for refusing to comply. new developments in the investigation by special counsel john durham and new information on what is pushing the trump russia collusion story. democrats in disarray still scrambling to push through the fake infrastructure and spending bills on the heels of election losses across the country this week, white house correspondent kevin corke is covering that for us tonight. >> house speaker nancy pelosi and her leadership team spent hours today scrambling to narrow the number of holdouts on the sweeping spending bill. while it is still anyone's guess if, and i mean if, they will manage a boat on friday as expected, they would do so on that and the infrastructure offering i should point out, no matter what makes it over the finish line especially as it relates to the build back better plan. help it could face a very thorny uphill climb. >> the president has been in close touch with speaker pelosi speaker pelosi and leader schumer and their strong agreement that we need to get to these both done for the american people as we've been saying as soon as possible. we cannot wait here, the american people cannot wait to. >> this train is moving so fast in the house, they've blown by hearings, blown by bipartisan markups, and they don't even have a score from the congressional budget office which is required in the senate. the product coming out of the house if it makes it over here is dead on arrival until we get a cbo score. >> that cbo score could balloon things, it could cost as much as $4 trillion according to some analysis. this is from one of the moderates on the democratic side, it's hard to make a decision when you haven't seen the full text and there hasn't been a cbo score. but i'm hopeful. that according to kathleen rice of the great state of new york. many moderates have suggested the house should take infrastructure, get that done since it's already made it past the senate and it's been cbo scored and spend more time on the $1.75 trillion bill which some estimates say could cost as much as $4 trillion. not surprising, democratic infighting has been heightened especially after the shellacking on tuesday both in virginia and other elections around the country. there is high confidence tonight that the house would get its work done by tomorrow at some point and make a vote and put the ball into the skeptical hands of the united states senate. >> shannon: in the meantime democrats cannot get on the same page about what went wrong with them, polar opposites in deciding where to point the blame. >> it's a familiar refrain, you and i have talked about it over the years whenever a party loses a major election, people debate in the party to be go too far? or did we not go far enough? in this case that would mean jog to the left too much or not so much? progressives say push harder next time, people will understand what we can do with our promises and they will fall in line. centrists argue going too far is what put them in the losers seat in the first place and if they keep going left come it will doom the party especially with midterms just around the corner. exit polling does suggested that some of the progressive left policies actually did turn off voters in the commonwealth, most notably their stance on covid lockdowns and illegal immigration. obviously inflation fears and we can't overlook the obvious, the elephant in the room is education it weighed heavily on voters in the commonwealth and crt in particular. >> shannon: see you in just a few. it is a date, president biden says january 4th is the deadline for a federal covid-19 vaccine mandate for businesses with more than 100 employees despite fierce resistance and plenty of threats of legal action, chief breaking news correspondents trace gallagher is on the case for us tonight. >> the best guess here is the january 4th deadline will apply to about 84 million workers at medium and large companies. the rule is that you can either get vaccinated or tested weekly and wear a mask in the workplace. there are no promises that mask mandates will go away even in early vaccinated workplaces. if you are among the 17 million people working in nursing homes, hospitals, and other health care related environments, there is no testing option. it is vaccination or else. eventually many believe these mandates will trickle down to smaller businesses. the general counsel for the national retail federation says this will have a major impact on an already overburdened system. >> we are suffering under real workforce shortages, we are suffering under supply chain issues, some of which are in turn due to workforce shortages. i'm really concerned about what is going to happen if employees and even marginal percentages decide they would rather not work then be subject to mandates like this one. >> florida governor ron desantis plans to mount a legal challenge, he called the move unconstitutional saying the biden administration does not have the authority to impose this using the applicant patient health administration. the status says the president is basing this on an imminent threat but is certainly taking his time. >> it took him six weeks to write the role and it doesn't go into effect until january, we are going to be challenging that. i think this rule is absolutely going down. >> governor desantis has support from other states including south dakota. here's governor christie nome. >> i've already signed an executive order that protected our people from this unconstitutional action but i am announcing you that we are joining several other states and filing litigation against this unconstitutional mandate. >> while the biden administration clearly believes it has the leverage to make this happen, the headwinds appear to be ratcheting up a notch or two. >> shannon: trace gallagher, thank you very much. friday november 12th will be vaccination awareness day for chicago public schools. officials in the windy city announcing tonight that classes will be canceled in order to allow kids the opportunity to get the vaccine and reportedly faculty and staff will be given paid days off. some children in san francisco will be added to the city's proof of vaccination requirement for indoor venues. kids ages 5 to 11 will be barred from places like restaurants, gyms, and large events inside without proof of vaccination. once the city expands the measure which officials they will be in a matter of weeks, that city will become the first in the u.s. to require vaccination proof from kids. a russian analyst who helped provide information for the infamous steele dossier which filled the trump-russia investigation is now facing multiple charges of lying to the fbi and has been arrested. this is a crucial part of the ongoing probe by special prosecutor john durham. david spunt has details tonight from the justice department. >> his name is igor, he is charged with five counts of lying to the fbi. he made an appearance in court this afternoon, we were there as he left court. special counsel john durham said a russian national living in northern virginia was the primary source for british spy christopher steele who compiled the widely talked about steele dossier full of accusations about president donald trump. the indictment alleges he lied to the fbi about working for christopher steele as his primary source of information prickled this afternoon he appeared in federal court in the eastern district of virginia with a judge released him with no electronic monitoring, the indictment also mentioned his involvement with someone identified as p.r. executive 1, someone believed to be close to the clinton operation. him he was the third defendant to be charged in john durham's two and a half year probe looking at the origins of the investigation into trump and his associates. the other two pleaded guilty to falsifying a document used to obtain a fisa warrant against trump campaign eight carter page, the other's name is michael sussman. he is the former clinton campaign attorney charged with lying to the fbi about alleged connections between donald trump and the kremlin. 