>> bret: this is a story worth following. griff, another topic, something with steve bannon, former trump adviser today. >> griff: that's right. the former senior trump adviser indicted by a federal grand jury on two counts of contempt of congress, he has since indicated that after refusing to comply with january 6th alleged panel subpoena, he will surrender on monday and appear in court. this just hours, bret, after this morning former chief of staff mark meadows, white house chief of staff mark meadows refused to appear before the committee. the chairman vinny thompson saying he will pursue contempt charges for him as well, bret? >> bret: both stories we will follow, griff, thank you. former president trump said he wasn't concerned about mike pence's safety during the january 6th former riot. the former defendant defended the shouts from capitol rioters threatening violence to threat it telling new book betrayal he was not concerned about the chants of "hang mike pence." if you heard those chants they were terrible. >> oh the people were very angry. >> saying hang mike pence. >> it's common sense, john. it's common sense that you are supposed to protect -- how can you -- if you know a vote is frauds lent, right? >> yes. >> how can you pass on a fraudulent vote to congress? >> bret: meanwhile, another story involving former president trump restaurateur and apprentice contestant summer is ending defamation case against the former president there will be no compensation and each party will pay its own expenses. she alleged mr. trump kissed and groped her as she tried to talk to him about her career in 2007. former president trump has always denied the allegation and called it a hoax and now the entire case has been dropped. stocks were up today. the dow gained 179. the s&p 500 finished ahead 34. the nasdaq surged 157 today. for the week the dow and the nasdaq fell about two thirds of a percentage point. the s&p 500 dropped one third. a crisis that has not diminished for president biden is the illegal immigration surge along the southern border. in recent events indicate that influx is actually ramping up once again. correspondent bill melugin reports tonight again from la joya, texas. >> illegal immigrant hides in a tree hoping to evade capture but a texas dps trooper knows to keep his eyes up in the dark of night. scenes like this play out nightly here in la joya, texas, law enforcement hunts for runners who refuse to turn themselves. in hours later the light of day reveals a huge grouch migrants crossed illegally la joya in the overnight hours. this group about 200 strong. mostly families and young children. over the past month, fox news has repeatedly gone roma, texas and shown the constant stream of smugglers bringing migrants across the rio grande in rafts. they have been brazen with no fear of being caught. but, on tuesday night in roma, for the very first time, texas dps and the texas national guard captured a smuggler on a raft as he brought seven illegal immigrants across the river. one of the men in the raft was a 45-year-old from el salvador a previously deported felon for sexual assault. dps says the 17-year-old smuggler assaulted troopers as they around him and he had already had two previous arrest force human smuggling. in a statement about the operation, texas dps tells fox news in part, quote: texas dps and texas national guard are taking action in combating human smugglers and deterring mass migration and stand ready to protect the people and property of texas. and, bret, all year long now we have been showing images of thousands of migrants crossing illegally here into lajoie a texas. never before how we have been able to show you this location. this is a hot spot on the banks of the rio grand here where these migrants like it cross illegally in the middle of the night. this is federal land. you cannot get down here without a law enforcement escort. texas dps tells us the activity is picking up so much they are planning to surge more resources including patrol gun boats to help out already overrun border patrol. send it back to you. >> bret: bill melugin and the fox flight team along the border. bill, thanks. >> bret: breaking tonight the conservatorship that has controlled a large part of the life of pop star britney spears has ended. a judge in los angeles officially announcing the decision just a short time ago. correspondent jeff paul is live in los angeles right now. good evening, jeff. >> good evening, bret. britney spears reacting moments ago on twitter saying, quote: good god i love my fans so much. it's crazy. best day ever. that's in part because tomorrow for the first time in more than a decade, spears is going to wake up with the freedom to make decisions both financially and with her personal life. now, also kicked off in 2019 when britney spears announced that she was going to take a hiatus. that's when a amount of her fans began to take a second look and question what was going on with her life. they soon began to highlight the strict orders she was living under which led them to the widely watched documentary causing public outrage that pressure pushed several key court hearings into the public life where britney spears publicly said on the record that the conservative shop was, quote, abusive. she wanted to be free. her newly picked attorney began to vouch for her wishes, her father then filed a petition to be removed and all of that leading to the moment where spears finds herself free for the first time. >> what's next for britney and this is the first time said for about a decade is up to one person. britney. >> bret: bryan llenas in central park tonight. thanks. closing arguments given monday in the trial of the illinois teenager accused of killing two people and wounding a third during a protest in wisconsin last summer. tonight the mother of kyle rittenhouse tells us what her son said after his emotional testimony on the stand two days ago. wendy rittenhouse spoke with fox news correspondent alexis mcadams. >> when he was telling, like, i had to do it, mom, and that's when he told me when he came back to the apartment, he goes, mom, i had to do it because they were chasing me. they were hurting me. >> bret: today the judge in the case said he would allow the jury to consider lesser charges in the shooting of one of the two men who were killed. he denied a prosecution request for similar option in the killing of the second man. the rittenhouse case has made for compelling television during its live prod broadcast of that trial. media reporting on the eventing. >> news network showed child rittenhouse sobbing on the stand. and he started describing how he shot three men, two of them fatally during last year's rioting in ken another shah, all of them the 18-year-old said in self-defense. >> if i didn't pull the trigger i thought mr. huber was going to kill me. >> wounded man said he didn't shoot until he pointed his own gun at rittenhouse. for more than a year while some conservative pundits defended him. much of the media have maligned rittenhouse who after the police shooting of jacob blake did illegally bring an a.r. 15 to the tense wisconsin town. >> it's not good that a 17-year-old vigilante arguably a domestic terrorists picked up a rifle, drove to a different state to shoot people. kyle rittenhouse is