The Covid Czar for the White House here says that theyre also considering international guests coming in to the united states. All of them would have to be vaccinated, Show Proof of vaccination to get in to the united states. Fox news is reporting the Defense Secretary will order 1. 3 million Military Members to get vaccinated. If you also have the governor of New York, the mayor of New York, Bill De Blasio mandating that people Show Proof of vaccination to dine out or go to a show. Some republican senators are concerned about this overreach. Selfgoverned people are very capable. When you bully or harassing people, thats very counter productive. Let people consult their doctors, make their own decision for them and their family. Now you have a number of private companies saying that they need their employees vaccinated. The airlines on the latest on the list. Delta saying all new employees need to be vaccinated. The mandating of vaccines, whether its the federal government or private industry . Well, i draw a distinction. I think private industry has the right to do that. Its within their realm. Its reasonable in many cases. The federal government is another issue all together. Theyve gone from making it an option to really trying to provide incentives. Its now just plain coercion. This is a reflection of a lack of leadership, poor messaging, not getting an Fda Commissioner or approval, this is a horrible policy and will backfire. You talked about the fda. This study is interesting to me from kizer. Shows that 31 of people would get a vaccine if it had full fda approval. My question to you is, if we are in a national emergency and pandemic, what is the holdup . Why is the fda waiting . So it takes some time to review. Lets look. Pfizer has been on their desk since may. Three months there. Theres 18,000 employees at the fda. Every one of them, this should be the number 1 priority. For the american people, theres no new data coming in. All the data are there. Its a process of being reviewed. The fda needs to get this done. I was on the governors commission. What were seeing is a dramatic rise in the number of cases throughout the state. So every county now is seeing a substantial level of transmission. The cause of that this is something that could help prevent the illness in children and among staff that either havent been able to get vaccinated or vaccinated and may have immune problems so that theyre not fully protected. I dont understand. Black on black killing each other. For what reason . The third Mass Shooting that night got the most attention because it happened in the affluent Lincoln Park neighborhood. This is one of those things that you have to decide how compelling it is and if the sheriff decides its compelling, he said we will arrest the governor and then its up to the d. A. To file charges. What do you expect . Thats right. There will be an independent investigation done by the sheriff or the prosecutor or both. Theres certainly going to be an independent investigation. How compelling and how specific are allegations where in youre right, trace. There was definitely you could see she was nervous, telling The Story of course shes nervous. Shes a young woman taking on a powerful, political man that was her boss for a number of years. Here we are with the allegations. Now, its really bold. I understand well have to see what happens with the attorneys that come forward. It should be focused on the Due Process that Governor Cuomo will have undoubtedly. If were going down this Criminal Path and what he could be facing or Sex Abuse charges. Its significant because Theres Jail time attached to the charges if hes found guilty of them. At The End of the day, whatever we hear from the attorneys, which would presumably be in the next few minutes, they would have to focus deeply on the process that Governor Cuomo will have and not these Build Pronouncements that parentally they made that this was is some sort of Witch Hunt, theyre false. This investigation, extremely thorough, 168 page report, 74,000 pieces of evidence. Im not sure how any Defense Attorney can stand there and boldly say this is all wrong. This is all false. He did nothing wrong. Its Adieu Process. He will have Due Process at the appropriate time. Trace tell me if im wrong, youll have cuomos attorneys coming in, Paul Fishman and Rita Glavine. Im guessing their strategy is walk in and rebut everything. You say its a bunch of bogus stuff. I wonder if that is a stretch. Theres a Due Process. Whatever it is. To really look and attack what the process this is a 5 1 2 month long investigation done by two very wellrespected attorneys, one of which i litigated against. I have respect for Ann Clark. She wont risk or do anything inappropriate. Both of these independent investigators left no stone unturned. These Defense Attorneys can stale It Back and still defend Governor Cuomo. Trace were at 3 31 on the east coast. The News Conference was supposed to start a little bit ago. Were waiting for that. The governor here with this News Conference today is making it clear, hes going to fight the state legislature. Theyre talking about impeachment. So his idea is you want to fight . You have to fight. It starts today. Your thoughts. Andrew cuomo is a fighter. I knew his father, mario, before that. Ive had a good relationship with andrew, as good as anybody can have. Im against impeachment. I voted against Bill Clinton and donald trump. Even though cuomo has a right to defend himself, cross examine the witnesses, find evidence, i dont think its going to have an impact. Every democrat i spoke to, hes called for Andrew Cuomo to resign. Im taken to senators and the republicans are against him to begin with and virtually every democrat. I dont know what hes hoping to