's information did not pan out. earlier today a judge signed an order dealing with classified information as part of his case. durum is clearly building a pattern, charging lower-level officials with lying to the fbi, attorney general merrick garland recently confirmed his budget was renewed and he continues to do his job, while kevin kleinsmith pleaded guilty to his charge, michael sussman pleaded not guilty and plans to fight the case in court. earlier today, he will make another appearance in court next week. >> shannon: thank you. from those latest developments in the special counsel investigation into the biden administration forging forward for a nationwide covert mandate for businesses, we have senator mike lee. thank you, senator. and i want to play a little bit of what we heard about whether there could be a mandates, whether that is the role of the government here. >> no, i wouldn't demand it be mandatory. >> i think the question, that is not the role of the federal government, that is the role that institutions, private sector entities and others may take, that certainly is appropriate. >> i don't think you will ever see a mandating of vaccines particularly for the general public. >> shannon: senator, we have now arrived at what looks like an osha rule which is forcing private businesses to do what the government has been saying. >> i was thrilled to hear that joe biden and jen psaki agreed with the basic principles of federalism and limited government and separation of powers. this is the role of the federal government, it's certainly not something the president of the united states can order alone. the extent that government action is appropriate, it's appropriate only at the state in the local level. even there, it shouldn't happen at all because people shouldn't be forced to choose between keeping their job and being able to feed their family on the one hand and on the other hand getting a medical procedure they don't want. >> shannon: i heard from a business owner down in florida tonight, obviously governor desantis has taken a different position on this and he has pushed back hard on any mandate, vaccine, whatever. florida is in a different place but now the business owner has to make a decision, he has lot of employees all over the world. he doesn't want to comply with this mandate but it would cost him thousands, maybe hundreds of thousands in all of these fines pile up. what do you say to these folks? it's going to take a court battle to get a further clarification on this, that can take some time. it can cost people a lot of businesses and a lot of jobs. >> this is the same question i'm hearing from business owners throughout utah and america, these fines make it crippling. it would destroy any business model. $14,000, roughly per person, per day, these things mount up quickly. they mount up in such a way that it makes it extortion, it makes it impossible to not comply, that's what the biden administration is doing it this way, the biden administration knows but the time it works its way through the courts, there's a good chance that the damage might be done and he might have won at. but at what cost? 14% of americans, that's the entire population of america who believes it's okay to make someone lose their job over this, it's not right. >> shannon: you've had a number of measures against mandates, you're not anti-vaccine, your anti-mandate, there's a difference. >> there's a big difference, i've gotten the vaccine come up my entire family has come i've encouraged everyone i know to get the vaccine. but that is a personal choice and it's not a choice the government should enforce, it's certainly not something that should force people to lose their jobs, its way of going to the senate floor 14 times including today each time offering up different pieces of legislation to stop the mandate. my latest one today drew the objection of democratic senators as each of the others have as well, that's unfortunate. >> i want to make sure we ask you about the newest development in the john durham investigation, jonathan turley a familiar face to fox viewers, and very well esteemed law professor said this today about igor danchenko. him his arrest as a seismic development and confirms that john durum is far from done with his investigation, a russian national who lives here in the u.s. as been indicted for lying five times to federal officials in connection with this investigation. where do you think it goes from here and how significant is this today? >> i tend to think it's very significant, it is fair to say that it's seismic and it's going to lead to other things. other lines of investigation, probably other indictments. this has deep state written all over it but in any event it confirms what we've known all along which was that dossier was a bunch of baloney it should never have been given credence to begin with. >> shannon: who will should be nervous about that tonight? >> i've said for some time that's where the real debate has been for about 25 years. how far left will the democrats go, how far left will liberals be and how much of that are they willing to admit? for the longest time the mainstream media has talked about as if the real movement in the real effort is on the right and among conservatives. now we are seeing what is really been going on. >> shannon: let's read something from steve israel, he is a former democratic representative and he headed up reelection efforts for democrats in the house side. he writes this, this is a form of electroshock therapy for democrats to stop infighting and start delivering tangible results for an impatient electorate. to coin a phrase, never bring reconciliation to an electoral knife fight. in the war between progressive democrats and moderate democrats, republicans won. what should democrats take from this moving forward and heading into the midterms? >> i agree with mr. israel, that's an astute observation. it's important that purity politics, i've mocked it on the right with these weird purity tests, the left has the same problem. purity tests don't work and we have to find compromise, we have defined that middle ground, we have stopped fighting with one another over -- we didn't get exactly what we wanted there, we need to find common ground, pass the bills like president biden has already done to his own executive action cutting child poverty in half in the united states in his first year in office, that's almost a miracle. if the rest of the party comes together, we can show those other benefits to the american people. such as over 40% of our roads are poor or moderate at best and if we get this infrastructure bill through, we start fixing roads and small towns throughout america, that's what people want to see done the. >> i do think there is bipartisan agreement on fixing roads commits some of the other stuff that gets sucked into the bill, grocery shopping for people so they can stay home if they are ill, that sounds a good thing. i don't know if it sounds like infrastructure. there is that whole debate as well. you talk about purity tests, i want to play something. senator joe manchin and senator kyrsten sinema have both been targeted because they are the ones that are holding things up in the senate for all sides. they have been confronted, we've all seen the video of people following senator sinema into a bathroom while she is in there doing her thing with cameras and filming it. we have some new cameras and new video, something that went on with senator joe manchin committees are folks that want to talk with him about the climate, here's a bit of that.
