to have answers? >> i think the first thing we've got to get past is the fact that the jury instructions have not yet been finalized particularly as it pertains to the issue of the citizens arrest. there was some debate in court from the defense that indicated that the court does not include the concept of the citizens arrest in its jury instructions that that basically would dismantle the defense. first we have to establish that. what is so critical we have got to consider as well as former prosecutors and lawyers, whenever we are in, we are obstructing potential jurors on the issue of reasonable intent as it pertains to the state burden. number one the state as the burden of proving the case beyond reasonable doubt. reasonable doubt is determined by a person's reasonable and common sense. the question is whether or not these jurors are able to determine based on the reason and common sense whether or not these defendants acted lawfully in nondelivery with intention and whether or not self-defense ought to be afforded to these particular defendants especially travis mcmichael. arthel: jury instruction so critical to how they formulate their thoughts. might the makeup of the jury impact the verdict, you will love and as you know are white. >> absolutely. that is why there is so much outcry over the makeup of this jury. the question is whether or not 11 white jurors have the common sense based on their life experiences. reasonable based on the life experiences so you're saying they're supposed to go in there as jurors and listen to the facts but you are saying we all got to where we were at this point in our lives and those experiences shape how we see things. >> absolutely they shape how we see things in our perspectives and they shape whether or not they have been satisfied with the states case beyond a reasonable doubt. were talking about reasonableness. were not talking about what they believe happened because that's not the standard it is beyond a reasonable doubt. based on the reason of the individual juror whether or not the state has proved its case beyond a reasonable doubt and not to accept the version of the defense that they have probable cause to make contact with ahmaud ardrey with his prior actions as they alleged were not so remote to be contact established between the mcmichael's and the other codefendant and ahmaud arbery. arthel: i want to get to a couple more points, i want to ask you besides the verdict, what is at stake in the ahmaud arbery murder trial. >> obviously what is at stake is justice in there has to be justice in this case. what justice looks like is a guilty on all accounts verdict to hold these three individual souls accountable. in addition to the family finally receives closure in this case and to not allow the sense that folks can create this vigilante justice type of contact with individuals who they believe have committed crimes and to just let law enforcement do their jobs and ultimately if this case has been if the jury finds that this case has been -- that the state meet the verdict it means a guilty verdict would be rendered against all three defenses. arthel: it's been tough on the mother of ahmaud arbery. i have a time for a quick answer, will the rittenhouse verdict have an effect on the ahmaud arbery verdict? >> certainly the rittenhouse verdict has created a cloud if you will over those who have been seeking justice for the victims in the rittenhouse case but also seeing the common elements and self-defense and other issues in the rittenhouse case that were seen as a common denominator of involving the killing of ahmaud arbery. those advocates and those people who have been fighting for to reshape what we consider to be justice in these cases. they are going to be looking for a different outcome in this particular case. arthel: that does not mean it will enter into the jury but we will see. >> we don't know whether to be deliberating on completely. we don't know what's going through their minds but hopefully the state has presented enough evidence and they believe the state as presented enough evidence and hopefully it means that these three defendants will be found guilty as charged. arthel: that's where you stand. thank you for joining us. >> thank you for having me, happy thanksgiving. arthel: as to you as well, tomorrow night you can see kyle rittenhouse will be with tucker carlson the first interview since his acquittal and we have a preview for you. >> i tell everybody there what happened i said i had to do it, i was attacked, i was dizzy, i was vomiting, i cannot breathe. arthel: that interview will air at 8:00 p.m. eastern tomorrow night on the fox news channel. eric: christian charity