do by prolonging this. Impeachment is a dangerous thing. Youre removing a duly elected official. If hes incapable of governoring, i dont know why he will stay on unless its part of a Negotiating Process that would involve him resigning and the criminal matters being resolved at the same time. The impeachment is primarily a political issue. Its whether or not people think he can govern. Its separate. Its very specific. It will be subject to cross examination, Grand Jury testimony and the rest. Trace you make a good point, congressman. Hes given his own defense. He did it a couple days ago with the pretaped, heavily produced rebut until which he discredited his accusers. I want this Sound Bite. Got at lot of push back. He has to find a way to rebut them, Show Weaknesses or inconsistencies. Thats one thing. As far as the state assembly, the state senate, yes, he has to show them that hes capable of governing. Rather than just drag this out, i can tell you, republicans politically are hoping he stays on. This will be a trial for the next three or four months and hurt democrats and help republicans. For the good of the state, it wouldnt serve any purpose at all. Trace this is Andrew Cuomo discrediting the 11 accusers. Watch this. For those using this moment to score political points or seek personal gain, i say they discredit the legitimate Sexual Harassment victims that the law was designed to protect. Trace when you say these 11 women are flatout lying, its a bold statement. Yeah, he went Out On A Limb there. He should be very specific when it comes to it as far as if he can show specific inconsiststsys. If his lawyers can show something through cross examination, thats something. But to make that bold statement up front, its counter productive to him. He has to find a better way to do it. Again, this is all almost tedious against the overall fact that almost every Assemblyman And Senator wants him to leave office. The criminal trial is one thing. As far as the impeachment and any trial or resignation, i dont those arguments will help him at all. Trace im going to bring in Leo Terrell. This is what were looking at at the Press Conference. It says Stand By for a live announcement by Governor Andrew m. Cuomo. Bryan llenas said we do not anticipate hearing from the governor. We anticipate hearing from his three attorneys but the statement says by Governor Cuomo. We are waiting for that. Six minutes late there. Leo, seems like Theres Something else at play here. Theyre going to give 2,000 pages to the state assembly. Are they trying to slow down the process . Is this part of the Defense Mechanism for the governor, to maybe slow the process down and maybe people lose interest after a while . Your thoughts. Absolutely, trace. You can look at this in a vacuum. Theres a criminal component, a administrative component and a political component and criminal component. Bill honest with you, these attorneys for cuomo are saying give us a chance to cross examine all of these witnesses, what they didnt get a chance. The End Game is to slow the clock down. Theyre going to give the state overwhelming witnesses and evidence. Investigate these people. Talk to these people. Because we have a right to Due Process. Theres Adieu Process in the political concept and trace, the Bottom Line is to slow the clock down completely where people forget this. One last month. The audio is back on. We have Rita Glavin and mrs. Hermozi represents New York. In connection with the attorney Generals Investigation of the allegations of Sexual Harassment. Were here to talk about that investigation. So let me start first by explaining the idea of mrs. Hermozi and i representing the executive chamber. Those of you that Cover Albany and the governors office, its a fancy and old fashioned way saying the governors office. We dont represent the governor. Mrs. Glavin and her colleagues do. In march, the governor referred to the Attorney General of New York a request that she select an independent Law Firm to investigate allegations of Sexual Harassment and the surrounding circumstances. About a week or ten days later, mrs. Hermozi and i and our Law Forms were engaged to represent the executive chamber. Our role was simple. Our first goal was to make sure that the investigators got all of the information, all of the documents, whether they were Hard Copy and electronic that they were entitled to. As you might imagine, that involved a massive production over the course of the next three or four months. An enormous numbers of Hard Copy and electronic documents. The second part of our task is to represent Chamber Employees if they didnt choose other counsel that wanted us to accompany them to the interviews that were requested by the investigators. Sure that the chamber and its employees were treated fairly. The last of those things that i want to address briefly. As you know, the Special Deputies on behalf of the Attorney General issued 165page Report tuesday. This is not like a ordinary civil or criminal proceeding. Their record will not be followed by a civil hearing or a criminal or a trial to determine the accuracy of their conclusions, how they got there or to weigh the evidence. For the people in the chamber, this is The End of the line. This is what the Attorney General and the investigators meant to have as the first and last word. We asked the Attorney Generals office about the conduct that is criticized. We asked them to provide a Draft Copy of those reports to the people whose conduct was implicated by the findings. We asked them to do that. We had concerns as people in any certain like this that there might be things that are inaccurate, things that were excluded from the report that might be fire. We want to make sure the people that are discussed had