he has revealed himself to be a total ideologue and i suspected he would become of that joe biden nominated him to provide a cover for the department of justice to be deeply politicized and even weaponized against the american people. >> shannon: a number of heated exchanges went down on capitol hill. plus tennessee senator marsha blackburn who asked the ag whether he would equate angry parents to the oklahoma city bomber. she joins us live to discuss. parents frustrated over another prominent democrat posting a picture inside without a mask while their kids are forced to mask up for hours a day in schools. this time it's new york governor kathy hochul mask less on broadway. not violating any laws or guidelines but a stirring backlash from parents who say they have had enough. americans irritated as more and more out of stock signs propping up in stores and online. one store owner has advice on how to save for your christmas. we begin with that senate judiciary committee hearing where amidst a slew of g.o.p., the ag stood by his memo warning of threats and intimidation and retaliation to the school board members. kevin corke is tracking the latest for us tonight. >> the ag merrick garland was subjected to the sort of grilling on capitol hill that is usually reserved for recalcitrant ceos and silk suited oil barons. the judge facing a withering onslaught of ridicule and recrimination after he issued that very controversial memo that had to do with parents and school boards. >> there is a difference between law and politics and you know the difference between law and politics. law is based on facts, it is impartial, it is not used as a tool for political retribution. this memo was not law. this memo was politics. >> texas senator ted cruz just one of several g.o.p. lawmakers to take to task the nation's chief law enforcement officer, going so far as to accuse the attorney general of engaging in political gamesmanship after he issued a memo instructing the doj to investigate parents who had "threatened a school board members." his october 4th memo was issued after the biden administration claimed it received a letter from the national school board association that suggested some parental behavior amounted to domestic terrorism. the ns b.a. has since issued an apology for that letter. >> thank god, you are not on the supreme court. you should resign in disgrace. >> he was also accused of targeting parents with opposing political views like scott smith, the father of a sexual assault dictum from loudoun county, virginia. >> you have weaponized the fbi and the department of justice ergo the u.s. attorneys are collecting and cataloging all the ways that might prosecute parents like mr. smith because they want to be involved in their children's education and they want to have a say in their elected officials. it's wrong, it is unprecedented to my knowledge in the history of this country and i calling you to resign. >> garland attempted to explain why the national security division of the doj was involved in the investigation and enforcement of framework of the directive, noting that forms of intimidation and harassment could rise to the level ergo but he also maintained that the memo itself was simply being mischaracterized. >> nothing in this memoranda or any memorandum is about parents expressing his agreements with school boards. >> and yet the doj has catalogued 13 federal crimes for which parents could be prosecuted for speaking out at the school board meetings and that is the crux of much of the discussion today on capitol hill. >> shannon: thank you very much. one of the g.o.p. senators questioning the attorney general today, republican marsha blackburn pressed garland about the justice department memo that's part of the controversy, what it was based on and who actually wrote it. >> would you really, honestly put parents in the same category as terry nichols or timothy mcveigh? >> my god, absolutely not. >> did you write that memo committed staff staff like the memo? what would have led you to do this west neck it is so over-the-top. >> this memo is about violence and threats of violence. >> shannon: senator blackburn joins us now talking about the answers she got and lawmakers have not gotten. welcome, senator. >> good to see you, it was quite a day. >> i want to play something from one of the top democrats, senator dick durbin describing the people that are supposed to be the subject of this memo, here is how he described them. >> these are not routine people incensed and angry, these are people who are acting out of their feelings in a violent manner over and over again. the same people we see on airplanes and other places, some of whom we saw on january 6th. >> shannon: what do you of that characterization? >> it is so inappropriate for them to categorize individuals, parents that are showing up at school board meetings and classify them as domestic terrorists. of course, attorney general garland was involved in the oklahoma city bombing, in that case. working through that process, that is why i brought up to him timothy mcveigh and terry nichols, because to say there is harassment, that there is intimidation, there is threats of violence but then to not be able to articulate any of those, it led to what we saw as being incomplete answers that frustrated attorney general's. someone who was confused, giving political answers instead of talking about the rule of law. >> shannon: i want to read something from esquire. republicans try to get merrick garland to admit he's sending fbi s.w.a.t. teams to bust pta bake sales. he characterized it this way, he said the cumulative effect of all this ranting and raving was to leave the unmistakable impression that republicans were defending the intimidation of inconvenient local officials. do you think it's important to have a distinction between parents who are angry and show up and are using their first amendment rights, and those who would actually threaten violence? it makes it look like republicans are actually saying that you should be able to intimidate local officials. >> we know that no one is in favor of violence but what we are protecting his freedom of speech and the right of parents to be involved in the education of their children, their right to petition their government, these are people who are elected to represent them on these local school boards. when parents have questions about curriculum, about mandates, about material that is in the library, about the safety of children in school, of course they should be at the school board. they should be asking questions of the school board members. this is their right and thank goodness parents are concerned they are showing up and they have these questions. i do hope they are holding school board members to account. but for the school board association which of course has apologized for their letter to coordinate with the white house and then to deliver a letter, a memo that is signed by the attorney general of the united states and it is done in a four day turnaround. i brought up to him that there are 45 senators that sent a letter to him in august asking for a status update on the