According to a source familiar with the situation, the qataris set up a Safety Corridor for these individuals to get to afghanistans biggest airport, the Hamed Karzai International Airport and got on the flight and fly here to doha. Now the individuals are here, theyre going to take Corona Tests and get food. Once processed, theyre free to return to their home countries. The citizens are americans, germans, british and ukrainians. Also today according to the Wall Street Journal, americans stuck in northern afghanistan were told to come to the airport for this flight. But its unclear how many were able to make the journey. Thats why we may see future flights like the one earlier today. Eight flights are conning with the Uae And Pakistan delivering aid to the country. Over half of afghanistan relying on international aid to survive. This is after protests erupted in kabul. Disturbing images and reports out of afghanistan of journalists and women being beat by taliban fighters. We talked about this earlier in the week. Announcing lawsuit seeking to block enforcement of the texas abortion ban. Lets listen. Thus far, the law has had its intented effect. Abortion providers have ceased providing services, this leaves women in texas unable to exercise their constitutional rights an unable to obtain Judicial Review at the very myment that they need it. This kind of scheme to nullify the Constitution Of The United States, is one that all americans, whatever their politics or party should fear. If it prevails, may be a model of action in other areas by other states and with respect to other constitutional rights and precedence. Nor need to think the damage that would be done to our society if states were allowed to implement any private individual to infringe on anothers constitutionally protected rights in this way. The united states has the authority and the responsibility to ensure that no state can deprive individuals of their constitutional rights through a legislative scheme specifically designed to prevent the vindication of those rights. The united states brings the suit to assert other interests that sb8 unconstitutionally impairs. Among other things, it conflicts with federal law by prohibiting federal agencies from exercises their authorities and carrying out their responsibilities under federal laws relating to abortion services. It subjects federal employees and not governmental partners to implement those laws for civil liabilities and penalties. Those that the statute restricts are the Labor Department Job corps program. The defense departments tricare health program, the bureau of prisons, the centers for Medicare And Medicaid services and the office of personnel management. The complaint seeks a Declaratory Judgment that sb8 is invalid under the Supremacy Clause and the 14th amendment, Preempted By Federal Law and violates the doctrine of intergovernmental immunity. The united states also seeks a permanent and preliminary injunction prohibiting the enforcement of the statute against the state of texas, including the officers, employees and agents and private parties that they have deputized that would bring suit under sb8. The department of justice has a duty to defend the Constitution Of The United States and to uphold the rule of law. Today we fulfill that duty by filing the lawsuit i have just described. Before i take questions, i want to say some words to the american people on the eve of the anniversary of the attacks of September 11th, 2001. That day is seared into all of our memories. Nothing we can do or say can replace the loss so many endured that day. Nothing can change the profound way the events of September 11th altered us individually and collectively as a nation. Let there be No Doubt the threat from terrorists, from foreign terrorists, like those involved in the September 11th attack is one that we must constantly guard against what we can do and what we have done is learn from the past to better anticipate and prepare for the next threat and to seek to disrupt it. As we mark this anniversary, we rededicate ourselves at the Justice Department to doing all we can to protect the american people from terrorism in all its forms, whether originating from aboard or at home. In doing so in a manner that is consistent with our values and the rule of law. With that, im happy to take questions. Attorney general garland, is therere a provision in the Texa Law that you find especially concern something. I think i described all of the provisions that i find especially concerning about the complaint does that in more detail. I wouldnt pick any one. Theres been several gop lawmakers that said that they will follow texas lead. I was wondering if you expect doj to be involved in similar actions against other states. Would it be to say that this could be one of several similar actions . As i said in my remarks, the greatest risk here, the additional and further risk here is that other states will follow similar models with respect not only to this constitutional right but theoretically against any constitutional right and in any other state. So if another state uses the same kind of provisions to deprive its citizens of their constitutional rights and in particular to deprive their citizens of the ability to seek immediate review, we will bring the same kind of lawsuit. Theres been some pressure it seems from democratic lawmakers on The Hill and antiabortion groups and some could argue from the White House on the department of justice to do something about this Texas Law. Did you feel that pressure . Did they play any role in this . The department of justice does not file a lawsuit based on pressure. We evaluated the law and the facts and this expresses our view. The attorney general, Merrick Garland taking questions there and laying out the suit that the department of justice is bringing against texas for the bill known as sb8 which limits abortion to prior to the period when a heartbeat is detected. Lets bring in jonathan turley, constitutional attorney. Hes been watching this along with us. Great to have you to respond to this. Essentially this bill means a Woman Cant Exercise her constitutional right. We Cant Stand by for anything that undermines the constitution and also detouched on the empowerment of private individuals in this case to bring suits against individuals that are receiving abortions or involved in abortions. He said you cannot empower private individuals to impinge on the constitutional rights of others. How does this case look to you the way its been laid out . Well, its hard to unpack all of this. Theres aspects of this that are quite breathtaking. Among other things, he challenges the use of private attorney generals as a type of Citizen Lawsuit involved in the texas abortion law. That is a common provision. Its used throughout federal law to allow citizens to enforce aspects of federal law. I brought a number of those lawsuits. So its it will be rather hard to see how you can challenge that as a concept. What really needs to be challenge is the base violation. What hes really objecting to is the previability of the Texas Law that sets it at roughly six weeks or eight weeks, depending who you ask. A Georgia Law was just struck down last year. Most of us expect that the lower courts will strike down this law. Its already being challenged in the federal courts. What is really odd about this is that the department of justice is entering as a party. Usually the department of justice is a friend of the court. Here theyre saying were a party of interest. Any time a State Law threatens constitutional rights, we have skin in the game. This is not how the department of