an opportunity to respond before the report was issued. The Attorney Generals office, the secretaries, the governor, who were discussed in that report got that report at exactly the same time as those of you in The Press did and you the members of the public did. That was problematic. Their opportunity to challenge, to rebut, to raise questions did not occur until after the report was public and in todays media world, whether its 24 7, all of those allegations were out and being reported while people were first flipping over the pages. Our request was not unusual. Turns out, its a common Place Occurrence in these kinds of investigations. State of the art really for investigators to provide that sort of information ahead of time to people being investigated. The department of justice, the office of the Inspector General does it, the gao does it. Most if not all Inspectors General in washington do it and they do it because they want to make sure theyre fair to the people being investigated but want it for themselves and the public to make sure the report is accurate. That did not happen. As a result, its taken some tiMe And Youll hear from mrs. Glavin in a little bit about things that relate to the governor. Its taken some time to sort through the report and see what is actually not correct. So ill give you one example today, which is one that got some Press Yesterday and the days before. Its the one really in which the special investigators take issue in particular with the activities of the chamber as a whole. Thats with respect to the allegations that were raised by mrs. Boylan last december and when she started tweeting about the governor as a sexual harasser. As the report makes clear, the governors office, the chamber, did two things. One, released some records that related to the circumstances of mrs. Boylans departure from the chamber. The second is to consider and decide not to publish either an Oped Or Letter regarding mrs. Boylan or about the governor. The reason that is important is we had a very strong sense from the questioning of various witnesses. We represented 20 some odd employees ourselves between Hermozis Firm and mine. They were investigating whether that conduct was effectively illegal retaliation against mrs. Boylan and we wrote a 13page letter, almost a brief actually, to the Attorney Generals office explaining why that conduct did not meet the legal definition of retaliation. I understand the Attorney Generals office reached a different conclusion and theyre free to do that. Thats what happens when lawyers go head to head and talk about the legal analysis surrounding a particular circumstance. What disturbed us about the report is that that letter got a, mischaracterized and give the back of its hand in a foot note. What matters is, theres a very serious legal issue about whether the Attorney Generals office is correct or not. And that serious legal issue should have gotten more consideration in a report that reaches a conclusion against ill legality. Thats one example. The second thing i want to talk about in terms of fairness is in terms of the transcript. Many witnesses testified, many of them were Chamber Employees. Many were interviewed without court reporters, many of them were interviewed with court reporters. Its now 76 hours since the Attorney Generals Press Conference. Not one of those witnesses and not one of their lawyers has a copy of the transcript as we understand it of their own clients interview. Nobody. The assembly seems to be getting them. District attorneys are getting them. The witnesses that still want to look and see whether their testimony was recorded accurately whether the question was right or wrong, and the public does not yet have a copy to see. Thats a particular problem nor the people whose conduct was being questioned. Its also a particular problem for the governor and the chamber as we respond to that report. As you can imagine, as lawyers, what we like to do, what we need to do, what were entitled to do on behalf of our clients is to see the evidence so we can properly respond. Right now we cant. My one ask its too late to fix getting the report before it comes out. Its not too late to get the transcripts. So whether its the Attorney Generals office or the assembly who has the power and the authority to release the transcripts to the lawyers and the witnesses that testified and to mrs. Glavin so she can repair her response, thats the last thing to think about. Whether its now time for those transcripts to be turned over so the lawyers representing their clients can finally respond on behalf of their clients as you, The Press, you the public and people want to hear. So now mrs. Glavin, i turn it over to you. I believe youre on mute. Sorry about that. Good afternoon, everybody. My name is Rita Glavin. I represent Governor Cuomo. Im a former federal prosecutor. I know the difference between putting together a case against a target versus doing independent factfinding with an open mind. There has been no open minded factfinding here. In this investigation. This investigation was conducted in a manner to support a predetermined narrative. Trace Rita Glavin is apparently frozen. Well bring her back on when she starts speaking. She says she knows the difference between putting together a case and doing openminded Fact Finding. There was no openminded Fact Finding. What do you think so far . She should have done her homework. If she knew Ann Clark like i know and litigated against her for decades, she would know this is a standup principaled extraordinary lawyer that went do anything inappropriate. Its offensive. She should have done her homework. I dont know the other investigator. I can only assume that hes equally principaled and an upstanding lawyer. They were