growing questions, what will be life in afghanistan now that the taliban have taken over. welcome, everybody. i'm neil cavuto, this is "your world." what in the world to make of the latest warnings from the chairman of the joint chiefs of staff that afghanistan remains a powder keg and could disintegrate in a matter of months. at best, 18 months. let's get the read from the pentagon and jennifer griffin. jennifer? >> today's hearing was supposed to be about afghanistan. there were a lot of heated questions from republicans about general milley's decision to book to bob woodward. >> you spent more time with bob woodward on this book than analyzing the prospect that the taliban would fall? >> not even close. >> i was quoted in the book when 100% was conflated and not portrayed. >> democrats focused on how the withdrawal began with the agreement signed with the taliban by the trump administration going down from 13,000 u.s. troops despite the taliban complying with all but one aspect or only one aspect of the conditions based agreement. most importantly that the taliban never broke with al guide. general milley said he learned of the taliban agreement days before it was signed. general mckenzie said that he and general miller recommended keeping 2,500 american troops. >> what do you call a retreat of enemy forces? >> i don't know. i've never done one of those operations. >> you just did. >> i disagree. >> so you did not withdraw forces from afghanistan at a negotiation with the taliban? >> that is correct. we did not do that. >> so this would not be a conditional surrender? >> it would not be. >> one question, vicky hartzler from missouri said that the prisoner jailed at bagram air base until the taliban left and he was released. >> neil: thanks, jennifer griffin at the pentagon. the big question comes back to what did the president know, when did he know it and did he either forget or choose to ignore the warnings that he was getting from top military aides. we still don't know. it's foggier as the day goes on. jacqui heinrich has more from the white house. jacqui? >> for the second day in a row, the white house insisted that what the president told abc last month that none of his advisers recommended keeping 2,500 troops in afghanistan is not being contradicted by his own generals, testifying underneath on capitol hill. >> i don't think we need to dumb this down for people. it's an important issue. what we're talking about here is an initial recommendation in the short initial period of time of having a troop presence that would continue. >> the president answered that point blank question from abc with a point blank answer. >> your top military advisers warned you from withdrawing. they wanted to keep 2,500 troops. >> no. it was split. that wasn't true. >> the transcript of that interview did not indicate that there was any additional context that we were missing from that, even though that's what the white house appears to be claiming today. >> i think it's important to understand the context here, too. obviously we know more now than we knew several months ago. there was no credible option to keep 2,500 troops over the long-term. what is clear now is that it would have been much higher than that and they conveyed that today. >> since the top military brass made the statements, we have not had a chance to ask the president about that. he's focused on the spending bills. he's meeting with members of congress and potentially possibly going to a congressional baseball game tonight as a bit of a push to get that through. >> neil: jacqui, thanks for that. the defense secretary was not spared in this angry exchange either. take a look. >> did the president forget what was told to him or is he not being trustful? >> i view that as an inappropriate question. >> you may but the american people don't. they what accountability. >> neil: and to rebecca heinrich. the president was duly warned by more than just a couple of top military advisers that a draw down at this time to zero would be problematic. i don't think there's anyway to dance around that basic inconsistency from the white house. what do you think? >> these are painful facts that jen psaki cannot spin. she cannot circle back to get more information that would make sense or disentangle this for president biden. we learned today under oath that the generals charged with providing our best military advice advised the president to keep 2,500 troops in the country. president biden on that exact question by george stephanopoulos said that no one, no one had made that recommendation to him. so i mean, all the american people can do now is have -- we have two options before us. either president biden was lying to george stephanopoulos and to the american people about that point or he actually doesn't remember on something so important, which i think is a worse problem for the american people. it's so weird to be in a position where you're hoping that the president was lying. because that would be a worse situation than the alternative. >> neil: i'm wondering, too, so much came out of today's house hearing that didn't get nearly as much attention as the senate hearing. it was interesting to hear, you know, general milley talking about what is emerging as a very imploding afghanistan where you have isis k fighters and others competing to take down the taliban and just outright civil war for which we're little prepared to act because we don't have any troops there. any personnel there at all. what did you make of that? >> that's the most important concern that i have at this point. that we don't have this over the horizon capability that we hear about. we saw the first example of what an over the horizon capability would look like in a retaliatory drone strike after 13 of our service members were killed in which the united states did a drone strike that took out no jihadists responsible for the attack and instead took out innocence noncombatants including children. is that what we're supposed to look forward to? whose intelligence did we rely on? was at this time taliban? the other important that was important that came out, general mckenzie