bill. now there is infighting among democrats and republicans. cracks biltmore defends appearance and rigid it takes on a liberal professional on vertical race theory. >> just like separating children by race. in describing them as oppressed or oppressed. their children coming home who are traumatized by this. >> did not see that coming. the exchanges coming up at. >> fox news alert a big blow to biden's covid vaccine mandate for businesses the fifth circuit court of appeals granting an emergency stay prohibiting enforcement of the rules for an operant ruling because the petition give cause to believe there are grave statutory and constitutional issues with the mandate the mandate is hereby stayed pending further action by this court. the mandate requires companies with more than 100 employees to ensure their workers are vaccinated or tested weekly. it was supposed to go into effect in january. texas sued the biden administration over the lawsuit in attorney general ken paxton tweeted earlier the fight is not over and i will not never stop resisting this administration on constitutional overreach. we will bring back in the panel to discuss here. i'll start with you, we sought new york city we lost 9000 workers to the vaccine mandate here. do you agree with ag paxton he said this is unconstitutional overreach? >> i agree, abby, this fight will continue. there are just so many questions over enforcement which is opposite with the court has decided to put things on pause right now. the first thing i thought of, abby, and everyone else with seasonal workers. you think about places, i am in colorado with the ski industry here. so during the season these businesses will relate beef. in the off-season they're operating on a skeleton crew. it's going to be very difficult and that in terms of enforcement as well, some businesses pit them against themselves. because they are going to be doing the enforcing while they also are trying to find people to work because we have a worker shortage. there are so many questions that are still out there. i deafly agree the fight will continue. >> is interesting to bring up that point. we also talked about the supply chain issue there's a shortage of 80000 truck drivers as of right now. that is an estimate around 80000. i am sure this would have affected that as well but let's go to the white house for the deputy press secretary responded to questions about the mandate holding up in court, take a listen. >> we are very confident it can asked for the legal side of this let me be crystal clear to avoid what appears to be possible misinformation or disinformation around the temporary standard being a vaccine mandate will be on its face incorrect as have been explicit for months. it's a standard for safe workplace to either comply with weekly testing or to be vaccinated. >> joe, what do you make of that? >> while the best part about this is, abby and guy's, a gentleman with the last name is the owner of ralph's market and a butcher boy at stores. he joined this a federal lawsuit against biden's vaccine mandate. you will never guess what this guy's first name is, brandon, let's go branded you cannot make this up. [laughter] more than half of the state in the country already oppose this mandate one more point, pfizer merck has not anti- covid pills coming to market that will halt covid in its tracks for the most part once it enters a person system. and in pfizer's state that pill can cut the risk of ending up in a hospital by dying but 89% and can be taken over the counter at home. if that is the case why do we need vaccine mandates with 80% of the country over 18 having received at least one dose of the vaccine. enough too post coming to market they can keep people out of the hospital. i would love to hear the president explained his justification on this mandate now given the data, given the science to give the constitutionality or lack there of in this case here. >> you mention the president. we had some sound of what he had to say about his vaccine mandate for workers let's take a listen to that charlie will get your thoughts on the other side. >> we have been patient, our patience is wearing thin. your refusal has cost all of us. >> that was back in september, charlie what you think of that? >> i have to say that remains one of the most stunning statements i have ever heard an elected president speak to the american people for whom he supposedly works. just a shocking stunning statement. i think what we look back but presidency years from now that will be the reminder of what a failed relationship joe biden has with the american people if he thanks he can wag his finger and treat american people like they are children. i do think it is also interesting his administration spent so much time debating whether this is a mandate or not. they're issuing a mandate than saying it's not a mandate. it is absurd it's like 1984 it is crazy part i have no idea what they are trying to get at here. it's a perfect example of where the federal government actually thanks they know what is best for workers. and they care about workers more than employers do. employers go out of business without their workers. if you don't think employers care about their employees you do not know anything about businesses. they do care about them and they do know what is best for those workers. in most of those cases workers have chosen not to get vaccinated chosen not to get vaccinated because they do not want to get vaccinated at this point. and you know, going forward if you think the supply chain problems that we have right now are bad, if you think inflation is bad now, if you think gas prices are bad now, wait until it mandate like this gets enforced and businesses around this country start having to grapple with this unimaginable burden of trying to sort through all of this and enforce this crazy mandate. it is going to get much uglier before