tasked with doing an investigation. How this individual that can boldly say this was just a targeted Witch Hunt, which she didnt use the words Witch Hunt but thats what she saying. Its outrageous when you look at the magnitude of this investigation. You cant ignore 179 witnesses and 74,000 pieces of evidence. You have to stand back and not be so bold and make pronouncements that dont help your client. Theres a Due Process in place. Thank goodness that Governor Cuomo didnt. When i saw it flash across the screen that he was going to participate himself, the Press Conference he had or The Presser a couple days ago was a train wreck. Saying what he said, im in my 60s doesnt help him. Saying hes italian and grabby doesnt help him. Saying he kissed and hugged and squeezed people from as all of these individuals doesnt help him. But this does not help him either. One other thing i do want to say, trace. There is already from the very moment that the attorney from our reporter spoke, you know that the state of New York is distancing themselves from the governor. They would not have an individual lawyer for Governor Cuomo if they didnt suspect that their interests were aligned. It happens all the time. You can represent the company but not the individual. Trace Stand By, if you will. Lets bring in Leo Terrell. Paul fishman said that this whole process was not fair. What happened is the Attorney General, the state of New York mischaracterized the atmosphere and the behavior of the governor and his staff what is the goal here . Yeah, ill tell you right now and ill disagree with mercedes. Believe it or not, they put up a good defense on tissue of Due Process. There was no way the state Attorney General could withhold the information or give them a chance to rebut. If that attorney is telling them that he got the information at the same time that is bad. More importantly, witnesses that gave statements. These attorneys should have the right to read the transcript. I know as an attorney, i can frame a transcript and take excerpts from a transcript that looked favorable for my client. Let me be clear. The Attorney General the governor needs his own personal representative because the office of the attorney that made the reference, he represents 20 other victims. Theres a conflict. I still think cuomo is a monitor. I believe in Due Process. If that information was withheld, was wrong, the state lawmakers a lot of lawyers in that state assembly. They understand Due Process and a chance to do a rebuttal. Trace listen, former new York Congressman Peter King is with us. Im going to get to him in a second. Mercedes, back to you. Leo says they were entitled to see this Report And Withholding it the wrong. Let me know if rita continues speaking. Well go back to her. I dont know of any specific Process Or Procedure that they would be required trace i apologize. Let me jump in here. Rita glavin is jumping in again. Im a former federal prosecutor. The investigation was conducted to support a predetermined narrative. Our legal system, both sides are heard. Given access to the evidence. Here, instead of acting as independent factfinders, the investigators acted as prosecutors, judge and jury. On tuesday, the Attorney General and the investigators called a Press Conference. Within minutes of that very carefully choreographed Press Conference, there were calls for the governor to step down. We werent given, as mr. Fishman told you, any advanced notice about when the report would be released, its findings, a chance to respond to errors, inaccuracies. That was intentional. This was not an exercise in truth finding. Let me tell you that on just our review of the report again, as mr. Fishman informed you, we do not have the underlying evidence. Its not been provided to us from that report. We have not had a chance to examine the transcripts or even memos of interview of the 179 people that the Attorney General interviewed. What i do know based on the limited Information Weve been given access to, there are contrary facts and omissions from that report. You have to ask yourselves why. Im going to give you three examples. The first relates to executive Assistant Number 1. What she has alleged is perhaps the most significant allegation made against the governor. She has said that during the workday, the governor groped her breasts in his office. In essence, shes accused the governor of sexual assault. The governor has repeatedly denied that ever took place quite frankly, when she first raised this in early march, he was stunned. This Executive Assistant gave an anonymous interview to the albany times union. I encourage you to read what she told the times union about that day. She told them that she was asked to come to the mansion, if its a technical issue with the Governors Iphone or with his phone. As fact that she was summoned to the mansion. She tells the times union that she walked into she arrived, walked into the governors second Floor Office where he slammed the door, groped her breasts under her shirt and over her bra and she left without saying a word because she was upset. The governor was interviewed on july 17. During that interview he was told for the first time when this alleged incident took place. November 16 of 2020. After that interview, i did, as the governors lawyer, what i would have expected, that the investigators had already done. I did what any investigator would do. I reconstructed the events of that day. Me and my team went through the emails for that day. All the Entrance And Exit records. This womans story stated as fact in the report is false. The Documentary Evidence does not support what she said. What is disturbing to me is that the two investigators did not show that evidence to you. They ignored it. Ask them why.