admitted that the taliban did in fact make the offer for the united states to be the ones that secured the u.s. military to secure kabul. that option was not something that general mckenzie could do because president biden told him he could have about 600 troops in country. these were political decisions that president biden made that put our military in an unwinnable situation that led to the disasters that were continuing to see unfold. this must mark the biden presidency. it's concerning about what other decisions he's making on security matters. >> neil: you know, rebecca, i found it curious that these top military officials are say we defer to the commander-in-chief. we understand that. we didn't think this was a good idea. we're still worried about the status of afghanistan and the region as we speak. that they wanted to get that all their chest. that was clear. regardless of how this might make the president feel. what did you make of that? >> that is definitely the sense that i have, that they were saying this is all different by political decisions. then general milley made this uncomfortable comment that he thought this was a logistical success. it was not a logistical success. the taliban are the ones that approved the flight manifests and put people on the planes that they wanted out of afghanistan. we didn't get all the sivs out and vulnerable christians and others out. we didn't get american citizens that wanted out. this is not a logistical success. this is a series of reckless political decisions made by president biden when he ignored the advice of his commanders and he needs to be held accountable. these military officers should be held accountable, too, for not pushing back hard enough or making big statements by resigning because they say i'm not going to put our troops and the american lives at risk by these foolish and politically hasty and reckless decisions of the commander-in-chief. >> neil: yeah. they said now they wouldn't resign. rebecca, thanks very much. meantime, the president was supposed to be in chicago today. he cancelled those plans to sort of stay in washington d.c. to hammer out some sort of agreement that can ensure a infrastructure vote tomorrow and cobble together some sort of agreement on the human infrastructure plan that so far democrats are fighting over. forget about republicans after this. ever notice how stiff clothes can feel rough on your skin? >> good afternoon. the presence of the speaker at the white house tells you a lot. the cancelled trip to chicago was a sign that things were getting serious about salvaging the 3.5 trillion social spending package. they can't go too low or democrats lose liberals. that's why the key what is in or out of the bill, that's what they have to figure out. >> i think if we come to a place where we have agreement in legislative language, because we're at the mercy of the senate and its customs and the parliamentarian and rules, we can't bring something to the floor without the approval of the parliamentarian. in order to preserve the 51 votes. >> being at the mercy of the senate means that you're at the mercy of two senators, krysten sinema and joe manchin. >> all you need to do is pass the bipartisan infrastructure bill, sit down and start negotiating. >> democrats could only muscle their bill through the senate if they have all 50 on board and vice president harris breaks the tie. there's nothing magic about doing this bill in the next couple days. it will likely take longer, maybe a few weeks. pelosi says the house will vote on the bipartisan infrastructure bill thursday. also there appears to be an agreement to avert a shut down friday. there will be a big vote tomorrow, neil. >> neil: progressives were not keen on that unless other issues were finalized or taken up in the senate. that now begins with the argument over the price tag means that won't happen. you have to rely on good faith. will they rely on good faith and let it happen and vote? >> it depends. we might see this play out the next couple hours as the president tries to twist some arms. jen psaki today was very cagey when asked whether or not the president would go to the congressional baseball game tonight at nats park. we saw this play in 2015. president obama was trying to get a trade frame work through the house and senate. he unexpectedly showed up at the congressional baseball game to try to whip the vote on both sides of the aisle and failed the next day, neil. >> neil: wow. i forgot about that. thanks, chad, in the middle of that. keeping track of that. phil wegman is here with real clear politics. let's assume the vote goes as scheduled. progressives would have to hold their nose a little bit. then what? what if they say we're not going to support this? >> well, then the jen psaki's construction is correct, they have been living in a television show during negotiations over spending this will look more like veep and less like the west wing. obviously the press secretary:joking through but gets to the tension of what is happening right now. the administration, they know the gravity of the situation because president biden desperately needs a win. he needs to bring both sides of the party to some sort of peace agreement. because with the mid-terms looming, this might be the president's last chance to do something big while democrats are still in control of congress. >> neil: now the question is how big, right? we don't know a number and we haven't heard it from krysten sinema and haven't heard it from joe manchin. 