it gets any better i think. >> yes, speaking of ugly we see how many people have commented on this. someone who did choose to not get vaccinated, lease and the traditional sense of the word was aaron rodgers. he was kind of in the middle of the fire storm heat misled people to think he was vaccinated with one of the approved vaccinations. he had received alternate treatment. he was kind of operating under this rules of a vaccinated player's we got a lot of pushback. here's what he had say on the show. joe your sports grants will benefit your thoughts. >> personal health decisions in my opinion should be private. the bodily autonomy is a right. everyone has their own story on their own issues in their own reasons for doing things. but this shaming cancel society that is wrong. >> of joe he was after those comments dropped from health for i do not know the reasoning exactly, i would assume it was because he probably has a different viewpoint on vaccination status as they do, when you make of all of this? [inaudible] [background noises] is alive at the scene in houston were law enforcement just gave an update, garrett. >> this is a tragedy just keeps getting more heartbreaking as we learn how young these victims are. eight people were killed last night. the youngest was just 14. another was 16. the other victims ages were 21, 23 and 27 years old. we are also learning more about those who were taken to the hospital last night. twenty-five people were taken, 13 remain hospitalized including five who are under the age of 18. the mayor said investigators are now trying to talk to as many people as they can to piece together exactly what happened. >> we are talking with those individuals who have been hospitalized to try to get a much better understanding of what took place, what went wrong, where were the missteps? >> the mayor also stressed how were cisco to benefit was in for good samaritan stepping in to help some of the folks who'd gotten hurt or passed out. roughly 50000 people showed up for this to date music festival put on by travis scott. when he took the stage last night a little after 9:00 p.m. the crowd started surging forward to the stage, packing people in so tight witnesses said it was hard to breathe. some people started passing out the crowd respect and so tight they could not get out some people got trampled, others crowd surf. lifeless bodies to try to get those folks help. >> eyewitness somebody unconscious struggling to get out like the friends were trying to get them out. those people were not caring enough to make a path. >> were sitting here had the time of my life but it's scary to think that was the last time some of these people had a wife. today travis got a houston native released a statement saying in part i am absolutely devastated by what took place last night my prayers go out to the families and all those impacted by what happened in astral world festival. i am committed to working together of the houston community to heal and support the families in need. texas governor greg abbott also weighed in saying what happened in esther world festival was tragic in our hearts are with those who lost their lives and those who were injured in the terrifying crowd surge. event organizers have also released a statement saying they are cooperating with this investigation pre-police just told us a short time ago all of the footage of that event will be turned over it later this evening for investigators to start reviewing. >> live in houston, garrett thank you for the update. so let's discuss this and abby i want to begin with you. we know there were 50000 people who were in attendance here. you have authorities now on the scene. it's hard to imagine how they even begin to start to sort this out when you have thousands of potential witnesses. plus all of the videos. >> yes, you're absolutely right. this was a tragic thing. especially when you hear the dead range from 14 years old to 27 years old. 50000 plus people at this concert you can only imagine what law enforcement officers were trying to do in that moment as these people were pushing towards the stage. think with something like this happens people automatically want to point fingers and point to blame. i don't know that we can do that we should not be doing that we should be thinking about these victims and their families, travis scott i know a lot of people right off the bat were saying why didn't he stop the concert? a lot goes through a performer's head went something like that head is happening but maybe he didn't realize maybe he did not have the chance we won't know. i think about arianna grahn date what happened in manchester when that bombing went off and people lost their lives at her concert, what she went through. and for for travis scott, families and law enforcement the houston mayor said the security that was at this concert or this event, was more than was at the world series. i don't think it was a lack of security. i don't think it was anyone's fault will just have to wait until more details come out of our thoughts and prayers go out to those families. >> same here, we are thinking about all of those families out there who at some point, charlie, are going to beat wanting someone to take responsibility for all of this. that is when he gets really tough, right? >> yes indeed. and can you imagine being a parent of one of those kids, your kid goes to a concert you think it's a pretty healthy, reasonable environment and something like this happens. and of course in the best of circumstances a concert like this is kind of a controlled chaos anyway per this lot of mayhem, this loud noise, there's a lot of people screaming. my heart goes out to travis scott. can you imagine in his voice you can hear the frustration of him trying to control the crowd once he realizes what is going on here. it really is incredibly tragic and incredibly sad for think you are