durum investigation and asking for that report to be made public. we still do not have a response but he can turn around this memo and basically calling parents domestic terrorists, it is unprecedented and unbelievable. >> shannon: the memo that came into them was the one that used the words domestic terrorists, it wasn't used in the doj and a lot of people feel like it was embracing that idea. >> once they signed it, yes. >> shannon: i want to make sure to ask about vaccine mandates, there are a number things floating down on capitol hill. i want to read something by jonathan reiner from the uw school of medicine. marsha blackburn stinks essential workers should be exempt from the vaccine because they figure out how to protect themselves, what the senator doesn't seem to understand is the becks majority figured out how vaccines work. not all of them want to or think they need to, what is your legislation about briefly if you could tell us? >> the legislation is very simple. that said if you are an essential worker, you showed up and did your job during the covid-19 pandemic, you do not want to take this vaccine for medical or religious reasons. you should be exempt from the federal mandate. we think that's important, it will help to preserve the jobs of first responders, our front-line workers, law enforcement, airline workers, the trucking industry, we are facing a supply chain shortage. we are going into the holidays, shelves are empty in stores and this is going to make it worse because there are 10.4 million jobs that are unfilled in this country and if joe biden gets his way with the mandate, what you are going to see is more jobs, hundreds of thousands of people that are going to become unemployed. >> shannon: we are going to talk later in the show how that is impacting one city and the police force in a hungry way, we will talk about that. a democratic leader taking heat over mask mandates, new york governor kathy hochul her night out on broadway with the tweet showing her without mask. the picture is sparking a lot of backlash online, primarily from parents who are angry their children are required to mask up for hours a day in order to attend school here in new york. no end to the supply chain crisis insight, a holiday season of heavy demands fast approaching, consumers are looking for those holiday bargains, they may be out of luck with retailers out of stock. correspondent mike tobin is taking a look at for us tonight. >> i don't have good news for you, through the pandemic u.s. consumers hoarded up $2.3 trillion in savings but it looks like that is over, the supply just isn't there. you would be doing well to pay manufacturer suggested retail. the parking lot of the west coast is a fine visual for the backup in the supply chain which means perfect holiday gifts will be hard to come by and more expensive this year. during the heart of the pandemic, pew research did a poll on universal basic income and 54% opposed it. 45% were in favor. the pole dug deeper and found republicans overwhelmingly opposed the plan with the democrats largely supporting it. a majority of black and hispanic residents were also in favor. we should note to push this across the finish line, the l.a. mayor had to break a few promises, he initially said the city would use federal dollars to pay for it, now it's up to city taxpayers. of the 40 million allocated, 11 million will come from cuts to the l.a. police budget that came its way north through mexico with fears growing inside the group of a possible crackdown by the mexican government or being preyed upon by dangerous drug cartels. griff jenkins reports on the ground of 17 and 18, at least 100 babies under a year. 65 pregnant women are in the group, three of them are past eight months, the journey has taken a toll after just five days. >> there are a lot of children here, so we see a lot of families in this caravan. >> as for who is paying for this group, caravan leader and u.s. citizen denies financial support. >> it's a people of goodwill like the it -- 63% believe in the paranormal in some form or another, 57% said they believe in ghosts. 39% believe in visitors from other planets, 27% said they believe in bigfoot. 44% of those surveyed reported having a personal experience with the paranormal and 55% of those surveyed said they believe that a full moon can make people act strangely. what do you think of the pole and do you believe in spirits? >> shannon: i think there's a lot of stuff we can't explain, people want to believe there is something else. you and i are both very spiritual people, i believe there are such things as angels and demons in that kind of stuff. i believe in spiritual warfare, i don't want to get too deep here. i think they sense at the. >> i agree 100% with you and that's like when somebody is like it >> i think that's terrible, i can't speak specifically to virginia and what is going on there but i can tell you as a guy who's fighting in education what is being taught, what people send me, letters and things like that -- i don't care what the label is, i don't know what districts are teaching and which aren't but i do know it's toxic and to say that it's much ado about nothing is totally ludicrous. >> shannon: it's something that keeps coming up. interesting message from the former president, what you saw is president biden use the name trump 22 times speaking there in that speech. the former president putting out a statement saying we love trump in arlington, virginia, thank you, see you soon. people wonder is he going to show up there? the glenn youngkin campaign haven't asked him to come, we have no reaction from them. matt walsh has this tweet. trump indicating he's going to virginia, this will not be helpful, mcauliffe has wanted to make it about trump, glenn youngkin doesn't need trump's help. if he injects himself now it can only hurt. the former president is really good at trolling people, at teases, what do you think this is about? >> i can't wait to see president trump come i hope he comes out. let's have him, he's got trump national, he's got trump wind their way here have him here because i think this is not just a virginia election, this is a national election in terms of its implications. we are six days away, we'd seen some great early vote numbers from democrats, that's an encouraging sign. three and a half times the early boats as we saw back in 2017 but there are critical issues on this ballot and i would love to see glenn youngkin campaign with president trump. i don't know why his campaign isn't pushing to have him join him because he is very popular with republicans in certain parts of that state. he can do a great job in terms of galvanizing the vote. >> shannon: the left has made this so much about republicans who are running here and there are only a couple of big off year elections. they will continue to link republicans to president trump for the controversies of januarg how does that play for republicans and how do they walk that fine line between being supportive of president trump and the supporters who believe they wanted to run again and making that separation of january 6th and associated with that?