3.5 trillion was too big. the rumor is something in the 2.5 trillion range what are you hearing? >> well, we've been hearing a lot of griping from progressives all summer before, this senator bernie sanders was complaining that 3.5 trillion was not enough. he says he's compromised and he would have been happy with a figure around the six trillion neighborhood. that won't happen right now. the white house is in the middle of this fight where you have senator bernie sanders saying that he's compromised enough and if pelosi does decouple the infrastructure bill from the larger reconciliation bill that he will sink that money for roads and brings in the senate. the white house, they were asked today in the briefing room about aoc's threat to follow suit with sanders and votal the bipartisan package. the white house says they trust the process, trust the speaker. they have not been eager to get in the middle of a messy food fight. >> neil: we know that chuck schumer has seen at the white house besides nancy pelosi. so they're cobbling together something. if, for example, the vote on the infrastructure package is pulled tomorrow, all bets are off, right? let's ask andy mccarthy, former u.s. assistant attorney. what do you think? >> neil, you're right. when a company enforces it, it's going to get a lot of leeway because they have a right to run their business the way that they choose to run their business and to hire who they wish to hire. now, a lot of these arrangements, the private arrangements are freighted by business contracts and union contracts that have been negotiated. the big issue is likely to be -- is the action that united has taken in some way in breach of those agreements. if it's not, private companies like united will have a lot of leeway here. >> neil: so we've seen this pattern get more broad. certainly corporate america, responding the way it has, it's been an in your face type of a policy here. there's workers that claim on religious grounds or because of personal health issues, et cetera, that they have an out. i'm wondering if that cuts it in some of these black and white corporate policies? >> it will cut it less, neil, i think in private company arrangements than it would in government arrangements. so i think you and i talked some time back from the university of indiana where their mandates were upheld. they were found to be a government entity and their vaccination program or mandate was approved by the court with the caveat that they had these religious exemptions and health exemptions for those that could show the vaccination was potentially a health problem for them. those are, you know, constitutional concerns that apply to government entities. they are not generally part of a private employment arrangement. there you're going to have to look much more carefully at the four corners of whatever contracts are involved. >> neil: thanks, andy. we'll see what happens. a lot of companies are enforcing it. the latest, harvard business school, which has already suspended most in-person nba classes after a covid outbreak. it's not an order but just in light of the cases that the better part of valor was to cease in-person classes. meantime, guess who is back in court? >> neil, the movement is called "free britney". inside of this los angeles courthouse, britney spears could be freed from the conservatorship underneath her father. there's dozens of britney fans outside. there's a street here that is blocked off. moments ago we talked to her friends about free britney. >> that means the end of abuse of the probate court system and liberating a pop star. >> the free britney army has been freed. i'm tired of hearing the word allegedly because it's true. >> a judge is expected to make rulings on petitions all filed since britney made headlines this summer for the first time when she talked about the dew he mannizing and embarrassing conservatorship. britney and her father have agreed to end the conservatorship as it stands. the drama is not over yesterday. her team has recommending an accountant replace her father. people close to britney allege that jamie spears was so controlling that he would take away britney's cell phone and secretly record her. a spokesperson for jamie spears tells fox news that all of his actions were well within the parameters of the court. his knowledge was done with the consent of britney or the court. jamie's record as a conservator speaks for himself. the meeting was supposed to begin five minutes ago. we have a producer inside. we'll have more on what could be a critical dee in the free britney movement. >> mark eiglarsh joins us. the father said i don't want this. if you don't want it, let's rip it up. so where did that go? one thing to get rid of him but still be i guess some sort of a professional conservator to help this process along? does she need that? would she protest that? >> let's break it down. there's people saying free britney, free britney. to their dismay, i have the following to tell them. the only thing we know for sure that will not happen today is this will not be over. because like fillet mignon at mcdonald's, it's not on the menu. the only thing they're discussing is whether the father should be out on not. they're not discussing the conservatorship. it will eventually but not today. >> let's say he's out. i don't know what will come of this hearing. but the possibility that someone could be overseeing her financial life is very much nor the time being in the cards. >> yes. there will be someone who will replace spears father temporarily a guy by the name of zabel. interest that interesting in the father accused of doing so many things that are so nefarious that something has to be legitimate. he says i'm out but that guy is not qualified. who are you to say who is qualified? you're out. she wants you out. you're saying you want out, step aside and let her team put in temporarily who will carry out what you allegedly did but in her best interests. >> neil: if she's had 13 or 14 years of dealing with this and says i can do this myself and i don't know what she ultimately wants, but does someone at this stage in her career and her life and maturity, the changes, warrant no oversight at all? >> the answer is yes. when you think of conservatorship, i don't think that many lawyers anywhere could point to someone that has a job and has this over them. we're talking about people in a coma, people that have had massive strokes. extraordinary mental disabilities. not for a pop star that can be form. it's being off, not 100% was the standard, most of hollywood would be under a conservatorship. >> very good point, mark. i know what you are thinking. neil, the government is on the brink of shutting down. we're hitting a debt ceiling and