justice has operated in the past. Some courts are going to ask about that. For example, garland said were going to say that this field is partially or wholly preempted. The Supreme Court has always recognized that states have a right to legislate in the area of abortion. The question is where to draw the line, this is a major assertion of federal authority and unprecedented one. The problem with that is he may have just created a new point of challenge for pro life litigants. He could have made the situation worse with this filing. Hes added robust Federalism Issue that is quite novel and a lot of courts are likely to be uncomfortable with this in this degree of federal authority. Martha very interesting. I have to go but one quick question. The interpretation is the statute was written in a novel way that made it sort of understandable that the Supreme Court would uphold it. Can you explain that to Everybody Briefly . Im sorry. You broke up slightly. Martha so there was sort of a novel writing of this bill and that because it was sort of clever was the word was used, the way it was written, you can understand how the Supreme Court would uphold it. Thats right. A lot of people said, including a member of congress, the court had just overturned roe and upheld the Texas Law. This proves it. If the Supreme Court upheld the Texas Law, they wouldnt be challenging it right now. What the court said, you pick two people at random, a State Judge and a clerk. They dont have any Enforcement Role here. Theyre not named in the law. What the court said is you cant ask us to enjoin two people at random as a way of enjoining the law. That was the basis. Some of this we heard them say that theyre dealing with the taliban in a moderate wait. They said we recognize the taliban. Thats a long way off was the term that was used. Is this just to get people out . Is all of this nice talk and to play along so that we can get these people out and then the tone will change . Well, if that were the case, martha, you wouldnt have to say some of the praising things the separation has said. You have to refrain from the criticism that the taliban so justly deserves. What troubles me more than what theyre saying is what theyre potentially doing behind closed doors. Things like holding out the off of Diplomatic Recognition or unfreezing billions of dollars in assets that the former afghan government had around or other financial inducements the united states had or financial institutions could offer. Well be probing those very questions. Martha what would be the line of question youd take with General Milley and general austin before i let you go . So with the secretary and the chairman, id like to know what were their recommendations and when did they make those recommendations to the president and how did he react. Lets take a simple case that is a very easy question to answer. Why was bagram closed, what did our military recommend and what did the president do . I looked back up and i saw a gash in the side of the world Trade Center. Martha unbelievable. Dan henninger, Wall Street Journal editor. Good to have you with us today. Good to be with you. Martha your colleagues say that you were able to write about what you saw the next morning. Yes. We hardly knew what to do with ourselves if we were there at the time. But everyone had to figure out some way to get through the day. Martha, we are were and are journalists. The Wall Street Journal found a way to publish the newspaper. Everyone that could went down to our offices in princeston, new jersey. Our technicians wired up about 100 computers in hours, connected it to the Publishing Network and writers that were distributed all over new york city, some in brooklyn, some on the upper west side. Im in my Colleagues Apartment on the lower east side. I just sat down and wrote a firsthand account of what i had seen. All the others at the journal were doing the same thing and we delivered a newspaper to our readers the next day. In hindsight, it was something of a miracle. Because the whole day seems like a horror in retrospect. Martha and you won a Pulitzer Price for the covering of what happened that day. Im sure you remember a day that weve been working on, remembering on our team here at the story. I want to play a piece of what happened when President Bush went to Ground Zero. Watch this. The crushed Fire Truck and fading Bull Horn would be the president s makeshift president. I said they want to hear from the president. I asked the president , would you be willing to say something . He said do you think its appropriate . I say if you think its appropriate, its appropriate. Just be you. Be yourself. He said okay. I went, took a Secret Service agent. Can the president stand on this thing . The lead secret Service Guy is going nuts. Hes like were not doing this. Hes making sure the president doesnt get visible. He doesnt want him highlighted up there. Not know we he had been asked to stand the strength of the truck, he stayed put. I didnt know who Karl Rove is. He said something is coming over here. When they come over, you help them up and get down. I said okay. Beck worth wasnting attention. I saw the president coming around. He comes in front of me. He puts his arm up. Oh, my god. I pulled him up. I turned him around. I said are you okay, mr. President . He said yeah. He said where are you going . He say i was told to get down. He said you stay right here. When you felt him pull his arm and you, said no, youre going to stay up here with me while i talk, what did you think . I looked up at the sky. I said look at me, ma, im with the president. Martha so many thought go through when i think about that day. I want people to understand, the country had been attacked in three different places. They had the president walking through the crowd. Everybody felt there was another attack coming and could be anywhere at any time, right . Absolutely. We all felt that way. The scale of these events were outside human understanding, the death, the two in the trade towers, one in the pentagon. What George Bush did then is what the country needs at a time like that, which is leadership. He stepped in and did what you expect from the president of the united states. He did it in a comfortable and secure way. He seemed secure, which had to be overwhelmingly difficult, standing down there at Ground Zero amid the rubble, the death, the odor. Many of us down there that day didnt return for weeks and months. President bush did what the nation needed at that moment, was to come and reassure that we would be protected and that the government would do what was needed. It was a very, very important thing that he did three days after the event. It sure was. The scars from the people down there continue. The things that they say what they worked there. Very hard for everybody on this 20th anniversary. Look at this poll. Abc poll. Nearly 46 say the events of 911 changed the country for the worse. After 911, there was a feeling in the following years that it had strengthened the country as well as the tragedy. Why do you think that number is so different now, dan . Well, you know, i looked back on this with a lot of sadness. There was such tremendous solidarity in the time after 911. The country really came together in a beautiful way. We forget that just a year before that, you had the contested 2000 election between President Bush, then george w. Bush and al gore. It was a bitter political fight. In seven years after that, the george w. Bush presidency was attacked relentlessly and the political divisions of that time had widened even to our day and that is what people recognize and so disheartens them.