the enemy. >> an abc news article called him an alleged white supremacist, despite the fact that rittenhouse and the three men he shot were all white. now, the trial has prompted some of rittenhouse's critics to revise their views. >> what kind of idiot, 17-year-old, gets a giant gun and goes to a riot. this is a tough case for the prosecution because it does seem like he has a plausible case of self-defense. >> and the media have admitted that prosecutors stumbled badly even getting scolded by the judge. >> don't get brazen with me. >> but that hasn't swayed commentators such as msnbc joy reid who last night invoked the history of vigilantism and lynching. >> 17-year-old proud boy believed he had the perfect right to cross state lines and protect property with the ar-15 property he got claiming it was cool. >> a tragedy for everyone involved and lesson for media rushing to judgment before trial and painting every story in racial terms. bret? >> bret: howie, "the washington post" today on this other story ran a lengthy correction having to deal doo with the steele dossier in the russian probe. what about that? >> bret, this is a highly unusual move for a newspaper to go back and remove large portions of two past stories published during the trump administration and which triggered by the indictment of igor danchenko, the primary source for the steele dossier for lying to the fbi. now, the post which won a pulitzer prize along if with the "new york times" for reporting that included the dossier that identified sergei as an unwaiting source for exspy christopher steele that accusation has been removed from the stories along with the dossier's most salacious and provable claim that they once had evidence of donald trump being with prostitutes at moscow hotel. he denied being a source for steele having any compromised information on the former president. bun question with the post stepping up to correct the record will other news outlets do the same? >> well, i'm sure i'm like a lot of people, i have gotten an ear full from the people i have dealt with in the marketplace about the costs they are facing whether somebody repairing my car or the electrician that comes by the house it gives you a very vivid picture of what is surging through the supply chain. for all the little parts and things that they have to be able to rely on. and i think the administration is feeling the heat because everybody in america is feeling the heat. you know, they talk about the fact that their bill, for example, will make child care less expensive. and to the extent that's true, that's great, but it is a problem that probably affects only a certain percentage of people whereas the general price increases now, are touching everyone. and this is a case in which they set out to solve a certain set of problems at the beginning of their administration and by the time they are getting around to passing legislation related to that, a whole new problem has come about. the additional issue is that as your tape of larry summers showed, there were people warning at the beginning of the year that the initial american rescue plan was oversized and would overheat the economy and they went ahead with it anyway. and so although a lot of this stuff is not their fault, that will be an issue that they're going to be held accountable for. >> bret: the president conceded this week, byron that is definitely adding to the inflationary pressures. the other thing is that the truck driver issue and how trucking happens is really affecting the supply chain. and that does deal with administration policy in one shape or another. >> well, absolutely does. i mean, this is the administration, of course, that wants the united states to produce less energy. but, you know, to elaborate on what chuck said, there were critics saying all along that while the covid pandemic was a -- had a terrible effect on the economy, the relief measures, the stimulus measures we were passing were too big. $900 billion in december. $1.9 trillion in march. they are about to sign another $1.1 trillion on monday. and then now democrats are arguing among themselves whether to spend between 1.75 trillion and 3.5 trillion more on top of all of that. and i think the poverty of president biden's ideas is shown by the fact that when presented with this inflation problem, the only thing he can think to say is "we have to pass more spending." and that is the official white house position right now. >> bret: right. and when you talk about oil and gas and talk about energy prices, there's a thin vale where the administration is not really pretending anymore that it doesn't mind higher prices in energy because, eventually that forces transition, kimberley to different kinds of energy sources. here is the nominee for comptroller of the currency on this issue and senator pat toomey responding. >> coal industry and oil and gas industry. a lot of the smaller players that industry are going to probably go bankrupt in short order, at least we want them to go bankrupt if we want to tackle climate change, right? >> the fact is, in my 11 years in congress, i don't think i have seen a more radical nominee for any regulatory spot in our entire federal government. >> bret: kimberley? >> yeah, well, this is the mindset of nearly all of their nominees. remember, this is an administration that came in and made clear that this climate agenda was going to direct almost all the rest of what it did throughout government. and, you know, we were just talking about inflation here. people, when we talk about that and they think about gas prices it, may normally tend to think about what it costs to fill up your tank. but the reality is as energy is the backbone of nearly all production of supply in this country whether you are creating plastics or manufacturing aluminum, whatever it is. it's the key reason why those prices are going up across the board. the answer is to send the right signals to companies to get them investing again. that's not what they're doing. >> bret: okay. well, it's interesting to watch and there is a couple of nominees who are potentially in trouble for the administration. panel, stand by if you would. up next, the friday lightning round, afghanistan, the northern virginia school board controversy with some breaking news tonight plus winners and losers. ♪ ♪s managers. bases. and as far as the actual afghan commandos are concerned. one's heart goes out to them. you have to think it might be a long time before the biden administration goes back and brings anybody and purposes the absolute spine of the afghan army. they fought really hard and took a lot of casualties right up almost to the end. we did get some of the air personnel, the pilots out quietly a little while ago. but their situation has become so desperate some of them are reported to be joining isis in self-defense which means their plight is turning to a national security issue for us as well. >> bret: all right, i want to turn to this situation in virginia and the national school board and the fbi reaction to it. here is senator kennedy and attorney general garland on this memo. >> the national school board association sent the letter to the white house and the white house promptly called you and said sick the fbi on parents at school board hearings. >> i did not speak with