you want to focus on free britney? >> good afternoon, neil. i'm in the middle of a river floating illegally on a raft between guatemala to my right and mexico to my left. there's international bridges in the distance where you legally cross. but much more preferred to just do it this way. if you look upriver, our camera man will point. you can see people going across all day long, day in, day out. the local officials say 800 haitians alone are legally crossing here. everyone of those 15,000 haitians you saw under the bridge in del rio last week came through this crossing, this comes as we're learning and confirming with mexican officials that 15,000 are down in south america headed this way. meanwhile, in the city beyond the mexican banks here, there's a 13,000 haitians applying for refugee status. an activist that helped organize the caravans of 2019 are down here slamming the biden administration saying they're no different than the trump administration. take a listen. >> tell me a single difference in the biden administration and trump? the only thing that trump talked tough. you know, really nasty about people or migrants. but he didn't deport as many. he wasn't as harsh and cruel as it is biden. >> as you look at the boats one last time coming and going, on the mexican side, the mexican bank, there's no immigration informations enforcing customs or registering who is coming and going. we've seen some national guards around for security but not much. no one is having trouble coming and going as they please. neil? >> neil: so mexico is doing nothing to thwart this. >> that's right. there's no border enforcement stopping people from coming and going as they will. of course, the significance is the haitians at this moment. the crossings still include folks as far as africa, as well as those from central american countries, the northern triangle, which has been the problem ever since. we get near the border here, we're going to stay in the river and stay on the mexican side. as you can see, nobody is bothering us from doing this all day long. neil? >> well, i gave it a little more thought this time than i have in the past. family are important. my kids are important. wife is important. but i heard so much from the people of iowa at the state fair, my county meetings. i go to each one of the 99 counties every year for a q&a with my constituents. at the football games, tail getting, et cetera, i heard from iowans that we need your common sense in washington. washington is an island surrounded by reality. i'm glad to bring the common sense of the midwest back to washington d.c. >> neil: you heard it from your opponents when you were a younger man at 82, 76. say think guy is too old. you seem to come back every time. the campaign against you is going in that direction. what do you say to your doubters that say do over? >> i heard the same thing in 2016 when i was 81 or 2. here i am. i'm saying to them, i heard that same thing six years ago and here i am. i'm ready to go. i get to the office at 6:00 a.m. this morning i got there at four minutes to 6:00. we leave at 6:30. i go to bed at 9:00, get up at 4:00. go two miles. this morning i only went 1 1/2 miles because i got a booster shot yesterday and i don't feel quite up to it. anyway, that's my life. i'm very vigorous. i can handle the job. besides, there's a lot of good bills that still have to be paid. i want to get down prescription drugs, control the border, i want to do something about fair prices for cattle in iowa for the farmers, things like that. >> i cannot keep up. that's not a badge of art, centered. leaving that aside, when you first -- we did not have a debt like this. i think it might've been 3000000000000-$5 trillion. now we are on the brink again of a possible shutdown again. what do you think of that? >> in the first year of the reagan administration, the first time i voted to increase the debt limit, it was the first time it was $1 trillion. we should've started back there to do that. i almost forgot your question. could you restate it? >> are you worried about it, your time here under a republican, democratic president and congress, the debt is going to explode again. nothing, no one is doing anything about it. >> we were republicans in the united states are doing something about it. we are following the democratic former secretary of treasury, larry summers in january, then again in april. he said "you are spending too much money, gasoline on the fires of inflation." we agree with that. you know how high inflation is. this additional money is just going to get us back to the 1970s on inflation. that's why we are concerned by not backing this $6 trillion this administration wants to add to the national debt and things of that nature. >> tomorrow, they want to vote on this infrastructure package. would you vote for that? this is the issue now for the house. would you vote for that? >> let's put it this way: they are talking about adding things other than a continued resolution for the government to keep going. i don't want to shut down the government. what's the extra stuff they're putting in? one thing we are certain, where we won the case on monday where we let them put in the debt limit into the continued resolution, and the reason we did not do that is all of this spending is democrat spending. they don't even have republicans at the table to negotiate with them. they want to go this direction. republicans have taken care of the debt limit from last year through what that was accumulated in the trump administration. we do not want this outrageous, irresponsible spending that is in this bill. that is how we are helping the issue you have. maybe -- they say there's 5-6 other democrats that don't want to talk about it, that may be glad that those two are leaving this drive on the part of the democrats to spend $6 trillion. it seems to me that they ought to be applauded for the acts, and maybe they will get the job done. >> do you think the government is going to shut down? >> no. it costs money to shut the government down, to open the government up. why would you do that? >> it has happened before, senator. >> yes.