right, abby, it is far too early and probably will always be very difficult to assign any kind of a blame or anything like that, we will see. obviously it will be deeply investigated. it is truly, truly a tragedy. >> is joe i was thinking about this as we are hearing all the statements of so many entities here saying they are participating, we know, you note specifically the more coverage there is the more interviews there are that people then start to take sides and blame starts to occur put a lot of finger-pointing is to be expected in the coming weeks. >> of course, that is just the dna unfortunately of our country as a whole in these situations. it is a blame culture. at this point we certainly have more questions than answers. to charlie's point, when you hear a child is young as ten years old was badly injured here, you hear about people experiencing cardiac arrest these are mostly young people. again i'm a parent of a six and 8-year-old i cannot imagine getting that call my child was injured? please show us because we would like to condemn it if this is happening somewhere. the truth of the matter is this history, all history is taught just about everywhere. i do not know a place of there's anyone in america not taught about slavery in america? [laughter] i am so happy to say that. we did something that is long overdue. that has long been talked about in washington but never actually done. >> infrastructure week but the bill only includes $110 billion going to actual infrastructure roads, bridges, and other quote transformational projects. and get this 13 republicans voted for the massive bill. six members of the squad voted against it. all right, said this built 1.2 trillion dollars, i remember the first heart attack by the bill and everybody was like whoa, that the huge price tag. not only that's not all infrastructure is human infrastructure there as well. so alecia i'm going to bring this up joe said he been anchoring for a long time in the last segment i'm sure you are anchoring when president obama passed the 800 billion that is with the be dollars stimulus package how do we compare those two numbers? that that 800 billion is a lot of money and now are talking 1.2 trillion. >> i have been anchoring since i was 15 let's remember that picnics keep that in your mind. we are really getting used to some big numbers and it is getting to be really frightening. i think is going to be very interesting going into the midterms how all of this plays out or even if folks remember because we talk about higher packages at some point it is a little scary. republicans really had a moment there while democrats were really beating dhec out of each other within their own party because they were dealing with the civil war. now you have these 13 republicans who stirred up a hornets nest in their own party. you have this other fight it took a moment for them to come together and let democrats sort of take care of things themselves. they've been tripping over themselves as we saw election night on tuesday. we will continue to watch this i do fear a lot of americans fear these numbers will continue to go up as we become ever used two eye-popping numbers which were once eye-popping and are no longer. >> you think maybe this is what is happening with the build back better plan that's estimated to be 1.5 trillion. it said to be 1.75 trillion estimate say it could go up to 4 trillion. want to look at what you said on the 13 republicans. we have a full screen of who voted another full screen, here are the 13 republicans we know six far left progresses voted against we knew that was going to happen a lot of them so were not going to vote for infrastructure before we get the build back better plan pushed through. what you said the 13 republicans who did vote for this bill while the far left progresses did not. >> sadly, i am not terribly surprised they managed to pick up a handful of republicans to go along with this. any time you a room full of democrats and a roomful of republican politicians in a room they spent six months talking about spending trillions of dollars, one thing you can guarantee before the meeting is all over with they are going to figure out how to spend at least a trillion dollars. the last frontier bipartisanship when it comes to politicians in washington. that is not to belittle or make light of what a serious issue this is. of course the biggest lie anybody tells us how it is all paid for. it is not all paid for. every dime of the $20 trillion that your children and your grandchildren will never live to pay off. every dime of that was paid for when congress spent it. we are just years away before we are going to hit a situation where it suddenly going to be really difficult to make debt payments. it's going to be really difficult for obligation to social security and things like this. there will be a time. it is not far away, when i think the american voters going to start punishing politicians who went through -- blew through all this money and spent like drunken sailors. i do think it's interesting the most ominous things joe biden said is when he talked about how long overdue this infrastructure bill was. long overdue and that for the past five years was clamoring to spend this kind of money on real infrastructure. democrats refused to go along with that for the past five years because they did not want to give them a win. they wanted to spend their time talking about all these crazy conspiracy theories that we now know are all lies and should have known at the time about russia. >> we do not have a lot of time left. let's throw up what is inside that massive spending social spending package. $555billion in tax credits for new energy you can read them all there. were waiting for the score to tell how much it will actually cost in the meantime, joe, what moderate are they thinking about for the expected vote the week of november 15?
